<official-title>To provide for entitlement to dependents’ and survivors’ benefits under the old-age, survivors, and disability insurance program under title II of the Social Security Act based on permanent partnership as well as marriage.</official-title>

<section id="H28CA34B82CDA473B97F19862F9F0006D" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Equal Access to Social Security Act of 2006</short-title></quote>.</text></section> 
<section id="HF212B1B95568453799001D20C57B8FCD"><enum>2.</enum><header>Definitions Relating to Permanent Partnership</header> 
<subsection id="H06F53E345781489D981F30E2B5D4333"><enum>(a)</enum><header>In general</header><text>Section 216 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block act-name="Social" id="H7291C95FDAFC40EB9017C1801926599B" style="other" other-style="archaic"> 
<subsection id="HFEAE75CE1BE349CAA72BC548E45442B1"><enum>(m)</enum><header>Definitions relating to permanent partnership</header> 
<paragraph id="HA3F16321BDE548B498FB7660FF7BE24E" display-inline="yes-display-inline"><enum>(1)</enum><text>The term <term>permanent partnership</term> means a committed, intimate relationship between 2 individuals who have attained 18 years of age, in any case in which—</text> 
<subparagraph id="H4161CF1DFCFF4002A624A0FA42F51689" indent="up1"><enum>(A)</enum><text>each such individual intends a lifelong commitment to the other,</text></subparagraph> 
<subparagraph id="HD2BCF65B1CF54175B4CE7C132DC80047" indent="up1"><enum>(B)</enum><text>such individuals are financially interdependent,</text></subparagraph> 
<subparagraph id="H5DB1E1B5DFC74909A941B28EA1A8592F" indent="up1"><enum>(C)</enum><text>such individuals are unable to contract with each other a marriage cognizable under this title,</text></subparagraph> 
<subparagraph id="H7D3B14DA3DF74A6E8E44CAD60002BE14" indent="up1"><enum>(D)</enum><text>each such individual is not a first, second, or third degree blood relation of the other individual, and</text></subparagraph> 
<subparagraph id="H091BCED94E4949D99EE9E642CF29B693" indent="up1"><enum>(E)</enum><text>each such individual is neither married to, nor in a relationship described in the preceding provisions of this paragraph with, any third individual.</text></subparagraph></paragraph> 
<paragraph id="H7ABDE455C22F44F0936ECD7FDF536D24" indent="up1"><enum>(2)</enum><text>The term <term>permanent partner</term> means, in connection with any other individual (hereinafter referred to as the <quote>other party</quote>), any individual who is in a permanent partnership with such other party, but only if such individual—</text> 
<subparagraph id="H1714AE0D66DD49E08DF9C2BDFCA97B33"><enum>(A)</enum><text>is also a parent of such other party’s son or daughter,</text></subparagraph> 
<subparagraph id="HC875229468994CF9A1413F76B3FD26F5"><enum>(B)</enum><text>was in a permanent partnership with such other party for a period of not less than one year immediately preceding the day on which such individual’s application is filed, or</text></subparagraph> 
<subparagraph id="H5B53231873874DFDA900B592E4C91D24"><enum>(C)</enum><text>in the month prior to the month during which such permanent partnership commenced—</text> 
<clause id="H0BAF86436D454DFFA19291877F113EBD"><enum>(i)</enum><text>was entitled to, or on application therefor and attainment of age 62 in such prior month would have been entitled to, benefits under subsection (b), (c), (e), (f), or (h) of section 202,</text></clause> 
<clause id="H6990AEAC89E949308C2398C209941D28"><enum>(ii)</enum><text>had attained age 18 and was entitled to, or on application therefor would have been entitled to, benefits under subsection (d) of such section (subject, however, to section 202(s)), or</text></clause> 
<clause id="H6C4A2A51B79343EAA472815C7D133371"><enum>(iii)</enum><text>was entitled to, or upon application therefor and attainment of the required age (if any) would have been entitled to, a widow’s, widower’s, child’s (after attainment of age 18), or parent’s insurance annuity under section 2 of the Railroad Retirement Act of 1974.</text></clause></subparagraph><continuation-text continuation-text-level="paragraph">For purposes of subparagraph (B), an individual shall be deemed to have been in a permanent partnership with the other party for a period of one year throughout the month in which occurs the first anniversary of the commencement of such permanent partnership.</continuation-text></paragraph> 
<paragraph id="H0BBB2C81249D403D8199100072C911C2" indent="up1"><enum>(3)</enum> 
<subparagraph id="H95F72BB54DEC48A799BAD67BBAC0900" display-inline="yes-display-inline"><enum>(A)</enum><text>The term <term>surviving permanent partner</term> means, in connection with any other individual (hereinafter in this paragraph referred to as the <quote>other party</quote>), an individual who is the surviving permanent partner of such other party, but only if—</text> 
<clause id="H424F1E5A31CD49E893486CE1EE7CB8D" indent="up1"><enum>(i)</enum><text>such individual is a parent of such other party’s son or daughter,</text></clause> 
