<section id="HDA80F0B8AA84405C8BE939AF6F8CC3C6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Executive Branch Reform Act of 2006</short-title></quote>.</text></section> 
<section id="HF98CBF1AB7084CA5B484F7402771217E"><enum>2.</enum><header>Requirements relating to significant contacts</header> 
<subsection id="HD51A2E403D6F47F488B7BAC92E1C3FBC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/4">5 U.S.C. App. 4</external-xref>) is amended by adding at the end the following new title:</text> 
<quoted-block style="OLC" id="HBBC12DDD797946C5BD4704001F673E5B" display-inline="no-display-inline"> 
<title id="H22564FC23A33463E98008953BA538D26"><enum>VI</enum><header>Executive Branch Disclosure of Significant Contacts</header> 
<section id="H9BD18B161FF746E899C3D0BEE79E8EC4"><enum>601.</enum><header>Recording and reporting by certain executive branch officials of significant contacts made to those officials</header> 
<subsection id="HEC5473DE8381498283A87E5BC94F64BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the end of a calendar quarter, each covered executive branch official shall make a record of, and file with the Office of Government Ethics a report on, any significant contacts during the quarter between the covered executive branch official and any private party relating to an official government action. If no such contacts occurred, each such official shall make a record of, and file with the Office a report on, this fact, at the same time.</text></subsection> 
<subsection id="H1B252B987CEA48A1B34B1EFC00A92100"><enum>(b)</enum><header>Contents of record and report</header><text>Each record made, and each report filed, under subsection (a) shall contain—</text> 
<paragraph id="H2AD1A46211854F599DA96EBF6FDAD79D"><enum>(1)</enum><text>the name of the covered executive branch official;</text></paragraph> 
<paragraph id="HB3D3C4754ACE42588F8D063176A27330"><enum>(2)</enum><text display-inline="yes-display-inline">the name of each private party who had a significant contact with that official; and </text></paragraph> 
<paragraph id="H8D9BF99DBF4241CA9026C6B69674F6AA"><enum>(3)</enum><text display-inline="yes-display-inline">for each private party so named, a summary of the nature of the contact, including—</text> 
<subparagraph id="H7EAFF1B656DF46A78726B76170C6D808"><enum>(A)</enum><text>the date of the contact; </text></subparagraph> 
<subparagraph id="HE57731CCAA5F429B8B895DF418765683"><enum>(B)</enum><text>the subject matter of the contact and the specific executive branch action to which the contact relates; and</text></subparagraph> 
<subparagraph id="H1B4EB60103ED41D0A222CDEE80511E88"><enum>(C)</enum><text>if the contact was made on behalf of a client, the name of the client.</text></subparagraph></paragraph></subsection> 
<subsection id="HA0C6174AADA446358421F2ECC55703E7"><enum>(c)</enum><header>Withholding FOIA-exempt information</header><text display-inline="yes-display-inline">This section does not require the filing with the Office of Government Ethics of information that is exempt from public disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552(b)</external-xref> of title 5, United States Code (popularly referred to at the “Freedom of Information Act”).</text></subsection></section> 
<section id="H530A4B1E67B94419A2A79331A96ED080"><enum>602.</enum><header>Authorities and responsibilities of Office of Government Ethics</header> 
<subsection id="HAE669340152C4D58B2196E3684C20733"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Government Ethics shall—</text> 
<paragraph id="H336C187C5D4548C689718C30E2B45600"><enum>(1)</enum><text display-inline="yes-display-inline">promulgate regulations to implement this title, provide guidance and assistance on the recording and reporting requirements of this title, and develop common standards, rules, and procedures for compliance with this title;</text></paragraph> 
<paragraph id="H987F3C0B06154272AF4B6130B87EE4D5"><enum>(2)</enum><text>review, and, where necessary, verify the accuracy, completeness, and timeliness of reports; </text></paragraph> 
<paragraph id="HA43D53889DF24064B5F111D2CE839B4F"><enum>(3)</enum><text>develop filing, coding, and cross-indexing systems to carry out the purpose of this title, including—</text> 
<subparagraph id="H2AF1DF3E63FC431996636102C6FF7604"><enum>(A)</enum><text>a publicly available list of all private parties who made a significant contact; and </text></subparagraph> 
<subparagraph id="H90503690218649F5BD788F3CC4258E17"><enum>(B)</enum><text>computerized systems designed to minimize the burden of filing and maximize public access to reports filed under this title; </text></subparagraph></paragraph> 
<paragraph id="H2BBC4F70C0344397B66DDEF47E329DDE"><enum>(4)</enum><text>make available for public inspection and copying at reasonable times the reports filed under this title;</text></paragraph> 
<paragraph id="HB3B344BE740C4ECE96774803C436E765"><enum>(5)</enum><text>retain reports for a period of at least 6 years after they are filed; </text></paragraph> 
<paragraph id="HF70DD2D4D98B49438DBA08B1102B87CC"><enum>(6)</enum><text>compile and summarize, with respect to each reporting period, the information contained in reports filed with respect to such period in a clear and complete manner; </text></paragraph> 
<paragraph id="H52CC4CB253154AEF8B6F6038A9189400"><enum>(7)</enum><text>notify any covered executive branch official in writing that may be in noncompliance with this title; and </text></paragraph> 
