<section id="H5BE489144C504AF9AD4F9E7D7606255B" section-type="section-one"><enum>1.</enum><header>Short title; reference</header> 
<subsection id="HF62944D1DAA14F9799387245AA946662"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Graduate Opportunities in Higher Education Act of 2005</short-title></quote>.</text></subsection> 
<subsection id="H0BC835447A864E42AD7602C5EC8CD37E"><enum>(b)</enum><header>References</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>).</text></subsection></section> 
<section id="H7ACCDCBB212549A6819ED670E66521BC" display-inline="no-display-inline"><enum>2.</enum><header>Javits fellowship program</header> 
<subsection id="H95737E188BF646FBB300022E41D100F1"><enum>(a)</enum><header>Interruptions of study</header><text>Section 701(c) (<external-xref legal-doc="usc" parsable-cite="usc/20/1134">20 U.S.C. 1134(c)</external-xref>) is amended by adding at the end the following new sentence: <quote>In the case of other exceptional circumstances, such as active duty military service or personal or family member illness, the institution of higher education may also permit the fellowship recipient to interrupt periods of study for the duration of the tour of duty (in the case of military service) or not more than 12 months (in any other case), but without payment of the stipend.</quote>.</text></subsection> 
<subsection id="H8DB0E1325E784452B3D2642405E85FC"><enum>(b)</enum><header>Allocation of fellowships</header><text>Section 702(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/20/1134a">20 U.S.C. 1134a(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H92F4588337D74D9D82FA20580717C67"><enum>(1)</enum><text>in the first sentence, by inserting <quote>from diverse geographic regions</quote> after <quote>higher education</quote>; and</text></paragraph> 
<paragraph id="H2A5D3C3D9F29467197BA7400AB6410D9"><enum>(2)</enum><text>by adding at the end the following new sentence: <quote>The Secretary shall also assure that at least one representative appointed to the Board represents an institution that is eligible for a grant under title III or V of this Act.</quote>.</text></paragraph></subsection> 
<subsection id="HA958AC8709F64CC9B2CDDFAE03127D21"><enum>(c)</enum><header>Stipends</header><text>Section 703 (<external-xref legal-doc="usc" parsable-cite="usc/20/1134b">20 U.S.C. 1134b(a)</external-xref>) is amended—</text> 
<paragraph id="H5B50B6AF0E6946808B86438089049066"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H30F06828AFBB41CEA9106E1B69AF33AB"><enum>(A)</enum><text>by striking <quote>1999–2000</quote> and inserting <quote>2006–2007</quote>;</text></subparagraph> 
<subparagraph id="HB06440B763CE49B9AC29FBEF0078AA2"><enum>(B)</enum><text>by striking <quote>shall be set</quote> and inserting <quote>may be set</quote>; and</text></subparagraph> 
<subparagraph id="HDD683A4FE4334E5285CE2FBBA2381180"><enum>(C)</enum><text>by striking <quote>Foundation graduate fellowships</quote> and inserting <quote>Foundation Graduate Research Fellowship Program</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H4A6ACFB2CDB246B5B044CF23C9C5EFF"><enum>(2)</enum><text>in subsection (b), by amending paragraph (1)(A) to read as follows:</text>

