<official-title>To amend the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 to establish vessel ballast water management requirements, and for other purposes.</official-title>

<section section-type="section-one" id="HBAC13EB1571849E5858963DD15ED13D" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title></quote>.</text></section> 
<section id="H7FAB10679FB341D7AFC040C426B59B9E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Section 1002(a) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4701">16 U.S.C. 4701(a)</external-xref>) is amended by striking <quote>and</quote> after the semicolon at the end of paragraph (14), by striking the period at the end of paragraph (15) and inserting a semicolon, and by adding at the end the following:</text> 
<quoted-block id="H6F8CCFEC27D34AB3963F89EF02EE48A2"> 
<paragraph id="H50ACC09146A94B369997D8C61C897971"><enum>(16)</enum><text>the introduction of aquatic invasive species into the Nation’s waters is one of the most urgent issues facing aquatic ecosystems in the United States;</text></paragraph> 
<paragraph id="H6A06F93BCAA74A2A804FCE22A711C4A5"><enum>(17)</enum><text>the direct and indirect costs of aquatic invasive species to the economy of the United States have been estimated at billions of dollars per year;</text></paragraph> 
<paragraph id="H040A934EE8194D52AF42009093D88194"><enum>(18)</enum><text>invasive species are thought to have been involved in 70 percent of the last century’s extinctions of native aquatic species;</text></paragraph> 
<paragraph id="HD09AA8F51F584876B0BB35287138429B"><enum>(19)</enum><text>aquatic invasive species are a significant problem throughout the United States, including Hawaii, Alaska, San Francisco Bay, the Great Lakes, the Southeast, and the Chesapeake Bay;</text></paragraph> 
<paragraph id="HE6BE7CF4E1134C26B1BD67411DDF6BB1"><enum>(20)</enum><text>ballast water from ships is one of the largest pathways for the introduction and spread of aquatic invasive species;</text></paragraph> 
<paragraph id="H982BB97269F24D949DD445E399828264"><enum>(21)</enum><text>it has been estimated that some 10,000 non-indigenous aquatic species travel around the globe each day in the ballast water of cargo ships;</text></paragraph> 
<paragraph id="H777FD9591BE9400BA2DD91B8253E3500"><enum>(22)</enum><text>over 2 billion gallons of ballast water are discharged in United States waters each year;</text></paragraph> 
<paragraph id="HBEC92A70926A449F004138EBD7ACE200"><enum>(23)</enum><text>ballast water has been found to transport not only invasive plants and animals but pathogens as well, such as cholera;</text></paragraph> 
<paragraph id="H8B87F1C87ABF445CA2D6EBE03C812722"><enum>(24)</enum><text>aquatic invasive species may also be introduced by other vessel conduits, including the hulls of ships;</text></paragraph> 
<paragraph id="HE322908D5DBB45D88331EB15E1CFE600"><enum>(25)</enum><text>aquatic invasive species may be transferred from other countries, or from distinct regions in the United States;</text></paragraph> 
<paragraph id="H2935006E9F0243E89BCA80A185E3520"><enum>(26)</enum><text>current Federal programs are insufficient to effectively address this growing problem;</text></paragraph> 
<paragraph id="H73BB92DB04B7413387EAB47919151FB3"><enum>(27)</enum><text>preventing aquatic invasive species from being introduced is the most cost-effective approach for addressing this issue because, once established, they are costly and sometimes impossible to control;</text></paragraph> 
<paragraph id="H33B8FD706BDB4559825240FECA90671F"><enum>(28)</enum><text>in 2004, the International Maritime Organization agreed to a Convention, which the United States played an active role in negotiating, to prevent, minimize, and ultimately eliminate the transfer of aquatic invasive species through the control and management of ballast water and sediments; and</text></paragraph> 
<paragraph id="HF3D67E5FFEFC4E0D8EE63D057568D37F"><enum>(29)</enum><text>the International Maritime Organization agreement specifically recognizes that countries can take more stringent measures than those of the Convention with respect to the control and management of ships’ ballast water and sediment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<title id="H944500EB46484548B817F84E28A14804"><enum>I</enum><header>Prevention of Introduction of Aquatic Invasive Species Into Waters of the United States by Vessels</header> 