<paragraph id="H5FF91E41CF974BAEAC84562145DE848B"><enum>(8)</enum><text>notify the United States Attorney for the District of Columbia that a covered executive branch official may be in noncompliance with this title, if the covered executive branch official has been notified in writing and has failed to provide an appropriate response within 60 days after notice was given under paragraph (7).</text></paragraph></subsection></section> 
<section id="H7C3D9BE9874E46D4B1C5D4264B3D6FD8"><enum>603.</enum><header>Penalties</header><text display-inline="no-display-inline">Whoever knowingly fails to—</text> 
<paragraph id="H5C272C1847474755BCA400BB82C7809F"><enum>(1)</enum><text>remedy a defective filing within 60 days after notice was given under paragraph (7); or</text></paragraph> 
<paragraph id="H68E6311EC2294C22BA979F5088A23FB2"><enum>(2)</enum><text>comply with any other provision of this title; </text></paragraph><continuation-text continuation-text-level="subsection">shall, upon proof of such knowing violation by a preponderance of the evidence, be subject to a civil fine of not more than $50,000, depending on the extent and gravity of the violation.</continuation-text></section> 
<section id="H871C9E06C5F04DBFBD71712F1B13D842"><enum>604.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="HEA05AC3DA2A24C4CA55E3882C2869B25"><enum>(1)</enum><header>Covered executive branch official</header><text display-inline="yes-display-inline">The term <quote>covered executive branch official</quote> means—</text> 
<subparagraph id="H2CB24DF129574386BA86DCC5F4EAB194"><enum>(A)</enum><text>any officer or employee serving in a position in level I, II, III, IV, or V of the Executive Schedule, as designated by statute or Executive order; </text></subparagraph> 
<subparagraph id="H019C5B47C8EB4C248026783226EAFA82"><enum>(B)</enum><text>any member of the uniformed services whose pay grade is at or above O-7 under <external-xref legal-doc="usc" parsable-cite="usc/37/201">section 201</external-xref> of title 37, United States Code; </text></subparagraph> 
<subparagraph id="H9C435C423A0C46A69FEE26362F319EC5"><enum>(C)</enum><text>any officer or employee serving in a position of a confidential, policy-determining, policy-making, or policy-advocating character described in <external-xref legal-doc="usc" parsable-cite="usc/5/7511">section 7511(b)(2)(B)</external-xref> of title 5, United States Code; and</text></subparagraph> 
<subparagraph id="HC557C98DE5A64890AE5B97A3D0E59D7D"><enum>(D)</enum><text display-inline="yes-display-inline">any officer or employee serving in a position of a confidential, policy-determining, policy-making, or policy advocating character, or any other individual functioning in the capacity of such an officer or employee, in the Executive Office of the President or the Office of the Vice President, but does not include the President or Vice President or the chief of staff of the President or Vice President.</text></subparagraph></paragraph> 
<paragraph id="HB98002F32C05437287A715A81D9634D7"><enum>(2)</enum><header>Significant contact</header><text>The term <quote>significant contact</quote> means oral or written communication (including electronic communication) that is made by a private party to a covered executive branch official in which such private party seeks to influence, or obtain nonpublic information about, official action by any officer or employee of the executive branch of the United States.</text></paragraph> 
<paragraph id="H5D99E5B277BA43EE808D9112101281DE"><enum>(3)</enum><header>Private party</header><text>The term <quote>private party</quote> means any person or entity, but does not include a Federal, State, or local government official or a person representing such an official.</text></paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCCB73E779A6E46CA8783AF20EFBE2553"><enum>(b)</enum><header>Effective date</header> 
<paragraph id="HA38DBDAD0B80425888CDA68EB0E4004F"><enum>(1)</enum><header>In general</header><text>Title VI of the Ethics in Government Act of 1978, as added by this section, takes effect 1 year after the date of the enactment of this Act, except as provided in paragraph (2).</text></paragraph> 
<paragraph id="H45DA7AA56F0F4C83A4CD6254A500FE9C"><enum>(2)</enum><header>Initial regulations</header><text>The initial regulations required by section 602 of that Act shall be promulgated—</text> 
<subparagraph id="H4D63A71CED254D38A3002F9E5D842D8F"><enum>(A)</enum><text>in draft form, not later than 270 days after the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="H45AC0D374F644AC8B31B6392FE549237"><enum>(B)</enum><text>in final form, not later than 1 year after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section> 
<section id="HE65A1DF1EC9A451889C579F87234C026"><enum>3.</enum><header>Requirements relating to stopping the revolving door</header><text display-inline="no-display-inline">The Ethics in Government Act of 1978 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/5/4">5 U.S.C. App. 4</external-xref>) is amended by adding at the end the following new title:</text>

<title id="H82CCB3D7275B43D5B9FF1C87855C8265"><enum>VII</enum><header>Stopping the Revolving Door</header> 
<section id="H4E85E480BE2D4AE28829E3FFF9FDC9F0" commented="no"><enum>701.</enum><header>Two-year cooling-off period for persons leaving government service</header> 
<subsection id="H5841D56D55234D0BAFFC1780C09DC9B6" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered executive branch official shall not, for a period of two years after the termination of his employment, engage in any conduct that would be prohibited under subsections (c) or (d) of <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207</external-xref> of title 18, United States Code, if it occurred within one year after the termination of his employment.</text></subsection> 
