<legis-type>A BILL</legis-type> 
<official-title>To amend title XVIII of the Social Security Act to extend the 2006 initial enrollment period for the Medicare prescription drug benefit by six months, to suspend the late enrollment penalty for such benefit during 2006, to permit Medicare beneficiaries to change enrollment in a prescription drug plan once a year, and to prevent changes in formularies other than at the time of open enrollment periods and only with advance notice.</official-title>

<section id="H1866D3C5188D41F08482796056826984" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Choice for America’s Seniors Act of 2006</short-title></quote>.</text></section> 
<section id="HA651212B5A0E445D8D85422409FCB671"><enum>2.</enum><header>Six-month extension of 2006 initial enrollment period for medicare prescription drug plans and MA plans</header> 
<subsection id="H57668D12A8664C020046F14059A92358"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1851(e)(3)(B)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21(e)(3)(B)(iii)</external-xref>) is amended by striking <quote>May 15, 2006</quote> and inserting <quote>November 14, 2006</quote>.</text> </subsection> 
<subsection id="HF8DE8C5CD9524FB9BC796F757F1E22F5"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text></subsection></section> 
<section id="H270408E9A6F74F02A99D12394F01191C"><enum>3.</enum><header>Suspension of medicare prescription drug late enrollment penalty during 2006</header> 
<subsection id="H1A0D2DE9AF394F649C3C51877CE17864"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1860D–13(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-113">42 U.S.C. 1395w–113(b)(3)(B)</external-xref>) is amended by inserting <quote>(after December 2006)</quote> after <quote>any month</quote>.</text></subsection> 
<subsection id="H6F708A248B3E44D0B677C17581E03CC"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text></subsection></section> 
<section id="HD928A1F723814040A1F0298148917C86"><enum>4.</enum><header>Changes of enrollment in prescription drug plans and MA plans allowed twice during year</header> 
<subsection id="H125D2E3EB30646B1864300D802710033"><enum>(a)</enum><header>Additional election permitted once each year outside of annual coordinated election period</header><text>Section 1851(e)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21(e)(4)</external-xref>) is amended by inserting <quote>once every year, and in addition,</quote> after <quote>make a new election under this section</quote>.</text></subsection> 
<subsection id="HE2416D35A0904A52AF1F004D580515DB"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall take effect as of the date of the enactment of this Act.</text></subsection></section> 
<section id="HBCF950B9486244CC9DC2CF5E92008755"><enum>5.</enum><header>Limitation on removal or change of covered part D drugs from the prescription drug plan formulary; notice of changes in coverage</header> 
<subsection commented="no" display-inline="no-display-inline" id="H99C0E8D075214693B0AE3C85C8CC9C3"><enum>(a)</enum><header>Limitation on removal or change of covered part D drugs from the prescription drug plan formulary</header><text display-inline="yes-display-inline">Section 1860D–4(b)(3)(E) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-104">42 U.S.C. 1395w–104(b)(3)(E)</external-xref>) is amended to read as follows:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H5EA8CB98489543FEA3DF4F5299C6D9B"><enum>(E)</enum><header>Removing a drug from formulary or imposing a restriction or limitation on coverage</header> 
<clause commented="no" display-inline="no-display-inline" id="H779D3620D3B14C3381D4F2AB29B028D0"><enum>(i)</enum><header>Limitation on removal, limitation, or restriction</header> 
<subclause commented="no" display-inline="no-display-inline" id="H9E63ED96B2C143998DFA1CACB27F04C7"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II) and clause (ii), beginning with 2006, the PDP sponsor of a prescription drug plan may not remove a covered part D drug from the plan formulary or impose a restriction or limitation on the coverage of such a drug (such as through the application of a preferred status, usage restriction, step therapy, prior authorization, or quantity limitation) other than at the beginning of each plan year except as the Secretary may permit to take into account new therapeutic uses and newly covered part D drugs.