<section id="H9510CADD91464D21914E5D2EDCA155AC"><enum>101.</enum><header>Ballast water management</header> 
<subsection id="H285643643BFC47CDA0731DD9004BF1AA"><enum>(a)</enum><header>In general</header><text>Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711</external-xref>) is amended to read as follows:</text>

<section id="HB77E6837E4D5476A97E7B5E9E120556F"><enum>1101.</enum><header>Prevention of introduction of aquatic invasive species into waters of the United States by vessels</header> 
<subsection id="H824BCD244CC74222AD09F1D3C8986F04"><enum>(a)</enum><header>Vessels to which this Section applies</header> 
<paragraph id="H66C634079F844DE6A6008001F4687EBA"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2), (3), and (4), this section applies to a vessel (including a towed vessel, and any structure being towed by a vessel) that is designed, constructed, or adapted to carry ballast water; and</text> 
<subparagraph id="HDC799A970EA843CFB586D0CA59AED418"><enum>(A)</enum><text>is a vessel (or a structure being towed by a vessel) of United States registry or nationality, or operated under the authority of the United States, wherever located; or</text></subparagraph> 
<subparagraph id="H5AB595B12267437882FF377B06977EFD"><enum>(B)</enum><text>is a foreign vessel that (or a structure being towed by a foreign vessel that)—</text> 
<clause id="HE341FE33ABE6440A8CA1CF34CC351900"><enum>(i)</enum><text>is en route to a United States port or place; or</text></clause> 
<clause id="H0577F3A3AE034A18A1B2C2F378900000"><enum>(ii)</enum><text>has departed from a United States port or place and is within waters subject to the jurisdiction of the United States.</text></clause></subparagraph></paragraph> 
<paragraph id="H730561979479429C9263E6FE41EF12AE"><enum>(2)</enum><header>Permanent ballast water vessels</header><text>This section does not apply to a vessel that carries all of its permanent ballast water in sealed tanks and is not subject to discharge.</text></paragraph> 
<paragraph id="H25B47C3B1E9441BF8BE684DE27008EE7"><enum>(3)</enum><header>Armed Forces vessels</header> 
<subparagraph id="H7D9513056AAB4AD88E3F5267FE59322D"><enum>(A)</enum><header>Exemption</header><text>Except as provided in subparagraph (B), this section does not apply to a vessel of the Armed Forces.</text></subparagraph> 
<subparagraph id="H700A696BA53E444AADE3FDCA892AB2F"><enum>(B)</enum><header>Ballast water management program</header><text>The Secretary of Defense and the Secretary, after consultation with the Administrator and the Under Secretary, shall implement a ballast water management program, including the promulgation of standards for ballast water exchange and treatment and for sediment management, for vessels of the Armed Forces under their respective jurisdictions designed, constructed, or adapted to carry ballast water that is—</text> 
<clause id="H3270C922F6034C888EFC5E4E4D862B05"><enum>(i)</enum><text>consistent with the requirements of this section, including the deadlines; and</text></clause> 
<clause id="HE93BF8B6E4A342E8B617B1D1DA09946D"><enum>(ii)</enum><text>at least as stringent as the requirements promulgated for such vessels under section 312 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1322">33 U.S.C. 1322</external-xref>).</text></clause></subparagraph></paragraph> 
<paragraph id="H708970E583FF4D8FA7FFC5FED5BECFA1"><enum>(4)</enum><header>Special rule for small recreational vessels</header><text>In applying this section to recreational vessels less than 50 meters in length that have a maximum ballast water capacity of 8 cubic meters, the Secretary may promulgate alternative measures for managing ballast water in a manner that is consistent with the requirements of this section.</text></paragraph></subsection> 
<subsection id="H3BADB65EA0E54368842EAC39F34486BF"><enum>(b)</enum><header>Uptake and discharge of ballast water or sediment</header> 
<paragraph id="HF875E84DD16F4415B5B03600B98C55C8"><enum>(1)</enum><header>Prohibition</header><text>The operator of a vessel to which this section applies may not conduct the uptake or discharge of ballast water or sediment except as provided in this section.</text></paragraph> 
<paragraph id="HF60CD6573630413FA949CD6700A33D74"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not apply to the uptake or discharge of ballast water or sediment in the following circumstances:</text> 
