			 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635f">12 U.S.C. 635f</external-xref>) is amended by striking <quote>2006</quote> and inserting
			 <quote>2011</quote>.</text>
		</section><section changed="added" id="H2F87C3ACD45E446B86F40027D42F33BF" reported-display-style="italic"><enum>4.</enum><header>Increasing exports by
			 small businesses</header>
			<subsection changed="added" id="H02E22358240A4EA7ABFC1700E81300F5" reported-display-style="italic"><enum>(a)</enum><header>Establishment of small
			 business division</header>
				<paragraph id="HC50903893CA64794A05D836500E83528"><enum>(1)</enum><header>In
			 general</header><text>Section 3 of the Export-Import Bank Act of 1945 (12
			 U.S.C. 635a) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7C000F08AD464634B05578E5D9004E18" style="OLC">
						<subsection id="HB6327687436B4F859E0083009CC5E080"><enum>(f)</enum><header>Small business
				division</header>
							<paragraph display-inline="no-display-inline" id="H617CED66BDEB42899DC87EEE329CF525"><enum>(1)</enum><header>Establishment</header><text>The
				President of the Bank shall establish and maintain a division of the Bank whose
				sole functions shall be to—</text>
								<subparagraph id="HD490C521C7C84A82995B1304AE1B00D8"><enum>(A)</enum><text display-inline="yes-display-inline">carry out subparagraphs (E) and (I) of
				section 2(b)(1), as such subparagraphs relate to outreach, feedback, product
				improvement, and transaction advocacy for small business concerns;</text>
								</subparagraph><subparagraph id="HB7A57F2BEFD845E0928EE7A0887E00CB"><enum>(B)</enum><text display-inline="yes-display-inline">advise and seek feedback from small
				business concerns of the opportunities and benefits for small business concerns
				in the financing products offered by the Bank, with particular emphasis on
				conducting outreach, better tailoring products to small business needs and
				increasing loans to small business concerns employing fewer than 100 employees;
				and</text>
								</subparagraph><subparagraph id="H22650337061B4B9AB8DB9E340000F7BC"><enum>(C)</enum><text>maintain liaison
				with the Small Business Administration and other departments and agencies in
				matters affecting small business concerns.</text>
								</subparagraph></paragraph><paragraph id="H13D5939414334CC4B42FA7F1103EFA5F"><enum>(2)</enum><header>Management</header><text>The
				division shall be managed by a Bank officer designated by the Board of
				Directors—</text>
								<subparagraph id="HD195F61B04AA4BDC975E3BA75EA94EC3"><enum>(A)</enum><text>who shall have
				substantial recent experience in financing exports by small business
				concerns;</text>
								</subparagraph><subparagraph id="H2532B80280FC428EBDD4D89314ADCBCF"><enum>(B)</enum><text>whose sole
				executive duty shall be to ensure that the division carries out the functions
				of the division;</text>
								</subparagraph><subparagraph id="H3267A8493C524B16B5FDD21B54C306EB"><enum>(C)</enum><text display-inline="yes-display-inline">who shall advise the Board, particularly
				the Director appointed under section 3(c)(8)(B) to represent the interests of
				small business, on matters of interest to, and concern for, small
				business;</text>
								</subparagraph><subparagraph id="H49DDD6B7DC38495A942DBBF9A046168E"><enum>(D)</enum><text>who shall rank not
				lower than senior vice president of the Bank; and</text>
								</subparagraph><subparagraph id="H1B1B31A16B21430E9061A005D05033A4"><enum>(E)</enum><text>who shall report
				directly to the President of the Bank.</text>
								</subparagraph></paragraph><paragraph id="H2ED1527F2FB84761A4144637B3122281"><enum>(3)</enum><header>Resources</header>
								<subparagraph id="H2EA02992CCBD4C2D9580ABA3922CB47E"><enum>(A)</enum><header>In
				general</header><text>The President of the Bank shall ensure that the division
				has sufficient qualified staff and budgetary resources to carry out
				subparagraphs (E) and (I) of section 2(b)(1), as determined annually by the
				President of the Bank, after consultation with—</text>
									<clause id="H49F20C11135D4A2B92CC6CE19978794"><enum>(i)</enum><text>the
				officer referred to in paragraph (2) of this subsection;</text>
									</clause><clause id="H7A47BEF6CB1C4C2BA3BFD3109E33ED8"><enum>(ii)</enum><text>the Director
				appointed under subsection (c)(8)(B) of this section;</text>
									</clause><clause id="HF6AFFE97A2AA401897D874DF2110708"><enum>(iii)</enum><text>the Committee on
				Financial Services of the House of Representatives; and</text>
									</clause><clause id="HAF0647184770468593E7040058E3CD6E"><enum>(iv)</enum><text>the Committee on
				Banking, Housing, and Urban Affairs of the Senate.</text>
									</clause></subparagraph><subparagraph id="H149769C6E9B94E008ED0A7B9DC6B0897"><enum>(B)</enum><header>Uses</header>
									<clause id="H18422DC7CED341308467A0CCA3DC0766"><enum>(i)</enum><header>In
				general</header><text>The President of the Bank shall ensure that the staff and
				budgetary resources of the division are devoted solely to carrying out the
				functions of the division.</text>
									</clause><clause id="HBDAB54DA3A1B4C0097947D00043C0441"><enum>(ii)</enum><header>Certain staff
				duties</header><text display-inline="yes-display-inline">The division shall
				include staff dedicated exclusively to providing outreach, training, and advice
				to, seeking feedback from, and advocating on behalf of small business concerns
				regarding Bank financing opportunities, products, and programs.</text>
									</clause></subparagraph><subparagraph id="H8988D7FD4D7C497DB81C1F01F741B374"><enum>(C)</enum><header>Rule of
				interpretation</header><text display-inline="yes-display-inline">Nothing in
				this Act shall be construed to prevent the delegation to the division of any
				authority necessary to carry out subparagraphs (E) and (I) of section
				2(b)(1).</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HAF60C714D5254D678FEBBD52650073BD"><enum>(4)</enum><header>Small business
				concern defined</header><text>In this subsection and subsections (g) and (h),
				the term <quote>small business concern</quote> shall have the meaning
				established under section 3(a) of the Small Business Act.</text>
							</paragraph></subsection><subsection id="HA3BFB7FE9ED5415DAA69E6A689E52BAC"><enum>(g)</enum><header>Handling of
				applications of, and processing of transactions involving small business
				concerns</header><text>Consistent with the requirement that the Bank obtain a
				reasonable assurance of repayment for each transaction the Bank supports, the
				Bank shall establish and maintain transaction standards tailored to the special
				circumstances of small business concerns and shall use the standards in
				evaluating applications by the concerns for Bank financing. The Bank shall
				ensure that each appropriate division of the Bank has staff dedicated to the
				processing of transactions involving small business concerns.</text>
						</subsection><subsection id="H3F35F318C4AC410A82C79CE5EF657E14"><enum>(h)</enum><header>Small business
				committee</header>
							<paragraph id="H97BC00EADB284FDBB0095739EA007846"><enum>(1)</enum><header>Establishment</header><text>The
				Bank shall establish and maintain a committee to be known as the <quote>Small
				Business Committee</quote>.</text>
							</paragraph><paragraph id="H4BD1544014574749A04CA7263D53DF2E"><enum>(2)</enum><header>Principal
				purpose</header><text display-inline="yes-display-inline">The principal purpose
				of the Small Business Committee shall be to focus on small business concerns
				and coordinate the efforts of the Bank with respect to small business concerns,
				including the timely processing of small business product applications and the
				evolution of new or improved Bank products to better serve small business
				needs.</text>
							</paragraph><paragraph id="H4DE12EA1429845FC89B2C93E8F34B3F4"><enum>(3)</enum><header>Composition</header>
								<subparagraph id="HBDFE22078CAB4657B6D7D9F310E4A0EE"><enum>(A)</enum><header>Chairman</header><text>The
				chairman of the Small Business Committee shall be the Senior Vice President of
				the Bank who is responsible for management of the Small Business Division of
				the Bank.</text>
								</subparagraph><subparagraph id="HE7E8A953A77646088F939546B414C5F9"><enum>(B)</enum><header>Other
				members</header><text>The President of the Bank shall ensure that the committee
				is comprised of officers and employees throughout the Bank that have
				responsibility for outreach and processing transactions involving small
				business concerns.</text>
								</subparagraph></paragraph><paragraph id="HCBE7B2A80CB042A6AF8F57FB3864B61"><enum>(4)</enum><header>Reports</header><text display-inline="yes-display-inline">The Small Business Committee shall report
				to the President of the
				Bank.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph changed="added" id="H451D712F455F43A3B082E7FE8EEA4E3" reported-display-style="italic"><enum>(2)</enum><header>Coordination in
