		  resources, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H3BCCBD850AAA4DEEAEE2BD6F4176CD8F" style="OLC" changed="added">
		<section display-inline="no-display-inline" id="H791849E79E964C04A02B63EB0083465D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Oregon Water Resources Management Act
			 of 2006</short-title></quote>.</text>
		</section><section id="H5C81E2B3BAA84E969345E19972D8FA0" section-type="subsequent-section"><enum>2.</enum><header>Extension of
			 participation of Bureau of Reclamation in Deschutes River
			 Conservancy</header><text display-inline="no-display-inline">Section 301 of the
			 Oregon Resource Conservation Act of 1996 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/104/208">Public Law 104–208</external-xref>; 110
			 Stat. 3009–534) is amended—</text>
			<paragraph id="H08537427C06345A986442C2189EEB9A4"><enum>(1)</enum><text>in subsection
			 (a)(1), by striking <quote>Deschutes River Basin Working Group</quote> and
			 inserting <quote>Deschutes River Conservancy Working Group</quote>;</text>
			</paragraph><paragraph commented="no" id="H4FBEFB42384E4CD1881956EDDD7B2BE"><enum>(2)</enum><text>by amending the
			 text of subsection (a)(1)(B) to read as follows: <quote>4 representatives of
			 private interests including two from irrigated agriculture who actively farm
			 more than 100 acres of irrigated land and are not irrigation district managers
			 and two from the environmental community;</quote>;</text>
			</paragraph><paragraph id="H436462B7F6954A9A00EDDA65ACD3A793"><enum>(3)</enum><text>in subsection
			 (b)(3), by inserting before the final period the following: <quote>, and up to
			 a total amount of $2,000,000 during each of fiscal years 2006 through
			 2015</quote>; and</text>
			</paragraph><paragraph id="H2439BF3AD87C4DA9B6C5BA6B74CC3C85"><enum>(4)</enum><text>in subsection (h),
			 by inserting before the period at the end the following: <quote>, and
			 $2,000,000 for each of fiscal years 2006 through 2015</quote>.</text>
			</paragraph></section><section id="H0A0FA1767E2E4C49AF0443496131C0AF" section-type="subsequent-section"><enum>3.</enum><header>Wallowa Lake Dam
			 Rehabilitation Act</header>
			<subsection id="H2B151BDCE6A6462A89948153E0F5DAC"><enum>(a)</enum><header>Definitions</header><text>In
			 this section, the following definitions apply:</text>
				<paragraph id="H319212E9CB974937AC62B2B074E98702"><enum>(1)</enum><header>Associated ditch
			 companies, incorporated</header><text>The term <term>Associated Ditch
			 Companies, Incorporated</term> means the nonprofit corporation established
			 under the laws of the State of Oregon that operates Wallowa Lake Dam.</text>
				</paragraph><paragraph id="H5605944D99324EB0BBFB329C7392345D"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the Commissioner of Reclamation.</text>
				</paragraph><paragraph id="H5C0F00BB7C1749058B59CA1B01E2C1"><enum>(3)</enum><header>Wallowa lake dam
			 rehabilitation program</header><text>The term <term>Wallowa Lake Dam
			 Rehabilitation Program</term> means the program for the rehabilitation of the
			 Wallowa Lake Dam in Oregon, as contained in the engineering document titled,
			 <quote>Phase I Dam Assessment and Preliminary Engineering Design</quote>, dated
			 December 2002, and on file with the Bureau of Reclamation.</text>
				</paragraph></subsection><subsection id="H37B30D706C564F4C8573EE43BDE287C8"><enum>(b)</enum><header>Authorization to
			 participate in program</header>
				<paragraph id="H6C8435627C814C2E9323D17C4990E8F1"><enum>(1)</enum><header>Grants and
			 cooperative agreements</header><text>The Secretary may provide grants to, or
			 enter into cooperative or other agreements with, tribal, State, and local
			 governmental entities and the Associated Ditch Companies, Incorporated, to
			 plan, design, and construct facilities needed to implement the Wallowa Lake Dam
			 Rehabilitation Program.</text>
				</paragraph><paragraph id="H16D26B2696D94DC39EFA4F6199A24973"><enum>(2)</enum><header>Conditions</header><text>As
			 a condition of providing funds under paragraph (1), the Secretary shall ensure
			 that—</text>
					<subparagraph id="HA4E159E830F3493BB84EDE07E23600C8"><enum>(A)</enum><text>the Wallowa Lake
			 Dam Rehabilitation Program and activities under this section meet the standards
