<subsection id="H822F84DA289C489C869705121294A1E0"><enum>(a)</enum><header>Annual Reports</header>
<paragraph id="H569A83B7A70D4DF6817CA1FD86FDF58"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/1117">Section 1117</external-xref> of title 49, United States Code, is amended—</text>
<subparagraph id="H344F65BCFE8B4E80BA6975C388FF8C5F"><enum>(A)</enum><text>in paragraph (2) by striking <quote>and</quote> after the semicolon;</text></subparagraph>
<subparagraph id="HCFE3BAC23BC04B6E9E831F353D18302F"><enum>(B)</enum><text>in paragraph (3) by striking <quote>State.</quote> and inserting <quote>State;</quote>; and</text></subparagraph>
<subparagraph id="HA7FFDF239418429296BE4C3C85361962"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HF5330ABBEB8243A1876482D590F8AF65"><enum>(4)</enum><text>a description of the activities and operations of the National Transportation Safety Board Academy during the prior calendar year;</text></paragraph>
<paragraph id="H27826A24BDA54D3CA8E4F9EC4418888"><enum>(5)</enum><text>a list of accidents, during the prior calendar year, that the Board was required to investigate under section 1131 but did not investigate and an explanation of why they were not investigated; and</text></paragraph>
<paragraph id="H9A87F821A0AF4D09BC52EA1CD2D0F45F" commented="no"><enum>(6)</enum><text>a list of ongoing investigations that have exceeded the expected time allotted for completion by Board order and an explanation for the additional time required to complete each such investigation. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H1DA2E9DF07674A0B9F70C80009820087"><enum>(2)</enum><header>Utilization plan</header>
<subparagraph id="H2D5E9D164CE140578D11F406B95C4729"><enum>(A)</enum><header>Plan</header><text>Within 90 days after the date of enactment of this Act, the National Transportation Safety Board shall—</text>
<clause id="H5A615D621F64411289B9593FE9A92FE"><enum>(i)</enum><text>develop a plan to achieve, to the maximum extent feasible, the self-sufficient operation of the National Transportation Safety Board Academy and utilize the Academy’s facilities and resources;</text></clause>
<clause id="HFCB604A93D3347C1ACB7BF09EA5BEE54"><enum>(ii)</enum><text>submit a draft of the plan to the Comptroller General for review and comment; and</text></clause>
<clause id="H4AA89C1748184A4AAF45A02B2503C637"><enum>(iii)</enum><text>submit a draft of the plan to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></clause></subparagraph>
<subparagraph id="HD362D7138F7B41FF8B61C2B2E398004E"><enum>(B)</enum><header>Plan development considerations</header><text>The Board shall—</text>
<clause id="H4ABB64467D6E4202995E64DFB93E836"><enum>(i)</enum><text>give consideration in developing the plan under subparagraph (A)(i) to other revenue-generating measures, including subleasing the facility to another entity; and</text></clause>
<clause id="H628E0EA7A3A046F0AFA7704BB9FAF13"><enum>(ii)</enum><text>include in the plan a detailed financial statement that covers current Academy expenses and revenues and an analysis of the projected impact of the plan on the Academy’s expenses and revenues.</text></clause></subparagraph>
<subparagraph id="H8F30664A3D014DF48F8F4EFE4886D763"><enum>(C)</enum><header>Report</header><text>Within 180 days after the date of enactment of this Act, the National Transportation Safety Board shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives that includes—</text>
<clause id="H40472CA998AC4BE89F3C2647F89674D5"><enum>(i)</enum><text>an updated copy of the plan developed pursuant to subparagraph (A)(i);</text></clause>
<clause id="H50F863AC9685497EB3CCD452A174FDCB"><enum>(ii)</enum><text>any comments and recommendations made by the Comptroller General pursuant to the Government Accountability Office’s review of the draft plan; and</text></clause>
<clause id="H33B9C15CAD2B437285BDE62DC00A710"><enum>(iii)</enum><text>a response to the Comptroller General’s comments and recommendations, including a description of any modifications made to the plan in response to those comments and recommendations.</text></clause></subparagraph>
<subparagraph id="H450F8F730567478E9FD9558CB4CFFF32" commented="no"><enum>(D)</enum><header>Implementation</header><text>The plan developed pursuant to subparagraph (A)(i) shall be implemented within 2 years after the date of enactment of this Act.</text></subparagraph></paragraph></subsection>
<subsection id="HC93D8402A14447989BBEC5471BB16C18"><enum>(b)</enum><header>DOT Report on Compliance With Recommendations</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/1135">Section 1135(d)(3)</external-xref> of title 49, United States Code, is amended to read as follows:</text>
