<section id="H2C4FAB626E174C99A476DB3676C4C933" section-type="section-one"><enum>1.</enum><header>Short title</header> 
<subsection id="H42BF2D88DA3A43D888CF741DBEEF43A3"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Animas River Good Samaritan Mined Land Remediation Pilot Project Act</short-title></quote>.</text></subsection></section> 
<section id="HED129EB88EFE442E86EBCF3C0100C6EC"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="H6635280281294FB590A226AC00E9E40"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="HA9FDEEF761A74DCDB054923ED1F913BD"><enum>(1)</enum><text display-inline="yes-display-inline">thousands of abandoned or inactive mines exist in the West and elsewhere in the United States that often cause acid mine drainage into our Nation’s waters;</text></paragraph> 
<paragraph id="H3AE37B77CA484B89BA07543651003C00"><enum>(2)</enum><text>often, a person that is responsible for conditions at abandoned or inactive mined land is not identifiable or economically viable, resulting in an inability to compel the person to clean up the mine site;</text></paragraph> 
<paragraph id="H758F481408DB4CAF87A3E4D2661B02D5"><enum>(3)</enum><text>cleanup of these sites is hampered by liability concerns and disagreements over how those concerns should be addressed;</text></paragraph> 
<paragraph id="HCD747BBB310B4ECF95976D3570AA11AA"><enum>(4)</enum><text>a pilot program in a small geographic area may demonstrate how best to address liability issues;</text></paragraph> 
<paragraph id="HF1CCFF04DCD545DAAFD3CFF9E59485F"><enum>(5)</enum><text>only a small number of the hundreds of inactive mines in the Upper Animas River basin in San Juan County, Colorado, have been actively mined since the 1940’s;</text></paragraph> 
<paragraph id="H824D6D77E268453AB96D8277F1EB5B3E"><enum>(6)</enum><text>29 total maximum daily load allocations have been established pursuant to section 303(d) of the Federal Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C. 1313(d)</external-xref>) for particular metals in specific segments of the Upper Animas River basin; and</text></paragraph> 
<paragraph id="H62F9555DC74D4295A342F609905D9767"><enum>(7)</enum><text>the Upper Animas River basin is one of 2 geographic areas nationwide chosen for intensive study under the Department of Interior’s Abandoned Mine Lands Initiative.</text></paragraph></subsection> 
<subsection id="H784A5D070E224CD09327EDB8C8345DF1"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to initiate a 10-year pilot program in the Upper Animas River basin which facilitates the cleanup of abandoned and inactive mine sites in the basin that negatively impact water quality by limiting liability under sections 301, 302, and 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1311">33 U.S.C. 1311</external-xref>, 1313, 1342) for third parties not responsible for the degradation but who take steps to improve water quality.</text></subsection></section> 
<section id="H0005856F24464DBA81330064F21054DC"><enum>3.</enum><header>Abandoned or inactive mined land remediation permits</header><text display-inline="no-display-inline">Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H1B6FD772967D4CE2951EF96B11061B0" display-inline="no-display-inline"> 
<subsection id="HB2BD71B21E07457EAB72F44D88E1A0B1"><enum>(r)</enum><header>Abandoned or inactive mined land remediation permits</header> 
<paragraph id="HC321544944D547F4A9EE2D2182FFB480"><enum>(1)</enum><header>Definitions</header><text>In this subsection, the following definitions apply:</text> 
<subparagraph id="HC059E9993B5F450B9F00BB000913A183"><enum>(A)</enum><header>Abandoned or inactive mined land</header><text display-inline="yes-display-inline">The term <quote>abandoned or inactive mined land</quote> means land located in the Animas River watershed above Elk Creek in San Juan County, Colorado, formerly hardrock mined for noncoal resources—</text> 
<clause id="HEA2C2CC5910648A4004799E0EAD5BD52"><enum>(i)</enum><text>that is no longer actively mined (and not in temporary shutdown) as of January 1, 1992;</text></clause> 
<clause id="H4631E907DE5E4040B740EF5919303093"><enum>(ii)</enum><text>that is not included on the National Priorities List under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>); and</text></clause> 
