<legis-type>A BILL</legis-type> 
<official-title>To amend the Child Nutrition Act of 1966 to improve the nutrition and health of schoolchildren by updating the definition of <quote>food of minimal nutritional value</quote> to conform to current nutrition science and to protect the Federal investment in the national school lunch and breakfast programs.</official-title>

<section id="H80F5AE2764164094B4B23D51B077FB00" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Nutrition Promotion and School Lunch Protection Act of 2006</short-title></quote>.</text></section>
<section id="HED374B7DE7E943A4B9CCDD4326C8BE85"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H09E81467FF534F67ADC6701F9700ED75"><enum>(1)</enum><text>for a school food service program to receive Federal reimbursements under the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) or the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>), school meals served by that program must meet science-based nutritional standards established by Congress and the Secretary of Agriculture;</text></paragraph>
<paragraph id="HF8B50E9900524709AB446FEBEAE6B6F"><enum>(2)</enum><text>foods sold individually outside the school meal programs (including foods sold in vending machines, a la carte or snack lines, school stores, and snack bars) are not required to meet comparable nutritional standards;</text></paragraph>
<paragraph id="HCE36E1B807E64903BD504DE694D2FFFE"><enum>(3)</enum><text>in order to promote child nutrition and health, Congress—</text>
<subparagraph id="H710A3F6FEAA44137B74E48C6EC2F888E"><enum>(A)</enum><text>has authorized the Secretary to establish nutritional standards in the school lunchroom during meal time; and</text></subparagraph>
<subparagraph id="H9113643D10FA4BC4BC0913F57149858"><enum>(B)</enum><text>since 1979, has prohibited the sale of food of minimal nutritional value, as defined by the Secretary, in areas where school meals are sold or eaten;</text></subparagraph></paragraph>
<paragraph id="H5BFDAD910F424B4BBF95C08661B048C6"><enum>(4)</enum><text>Federally-reimbursed school meals and child nutrition and health are undermined by the uneven authority of the Secretary to set nutritional standards throughout the school campus and over the course of the school day;</text></paragraph>
<paragraph id="H9DD1686673184E5A837215839153F6BA"><enum>(5)</enum><text>since 1979, when the Secretary defined the term <term>food of minimal nutritional value</term> and promulgated regulations for the sale of those foods during meal times, nutrition science has evolved and expanded;</text></paragraph>
<paragraph id="H80B995BCE848401881A743F6A72BB6"><enum>(6)</enum><text>the current definition of <quote>food of minimal nutritional value</quote> is inconsistent with current knowledge about nutrition and health;</text></paragraph>
<paragraph id="H75952C0420014804BED0B693798B9CDF"><enum>(7)</enum><text>because some children purchase foods other than balanced meals provided through the school lunch program established under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the school breakfast program established by section 4 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), the efforts of parents to ensure that their children consume healthful diets are undermined;</text></paragraph>
<paragraph id="HD5A230683EC04A999EE9BA70CA18D049"><enum>(8)</enum><text>experts in nutrition science have found that—</text>
<subparagraph id="H6879ABD11C614FE193FD65FA75BFB3C"><enum>(A)</enum><text>since 1980, rates of obesity have doubled in children and tripled in adolescents;</text></subparagraph>
<subparagraph id="HD82BB7E2E18143C3AB04F6CCC600F457"><enum>(B)</enum><text>only 2 percent of children eat a healthy diet that is consistent with Federal nutrition recommendations;</text></subparagraph>
<subparagraph id="H1D769D27AC11440F8F37FDAC753B741C"><enum>(C)</enum><text>3 out of 4 high school students do not eat the minimum recommended number of servings of fruits and vegetables each day; and</text></subparagraph>
<subparagraph id="HBC58D96C3F3744039E00114DA3007522"><enum>(D)</enum><text>type 2 diabetes, which is primarily due to poor diet and physical inactivity, is rising rapidly in children;</text></subparagraph></paragraph>
<paragraph id="HA25EC55A23214530001400F3FE36D5B1"><enum>(9)</enum><text>in 1996, children aged 2 to 18 years consumed an average of 118 more calories per day than similar children did in 1978, which is the equivalent of 12 pounds of weight gain annually, if not compensated for through increased physical activity; and</text></paragraph>
<paragraph id="H29FEDFC3FCE949B8AF8C7FD3BC41A74E"><enum>(10)</enum><text>according to the Surgeon General, the direct and indirect costs of obesity in the United States are $117,000,000,000 per year.</text></paragraph></section>
<section id="H929809D542EE44EF83FFF32532D555B6"><enum>3.</enum><header>Food of minimal nutritional value</header><text display-inline="no-display-inline">Section 10 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1779">42 U.S.C. 1779</external-xref>) is amended—</text>
<paragraph id="H2868DEFBF7A04A60A9FFB04CD1E4DDCF"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section heading and all that follows through <quote>(a) The Secretary</quote> and inserting the following:</text>