<quoted-block style="OLC" id="H3A9ABD6836414F7D87A27F29B97988B" display-inline="no-display-inline">
<paragraph id="H3CBDF0602798478EB9677219E7E830D3"><enum>(3)</enum><header>Compliance report with recommendations</header><text display-inline="yes-display-inline">Within 90 days after the date on which the Secretary submits a report under this subsection, the Board shall review the Secretary’s report and transmit comments on the report to the Secretary, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H36E5C76EA8B14DC287ACA2B4C1C9193"><enum>3.</enum><header>Investigation services</header>
<subsection id="H4F91C9D9CD4D4BF5A3905BDBCFA70895"><enum>(a)</enum><header>In general</header><text>Section 4(a) of the National Transportation Safety Board Reauthorization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/168">Public Law 108–168</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/1113">49 U.S.C. 1113</external-xref> note) is amended by striking <quote>From the date of enactment of this Act through September 30, 2006, the</quote> and inserting <quote>The</quote>.</text></subsection>
<subsection id="HFC7E5AB81FA343128BB4250053E4002D"><enum>(b)</enum><header>Report</header><text>Section 4(b) of such Act is amended—</text>
<paragraph id="H2AB1E87FC23346F5931924B7971D79C7" display-inline="no-display-inline"><enum>(1)</enum><text> by striking <quote>On February 1, 2006,</quote> and inserting <quote>On July 1 of each year, as part of the annual report required by <external-xref legal-doc="usc" parsable-cite="usc/49/1117">section 1117</external-xref> of title 49, United States Code,</quote>; and</text></paragraph>
<paragraph id="H55C83AD75CD34068AF76EE558BD7080"><enum>(2)</enum><text>in paragraph (1) by striking <quote>for $25,000 or more</quote>.</text></paragraph></subsection></section>
<section id="H2B156D0813954D60AFEF8B569DD83B1" commented="no"><enum>4.</enum><header>Expenses of DOT Inspector General</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/1137">Section 1137(d)</external-xref> of title 49, United States Code, is amended to read as follows:</text>

<subsection id="HAFADEACF2B664012BEA669936FEDA539" commented="no"><enum>(d)</enum><header>Authorizations of Appropriations</header>
<paragraph id="H4C6985A926C4478500C73DCA2FDCDC3" commented="no"><enum>(1)</enum><header>Funding</header><text>There are authorized to be appropriated to the Secretary of Transportation for use by the Inspector General of the Department of Transportation such sums as may be necessary to cover expenses associated with activities pursuant to the authority exercised under this section.</text></paragraph>
<paragraph id="H285FBBF5AD0D4FE3B7929B93088591C7" commented="no"><enum>(2)</enum><header>Reimbursable agreement</header><text>In the absence of an appropriation under this subsection for an expense referred to in paragraph (1), the Inspector General and the Board shall have a reimbursable agreement to cover such expense.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H76D22F75F6A34E1CB3DD5C40AEBE27"><enum>5.</enum><header>Evaluation and audit of the National Transportation Safety Board</header>
<subsection id="HA01F037108B94AAD9CE3483043FD1DCA"><enum>(a)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/11">chapter 11</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>
<quoted-block id="H12923E66C50748DAA69394B4E39BDCE" style="USC">
<section id="H9159E7D1F4344707B9051812D5C29B60"><enum>1138.</enum><header>Evaluation and audit of National Transportation Safety Board</header>
<subsection id="H6852FC17A72B480C00FBCA1BB00BDFE"><enum>(a)</enum><header>In general</header><text>To promote economy, efficiency, and effectiveness in the administration of the programs, operations, and activities of the National Transportation Safety Board, the Comptroller General of the United States shall evaluate and audit the programs and expenditures of the National Transportation Safety Board. Such evaluation and audit shall be conducted at least annually, but may be conducted as determined necessary by the Comptroller General or the appropriate congressional committees.</text></subsection>
<subsection id="HD534C15E60EC4F3CB7B213C55F4FF7DD"><enum>(b)</enum><header>Responsibility of Comptroller General</header><text>The Comptroller General shall evaluate and audit Board programs, operations, and activities, including—</text>
<paragraph id="H926AB71ADD9E4B4384BCA1DE32616165"><enum>(1)</enum><text>information management and security, including privacy protection of personally identifiable information;</text></paragraph>