<clause id="H307812456AE540E6836061BB9DE1D3D"><enum>(iii)</enum><text>for which there is no known responsible owner or operator.</text></clause></subparagraph> 
<subparagraph id="H111D432B52D5439EB3FE58E8FD3200"><enum>(B)</enum><header>Responsible owner or operator</header><text>The term <quote>responsible owner or operator</quote> means a person, including a governmental entity—</text> 
<clause id="H753D7B6AC8564563BF00ED4681F4E536"><enum>(i)</enum><text>that is responsible for activities conducted at abandoned or inactive mined land that created conditions that cause or contribute to the discharge of pollutants from the abandoned or inactive mined land; and</text></clause> 
<clause id="H7B6FBF3DDF4C408797B9A15233767DE"><enum>(ii)</enum><text>that is financially capable of compliance with the requirements of sections 301 and 302 and this section.</text></clause></subparagraph> 
<subparagraph id="HDBFC847AECF84445AAE28F8DDAA21FEE"><enum>(C)</enum><header>Remediating party</header><text>The term <quote>remediating party</quote> means—</text> 
<clause id="H8BB93102D0604C3680B08F56EED22603"><enum>(i)</enum><text>the United States, except with respect to abandoned or inactive mined land located on Federal land;</text></clause> 
<clause id="HE5FA1D40692F449C87513825C4077EC3"><enum>(ii)</enum><text>the State of Colorado or political subdivision thereof; or</text></clause> 
<clause id="H34F6003E4F7A4A2496EDEE671CF9EA" commented="no"><enum>(iii)</enum><text>a person that is not—</text> 
<subclause id="H3648362097604C0298E9A820A3DF641" commented="no"><enum>(I)</enum><text>responsible for activities conducted at the site to be remediated that caused or contributed to the discharge of pollutants from the site; or</text></subclause> 
<subclause id="H2F15E4011F724D589028BE262406C083" commented="no"><enum>(II)</enum><text>the owner of the site.</text></subclause></clause></subparagraph> 
<subparagraph id="H6952B924E87549C0A3AB3D1C98452430"><enum>(D)</enum><header>Cooperating party</header><text display-inline="yes-display-inline">The term <quote>cooperating party</quote> means any person, including a governmental entity, that is not the owner of the site to be remediated or responsible for activities conducted at the site to be remediated that caused or contributed to the discharge of pollutants from the site—</text> 
<clause id="H0946C20001F349B49F552523B825831E"><enum>(i)</enum><text>participates in the design or implementation of the practices described in paragraph (3)(B)(viii) with respect to such site;</text></clause> 
<clause id="HEFD59A199FCA462B8684E4E68D6865FE"><enum>(ii)</enum><text>participates in the design or implementation of monitoring or other forms of assessment described in paragraph (3)(B)(x) with respect to such site; or</text></clause> 
<clause id="H338C37E8F29646D59F12DC2C83905DB7"><enum>(iii)</enum><text>raises, contributes, or administers funding or in-kind services for the purposes described in paragraph (3)(B)(viii) or (3)(B)(x) with respect to such site.</text></clause></subparagraph></paragraph> 
<paragraph id="H136BB965B0264BBCA31D89111C696579"><enum>(2)</enum><header>Permits</header> 
<subparagraph id="H28BA2AF88ED04CD79C62519DE438A253"><enum>(A)</enum><header>In general</header><text>The Administrator shall conduct beginning on the 90th day following the date of enactment of this subsection a 10-year pilot project under which the Administrator, with the concurrence of the State of Colorado, may issue, modify, enforce, or terminate a permit issued under this section to a remediating party for discharges associated with remediation activity at abandoned or inactive mined land and that modifies the otherwise applicable requirements of any other subsection of this section or section 301, 302, or 401.</text></subparagraph> 
<subparagraph id="HD697CDA0AD404F12A4CC4315AEFE9CFA"><enum>(B)</enum><header>Delegation</header><text>The Administrator may delegate all or part of the authority under subparagraph (A) to the State of Colorado.</text></subparagraph></paragraph> 
<paragraph id="H25C023DE42D14A9389B18B9766B8E69"><enum>(3)</enum><header>Permit process</header> 
<subparagraph id="H36F4E10089F9415A8BF799D4FC37A592"><enum>(A)</enum><header>Scope</header><text>A remediating party may apply for a permit under this section for remediation activities at abandoned or inactive mined land from which there is or may be a discharge of pollutants to waters of the United States.</text></subparagraph> 