			 of the dam safety program of the State of Oregon;</text>
					</subparagraph><subparagraph id="H8E36844259B5463E822B405CF0A910D8"><enum>(B)</enum><text>the Associated
			 Ditch Companies, Incorporated, agrees to assume liability for any work
			 performed, or supervised, with Federal funds provided to it under this section;
			 and</text>
					</subparagraph><subparagraph id="HC87A0F855CC347C0B550F654BDC45DC9"><enum>(C)</enum><text>the United States
			 shall not be liable for damages of any kind arising out of any act, omission,
			 or occurrence relating to a facility rehabilitated or constructed with Federal
			 funds provided under this section, both while and after activities are
			 conducted using Federal funds provided under this section.</text>
					</subparagraph></paragraph><paragraph id="H7A307969F2CE4145849BC378C65E6457"><enum>(3)</enum><header>Cost
			 sharing</header>
					<subparagraph id="H0C609B955AA64AD39D606280C7E7F829"><enum>(A)</enum><header>In
			 general</header><text>The Federal share of the costs of activities authorized
			 under this section shall not exceed 50 percent.</text>
					</subparagraph><subparagraph id="H06C03E8B16844F658487DA907DC6BD4"><enum>(B)</enum><header>Exclusions from
			 federal share</header><text>There shall not be credited against the Federal
			 share of such costs—</text>
						<clause id="H4620A25EC2F4409A9D8D5833B569FA15"><enum>(i)</enum><text>any expenditure by
			 the Bonneville Power Administration in the Wallowa River watershed; and</text>
						</clause><clause id="H7BA278AD6BFD44DAA7C15778BE657CFA"><enum>(ii)</enum><text>expenditures made
			 by individual agricultural producers in any Federal commodity or conservation
			 program.</text>
						</clause></subparagraph></paragraph><paragraph id="H4F4E10EB5D544DF7882F145D10300028"><enum>(4)</enum><header>Compliance with
			 state law</header><text>The Secretary, in carrying out this section, shall
			 comply with applicable Oregon State water law.</text>
				</paragraph><paragraph id="H0A47BA05F748424D8312877C5BE3B4A1"><enum>(5)</enum><header>Prohibition on
			 holding title</header><text>The Federal Government shall not hold title to any
			 facility rehabilitated or constructed under this section.</text>
				</paragraph><paragraph id="H9E0E109921FF4C270042C466C5D84CDD"><enum>(6)</enum><header>Prohibition on
			 operation and maintenance</header><text>The Federal Government shall not be
			 responsible for the operation and maintenance of any facility constructed or
			 rehabilitated under this section.</text>
				</paragraph></subsection><subsection id="H4F688B2D6F44417C00FF47C49872A172"><enum>(c)</enum><header>Relationship to
			 other law</header><text>Activities funded under this section shall not be
			 considered a supplemental or additional benefit under Federal reclamation law
			 (the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental
			 to and amendatory of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/371">43 U.S.C. 371 et seq.</external-xref>)).</text>
			</subsection><subsection id="H1117AD38EA49400682D709552FE47B07"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to the
			 Secretary to pay the Federal share of the costs of activities authorized under
			 this section, $6,000,000.</text>
			</subsection><subsection id="H9398C1EA7F8F4A2AADCCF1DA1D2FCA29"><enum>(e)</enum><header>Sunset</header><text>The
			 authority of the Secretary to carry out any provisions of this section shall
			 terminate 10 years after the date of the enactment of this section.</text>
			</subsection></section><section id="HF95AC9D4521B420F874D4D532300C6B6" section-type="subsequent-section"><enum>4.</enum><header>Little Butte/Bear
			 Creek Subbasins, Oregon, Water resource study</header>
			<subsection id="H8A0DE12E8C984DCCB43636B596EB49D6"><enum>(a)</enum><header>Authorization</header><text>The
			 Secretary of the Interior, acting through the Bureau of Reclamation, may
			 participate in the Water for Irrigation, Streams and the Economy Project water
			 management feasibility study and environmental impact statement in accordance
			 with the <quote>Memorandum of Agreement Between City of Medford and Bureau of
			 Reclamation for the Water for Irrigation, Streams, and the Economy
			 Project</quote>, dated July 2, 2004.</text>