<paragraph id="H4F26798BF03E4008A47F3EAED072168"><enum>(2)</enum><text>resource management;</text></paragraph>
<paragraph id="H9C3050A9F0EE45BDAC05659448A32339"><enum>(3)</enum><text>workforce development;</text></paragraph>
<paragraph id="H899DE5A0FDDA4AB6BD89B88DD5B5425B"><enum>(4)</enum><text>procurement and contracting planning, practices and policies;</text></paragraph>
<paragraph id="HFFECD0336BBD4949BD68EA0800C6C837"><enum>(5)</enum><text>the extent to which the Board follows leading practices in selected management areas; and</text></paragraph>
<paragraph id="H9BF71105FB0E477BA0F06BCD3742F59B"><enum>(6)</enum><text>the extent to which the Board addresses management challenges in completing accident investigations.</text></paragraph></subsection>
<subsection id="H9313012A13DC4142B32BC26C73DB3B"><enum>(c)</enum><header>Appropriate congressional committees</header><text>For purposes of this section the term <quote>appropriate congressional committees</quote> means the Committee on Commerce, Science and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H5A2B3197CB1F408F83BC3DB62976C511"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for such chapter is amended by inserting after the item relating to section 1137 the following:</text>

<toc-entry level="section">1138. Evaluation and audit of National Transportation Safety Board </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HF336E341FD47458E9391E2001D422589"><enum>6.</enum><header>Audit procedures</header><text display-inline="no-display-inline"> The National Transportation Safety Board, in consultation with the Inspector General of the Department of Transportation, shall continue to develop and implement comprehensive internal audit controls for its operations. The audit controls shall address, at a minimum, Board asset management systems, including systems for accounting management, debt collection, travel, and property and inventory management and control.</text></section>
<section id="HD313E9911ACF4C6496B8C0EEDAF0E349"><enum>7.</enum><header>Implementation of NTSB’s <quote>Most Wanted Transportation Safety Improvements, 2006</quote></header><text display-inline="no-display-inline"> Within 90 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall submit a report to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives explaining why the Federal Aviation Administration has not implemented the aviation recommendations in the <quote>Most Wanted Transportation Safety Improvements, 2006</quote> of the National Transportation Safety Board.</text></section>
<section id="H7EBED947D94643FB801550E17D6875CF"><enum>8.</enum><header>Authorization of appropriations</header>
<subsection id="HE2E92A61A28B4DD5A3008135B115B2E4"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/1118">Section 1118(a)</external-xref> of title 49, United States Code, is amended—</text>
<paragraph id="HAECCE845D9D94B16B9745692A3124CC8"><enum>(1)</enum><text>by striking <quote>and</quote> after <quote>2005,</quote>; and</text></paragraph>
<paragraph id="H57B11B46EBA94E5B994288B353386650"><enum>(2)</enum><text>by striking <quote>2006.</quote> and inserting <quote>2006, $81,594,000 for fiscal year 2007, and $92,625,000 for fiscal year 2008.</quote>.</text></paragraph></subsection>
<subsection id="HF811F8A0B65C425680234B003E532EF1"><enum>(b)</enum><header>Fees, Refunds, and Reimbursements</header>
<paragraph id="H366B0385078B46C1AEB626115817D02B"><enum>(1)</enum><header>In general</header><text>Section 1118(c) of such title is amended to read as follows:</text>

<subsection id="HF74CFF2121EF449FA6CD6F6E1B7751C9"><enum>(c)</enum><header>Fees, refunds, and reimbursements</header></subsection>
<paragraph id="HDA6148F651BE452990A6D5058564DF31"><enum>(1)</enum><header>In general</header><text>The Board may impose and collect such fees, refunds, and reimbursements as it determines to be appropriate for services provided by or through the Board.</text></paragraph>
<paragraph id="HEDD3DB1D0CD54A6B9BE4647657A4C420"><enum>(2)</enum><header>Receipts credited as offsetting collections</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, any fee, refund, or reimbursement collected under this subsection—</text>
<subparagraph id="H24FAD8819A1E4159A3978BE800F84B43"><enum>(A)</enum><text>shall be credited as offsetting collections to the account that finances the activities and services for which the fee is imposed or with which the refund or reimbursement is associated;</text></subparagraph>