			 financing of small business exports</header><text>Section 2(b)(1)(E)(vii)(I) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(E)(vii)(I)</external-xref>) is amended by adding at the end the
			 following: <quote>The Bank shall work in coordination with the entities
			 described in the preceding sentence to streamline the processing of
			 applications for Bank financing from small business concerns and to provide
			 training and advice as required on the needs and benefits of export financing
			 for small business concerns.</quote></text>
				</paragraph></subsection><subsection changed="added" id="H420470A1CADD4682BC34C14703CC78CB" reported-display-style="italic"><enum>(b)</enum><header>Report on fees charged
			 to, and transactions costs incurred by, small and medium business for Bank
			 services</header><text>Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HCADC036E2FBC449797AF38C7C45B32C" style="OLC">
					<subsection id="H5EE2C1244F694C27B7F9E5E460D971F9"><enum>(f)</enum><header>Report on fees
				charged to, and transactions costs incurred by, small and medium business for
				Bank services</header><text display-inline="yes-display-inline">The Bank shall
				submit to the Congress annually, and include in a separate section of the
				annual report to the Congress under subsection (a) of this section, a report
				on—</text>
						<paragraph id="H21DFF839AC6A4E4A00E3F82BA436B4C5"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to each type of transaction,
				the interest and fees charged by the Bank to exporters (including a description
				of fees and interest, if any, charged to small business concerns), buyers, and
				other applicants in connection with each financing program of the Bank, and the
				highest, lowest, and average fees charged by the Bank for short term insurance
				transactions;</text>
						</paragraph><paragraph id="HC8377AC1721C44B4AA779E46F3828639"><enum>(2)</enum><text>the effects of the
				fees on the ability of the Bank to achieve the objectives of the Bank relating
				to small business; and</text>
						</paragraph><paragraph id="H4829A5817C9A4716BA46EBD87BD03DB1"><enum>(3)</enum><text display-inline="yes-display-inline">the fee structure of the Bank as compared
				with that of other foreign export credit
				agencies.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H55269A3C9EFE4AE493B20683A24F9148" reported-display-style="italic"><enum>(c)</enum><header>Report on financing
			 directed toward small business</header><text>Section 8 of such Act (12 U.S.C.
			 635g), as amended by subsection (b) of this section, is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H14F6EA6AB0714DBAA5D35D41B3F5BB95" style="OLC">
					<subsection id="H80377289114D4CA1B77289388BCDF18E"><enum>(g)</enum><header>Report on
				financing directed toward small business</header><text display-inline="yes-display-inline">The Bank shall submit annually to the
				Committees on Financial Services and on Small Business of the House of
				Representatives—</text>
						<paragraph id="HFE3CE835FA02483D8C56B52B31C26204"><enum>(1)</enum><text>a report on the
				extent to which the Bank has been able to use the authorities referred to in
				section 2(b)(1)(E)(iv), and, to the extent the Bank has been unable to fully do
				so, a report on the obstacles to doing so and on what the Bank is doing to
				overcome the obstacles;</text>
						</paragraph><paragraph id="H25EECF8904264BA395C93668B399E6F"><enum>(2)</enum><text display-inline="yes-display-inline">a report on the extent to which financing
				has been made available to small business concerns to enable them to
				participate in exports by major contractor, including through access to the
				supply chains of the contractors through direct or indirect funding; and</text>
						</paragraph><paragraph id="H7F96ACAD07514BA1AA805401A3EF9424"><enum>(3)</enum><text>a strategic plan
				of action describing how, in the upcoming year, the Bank will take specific
				measures to achieve the small business objectives of the Bank, including
				expanded outreach, product improvements, and related
				actions.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" display-inline="no-display-inline" id="H7C0A047387B64CC3B349D4018D129EC0" reported-display-style="italic"><enum>(d)</enum><header>Conforming
			 amendments</header>
				<paragraph changed="added" id="HFE82112915A7494DB41EEBE6A42809F4" reported-display-style="italic"><enum>(1)</enum><header>In general</header>
					<subparagraph changed="added" id="HD438B893F3CC479EB6102CE47FE512E6" reported-display-style="italic"><enum>(A)</enum><text>Section 2(b)(1)(E) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(E)</external-xref>), as amended by subsection (a)(2) of this
			 section, is amended—</text>

			 enactment of this Act, the Export-Import Bank of the United States shall make
			 available lines of credit and guarantees to carry out section 2(b)(1)(E)(vi) of
			 the Export-Import Bank Act of 1945 (as so redesignated by subsection
			 (d)(1)(A)(vi) of this section), pursuant to policies and procedures established
			 by the Board of Directors of the Export-Import Bank of the United
			 States.</text>
				</paragraph></subsection></section><section changed="added" id="H69D3D749908B438584849410DB90DA87" reported-display-style="italic"><enum>5.</enum><header>Office of financing for
			 socially and economically disadvantaged small business concerns and small
			 business concerns owned by women</header>
			<subsection id="H7921FA25FEFC46AD862F8CCBA262428C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 3(f) of the
			 Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a(f)</external-xref>), as added by section 4(a) of
			 this Act, is amended by redesignating paragraph (4) as paragraph (5) and by
			 inserting after paragraph (3) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEC3A2AA239D24FE297BEFDEFCABC0097" style="OLC">
					<paragraph id="H9FA0E6CB6AC9478D8F5BAD3B2392AC31"><enum>(4)</enum><header>Office of

						<subparagraph id="HC5E69AA478E641B09CE52895C44E991"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The President of the Bank shall establish
				in the division an office whose sole functions shall be to continue and enhance
				the outreach activities of the Bank with respect to, and increase the total
				amount of loans, guarantees, and insurance provided by the Bank to support
				exports by, socially and economically disadvantaged small business concerns (as
				defined in section 8(a)(4) of the Small Business Act) and small business
				concerns owned by women.</text>
						</subparagraph><subparagraph id="HD0369A19D41444309982042BC7661686"><enum>(B)</enum><header>Management</header><text>The
				office shall be managed by a Bank officer of appropriate rank who shall report
				to the Bank officer designated under section 3(f)(2).</text>
						</subparagraph><subparagraph id="HFED3658BE48648948E118FCC00D6A4E0"><enum>(C)</enum><header>Staffing</header><text display-inline="yes-display-inline">To the maximum extent practicable, the
				President of the Bank shall ensure that qualified minority and women applicants
				are considered when filling any position in the
				office.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H063AE3B50B854B45BB8D2804EFCE6B00" reported-display-style="italic"><enum>(b)</enum><header>Financing directed
			 toward small businesses owned by minorities or women</header><text>Section
			 2(b)(1)(E)(iv) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(1)(E)(iv)</external-xref>), as so redesignated by
			 section 4(d)(1)(A)(vi) of this Act, is amended by adding at the end the
			 following: <quote>From the amount made available under the preceding sentence,
			 it shall be a goal of the Bank to make available not less than 15 percent of
			 the amount to finance exports directly by small business concerns referred to
			 in section 3(f)(4)(A).</quote>.</text>
			</subsection><subsection changed="added" display-inline="no-display-inline" id="HA9C9C2315A394E49899C5761DCBB054" reported-display-style="italic"><enum>(c)</enum><header>Report on financing
			 directed toward small businesses owned by minorities or
			 women</header><text>Section 8(g)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g(g)(1)</external-xref>), as
			 added by section 4(c) of this Act, is amended by inserting <quote>and to
			 finance exports by small business concerns referred to in section
			 3(f)(4)(A),</quote> before <quote>and, to the extent</quote>.</text>
			</subsection><subsection changed="added" id="HF1267D547F1A4143B3703BADB217C228" reported-display-style="italic"><enum>(d)</enum><header>Report on Bank efforts
			 to support exports by socially and economically disadvantaged small business
			 concerns and small business concerns owned by women</header><text>Section 8 of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g</external-xref>), as amended by section 4 of this Act, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9AB8FBD67EC0407C81F5AE8ECE269459" style="OLC">