			</subsection><subsection id="H4A22A297DC4B40B2822CA988626D88BE"><enum>(b)</enum><header>Authorization of
			 Appropriations</header>
				<paragraph id="H2768D7D3A15344FD809B36DF937996FE"><enum>(1)</enum><header>In
			 general</header><text>There is authorized to be appropriated to the Bureau of
			 Reclamation $500,000 to carry out activities under this section.</text>
				</paragraph><paragraph id="H352E889D18F64F7CB3EB8C6D1E91799E"><enum>(2)</enum><header>Non-federal
			 share</header>
					<subparagraph id="H4B617879AA10419EB91171D6F9ADA7E2"><enum>(A)</enum><header>In
			 general</header><text>The non-Federal share shall be 50 percent of the total
			 costs of the Bureau of Reclamation in carrying out subsection (a).</text>
					</subparagraph><subparagraph id="H8469176D4F0440FBB7E0B71FF2DCC2E"><enum>(B)</enum><header>Form</header><text>The
			 non-Federal share required under subparagraph (A) may be in the form of any
			 in-kind services that the Secretary of the Interior determines would contribute
			 substantially toward the conduct and completion of the study and environmental
			 impact statement required under subsection (a).</text>
					</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H2E389E3149AA4834ACA17B0057E828CC"><enum>(c)</enum><header>Sunset</header><text>The
			 authority of the Secretary to carry out any provisions of this section shall
			 terminate 10 years after the date of the enactment of this section.</text>
			</subsection></section><section id="H9C4D4B66CAD34F28877CB0E99EDB3DBE"><enum>5.</enum><header>North Unit
			 Irrigation District</header>
			<subsection id="HF3E5343F904E4F38AEF98E76B66313E"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This section may be
			 cited as the <quote>North Unit Irrigation District Act of 2006</quote>.</text>
			</subsection><subsection id="H108935B6CAAD407D809E9544AAF83D18"><enum>(b)</enum><header>Amendment</header><text display-inline="yes-display-inline">The Act of August 10, 1954 (68 Stat. 679,
			 chapter 663), is amended—</text>
				<paragraph id="H9C439BAB6833434D95E2D03F79799A2"><enum>(1)</enum><text>in the first
			 section—</text>
					<subparagraph id="H3CFBC2F122B548E9B22EF0A74C9E737D"><enum>(A)</enum><text>by inserting
			 <quote>(referred to in this Act as the <quote>District</quote>)</quote> after
			 <quote>irrigation district</quote>; and</text>
					</subparagraph><subparagraph id="H2D1D67405B954345B8DEAEBC0E6128F"><enum>(B)</enum><text>by inserting
			 <quote>(referred to in this Act as the <quote>Contract</quote>)</quote> after
			 <quote>1953</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H08F0ED91C7B44F55A1682527CB5DCD4"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H678F5B9DBEAD46F588D53B7219003DE4" style="OLC" changed="added">
						<section id="H6407A13C0E7E467E8DB15644A8512EE5"><enum>3.</enum><header>Additional
				terms</header><text display-inline="no-display-inline">On approval of the
				District directors and notwithstanding project authorizing legislation to the
				contrary, the Contract is modified, without further action by the Secretary of
				the Interior, to include the following modifications:</text>
							<paragraph id="HFB6FFDE712704DF9BCDE924BC0B26200"><enum>(1)</enum><text>In Article 8(a) of
				the Contract, by deleting <quote>a maximum of 50,000</quote> and inserting
				<quote>approximately 59,000</quote> after <quote>irrigation service
				to</quote>.</text>
							</paragraph><paragraph id="HFB5058B330344CCE98053103B7869203"><enum>(2)</enum><text>In Article 11(a)
				of the Contract, by deleting <quote>The classified irrigable lands within the
				project comprise 49,817.75 irrigable acres, of which 35,773.75 acres are in
				Class A and 14,044.40 in Class B. These lands and the standards upon which the
				classification was made are described in the document entitled <quote>Land
				Classification, North Unit, Deschutes Project, 1953</quote> which is on file in
				the office of the Regional Director, Bureau of Reclamation, Boise, Idaho, and
				in the office of the District</quote> and inserting <quote>The classified
				irrigable land within the project comprises 58,902.8 irrigable acres, all of
				which are authorized to receive irrigation water pursuant to water rights
				issued by the State of Oregon and have in the past received water pursuant to