<subparagraph id="H209987F8F00F4CCE81EA8D3038F215D1"><enum>(B)</enum><text>shall be available for expenditure only to pay the costs of activities and services for which the fee is imposed or with which the refund or reimbursement is associated; and</text></subparagraph>
<subparagraph id="H0A6F39EE694E4FCCAC008FE021D5B69E"><enum>(C)</enum><text>shall remain available until expended.</text></subparagraph></paragraph>
<paragraph id="H5DB0C6C543104B8596A6FDE577C0C612"><enum>(3)</enum><header>Refunds</header><text>The Board may refund any fee paid by mistake or any amount paid in excess of that required.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H13DA6BB2E7A347BAA6E6AA3C00F31D32"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on October 1, 2005.</text></paragraph></subsection>
<subsection id="HE37FB562E48446FEB777AEF5D5D132C4"><enum>(c)</enum><header>Report</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/1118">Section 1118(d)</external-xref> of title 49, United States Code, is repealed.</text></subsection></section>
<section id="HECB3A436CA9046A0B9E0CA3B7F8393DB"><enum>9.</enum><header>Technical corrections</header>
<subsection id="H011BA718F74B46F69BE40544CDEAE48D"><enum>(a)</enum><header>Functional Unit for Marine Investigations</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/1111">Section 1111(g)</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<paragraph id="HC2DC45AC8EC8429A875C71CA22BF124C"><enum>(5)</enum><text>marine.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HE8097D21AAEE44089500318E66D4F579" commented="no"><enum>(b)</enum><header>Marine Casualty Investigations</header><text>Section 1131(a)(1)(E) of such title is amended—</text>
<paragraph id="H7A3BA43AB7434FDA9DDC82E6003BD057" commented="no"><enum>(1)</enum><text>by striking <quote>on the navigable waters or territorial sea of the United States,</quote> and inserting <quote>on or under the navigable waters, internal waters, or the territorial sea of the United States as described in Presidential Proclamation No. 5928 of December 27, 1988,</quote>; and</text></paragraph>
<paragraph id="HF788A59AE1B947508438FD00D8228796" commented="no"><enum>(2)</enum><text>by inserting <quote>(as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(46)</external-xref> of title 46)</quote> after <quote>vessel of the United States</quote>.</text></paragraph></subsection>
<subsection id="H9189FCFB9DFA4695ADA7EEDE8CE8ECD"><enum>(c)</enum><header>Reference to Departmental Authority</header><text>Section 1131(c)(1) of such title is amended by inserting <quote>or the Secretary of the department in which the Coast Guard is operating</quote> after <quote>Transportation</quote>.</text></subsection>
<subsection id="HC2553B222A554E65925E18C5B2005D6B"><enum>(d)</enum><header>Appointment of Staff</header><text>Section 1111 of such title is amended—</text>
<paragraph id="HB58FE602DC6345E1A174E0FA0898507B"><enum>(1)</enum><text>by striking paragraph (1) of subsection (e) and inserting the following:</text>
<quoted-block id="H00B0FBE625614F458F1C2876FD78AF5E" style="OLC">
<paragraph id="H5D1B4011E106498AA2D645D486612425"><enum>(1)</enum><text>appoint and supervise officers and employees, other than regular and full-time employees in the immediate offices of another member, necessary to carry out this chapter;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H86B16D66D3344EF094231D7E69B4BF24"><enum>(2)</enum><text>by redesignating paragraphs (2) and (3) of subsection (e) as paragraphs (3) and (4), respectively;</text></paragraph>
<paragraph id="H9118F2A253164744AA029EB7D41F2EF"><enum>(3)</enum><text>by inserting after paragraph (1) of subsection (e) the following:</text>

<paragraph id="H1F3418F6BD8B47CB91751365ADC0538"><enum>(4)</enum><text>by redesignating subsection (i) as subsection (j); and</text></paragraph>

<subsection id="H789ED797BD194E9891D0449ED9A30061"><enum>(i)</enum><header>Board Member Staff</header><text>Each member of the Board shall select and supervise regular and full-time employees in his or her immediate office as long as any such employee has been approved for employment by the designated agency ethics official under the same guidelines that apply to all employees of the Board. Except for the Chairman, the appointment authority provided by this subsection is limited to the number of full-time equivalent positions, in addition to 1 senior professional staff at a level not to exceed the GS 15 level and 1 administrative staff, allocated to each member through the Board’s annual budget and allocation process. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HEBEACB33C3FA44ACB4D535A4518BFA6F"><enum>(e)</enum><header>Spelling correction</header><text>Section 1113(a) of such title is amended in paragraphs (3) and (4) by striking <quote>subpena</quote> and inserting <quote>subpoena</quote>. </text></subsection>