<subparagraph id="HA895A119084347D0B8C0965705362CBB"><enum>(A)</enum><text>The uptake or discharge is solely for the purpose of—</text> 
<clause id="H41CD21907B1243FDBE60B7F035E1400"><enum>(i)</enum><text>ensuring the safety of the vessel in an emergency situation; or</text></clause> 
<clause id="HBDF465BCF5914DE18788ACCDFB8161E8"><enum>(ii)</enum><text>saving a life at sea.</text></clause></subparagraph> 
<subparagraph id="H9FD1E5BED4D842E599EAAC2B65556586"><enum>(B)</enum><text>The uptake or discharge is accidental and the result of damage to the vessel or its equipment and—</text> 
<clause id="H966DCEBBB28D4C148250DCC118DFD730"><enum>(i)</enum><text>all reasonable precautions to prevent or minimize ballast water and sediment discharge have been taken before and after the damage occurs, the discovery of the damage, and the discharge; and</text></clause> 
<clause id="H1A94F7A908B94999A4FB95122C3BB7FB"><enum>(ii)</enum><text>the owner or officer in charge of the vessel did not willfully or recklessly cause the damage.</text></clause></subparagraph> 
<subparagraph id="H2551B778B4DC45D7A467AA6D4CEEB388"><enum>(C)</enum><text>The uptake or discharge is solely for the purpose of avoiding or minimizing the discharge from the vessel of pollution that would otherwise violate applicable Federal or State law.</text></subparagraph> 
<subparagraph id="H1BA6DBED4325464EAAAC74327B8255F6"><enum>(D)</enum><text>The uptake or discharge of ballast water and sediment occurs at the same location where the whole of that ballast water and that sediment originated and there is no mixing with ballast water and sediment from another area that has not been managed in accordance with the requirements of this section.</text></subparagraph></paragraph></subsection> 
<subsection id="HC35D1EF86BA94B09A66752F5E6DBF7CD"><enum>(c)</enum><header>Aquatic invasive species plan</header> 
<paragraph id="HDC4971E896B248FA9342C20626CACEF"><enum>(1)</enum><header>In general</header><text>The operator of a vessel to which this section applies shall conduct all ballast water management operations of that vessel in accordance with an aquatic invasive species plan designed to minimize the discharge of aquatic invasive species that—</text> 
<subparagraph id="H26A9BBF4C30B4A81BD82A9AA12D6AFB4"><enum>(A)</enum><text>meets the requirements prescribed by the Secretary by regulation; and</text></subparagraph> 
<subparagraph id="H36D4421042A6455CA43681089869848F"><enum>(B)</enum><text>is approved by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H9173318B838F43AFBB9FAB4F8DEAF665"><enum>(2)</enum><header>Approval criteria</header> 
<subparagraph id="HD64572BBFEA84FAC00B695B6A7A8EB93"><enum>(A)</enum><header>In general</header><text>The Secretary may not approve an aquatic invasive species plan unless the Secretary determines that the plan—</text> 
<clause id="H193B762F4DCE403B9139BAEDA94035CA"><enum>(i)</enum><text>describes in detail the actions to be taken to implement the ballast water management requirements established under this section;</text></clause> 
<clause id="H7DE73892BB234736A65904F42FD6106"><enum>(ii)</enum><text>describes in detail the procedures to be used for disposal of sediment at sea and on shore in accordance with the requirements of this section;</text></clause> 
<clause id="H24EEEB2136854BE1BBF4BB78C645E14"><enum>(iii)</enum><text>describes in detail safety procedures for the vessel and crew associated with ballast water management;</text></clause> 
<clause id="HFECA85608DF547EAA24CFCA0562F0099"><enum>(iv)</enum><text>designates the officer on board the vessel in charge of ensuring that the plan is properly implemented;</text></clause> 
<clause id="H50ABE662FA4E4470BEF2299C838922E"><enum>(v)</enum><text>contains the reporting requirements for vessels established under this section and a copy of each form necessary to meet those requirements;</text></clause> 
<clause id="H1462E5B2D3934391A062AA645826A5E6"><enum>(vi)</enum><text display-inline="yes-display-inline">includes documents relevant to aquatic invasive species management equipment and procedures;</text></clause> 
<clause id="H77ED3ED3408147F28B8F0068E81C54A1"><enum>(vii)</enum><text>includes the location of access points for sampling ballast water and sediment;</text></clause> 
<clause id="H486EFBB825C245CEAB6EEF25BDB08BB9"><enum>(viii)</enum><text>includes other requirements prescribed by the Secretary, including operational requirements for complying with subsections (f) and (g);</text></clause> 
