		  other purposes of water produced in connection with development of energy

		<section display-inline="no-display-inline" id="H798F6B2D2B0F410D916D1CD74BB16BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>More Water and More Energy Act of
			 2006</short-title></quote>.</text>
		</section><section id="H5E4D42ABA6D84F40BDC8DF50F51F902C"><enum>2.</enum><header>Produced
			 water</header><text display-inline="no-display-inline">The Water Resources
			 Research Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10301">42 U.S.C. 10301 et seq.</external-xref>) is
			 amended by adding at the end thereof a new section, as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HD306F0D4FE084A08B2FB6BFF4C1455E7" style="OLC">
				<section id="H083EDF5CB1E44A37B9F0D254DC6EBB3"><enum>112.</enum><header>Produced
				water</header>
					<subsection id="H99F0E01EC2794A02B8DEF234A5A36CA"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary, acting through the
				Commissioner of Reclamation and the Director of the United States Geological
				Survey, shall conduct a study to identify—</text>
						<paragraph id="H0DEDEE38EC7E49EB96E78059636C95C0"><enum>(1)</enum><text>the technical,
				economic, environmental (including potential adverse effects on water quality),
				legal, and other obstacles to increasing the extent to which produced water can
				be used for irrigation and other purposes; and</text>
						</paragraph><paragraph id="H878759AF58C74CEA9670B772C61EDA00"><enum>(2)</enum><text>the legislative,
				administrative, and other actions that could reduce or eliminate such
				obstacles.</text>
						</paragraph></subsection><subsection id="H3522A25C6DA94596BD833D65E00069E8"><enum>(b)</enum><header>Report</header><text>Not
				later than one year after the date of the enactment of this section, the
				Secretary shall report to the Committee on Resources of the House of
				Representatives and the Committee on Energy and Natural Resources of the Senate
				regarding the results of the study required by this section.</text>
					</subsection><subsection id="HBD7EE253F0E9449190D3A5CF92AFB17C"><enum>(c)</enum><header>Projects
				authorized</header>
						<paragraph id="HA9103A89351143D9831D2011B611C206"><enum>(1)</enum><text>In the
				implementation of authority available to the Secretary prior to the date of
				enactment of this section and subject to the availability of funds appropriated
				for the purpose, the following projects are authorized:</text>
							<subparagraph id="H96CDC8A54B6F46A8BCB349672FA1555D"><enum>(A)</enum><text>At least one
				project in one of the Upper Basin States.</text>
							</subparagraph><subparagraph id="HF7BCD28D8AE84F0D99F855ACFD309F76"><enum>(B)</enum><text>At least one
				project in one of the Lower Basin States other than California.</text>
							</subparagraph><subparagraph id="H8D30E23DDBF24FF3AA4C199CD8B95E70"><enum>(C)</enum><text>At least one
				project in California.</text>
							</subparagraph></paragraph><paragraph id="H61ED6B67C32C4D019C5700C6DFD63F44"><enum>(2)</enum><text>Funds obligated
				under this subsection—</text>
							<subparagraph id="HDF4520465C55499DB8949B60B55DBA16"><enum>(A)</enum><text>shall not exceed
				$1,000,000 for any project;</text>
							</subparagraph><subparagraph id="H29298BD381834F0386438DEB78EE0004"><enum>(B)</enum><text>shall be used to
				pay not more than 50 percent of the total cost of a project;</text>
							</subparagraph><subparagraph id="H78F3E5167B214413AAD5AFC846CB71DF"><enum>(C)</enum><text>shall not be used
				for operation or maintenance of any facility; and</text>
							</subparagraph><subparagraph id="HB9169199614C41BAB35B3118F020FD95"><enum>(D)</enum><text>may be in addition
				to assistance provided by the United States pursuant to other provisions of
				law.</text>
							</subparagraph></paragraph></subsection><subsection id="HE6B4C2194D6F487084813B8EF567CB4C"><enum>(d)</enum><header>Additional
				consultation, review, advice, and comment</header><text>In implementing this
				section, including preparation of the report required by subsection (b) and the