<paragraph id="HCEFA2F82093C4156B86800AE32B57D07"><enum>(1)</enum><header>In general</header> 
<subparagraph display-inline="yes-display-inline" id="HDFC42F35AA6044C9A37C2789661123A1"><enum>(A)</enum><text>The Secretary shall (in addition to stipends paid to individuals under this subpart) pay to the institution of higher education, for each individual awarded a fellowship under this subpart at such institution, an institutional allowance. Except as provided in subparagraph (B), such allowance shall be, for 2006–2007 and succeeding academic years, the same amount as the institutional payment made for 2005–2006 adjusted for 2006–2007 and annually thereafter in accordance with inflation as determined by the Department of Labor’s Consumer Price Index for the previous calendar year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAC76D28BABB1408B99E6B41FA6EAD63"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 705 (<external-xref legal-doc="usc" parsable-cite="usc/20/1134d">20 U.S.C. 1134d</external-xref>) is amended by striking <quote>fiscal year 1999 and such sums as may be necessary for each of the 4 succeeding fiscal years</quote> and inserting <quote>fiscal year 2006 and such sums as may be necessary for each of the 5 succeeding fiscal years</quote>.</text></subsection></section> 
<section id="H6801000D7B7249CB8F00C52473A91DB0"><enum>3.</enum><header>Graduate assistance in areas of national need</header> 
<subsection id="HD47A6C2DBE674BCB8166253534E7BEC8"><enum>(a)</enum><header>Designation of areas of national need; priority</header><text>Section 712 (<external-xref legal-doc="usc" parsable-cite="usc/20/1135a">20 U.S.C. 1135a</external-xref>) is amended—</text> 
<paragraph id="H628F5654F2F1416B89A68D88249113F4"><enum>(1)</enum><text>in the last sentence of subsection (b)—</text> 
<subparagraph id="H3A1856FCCF47489A9C9674794FA58E00"><enum>(A)</enum><text>by striking <quote>and an assessment</quote> and inserting <quote>an assessment</quote>; and</text></subparagraph> 
<subparagraph id="HCC4CF48A068143F4BD82EED67D1900E9"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, and the priority described in subsection (c) of this section</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HA062F99D411844E39785285D6F9F45E5"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H9A9D7F118E024A179000E65F84EE42C4"><enum>(c)</enum><header>Priority</header><text>The Secretary shall establish a priority for grants in order to prepare individuals for the professoriate who will train highly-qualified elementary and secondary school teachers of math, science, and special education, and teachers who provide instruction for limited English proficient individuals. Such grants shall offer program assistance and graduate fellowships for—</text> 
<paragraph id="HF5B7F74D99634298A83ECA2409EBAF0"><enum>(1)</enum><text>post-baccalaureate study related to teacher preparation and pedagogy in math and science for students who have completed a master’s degree or are pursuing a doctorate of philosophy in math and science;</text></paragraph> 
<paragraph id="H6C9F7E519A434BC5AA3E13BC48956386"><enum>(2)</enum><text>post-baccalaureate study related to teacher preparation and pedagogy in special education and English language acquisition and academic proficiency for limited English proficient individuals; and</text></paragraph> 
<paragraph id="HC4916D3408994ABDA393007104785580"><enum>(3)</enum><text>support of dissertation research in the fields of math, science, special education, or second language pedagogy and second language acquisition.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H18AA90D702AB43AC94EA14E07446DBAE"><enum>(b)</enum><header>Collaboration required for certain applications</header><text>Section 713(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/1135b">20 U.S.C. 1135b</external-xref>) is amended—</text> 
<paragraph id="H21CA394F446448EC9B6400A586BBA971"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (9);</text></paragraph> 
<paragraph id="HC2E2D5F0A20A40F5883BD7B161CE2F3"><enum>(2)</enum><text>by redesignating paragraph (10) as paragraph (11); and</text></paragraph> 
<paragraph id="H9F36CBBB563140FD86F419D85EF497A1"><enum>(3)</enum><text>by inserting after paragraph (9) the following new paragraph:</text>

<subsection id="HD6E593098D7E41EB9E26A33DE262879B"><enum>(c)</enum><header>Stipends</header><text>Section 714(b) (<external-xref legal-doc="usc" parsable-cite="usc/20/1135c">20 U.S.C. 1135c(b)</external-xref>) is amended—</text> 
<paragraph id="HDCF4B85D52E54940AFCB40FF856BA28F"><enum>(1)</enum><text>by striking <quote>1999–2000</quote> and inserting <quote>2006–2007</quote>;</text></paragraph> 
<paragraph id="H0FF00C5C7BF443A78283CE09247E29BE"><enum>(2)</enum><text>by striking <quote>shall be set</quote> and inserting <quote>may be set</quote>; and</text></paragraph>

<section id="HCE0720FB4371488EBF5EBB2A89926E2"><enum>4.</enum><header>Thurgood marshall legal educational opportunity program</header> 
<subsection id="H263ED5501DF142C9836873988E018C26"><enum>(a)</enum><header>Contract and grant purposes</header><text>Section 721(c) (<external-xref legal-doc="usc" parsable-cite="usc/20/1136">20 U.S.C. 1136(c)</external-xref>) is amended—</text> 
<paragraph id="H133D31DE4E584AE8BC055840C2EAC65"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text>

<subsection id="HB994820CF41F46A188B6B1DA307B86DD"><enum>(b)</enum><header>Services provided</header><text>Section 721(d)(1)(D) (<external-xref legal-doc="usc" parsable-cite="usc/20/1136">20 U.S.C. 1136(d)(1)(D)</external-xref>) is amended by inserting <quote>in analytical skills and study methods</quote> after <quote>courses</quote>.</text></subsection> 
<subsection id="H271E37B7527C4C22B32BDA9EF152B6B"><enum>(c)</enum><header>Authorization of appropriations</header><text>Section 721(h) (<external-xref legal-doc="usc" parsable-cite="usc/20/1136">20 U.S.C. 1136(h)</external-xref>) is amended by striking <quote>1999 and each of the 4 succeeding fiscal years</quote> and inserting <quote>2006 and each of the 5 succeeding fiscal years</quote>.</text></subsection>