<subsection id="H82899862707146809CD3BA4303286BA" commented="no"><enum>(b)</enum><header>No effect on section 207</header><text>This section does not expand, contract, or otherwise affect the application of any waiver or criminal penalties under <external-xref legal-doc="usc" parsable-cite="usc/18/207">section 207</external-xref> of title 18, United States Code.</text></subsection></section> 
<section id="HE3ABA63DDD844EF8B1D56C92F2DA64C"><enum>702.</enum><header>Prohibition on negotiation of future employment</header> 
<subsection id="H9B6C7DFF3F77466EAC136E0896E1F82B"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A covered executive branch official shall not participate in any official matter in which, to the official’s knowledge, a person or organization with whom the official is negotiating or has any arrangement concerning prospective employment has a financial interest, unless a waiver has been granted under subsection (b).</text></subsection> 
<subsection id="H34D04956DD074E2F94A8A29660B7E36"><enum>(b)</enum><header>Waivers only when exceptional circumstances exist</header><text>A waiver to subsection (a) is not available, and shall not be granted, to any individual except in a case which the Government official responsible for the individual’s appointment as a covered executive branch official determines that exceptional circumstances exist. Whenever such a determination is made, the Director of the Office of Government Ethics shall independently investigate and review the circumstances relating to the determination, and the waiver shall not take effect until the date on which the Director certifies in writing that exceptional circumstances exist.</text></subsection></section> 
<section id="H5ED1D4B4556E433DA2AC52786E6DBFA6"><enum>703.</enum><header>Cooling-off period for certain persons entering government service</header> 
<subsection id="H0B9708FD9B2642069C46B4B36687D9FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered executive branch official shall not engage in conduct relating to a covered entity that would be prohibited under <external-xref legal-doc="usc" parsable-cite="usc/18/208">section 208</external-xref> of title 18, United States Code, if the official had a financial interest in the covered entity, unless a waiver has been granted under subsection (b).</text></subsection> 
<subsection id="HFBB6894AC4F947DAB8AA001845D5436F"><enum>(b)</enum><header>Waiver</header><text>An agency’s designated ethics officer may, if the Director of the Office of Government Ethics approves, waive the prohibition in subsection (a) with respect to a covered executive branch official of that agency upon a determination that the relationship between the covered executive branch official and the covered entity is not so substantial as to be deemed likely to affect the integrity of the services that the Government may expect from the official.</text></subsection> 
<subsection id="H74070F7700964F2290A20073FE8EA4C7"><enum>(c)</enum><header>Definition</header><text>In this section, the term <quote>covered entity</quote> means an entity—</text> 
<paragraph id="HE6EE27FD59B1430DB637416BDE2BAA00"><enum>(1)</enum><text>in which the official, within the previous 2 years, served as an officer, director, trustee, general partner, or employee; or </text></paragraph> 
<paragraph id="H5ED8ACBE726B42EC9505AAEC85F2A2BE"><enum>(2)</enum><text>for which the official, within the previous 2 years, worked as a lobbyist, lawyer, or other representative. </text></paragraph></subsection> 
<subsection id="HCD577F64664C48BFA3ABFFDF00C0D1FC"><enum>(d)</enum><header>No effect on section 208</header><text>This section does not expand, contract, or otherwise affect the application of any criminal penalties under <external-xref legal-doc="usc" parsable-cite="usc/18/208">section 208</external-xref> of title 18, United States Code.</text></subsection></section> 
<section id="H884B892E4F8A42E2BEB691F0B6FE7F4F"><enum>704.</enum><header>Penalties</header><text display-inline="no-display-inline">Whoever violates section 701, 702, or 703 of this title shall, upon proof of such knowing violation by a preponderance of the evidence, be subject to a civil fine of not more than $100,000, depending on the extent and gravity of the violation.</text></section> 
<section id="H91A559B74F5940E19F2044CB25B8006B" display-inline="no-display-inline"><enum>705.</enum><header>Definition</header><text display-inline="no-display-inline">In this title, the term <quote>covered executive branch official</quote> means—</text> 
<paragraph id="H45F9DAE8251849FD8414DFABCB28E904"><enum>(1)</enum><text>any officer or employee serving in a position in level I, II, III, IV, or V of the Executive Schedule, as designated by statute or Executive order; </text></paragraph> 
<paragraph id="H949538D953024573B3A95B0052C636FE"><enum>(2)</enum><text>any member of the uniformed services whose pay grade is at or above O-7 under <external-xref legal-doc="usc" parsable-cite="usc/37/201">section 201</external-xref> of title 37, United States Code; </text></paragraph> 
<paragraph id="H5A055B5CDD8542218C64FCFF01B73133"><enum>(3)</enum><text>any officer or employee serving in a position of a confidential, policy-determining, policy-making, or policy-advocating character described in <external-xref legal-doc="usc" parsable-cite="usc/5/7511">section 7511(b)(2)(B)</external-xref> of title 5, United States Code;</text></paragraph> 