<clause id="H081DD02B52044DCD99FDA8959FA860CE" indent="up1"><enum>(ii)</enum><text>such individual legally adopted such other party’s son or daughter while such individual was in a permanent partnership with such other party and while such son or daughter was under the age of 18,</text></clause> 
<clause id="HDFCC03ADE0984E0984EAAB314613F0C6" indent="up1"><enum>(iii)</enum><text>such other party legally adopted such individual’s son or daughter while such individual was in a permanent partnership with such other party and while such son or daughter was under the age of 18,</text></clause> 
<clause id="H6CCF9EFB3CE2431A99ADB7B4D550FEAF" indent="up1"><enum>(iv)</enum><text>such individual was in a permanent partnership with such other party at the time both of them legally adopted a child under the age of 18,</text></clause> 
<clause id="HEA6C578F1DA0420A9100ECAFE10021EA" indent="up1"><enum>(v)</enum><text>as of the date of the death of such other party, such individual had been living with a child of such other party for a period of at least 1 year which began before such child attained the age of 18, or such other party had been living with a child of such individual for at least such 1-year period,</text></clause> 
<clause id="H8060F515383A481E8837E29DC73DAF00" indent="up1"><enum>(vi)</enum><text>such individual was in a permanent partnership with such other party for a period of not less than 9 months immediately prior to the day on which such other party died, or</text></clause> 
<clause id="H72663CE6B3AE4DE9ABF1959132F8F8D" indent="up1"><enum>(vii)</enum><text>in the month prior to the month in which the permanent partnership commenced—</text> 
<subclause id="HA9584139E035419DB9D364E4759040E2"><enum>(I)</enum><text>such individual was entitled to, or on application therefor and attainment of age 62 in such prior month would have been entitled to, benefits under subsection (b), (c), (e), (f), or (h) of section 202,</text></subclause> 
<subclause id="HE5F39FA68E8A4AA197F87B609DF00007"><enum>(II)</enum><text>such individual had attained age 18 and was entitled to, or on application therefor would have been entitled to, benefits under subsection (d) of such section (subject, however, to section 202(s)), or</text></subclause> 
<subclause id="H2370E3125D394ADE9E246019367637AA"><enum>(III)</enum><text>such individual was entitled to, or upon application therefor and attainment of the required age (if any) would have been entitled to, a widow’s, widower’s, child’s (after attainment of age 18), or parent’s insurance annuity under section 2 of the Railroad Retirement Act of 1974.</text></subclause></clause></subparagraph> 
<subparagraph id="H751631EF7D814D85B0918C541FFB26FE" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline"> The requirements of subparagraph (A)(vi) in connection with the surviving permanent partner of such other party shall be treated as satisfied if—</text> 
<clause id="H236CED861D53421D8900E0F491004869"><enum>(i)</enum><text>such other party had been married or in a permanent partnership prior to such other party’s entry into a permanent partnership with the surviving permanent partner,</text></clause> 
<clause id="HEF7D581F73164E6CAC00828742FC84C1"><enum>(ii)</enum><text>the prior wife or prior permanent partner was institutionalized during such other party’s marriage to the prior wife or permanent partnership with the prior permanent partner due to mental incompetence or similar incapacity,</text></clause> 
<clause id="HBBA04A121A044BB4B7ABBA8100527B4F"><enum>(iii)</enum><text>during the period of the institutionalization of the prior wife or prior permanent partner, such other party would have divorced the prior wife or terminated the permanent partnership with the prior permanent partner and entered into a permanent partnership with the surviving permanent partner, but such other party did not do so because such divorce or termination would have been unlawful, by reason of the institutionalization of the prior wife or prior permanent partner, under the laws of the State in which such other party was domiciled at the time (as determined based on evidence satisfactory to the Commissioner of Social Security),</text></clause> 
<clause id="H8FE8040EE60C4573A011FEE0CDC3DA10"><enum>(iv)</enum><text>the prior wife or prior permanent partner continued to remain institutionalized up to the time of the death of the prior wife or prior permanent partner, and</text></clause> 
<clause id="H2E08BC2E3F034DF0B240EDF7ED4007D"><enum>(v)</enum><text>such other party entered into a permanent partnership with the surviving permanent partner within 60 days after the death of the prior wife or prior permanent partner.</text></clause></subparagraph></paragraph> 