					<subsection id="H2F0D3CF1E47047B9B05CFD31988EAC42"><enum>(h)</enum><header>Report on
				efforts to support exports by small- and medium-sized businesses owned by women

				March 1 of each year, the Director appointed under section 3(c)(8)(B) of this
				Act shall prepare and submit to the Committee on Financial Services of the
				House of Representatives and the Committee on Banking, Housing, and Urban
				Affairs of the Senate, and the Bank shall include in a separate section of the
				annual report submitted pursuant to subsection (a) of this section, a written
				report that describes the progress made by the Bank in supporting exports by
				socially and economically disadvantaged small business concerns (as defined in
				section 8(a)(4) of the Small Business Act) and small business concerns owned by
				women.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" id="H11F6EB5A7E60473395F79C0742829B59" reported-display-style="italic"><enum>6.</enum><header>Sub-Saharan
			 Africa</header>
			<subsection changed="added" id="H581C4EF924B84DA495A6A46F11623B07" reported-display-style="italic"><enum>(a)</enum><header>Extension of advisory
			 committee</header><text>Section 2(b)(9)(B)(iii) of the Export-Import Bank Act
			 of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(9)(B)(iii)</external-xref>) is amended by striking
			 <quote>2006</quote> and inserting <quote>2011</quote>.</text>
			</subsection><subsection changed="added" id="H985662D8B3664DE892EA941F1529F26" reported-display-style="italic"><enum>(b)</enum><header>Improved liaison with
			 african regional financial institutions</header>
				<paragraph id="HAB133353E1D0406095C231AE3B03E398"><enum>(1)</enum><header>Master guarantee
			 agreements</header><text display-inline="yes-display-inline">Within 1 year
			 after the date of the enactment of this Act, the Export-Import Bank of the
			 United States shall seek to ensure that there is in effect a contract between
			 each approved lender in Africa and the Bank, which sets forth the Bank's
			 guarantee undertakings and related obligations between the Bank and the
			 lender.</text>
				</paragraph><paragraph id="HA5B0E51B7D724CDCB5DDA67CF8FBE6FB"><enum>(2)</enum><header>Report on working
			 relationships with the African Development Bank, the Africa Export-Import Bank,
			 and other institutions</header><text>Section 2(b)(9) of such Act (12 U.S.C.
			 635(b)(9)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H31E3F223AEF242A19633EEFAEF9D10B4" style="OLC">
						<subparagraph id="HD3E4E11ED44D4A49B5AB3EE0539CCD62" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The Bank shall include in the annual report
				to the Congress submitted under section 8(a) a separate section that contains a
				report on the efforts of the Bank to improve working relationships with the
				African Development Bank, the Africa Export-Import Bank, and other institutions
				in the region that are relevant to the purposes of subparagraph (A) of this
				paragraph.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection changed="added" id="H23CDE7F441A14B24B1009F94F26CD447" reported-display-style="italic"><enum>(c)</enum><header>Closer cooperation with
			 other United States agencies working in Africa</header><text>Section 2(b)(9) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(9)</external-xref>) is further amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D85CB94268349CD9C762098D69E6B2" style="OLC">
					<subparagraph id="HC517588FBA4C490B8ED0A53EC707200" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">The Bank shall closely coordinate with the
				United States Foreign Commercial Service and with the overall strategy of the
				United States Government, for economic engagement with Africa pursuant to the
				African Growth and Opportunity Act.</text>
					</subparagraph><subparagraph id="HB174655E1C334D058C879CC8B0D42DB6" indent="up2"><enum>(E)</enum><text display-inline="yes-display-inline">The Bank shall develop initiatives to train
				Foreign Service and Commercial Service officers serving at United State
				embassies in Africa, in the use of Bank programs, so the officers can encourage
				African buyers to take part in transactions supported by the
				Bank.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H0CE5B9B482FD4B8594DECC0944675901" reported-display-style="italic"><enum>(d)</enum><header>Adjustments to
			 procedures to promote qualification of African entities</header><text>Section
			 2(b)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(9)</external-xref>) is further amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H18D92698CE02437E8CA09351EE265367" style="OLC">
					<subparagraph id="HEEFEED94F15A4340B884607DA38B7776" indent="up2"><enum>(F)</enum><text display-inline="yes-display-inline">Consistent with the requirement that the
				Bank obtain a reasonable assurance of repayment in connection with each
				transaction the Bank supports, the Bank shall, in consultation with the
				entities described in subparagraph (C), seek greater flexibility in the
				due-diligence procedures of the Bank for the purpose of qualifying a greater
				number of appropriate African entities for participation in programs of the
				Bank.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H2FC2FA609BCB480D80BD6C15F0DAFF43" reported-display-style="italic"><enum>(e)</enum><header>Local currency
			 financing</header><text>Section 2(b)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)(9)</external-xref>) is
			 further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDFADB45A8A0547209C19DD2F6440AFF2" style="OLC">
					<subparagraph id="H8BD7387247E74E93ACE4BF57178C774C" indent="up2"><enum>(G)</enum><text display-inline="yes-display-inline">The Bank shall develop procedures under
				which the Bank is capable of financing certain African programs in local
				currencies.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" id="H0406A4E27D2E4D1E8878D8D060ADEB75" reported-display-style="italic"><enum>7.</enum><header>Extension of
			 authority</header><text display-inline="no-display-inline">Section 1(c) of
			 <external-xref legal-doc="public-law" parsable-cite="pl/103/428">Public Law 103–428</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref> note) is amended by striking
			 <quote>2001</quote> and inserting <quote>2011</quote>.</text>
		</section><section changed="added" id="H56FF6CB4EE114654883BC637554D3D90" reported-display-style="italic"><enum>8.</enum><header>Transparency
			 initiatives</header>
			<subsection id="HAD9245E4B5CD437BA66740774D6E3F58"><enum>(a)</enum><header>Frequency of
			 meetings</header><text>Section 3(c) of the Export-Import Bank Act of 1945 (12
			 U.S.C. 635a(c)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H68FCD63006AD48D791C132D491F08110" style="OLC">
					<paragraph id="HE6A6433ACE564DAB84CD34EB8824E4F3" indent="up1"><enum>(9)</enum><text>The Board of Directors shall meet not
				less frequently than biweekly.</text>
					</paragraph><paragraph id="H87898D34AC6243428946EA888B673443" indent="up1"><enum>(10)</enum><text display-inline="yes-display-inline">At the request of any 2 members of the
				Board of Directors, the Chairman shall place an item on the agenda for
				consideration by the Board. Within 30 days after the date such a request is
				made, the Chairman shall hold a meeting of the Board at which the item will be
				considered.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H036320B233E94411A1B5712266C56422" reported-display-style="italic"><enum>(b)</enum><header>Voting required in
			 cases involving economic impact analysis</header><text>Section 2(e) of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(e)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD22B1700F60F4852B516F020556509F9" style="OLC">
					<paragraph id="HC2B45B9E22F7427DA791847092CA5733"><enum>(5)</enum><header>Board vote
				required</header><text display-inline="yes-display-inline">Within 60 days after
				completing a review, pursuant to this subsection, of a proposed loan or
				guarantee (including any applicable comment period), the Board of Directors
				shall hold a vote to determine whether or not to proceed with the proposed loan
				or guarantee, unless the applicant has withdrawn the application for the loan
				or
				guarantee.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="HE292D8914F45470B923630EBFC21BD78" reported-display-style="italic"><enum>(c)</enum><header>Process for notifying
			 applicants of application status</header><text display-inline="yes-display-inline">Section 2 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC21A6C1FE464463CB45B3FB283B44FBE" style="OLC">
					<subsection id="HB6E1427FE3E24B329BFCD241BC9FB191"><enum>(g)</enum><header>Process for
				notifying applicants of application status</header><text display-inline="yes-display-inline">The Bank shall establish and adhere to a
				clearly defined process for—</text>
						<paragraph id="HC23EF5E3086F4350BA55683EBFF29541"><enum>(1)</enum><text>acknowledging