<subsection id="H6F0A40B1315B443B8BB4471C41343BF"><enum>(a)</enum><header>Contract and grant purposes</header><text>Section 741(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/1138">20 U.S.C. 1138(a)</external-xref>) is amended—</text>

<subsection id="HCD8BD65F9E364AF2B6346805B036440"><enum>(b)</enum><header>Areas of national need</header><text>Section 744(c) (<external-xref legal-doc="usc" parsable-cite="usc/20/1138c">20 U.S.C. 1138c(c)</external-xref>) is amended by striking paragraph (4) and inserting the following:</text> 
<quoted-block id="HC17C1AB8F5ED40D0B5ADDFBBCBAEB6F5"> 
<paragraph id="H8692DB5DCBFB402EBDF028BC33DB3177"><enum>(4)</enum><text>International cooperation, partnerships, or student exchange among postsecondary educational institutions in the United States and abroad.</text></paragraph> 
<paragraph id="HBC1C46A9B00E404481B3B09839FDF1F3"><enum>(5)</enum><text>Establishment of academic programs including graduate and undergraduate courses, seminars and lectures, support of research, and development of teaching materials for the purpose of supporting faculty and academic programs that teach traditional American history (including significant constitutional, political, intellectual, economic, diplomatic, and foreign policy trends, issues, and documents; the history, nature, and development of democratic institutions of which American democracy is a part; and significant events and individuals in the history of the United States).</text></paragraph> 
<paragraph id="H02CA323A070E4E529D78D0ECE8DD09A5"><enum>(6)</enum><text>Support for planning, applied research, training, resource exchanges or technology transfers, the delivery of services, or other activities the purpose of which is to design and implement programs to enable institutions of higher education to work with private and civic organizations to assist communities to meet and address their pressing and severe problems, including economic development, community infrastructure and housing, crime prevention, education, healthcare, self sufficiency, and workforce preparation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2F26257B75814AA59C79FDFAE5BB2D9C"><enum>(c)</enum><header>Authorization of appropriations</header><text>Section 745 (<external-xref legal-doc="usc" parsable-cite="usc/20/1138d">20 U.S.C. 1138d</external-xref>) is amended by striking <quote>$30,000,000 for fiscal year 1999 and such sums as may be necessary for each of the 4 succeeding fiscal years</quote> and inserting <quote>$40,000,000 for fiscal year 2006 and such sums as may be necessary for each of the 5 succeeding fiscal years</quote> .</text></subsection></section> 
<section id="H8403A2E6D78C4B9FAF409C4356238769"><enum>6.</enum><header>Urban community service</header><text display-inline="no-display-inline">Part C of title VII (<external-xref legal-doc="usc" parsable-cite="usc/20/1139">20 U.S.C. 1139 et seq.</external-xref>) is repealed.</text></section> 
<section id="HD0F445069F454069B09E5717746605E0"><enum>7.</enum><header>Demonstration projects to ensure students with disabilities receive a quality higher education</header> 
<subsection id="H9BE596A6677542609454AD212BADC40"><enum>(a)</enum><header>Serving all students with disabilities</header><text>Section 762(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/1140a">20 U.S.C. 1140a(a)</external-xref>) is amended by striking <quote>students with learning disabilities</quote> and inserting <quote>students with disabilities</quote>.</text></subsection> 
<subsection id="HD3943007582742AFB1A2855304304267"><enum>(b)</enum><header>Authorized activities</header> 
<paragraph id="HABD959E7A4EC4412AE696B2C715B494D"><enum>(1)</enum><header>Amendment</header><text>Section 762(b)(2) is amended—</text> 
<subparagraph id="H9FDE8CD3BEF64BB1A4AD2B2F5CC896D8"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>in order to improve retention and completion</quote> after <quote>disabilities</quote>;</text></subparagraph> 
<subparagraph id="H03F95FA0F8774DB089A6189F111051B8"><enum>(B)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (E), respectively;</text></subparagraph> 
<subparagraph id="HB07745029B104AF5B5D4C5A200120077"><enum>(C)</enum><text>by inserting after subparagraph (A) the following new subparagraph:</text>
