2.In this title:
(1)The term additional coverage has the meaning given the term in section 502(b)(1) of the Federal Crop Insurance Act (7 U.S.C. 1502(b)(1)).
(2)The term disaster county means—
(A)a county included in the geographic area covered by a natural disaster declaration; and
(B)each county contiguous to a county described in subparagraph (A).
(3)Hurricane-affected countyThe term hurricane-affected county means—
(A)a county included in the geographic area covered by a natural disaster declaration related to Hurricane Katrina, Hurricane Rita, Hurricane Wilma, or a related condition; and
(B)each county contiguous to a county described in subparagraph (A).
(4)The term insurable commodity means an agricultural commodity (excluding livestock) for which the producers on a farm are eligible to obtain a policy or plan of insurance under the Federal Crop Insurance Act (7 U.S.C. 1501 et seq.).
(5)The term livestock includes—
(A)cattle (including dairy cattle);
(B)bison;
(C)sheep;
(D)swine; and
(E)other livestock, as determined by the Secretary.
(6)Natural disaster declarationThe term natural disaster declaration means—
(A)a natural disaster declared by the Secretary—
(i)during calendar year 2005 under section 321(a) of the Consolidated Farm and Rural Development Act (7 U.S.C. 1961(a)); or
(ii)during calendar year 2006 under that section, but for which a request was pending as of the date of enactment of this Act; or
(B)a major disaster or emergency designated by the President—
(i)during calendar year 2005 under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.); or
(ii)during calendar year 2006 under that Act, but for which a request was pending as of the date of enactment of this Act.
(7)The term noninsurable commodity means a crop for which the producers on a farm are eligible to obtain assistance under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (7 U.S.C. 7333).
(8)The term Secretary means the Secretary of Agriculture.
<enum>I</enum><header>Agricultural production losses</header>
<section id="H1620A73B5AED4E97A1863DABC687DCF2"><enum>101.</enum><header>Crop disaster assistance</header>
<subsection id="HA7DC830FCA5C46D98864557ED81EDCB9"><enum>(a)</enum><header>In general</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make emergency financial assistance authorized under this section available to producers on a farm that have incurred qualifying losses described in subsection (c).</text></subsection>
<subsection id="H7503BC24287C49D600E2DF8E1CE100C9"><enum>(b)</enum><header>Administration</header>
<paragraph id="HA9330CF9CBD945E39FDF13ED8B92A18E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall make assistance available under this section in the same manner as provided under section 815 of the Agriculture, Rural Development, Food and Drug Administration and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–55), including using the same loss thresholds for quantity and economic losses as were used in administering that section, except that the payment rate shall be 50 percent of the established price, instead of 65 percent.</text></paragraph>
<paragraph id="H6BB616A624D2407AB003FCCF2FAAFB45"><enum>(2)</enum><header>Loss thresholds for quality losses</header><text>In the case of a payment for quality loss for a crop under subsection (c)(2), the loss thresholds for quality loss for the crop shall be determined under subsection (d).</text></paragraph></subsection>
<subsection id="H330D3D1920BC4A48AB4FEA429F7DE4C2"><enum>(c)</enum><header>Qualifying losses</header><text>Assistance under this section shall be made available to producers on farms, other than producers of sugar cane and sugar beets, that incurred qualifying quantity or quality losses for—</text>
<paragraph id="H180299D72A8E430788702764A5AE6234"><enum>(1)</enum><text>the 2005 crop due to damaging weather or any related condition (including losses due to crop diseases, insects, and delayed harvest), as determined by the Secretary; and</text></paragraph>
<paragraph id="H7A09831B7AEB458DA4A6BE8091F001C"><enum>(2)</enum><text>the 2006 crop due to flooding in California and Hawaii that occurred prior to the date of enactment of this Act and for which a petition for a disaster designation has been filed with the Secretary not later than that date.</text></paragraph></subsection>
<subsection id="H59F88270F6B640219D53D25504B1670"><enum>(d)</enum><header>Quality losses</header>
<paragraph id="H3D454878EFEC449B00CB770077CE7D7E"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), the amount of a payment made to producers on a farm for a quality loss for a crop under subsection (c)(2) shall be equal to the amount obtained by multiplying—</text>
<subparagraph id="H3CB6D143EECD4BD700235CA9DBEFC00"><enum>(A)</enum><text>65 percent of the payment quantity determined under paragraph (2); by</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1E55BB6359B246E5AEFBB6D0574FAD2C"><enum>(B)</enum><text>50 percent of the payment rate determined under paragraph (3).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF22094C0E0884CC996E14FA311DD4792"><enum>(2)</enum><header>Payment quantity</header><text>For the purpose of paragraph (1)(A), the payment quantity for quality losses for a crop of a commodity on a farm shall equal the lesser of—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HDC36F40EED67440B93C1C455EAEA74D0"><enum>(A)</enum><text>the actual production of the crop affected by a quality loss of the commodity on the farm; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6EFDB28F97844AD895042E6DD0F8C7BB"><enum>(B)</enum><text>the quantity of expected production of the crop affected by a quality loss of the commodity on the farm, using the formula used by the Secretary to determine quantity losses for the crop of the commodity under subsection (c)(1).</text></subparagraph></paragraph>
<paragraph id="HD439B655432B4CC7B65F543835B0D1EE"><enum>(3)</enum><header>Payment rate</header><text>For the purpose of paragraph (1)(B) and in accordance with paragraphs (5) and (6), the payment rate for quality losses for a crop of a commodity on a farm shall be equal to the difference between—</text>
<subparagraph id="H1494AA6BDF644468871BF57B43C7A3BC"><enum>(A)</enum><text>the per unit market value that the units of the crop affected by the quality loss would have had if the crop had not suffered a quality loss; and</text></subparagraph>