				such State water rights.</quote>.</text>
							</paragraph><paragraph id="H9935421A8B6D4D5082A335F961C2ED9E"><enum>(3)</enum><text>In Article 11(c)
				of the Contract, by deleting <quote>, with the approval of the
				Secretary,</quote> after <quote>District may</quote>, by deleting <quote>the
				49,817.75 acre maximum limit on the irrigable area is not exceeded</quote> and
				inserting <quote>irrigation service is provided to no more than approximately
				59,000 acres and no amendment to the District boundary is required</quote>
				after <quote>time so long as</quote>.</text>
							</paragraph><paragraph id="H4B029A3FA1F24C2F9C25FAE86147DBDC"><enum>(4)</enum><text>In Article 11(d)
				of the Contract, by inserting <quote>, and may further be used for instream
				purposes, including fish or wildlife purposes, to the extent that such use is
				required by Oregon State law in order for the District to engage in, or take
				advantage of, conserved water projects as authorized by Oregon State
				law</quote> after <quote>herein provided</quote>.</text>
							</paragraph><paragraph id="H054924FB0BEC4F44B02E7660183CFA10"><enum>(5)</enum><text>By adding at the
				end of Article 12(d) the following: <quote>(e) Notwithstanding the above
				subsections of this Article or Article 13 below, beginning with the irrigation
				season immediately following the date of enactment of the North Unit Irrigation
				District Act of 2006, the annual installment for each year, for the District,
				under the Contract, on account of the District’s construction charge
				obligation, shall be a fixed and equal annual amount payable on June 30 the
				year following the year for which it is applicable, such that the District’s
				total construction charge obligation shall be completely paid by June 30,
				2044.</quote>.</text>
							</paragraph><paragraph id="HC9EB834E46AB41D5BE787C19D5BAC16C"><enum>(6)</enum><text>In Article 14(a)
				of the Contract, by inserting <quote>and for instream purposes, including fish
				or wildlife purposes, to the extent that such use is required by Oregon State
				law in order for the District to engage in, or take advantage of, conserved
				water projects as authorized by Oregon State law,</quote> after <quote>and
				incidental stock and domestic uses</quote>, by inserting <quote>and for
				instream purposes as described above,</quote> after <quote>irrigation, stock
				and domestic uses</quote>, and by inserting <quote>, including natural flow
				rights out of the Crooked River held by the District</quote> after
				<quote>irrigation system</quote>.</text>
							</paragraph><paragraph id="H155DCBF448244472ADD00A36E226EC"><enum>(7)</enum><text>In Article 29(a) of
				the Contract, by inserting <quote>and for instream purposes, including fish or
				wildlife purposes, to the extent that such use is required by Oregon State law
				in order for the District to engage in, or take advantage of, conserved water
				projects as authorized by Oregon State law</quote> after <quote>provided in
				article 11</quote>.</text>
							</paragraph><paragraph id="H04FB04ED5AE146E1A2FCF803DD33094E"><enum>(8)</enum><text>In Article 34 of
				the Contract, by deleting <quote>The District, after the election and upon the
				execution of this contract, shall promptly secure final decree of the proper
				State court approving and confirming this contract and decreeing and adjudging
				it to be a lawful, valid, and binding general obligation of the District. The
				District shall furnish to the United States certified copies of such decrees
				and of all pertinent supporting records.</quote> after <quote>for that
				purpose.</quote>.</text>
							</paragraph></section><section id="H01BB60A46F314BBC8DC6DE2708B8045F"><enum>4.</enum><header>Future authority
				to renegotiate</header><text display-inline="no-display-inline">The Secretary
				of the Interior (acting through the Commissioner of Reclamation) may in the
				future renegotiate with the District such terms of the Contract as the District
				directors determine to be necessary, only upon the written request of the
				District directors and the consent of the Commissioner of
				Reclamation.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section></legis-body>