				receipt of applications;</text>
						</paragraph><paragraph id="H7C78CA278EBA4A919D38638349946224"><enum>(2)</enum><text>informing
				applicants that their applications are complete or, if incomplete or containing
				a minor defect, of the additional material or changes that, if supplied or
				made, would make the application eligible for consideration; and</text>
						</paragraph><paragraph id="HE407F26C6BD948A7BBECFEDF6218498B"><enum>(3)</enum><text display-inline="yes-display-inline">keeping applicants informed of the status
				of their applications, including a clear and timely notification of approval or
				disapproval, and, in the case of disapproval, the reason for disapproval, as
				appropriate.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="HE1FCC5FF398740B3BEFCB0DDDF0021FF" reported-display-style="italic"><enum>(d)</enum><header>Response to application
			 for financing; implementation of online loan request and tracking
			 process</header><text>Section 2 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635</external-xref>) is further amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEAB427B40D9E4FBDAB36148CB814FF19" style="OLC">
					<subsection id="HD297D249B7834CA7BD5BD1351E637FFE"><enum>(h)</enum><header>Response to
				application for financing; implementation of online loan request and tracking
				process</header><text display-inline="yes-display-inline">Within 5 days after
				receipt of an application for financing from the Bank, the Bank shall notify
				the applicant that the application has been received, and shall include in the
				notice a request for such additional information as may be necessary to make
				the application complete, the name of a Bank employee who may be contacted with
				questions relating to the application, and a unique identification number which
				may be used to review the status of the application at a website established as
				provided in the next sentence. Not later than September 1, 2006, the Bank shall
				use the authorities provided by subparagraphs (E)(ix) and (J) of subsection
				(b)(1) of this section to establish, and thereafter to maintain, a website
				through which any Bank product may be applied for, information may be obtained
				about the status of any such application, about the small business division of
				the Bank, or about incentives, preferences, targets, and goals relating to
				small business concerns referred to in section 3(f)(4)(A) or small business
				concerns exporting to
				Africa.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="HE2932B09EE1E41979E5FE542BD78006F" reported-display-style="italic"><enum>(e)</enum><header>Reports relating to
			 technology to assist small businesses</header>
				<paragraph changed="added" id="H33142BC636FC410E98D71400A889D752" reported-display-style="italic"><enum>(1)</enum><header>Reports by the
			 Bank</header>
					<subparagraph changed="added" id="H37909E23E0C1425A92E16F3E4700B858" reported-display-style="italic"><enum>(A)</enum><header>Initial
			 report</header><text>Within 60 days after the date of the enactment of this
			 Act, the President of the Export-Import Bank of the United States shall submit
			 to the Committee on Financial Services of the House of Representatives and the
			 Committee on Banking, Housing, and Urban Affairs of the Senate a report
			 on—</text>
						<clause changed="added" id="HF016FC97EBBC4A9B885E114726C9F784" reported-display-style="italic"><enum>(i)</enum><text>the efforts made by the
			 Bank to carry out subparagraphs (E)(ix) and (J) of section 2(b)(1) of the

			 unable to comply with such subparagraphs—</text>
							<subclause id="H39AC852B36B749429B73E33601FA267F"><enum>(I)</enum><text>an analysis of the
			 reasons therefor;</text>
							</subclause><subclause id="H58E10D405FD045A6BFCC08D82675F9E0"><enum>(II)</enum><text>what the Bank is doing
			 to achieve, and the date by which the Banks expects to have achieved, such
			 compliance; and</text>
							</subclause><subclause id="H35A41D6824164E6B9BDAE04716DE11D8"><enum>(III)</enum><text>the name of each Bank
			 officer who is responsible for ensuring that the Bank achieves, and the name of
			 the person to whom the Bank officer reports on progress in achieving, such
			 compliance.</text>
							</subclause></clause></subparagraph><subparagraph changed="added" id="HEE20EAED1E6B41EDB6A7A16950FEAA22" reported-display-style="italic"><enum>(B)</enum><header>Subsequent annual
			 reports</header><text>Section 8(c) of the Export-Import Bank Act of 1945 (12
			 U.S.C. 635g(c)), as amended by section 4(d)(1)(B)(ii) of this Act, is amended
			 to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HA2CF8D2C12C54169A793882473B514D7" style="OLC">
							<subsection id="H012B87F2A4734A8DB4136218D3E449E2"><enum>(c)</enum><header>Technology to
				assist small businesses</header><text>The Bank shall include in its annual
				report to the Congress under subsection (a) of this section for each of fiscal
				years 2007 through 2011 a separate section that contains—</text>

				efforts made by the Bank to carry out subparagraphs (E)(ix) and (J) of section
				2(b)(1) of this Act, the total amount expended in the fiscal year to do so, and
				how the efforts are assisting small business concerns (as defined under section
				3(a) of the Small Business Act); and</text>
								</paragraph><paragraph id="H99394F11E8224F388D53F82300CC4804"><enum>(2)</enum><text>if the Bank has
				been unable to comply fully with such subparagraphs—</text>
									<subparagraph id="HD483CBA44EFB49068BD30471517E4B02"><enum>(A)</enum><text>an analysis of the
				reasons therefor;</text>
									</subparagraph><subparagraph id="H646DFA836DB64E6794C1CD14333D006C"><enum>(B)</enum><text>a description of
				what the Bank is doing to achieve, and the date by which the Banks expects to
				have achieved, such full compliance; and</text>
									</subparagraph><subparagraph id="H60B6EC9BE6AD46D6A6900133961FDE5B"><enum>(C)</enum><text>the name of each
				Bank officer who is responsible for ensuring that the Bank achieves, and the

				such full

					</subparagraph></paragraph><paragraph changed="added" id="H58525396C68D4BDD8728AB5FA2E1A2E1" reported-display-style="italic"><enum>(2)</enum><header>Report by the Inspector
			 General of the Bank</header><text display-inline="yes-display-inline">Within
			 120 days after the date of the enactment of this Act or, if later, within 30
			 days after the date the vacancy in the position of the Inspector General of the
			 Export-Import Bank of the United States is filled, the Inspector General of the
			 Export-Import Bank of the United States shall submit to the Committee on
			 Financial Services of the House of Representatives and the Committee on
			 Banking, Housing, and Urban Affairs of the Senate—</text>
					<subparagraph changed="added" id="H74FC57D488D547A685A868D8A5EE578B" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">a report on the efforts made by the Bank to
			 carry out subparagraphs (E)(ix) and (J) of section 2(b)(1) of the Export-Import
			 Bank Act of 1945, the total amount expended to do so, and how the efforts are
			 assisting small business concerns (as defined under section 3(a) of the Small
			 Business Act); and</text>
					</subparagraph><subparagraph changed="added" id="H082E20B8F6254089A7128550EA5EB0D8" reported-display-style="italic"><enum>(B)</enum><text>if the Bank has been
			 unable to comply with such subparagraphs—</text>
						<clause id="HFF85FF8E833C4519B261E8FBE6FB7502"><enum>(i)</enum><text>an analysis of the
			 reasons therefor;</text>
						</clause><clause id="HE954BD4D28C14518ACD38EC2D0009941"><enum>(ii)</enum><text>a description of what
			 the Bank is doing to achieve, and the date by which the Banks expects to have
			 achieved, such compliance; and</text>
						</clause><clause id="H7ECDDBFB50134FBAAE4340F1D4E467B0"><enum>(iii)</enum><text>the name of each Bank
			 officer who is responsible for ensuring that the Bank achieves, and the name of
			 the person to whom the Bank officer reports on progress in achieving, such
			 compliance.</text>
						</clause></subparagraph></paragraph></subsection><subsection changed="added" id="H608624799902441ABC54CB12A989D300" reported-display-style="italic"><enum>(f)</enum><header>Public disclosure of
			 certain documents</header><text display-inline="yes-display-inline">Section
			 11(a)(1) of the Export-Import Bank of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635i-5">12 U.S.C. 635i–5(a)(1)</external-xref>) is amended
			 by inserting after the first sentence the following: <quote>Such procedures
			 shall provide for the public disclosure of environmental assessments and
			 supplemental environmental reports required to be submitted to the Bank,
			 including remediation or mitigation plans and procedures, and related
			 monitoring reports. The preceding sentence shall not be interpreted to require
			 the public disclosure of any information described in <external-xref legal-doc="usc" parsable-cite="usc/18/1905">section 1905</external-xref> of title 18,