<subparagraph id="H266F7EEDF4F84BAF90CA3EF1F8FD788"><enum>(B)</enum><text>the per unit market value of the units of the crop affected by the quality loss.</text></subparagraph></paragraph>
<paragraph id="H527B8261F9174F2E9C63B8FB5FC056D7"><enum>(4)</enum><header>Eligibility</header><text>For producers on a farm to be eligible to obtain a payment for a quality loss for a crop under subsection (c)(2), the amount obtained by multiplying the per unit loss determined under paragraph (1) by the number of units affected by the quality loss shall be at least 25 percent of the value that all affected production of the crop would have had if the crop had not suffered a quality loss.</text></paragraph>
<paragraph id="HDF4FC171F87B4FC4BC8EC028A06D427"><enum>(5)</enum><header>Marketing contracts</header><text>In the case of any production of a commodity that is sold pursuant to 1 or more marketing contracts (regardless of whether the contract is entered into by the producers on the farm before or after harvest) and for which appropriate documentation exists, the quantity designated in the contracts shall be eligible for quality loss assistance based on the 1 or more prices specified in the contracts.</text></paragraph>
<paragraph id="H6B404F5DB8184E79861E7DE600056C17"><enum>(6)</enum><header>Other production</header><text>For any additional production of a commodity for which a marketing contract does not exist or for which production continues to be owned by the producer, quality losses shall be based on the average local market discounts for reduced quality, as determined by the appropriate State committee of the Farm Service Agency.</text></paragraph>
<paragraph id="HC770687D92974C4A974E1F42F96CCB4E"><enum>(7)</enum><header>Quality adjustments and discounts</header><text>The appropriate State committee of the Farm Service Agency shall identify the appropriate quality adjustment and discount factors to be considered in carrying out this subsection, including—</text>
<subparagraph id="HA95C8A682C8145E0A282102E09F505FC"><enum>(A)</enum><text>the average local discounts actually applied to a crop; and</text></subparagraph>
<subparagraph id="HCBD5C361F3214D38B197067D11987847"><enum>(B)</enum><text>the discount schedules applied to loans made by the Farm Service Agency or crop insurance coverage under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC2C3A87028B342DDB136611F89222580"><enum>(8)</enum><header>Eligible production</header><text>The Secretary shall carry out this subsection in a fair and equitable manner for all eligible production, including the production of fruits and vegetables, other specialty crops, and field crops.</text></paragraph></subsection>
<subsection id="H1C8C22BA9EC9414BBB047E90FF1CA3C6"><enum>(e)</enum><header>Eligibility for assistance</header>
<paragraph id="H83627A03A12A490799613208A1C0858F"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the producers on a farm shall not be eligible for assistance under this section with respect to losses to an insurable commodity or noninsurable commodity if the producers on the farm—</text>
<subparagraph id="H26D5893674734FA0BE9003DC7569A913"><enum>(A)</enum><text>in the case of an insurable commodity, did not obtain a policy or plan of insurance for the insurable commodity under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) for the crop incurring the losses;</text></subparagraph>
<subparagraph id="HA08F8B8CAEA843F09BFF1DDBC000CD9E"><enum>(B)</enum><text>in the case of a noninsurable commodity, did not file the required paperwork, and pay the administrative fee by the applicable State filing deadline, for the noninsurable commodity under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) for the crop incurring the losses;</text></subparagraph>
<subparagraph id="H300A08F3C8454B1F8233E1B1D03D4DD"><enum>(C)</enum><text>had average adjusted gross income (as defined by section 1001D(a) of the Food Security Act of 1985 (7 U.S.C. 1308–3a(a)), of greater than $2,500,000 in 2004; or</text></subparagraph>
<subparagraph id="HA3B05C673B464584B0AA0078A4DDD298"><enum>(D)</enum><text>were not in compliance with highly erodible land conservation and wetland conservation provisions.</text></subparagraph></paragraph>
<paragraph id="H8C20884E69B444E100FDE1F85EC25351"><enum>(2)</enum><header>Contract waiver</header><text>The Secretary may waive paragraph (1) with respect to the producers on a farm if the producers enter into a contract with the Secretary under which the producers agree—</text>
<subparagraph id="H773D0E375A934AD5AAB9369D837E47DA"><enum>(A)</enum><text>in the case of an insurable commodity, to obtain a policy or plan of insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) providing additional coverage for the insurable commodity for each of the next 2 crops, at a coverage level that provides—</text>
<clause id="H87D8CD8C241044F99408BC596284ED15"><enum>(i)</enum><text>not less than 65 percent of the actual production history for the crop produced on the farm; and</text></clause>
<clause id="H841DDFC76574428284BFD0DDA1DC53A2"><enum>(ii)</enum><text>100 percent of the expected market price or a comparable coverage (as determined by the Federal Crop Insurance Corporation); and</text></clause></subparagraph>
<subparagraph id="HF2573F52413941F0B6E3562064CCA5ED"><enum>(B)</enum><text>in the case of a noninsurable commodity, to file the required paperwork and pay the administrative fee by the applicable State filing deadline, for the noninsurable commodity for each of the next 2 crops under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6D1D98F18D244AC093871CE0031BDB2"><enum>(3)</enum><header>Effect of violation</header><text>In the event of the violation of a contract under paragraph (2) by a producer, the producer shall reimburse the Secretary for the full amount of the assistance provided to the producer under this section.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H786DE47F146D476EBEFD0077C5F21D06"><enum>(f)</enum><header>Timing</header>