</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H6C6832B7CCB44380A3F9F838E54BC132"><enum>(II)</enum><header>Special rule for newly enrolled individuals</header><text>Subject to clause (ii), in the case of an individual who enrolls in a prescription drug plan on or after the date of enactment of this subparagraph, the PDP sponsor of such plan may not remove a covered part D drug from the plan formulary or impose a restriction or limitation on the coverage of such a drug (such as through the application of a preferred status, usage restriction, step therapy, prior authorization, or quantity limitation) during the period beginning on the date of such enrollment and ending on December 31 of the immediately succeeding plan year except as the Secretary may permit to take into account new therapeutic uses and newly covered part D drugs.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H5F321083C3EE489C8B5D3000E49E2232"><enum>(ii)</enum><header>Exceptions to limitation on removal</header><text>Clause (i) shall not apply with respect to a covered part D drug that—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HA814BEE7D7A74A34818BE1596235861C"><enum>(I)</enum><text display-inline="yes-display-inline">is a brand name drug for which there is a generic drug approved under section 505(j) of the Food and Drug Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355(j)</external-xref>) that is placed on the market during the period in which there are limitations on removal or change in the formulary under subclause (I) or (II) of clause (i) if such generic drug is included in the formulary without any restriction or limitation placed on the coverage of such generic drug other than a restriction or limitation that would be placed on the coverage of the brand name drug during such period without the application of this clause;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HD93C38CBAAF849919D0984817822A4C3"><enum>(II)</enum><text>is a brand name drug that goes off-patent during such period;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H2D57D9FB4D7F4B198DED47FA2EAD7C52"><enum>(III)</enum><text>is a drug for which the Commissioner of Food and Drugs issues a clinical warning that imposes a restriction or limitation on the drug during such period;</text></subclause> 
<subclause id="H73AEA9C54F6440C09F4F0019DF64EE92"><enum>(IV)</enum><text display-inline="yes-display-inline">is a drug that the appropriate pharmacy and therapeutic committee determines, based on evidence from peer-reviewed medical research, to be unsafe or ineffective during such period; or</text></subclause> 
<subclause id="H7806A549ECFB40839100464669086FD6"><enum>(V)</enum><text display-inline="yes-display-inline">is any other drug that satisfies any other requirement determined appropriate by the Secretary.</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="HFABD1CBFFCE5480E916B962B252C355D"><enum>(iii)</enum><header>Notice of removal under application of exception to limitation</header><text>Not later than 90 days before a PDP sponsor of a prescription drug plan removes a covered part D drug from the plan formulary (or restricts or limits such coverage) under clause (ii), the sponsor shall provide appropriate notice (such as under subsection (a)(3)) of such removal (or restriction or limitation) to the Secretary, affected enrollees, physicians, pharmacies, and pharmacists.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBC1234BE208F473DAD5CD9185B9B585B"><enum>(a)</enum><header>Advance notice required for change in formulary and other restrictions or limitations on coverage</header> 
<paragraph id="HBA08E100857E4C45A9E46D388294A37C"><enum>(1)</enum><header>In general</header><text>Section 1860D–4(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-104">42 U.S.C. 1395w–104(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HE1668F2402834A5FB5A0A4215EF75EE" display-inline="no-display-inline"> 
<paragraph id="H0720664F739D43748942D5029D624816"><enum>(5)</enum><header>Annual notice of changes in formulary and other restrictions or limitations on coverage</header><text>Each PDP sponsor offering a prescription drug plan shall furnish to each enrollee 90 days before the time of each annual coordinated election period (referred to in section 1860D–1(b)(1)(B)(iii)) for a plan year a notice of any changes in the formulary or other restrictions or limitations on coverage of a covered part D drug under the plan that will take effect for the plan year.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H82D0776AC89248218EDD76155165668C"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to annual coordinated election periods beginning after the date of the enactment of this Act, except that if this Act is enacted after September 15, 2006, and before January 1, 2007, the notice required under such section shall apply with respect to the annual coordinated election period that begins on November 15, 2006, as of such date (as soon as possible after such date of enactment) as the Secretary of Health and Human Services shall specify.</text></paragraph></subsection></section>