			 United States Code.</quote>.</text>
			</subsection></section><section changed="added" id="H29323993B3F947919E45AB62061FDCB7" reported-display-style="italic"><enum>9.</enum><header>Effect of the Bank on
			 the budget of the United States</header><text display-inline="no-display-inline">Within 90 days after the date of the
			 enactment of this Act, the Export-Import Bank of the United States shall submit
			 to the appropriate committees of the Congress a report on the revenues,
			 expenditures, and resulting annual net income or expense to the United States
			 for each of the 10 years most recently completed before the date of the
			 report.</text>
		</section><section changed="added" id="H7FF39BEC1FAB41FFA961BCADD8131975" reported-display-style="italic"><enum>10.</enum><header>Competitiveness
			 initiatives</header>
			<subsection changed="added" id="H2B53AE6BC68842E381553360A509C474" reported-display-style="italic"><enum>(a)</enum><header>Expansion of scope of
			 annual competitiveness report</header>
				<paragraph id="H0AF1AEBC3F9C4E9395FE9B65A25120C"><enum>(1)</enum><header>Consolidation and
			 reorganization of provisions</header><text display-inline="yes-display-inline">The Export-Import Bank Act of 1945 (12
			 U.S.C. 635—635i–9) is amended by inserting after section 8 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H241A68E67B404295BA0437B54D4C6CFE" style="OLC">
						<section id="HA6F32F2979344984B27F8B00A58FD23C"><enum>8A.</enum><header>Annual
				competitiveness report</header>
							<subsection id="H1705646F07424A91AC822F36F4D920DB"><enum>(a)</enum><header>In
				general</header><text>Not later than June 30 of each year, the Bank shall
				submit to the appropriate committees of the Congress a report that includes the
				following:</text>
								<paragraph id="H4E6708F50767403C8377144F6C871FD1"><enum>(1)</enum><header>Actions of Bank
				in providing financing on a competitive basis, and to minimize competition in
				government-supported export financing</header><text>A description of the
				actions of the Bank in complying with the 2nd and 3rd sentences of section
				2(b)(1)(A). In this part of the report, the Bank shall include a survey of all
				other major export-financing facilities available from other governments and
				government-related agencies through which foreign exporters compete with United
				States exporters (including through use of market windows (as defined in
				section 10(h)(7)) and indicate in specific terms the ways in which the Bank's
				rates, terms, and other conditions compare with those offered from such other
				governments directly or indirectly. With respect to the preceding sentence, the
				Bank shall use all available information to estimate the annual amount of
				export financing available from each such government and government-related
				agency. In this part of the report, the Bank shall include a survey of a
				representative number of United States exporters and United States commercial
				lending institutions which provide export credit to determine the experience of
				the exporters and institutions in meeting financial competition from other
				countries whose exporters compete with United States exporters.</text>
								</paragraph><paragraph id="HE3456DDE49A64DED834494C05800736C"><enum>(2)</enum><header>Role of Bank in
				implementing strategic plan prepared by the Trade Promotion Coordinating
				Committee</header><text>A description of the role of the Bank in implementing
				the strategic plan prepared by the Trade Promotion Coordinating Committee in
				accordance with section 2312 of the Export Enhancement Act of 1988.</text>
								</paragraph><paragraph id="HB4A4F45F04E14A8FAC002CF69F74C493"><enum>(3)</enum><header>Tied Aid Credit
				Program and Fund</header><text>The report required by section 10(g).</text>
								</paragraph><paragraph id="HB3B1D59321E9498DBEFAD78CC89FA580"><enum>(4)</enum><header>Purpose of all
				Bank transactions</header><text>A description of all Bank transactions which
				shall be classified according to their principal purpose, such as to correct a
				market failure or to provide matching support.</text>
								</paragraph><paragraph id="H0F1C7C23A0CD4ADF88E613B1C32B74B"><enum>(5)</enum><header>Efforts of Bank
				to promote export of goods and services related to renewable energy
				sources</header><text>A description of the efforts undertaken under section
				2(b)(1)(K).</text>
								</paragraph><paragraph display-inline="no-display-inline" id="HCCB84079E36747D0B8C0A5D684354990"><enum>(6)</enum><header>Size of Bank
				program account</header><text display-inline="yes-display-inline">A separate
				section which—</text>
									<subparagraph id="H6E08D8C3936D4A45B5B961809DB23105"><enum>(A)</enum><text display-inline="yes-display-inline">compares the size of the Bank program
				account with the size of the program accounts of the other major
				export-financing facilities referred to in paragraph (1); and</text>
									</subparagraph><subparagraph id="H9BEC9006305B4B49A338CC1231A71849"><enum>(B)</enum><text>makes
				recommendations with respect to the relative size of the Bank program account,
				based on factors including whether the size differences are in the best
				interests of the United States taxpayer.</text>
									</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H2F9BB8020FB74FCF92BB86EE00D15735"><enum>(7)</enum><header>Co-financing
				programs of the Bank and of other export credit agencies</header><text display-inline="yes-display-inline">A separate section which describes the
				co-financing programs of the Bank and of the other major export-financing
				facilities referred to in paragraph (1), which shall include a list of which
				countries with which the United States has in effect a memorandum of
				understanding relating to export credit agency co-financing and an explanation
				of why such a memorandum is not in effect with the countries with which such a
				memorandum is not in effect.</text>
								</paragraph><paragraph display-inline="no-display-inline" id="HBFB878591BEE4ED6A7A7C53671FB4E3B"><enum>(8)</enum><header>After-market
				services support by the Bank and by other export credit agencies</header><text display-inline="yes-display-inline">A separate section which describes the
				participation of the Bank in providing funding, guarantees, or insurance for
				after-market services, which shall include appropriate information on the
				involvement of the other major export-financing facilities referred to in
				paragraph (1) in providing such support for after-market services, and an
				explanation of any differences among the facilities in providing the
				support.</text>
								</paragraph><paragraph id="HFEBDB6C2B789457C911C58BFA7DA3496"><enum>(9)</enum><header>Export finance
				cases not in compliance with the Arrangement</header><text display-inline="yes-display-inline">Detailed information on cases of export
				finance that are not in compliance with the Arrangement (as defined in section
				10(h)(3)) or that exploit loopholes in the Arrangement for the purpose of
				obtaining a commercial competitive advantage.</text>
								</paragraph><paragraph id="HCEDC323056424DFD91114E5D69C13EE9"><enum>(10)</enum><header>Foreign export
				credit agency activities not consistent with the WTO Agreement on Subsidies and
				Countervailing Measures</header><text display-inline="yes-display-inline">A
				description of the extent to which the activities of foreign export credit
				agencies and other entities sponsored by a foreign government, particularly
				those that are not members of the Arrangement (as defined in section 10(h)(3)),
				are not in compliance with the Arrangement and may not be consistent with the
				terms of the Agreement on Subsidies and Countervailing Measures referred to in
				section 101(d)(12) of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(12)</external-xref>),
				and a description of the actions taken by the United States Government to
				address the activities.</text>
								</paragraph></subsection><subsection id="H3E9682FC40C04DCEA6D5111F906535FE"><enum>(b)</enum><header>Board vote on
				report required</header><text display-inline="yes-display-inline">The Board of
				Directors shall vote to approve and shall sign each report required by
				subsection (a).</text>
							</subsection><subsection id="H1E6325B26ACB4BE49D9D7C6FD5406B46"><enum>(c)</enum><header>Inclusion of
				dissenting views, etc</header><text>Each report required by subsection (a)
				shall include such dissenting views and additional comments as any member of
				the Board of Directors may submit to the Board for inclusion in the

			 amended by sections 4 and 5 of this Act, is amended by adding at the end the

				multi-buyer insurance programs and working capital guarantee programs operated
				by, through, or in conjunction with the Bank, which shall include an analysis
				of the effectiveness of the programs and of how effective the programs would be