<paragraph commented="no" display-inline="no-display-inline" id="H41A534040506426FB71DD5D0A7DD8548"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall make payments to producers on a farm for a crop under this section not later than 60 days after the date the producers on the farm submit to the Secretary a completed application for the payments.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HE58D9216CD9A4816A5737725FEEB5E83"><enum>(2)</enum><header>Interest</header><text>If the Secretary does not make payments to the producers on a farm by the date described in paragraph (1), the Secretary shall pay to the producers on a farm interest on the payments at a rate equal to the current (as of the sign-up deadline established by the Secretary) market yield on outstanding, marketable obligations of the United States with maturities of 30 years.</text></paragraph></subsection></section>
<section id="HF6C735CC0EEA4F39B23500AC80DE85AE"><enum>102.</enum><header>Livestock assistance</header>
<subsection id="HF957CB0E3846461D9B12B7DB4534B00"><enum>(a)</enum><header>Livestock Compensation Program</header>
<paragraph id="H6B300A196554477B8F168199F0955C7B"><enum>(1)</enum><header>Use of commodity credit corporation funds</header><text>Effective beginning on the date of enactment of this Act, the Secretary shall use funds of the Commodity Credit Corporation to carry out the 2002 Livestock Compensation Program announced by the Secretary on October 10, 2002 (67 Fed. Reg. 63070), to provide compensation for livestock losses during calendar years 2005 and 2006 for losses that occurred prior to the date of enactment of this Act (including wildfire disaster losses in the State of Texas and other States) due to a disaster, as determined by the Secretary, except that the payment rate shall be 75 percent of the payment rate established for the 2002 Livestock Compensation Program.</text></paragraph>
<paragraph id="H3137B1376DD3472A9ED42DFFB25FFAB7"><enum>(2)</enum><header>Eligible applicants</header><text>In carrying out the program described in paragraph (1), the Secretary shall provide assistance to any applicant that—</text>
<subparagraph id="HAD353D09767D45EAB4C15E82F258156E"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H5B33DBE4C7614BE592707955AE8BA179"><enum>(i)</enum><text>conducts a livestock operation that is located in a disaster county, including any applicant conducting a livestock operation with eligible livestock (within the meaning of the livestock assistance program under section 101(b) of division B of <external-xref legal-doc="public-law" parsable-cite="pl/108/324">Public Law 108–324</external-xref> (118 Stat. 1234)); or</text></clause>
<clause id="HF0AD87542BDE474EA4599924A89883B" indent="up1"><enum>(ii)</enum><text>produces an animal described in section 10806(a)(1) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/21/321d">21 U.S.C. 321d(a)(1)</external-xref>); and</text></clause></subparagraph>
<subparagraph id="HC1AE4EF11CF94010BA02AF254C471834"><enum>(B)</enum><text>meets all other eligibility requirements established by the Secretary for the program.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC00F3E922A65436396DB86BECE879DE6"><enum>(3)</enum><header>Mitigation</header><text>In determining the eligibility for or amount of payments for which a producer is eligible under the livestock compensation program, the Secretary shall not penalize a producer that takes actions (recognizing disaster conditions) that reduce the average number of livestock the producer owned for grazing during the production year for which assistance is being provided.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HA385464F3DE34E7393DFEEAAB5F89E53"><enum>(4)</enum><header>Limitation</header><text>The Secretary shall ensure, to the maximum extent practicable, that no producer on a farm receives duplicative payments under this subsection and another Federal program with respect to any loss.</text></paragraph></subsection>
<subsection id="H70B575578C7842DA8BAD3C91A2A3AAEA"><enum>(b)</enum><header>Livestock indemnity payments</header>
<paragraph id="H8C24783C9E7F45A794E8A150FB52D238"><enum>(1)</enum><header>In general</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make livestock indemnity payments to producers on farms that have incurred livestock losses during calendar years 2005 and 2006 for losses that occurred prior to the date of enactment of this Act (including wildfire disaster losses in the State of Texas and other States) due to a disaster, as determined by the Secretary, including losses due to hurricanes, floods, anthrax, and wildfires.</text></paragraph>
<paragraph id="H43B63BB3C2734B7C8CBC16A3FE59B9FA"><enum>(2)</enum><header>Payment rates</header><text>Indemnity payments to a producer on a farm under paragraph (1) shall be made at a rate of not less than 30 percent of the market value of the applicable livestock on the day before the date of death of the livestock, as determined by the Secretary.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H97D023064A7F4F5788A2AFD8EC6223C0"><enum>(c)</enum><header>Livestock indemnity program for contract growers</header>
<paragraph commented="no" display-inline="no-display-inline" id="H3BDECC8F466548998DBE764836AF2436"><enum>(1)</enum><header>In general</header><text>Subject to subsection (d), the Secretary shall use funds of the Commodity Credit Corporation to establish a program to assist poultry producers in hurricane-affected counties that suffered income losses.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3A096D59D73B42A8B304EA03D5693760"><enum>(2)</enum><header>Terms and conditions</header><text>The program established under paragraph (1) shall contain similar terms and conditions as the terms and conditions used for the livestock indemnity program for contract growers described in subpart E of chapter XIV of title 7, Code of Federal Regulations (as in effect on January 1, 2002).</text></paragraph></subsection>
<subsection id="HF516803F27144585A1F737A18BF03866"><enum>(d)</enum><header>Ewe lamb replacement and retention</header>
<paragraph id="H9B9B7209DF2D4C0AB01EE4E3631F0A6"><enum>(1)</enum><header>In general</header><text>The Secretary shall use $15,000,000 of funds of the Commodity Credit Corporation to make payments under the Ewe Lamb Replacement and Retention Payment Program under part 784 of title 7, Code of Federal Regulations (or a successor regulation) for each qualifying ewe lamb retained or purchased during the period beginning on January 1, 2006, and ending on December 31, 2006.</text></paragraph>
<paragraph id="H06B9842E3A3544CB80C5F0EFDA098CC"><enum>(2)</enum><header>Ineligibility for other assistance</header><text>A producer that receives assistance under this subsection shall not be eligible to receive assistance under subsection (a).</text></paragraph></subsection>