<paragraph id="H4CFC835D70414CCA99170038A3BB4400"><enum>(4)</enum><text display-inline="yes-display-inline">any officer or employee serving in a position of a confidential, policy-determining, policy-making, or policy advocating character, or any other individual functioning in the capacity of such an officer or employee, in the Executive Office of the President or the Office of the Vice President; and</text></paragraph> 
<paragraph id="H63D7FD4D9A6B4CE288901B36BAA9F767"><enum>(5)</enum><text>the Vice President.</text></paragraph></section></title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8C056A2F070E4B05B9EC93E8F3036E41"><enum>4.</enum><header>Additional provisions relating to procurement officials</header> 
<subsection id="H0C6C5F2FBC6D4D7A9E5F90858DE670BC"><enum>(a)</enum><header>Elimination of loopholes that allow former Federal officials to accept compensation from contractors or related entities</header><text>Section 27(d) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(d)</external-xref>) is amended—</text> 
<paragraph id="HD9DFA83A6E4647A8A7F0D2515657E3F7"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H9E74B8EA428646208EF66B2F8F9D7D14"><enum>(A)</enum><text>by striking <quote>or consultant</quote> and inserting <quote>consultant, lawyer, or lobbyist</quote>;</text></subparagraph> 
<subparagraph id="HD4F1F54662684B799F90F318A0EE5FEE"><enum>(B)</enum><text>by striking <quote>one year</quote> and inserting <quote>two years</quote>; and</text></subparagraph> 
<subparagraph id="HA2CB8AE6E2B24237B57324E8B64DFEE0"><enum>(C)</enum><text>in subparagraph (C), by striking <quote>personally made for the Federal agency—</quote> and inserting <quote>participated personally and substantially in—</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H6EFF2A28723644D0A3C8390661EC1A0"><enum>(2)</enum><text>by amending paragraph (2) to read as follows:</text> 
<quoted-block style="OLC" id="H78E9B0C1CDF441D1934C6BE156B4CF1F" display-inline="no-display-inline"> 
<paragraph id="HA68B136FF85846E196C61296404C004C"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) shall not prohibit a former official of a Federal agency from accepting compensation from any division or affiliate of a contractor that does not produce the same or similar products or services as the entity of the contractor that is responsible for the contract referred to in subparagraph (A), (B), or (C) of such paragraph if the agency’s designated ethics officer determines that—</text> 
<subparagraph id="HA47035BEFDDC4C68B65CF0E3E411A155"><enum>(A)</enum><text>the offer of compensation is not a reward for any action described in paragraph (1); and</text></subparagraph> 
<subparagraph id="H3A4CA16065C94583B744A5FA4F170023"><enum>(B)</enum><text>acceptance of the compensation is appropriate and will not affect the integrity of the procurement process.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2E4AF7755F4B4FF58522F556F08FDA83"><enum>(b)</enum><header>Requirement for Federal Procurement Officers to Disclose Job Offers Made to Relatives</header><text>Section 27(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(c)(1)</external-xref>) is amended by inserting after <quote>that official</quote> the following: <quote>or for a relative of that official (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/3110">section 3110</external-xref> of title 5, United States Code),</quote>.</text></subsection> 
<subsection id="H73FCB899993A4566A6A76D7BB50000CC"><enum>(c)</enum><header>Requirement on award of government contracts to former employers</header><text display-inline="yes-display-inline">Section 27 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423</external-xref>) is amended by adding at the end the following new subsection: </text>

<subsection id="HD4639C4F83C146B6A1437ECC15DB58"><enum>(i)</enum><header>Prohibition on involvement by certain former contractor employees in procurements</header><text display-inline="yes-display-inline">An employee of the Federal Government who is a former employee of a contractor with the Federal Government shall not be personally and substantially involved with any award of a contract to the employee’s former employer, or the administration of such a contract, for the two-year period beginning on the date on which the employee leaves the employment of the contractor.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEA9843E513F24756A199152C67F05F0" commented="no"><enum>(d)</enum><header>Regulations</header><text>Section 27 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423</external-xref>) is further amended by adding at the end of the following new subsection:</text>

<paragraph id="H0CE20C658C404BC8BA3E55088262E029" commented="no"><enum>(1)</enum><text>promulgate regulations to carry out and ensure the enforcement of this section; and</text></paragraph> 
<paragraph id="HE37BF8B868F242338564428783751036" commented="no"><enum>(2)</enum><text>monitor and investigate individual and agency compliance with this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H5F20EC1251DD4B25915D05FFFFE2CB52"><enum>5.</enum><header>Prohibition on unauthorized expenditure of funds for publicity or propaganda purposes</header> 
<subsection id="H2B066661A3A047B2A8FFB3E20A400E8"><enum>(a)</enum><header>Prohibition</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/13">Chapter 13</external-xref> of title 31, United States Code, is amended by adding at the end the following new section:</text>

