<section id="H1C3D03991C87453A000835665DEBC198" section-type="section-one"><enum>1.</enum><header>Short title, findings, and purpose</header> 
<subsection id="HF0BB9A5852BA4DF685B0FB2377B8BCD0"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>More Water and More Energy Act of 2006</short-title></quote>.</text></subsection> 
<subsection id="H4E222E7D0B4C4085B9E4BA6C7143D55E"><enum>(b)</enum><header>Findings</header><text>The Congress finds the following:</text> 
<paragraph id="H6E9ED67D1897416EB553601FF16F70F2"><enum>(1)</enum><text>Development of energy resources, including oil, natural gas, and coalbed methane, frequently results in bringing to the surface water extracted from underground sources.</text> </paragraph> 
<paragraph id="H1F9AFBC11C1D4B1BAD4268EDA86C39E8"><enum>(2)</enum><text>Some of this produced water is used for irrigation or other purposes, but most of it is returned to the subsurface.</text> </paragraph> 
<paragraph id="H2EFC144806024F6BBDCD9ED34DEADFBE"><enum>(3)</enum><text>Reducing the amount of produced water returned to the subsurface, and increasing the amount that is made available for irrigation and other uses—</text> 
<subparagraph id="HF14F1991F3DB4A31B8F800101CA4ECE8"><enum>(A)</enum><text>would augment water supplies;</text></subparagraph> 
<subparagraph id="H97AD35AA97D1493C868DB2914838DC3"><enum>(B)</enum><text>could reduce the costs to energy developers for disposing of such water; and</text></subparagraph> 
<subparagraph id="H0F9130F9EC5F451BA961DC1576B2F5A9"><enum>(C)</enum><text>in some instances could increase the efficiency of energy development activities.</text></subparagraph></paragraph> 
<paragraph id="H7E098A72A2A04C32B976E478C9A3898D"><enum>(4)</enum><text>Removing or reducing the technical, economic, environmental, legal, and other factors that impede use of produced water for irrigation and other purposes is in the national interest.</text></paragraph></subsection> 
<subsection id="HCD80B4AB64A44609A66F130567188D63"><enum>(c)</enum><header>Purpose</header><text>The purpose of this Act is to facilitate the use of produced water for irrigation and other purposes and to demonstrate ways to accomplish that result.</text></subsection></section> 
<section id="H6FA41C5740AF4A34AB887435E58372D6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H67C67E216D834E738300325236DB0105"><enum>(1)</enum><header>Produced water</header><text>The term <quote>produced water</quote> means water from an underground source, that is brought to the surface as part of the process of exploration for or development of oil, natural gas, coalbed methane, or any other substance to be used as an energy source.</text> </paragraph> 
<paragraph id="HE0964CD145AA46AA82996CB0005722A0"><enum>(2)</enum><header>Secretary</header><text>The term <quote>the Secretary</quote> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HF23C1D306AC34DE187C263DA27A3C4D8"><enum>(3)</enum><header>Upper Basin States</header><text>The term <quote>Upper Basin States</quote> means the States of Colorado, New Mexico, Utah, and Wyoming.</text></paragraph> 
<paragraph id="H2340C597E4B848A9B610C0F77616AA66"><enum>(4)</enum><header>Lower Basin States</header><text>The term <quote>Lower Basin States</quote> means the States of Arizona, California, and Nevada.</text></paragraph></section> 
<section id="H70D4C134B3CF40FBBBE375C11CFEC0C9"><enum>3.</enum><header>Identification of problems and solutions</header> 
<subsection id="H8DB53A6AFD614595A389000051C125F"><enum>(a)</enum><header>Study</header> 
<paragraph id="H3BBDAD491932401295153D192503D58F"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Commissioner of Reclamation and the Director of the United States Geological Survey, shall conduct a study to identify—</text> 