<subparagraph id="H9E4AE12CB9CC48CB81795C00F8910D7"><enum>(B)</enum><header>Remediation plan</header><text>A remediating party that seeks a permit under subparagraph (A) shall submit an application for the permit that includes a remediation plan that—</text> 
<clause id="HCC8B2B3F9BC949C09F1D2DA3007D4FAB"><enum>(i)</enum><text>identifies the remediating party and any cooperating parties with respect to the plan;</text></clause> 
<clause id="HDB9E11EA01BF4A3384777B1BAEE800C1"><enum>(ii)</enum><text display-inline="yes-display-inline">identifies the geographic boundaries of the abandoned or inactive mined land addressed by the plan, including a verification that the land is abandoned or inactive mined land;</text></clause> 
<clause id="H13469BBD807C47B58294B74031C0E950"><enum>(iii)</enum><text>identifies the waters of the United States affected by past mining activities at the abandoned or inactive mined land;</text></clause> 
<clause id="H9E0DB79DD61E44218B6D75D8BB9FFA64"><enum>(iv)</enum><text>describes the baseline conditions of the waters at the time of the permit application (including the nature and extent of any pollutant causing an adverse water quality impact);</text></clause> 
<clause id="H32A4832A84204B15AAF3B3A6BBD0ED4"><enum>(v)</enum><text>describes the physical and chemical conditions at, and pollutants from, the abandoned or inactive mined land that are causing adverse water quality impacts;</text></clause> 
<clause id="H27EF1F4A683F4267A5D35E98EAA7F28"><enum>(vi)</enum><text>describes the applicant’s reasonable efforts to identify—</text> 
<subclause id="H9350FD42313A47A0A154DE1811223EB4" commented="no"><enum>(I)</enum><text>current owners and lessees of the abandoned or inactive mined land; and</text></subclause> 
<subclause id="H3936754120C042EFB8ABB18790D6DA17" commented="no"><enum>(II)</enum><text>any persons, including mine operators, whose activities at or on such land after October 18, 1972, created conditions that cause or contribute to the discharge of pollutants from such land;</text></subclause></clause> 
<clause id="H0F991D3AEFDC4216A976093679592C2B"><enum>(vii)</enum><text>describes the remediation goals and objectives of the plan, including the pollutant or pollutants to be addressed by the plan;</text></clause> 
<clause id="H7DCE8E3BB48648B0A87C5E9EA5AF9F2F"><enum>(viii)</enum><text>describes the practices, including a schedule and estimated completion date for implementing the practices, that are proposed to reduce, control, mitigate, or eliminate the adverse water quality impacts described in clause (v), including—</text> 
<subclause id="H3DA3D7665E494021BB98D670C30A6E7"><enum>(I)</enum><text>in the case of a new remediation project, the preliminary system design and construction, operation, and maintenance plans; and</text></subclause> 
<subclause id="H9E8A1B218EDE444793359E57006F15CF"><enum>(II)</enum><text>in the case of an existing remediation project, available system design and construction, operation, and maintenance plans and any planned improvements to the project;</text></subclause></clause> 
<clause id="HA7528F7D8CD046F0AC4862ABA1B2E15F"><enum>(ix)</enum><text>explains how the practices described in clause (viii) are expected to result in furthering the objectives of existing total maximum daily load allocations under section 303(d) for the identified waters;</text></clause> 
<clause id="H1A3976CCA27F4054A3061C47DFBC24DE"><enum>(x)</enum><text display-inline="yes-display-inline">describes the monitoring or other forms of assessment that will be undertaken to evaluate the success of the practices described in clause (viii) during and after implementation of such practices, relative to baseline conditions;</text></clause> 
<clause id="H04EF2DC01F474FB6AD081BE23B9E67D"><enum>(xi)</enum><text>describes a mechanism or method that will ensure the full net environmental benefits of the project are realized in the future even if ownership of the land changes;</text></clause> 
<clause id="HE109BF662D6445E9B6E3A6F189A99700"><enum>(xii)</enum><text>describes contingency plans for responding to foreseeable, unplanned, adverse events;</text></clause> 