<subsection id="H98F232AE5E77409BA003AD68CBB58E9D"><enum>(f)</enum><header>Board review</header><text>Section 1113(c) of such title is amended by inserting after the period at the end the following: <quote>The Board shall develop and approve a process for the Board’s review and comment or approval of documents submitted to the President, Director of the Office of Management and Budget, or Congress under this subsection.</quote>. </text></subsection>
<subsection id="H8882F1AD6DD8456E8CDE00C76000ECE5"><enum>(g)</enum><header>Investigative Officers</header><text>Section 1113 of such title is amended by adding at the end the following:</text>

<subsection id="H22F38C5702FF40C4A8E2FC3470BCEC4C"><enum>(h)</enum><header>Investigative Officers</header><text>The Board shall maintain at least 1 full-time employee in each State located more than 1,000 miles from the nearest Board regional office to provide initial investigative response to accidents the Board is empowered to investigate under this chapter that occur in that State.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HE14B7A19FF854D39ABF0437CBBD6221D"><enum>10.</enum><header>Safety review</header>
<subsection id="HF64C5E361CC24EE397D150FE3B4CF63C"><enum>(a)</enum><header>Safety area alternatives</header><text display-inline="yes-display-inline">With regard to an environmental review of a project to improve runway safety areas on Runway 8/26 at Juneau International Airport, the Secretary of Transportation may only select as the preferred alternative the least expensive runway safety area alternative that meets the standards of the Federal Aviation Administration and that maintains the length of the runway as of the date of enactment of this Act.</text></subsection>
<subsection id="HADD35D0B0ABA416E95CA18CDE5008FD5"><enum>(b)</enum><header>Costs to be considered</header><text>In determining what is the least expensive runway safety area for purposes of subsection (a), the Secretary shall consider, at a minimum, the initial development costs and life cycle costs of the project.</text></subsection>
<subsection id="H12DDCBE2B923452083D9E55B39DC45E1"><enum>(c)</enum><header>Satisfaction of requirement</header><text>With respect to the project described in subsection (a), the requirements of <external-xref legal-doc="usc" parsable-cite="usc/49/303">section 303(c)(1)</external-xref> of title 49, United States Code, shall be considered to be satisfied by the selection of the least expensive safety area alternative.</text></subsection></section>
<section id="H1D02843A0967476100279E275B7878F0"><enum>11.</enum><header>DOT Inspector General oversight and investigations related to Central Artery tunnel project</header>
<subsection id="HD648A1EBC6FF49188006C07DE29DA1B"><enum>(a)</enum><header>Oversight of safety review</header><text display-inline="yes-display-inline">The Inspector General of the Department of Transportation shall provide objective and independent oversight of the activities performed by the Federal Highway Administration, the Massachusetts Executive Office of Transportation, and the Massachusetts Department of Transportation for the project-wide safety review initiated as a result of the July 10, 2006, accident in the Central Artery tunnel project in Boston, Massachusetts. The Inspector General shall ensure that such oversight is comprehensive, complete, and carried out in a rigorous manner. </text></subsection>
<subsection id="H6ACBCFBD93D8441080256B47CFF966F"><enum>(b)</enum><header>Investigations of criminal and fraudulent activities</header><text>In cooperation with the Attorney General of the United States and the Attorney General of the Commonwealth of Massachusetts, the Inspector General shall investigate criminal or fraudulent acts committed in the design, expenditure of funds, and construction of the Central Artery tunnel project.</text></subsection>
<subsection id="H1B4D913C61FE4C6FBD5200476F543F56"><enum>(c)</enum><header>Reports to Congress</header><text>The Inspector General shall submit to Congress periodically reports on the oversight and investigative activities conducted pursuant to this section, together with any recommendations and observations of the Inspector General. If the Inspector General identifies any safety issues of a time sensitive and critical nature in carrying out this section, the Inspector General shall promptly notify Congress.</text></subsection></section>