<subparagraph id="HED2C65648084439390EEE769C1A1AD1C"><enum>(A)</enum><text>the technical, economic, environmental, legal, and other obstacles to increasing the extent to which produced water can be used for irrigation and other purposes; and</text></subparagraph> 
<subparagraph id="H133D0C0FEFBF454FBFE0EAF430991BF4"><enum>(B)</enum><text>the legislative, administrative, and other actions that could reduce or eliminate such obstacles.</text></subparagraph></paragraph> 
<paragraph id="H9129D45045C24CDC94C4D21C9DFBC59"><enum>(2)</enum><header>Consultation, advice, and comments</header><text>In implementing this subsection, the Secretary—</text> 
<subparagraph id="HA4583D224C2141C4957D938427008145"><enum>(A)</enum><text>shall consult with the Secretary of Energy, the Administrator of the Environmental Protection Agency, and appropriate Governors and local officials;</text></subparagraph> 
<subparagraph id="H4BF48333AB8143578900637CDE22DB6B"><enum>(B)</enum><text>shall seek the advice of individuals with relevant professional and industrial experience or academic expertise; and</text></subparagraph> 
<subparagraph id="H684B02476F454CED93DDB02D486C21F8"><enum>(C)</enum><text>shall solicit comments and suggestions from the public.</text></subparagraph></paragraph></subsection> 
<subsection id="H8A03C8447CF44900883CB909C1E5E723"><enum>(b)</enum><header>Report</header><text>Not later than one year after the date of the enactment of this Act, the Secretary shall report to the Committee on Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate regarding the results of the study required by this section.</text></subsection></section> 
<section id="H85288D40DEA64F1CBEB88BB123CC2D1"><enum>4.</enum><header>Demonstration projects</header> 
<subsection id="HC8B748F6DFEE49F3A9CD00FD460983E7"><enum>(a)</enum><header>Grants</header><text>Subject to the availability of funds appropriated for the purpose, the Secretary shall award grants to assist in the development of facilities to demonstrate the feasibility, effectiveness, and safety of processes to increase the extent to which produced water may be recovered and made suitable for use for irrigation, municipal or industrial uses, or other purposes.</text></subsection> 
<subsection id="HE7DC4127C33847AF81AB8241715F4CB3"><enum>(b)</enum><header>Limitations</header><text>Grants under this section—</text> 
<paragraph id="H6F036C3463574667812622413D8E308B"><enum>(1)</enum><text>shall be provided for—</text> 
<subparagraph id="HD6ABBEFE6FF1408C81CCC121DDAA6BAE"><enum>(A)</enum><text>no more than one project in one of the Upper Basin States;</text></subparagraph> 
<subparagraph id="H7D262C304C8C4738B2EFA5DCE8C47C49"><enum>(B)</enum><text>no more than one project in one of the Lower Basin States other than California; and</text></subparagraph> 
<subparagraph id="H2EC316303DF7477DB7ED70EAF261A649"><enum>(C)</enum><text>no more than one project in California;</text></subparagraph></paragraph> 
<paragraph id="H383CCDD8976947E99131DA7C6394B83E"><enum>(2)</enum><text>shall not exceed $1,000,000 for any project;</text></paragraph> 
<paragraph id="H331B7F1BE7A84C538BA66DA0664D1222"><enum>(3)</enum><text>shall be used to pay not more than 50 percent of the total cost of a project carried out with such grants; and</text></paragraph> 
<paragraph id="H7532EEE7BA384019B441813100AA057B"><enum>(4)</enum><text>shall not be used for operation or maintenance of any facility.</text></paragraph></subsection></section> 
<section id="HA7CAAA39C2EC4B659F63E20010E897CD"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text> 
<paragraph id="H3BF83FA802A1455BA9D9148EB9DEBB90"><enum>(1)</enum><text>such sums as may be required to implement section 3; and</text></paragraph> 
<paragraph id="HA8493197EAA54B6B8410F43D714DCF2E"><enum>(2)</enum><text>$5,000,000 to implement section 4.</text></paragraph></section>