<clause id="H5BC866126D484DB2B4574831FED8D76"><enum>(xiii)</enum><text>provides a schedule for periodic reporting on progress in implementing the plan;</text></clause> 
<clause id="H7B3973D9259646B6ABF352E0B968A404"><enum>(xiv)</enum><text>provides a budget for the plan and identifies the funding sources that will support the implementation of the plan;</text></clause> 
<clause id="HBEC067B239994D1C97F81C53419EA9D6"><enum>(xv)</enum><text>describes the applicant’s legal authority to enter and conduct activities at or on the abandoned or inactive mined land to be addressed by the plan;</text></clause> 
<clause id="HD8FDF6557A4F44DCA55528F4C12BACBB"><enum>(xvi)</enum><text>contains any additional information requested by the Administrator to clarify the plan and activities covered by the plan; and</text></clause> 
<clause id="HB92B1763504F419A802135C3E18C09F3"><enum>(xvii)</enum><text>is signed by the applicant.</text></clause></subparagraph> 
<subparagraph id="H8537BE21DAF3401B8CDF458F6597A75F"><enum>(C)</enum><header>Review of application</header> 
<clause id="H2FE1119DE17445BEA6901499E7E4F85E"><enum>(i)</enum><header>In general</header><text>The Administrator shall review each permit application submitted under subparagraph (B), and determine whether the application meets the requirements of subparagraph (B) and contains all the information required by the Administrator, within 90 days of the date of such submittal.</text></clause> 
<clause id="HB8BFCCD6310E4FE697B600E9E2D8FAE"><enum>(ii)</enum><header>Disapproval</header><text>If the Administrator determines that an application submitted under subparagraph (B) does not meet the requirements of subparagraph (B), the Administrator, shall notify the applicant that the application is disapproved, explain the reasons for the disapproval, and allow the applicant to submit a revised application.</text></clause> 
<clause id="HEBD74CE50147438E92327896EAA5259"><enum>(iii)</enum><header>Approval</header><text display-inline="yes-display-inline">If the Administrator determines that a permit application submitted under subparagraph (B) meets the requirements of subparagraph (B) and contains all the information required by the Administrator, the Administrator shall notify the applicant of the proposed issuance of the permit being applied for, provide to the public notice in the San Juan County, Colorado, and La Plata County, Colorado, newspapers of, and an opportunity to comment on, such proposed issuance and hold a public hearing on such proposed issuance in the Animas River watershed, Colorado.</text></clause></subparagraph> 
<subparagraph id="H8FE4DA63CD924A42AAC6735F94A6F8FA"><enum>(D)</enum><header>Issuance</header> 
<clause id="H60343A0BC24C4A56884CDA009B33F181"><enum>(i)</enum><header>Decision to issue</header><text display-inline="yes-display-inline">After notice and opportunity for public comment on a permit proposed to be issued for mined land under subparagraph (C)(iii), the Administrator may issue the permit to the applicant remediation party if the Administrator, with the concurrence of the State of Colorado, determines that—</text> 
<subclause id="HA472A6C3DADC49C6B8C59ED65DD1D6D0"><enum>(I)</enum><text>relative to the resources available to the remediating party for the proposed remediation activity, the remediating party has made a reasonable effort to identify persons under subparagraph (B)(vi);</text></subclause> 
<subclause id="H338299E75228406A9B23A61F3F4C82EA" commented="no"><enum>(II)</enum><text>no responsible owner or operator exists for the mined land; and</text></subclause> 
<subclause id="H4A770664B97649508CACF803D4117073"><enum>(III)</enum><text>the remediation party has demonstrated with reasonable certainty that the implementation of the remediation plan will result in an improvement in water quality and will further the goal of meeting existing total maximum daily load allocations applicable under section 303(d) taking into consideration the resources available to the remediating party for the proposed remediation activity.</text></subclause></clause> 
<clause id="HE6BC37AE766D4903BF58C77F216200A8"><enum>(ii)</enum><header>Decision not to issue</header><text>If the Administrator decides not to issue the permit to the applicant, the Administrator shall notify the applicant of the reasons for not issuing the permit not later than 30 days after the date of the decision.</text></clause></subparagraph> 