<clause id="HC5DF0B8A025E435697BDAD1B86F2E0C"><enum>(ix)</enum><text>includes a contingency plan for acting under the safety or stability exception under subsection (f)(4), that includes procedures to reduce the risk of organism transfer via ballast water discharge; and</text></clause> 
<clause id="H9958C29E93014FF2A2BAB598B1C5BD2E"><enum>(x)</enum><text>meets all other requirements prescribed by the Secretary.</text></clause></subparagraph> 
<subparagraph id="HB2DC20D05CA840E30049E0D4A78ECDBD"><enum>(B)</enum><header>Foreign vessels</header><text>The Secretary may approve an aquatic invasive species plan for a foreign vessel (as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(12)</external-xref> of title 46, United States Code) on the basis of a certificate of compliance with the criteria described in subparagraph (A) issued by the vessel’s country of registration in accordance with regulations promulgated by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H7A90894416D847EF885D7B46B070F925"><enum>(3)</enum><header>Copy of plan on board vessel</header><text>The owner or operator of a vessel to which this section applies shall—</text> 
<subparagraph id="HA7EF787F50C74E2A90BB5117FF39291"><enum>(A)</enum><text display-inline="yes-display-inline">maintain a copy of the vessel’s aquatic invasive species plan on board at all times; and</text></subparagraph> 
<subparagraph id="H5616C2895B9A4C74AB72A163E004F9FB"><enum>(B)</enum><text>keep the plan readily available at all reasonable times for examination by the Secretary or a representative of the State in which the port is located.</text></subparagraph></paragraph> 
<paragraph id="HF12FF0D3B1A540508DCFC6A5AD2C70AE"><enum>(4)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Task Force, shall issue regulations prescribing the requirements of this subsection.</text></paragraph></subsection> 
<subsection id="HA124DA4870134FD1991E081E0099F09F"><enum>(d)</enum><header>Vessel ballast water record book</header> 
<paragraph id="H46257EBA61934C15B0DC3D5B5045B2E5"><enum>(1)</enum><header>In general</header><text>The owner or operator of a vessel to which this section applies shall maintain a ballast water record book in English on board the vessel in which—</text> 
<subparagraph id="H7527A40F7FD944D29038CAB700B5A895"><enum>(A)</enum><text>each operation involving the uptake or discharge of ballast water or sediment discharge is fully recorded without delay, in accordance with regulations promulgated by the Secretary;</text></subparagraph> 
<subparagraph id="H169DE83512934D0BA700D112ECEC421"><enum>(B)</enum><text>each such operation is described in detail, including the location and circumstances of, and the reason for, the operation; and</text></subparagraph> 
<subparagraph id="H4879A8C5085A4F3A9E8B331E2F4C3C49"><enum>(C)</enum><text>the exact nature and circumstances of any situation under which any operation was conducted under an exception set forth in subsection (b)(2) or (f)(4) is described.</text></subparagraph></paragraph> 
<paragraph id="H4EFE0FA6CE4F4DA3A6BC44F2FBC6034"><enum>(2)</enum><header>Availability</header><text>The ballast water record book—</text> 
<subparagraph id="H344F6338C5D74A8B81D4B4B899145DE5"><enum>(A)</enum><text>shall be kept readily available for examination by the Secretary or a representative of the State at all reasonable times in each port that is entered by the vessel; and</text> </subparagraph> 
<subparagraph id="H145F1EEA5011408EA7F1172BFEBFF119"><enum>(B)</enum><text>notwithstanding paragraph (1), may be kept on the towing vessel in the case of an unmanned vessel under tow.</text></subparagraph></paragraph> 
<paragraph id="H95A918BE5BFF4699912F326824F7E7BD"><enum>(3)</enum><header>Retention period</header><text>The ballast water record book shall be retained—</text> 
<subparagraph id="H810816D9E928435D88302B1731BD9098"><enum>(A)</enum><text>on board the vessel for a period of 3 years after the date on which the last entry in the book is made; and</text></subparagraph> 
<subparagraph id="H7CB669422D0B481281DFEBE17D8C8960"><enum>(B)</enum><text>under the control of the vessel’s owner for an additional period of 3 years.</text></subparagraph></paragraph> 
<paragraph id="HE7B28181CA8A4403A12E0025A17DB458"><enum>(4)</enum><header>Regulations</header><text>In the regulations prescribed under this section, the Secretary shall require, at a minimum, that—</text> 