<subsection id="H015D995EC10B4B2CBD674065A5F1B223"><enum>(e)</enum><header>Limit on amount of assistance</header><text>The Secretary shall ensure, to the maximum extent practicable, that no producer on a farm receives duplicative payments under this section and any other Federal program for the same loss.</text></subsection></section>
<section id="HECBAF8A339D84B55A3E06B00D0A4AB57"><enum>103.</enum><header>Flooded crop and grazing land</header>
<subsection id="H9B51B0DA8CB14B0687292C2FC2820088"><enum>(a)</enum><header>In general</header><text>The Secretary shall compensate eligible owners of flooded crop and grazing land in—</text>
<paragraph id="H9EF44977EDC449D2B9DFB5701D01DAEF"><enum>(1)</enum><text>the Devils Lake basin; and</text></paragraph>
<paragraph id="H245F5D0CBA134601A2E43D4BE40856BE"><enum>(2)</enum><text>the McHugh, Lake Laretta, and Rose Lake closed drainage areas of the State of North Dakota.</text></paragraph></subsection>
<subsection id="HB9B776E893C846DF808F23B4B2387011"><enum>(b)</enum><header>Eligibility</header>
<paragraph id="HB4578C047E5B4E528CEEFB30B80382F"><enum>(1)</enum><header>In general</header><text>To be eligible to receive compensation under this section, an owner shall own land described in subsection (a) that, during the 2 crop years preceding receipt of compensation, was rendered incapable of use for the production of an agricultural commodity or for grazing purposes (in a manner consistent with the historical use of the land) as the result of flooding, as determined by the Secretary.</text></paragraph>
<paragraph id="H2F0267C3FE0F4461A7DF00FE93D68F40"><enum>(2)</enum><header>Inclusions</header><text>Land described in paragraph (1) shall include—</text>
<subparagraph id="H5CE73AFEF79B494DBA8B1E700769A3E"><enum>(A)</enum><text>land that has been flooded;</text></subparagraph>
<subparagraph id="H01A8253E42F3467AB7111BCA4291FFD9"><enum>(B)</enum><text>land that has been rendered inaccessible due to flooding; and</text></subparagraph>
<subparagraph id="H6A28A6EA025D4941A8DE25F92BEE5795"><enum>(C)</enum><text>a reasonable buffer strip adjoining the flooded land, as determined by the Secretary.</text></subparagraph></paragraph>
<paragraph id="HF3D11F08E96C442A8710EE2212B55977"><enum>(3)</enum><header>Administration</header><text>The Secretary may establish—</text>
<subparagraph id="HB9F629DB91334BAAAEF6CAEF87BF82EE"><enum>(A)</enum><text>reasonable minimum acreage levels for individual parcels of land for which owners may receive compensation under this section; and</text></subparagraph>
<subparagraph id="H38E1821ED3A844549BB8CFB3B142B5F"><enum>(B)</enum><text>the location and area of adjoining flooded land for which owners may receive compensation under this section.</text></subparagraph></paragraph></subsection>
<subsection id="HF2B89650D1FF405D8E53005FB6E8CD7D"><enum>(c)</enum><header>Sign-up</header><text>The Secretary shall establish a sign-up program for eligible owners to apply for compensation from the Secretary under this section.</text></subsection>
<subsection id="HFB242CCF44F54566959B4E93ECD04C7B"><enum>(d)</enum><header>Compensation payments</header>
<paragraph id="HD9495D364B9C4D33ABBD5AE7000038D"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), the rate of an annual compensation payment under this section shall be equal to 90 percent of the average annual per acre rental payment rate (at the time of entry into the contract) for comparable crop or grazing land that has not been flooded and remains in production in the county where the flooded land is located, as determined by the Secretary.</text></paragraph>
<paragraph id="HD1F3178631FA4B5DACFCC12EEA0061C9"><enum>(2)</enum><header>Reduction</header><text>An annual compensation payment under this section shall be reduced by the amount of any conservation program rental payments or Federal agricultural commodity program payments received by the owner for the land during any crop year for which compensation is received under this section.</text></paragraph>
<paragraph id="H511DFC8D7F954D40B41BA6C3F520C872"><enum>(3)</enum><header>Exclusion</header><text>During any year in which an owner receives compensation for flooded land under this section, the owner shall not be eligible to participate in or receive benefits for the flooded land under—</text>
<subparagraph id="H5430BAFD9DEF4791863B67F1C661C935"><enum>(A)</enum><text>the Federal crop insurance program established under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>);</text></subparagraph>
<subparagraph id="HDD8E477D4D194F2E9BDCD2D688B2F536"><enum>(B)</enum><text>the noninsured crop assistance program established under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>); or</text></subparagraph>
<subparagraph id="HF4150FF8E0CE4ED88324887F8473669B"><enum>(C)</enum><text>any Federal agricultural crop disaster assistance program.</text></subparagraph></paragraph></subsection>
<subsection id="HEA614E682A6C4784B56F7376834452BC"><enum>(e)</enum><header>Relationship to agricultural commodity programs</header><text>The Secretary, by regulation, shall provide for the preservation of cropland base, allotment history, and payment yields applicable to land described in subsection (a) that was rendered incapable of use for the production of an agricultural commodity or for grazing purposes as the result of flooding.</text></subsection>
<subsection id="H11F159422FD04B2FB2149901FBCFC01"><enum>(f)</enum><header>Use of land</header>
<paragraph id="H7C14E6F5881C407DB849BE56D60D57B"><enum>(1)</enum><header>In general</header><text>An owner that receives compensation under this section for flooded land shall take such actions as are necessary to not degrade any wildlife habitat on the land that has naturally developed as a result of the flooding.</text></paragraph>
<paragraph id="HC28F4FB88E014886B9D38776013DB077"><enum>(2)</enum><header>Recreational activities</header><text>To encourage owners that receive compensation for flooded land to allow public access to and use of the land for recreational activities, as determined by the Secretary, the Secretary may—</text>
<subparagraph id="H75BC450AA27A4D5D8F9E4429F6C4138"><enum>(A)</enum><text>offer an eligible owner additional compensation; and</text></subparagraph>
