<official-title>To amend the Indian Gaming Regulatory Act to provide that the Secretary of the Interior shall not approve a Tribal-State gaming compact under that Act unless the State involved has a State law providing for a gaming master plan that has been approved by the Secretary.</official-title>

<section id="H4C5B86A90BE743A5A9075260F77FE74" section-type="section-one"><enum>1.</enum><header>State Gaming Master Plan</header><text display-inline="no-display-inline">Section 11(d) of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2710">25 U.S.C. 2710(d)</external-xref>) is amended—</text> 
<paragraph id="H10D17E5F39144A0FB7B800DDCF64E679"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>entity, and</quote> and inserting <quote>entity and has a State law providing for a gaming master plan that has been approved by the Secretary, and</quote>; and</text></paragraph> 
<paragraph id="HE96A2E27E00749140074EE93416100BA"><enum>(2)</enum><text>by adding at the end the following new paragraph: </text>

<paragraph id="HB159CE670C7F4C29B0DAAA81B83008D"><enum>(10)</enum> 
<subparagraph id="H319028B9CC9B406FBED5C88634CFA200" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary is authorized to approve a Tribal-State compact under this Act only if the State in which the gaming activities subject to the compact will be conducted has a State law providing for a gaming master plan that has been approved by the Secretary.</text></subparagraph> 
<subparagraph id="H15500D76FE8F4869A6BBDC637DC2E15B" indent="up1"><enum>(B)</enum><text>The Secretary may approve a State gaming master plan only if the plan contains, at a minimum, the following:</text> 
<clause id="H73D5551779F5478281174C85B22CE195"><enum>(i)</enum><text>A list of federally recognized Indian tribes with Indian lands within the boundaries of the State and the location of those Indian lands in reference to the Indian Economic Opportunity Zone, if such a zone has been established, and other land in that State on which gaming activities regulated under this Act are conducted.</text></clause> 
<clause id="HEDA587C9860846B59294738E6546EE5B"><enum>(ii)</enum><text>A limit on the number of Tribal-State compacts that the State may approve per year in the 10 years following submission of the plan to the Secretary.</text></clause> 
<clause id="H403952ACD57B42D600FE546F425B4DBE"><enum>(iii)</enum><text display-inline="yes-display-inline">A limit on the number of slot machines that will be allowed under the Tribal-State compacts that the State may approve in the 10 years following submission of the plan to the Secretary.</text></clause> 
<clause id="HEA6F454147F248A8A915713824FCB456"><enum>(iv)</enum><text>A description of the process that the State used to consult with the Indian tribes listed pursuant to clause (i) regarding the criteria set forth pursuant to this subparagraph.</text></clause> 
<clause id="HC29B0B1EE41847E49417B31B1D1649AF"><enum>(v)</enum><text display-inline="yes-display-inline">A description of the process that the State will use to determine civil and criminal jurisdiction regarding gaming activities regulated under this Act.</text></clause> 
<clause id="H24DB634879104A57B100278094B27B13"><enum>(vi)</enum><text>A description of the cost-benefit analysis that the State will use to determine the feasibility of any Tribal-State compact proposed to be entered into under this Act.</text></clause> 
<clause id="HA0C0EF3F4E764B57ADC822B8CC46D3D"><enum>(vii)</enum><text>A description of the process that the State used to allow interested parties to comment on the plan.</text></clause> 
<clause id="H9D859B435E7A400A00D591902B55A00"><enum>(viii)</enum><text display-inline="yes-display-inline">A description of the process that the State requires for final approval of any new or renewed Tribal-State compact.</text></clause> </subparagraph> 
<subparagraph id="HB3C72E23D8B14CF88B5F4EF6B48FAF74" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">If the Secretary does not approve or disapprove a State gaming master plan before the date that is 30 days after the date on which the plan is submitted to the Secretary for approval, the plan shall be considered to have been approved by the Secretary.</text></subparagraph> 
<subparagraph id="HFAB45A79FDF245A9AAADCF4FF0F48B17" indent="up1"><enum>(D)</enum><text>Nothing in this paragraph shall restrict newly recognized, restored, or landless federally recognized Indian tribes from entering into Tribal-State compact negotiations in accordance with this Act.</text></subparagraph> 
<subparagraph id="HB769F1F9A76845AE9D31ACCE7B038B52" indent="up1"><enum>(E)</enum><text>Nothing in this paragraph shall affect Tribal-State compacts that are lawful, valid, and in effect on the date of the enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