				establishment of criteria to be used in connection with award of assistance
				pursuant to subsection (c), the Secretary shall—</text>
						<paragraph id="H397023CB5F14402087119CE3C30836EF"><enum>(1)</enum><text>consult with the
				Secretary of Energy, the Administrator of the Environmental Protection Agency,
				and appropriate Governors and local officials;</text>
						</paragraph><paragraph id="H8C5F49529C174EE186865DB5EBF79DA6"><enum>(2)</enum><text>review any
				relevant information developed in connection with research carried out by
				others, including research carried out pursuant to section 999 of
				Public Law
				109–58, and to the extent the Secretary considers advisable
				include such information in the report required by paragraph (3);</text>
						</paragraph><paragraph id="H33D61DC066C14D5CA11F7F91A400FB4C"><enum>(3)</enum><text>seek the advice of
				individuals with relevant professional or academic expertise and of companies
				or individuals with industrial experience, particularly experience related to
				production of oil, natural gas, or other energy resources, including geothermal
				resources; and</text>
						</paragraph><paragraph id="H380F2F05DB03409098A00007A05B49B"><enum>(4)</enum><text>solicit comments
				and suggestions from the public.</text>
						</paragraph></subsection><subsection id="H4ABAA53898C949A2A3CC3629F1F1BFEF"><enum>(e)</enum><header>Relationship to
				State laws and interstate authorities and compacts</header><text>Nothing in
				this section shall be construed as superseding, modifying, abrogating, or
				limiting—</text>
						<paragraph id="H84E6DA39BFA848AE9BB12B7560009E8B"><enum>(1)</enum><text>the effect of any
				State law or any interstate authority or compact with regard to any use of
				water or the regulation of water quantity or quality; or</text>
						</paragraph><paragraph id="HFB3F60726C2947E3BA9BDD46CDAE1287"><enum>(2)</enum><text>the applicability
				or effect of any Federal law or regulation.</text>
						</paragraph></subsection><subsection id="H588333942FFE440F98F6B24449E2B352"><enum>(f)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="HDC6A3A6CB4CF46F9AA254E853406BD84"><enum>(1)</enum><text>The term
				<quote>produced water</quote> means water from an underground source, that is
				brought to the surface as part of the process of exploration for or development
				of oil, natural gas, coalbed methane, or any other substance to be used as an
				energy source.</text>
						</paragraph><paragraph id="H6272D6C72D964A6199C494A850D9BB87"><enum>(2)</enum><text>The term
				<quote>Secretary</quote> means the Secretary of the Interior.</text>
						</paragraph><paragraph id="HA30874217DCD49579C319F744395CFF4"><enum>(3)</enum><text>The term
				<quote>Upper Basin States</quote> means the States of Colorado, New Mexico,
				Utah, and Wyoming.</text>
						</paragraph><paragraph id="H713AB90545F4404385C8A99173E12F19"><enum>(4)</enum><text>The term
				<quote>Lower Basin States</quote> means the States of Arizona, California, and
				Nevada.</text>
						</paragraph><paragraph id="H3FD4D38C24E64387BF4C2BC5DE2BE6E6"><enum>(5)</enum><text>The term
				<quote>project</quote> means the provision of financial assistance for the
				development of a facility to demonstrate the feasibility, effectiveness, and
				safety of processes to increase the extent to which produced water may be
				recovered and made suitable for use for irrigation, municipal or industrial
				uses, or other purposes.</text>
						</paragraph></subsection><subsection id="H222E71A7D8D14D3ABF5E64352F44657E"><enum>(g)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated—</text>
						<paragraph id="H61B03215B8DA4F53AB69F7B38901803D"><enum>(1)</enum><text display-inline="yes-display-inline">$1,000,000 to carry out the study required
				by subsection (a); and</text>
						</paragraph><paragraph id="HF956574A5B2D4F159689C475000077CD"><enum>(2)</enum><text display-inline="yes-display-inline">$5,000,000 to carry out the other
				provisions of this
				section.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