<paragraph id="H89F5BF97AEA0420AAD941983599FE980" indent="up1"><enum>(4)</enum><text>The term <term>former permanent partner</term> means, in connection with any other individual, an individual who has been in a permanent partnership with such other individual, in any case in which either individual who was a party to such permanent partnership has certified to the Commissioner, in accordance with regulations issued under subsection (h)(1)(C)(ii), that such permanent partnership has terminated other than by reason of death, but only if such individuals have been in a permanent partnership for a period of 10 years immediately before the date of the termination of the partnership, as determined under such regulations. For purposes of subparagraph (C) of subsections (b)(1) and (c)(1) of section 202, a former permanent partner in connection with a terminated permanent partnership shall be deemed not to be in such permanent partnership throughout the month in which the permanent partnership terminates.</text></paragraph> 
<paragraph id="H92D05534B63A44B19B90A3675D466F01" indent="up1"><enum>(5)</enum><text>The term <term>surviving former permanent partner</term> means, in connection with any other individual, an individual—</text> 
<subparagraph id="HB4C3A9423A84438194A125A436AE62D"><enum>(A)</enum><text>who was in a permanent partnership with such other individual, in any case in which either individual who was a party to such permanent partnership has certified to the Commissioner, in accordance with regulations issued under subsection (h)(1)(C)(ii), that such permanent partnership has terminated other than by reason of death, and</text></subparagraph> 
<subparagraph id="H735C833144B841E38C41224C1EAEE88"><enum>(B)</enum><text>who has died, but only if such individuals had been in a permanent partnership for a period of 10 years immediately before the date of the termination of the partnership, as determined under such regulations.</text></subparagraph></paragraph> 
<paragraph id="H7E92FC708C6949EEA65783D81C4235B7" indent="up1"><enum>(6)</enum><text>The term <term>surviving former permanent partner parent</term> means, in connection with any other individual, an individual who was in a permanent partnership with such other individual, in any case in which either individual who was a party to such permanent partnership certified to the Commissioner, in accordance with regulations issued under subsection (h)(1)(C)(ii), that such permanent partnership terminated other than by reason of death, and, subsequent to such certification, such other individual died, but only if—</text> 
<subparagraph id="H151AB13A64F1456E001EB23FCBF200A7"><enum>(A)</enum><text>the surviving individual is the mother or father of the son or daughter of the deceased individual,</text></subparagraph> 
<subparagraph id="HC0C3E04E816C43B2B99BC29C075B697E"><enum>(B)</enum><text>the surviving individual legally adopted the son or daughter of the deceased individual while both individuals were in the permanent partnership and while such son or daughter was under the age of 18,</text></subparagraph> 
<subparagraph id="H9C4F352A7D9A4F8F99A3A3ED32F3E364"><enum>(C)</enum><text>the deceased individual legally adopted the son or daughter of the surviving individual while both individuals were in the permanent partnership and while such son or daughter was under the age of 18,</text></subparagraph> 
<subparagraph id="H49275B74B3604B1596F4E5E2D852E379"><enum>(D)</enum><text>the surviving individual was in the permanent partnership with the deceased individual at the time both of them legally adopted a child under the age of 18, or</text></subparagraph> 
<subparagraph id="HF50C533067BB46FB8F59939EF977C663"><enum>(E)</enum><text>as of the date of the death of such the deceased individual, the surviving individual had been living with a child of the deceased individual for a period of at least a 1-year which began before such child attained the age of 18, or the deceased individual had been living with a child of the surviving individual for at least such 1-year period.</text> 
<clause id="H2F7503F8ED014BABB3665C93F8320000"><enum>(i)</enum><text>was entitled to, or on application therefor and attainment of age 62 in such prior month would have been entitled to, benefits under subsection (b), (c), (e), (f), or (h) of section 202,</text></clause> 
<clause id="HD011F56A60454619A1CA52231D76D1B"><enum>(ii)</enum><text>had attained age 18 and was entitled to, or on application therefor would have been entitled to, benefits under subsection (d) of such section (subject, however, to section 202(s)), or</text></clause> 
<clause id="H1B40D2CF64B54A2AB900AC1459A1DC4"><enum>(iii)</enum><text>was entitled to, or upon application therefor and attainment of the required age (if any) would have been entitled to, a widow’s, widower’s, child’s (after attainment of age 18), or parent’s insurance annuity under section 2 of the Railroad Retirement Act of 1974.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7E5D54F0DC084B8CB24FB1D1A08D8306"><enum>(b)</enum><header>Conforming amendment to definition of child</header><text>Section 216(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416(e)</external-xref>) is amended by adding at the end the following new sentence: <quote>For purposes of this title, the child of an individual’s permanent partner who has not been legally adopted by such individual shall be treated as a stepchild of such individual.</quote>.</text></subsection></section> 