<subsection id="H3D6C6811427E40D7AEBCB6535D84FEA1"><enum>(a)</enum><header>In general</header><text>The Secretary</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="HE21A79C4D7244D06908039DF00AE507D"><enum>(2)</enum><text>by striking subsections (b) and (c) and inserting the following:</text>

<subsection id="H20FC0BC1372748AC8297D1A82275A397"><enum>(b)</enum><header>Food of minimal nutritional value</header>
<paragraph id="H1261D982DAEC45A6942F9888504BAAD1"><enum>(1)</enum><header>Proposed regulations</header>
<subparagraph id="H0B27C51E4E0D4E4DAD5489A4A163ADEC"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this paragraph, the Secretary shall promulgate proposed regulations to revise the definition of <quote>food of minimal nutritional value</quote> that is used to carry out this Act and the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></subparagraph>
<subparagraph id="H2B1CE71003AF41EA9EEE5CA19424D6D1"><enum>(B)</enum><header>Application</header><text>The revised definition of <quote>food of minimal nutritional value</quote> shall apply to all foods sold—</text>
<clause id="H745EE14F2B0E46B48B0069903400079E"><enum>(i)</enum><text>outside the school meal programs;</text></clause>
<clause id="H22E94837FA3E48EABC0388952862D2F"><enum>(ii)</enum><text>on the school campus; and</text></clause>
<clause id="H93DBD75B99394B05912DA38925779EDA"><enum>(iii)</enum><text>at any time during the school day.</text></clause></subparagraph>
<subparagraph id="HB0FD0720F6B04CC2A17496D942AB8FD5"><enum>(C)</enum><header>Requirements</header><text>In revising the definition, the Secretary shall consider—</text>
<clause id="HB510054772F94762BBFC0676C8100F9"><enum>(i)</enum><text>both the positive and negative contributions of nutrients, ingredients, and foods (including calories, portion size, saturated fat, trans fat, sodium, and added sugars) to the diets of children;</text></clause>
<clause id="H3246CF28EB5C465B95459FB5DF554E7"><enum>(ii)</enum><text>evidence concerning the relationship between consumption of certain nutrients, ingredients, and foods to both preventing and promoting the development of overweight, obesity, and other chronic illnesses;</text></clause>
<clause id="HD29A913B0F744037BC617C70A4067FE1"><enum>(iii)</enum><text>recommendations made by authoritative scientific organizations concerning appropriate nutritional standards for foods sold outside of the reimbursable meal programs in schools; and</text></clause>
<clause id="H991DB6B1D6F54FE08E99C900229029F0"><enum>(iv)</enum><text>special exemptions for school-sponsored fundraisers (other than fundraising through vending machines, school stores, snack bars, a la carte sales, and any other exclusions determined by the Secretary), if the fundraisers are approved by the school and are infrequent within the school.</text></clause></subparagraph></paragraph>
<paragraph id="HCD00C8DB82D54FD392EAF49E0780F2B4"><enum>(2)</enum><header>Implementation</header>
<subparagraph id="H4132DF9A2E494D0EA037912E1FBF07EA"><enum>(A)</enum><header>Effective date</header>
<clause id="H1286969A3ABD4E6FA69C44BDFF7873A7"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the proposed regulations shall take effect at the beginning of the school year following the date on which the regulations are finalized.</text></clause>
<clause id="H750FB451D666478DB9684D3CA350CBDA"><enum>(ii)</enum><header>Exception</header><text>If the regulations are finalized on a date that is not more than 60 days before the beginning of the school year, the proposed regulations shall take effect at the beginning of the following school year.</text></clause></subparagraph>
<subparagraph id="H7916A0E1CD364AABB100A9E556CBC7D5"><enum>(B)</enum><header>Failure to promulgate</header><text>If, on the date that is 1 year after the date of enactment of this paragraph, the Secretary has not promulgated final regulations, the proposed regulations shall be considered to be final regulations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