				in increasing export-related jobs in the United States if the programs were
				larger;</text>
						</paragraph><paragraph id="H4FF2620840F6494E878CBE10428936C5"><enum>(2)</enum><text display-inline="yes-display-inline">the size of similar programs of all other
				major export-financing facilities available from other governments and
				government-related agencies through which foreign exporters compete with United
				States exporters (including through use of market windows (as defined in
				section 10(h)(7)); and</text>
						</paragraph><paragraph id="HD32D7D172D9A4566A97EE889C5B7DED0"><enum>(3)</enum><text display-inline="yes-display-inline">as a detailed explanation, with respect to
				the programs, of the working relationship between the Bank and the Small
				Business Administration, the Department of Commerce, and other United States
				Government agencies concerned with increasing the number of export-related jobs
				in the United
				States.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 of mixed forms of concessional financing</header><text>Section 10 of such Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/635i-3">12 U.S.C. 635i–3</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HFCDDEB4BDE194C469695855723009EA" style="OLC">
					<subsection id="HD4088BFA0D514CA8B693E6940016DAB"><enum>(i)</enum><header>Authority to seek
				use of mixed forms of concessional financing</header><text>For purposes of
				improving the effects of Bank financing on development in tied aid eligible
				markets (as defined under the Arrangement) and of improving the competitiveness
				of the Bank in the markets, the Bank shall, in consultation with United States
				government aid agencies and, as appropriate, multilateral aid institutions,
				seek to establish, consistent with the Arrangement, a mixed credit program
				consisting of longer term financing and other forms of more flexible repayment
				terms, financing of transactions in local currencies, and other forms of
				concessional financing that meets the needs of the product sector and foreign
				market
				involved.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H3DC5BD74E6B94FC6BF2EFF61D659FF46" reported-display-style="italic"><enum>(f)</enum><header>Instructions regarding
			 negotiation of the OECD Arrangement</header><text>The Secretary of the Treasury
			 shall instruct the designee of the Secretary to the negotiation of the
			 Arrangement (as defined in section 10(h)(3) of the Export-Import Bank Act of
			 1945) to inform the other participants in the negotiation that the goals of the
			 United States include the following:</text>
				<paragraph id="HA5F90E82736F42248EDD6DB7AB5F94E1"><enum>(1)</enum><text display-inline="yes-display-inline">Seeking compliance with the Arrangement
			 among countries with significant export credit programs who are not members of
			 the Arrangement.</text>
				</paragraph><paragraph id="HC73A67597C044E398790171BE5B1D4B8"><enum>(2)</enum><text display-inline="yes-display-inline">Seeking to identify within the World Trade
			 Organization the extent to which countries that are not a party to the
			 Arrangement are not in compliance with the terms of the Agreement on Subsidies
			 and Countervailing Measures referred to in section 101(d)(12) of the Uruguay
			 Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3511">19 U.S.C. 3511(d)(12)</external-xref>) in regards to export finance, and
			 seeking appropriate action within the World Trade Organization if such a
			 country is not in such compliance.</text>
				</paragraph><paragraph id="HC75B84EAC8E74D858E9FB2CD6B481FE"><enum>(3)</enum><text>Implementing new
			 disciplines on the use of untied aid, market windows, and other forms of export
			 finance that seek to exploit loopholes in the Arrangement for purposes of
			 obtaining a commercial competitive advantage.</text>
				</paragraph></subsection></section><section changed="added" id="HE2682AA7E417454197A7882D65C6F498" reported-display-style="italic"><enum>11.</enum><header>Consideration of
			 environmental matters by the Advisory Committee</header><text display-inline="no-display-inline">Section 3(d) of the Export-Import Bank Act
			 of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a(d)</external-xref>) is amended—</text>
			<paragraph changed="added" id="HFF7FCFCD86C14044B08CCF0097235990" reported-display-style="italic"><enum>(1)</enum><text>in paragraph (1)—</text>
				<subparagraph id="HC08DA891809940429DC6881C76BC4F99"><enum>(A)</enum><text>in subparagraph (A), by

					<subparagraph id="H8CFBAC9298C949939C3500553300CCD9" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Not less than 2 members appointed to the
				Advisory Committee shall be representative of the environmental nongovernmental
				organization community, except that no 2 of the members shall be from the same
				environmental organization. Environmental organizations represented shall have
				demonstrated experience with environmental issues associated with the Bank, the
				Export Credit Group of the Organization for Economic Cooperation and
				Development, or
				both.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" display-inline="no-display-inline" id="HA8CA39A4C1B845438CEF3D36B0BCC16" reported-display-style="italic" section-type="subsequent-section"><enum>12.</enum><header>Study of how
			 Export-Import Bank could assist United States exporters to meet import needs of
			 new or impoverished democracies; reports</header>
			<subsection changed="added" id="H92E26208DF864FC08CBF582FCE1DC39" reported-display-style="italic"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Export-Import Bank of the United States
			 shall conduct a study designed to assess the needs of new or impoverished
			 democracies such as Liberia and Haiti, for imports from the United States, and
			 shall determine what role the Bank can play a role in helping United States
			 exporters seize the opportunities presented by the need for such
			 imports.</text>
			</subsection><subsection changed="added" id="H6DB3F885075D4413966050143F7B7043" reported-display-style="italic"><enum>(b)</enum><header>Reports to the
			 Congress</header>
				<paragraph id="HF88541A4BE2A4903A3A7AEA0005350F2"><enum>(1)</enum><header>Interim
			 report</header><text>Within 6 months after the date of the enactment of this
			 Act, the Bank shall submit to the Committee on Financial Services of the House
			 of Representatives and the Committee on Banking, Housing, and Urban Affairs of
			 the Senate, in writing, an interim report that contains the results of the
			 study required by subsection (a).</text>
				</paragraph><paragraph id="H245F6F29B37D4405A22D59822BD0134B"><enum>(2)</enum><header>Final
			 report</header><text>Within 12 months after the date of the enactment of this
			 Act, the Bank shall submit to the Committee on Financial Services of the House
			 of Representatives and the Committee on Banking, Housing, and Urban Affairs of
			 the Senate, in writing a final report that contains the results of the study
			 required by subsection (a).</text>
				</paragraph></subsection></section><section changed="added" display-inline="no-display-inline" id="HBD12EA10A47D439086A0E8EF2433854D" reported-display-style="italic" section-type="subsequent-section"><enum>13.</enum><header>Review
			 of environmental screening requirement</header>
			<subsection changed="added" id="H2B2E01D7903D4461809BAF1C1DE37A" reported-display-style="italic"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Within 6 months after
			 the position of Inspector General of the Export-Import Bank of the United
			 States is filled, the Inspector General of the Export-Import Bank of the United
			 States shall submit to the Committee on Resources and the Committee on
			 Financial Services of the House of Representatives, and to the Committee on
			 Banking, Housing, and Urban Affairs of the Senate a report on the implications
			 of limiting the requirement to conduct environmental screenings of projects
			 proposed to be financed by the Bank to only those involving at least
			 $10,000,000.</text>
			</subsection><subsection changed="added" id="HE99D1A0D1FEB483085836E637EFE04B3" reported-display-style="italic"><enum>(b)</enum><header>Contents of
			 report</header><text display-inline="yes-display-inline">The report
			 shall—</text>
				<paragraph id="H2585370940EB443CADBFF093867978FA"><enum>(1)</enum><text display-inline="yes-display-inline">determine whether the $10,000,000
			 limitation prevents the identification of any project that may have an adverse
			 effect on the environment; and</text>
				</paragraph><paragraph id="H30770207BFFF48BC9E091E05819992E1"><enum>(2)</enum><text display-inline="yes-display-inline">propose guidelines for how project
			 applications may be screened more effectively to determine whether a project
			 may have such an effect.</text>
