<official-title display="yes">To amend the Horse Protection Act to prohibit the shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation of horses and other equines to be slaughtered for human consumption, and for other purposes.</official-title>

<section id="H869FFD051ADE4DC2B05933E652761400" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Prohibition on shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation of horses and other equines for slaughter for human consumption</header> 
<subsection id="HA17D986C575C4DA28CF138C4A2CF1E62"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1821">15 U.S.C. 1821</external-xref>) is amended—</text> 
<paragraph id="H2599BDD017204A3C81B75D009941FA67"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), (3), and (4) as paragraphs (2), (3), (5), and (6), respectively;</text></paragraph> 
<paragraph id="HCDB0E6E0215741F6B43272C844245C30"><enum>(2)</enum><text>by inserting before paragraph (2), as so redesignated, the following new paragraph:</text>

<paragraph id="H41AA906AD13248F395ACFAAC25BD67F9"><enum>(1)</enum><text>The term <quote>human consumption</quote> means ingestion by people as a source of food.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB4D77A8E293A402CAAE67B2B4451D5F3"><enum>(3)</enum><text>by inserting after paragraph (3), as so redesignated, the following new paragraph:</text>

<paragraph id="H0C05B7281AEF42E0A800F157285B2502"><enum>(4)</enum><text>The term <quote>slaughter</quote> means the killing of one or more horses or other equines with the intent to sell or trade the flesh for human consumption.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9337E503432F4715002C708C15DAE757"><enum>(b)</enum><header>Findings</header><text>Section 3 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1822">15 U.S.C. 1822</external-xref>) is amended—</text> 
<paragraph id="H8CA9C9249DC244198FB6CBFEF72346C"><enum>(1)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (6) through (10), respectively; </text></paragraph> 
<paragraph id="HD1C617599C4F4B95B99D29F9CE7A01B"><enum>(2)</enum><text>by adding before paragraph (6), as so redesignated, the following new paragraphs:</text>

<paragraph id="H5A8675C4EFF64C019EA925A800AB5E85"><enum>(1)</enum><text>horses and other equines play a vital role in the collective experience of the United States and deserve protection and compassion;</text></paragraph> 
<paragraph id="H54AD5FBDC2684B43828DF1777B064989"><enum>(2)</enum><text display-inline="yes-display-inline">horses and other equines are domestic animals that are used primarily for recreation, pleasure, and sport;</text></paragraph> 
<paragraph id="H0EA0000603FD4D0B904E73C808174D72" display-inline="no-display-inline"><enum>(3)</enum><text>unlike cows, pigs, and many other animals, horses and other equines are not raised for the purpose of being slaughtered for human consumption;</text></paragraph> 
<paragraph id="H6656688674E24910A205A707ADE219CB"><enum>(4)</enum><text>individuals selling horses or other equines at auctions are seldom aware that the animals may be bought for the purpose of being slaughtered for human consumption;</text></paragraph> 
<paragraph id="H8C4F63C4ED394638B9EBEE9EE9184A7"><enum>(5)</enum><text>the Animal and Plant Health Inspection Service of the Department of Agriculture has found that horses and other equines cannot be safely and humanely transported in double deck trailers;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H390773E5A99842689E71D3A4F5A2B506"><enum>(3)</enum><text>by striking paragraph (8), as so redesignated, and inserting the following new paragraph:</text>

<paragraph id="H2AB46E1984BD450F93F219B507FEA069"><enum>(8)</enum><text display-inline="yes-display-inline">the movement, showing, exhibition, or sale of sore horses in intrastate commerce, and the shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation in intrastate commerce of horses and other equines to be slaughtered for human consumption, adversely affect and burden interstate and foreign commerce;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H034756465DC74B929BF000D5DE01B061"><enum>(c)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 5 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1824">15 U.S.C. 1824</external-xref>) is amended—</text> 
<paragraph id="HD6E2913D92E7461784C6D24E1EA168BF"><enum>(1)</enum><text>by redesignating paragraphs (8) through (11) as paragraphs (9) through (12), respectively; and</text></paragraph> 
<paragraph id="HEE710A0EB126470CB560DF1A48B896F"><enum>(2)</enum><text>by inserting after paragraph 7 the following new paragraph:</text>

<paragraph id="H1D7DE5BF78FD44C596C9F2F338AE71B2"><enum>(8)</enum><text>The shipping, transporting, moving, delivering, receiving, possessing, purchasing, selling, or donation of any horse or other equine to be slaughtered for human consumption.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF4A05EFA2A2D45739B255659768DBACE"><enum>(d)</enum><header>Authority to detain</header><text>Section 6(e) of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1825">15 U.S.C. 1825(e)</external-xref>) is amended—</text> 
<paragraph id="HA95250612B2F40F0A6A713B2DEDA7EB8"><enum>(1)</enum><text>by striking the first sentence of paragraph (1);</text></paragraph> 
<paragraph id="H44578A150F714D4DB25EB0DCFB28944"><enum>(2)</enum><text>by redesignating paragraphs (1) and (2) and as paragraphs (2) and (3), respectively; and</text></paragraph> 
<paragraph id="HD07268D336C243E4B9DFC15E1F69B986"><enum>(3)</enum><text>by inserting before paragraph (2), as so redesignated, the following new paragraph:</text>

<paragraph id="HB9CD167E61574B6AABB8C355F0152C9" indent="up1"><enum>(1)</enum><text>The Secretary may detain for examination, testing, or the taking of evidence—</text> 
<subparagraph id="HC04970749F08456AA8C32896D5F833E"><enum>(A)</enum><text display-inline="yes-display-inline">any horse at any horse show, horse exhibition, or horse sale or auction which is sore or which the Secretary has probable cause to believe is sore; and</text></subparagraph> 
<subparagraph id="H586DEA2AE4BA48A4BB739275644EE05D"><enum>(B)</enum><text display-inline="yes-display-inline">any horse or other equine which the Secretary has probable cause to believe is being shipped, transported, moved, delivered, received, possessed, purchased, sold, or donated in violation of section 5(8).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDCC95239D4304A5AAB477E538FB4E6F"><enum>(e)</enum><header>Authorization of appropriations</header><text>Section 12 of the Horse Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1831">15 U.S.C. 1831</external-xref>) is amended by striking <quote>$500,000</quote> and inserting <quote>$5,000,000</quote>. </text></subsection></section>