<subparagraph id="H07C9C69DF4464B779FD7BAF60035FD1B"><enum>(A)</enum><text>each entry in the ballast water record book be signed and dated by the officer in charge of the ballast water operation recorded;</text></subparagraph> 
<subparagraph id="H6DCB975F204A495DBD4326272397D58F"><enum>(B)</enum><text>each completed page in the ballast water record book be signed and dated by the master of the vessel; and</text></subparagraph> 
<subparagraph id="H373388408CE445B0B9CFD0A9C222037C"><enum>(C)</enum><text>the owner or operator of the vessel transmit such information to the Secretary regarding the ballast operations of the vessel as the Secretary may require.</text></subparagraph></paragraph> 
<paragraph id="H9BFBBF49D11B4600926ED334463E8191"><enum>(5)</enum><header>Alternative means of recordkeeping</header><text>The Secretary shall provide by regulation for alternative methods of recordkeeping, including electronic recordkeeping, to comply with the requirements of this subsection.</text></paragraph> 
<paragraph id="H4706F24044B947269783B19286692B86"><enum>(6)</enum><header>National ballast information clearinghouse</header><text display-inline="yes-display-inline">Records required for a vessel under this subsection shall be transmitted by the owner or operator of the vessel to the National Ballast Information Clearinghouse established under section 1102(f).</text></paragraph></subsection> 
<subsection id="HBF647CEE13C24B4AAD28F0FCC58FA3C1"><enum>(e)</enum><header>Best management practices</header> 
<paragraph id="HC735C23F857E462EBF82573D325654A"><enum>(1)</enum><header>Guidelines for best management practices</header><text>The Secretary shall issue guidance for best management practices for purposes of compliance with this section by no later than 18 months after the date of the enactment of this subsection.</text> </paragraph> 
<paragraph id="H4BC30285838D47C69FF87B17351CD3B0"><enum>(2)</enum><header>Content</header><text>The guidance shall include—</text> 
<subparagraph id="HC34589030C154AACA38647BE52423F81"><enum>(A)</enum><text>sediment management in transoceanic vessels, including—</text> 
<clause id="HCD055C5FDB9B411CA46C1E7D296D27C5"><enum>(i)</enum><text>saltwater flushing of ballast tanks in accordance with subsection (f)(9) at regular intervals, for vessels that declare no-ballast-on-board or claim to be carrying only unpumpable quantities of ballast water;</text></clause> 
<clause id="HE724C478F6B04103800111E6667C937C"><enum>(ii)</enum><text>the minimization of ballast water uptake in areas with a greater risk of harmful organisms entering ballast tanks, such as areas with toxic algal blooms or known outbreaks of aquatic invasive species; </text> </clause> 
<clause id="H6397BE4FAC5349A6895612F8EFD93D62"><enum>(iii)</enum><text>the avoidance of unnecessary ballast water discharge in a port of ballast water taken up in another port;</text></clause> 
<clause id="H02658340168942CBA6E7C3CB66BAC750"><enum>(iv)</enum><text>to the maximum extent possible, the collection and proper disposal of debris from cleaning of the vessel’s hull;</text></clause> 
<clause id="HAFCF3EE5601941CAAE745DF07C71D790"><enum>(v)</enum><text>the proper use of anti-fouling coating; and</text></clause> 
<clause id="H01677FD8C9B6401FAED6F5D3BCEB189"><enum>(vi)</enum><text>the minimization of the transfer of aquatic invasive species from other pathways relevant to the vessel or towed structure, including the hull.</text> </clause></subparagraph></paragraph></subsection> 
<subsection id="H7FC8FB7F97C44601AD6129ABAE275C9C"><enum>(f)</enum><header>Ballast water exchange requirements</header> 
<paragraph id="H635558F42A8349B1BD6053B5BAAF94BA"><enum>(1)</enum><header>In general</header><text>Until a vessel is required to conduct ballast water treatment in accordance with subsection (g) of this section, the operator of a vessel to which this section applies may not discharge ballast water except after—</text> 
<subparagraph id="HB98BC8F0392D4E129EC93F8920517C00"><enum>(A)</enum><text>conducting ballast water exchange, in accordance with paragraph (3) and regulations prescribed by the Secretary, in a manner that results in an efficiency of at least 95 percent volumetric exchange of the ballast water for each ballast water tank;</text></subparagraph> 