				</paragraph></subsection></section><section changed="added" display-inline="no-display-inline" id="HEEEC6F70A3874DC581CE8751C94B4253" reported-display-style="italic" section-type="subsequent-section"><enum>14.</enum><header>Office
			 of Renewable Energy Promotion</header><text display-inline="no-display-inline">Section 3 of the Export-Import Bank Act of
			 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635a">12 U.S.C. 635a</external-xref>), as amended by section 4(a)(1) of this Act, is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H1E730A1A9BBC4F968F94F5464DA7D284" style="OLC">
				<subsection id="H62B3F4FF5ADD418A82CDCE9557790000"><enum>(i)</enum><header>Office of
				Renewable Energy Promotion</header>
					<paragraph id="HB507E91F9C0B4F67A5D8C0BF63ACF0EE"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Within 1 year after the date of the
				enactment of this subsection, the President of the Bank shall establish and
				maintain in the Bank an office which shall be known as the <quote>Office of
				Renewable Energy Promotion</quote> (in this subsection referred to as the
				<quote>Office</quote>).</text>
					</paragraph><paragraph id="H28C19C7010A9486F92357D00B71BF5CC"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The Office shall be responsible for
				proactively identifying new opportunities for renewable energy financing and
				carrying out section 2(b)(1)(K). In carrying out its function of promoting
				renewable energy technologies, the Office should, among other things, consider
				the recommendations made by the Renewable Energy Export Advisory
				Committee.</text>
					</paragraph><paragraph id="HA8455DC2903043D395B6EE9BB495D56"><enum>(3)</enum><header>Staff</header><text>The
				President of the Bank shall ensure that the Office has staff with appropriate
				expertise in renewable energy technologies.</text>
					</paragraph><paragraph id="H689BDF4C50774DE095B9C37F5FA639C8"><enum>(4)</enum><header>Annual
				reports</header><text display-inline="yes-display-inline">The Bank shall submit
				annually to the Committee on Resources and the Committee on Financial Services
				of the House of Representatives, and to the Committee on Banking, Housing, and
				Urban Affairs of the Senate, a report that contains, for the fiscal year
				covered by the report—</text>
						<subparagraph id="H087EEB3B154148BBA5E876F4AABE1CC0"><enum>(A)</enum><text display-inline="yes-display-inline">a detailed description of the activities of
				the Office; and</text>
						</subparagraph><subparagraph id="HF5B0CE97EE7643EA94DAC792700ECA8"><enum>(B)</enum><text display-inline="yes-display-inline">an analysis comparing the level of credit
				extended by the Bank for renewable energy projects with the level of credit so
				extended for the preceding fiscal year.</text>
						</subparagraph></paragraph><paragraph id="H1B73BC8939664907A7BFB648AE91475E"><enum>(5)</enum><header>Renewable energy
				technologies defined</header><text display-inline="yes-display-inline">In this
				subsection, the term <quote>renewable energy technologies</quote> means
				technologies for producing power through the use of solar energy, wind energy,
				and energy from biomass, fuel cells, or geothermal sources, and technologies
				for producing less than 10 megawatts in
				hydropower.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="H659C6EDDA8E7491B8D7E16EF00C4AF6C" reported-display-style="italic"><enum>15.</enum><header>Transparency</header>
			<subsection id="HF4C9B7F339C64C0EAC00048998430005"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2(e) of the
			 Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(e)</external-xref>), as amended by section 8(b)
			 of this Act, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H5810A6A68B8F4E51AA0249DC8987A321" style="OLC">
					<paragraph id="HAD800E046004436B8EDF849C5741C9D7"><enum>(6)</enum><header>Procedures to
				reduce adverse effects of loans and guarantees on industries and employment in
				United States</header>
						<subparagraph id="H6B821A7E461841FDBE03DBC9939E0024"><enum>(A)</enum><header>Consideration of
				economic effects of proposed transactions</header><text>If, in making a
				determination under this paragraph with respect to a loan or guarantee, the
				Bank conducts a detailed economic impact analysis or similar study, the
				analysis or study, as the case may be, shall include consideration of—</text>
							<clause id="HEC98AE30F24F4375892513398862071B"><enum>(i)</enum><text>the factors set
				forth in subparagraphs (A) and (B) of paragraph (1); and</text>
							</clause><clause id="H4691E5CE3D5049DE9598C207E6B0A4D"><enum>(ii)</enum><text>the views of the
				public and interested parties.</text>
							</clause></subparagraph><subparagraph id="H1694A0B14C0A4C0C92E96B818099CEC"><enum>(B)</enum><header>Notice and
				comment requirements</header>
							<clause id="H5CE4C3ADC271479F87C05D7DAADBEFEF"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">If, in making a
				determination under this subsection with respect to a loan or guarantee, the
				Bank intends to conduct a detailed economic impact analysis or similar study,
				the Bank shall cause to be published in the Federal Register a notice of the
				intent, and provide a period of not less than 14 days (which, on request by any
				affected party, shall be extended to a period of not more than 30 days) for the
				submission to the Bank of comments on the economic effects of the provision of
				the loan or guarantee. In addition, the Bank shall seek comments on the effects
				from the Department of Commerce, the International Trade Commission, the Office
				of Management and Budget, the Committee on Banking, Housing, and Urban Affairs
				of the Senate, and the Committee on Financial Services of the House of
				Representatives.</text>
							</clause><clause id="H1E2C3454BE84498D80ACC2C678B237A"><enum>(ii)</enum><header>Content of
				notice</header><text display-inline="yes-display-inline">The notice shall
				include appropriate, nonproprietary information about—</text>
								<subclause id="HE551002B91104DC1A418879C1CFC96D"><enum>(I)</enum><text>the name of the
				applicant;</text>
								</subclause><subclause id="H122B674CF22049BE93487B9D409E2EAB"><enum>(II)</enum><text>the country to
				which the goods involved in the transaction will be shipped;</text>
								</subclause><subclause id="H0563F37B194C4914AEFCE84E68C0D83D"><enum>(III)</enum><text>the type of
				goods being exported;</text>
								</subclause><subclause id="HE1B13B26CAA4459EB26D983D6C3667E4"><enum>(IV)</enum><text>the amount of the
				loan or guarantee involved;</text>
								</subclause><subclause id="H8DEE98B020BF4E419566331467DD0634"><enum>(V)</enum><text>the goods that
				would be produced as a result of the provision of the loan or guarantee;</text>
								</subclause><subclause id="H0B12AEDEE1B84D3DAA6F68009CA39DF0"><enum>(VI)</enum><text>the amount of
				increased production that will result from the transaction;</text>
								</subclause><subclause id="H00668CFDF4494E9DB1FB6639669BCCD1"><enum>(VII)</enum><text>the potential
				sales market for the resulting goods;</text>
								</subclause><subclause id="H77F116E4097241FAAFF9BB3326BE5611"><enum>(VIII)</enum><text>the value of
				the transaction; and</text>
								</subclause><subclause id="H9B535A464DC0461D8F16E2D477D700FF"><enum>(IX)</enum><text>any other
				relevant information.</text>
								</subclause></clause><clause id="HD53B4409C7444AD6874352B984E56AD"><enum>(iii)</enum><header>Procedure
				regarding materially changed applications</header>
								<subclause id="H2E52A62EDBB342168326311BF2AA81CC"><enum>(I)</enum><header>In
				general</header><text>If a material change is made to an application for a loan
				or guarantee from the Bank after a notice with respect to the intent described
				in clause (i) is published under this subparagraph, the Bank shall cause to be
				published in the Federal Register a revised notice of the intent, and shall
				provide for a comment period, as provided in clauses (i) and (ii).</text>
								</subclause><subclause id="H65FFFDBF1E254BA08C511BD4FC82CA30"><enum>(II)</enum><header>Material change
				defined</header><text>In subclause (I), the term <quote>material
				change</quote>, with respect to an application, includes—</text>
									<item id="H317F7CC4E2624091B19170E753BEBCC"><enum>(aa)</enum><text>a
				change of at least 25 percent in the amount of a loan or guarantee requested in
				the application; and</text>
									</item><item id="HF1DED796846C4B64A00000F482EC6352"><enum>(bb)</enum><text>a
				change in the principal product to be produced as a result of any transaction
				that would be facilitated by the provision of the loan or guarantee.</text>
									</item></subclause></clause></subparagraph><subparagraph id="HAA9CFFEFDA074792B600BCEBD416AE4D"><enum>(C)</enum><header>Requirement to
				consider and address views of adversely affected persons</header><text display-inline="yes-display-inline">Before taking final action on an
				application for a loan or guarantee from the Bank to which this subsection