<subparagraph id="H55F6EF6A05B643D4A0BEA33B50356068"><enum>(E)</enum><header>Modification</header> 
<clause id="H337735DE8C6242819133F4F9B1002C4F"><enum>(i)</enum><header>In general</header><text>Not later than 15 days after the date of receipt of a written request for modification of a permit issued under subparagraph (D), the Administrator shall provide to the public notice of such request. Not later than 30 days after the last date on which such notice is provided, the Administrator shall approve or disapprove the modification, unless a public hearing is requested by a person, Indian tribe, State agency, or local governmental agency during such 30-day period.</text></clause> 
<clause id="HE043DE718ABD47D08EA100B70082E03"><enum>(ii)</enum><header>Public hearing</header><text>If a public hearing is requested under clause (i), the Administrator shall have 90 days beginning on the date of such request to hold in the Animas River watershed a public hearing on the modification and approve or disapprove the modification.</text></clause> 
<clause id="H8FD66F7B07694F6C91B2D1A768B215C2"><enum>(iii)</enum><header>Approval</header><text>The Administrator may only approve a permit modification under this subparagraph if—</text> 
<subclause id="H996A94B03D77442F00C60079542E9B8F"><enum>(I)</enum><text>the State of Colorado concurs in such approval; and</text></subclause> 
<subclause id="H9B49855BA7904192969B6D2688CB6B41"><enum>(II)</enum><text>the Administrator determines that the modified remediation plan will comply with subparagraph (D)(i)(III).</text></subclause> </clause> 
<clause id="H3BEAA691C26745A1B2021FDB762DC5D5" commented="no"><enum>(iv)</enum><header>Administrative provision</header><text>The Administrator shall ensure that a permit modification approved under this subparagraph is immediately reflected in, and applicable to, the permit.</text></clause></subparagraph></paragraph> 
<paragraph id="HFE48A5CD3F8943979ED03F656CF86E45"><enum>(4)</enum><header>Contents of permit</header> 
<subparagraph id="H1667B3E48529459FBF9C192808D206B5"><enum>(A)</enum><header>In general</header><text>A permit issued or modified, or both, under this subsection shall—</text> 
<clause id="H03CC38912E1D43BEB295F6404673B922"><enum>(i)</enum><text>include a remediation plan approved by the Administrator and any additional requirements that the Administrator establishes under paragraph (10); </text></clause> 
<clause id="H2488BCD9FEB84B19BA699885D75EC649"><enum>(ii)</enum><text>provide for compliance with and implementation of the remediation plan and the additional requirements; </text></clause> 
<clause id="HAE1B42110DC54D239729A62D6903BE17"><enum>(iii)</enum><text>establish a schedule for review by the Administrator of compliance with the conditions and limitations of the permit; and</text></clause> 
<clause id="H411CF08021ED4D9CB52E8550BE15B54B"><enum>(iv)</enum><text>exempt the remediating party or any cooperating parties with respect to the remediation plan from complying with any other subsection of this section or with section 301 or 302.</text></clause></subparagraph> 
<subparagraph id="HE6DE4D91614D4624822F70782E89873E"><enum>(B)</enum><header>Recoverable value</header><text>A remediation party for a permit issued or modified, or both, under this subsection is not prohibited from selling or using materials recovered during the implementation of the remediation plan under the permit, but the proceeds of any such sale must be used to defray the costs of remediation of the mined land addressed in the permit or the costs of remediation of other abandoned or inactive mined lands.</text></subparagraph></paragraph> 
<paragraph id="H9E11109964084160872ECC65B098DE50"><enum>(5)</enum><header>Failure to comply</header><text>If, during a review conducted under paragraph (4)(A)(iii), on the receipt of a petition from any person, or for any other appropriate reason, the Administrator determines that the remediating party for a permit issued or modified, or both, under this subsection has failed to comply with the provisions of the permit, the Administrator may bring an enforcement action under section 309.</text></paragraph> 