<subparagraph id="H20F700052CEE414BA6F0EE5EC926776D"><enum>(B)</enum><text>provide compensation for additional acreage under this section.</text></subparagraph></paragraph></subsection>
<subsection id="H6AB71763B9174692BD9BBB30415FED8F"><enum>(g)</enum><header>Funding</header>
<paragraph id="H821E24D9A9B548C0934829E0D4913CCE"><enum>(1)</enum><header>In general</header><text>The Secretary shall use $6,000,000 of funds of the Commodity Credit Corporation to carry out this section.</text></paragraph>
<paragraph id="HB72DE44C74024DFCB5232C4727F97131"><enum>(2)</enum><header>Pro-rated payments</header><text>In a case in which the amount made available under paragraph (1) for a fiscal year is insufficient to compensate all eligible owners under this section, the Secretary shall pro-rate payments for that fiscal year on a per acre basis.</text></paragraph></subsection></section>
<section id="HB8E0260B67C44ED898771F14E1E60843"><enum>104.</enum><header>Sugarcane and sugar beet disaster assistance</header>
<subsection commented="no" display-inline="no-display-inline" id="HBD77712ED4E14515900063D4CC93CEFF"><enum>(a)</enum><header>Florida</header><text>The Secretary of Agriculture shall use $120,000,000 of funds of the Commodity Credit Corporation to make payments to processors in Florida that are eligible to obtain a loan under section 156(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272(a)</external-xref>) to compensate first processors and producers for crop and other losses in hurricane-affected counties that are related to hurricanes, tropical storms, excessive rains, floods, and wind in Florida during calendar year 2005, by an agreement on the same terms and conditions, to the maximum extent practicable, as the payments made under section 102 of the Emergency Supplemental Appropriations for Hurricane Disasters Assistance Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/324">Public Law 108–324</external-xref>; 118 Stat. 1235), including that the 2005 base production of each harvesting unit shall be determined using the same base year crop production history that was used pursuant to the agreement under that section.</text></subsection>
<subsection id="H689B9D55B83347FA9D229E8BCC41C499"><enum>(b)</enum><header>Louisiana</header>
<paragraph id="H9545F71931C4474BAC1C00E26C442CC5"><enum>(1)</enum><header>Compensation for losses</header><text>The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to make $120,000,000 in payments to first processors of sugarcane that operate in a disaster county in Louisiana, or obtain sugarcane from a disaster county in Louisiana, and that are eligible to obtain a loan under section 156(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272(a)</external-xref>), to compensate the producers and first processors for crop and other losses due to Hurricane Katrina, Hurricane Rita, or related conditions.</text></paragraph>
<paragraph id="HD1F9EC89669E439892007424798711A4"><enum>(2)</enum><header>Administration</header><text>Assistance under this subsection shall be—</text>
<subparagraph id="H377E2F211075403B8031F78BF62A96E"><enum>(A)</enum><text>shared by an affected first processor with affected producers that provide commodities to the processor in a manner that reflects contracts entered into between the processor and the producers, except with respect to a portion of the amount of total assistance described under paragraph (1) necessary to compensate affected producers for individual losses experienced by the producers, including losses due to saltwater intrusion, flooding, wind damage, or increased planting, replanting, or harvesting costs, which shall be transferred by the first processor to the affected producers without regard to contractual share arrangements; and</text></subparagraph>
<subparagraph id="H863F7507FB1B4A71A131569F59DF0343"><enum>(B)</enum><text>made available under such terms and conditions as the Secretary determines are necessary to carry out this subsection.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3F90EEE3C8FC4695ABB868ECD8001600"><enum>(3)</enum><header>Loss determination</header><text>In carrying out this subsection, the Secretary shall use the same base year to determine crop loss that was elected by a producer to determine crop loss in carrying out the hurricane assistance program under section 207 of the Agricultural Assistance Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>; 117 Stat. 543).</text></paragraph></subsection>
<subsection id="HEEF3C6906C7943279700C42913A428C8"><enum>(c)</enum><header>Funding</header><text>The Secretary shall use $40,000,000 of funds of the Commodity Credit Corporation to provide assistance to sugar beet producers that suffered production losses (including quality losses) for the 2005 crop year.</text></subsection>
<subsection id="H39E1032CEA1B4EFAB1A35E9556C946FC"><enum>(d)</enum><header>Requirement</header><text>The Secretary shall make payments under subsection (c) in the same manner as payments were made under section 208 of the Agricultural Assistance Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>; 117 Stat. 544), including using the same indemnity benefits as were used in carrying out that section.</text></subsection>
<subsection id="H356AF3155E3F4595995B99BB1D3C38B2"><enum>(e)</enum><header>Texas</header><text>The Secretary shall use $400,000 of funds of the Commodity Credit Corporation to assist sugarcane growers in Texas by making a payment in that amount to the Rio Grande Valley Sugar Growers, a farmer-owned cooperative sugarcane processor in that State, for additional demurrage costs at the Port of Baton Rouge and additional storage and transportation costs of raw sugar resulting from hurricanes during calendar year 2005, excessive rains, floods, wind, and other related conditions.</text></subsection>
<subsection id="HDFE48B419B1B4112BC09336935E1794B"><enum>(f)</enum><header>Hawaii</header><text>The Secretary shall use $6,000,000 of funds of the Commodity Credit Corporation to assist sugarcane growers in Hawaii by making a payment in that amount to an agricultural transportation cooperative in Hawaii, the members of which are eligible to receive marketing assistance loans and loan deficiency payments made available under subtitle B of title I of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7931">7 U.S.C. 7931 et seq.</external-xref>).</text></subsection>