				applies, the Bank shall consider and address in writing the views of any person
				who may be substantially adversely affected by the provision of the loan or
				guarantee.</text>
						</subparagraph><subparagraph id="HB617BE9974834A82A46D22736322ABD9"><enum>(D)</enum><header>Publication of
				conclusions</header><text display-inline="yes-display-inline">Within 30 days
				after a party affected by a final decision of the Board of Directors with
				respect to a loan or guarantee makes a written request therefor, the Bank shall
				provide to the affected party a non-confidential summary of the facts found and
				conclusions reached in any detailed economic impact analysis or similar study
				conducted pursuant to subparagraph (B) with respect to the loan or guarantee,
				that were submitted to the Board of Directors.</text>
						</subparagraph><subparagraph id="H76143A57E6BD41F6B801F3FD707E1F52"><enum>(E)</enum><header>Rule of
				interpretation</header><text>This paragraph shall not be construed to make
				subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, applicable to the
				Bank.</text>
						</subparagraph><subparagraph id="H59D2E65F5AF1432DAADC81E0003DC2FD"><enum>(F)</enum><header>Regulations</header><text>The
				Bank shall implement such regulations and procedures as may be appropriate to
				carry out this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="HF289B488BAD445368000CD45DBAC3E6E" reported-display-style="italic"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 2(e)(2)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(e)(2)(C)</external-xref>)
			 is amended by inserting <quote>of not less than 14 days (which, on request of
			 any affected party, shall be extended to a period of not more than 30
			 days)</quote> after <quote>comment period</quote>.</text>
			</subsection></section><section changed="added" display-inline="no-display-inline" id="H540188053D2749049CA910BAC8AEFCCB" reported-display-style="italic" section-type="subsequent-section"><enum>16.</enum><header>Anti-circumvention</header><text display-inline="no-display-inline">Section 2(e) of the Export-Import Bank Act
			 of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(e)</external-xref>), as amended by sections 8(b) and 15(a) of this Act,
			 is amended—</text>
			<paragraph id="H49488EA1E84E47C68415B282CC4CAF4F"><enum>(1)</enum><text>in paragraph (1), by
			 adding after and below the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H9817CAAAC96F4ADD9737DE4500FDB2AC" style="OLC">
					<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">In making
				the determination under subparagraph (B), the Bank shall determine whether the
				facility that would benefit from the extension of a credit or guarantee is
				reasonably likely to produce products in addition to or other than the product
				specified in the application and whether the production of the products may
				cause substantial injury to United States producers of the same, or a similar
				or competing,
				commodity.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="H75D8DEAE69C64935AE5378DFFAA405FE" reported-display-style="italic"><enum>(2)</enum><text>in paragraph (2), by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H3AF2FEA69009413BBAA76FC40448A07" style="OLC">
					<subparagraph id="H9E2CBC74D7F643B3968BD4D411F2FECE"><enum>(E)</enum><header>Anti-circumvention</header><text display-inline="yes-display-inline">The Bank shall not provide a loan or
				guarantee if the Bank determines that providing the loan or guarantee will
				facilitate circumvention of a trade law order or determination referred to in
				subparagraph (A).</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph changed="added" id="HC66D4A663C8744D29C7B62A5C952C1C" reported-display-style="italic"><enum>(3)</enum><text>by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H33DEDC2E34C64C71B3C4D8CBFBBDFD73" style="OLC">
					<paragraph id="HAC948B5D94C24445B8310206A822901B"><enum>(7)</enum><header>Financial
				threshold determinations</header><text display-inline="yes-display-inline">For
				purposes of determining whether a proposed transaction exceeds a financial
				threshold under this subsection or under the procedures or rules of the Bank,
				the Bank shall aggregate the dollar amount of the proposed transaction and the
				dollar amounts of all loans and guarantees, approved by the Bank in the
				preceding 24-month period, that involved the same foreign entity and
				substantially the same product to be
				produced.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" display-inline="no-display-inline" id="H1BA4462CE69C416B937EF2B744BFD5AB" reported-display-style="italic" section-type="subsequent-section"><enum>17.</enum><header>Performance standards
			 applicable to Bank assistance for small businesses, especially those owned by
			 social and economically disadvantaged individuals and those owned by
			 women</header>
			<subsection changed="added" id="HEB40416885744749A9847272429BC618" reported-display-style="italic"><enum>(a)</enum><header>Development of
			 performance standards</header><text>Within 120 days after the date of the
			 enactment of this Act, the Comptroller General of the United States shall
			 develop and transmit to the Board of Directors of the Export-Import Bank of the
			 United States—</text>
				<paragraph id="HB3A30260D81640448400C9D886A0D2AF"><enum>(1)</enum><text>a set of standards which
			 may be used to determine the extent to which the Bank has carried out
			 successfully subparagraphs (E) and (I) of section 2(b)(1) of the Export-Import
			 Bank Act of 1945, and the functions described in subsections (f)(1)(A),
			 (f)(4)(A), and (h)(2) of section 3 of such Act; and</text>
				</paragraph><paragraph id="HA5799126D4EC46DCA539DBA3B338C709"><enum>(2)</enum><text>a set of rules for
			 measuring the performance of the Bank against the standards.</text>
				</paragraph></subsection><subsection changed="added" id="H2F875AD881CC4DF79DDF04B9C232CF0" reported-display-style="italic"><enum>(b)</enum><header>Report on
			 performance</header><text>Section 8 of the Export-Import Bank Act of 1945 (12
			 U.S.C. 635g), as amended by sections 4, 5, and 10(b) of this Act, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HED37D8C7B8B34319AD6691850888B7F7" style="OLC">
					<subsection id="HF60CBE71E65E4663A9C087789D750115"><enum>(j)</enum><header>Report on
				achievement of performance standards applicable to small business concerns,
				socially and economically disadvantaged small business conerns, and small
				business concerns owned by women</header><text display-inline="yes-display-inline">The Bank shall submit annually to the
				Congress, and include in a separate section of the annual report to the
				Congress under subsection (a) of this section, a report on the extent to which
				the Bank has carried out successfully subparagraphs (E) and (I) of section
				2(b)(1), and the functions described in subsections (f)(1)(A), (f)(4)(A), and
				(h)(2) of section 3, of this Act, using the performance standards and measuring
				rules developed pursuant to section 12(a) of the Export-Import Bank
				Reauthorization Act of 2006.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" display-inline="no-display-inline" id="HC2AC3865C04140209938C0011C11B6F" reported-display-style="italic" section-type="subsequent-section"><enum>18.</enum><header>Prohibition on
			 assistance to develop or promote any rail connections or railway-related
			 connections that traverse or connect Baku, Azerbaijan, Tbilisi, Georgia, and
			 Kars, Turkey, and that specifically exclude cities in Armenia</header><text display-inline="no-display-inline">Section 2(b) of the Export-Import Bank Act
			 of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(b)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H25D50E1635AA4269994B22779F87B51B" style="OLC">
				<paragraph id="HB4E35A7D7EBE48DBA6A9FED9B6AAD349" indent="up1"><enum>(13)</enum><text display-inline="yes-display-inline">The Bank shall not guarantee, insure,
				extend credit, or participate in an extension of credit in connection with the
				development or promotion of any rail connections or railway-related connections
				that do not traverse or connect with Armenia, and do traverse or connect Baku,
				Azerbaijan, Tbilisi, Georgia, and Kars,
				Turkey.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="H7553AE28EE10494E987428CF62055DA6" reported-display-style="italic"><enum>19.</enum><header>Technical
			 corrections</header><text display-inline="no-display-inline">Section
			 2(b)(2)(B)(ii) of the Export-Import Bank Act of 1945 (12 U.S.C.
			 635(b)(2)(B)(ii)) is amended by striking subclauses (I), (III), (VII), (VIII),
			 and (IX), and redesignating subclauses (II), (IV), (V), and (VI) as subclauses
			 (I) through (IV), respectively.</text>
		</section><section changed="added" id="H2A79192FD12D4E9D8375DF8C9D5600FA" reported-display-style="italic"><enum>20.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on October 1, 2006.</text>