<section id="H7BC8D9AF5DDA46A790A3BCD5336D6C5"><enum>1355.</enum><header>Prohibition on unauthorized expenditure of funds for publicity or propaganda purposes</header><text display-inline="no-display-inline">An officer or employee of the United States Government may not make or authorize an expenditure or obligation of funds for publicity or propaganda purposes within the United States unless authorized by law.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3C68881C24AF47E29168DDFD169F54FE"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for chapter 13 of such title is amended by adding at the end the following new item:</text>

<subsection id="HD5F610741D774C738E9D69A098F96083"><enum>(a)</enum><header>Requirement</header><text>Each advertisement or other communication paid for by an Executive agency, either directly or through a contract awarded by the Executive agency, shall include a prominent notice informing the target audience that the advertisement or other communication is paid for by that Executive agency.</text></subsection> 
<subsection id="H41081E2409E24C9DA29B271B3FA3F061"><enum>(b)</enum><header>Advertisement or other communication</header><text>In this section, the term <quote>advertisement or other communication</quote> includes—</text> 
<paragraph id="H2032A5F2B7DD405E004192D9A1A8840"><enum>(1)</enum><text>an advertisement disseminated in any form, including print or by any electronic means; and</text></paragraph> 
<paragraph id="H7CBE32F5925F4D1681B9A356449C0265"><enum>(2)</enum><text>a communication by an individual in any form, including speech, print, or by any electronic means.</text></paragraph></subsection> 
<subsection id="H43F7D5BA3A4F4A2397B6003CCFE0597C" display-inline="no-display-inline"><enum>(c)</enum><header> Executive agency</header><text>In this section, the term <quote>Executive agency</quote> has the meaning provided in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text></subsection></section> 
<section id="HEC6E89EB6D2546158B10B0F2D8B6E2C"><enum>7.</enum><header>Elimination of <quote>pseudo</quote> classification</header> 
<subsection id="H4D386532CE434EEF0039ACE09AFE1CD"><enum>(a)</enum><header>Reports on the proliferating use of <quote>pseudo</quote> classification designations</header> 
<paragraph id="HE7006192294741FCA4BA05F082248D01"><enum>(1)</enum><header>Report by Federal agencies</header><text>Not later than six months after the date of the enactment of this Act, each federal agency shall submit to the Archivist of the United States and the congressional committees described in subsection (d) a report describing the use of <quote>pseudo</quote> classification designations. </text></paragraph> 
<paragraph id="HF93FB9CBB91A444985FE1E545BA369CA"><enum>(2)</enum><header>Matters covered</header><text>Each such agency shall report on, at a minimum, the following: </text> 
<subparagraph id="HB90D554BFFF5451FBAE775E33CF8572C"><enum>(A)</enum><text>The number of <quote>pseudo</quote>classification designation policies used by the agency.</text></subparagraph> 
<subparagraph id="H97D21B88D54A40EAB3DB00CDF5B7ECF"><enum>(B)</enum><text>Any existing guidance, instruction, directive, or regulations regarding the agency's use of <quote>pseudo</quote> classification designations. </text></subparagraph> 
<subparagraph id="H410A263DC0A24D7CB6DF5EFA23BF24F2"><enum>(C)</enum><text>The number and level of experience and training of Federal agency, office, and contractor personnel authorized to make <quote>pseudo</quote> classification designations. </text></subparagraph> 
<subparagraph id="H48EED20D9BAD4772A35EA636CBF0CEF2"><enum>(D)</enum><text>The cost of placing and maintaining information under each <quote>pseudo</quote> classification designation. </text></subparagraph> 
<subparagraph id="H70E9DB9F154F4C8282F61725728D8B3"><enum>(E)</enum><text>The extent to which information placed under <quote>pseudo</quote> classification designations has subsequently been released under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (popularly known as the Freedom of Information Act). </text></subparagraph> 
<subparagraph id="H1716AE46C65B4D9BB43DBC74606D9F36"><enum>(F)</enum><text>The extent to which <quote>pseudo</quote> classification designations have been used to withhold from the public information that is not authorized to be withheld by Federal statute, or by an Executive order relating to the classification of national security information. </text></subparagraph> 
<subparagraph id="HB617FE7615104A7C92CEA38150000A0"><enum>(G)</enum><text>The statutory provisions described in subsection (c). </text></subparagraph></paragraph> 
<paragraph id="H426F4B68B700437E98EFBA00E132B9"><enum>(3)</enum><header>Report by the Archivist of the United States</header><text>Not later than 9 months after the date of the enactment of this Act, the Archivist of the United States shall issue to the congressional committees described in subsection (d) a report on the use of <quote>pseudo</quote> classification designations across the executive branch that is based on the information provided by agencies, as well as input from the Director of National Intelligence, Federal agencies, offices, and contractors. All federal agencies, offices, and contractors shall cooperate fully and promptly with all requests by the Archivist in the fulfillment of this paragraph.</text></paragraph> 
<paragraph id="H81BCDD11CB1442D4BCAA8141FE68DC45"><enum>(4)</enum><header>Notice and comment</header><text>The Archivist shall provide notice and an opportunity for public comment on the report. </text></paragraph></subsection> 
<subsection id="HEBAE405A10F046BBA0567BE3F161E040"><enum>(b)</enum><header>Elimination of <quote>pseudo</quote> classification designations</header> 