<section id="HDC578B2204B947D7964EF393226B44D2" section-type="subsequent-section"><enum>3.</enum><header>Determination of permanent partner status</header><text display-inline="no-display-inline">Section 216(h)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/416">42 U.S.C. 416(h)(1)</external-xref>) is amended—</text> 
<paragraph id="H2A02AF07449A49C4A5BC96A9EE7BC4B8"><enum>(1)</enum><text>in subparagraph (B)(iii), by inserting <quote>or permanent partnership</quote> after <quote>marriage</quote>;</text></paragraph> 
<paragraph id="HCA1C3C2EAAFF4C37B3BFA9AEEDF77E1D"><enum>(2)</enum><text>in subparagraph (B)(iv), by inserting <quote>or previous permanent partnership</quote> after <quote>previous marriage</quote> each place it appears in subclause (I), and by inserting <quote>or purported permanent partnership</quote> after <quote>purported marriage</quote> in subclause (II); and</text></paragraph> 
<paragraph id="H6CEACB0FBFF044EE8B16C0A2824B17E0"><enum>(3)</enum><text>by adding at the end the following new subparagraphs:</text> 
<quoted-block id="H37E58A9167E9413492E7BAF92091806" style="traditional"> 
<subparagraph indent="up2" id="H772F49C3AE274FCBBAF1114E00447CD8"><enum>(C)</enum> 
<clause id="HC3F2002D4D2544DEB45E826171EDC17D" display-inline="yes-display-inline"><enum>(i)</enum><text>An applicant is the permanent partner or surviving permanent partner of a fully or currently insured individual for purposes of this title if the Commissioner of Social Security finds that such applicant and such insured individual were validly members of a permanent partnership at the time such applicant files such application or, if such insured individual is dead, at the time he died.</text></clause> 
<clause id="H67C6D0A202CE4F2CB800C615F9A819CE" indent="up1"><enum>(ii)</enum><text>Any 2 individuals shall not be treated as being in a permanent partnership with each other unless there is in effect, in accordance with regulations which shall be prescribed by the Commissioner, a written certification made by both such individuals to the Commissioner of the existence of such permanent partnership. A certification made to the Commissioner under this clause shall remain in effect until the earlier of the date of the death of either such individual or the date of a certification made by both such individuals, in accordance with such regulations, indicating that such relationship has terminated other than by reason of death or, if earlier, the date on which the Commissioner otherwise determines that such permanent partnership has terminated.</text></clause></subparagraph> 
<subparagraph indent="up2" id="HDE9C27CB1C434C6BAECBAE84ADD3BB9C"><enum>(D)</enum> 
<clause id="HCB9165352B614136917222C72FEA608C" display-inline="yes-display-inline"><enum>(i)</enum><text>In any case where under subparagraph (C) an applicant is not the permanent partner or surviving permanent partner of a fully or currently insured individual, or where under paragraph (2), (3), (4), or (5) of subsection (m) such applicant is not the permanent partner, former permanent partner, surviving permanent partner, or surviving former permanent partner of such individual, but it is established to the satisfaction of the Commissioner of Social Security that such applicant in good faith entered into an arrangement with such individual resulting in a purported permanent partnership between them which, but for a legal impediment not known to the applicant at the time of the entry into such arrangement, would have been a valid permanent partnership, then, for purposes of subparagraph (C) and paragraphs (2), (3), (4), and (5) of subsection (m), such purported permanent partnership shall be deemed to be a valid permanent partnership. Notwithstanding the preceding sentence, in the case of any person who would be deemed under the preceding sentence a permanent partner or surviving permanent partner of the insured individual, such purported permanent partnership shall not be deemed to be a valid permanent partnership unless the applicant and the insured individual were living in the same household at the time of the death of the insured individual or (if the insured individual is living) at the time the applicant files the application. A purported permanent partnership that is deemed to be a valid permanent partnership by reason of the preceding sentence shall continue to be deemed a valid permanent partnership if the insured individual and the person entitled to benefits as the permanent partner of the insured individual are no longer living in the same household at the time of the death of such insured individual.</text></clause> 