<paragraph id="H8DEF038249F24CE587F319E6A29800C3"><enum>(6)</enum><header>State certification</header><text>To the extent that this subsection relates to water quality standards, a certification under section 401 shall not apply to a permit issued or modified, or both, under this subsection.</text></paragraph> 
<paragraph id="HE23C4616C5C343D0AB0363DE70B04312"><enum>(7)</enum><header>Termination</header> 
<subparagraph id="H70E65D9304134BCC99AC25BCAE26D929"><enum>(A)</enum><header>Mandatory</header><text display-inline="yes-display-inline">The Administrator, with the concurrence of the State of Colorado, shall terminate a permit issued or modified, or both, under this subsection if—</text> 
<clause id="H8ECA20F83C654C8C84B62CB981AB2227"><enum>(i)</enum><text>the remediating party completes the implementation of the remediation plan; or</text></clause> 
<clause id="HACCC9257A587487CAE139042188D1DD1"><enum>(ii)</enum><text>a discharge covered by the permit becomes subject to a permit issued under the other subsections of this section that is not part of the implementation of the remediation plan.</text></clause></subparagraph> 
<subparagraph id="HD9B1C730059A4A61B5984500B957A4A5"><enum>(B)</enum><header>Discretionary</header><text display-inline="yes-display-inline">The Administrator, with the concurrence of the State of Colorado, may terminate a permit issued or modified, or both, under this subsection if—</text> 
<clause id="H0C2CB01E06CD46B2A30750294D488442"><enum>(i)</enum><text>an event or condition is encountered that was not contemplated by the remediation plan and is beyond the control of the remediating party; or</text></clause> 
<clause id="HD90513022C8749138E418E66B446C836"><enum>(ii)</enum><text>the remediating party fails to conduct the remediation according to the approved remediation plan.</text></clause></subparagraph> 
<subparagraph id="HEFB9CE197A3C44309F7D1EE36492BE3D"><enum>(C)</enum><header>No enforcement liability</header><text>If a permit is terminated under this paragraph, the remediating party and any cooperating parties with respect to the remediation plan shall not be subject to enforcement under section 309 or 505 for any remaining discharges from the abandoned or inactive mined land described in the permit.</text></subparagraph></paragraph> 
<paragraph id="H90EEB4156B34463CB4563090AB00065C"><enum>(8)</enum><header>Limitations</header> 
<subparagraph id="HFC0FFA91083947EBAB516DF54D65C00"><enum>(A)</enum><header>Emergency powers</header><text>Nothing in this subsection limits the authority of the Administrator under section 504.</text></subparagraph> 
<subparagraph id="HAB8B68779A204B2C90A97975C96D9B56"><enum>(B)</enum><header>Prior violations</header><text>Nothing in this subsection or a permit issued or modified, or both, under this subsection precludes an action under section 309 or 505 or affects the relief available in an action under such section, with respect to a violation of this section or section 301(a) or 302 that occurred prior to the issuance of a permit under this subsection.</text></subparagraph> 
<subparagraph id="H16BE27826F4346E9B85DFEFBC9BD59B7"><enum>(C)</enum><header>Obligation of states and indian tribes</header><text>Except as expressly provided, nothing in this subsection limits any obligation of a State or Indian tribe under section 303.</text></subparagraph> 
<subparagraph id="H595C720B4E924CA3BC032B747F35F3D6" commented="no"><enum>(D)</enum><header>Other development</header><text>Nothing in this subsection affects the applicability of this Act (other than this subsection) to any development of abandoned or inactive mined land (including mineral exploration or mining) not described in a permit issued by the Administrator under this subsection.</text></subparagraph></paragraph> 
<paragraph id="HC63A6CAFDCBD4FB6B47111C9DD597389" commented="no"><enum>(9)</enum><header>Liability of other parties</header><text>Nothing in this subsection limits the liability under this Act (other than this subsection) or any other law of any person (other than the remediating party and any cooperating parties) with respect to the remediation plan for a permit approved or modified, or both, under this subsection.</text></paragraph> 
