<section id="HE86184032D5944AD8898FD00884C21A3" section-type="section-one"><enum>1.</enum><header>Discretionary authority with respect to removal of parents of citizen children</header><text display-inline="no-display-inline">Section 240(c)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)(4)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="H34A5D5BC80BE456FA16BCF381C6DB115"><enum>(D)</enum><header>Discretion of judge in case of citizen child</header><text>In the case of an alien deportable under section 237 who is the parent of a child who is a citizen of the United States, the immigration judge may exercise discretion to decline to order the alien removed from the United States if the judge determines that such removal is clearly against the best interests of the child, except that this subparagraph shall not apply to any alien who the judge determines—</text> 
<clause id="H9DED1C0587F94F6CA33D1B20CBBD1142"><enum>(i)</enum><text>is described in section 237(a)(4); or</text></clause> 
<clause id="HB3BF5DDE0A224ED6B7F71BCD7EF6A826"><enum>(ii)</enum><text>has engaged in conduct described in paragraph (8) or (9) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