<paragraph id="HFB2077DD328043AF88D96C902B84E2E7"><enum>(1)</enum><header>Regulations</header><text>Not later than 15 months after the date of the enactment of this Act, the Archivist of the United States shall promulgate regulations banning the use of <quote>pseudo</quote> classification designations. </text></paragraph> 
<paragraph id="HE608CE81228348058B9771CFD812916F"><enum>(2)</enum><header>Standards for information control designations</header><text>If the Archivist determines that there is a need for some agencies to use information control designations to safeguard information prior to review for disclosure, beyond those designations established by statute or by an Executive Order relating to the classification of national security information, the regulations under paragraph (1) shall establish standards for the use of those designations by agencies. Such standards shall address, at a minimum, the following issues: </text> 
<subparagraph id="H2F1AEDB199934C61A17C270000FAE341"><enum>(A)</enum><text>Standards for utilizing the information control designations in a manner that is narrowly tailored to maximize public access to information. </text></subparagraph> 
<subparagraph id="HD9AA02CA259540FF9C88C2EB8FF99EAE"><enum>(B)</enum><text>Procedures for providing specified Federal officials with authority to utilize the information control designations, including training and certification requirements. </text></subparagraph> 
<subparagraph id="H3A6C9F0C132E42ACA4DD70179EC800C4"><enum>(C)</enum><text>Categories of information that may be assigned the information control designations. </text></subparagraph> 
<subparagraph id="H7C85C333D7A74679A007AF92B1B79B21"><enum>(D)</enum><text>The duration of the information control designations and the process by which they will be removed. </text></subparagraph> 
<subparagraph id="HB7CAABD0BFED4DEC9ED7CCE5D08DDA92"><enum>(E)</enum><text>Procedures for identifying, marking, dating, and tracking information assigned the information control designations, including the identity of officials making the designations. </text></subparagraph> 
<subparagraph id="H53BDB4DD4263485FB18C3166FE00A723"><enum>(F)</enum><text>Specific limitations and prohibitions against using the information control designations. </text></subparagraph> 
<subparagraph id="H373EA41F5F4C4607A818437477710200"><enum>(G)</enum><text>Procedures for members of the public to challenge the use of the information control designations. </text></subparagraph> 
<subparagraph id="H9D5DB1089FD74651B7AE3B674C392967"><enum>(H)</enum><text>The manner in which the use of the information control designations relates to the procedures of each agency or office under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code. </text></subparagraph></paragraph> 
<paragraph id="H0CDC9787580444D097AC6934215DB81B"><enum>(3)</enum><header>Regulation to constitute sole authority</header><text>A regulation promulgated pursuant to this subsection shall constitute the sole authority by which Federal agencies, offices, or contractors are permitted to control information for the purposes of safeguarding information prior to review for disclosure, other than authority granted by Federal statute or by an Executive order relating to the classification of national security information. </text></paragraph></subsection> 
<subsection id="H1EECC38227874977BA09A6996C188296"><enum>(c)</enum><header>Review of statutory barriers to public access information</header><text></text> 
<paragraph id="HE72B2E59C2FD4831A60036D29DB663FD"><enum>(1)</enum><header>Review of statutes</header><text>As part of the report required under subsection (a)(3), the Archivist shall examine existing Federal statutes that allow Federal agencies, offices, or contractors to control, protect, or otherwise withhold information based on security concerns. </text></paragraph> 
<paragraph id="H944F8AD8601D4D3E9CD1A0BB7D6625CD"><enum>(2)</enum><header>Recommendations</header><text>The report shall make recommendations on potential changes to the Federal statutes examined under paragraph (1) that would improve public access to information governed by such statutes. </text></paragraph></subsection> 
<subsection id="H597A7E37D2C84641BB86613E1EB0B0CD"><enum>(d)</enum><header>Definitions</header><text>In this section: </text> 
<paragraph id="H284C355407774770ACA500AA92F6595D"><enum>(1)</enum><text>The term <quote>congressional committees</quote> means the Committees on Government Reform, Judiciary, Homeland Security, and Appropriations of the House of Representatives and the Committees on Homeland Security and Governmental Affairs, Judiciary, and Appropriations of the Senate. </text></paragraph> 
<paragraph id="H113268D1D169417DBF1B96BA9079A188"><enum>(2)</enum><text>The term <quote><quote>pseudo</quote> classification designations</quote> means information control designations, including <quote>sensitive but unclassified</quote> and <quote>for official use only</quote>, that are not defined by Federal statute, or by an Executive order relating to the classification of national security information, but that are used to manage, direct, or route Government information, or control the accessibility of Government information, regardless of its form or format.</text></paragraph></subsection></section> 
<section id="HFC782A3E97DF4F7BA5815B22BA118816"><enum>8.</enum><header>National security whistleblower rights</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/23">Chapter 23</external-xref> of title 5, United States Code, is amended by adding after section 2303 the following new section:</text> 