<clause id="H633104017AD54C6B8039D0351CCCAB6D" indent="up1"><enum>(ii)</enum><text>The provisions of clause (i) shall not apply if the Commissioner of Social Security determines, on the basis of information brought to the Commissioner’s attention, that such applicant entered into such purported permanent partnership with such insured individual with knowledge that it would not be a valid permanent partnership.</text></clause> 
<clause id="H0B9F1F16F32C4BBD00BB97CFE054BDC4" indent="up1"><enum>(iii)</enum><text>The entitlement to a monthly benefit under subsection (b) or (c) of section 202, based on the wages and self-employment income of such insured individual, of a person who would not be deemed to be a permanent partner of such insured individual but for this subparagraph, shall end with the month before the month in which such person enters into a permanent partnership or marriage, valid without regard to this subparagraph or subparagraph (B), with a person other than such insured individual.</text></clause> 
<clause id="HB8517AB8CE784598A16DE72F7864F79" indent="up1"><enum>(iv)</enum><text>For purposes of this subparagraph, a legal impediment to the validity of a purported permanent partnership includes only an impediment (I) resulting from the lack of dissolution of a previous marriage or previous permanent partnership or otherwise arising out of such previous marriage or permanent partnership or its dissolution, or (II) resulting from a defect in the procedure followed in connection with such purported permanent partnership.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5FD13C1D4F2D433ABB7F54A7F711E996"><enum>4.</enum><header>Wife’s insurance benefits for permanent partners</header><text display-inline="no-display-inline">Section 202(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(b)</external-xref>) is amended—</text> 
<paragraph id="H0D0A60AC21E2474E006662BB7C6673C8"><enum>(1)</enum><text>in paragraph (1), by striking <quote>The wife (as defined in section 216(b)) and every divorced wife (as defined in section 216(d))</quote> and inserting <quote>The wife (as defined in section 216(b)), every divorced wife (as defined in section 216(d), the female permanent partner (as defined in section 216(m)(2)), and every female former permanent partner (as defined in section 216(m)(4))</quote>, and by striking <quote>such wife or such divorced wife</quote> and inserting <quote>such wife, such divorced wife, such permanent partner, or such former permanent partner</quote>;</text></paragraph> 
<paragraph id="H8351FC820F9A47C0821C40496B22D7B5"><enum>(2)</enum><text>in paragraph (1)(B), by inserting <quote>or permanent partner</quote> after <quote>wife</quote>;</text></paragraph> 
<paragraph id="H593F956FC32940E08B11DD9C801BE6"><enum>(3)</enum><text>in paragraph (1)(C), by inserting <quote>or former permanent partner</quote> after <quote>divorced wife</quote>, and by inserting <quote>and is not in a permanent partnership</quote> after <quote>married</quote>;</text></paragraph> 
<paragraph id="H7A7C2998CFAA4233B99509E39C7533C0"><enum>(4)</enum><text>in paragraph (1)(i), by striking <quote>wife or divorced wife</quote> each place it appears and inserting <quote>wife, divorced wife, permanent partner, or former permanent partner</quote>;</text></paragraph>

<paragraph id="HA923B30A867A46AC89178009C900DC79"><enum>(3)</enum><text>Section 3121(b)(3)(B) of such Code (relating to exclusion from employment of service in the employ of mother, father, spouse, son, or daughter) is amended—</text> 
<subparagraph id="HD7B23371EEE94F698E834FC97200C1F"><enum>(A)</enum><text>by striking <quote>his spouse or son or daughter</quote> and inserting <quote>his spouse, permanent partner, son, or daughter</quote>; and</text></subparagraph> 
<subparagraph id="H2ABB0872383A4D84B55D8DE705DE978B"><enum>(B)</enum><text>by striking clause (i) and inserting the following:</text>

<clause indent="up1" id="HDEE330A4A27540E495319BF31E98D064"><enum>(i)</enum><text>the employer is a surviving spouse, a surviving permanent partner (as defined in section 216(m)(3) of the <act-name parsable-cite="SSA">Social Security Act</act-name>), a divorced individual, or a former permanent partner (as defined in section 216(m)(4) of such Act) and has not, since the death of his or her spouse or permanent partner (as defined in section 216(m)(2) of such Act) or the termination of his or her marriage or permanent partnership (as defined in section 216(m)(1) of such Act), married or entered into a permanent partnership, or the employer has a spouse or permanent partner living in the home who has a mental or physical condition which results in an incapability of such spouse or permanent partner of caring for a son, daughter, stepson, or stepdaughter (referred to in clause (ii)) for at least 4 continuous weeks in the calendar quarter in which the service is rendered, and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> 
<section id="H86CA30350A144C9D89FB5B699DD56409"><enum>11.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to benefits for which applications are filed after 1 year after the date of the enactment of this Act.</text></section>