<subsection id="H410CFDDBF2834FD2B53612F1875F1E2E"><enum>(g)</enum><header>Limit on amount of assistance</header><text>The Secretary shall ensure, to the maximum extent practicable, that no producer on a farm receives duplicative payments under this section and any other Federal program for the same loss.</text></subsection></section>
<section id="HC2628E4C4BBC49558E44009816C0E537"><enum>105.</enum><header>Specialty crops and nursery crops</header>
<subsection id="HD871257407AF4CD095786FF6A6049CB1"><enum>(a)</enum><header>In general</header><text>The Secretary shall use funds of the Commodity Credit Corporation to provide assistance to producers of specialty crops and nursery crops in hurricane-affected counties.</text></subsection>
<subsection id="HEBB304B7432D4DEB99070002C8083962"><enum>(b)</enum><header>Administration</header>
<paragraph id="HD9DF0404191549D098927E43E86D6CC1"><enum>(1)</enum><header>In general</header><text>Assistance required by subsection (a) shall be carried out by the Secretary under the same terms and conditions as the special disaster relief programs carried out for producers that suffered from crop damage and tree losses, and carried out related cleanup, in certain areas of Florida due to Hurricanes Charley, Frances, and Jeanne during August and September 2004, as described in the notice of program implementation relating to Florida citrus, fruit, vegetable, and nursery crop disaster programs (69 Fed. Reg. 63134 (October 29, 2004)).</text></paragraph>
<paragraph id="H9733C6DA94694059A8A944ED3384F6C2"><enum>(2)</enum><header>Loss of records</header><text>Due to the complete destruction of the business records of many producers, the Secretary shall use the best available information in determining eligibility, determining losses, and calculating payment amounts under this section.</text></paragraph></subsection>
<subsection id="H46D2192A171C4DC1AF7C92C5CEDCF6CB"><enum>(c)</enum><header>Limit on amount of assistance</header><text>The Secretary shall ensure, to the maximum extent practicable, that no producer on a farm receives duplicative payments under this section and any other Federal program for the same loss.</text></subsection></section>
<section id="H6B9D950D227140FCB5B7A9591FF9B46D"><enum>106.</enum><header>Dairy assistance</header><text display-inline="no-display-inline">The Secretary shall use $25,000,000 of the funds of the Commodity Credit Corporation to make payments to dairy producers for dairy production losses and dairy spoilage losses in hurricane-affected counties.</text></section>
<section id="HB0847F879AF940D3A0A3B7CE89639123"><enum>107.</enum><header>Cottonseed</header>
<subsection id="HFA7B9A0E91144E679914EF64CE87E207"><enum>(a)</enum><header>Distribution of funds</header><text display-inline="yes-display-inline">The Secretary shall provide disaster assistance under subsection (c) under the same terms and conditions as assistance provided under section 206 of the Agricultural Assistance Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>; 117 Stat. 543), except that assistance shall be—</text>
<paragraph id="HDC7AA5109AF74714830841AA5BA58061"><enum>(1)</enum><text display-inline="yes-display-inline">distributed to producers and first handlers of cottonseed; and</text></paragraph>
<paragraph id="H02956E672DDD49289171001047956200"><enum>(2)</enum><text>based on cottonseed production during the most recent year for which a disaster payment specifically for cottonseed was not authorized.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HDDF733DE19A240BFA4C2BCB594310F7"><enum>(b)</enum><header>Cottonseed assistance</header><text display-inline="yes-display-inline">The Secretary shall use $15,000,000 of the funds of the Commodity Credit Corporation to provide assistance to producers and first-handlers of the 2005 crop of cottonseed in hurricane-affected counties.</text></subsection></section>
<section id="H612CD9C2CEAF4B01A8AB0269CAFEE066"><enum>108.</enum><header>Reduction in payments</header><text display-inline="no-display-inline">The amount of any payment for which a producer is eligible under this subtitle shall be reduced by any amount received by the producer for the same loss or any similar loss under—</text>
<paragraph id="HF8B6A7E9A40C4370B4FF28B53F58EFCD"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>; 119 Stat. 2680); or</text></paragraph>
<paragraph id="HACECFCDA267F42E982D1D98ED9CFF071"><enum>(2)</enum><text>an agricultural disaster assistance provision contained in the announcement of the Secretary on January 26, 2006.</text></paragraph></section>
<enum>II</enum><header>Supplemental nutrition and agricultural economic disaster assistance</header>
<section id="H2E67AC63CBB44E1DAB0011B140E8AD87"><enum>201.</enum><header>Replenishment of Section 32</header>
<subsection id="HA811A3F2F0794F0ABA4BCA23BC73D741"><enum>(a)</enum><header>Definition of specialty crop</header><text>In this section:</text>
<paragraph id="HA0814F8CA5F34C09AECF1289D7FEE2DE"><enum>(1)</enum><header>In general</header><text>The term <term>specialty crop</term> means any agricultural crop.</text></paragraph>
<paragraph id="HB8964C0CB44B4A5398909078BE886DD9"><enum>(2)</enum><header>Exception</header><text>The term <term>specialty crop</term> does not include—</text>
<subparagraph id="H75BAD995861B4879BA6400AC2751B40"><enum>(A)</enum><text>wheat;</text></subparagraph>
<subparagraph id="HA5DFCDB010F9447AA4F5D3F42CC3E6D8"><enum>(B)</enum><text>feed grains;</text></subparagraph>
<subparagraph id="HBD21CBE6A0CE4AF1B8E5D7B146796EA9"><enum>(C)</enum><text>oilseeds;</text></subparagraph>
<subparagraph id="H6F025E171F3E4B54AB40634F0193672E"><enum>(D)</enum><text>cotton;</text></subparagraph>
<subparagraph id="H41B0CBF4B858493DBDE9728410FEB7"><enum>(E)</enum><text>rice; or</text></subparagraph>
<subparagraph id="H6E00C800D2EC41B0883DB27E77546007"><enum>(F)</enum><text>peanuts.</text></subparagraph></paragraph></subsection>
<subsection id="HC7D44E9CD5064091A4EC38E5CC350064"><enum>(b)</enum><header>Base State grants</header>
<paragraph id="H7F98DAC7D9E6419DA259C6F79A876D3"><enum>(1)</enum><header>In general</header><text>The Secretary shall use $25,500,000 of funds of the Commodity Credit Corporation to make grants to the several States, the District of Columbia, and the Commonwealth of Puerto Rico to be used to support activities that promote agriculture.</text></paragraph>