<quoted-block style="USC" id="H89ED7C596A9C4A6FB40083FFA6922A3" display-inline="no-display-inline"> 
<section id="HC2E89214F2204B518ED155395E0536EE"><enum>2303a.</enum><header>National security whistleblower rights</header> 
<subsection id="HE3B82189571145DA89571EE687F36B24"><enum>(a)</enum><header>Prohibition of reprisals</header><text display-inline="yes-display-inline">In addition to any rights provided in Title VII of <external-xref legal-doc="public-law" parsable-cite="pl/105/272">Public Law 105–272</external-xref>, <external-xref legal-doc="usc" parsable-cite="usc/5/2303">section 2303</external-xref> of title 5, United States Code, or any other law, an employee or applicant for employment of a covered agency may not be discharged, demoted, or otherwise discriminated against, including denying, suspending, or revoking a security clearance or otherwise restricting access to classified or sensitive information, as a reprisal for disclosing covered information to an authorized Member of Congress or to an authorized official of an executive agency, the Department of Justice, or the Inspector General of the employee’s employing covered agency. </text></subsection> 
<subsection id="HD2764DE11ED64F37B1EC63A7DAA534A8"><enum>(b)</enum><header>Investigation of complaints</header><text>An employee or applicant for employment of a covered agency who believes he has been subjected to a reprisal prohibited by subsection (a) may submit a complaint to the Inspector General and head of the covered agency. The Inspector General shall investigate the complaint and, unless the Inspector General determines that the complaint is frivolous, submit a report of the findings of the investigation within 180 days to the employee or applicant for employment and the head of the covered agency. </text></subsection> 
<subsection id="HA9581988F78645F7BD07F5A73C81A1DE"><enum>(c)</enum><header>Remedy</header> 
<paragraph id="H05FC26E3E2734175BE341DF392C00B7"><enum>(1)</enum><text>Within 210 days of the filing of the complaint, the head of the covered agency shall issue an order accepting or rejecting the complaint, or portions thereof, taking into consideration the report issued by the Inspector General under subsection (b), if any. If the head of the covered agency accepts the complaint, he shall implement corrective action to return the complainant, as nearly as possible, to the position he would have held had the reprisal not occurred, including voiding any directive or order denying, suspending, or revoking a security clearance or otherwise restricting access to classified or sensitive information that constituted a reprisal, as well as providing back pay and related benefits, medical costs incurred, travel expenses, and any other reasonable and foreseeable consequential damages including attorney’s fees and costs. If the head of the covered agency rejects the complaint, he shall issue a report to the employee or applicant for employment detailing the reasons for the rejection. </text></paragraph> 
<paragraph id="HC3B7BD0EEEB246E5B11809D38C3C00CA"><enum>(2)</enum> 
<subparagraph id="HC05F5EBF190B40058999169817C17822" display-inline="yes-display-inline"><enum>(A)</enum><text>If the head of the covered agency, in the process of implementing corrective action under (c)(1), voids a directive or order denying, suspending, or revoking a security clearance or otherwise restricting access to classified or sensitive information that constituted a reprisal, the head of the covered agency may re-initiate procedures to issue a directive or order denying, suspending, or revoking a security clearance or otherwise restricting access to classified or sensitive information only if those re-initiated procedures are based exclusively on national security concerns and are unrelated to the actions constituting the original reprisal. </text></subparagraph> 
<subparagraph id="H8A87837CEEC14D28925F49566694ABE7" indent="up1"><enum>(B)</enum><text>In any case in which the head of a covered agency re-initiates procedures under (2)(A), the head of the covered agency shall issue an unclassified report to its IG and authorized members of Congress (with a classified annex if necessary), detailing the circumstances of the agency’s re-initiated procedures and describing the manner in which those procedures are based exclusively on national security concerns and are unrelated to the actions constituting the original reprisal. The head of the covered agency shall also provide periodic updates to the IG and authorized members of Congress detailing any significant actions taken as a result of those procedures, and shall respond promptly to inquiries from authorized Members of Congress regarding the status of those procedures. </text></subparagraph></paragraph> 
<paragraph id="H054FB36D87C64EF0AB87A94453A7BB58"><enum>(3)</enum><text>If the head of the covered agency has not accepted or rejected the complaint within 210 days of the filing of the complaint, and there is no showing that such delay is due to the bad faith of the complainant, the complainant shall be deemed to have exhausted his or her administrative remedies with respect to the complaint, and the complainant may bring an action at law or equity for de novo review to seek any relief described in (c)(1) in the appropriate district court of the United States, which shall have jurisdiction over such action without regard to the amount in controversy. A petition to review a final decision under this subsection shall be filed in the United States Court of Appeals for the Federal Circuit. </text></paragraph> 
