<official-title>To clarify that Arizona is in compliance with the Equal Educational Opportunities Act of 1974 with respect to English language learners.</official-title>

<section id="H1B4BD4FED77249BFBB08B209C47DA315" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>_______ Act of 2006</short-title></quote>.</text></section> 
<section id="HE3D12F8B905D4A058494ED1164AADDF0"><enum>2.</enum><header>Arizona is in compliance with the Equal Educational Opportunities Act of 1974 with respect to English language learners</header> 
<subsection id="H5714055984414504AB1CA8C2B7ADDB5B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of the Equal Educational Opportunities Act of 1974 (title II of <external-xref legal-doc="public-law" parsable-cite="pl/93/380">Public Law 93–380</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/20/1701">20 U.S.C. 1701 et seq.</external-xref>)—</text> 
<paragraph id="H95ED23DAAD0644DFBAFCBB46C401FA47"><enum>(1)</enum><text>the funding for English language learners provided pursuant to Chapter Four of the State of Arizona’s 47th Legislature’s Second Legislative Session is adequate; and</text></paragraph> 
<paragraph id="HA89DB861DAAB4229AC3D0000E685D50"><enum>(2)</enum><text>any failure of Arizona (or by any agency or subdivision of Arizona) to provide funding for English language learners in excess of the funding referred to in paragraph (1)—</text> 
<subparagraph id="HE340F73D677D423283BFE001C892D28B"><enum>(A)</enum><text>is not a denial by Arizona (or by any agency or subdivision of Arizona) of equal educational opportunity for purposes of section 204(f) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1703">20 U.S.C. 1703(f)</external-xref>); and</text></subparagraph> 
<subparagraph id="H50AC8639FAC546ACBB635E592CBE27DE"><enum>(B)</enum><text>is not a basis for a civil action, or for relief, against Arizona (or against any agency or subdivision of Arizona) under section 207 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1706">20 U.S.C. 1706</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="H6EC555319688492BAC77CC8F7E3C7996"><enum>(b)</enum><header>Applicability to current litigation</header><text>This Act applies to litigation pending as of the date of the enactment of this Act, including the litigation known as Flores v. Arizona.</text> </subsection></section>