<subparagraph id="HD1D61E8A081A4587BB3E759BF1253C3C"><enum>(B)</enum><text display-inline="yes-display-inline">meeting the requirements of paragraph (9), if the vessel’s condition is such that the vessel is declared to have no ballast on board or is claimed to be carrying only unpumpable quantities of ballast;</text></subparagraph> 
<subparagraph id="H22375B6A10E7488CA788B6CAFF42DA9B"><enum>(C)</enum><text>using ballast water treatment that meets the performance standards of subsection (g); or</text></subparagraph> 
<subparagraph id="H4AC96F8E3B894010ADEF41596E8BED77"><enum>(D)</enum><text display-inline="yes-display-inline">using an environmentally sound alternative ballast water treatment method if the Secretary determines that the performance of such treatment meets, for the relevant vessel or group vessels, the International Maritime Organization standard for treatment in the Ballast Water Management Convention.</text></subparagraph></paragraph> 
<paragraph id="H80B2E75CFE3D41A9A21CFB8C6582EF19"><enum>(2)</enum><header>Alternative ballast water treatment technology to meet imo standards</header> 
<subparagraph id="HBEFA5515C79B48508FAB9D136E6E212"><enum>(A)</enum><header>In general</header><text>Within 1 year after the date of the enactment of this paragraph, the Secretary, in consultation with the Administrator and the Under Secretary, shall promulgate regulations to establish an approval process for alternative ballast water treatment technologies meeting the International Maritime Organization standard for treatment in the Ballast Water Management Convention.</text></subparagraph> 
<subparagraph id="H17E54760FBEC4F4DA640C2F7537295CC"><enum>(B)</enum><header>Compliance with ballast water exchange requirements</header><text>A vessel is not in compliance with paragraph (1)(D) unless the Secretary, under the approval process established under subparagraph (A) of this paragraph, approves the technology employed by the vessel for purposes of complying with paragraph (1)(D).</text></subparagraph> 
<subparagraph id="H747ECFF1F90B4F0E00A61C004C87BBB0"><enum>(C)</enum><header>Incentives for use of alternative treatment methods</header><text>If a vessel uses an alternative ballast water treatment technology approved under this paragraph, then vessel is in compliance with subsection (g) for the 10-year period beginning on the date that the approved technology is first placed on the vessel.</text></subparagraph> 
<subparagraph id="HDAFF0A0CFEDA4F38A3BB5314BD938BCA"><enum>(D)</enum><header>Revocation of approval</header><text>The Secretary shall revoke approval for an alternative technology if—</text> 
<clause id="HFC69BAB91E254AA3B23BB58625FEB417"><enum>(i)</enum><text>it is discovered the technology does not meet the International Maritime Organization standard for treatment in the Ballast Water Management Convention; or</text> 
<subclause id="H164B2BBAF0E84288A5BACAB949004D6D" indent="up1"><enum>(ii)</enum><text>use of the technology causes harm to the environment.</text></subclause></clause> </subparagraph> 
<subparagraph id="H2A9FE098FC4E49DD81EC99FE3D3988C2"><enum>(E)</enum><header>Discretionary Revocation of Approval</header><text>The Secretary may revoke approval for an alternative technology if revocation of approval is appropriate under any circumstance.</text> </subparagraph></paragraph> 
<paragraph id="H27020AF0C4594CCC9893A6B8FD23009D"><enum>(3)</enum><header>Exchange areas</header> 
<subparagraph id="HDD6D585FD75B4EB5001EA7EB09216E51"><enum>(A)</enum><header>In general</header><text>A vessel is in compliance with paragraph (1)(A) only if—</text> 
<clause id="H7FC0D45A53044D6F99002269B6FFABC4"><enum>(i)</enum><text>in the case of a vessel en route to a United States port or place from a port or place outside the United States exclusive economic zone, the vessel conducts ballast water exchange—</text> 
<subclause id="HDBEF1CB0726B4C1985A87571EDB2CFF4"><enum>(I)</enum><text>at least 200 nautical miles from the nearest point of land in the United States; and</text></subclause> 
<subclause id="H081B28F8583A4FA78EB5995523E736A2"><enum>(II)</enum><text>in water at least 200 meters in depth;</text></subclause></clause> 
<clause id="HE1D3E4E04C37423E9800F880B7EE4787"><enum>(ii)</enum><text>in the case of a vessel originating from a port or place within the United States exclusive economic zone, or from a port within 200 nautical miles of the United States in Canada, Mexico, or other ports designated by the Secretary for purposes of this section, the vessel conducts ballast water exchange—</text> 