<paragraph id="H709DFD1197EC4DD497D7AFCAC5CD3882"><enum>(4)</enum><text>The complainant may obtain review of any order issued under this section in the appropriate district court of the United States or the United States Court of Appeals for the Federal Circuit. No petition seeking such review may be filed more than 60 days after issuance of the order by the head of the agency. Review shall conform to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5. A petition to review a final decision of a district court under this subsection shall be filed in the United States Court of Appeals for the Federal Circuit. </text></paragraph> 
<paragraph id="H2057AA2E74774C45B59B2CDA0063332B"><enum>(5)</enum> 
<subparagraph id="H73F970B0056B4151B268D1000231B01B" display-inline="yes-display-inline"><enum>(A)</enum><text>If, in any action for damages or relief under subsections (c)(3) or (c)(4), an executive branch agency moves to withhold information from discovery based on a claim that disclosure would be inimical to national security by asserting the privilege commonly referred to as the “state secrets privilege,” and if the assertion of such privilege prevents the plaintiff from establishing an element in support of the plaintiff’s claim, the court shall resolve the disputed issue of fact or law in favor of the plaintiff, provided that an inspector general investigation under subsection (b) has resulted in substantial confirmation of that element, or those elements, of the plaintiff’s claim. </text></subparagraph> 
<subparagraph id="H8F0F1B0B3E3D4DD195EA567777A59F5B" indent="up1"><enum>(B)</enum><text>In any case in which an executive branch agency asserts the privilege commonly referred to as the “state secrets privilege,” whether or not an inspector general has conducted an investigation under subsection (b), the head of that agency shall, at the same time it asserts the privilege, issue a report to authorized Members of Congress, accompanied by a classified annex if necessary, describing the reasons for the assertion, explaining why the court hearing the matter does not have the ability to maintain the protection of classified information related to the assertion, detailing the steps the agency has taken to arrive at a mutually agreeable settlement with the employee or applicant for employment, setting forth the date on which the classified information at issue will be declassified, and providing all relevant information about the underlying substantive matter. </text></subparagraph></paragraph></subsection> 
<subsection id="H601C50E449874366B34959AFAF4385B"><enum>(d)</enum><header>Construction</header><text>Nothing in this section may be construed to authorize the discharge of, demotion of, or discrimination against an employee for a disclosure other than a disclosure protected by subsection (a) of this section or to modify or derogate from a right or remedy otherwise available to the employee or applicant for employment. </text></subsection> 
<subsection id="HDA73F09D187448EDA293694B48721C37"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HB62F8FA747804254A270E4A7D1D7309"><enum>(1)</enum><text>The term “covered information,” including classified information, is information that an employee reasonably believes to provide direct and specific evidence of—</text> 
<subparagraph id="H50F1AA1712B0454D8E5EB2C92588A69F"><enum>(A)</enum><text>a violation of any law, rule, or regulation, or</text></subparagraph> 
<subparagraph id="H3F65878110B94E2DA7F83485864F343E"><enum>(B)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety. </text></subparagraph></paragraph> 
<paragraph id="HDCBB7FEAF6BB4753B16EE90070CE4828"><enum>(2)</enum><text>The term “covered agency” means one of the following:</text> 
<subparagraph id="HB8561BA2FB0348BF92357F7C49ECE37"><enum>(A)</enum><text>The Central Intelligence Agency.</text></subparagraph> 
<subparagraph id="HCF852C59FABD4DC891644277FF124CF0"><enum>(B)</enum><text>The Defense Intelligence Agency.</text></subparagraph> 
<subparagraph id="HFDECB11B70DA4F11A5869236753C13BC"><enum>(C)</enum><text>The National Imagery and Mapping Agency.</text></subparagraph> 
<subparagraph id="H96C16A75494B4CA5A11DC7330024A745"><enum>(D)</enum><text>The National Security Agency.</text></subparagraph> 
<subparagraph id="H0D7514EF4D5D4C22808925F100D524FC"><enum>(E)</enum><text>The Federal Bureau of Investigation.</text></subparagraph> 
<subparagraph id="H66CD5B5DDBD04A3795002834F380B854"><enum>(F)</enum><text>The National Reconnaissance Office.</text></subparagraph> 
<subparagraph id="HB72305ADF20F4F3BA29F04A097CD83F1"><enum>(G)</enum><text>Any other Executive agency, or element or unit thereof, determined by the President under <external-xref legal-doc="usc" parsable-cite="usc/5/2302">section 2302(a)(2)(C)(ii)</external-xref> of title 5, United States Code, to have as its principal function the conduct of foreign intelligence or counterintelligence activities.</text></subparagraph></paragraph> 
<paragraph id="H731E46970329436C92EB995FC35C95E1"><enum>(3)</enum><text>The term “authorized member of Congress” means a member of the House Permanent Select Committee on Intelligence, the Senate Select Committee on Intelligence, the House Committee on Government Reform, the Senate Committee on Homeland Security and Governmental Affairs, and the committees of the House of Representatives or the Senate that have oversight over the program about which the covered information is disclosed.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
