<official-title>To amend the Federal Food, Drug, and Cosmetic Act with respect to counterfeit drugs, and for other purposes.</official-title>

<section id="H57E921428F5144528400514D36D53446" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Counterfeit Drug Prevention Act of 2006</short-title></quote>.</text></section> 
<section id="H1986B7036D8543F384D52BB750FE835F"><enum>2.</enum><header>Penalties regarding counterfeit drugs</header><text display-inline="no-display-inline">Section 303(a) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/333">21 U.S.C. 333(a)</external-xref>) is amended by adding at the end the following paragraph:</text> 
<quoted-block style="OLC" id="HCC06639BA3DB491885879CD4A4C87CAE" display-inline="no-display-inline"> 
<paragraph id="H4CA0CE3E609F486F8F0059A8C0852E7" indent="up1"><enum>(3)</enum><text>Notwithstanding paragraph (1) or (2), any person who engages in any conduct described in section 301(i)(2) knowing that the conduct concerns the rendering of a drug as a counterfeit drug, or who engages in conduct described in section 301(i)(3) knowing that the conduct will cause a drug to be a counterfeit drug or knowing that a drug held, sold, or dispensed is a counterfeit drug, shall be fined in accordance with title 18, United States Code, or imprisoned not more than 20 years, or both, except that if the use of the counterfeit drug by a consumer is the proximate cause of the death of the consumer, the term of imprisonment shall be any term of years or for life.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6BAD08B322284A7EA17140A759C706E4"><enum>3.</enum><header>Other criminal penalties; clarification regarding fines</header><text display-inline="no-display-inline">Section 303 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/333">21 U.S.C. 333(a)</external-xref>) is amended—</text> 
<paragraph id="H2EEE95868CE94DB9B906A8DC43BDD19C"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H9996A2C321384D56933205E070FD29EC"><enum>(A)</enum><text>in paragraph (1), by striking <quote>shall be imprisoned</quote> and all that follows and inserting the following: <quote>shall be fined in accordance with title 18, United States Code, or imprisoned not more than one year, or both.</quote>; and</text></subparagraph> 
<subparagraph id="H82C65E7A7BCC442C8EC3E2505D86D333"><enum>(B)</enum><text>in paragraph (2), by striking <quote>shall be imprisoned</quote> and all that follows and inserting the following: <quote>shall be fined in accordance with title 18, United States Code, or imprisoned not more than three years, or both.</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H1BD14CE1354C47B6BC35BFE4946D008D"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="HC8A103B3D2D74531ADC39881295000AD"><enum>(A)</enum><text>in paragraph (1), in the matter after and below subparagraph (D), by striking <quote>shall be imprisoned</quote> and all that follows an inserting the following: <quote>shall be fined in accordance with title 18, United States Code, or imprisoned not more than 10 years, or both.</quote>; and</text></subparagraph> 
<subparagraph id="H6B0D8495A40044E8BDE4B54964C845B9"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>shall be imprisoned</quote> and all that follows an inserting the following: <quote>shall be fined in accordance with title 18, United States Code, or imprisoned not more than 10 years, or both.</quote>.</text></subparagraph></paragraph></section>
