<official-title>To amend the Communications Act of 1934 to promote and expedite wireless broadband deployment in rural and other areas, and for other purposes.</official-title>

<section section-type="section-one" id="HF13B827CB3BF45A6B4C9A4C193050286" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Broadband for Communities Act</short-title></quote>.</text></section> 
<section id="H24FCE590AD9A4F2DA7B917B5FE7002E"><enum>2.</enum><header>Unused television spectrum made available for wireless use</header><text display-inline="no-display-inline">Part I of title III of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Communications Act of 1934" id="H726672CF336A431599C10019E5796F3"> 
<section id="H17511DCDB9884270BD7431F781EEF7A7"><enum>342.</enum><header>Unused broadcast television spectrum made available for wireless use</header><text display-inline="no-display-inline">Any unused broadcast television spectrum in the band between 54 and 698 megaHertz, inclusive, other than spectrum in the band between 608 and 614 megaHertz, inclusive, may be used by unlicensed devices, including wireless broadband devices.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H308E59B5240744B3A771426F4E2B8113"><enum>3.</enum><header>FCC to facilitate use</header><text display-inline="no-display-inline">Within 180 days after the date of enactment of this Act, the Federal Communications Commission shall—</text> 
<paragraph id="H80C855BEC5974D4C002CCE0871C80499"><enum>(1)</enum><text>adopt minimal technical and device rules in ET Docket Nos. 02–380 and 04–186 to facilitate the robust and efficient use of the spectrum made available under section 342 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/342">47 U.S.C. 342</external-xref>) by unlicensed devices, including wireless broadband devices; and</text></paragraph> 
<paragraph id="H8242C0B9BA6C40DF004E21797917B05D"><enum>(2)</enum><text>establish rules and procedures to—</text> 
<subparagraph id="HE5952E229E2C464691E953DEB415BC42"><enum>(A)</enum><text display-inline="yes-display-inline">protect incumbent licensed services, including broadcast television and public safety equipment, operating pursuant to their licenses from harmful interference from such unlicensed devices;</text></subparagraph> 
<subparagraph id="H1985AD30512F4592AB27975F2F705088"><enum>(B)</enum><text>address complaints, no later than 30 days after receipt, from licensed broadcast stations that an unlicensed device using such spectrum causes harmful interference that include verification, in the field, of actual harmful interference;</text></subparagraph> 
<subparagraph id="H13ADADDC04514419001F7D8C071B36AA"><enum>(C)</enum><text>require manufacturers of unlicensed devices designed to be operated in this spectrum to submit a plan to the Commission to remedy actual harmful interference to the extent that harmful interference is found by the Commission which may include disabling or modifying the unlicensed device remotely; and</text></subparagraph> 
<subparagraph id="H769DEB69891D49F99D9C2C122BF1D54C"><enum>(D)</enum><text>require certification of unlicensed devices designed to be operated in that spectrum to ensure that they meet the technical criteria established under paragraph (1) and can perform the functions described in subparagraph (C).</text></subparagraph></paragraph></section>