<paragraph id="HE3CC24181EE548CF914D15C706F52F9E"><enum>(2)</enum><header>Amounts</header><text>The amount of the grants shall be—</text>
<subparagraph id="HE140AB0EC86E4EC092BC49D967111335"><enum>(A)</enum><text>$500,000 to each of the several States; and</text></subparagraph>
<subparagraph id="H3F2D504529704561A43193737B79976B"><enum>(B)</enum><text>$250,000 to each of the Commonwealth of Puerto Rico and the District of Columbia.</text></subparagraph></paragraph></subsection>
<subsection id="HC6A3048897CE40D084DE9E8B7F968B8D"><enum>(c)</enum><header>Grants for value of production</header><text>The Secretary shall use $74,500,000 of funds of the Commodity Credit Corporation to make a grant to each of the several States in an amount equal to the product obtained by multiplying—</text>
<paragraph id="H737E4FA10F5A495F8FC084B6CDCCB189"><enum>(1)</enum><text>the share of the State of the total value of specialty crop, livestock, and dairy production of the United States for the 2004 crop year, as determined by the Secretary; by</text></paragraph>
<paragraph id="H14E7947F08E74450A4EF00283C69F976"><enum>(2)</enum><text>$74,500,000.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H08F58E3B48954BDA98B9366FD1D2A100"><enum>(d)</enum><header>Special crop and livestock priority</header><text>As a condition on the receipt of a grant under this section, a State shall agree to give priority to the support of specialty crops and livestock in the use of the grant funds.</text></subsection>
<subsection id="H0DC0E86062154EB8BC5CFE615EFA109E"><enum>(e)</enum><header>Use of funds</header><text>A State may use funds from a grant awarded under this section—</text>
<paragraph id="HC05C8FB04073459C8153D6B902CB8C"><enum>(1)</enum><text>to supplement State food bank programs or other nutrition assistance programs;</text></paragraph>
<paragraph id="H2FD84047188C4FDEB703E4E50291F0F1"><enum>(2)</enum><text>to promote the purchase, sale, or consumption of agricultural products;</text></paragraph>
<paragraph id="HC9D026BE856E43F2A0BA684188742368"><enum>(3)</enum><text>to provide economic assistance to agricultural producers, giving a priority to the support of specialty crops and livestock; or</text></paragraph>
<paragraph id="HCD0FD02C7144443BBC412BF608FC235E"><enum>(4)</enum><text>for other purposes as determined by the Secretary.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H0F2565013FB44D4B9B87AFFC646E4270"><enum>202.</enum><header>Supplemental economic loss payments</header><text display-inline="no-display-inline">The Secretary shall make a supplemental economic loss payment to any producer on a farm that received a direct payment for crop year 2005 under title I of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7901">7 U.S.C. 7901 et seq.</external-xref>) at a rate equal to the product obtained by multiplying—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H44FE8F45D0D240A2A39026DA615FC108"><enum>(1)</enum><text display-inline="yes-display-inline">30 percent of the direct payment rate in effect for the program crop of the farmer;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HEFA250A08C96445882D72778E5D7A81D"><enum>(2)</enum><text>85 percent of the program crop base of the farmer; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3631B9EC0CE74D20A587EF8500890488"><enum>(3)</enum><text>the program payment yield for each program crop of the farmer.</text></paragraph></section>
<section id="H28BC656509A240B1ADE7E08928CBCB38"><enum>203.</enum><header>Reduction in payments</header><text display-inline="no-display-inline">The amount of any payment for which a producer is eligible under this subtitle shall be reduced by any amount received by the producer for the same loss or any similar loss under—</text>
<paragraph id="H446C809FE14B495196694CD66367F668"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of Defense, Emergency Supplemental Appropriations to Address Hurricanes in the Gulf of Mexico, and Pandemic Influenza Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/148">Public Law 109–148</external-xref>; 119 Stat. 2680); or</text></paragraph>

<enum>III</enum><header>Forestry</header>
<section id="H9E6FA368938D429381BA9F4C63E1F8B"><enum>301.</enum><header>Tree assistance program</header>
<subsection id="H2ECFB0C42B44426B984964A599A3AC2B"><enum>(a)</enum><header>Definition of tree</header><text>In this section, the term <term>tree</term> includes a tree (including a Christmas tree, ornamental tree, nursery tree, and potted tree), bush (including a shrub), and vine.</text></subsection>
<subsection id="H0B98E5ED545349759C099194D6258EBC"><enum>(b)</enum><header>Program</header><text>Except as otherwise provided in this section, the Secretary shall use such sums as are necessary of the funds of the Commodity Credit Corporation to provide assistance under the tree assistance program established under sections 10201 through 10203 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/8201">7 U.S.C. 8201 et seq.</external-xref>) to—</text>
<paragraph id="H91D069261DEE49A2B49DDC95D6DF2933"><enum>(1)</enum><text>producers who suffered tree losses in hurricane-affected counties; and</text></paragraph>
<paragraph id="HA63BCD55B21E43D88BF68508AA1CCC95"><enum>(2)</enum><text>fruit and tree nut producers in hurricane-affected counties for site preparation, replacement, rehabilitation, and pruning.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA21445575B674A3489F39051A206010"><enum>(c)</enum><header>Costs</header><text>Funds made available under this section shall also be made available to cover costs associated with tree pruning, tree rehabilitation, and other appropriate tree-related activities as determined by the Secretary.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H9DC42F73B7594EB490BF075512C5E0EA"><enum>(d)</enum><header>Limit on amount of assistance</header><text>The Secretary shall ensure, to the maximum extent practicable, that no producer on a farm receives duplicative payments under this section and any other Federal program for the same loss.</text></subsection></section>
<enum>IV</enum><header>Conservation</header>
<section id="H862E58F194664BD6834B6D53C1390000"><enum>401.</enum><header>Natural Resources Conservation Service</header>
