<official-title display="yes">To amend titles 38 and 18, United States Code, to prohibit certain demonstrations at cemeteries under the control of the National Cemetery Administration and at Arlington National Cemetery, and for other purposes.</official-title>

<section id="H3BB51284394E4087AB44AD3F71FA2CB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Respect for America’s Fallen Heroes Act</short-title></quote>.</text></section> 
<section id="HD3AE9AFB6D1C44F687D7CD8C92AF5600"><enum>2.</enum><header>Prohibition on certain demonstrations at cemeteries under the control of the National Cemetery Administration and at Arlington National Cemetery</header> 
<subsection id="H7D7012A2181F4EF59E8636022222CE69"><enum>(a)</enum><header>Prohibition</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/24">Chapter 24</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="H6EBADBF5310F4F91B0D0EC834734B9EA" display-inline="no-display-inline"><enum>2413.</enum><header>Prohibition on certain demonstrations at cemeteries under control of National Cemetery Administration and at Arlington National Cemetery</header> 
<subsection id="H0795449D2F4C480386ADDEAF009389C5" display-inline="no-display-inline"><enum>(a)</enum><header>Prohibition</header><text>No person may carry out—</text> 
<paragraph id="HCD190F3B39DA4F92915C98C00C64C30" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">a demonstration on the property of a cemetery under the control of the National Cemetery Administration or on the property of Arlington National Cemetery unless the demonstration has been approved by the cemetery superintendent or the director of the property on which the cemetery is located; or</text></paragraph> 
<paragraph id="H2CEBA300492249C38074392F855E584C" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to such a cemetery at which a funeral or memorial service or ceremony is to be held, a demonstration within 500 feet of that cemetery that—</text> 
<subparagraph id="H97143C067E74485EAB00A6E7AA596588"><enum>(A)</enum><text>is conducted during the period beginning 60 minutes before and ending 60 minutes after the funeral or memorial service or ceremony is held; and</text></subparagraph> 
<subparagraph id="H42BF8C75634C4629B0617E31889395BF"><enum>(B)</enum><text display-inline="yes-display-inline">includes, as a part of such demonstration, any individual willfully making or assisting in the making of any noise or diversion that disturbs or tends to disturb the peace or good order of the funeral or memorial service or ceremony.</text></subparagraph></paragraph></subsection> 
<subsection id="H8A75E6C4DDAF49A89BDA95C01E9CD136" commented="no"><enum>(b)</enum><header>Demonstration</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>demonstration</quote> includes the following:</text> 
<paragraph id="H305B51E9F06D41129CA68052BD366330" commented="no"><enum>(1)</enum><text>Any picketing or similar conduct.</text></paragraph> 
<paragraph id="H164989B472554BE4A926224BAB00DCE8" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Any oration, speech, use of sound amplification equipment or device, or similar conduct before an assembled group of people that is not part of a funeral or memorial service or ceremony.</text></paragraph> 
<paragraph id="HE6E8E274096E4531A87DE93AA2696BC" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The display of any placard, banner, flag, or similar device, unless such a display is part of a funeral or memorial service or ceremony.</text></paragraph> 
<paragraph id="H9199F57FADDA471CB5A360185DF0AF8E" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The distribution of any handbill, pamphlet, leaflet, or other written or printed matter other than a program distributed as part of a funeral or memorial service or ceremony.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDB2D9FB9DB8044358B041CA1F7978E2C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<section id="HE8526AD8A8944C41843DF8DA849D60CA"><enum>3.</enum><header>Penalty for violation of prohibition on unapproved demonstrations at cemeteries under the control of the National Cemetery Administration and at Arlington National Cemetery</header> 
<subsection id="H0B94F8BB64FB432EB360451910FE3C8"><enum>(a)</enum><header>Penalty</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/67">Chapter 67</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text>

<section id="H5AB466363E194E5AB1C7E228B8DEE03"><enum>1387.</enum><header>Demonstrations at cemeteries under the control of National Cemetery Administration and at Arlington National Cemetery</header> <text display-inline="no-display-inline">Whoever violates <external-xref legal-doc="usc" parsable-cite="usc/38/2413">section 2413</external-xref> of title 38 shall be fined under this title, imprisoned for not more than one year, or both.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF5AA4336550F4DE1A4EF5151B83858F2"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<section id="H847C149480384166A1CC7ECB97A2238C"><enum>4.</enum><header>Sense of Congress on State restriction of demonstrations near military funerals</header><text display-inline="no-display-inline">It is the sense of Congress that each State should enact legislation to restrict demonstrations near any military funeral.</text> </section>