<paragraph id="HBF9D53582EC54B9490683BF82CA4EB1"><enum>(10)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this subsection, the Administrator, in consultation with the State of Colorado, tribal, and local officials and after providing notice, an opportunity for comment, and a hearing, shall issue regulations establishing generally applicable requirements for remediation plans described in paragraph (3)(B) and such other regulations as the Administrator considers necessary to carry out this subsection</text></paragraph> 
<paragraph id="H3680D83964894AA29B08004DE92500B4"><enum>(11)</enum><header>Funding for implementing remediation plans</header> 
<subparagraph id="H83C22CFBAEFB4E908804F9AADF4D1C3C"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator $30,000,000 to pay 85 percent of the costs of designing and implementing remediation plans for which permits are issued under this subsection. The remaining share of such costs may be provided with funds or in-kind services by private, local, State, or other Federal sources, including grants under section 319.</text></subparagraph> 
<subparagraph id="HA00B6957A5724B9BBA2DC5B886F59341"><enum>(B)</enum><header>Priority</header><text>The funds appropriated under this paragraph shall be allocated first to proposed remediation plans that are comparatively more likely than other proposed remediation plans to further the objectives of the existing total maximum daily load allocations under section 303(d) with respect to discharges from abandoned or inactive mined land.</text></subparagraph></paragraph> 
<paragraph id="H57AA8E7449DF4D03A0C404BBB4892C36"><enum>(12)</enum><header>Reports</header> 
<subparagraph id="H420AF659B8354319912FA7A2E5FB8487"><enum>(A)</enum><header>In general</header><text>Not later than the last day of each of the 2nd, 5th, 7th, and 10th years of the pilot program conducted pursuant to this subsection, the Administrator shall submit to Congress a report on the activities carried out under this subsection.</text></subparagraph> 
<subparagraph id="H58DFB02D4E8E4B87B870C54A8BD80B2"><enum>(B)</enum><header>Contents</header><text>The report under subparagraph (A) shall, at a minimum—</text> 
<clause id="HC2BA61D8CA75494581AEC28D8477150"><enum>(i)</enum><text>identify each permit issued under this subsection and associated remediating party;</text></clause> 
<clause id="H48640B6CAAC14FDDA4A6E42F19A549D0"><enum>(ii)</enum><text>identify the abandoned or inactive mined land addressed by each permit issued under this subsection (including the water bodies and baseline water quality of the water bodies affected by the land);</text></clause> 
<clause id="H359781EA57BD4F78B681F81CE26E82B6"><enum>(iii)</enum><text>summarize the remediation plan associated with each permit issued under this subsection, including the goals and objectives of the plan, the plan budget, and the practices to be employed according to the plan to reduce, control, mitigate, or eliminate adverse water quality impacts on such water bodies;</text></clause> 
<clause id="HC48662BA10E6420FA0F7C33BA6CC0041"><enum>(iv)</enum><text>identify the status of the implementation of each remediation plan associated with each permit issued under this subsection (including specific progress that permitted remediation activities have made toward achieving the goals and objectives of the remediation plan);</text></clause> 
<clause id="H6B79ADB2C16042BDBB643B477EA5C525"><enum>(v)</enum><text>identify and describe any enforcement action taken by the Administrator or any civil action brought by a citizen concerning a permit issued under this subsection (including the disposition of the legal action); and</text></clause> 
<clause id="H9EF6251B42574F57950000333F32E974"><enum>(vi)</enum><text>include recommendations by the Administrator for any modifications to this subsection, or regulations issued under paragraph (10) to implement this subsection, that would facilitate the improvement of water quality through remediation of abandoned or inactive mined land.</text></clause></subparagraph></paragraph> 
<paragraph id="H930D3C41FE644371BDFFDADDFD494455"><enum>(13)</enum><header>Termination of permitting authority</header><text>The authority granted to the Administrator under this subsection to issue an abandoned or inactive mined land remediation permit terminates on the date that is 10 years after the date of enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