<subsection id="HDC42C7DAEEC744A4BAE98139D94784A0"><enum>(a)</enum><header>Authority to clear debris and animal carcasses</header><text>Notwithstanding any other provision of law, the Secretary, acting through the Natural Resources Conservation Service, using funds made available for the emergency watershed protection program established under section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>), may provide financial and technical assistance to remove and dispose of debris and animal carcasses that could adversely affect health and safety on non-Federal land in a hurricane-affected county.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7364324391BB43A380416FDADBC18686"><enum>(b)</enum><header>Authority to use certain practices</header><text>Notwithstanding any other provision of law, the Secretary, acting through the Natural Resources Conservation Service, may use direct check-writing practices and electronic transfers to provide financial and technical assistance under the emergency watershed protection program established under section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>) in a hurricane-affected county.</text></subsection></section>
<section id="H38EC471892D94A3F91A9DEB7D2B4494C"><enum>402.</enum><header>Emergency watershed protection program</header><text display-inline="no-display-inline">The Secretary shall use an additional $108,500,000 of funds of the Commodity Credit Corporation to carry out emergency measures identified by the Chief of the Natural Resources Conservation Service as of the date of enactment of this Act through the emergency watershed protection program established under section 403 of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2203">16 U.S.C. 2203</external-xref>).</text></section>
<section id="H7F82F1C4C11240F382868E77F1FD823F"><enum>403.</enum><header>Emergency conservation program</header><text display-inline="no-display-inline">The Secretary shall use an additional $17,000,000 of funds of the Commodity Credit Corporation to carry out emergency measures identified by the Administrator of the Farm Service Agency as of the date of enactment of this Act through the emergency conservation program established under title IV of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2201">16 U.S.C. 2201 et seq.</external-xref>).</text></section>
<enum>V</enum><header>Farm service agency</header>
<section id="H30DE6F941D294A47A4709CF4690089CE"><enum>501.</enum><header>Funding for additional personnel</header><text display-inline="no-display-inline">The Secretary shall use $23,000,000 of funds of the Commodity Credit Corporation to hire additional County Farm Service Agency personnel—</text>
<paragraph id="H1AFDEA17031141F1AEAB26C15D3F00A3"><enum>(1)</enum><text display-inline="yes-display-inline">to expedite the implementation of, and delivery under, the agricultural disaster and economic assistance programs under this title; and</text></paragraph>
<paragraph id="HC700978AECB34391BD6F2559AD884FE2"><enum>(2)</enum><text>as the Secretary determines to be necessary to carry out other agriculture and disaster assistance programs.</text></paragraph></section>
<enum>VI</enum><header>Miscellaneous</header>
<section id="HFD5EBAD672B64226B01FC36B3D002C81"><enum>601.</enum><header>Authority to provide immunizations</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary of Defense may provide immunizations to employees of the Department of Agriculture involved in direct recovery work in a hurricane-affected county.</text></section>
<section commented="no" display-inline="no-display-inline" id="H81BC2398344A45FCADCC23000302D177"><enum>602.</enum><header>Waiver of certain provisions</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary may provide assistance in a hurricane-affected county under the emergency conservation program established under title IV of the Agricultural Credit Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2201">16 U.S.C. 2201 et seq.</external-xref>) without regard to subtitle C of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3821">16 U.S.C. 3821 et seq.</external-xref>).</text></section>
<section id="H244DD9BABA8A41AEB5C7D4DEC85DC86F"><enum>603.</enum><header>Funding</header><text display-inline="no-display-inline">The Secretary shall use the funds, facilities, and authorities of the Commodity Credit Corporation to carry out this title, to remain available until expended.</text></section>
<section id="H3416B86F2D63433DB1AEF738DA4CF372"><enum>604.</enum><header>Regulations</header>
<subsection id="H0EC79E9C83AF46C5B2F96C5929FC55C8"><enum>(a)</enum><header>In general</header><text>The Secretary may promulgate such regulations as are necessary to implement this title.</text></subsection>
<subsection id="H64048A5152D94E41A00924FAFC1570A6"><enum>(b)</enum><header>Procedure</header><text>The promulgation of the regulations and administration of this title shall be made without regard to—</text>
<paragraph id="H9045CECDBE8540D3AF001E2D12B7F329"><enum>(1)</enum><text>the notice and comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text></paragraph>
<paragraph id="H692FAF2C99474AA0B4ABA2E4A799A7DF"><enum>(2)</enum><text>the Statement of Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices of proposed rulemaking and public participation in rulemaking; and</text></paragraph>
<paragraph id="H4F35531E7207483386044F1CA0FCABB6"><enum>(3)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection>

<section id="H6E46EBD48D8846FFB8A2CF5B5704386"><enum>801.</enum><header>Corps of Engineers</header><text display-inline="no-display-inline">In addition to any other funds made available by this Act, there is appropriated for <quote>Department of Defense-Civil, Department of the Army, Corps of Engineer-Civil, Flood Control and Coastal Emergencies</quote>, as authorized by section 5 of the Act of August 18, 1941 (<external-xref legal-doc="usc" parsable-cite="usc/33/701n">33 U.S.C. 701n</external-xref>), $5,000,000, to remain available until expended, to be used by the Secretary of the Army, acting through the Chief of Engineers, for emergency drought assistance.</text> </section>
<section id="HC058EB6BFE5046F7ACBC7EAA3807CF9C"><enum>802.</enum><header>Bureau of Reclamation</header><text display-inline="no-display-inline">In addition to any other funds made available by this Act, there is appropriated for <quote>Department of the Interior, Bureau of Reclamation, Water and Related Resources</quote>, $7,500,000, to remain available until expended, for drought emergency assistance.</text> </section>