<subclause id="HCF8DF890650C490680D9C335F8815F8"><enum>(I)</enum><text>at least 50 nautical miles from the nearest point of land in the United States, or in an area determined by the Secretary under subparagraph (B) of this paragraph or paragraph (6); and</text></subclause> 
<subclause id="HBDF7C49278FE4BF3B45ED3D500115500"><enum>(II)</enum><text>in water at least 200 meters in depth.</text> </subclause></clause></subparagraph> 
<subparagraph id="H1E3C5DF65DFD4B4086401000989015AB"><enum>(B)</enum><header>Designation of exchange areas</header> 
<clause id="H16BCC96995F844F092DB13317607AD55"><enum>(i)</enum><header>Designation</header><text>If the Secretary, in consultation with the Administrator and the Under Secretary, determines based on oceanographic information that 50 nautical miles is an inadequate distance from the nearest point of land in the United States to prevent harm to coastal areas from organisms released in ballast water exchanges, the Secretary shall issue regulations that establish designated areas for allowable ballast water exchange. The designated areas shall be located not more than 100 nautical miles from the nearest point of land in the United States. </text></clause> 
<clause id="HC02FE078BB334752A6CC515F7D18FF7"><enum>(ii)</enum><header>Exchange deemed in compliance</header><text>Any ballast water exchange conducted in accordance with regulations issued under this subparagraph is deemed to comply with this paragraph.</text></clause></subparagraph></paragraph> 
<paragraph id="H635049169AC849438D8E227BE7D5FCFE"><enum>(4)</enum><header>Safety or stability exception</header> 
<subparagraph id="H49E06E5F47674F64A1DCB7CABEF68D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraphs (1) and (3) do not apply to the discharge of ballast water by a vessel if the master of a vessel determines that compliance with those paragraphs would threaten the safety or stability of the vessel, its crew, or its passengers because of adverse weather, equipment failure, or any other relevant condition.</text></subparagraph> 
<subparagraph id="HFFE3451FE6D24B12BB442372A3A96CC0"><enum>(B)</enum><header>Notification required</header><text display-inline="yes-display-inline">Whenever the master of a vessel is unable to comply with the requirements of paragraphs (1) and (3) because of a determination made under subparagraph (A), the master of the vessel shall—</text> 
<clause id="H50D9D3D4B475419E923E868D64AB7500"><enum>(i)</enum><text display-inline="yes-display-inline">notify the Secretary as soon as practicable thereafter but no later than 24 hours after making that determination;</text></clause> 
<clause id="H74DDF64F0D6149EB81D4961419A52812"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that the determination, the reasons for the determination, and the notice are recorded in the vessel’s ballast water record book; and</text></clause> 
<clause id="H81B932726C6240209DAE6CC159CE15C6"><enum>(iii)</enum><text display-inline="yes-display-inline">conduct one of the following—</text> 
<subclause id="H252571DFC41147B584C95D6D54D45F5C"><enum>(I)</enum><text>undertake ballast water exchange in an alternative area designated by the Secretary under paragraph (3)(B) or paragraph (6);</text></subclause> 
<subclause id="HD8057F1AA2D74485A368412936009FF0"><enum>(II)</enum><text>undertake discharge of ballast water in accordance with paragraph (7); or</text></subclause> 
<subclause id="HB41DB1AD1997429B959C9EF19CDF36F4"><enum>(III)</enum><text>act in accordance with a contingency plan included in the vessel’s aquatic invasive species plan.</text></subclause></clause> </subparagraph> 
<subparagraph indent="subparagraph" id="H243317935B854E6B88FE151FF68E212"><enum>(C)</enum><header>Review of circumstances</header><text display-inline="yes-display-inline">If the master of a vessel conducts a ballast water discharge under this paragraph, the Secretary shall review the circumstances to determine whether the discharge met the requirements of this paragraph. The review under this subparagraph shall be in addition to any other enforcement authority of the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HA289F9F0E9BA4267B850714D585BC2A5"><enum>(5)</enum><header>Discharge under waiver</header> 
<subparagraph id="H405AB0BA05904F7C965250ECA79B5DC6"><enum>(A)</enum><header>Substantial business hardship waiver</header><text>If, because of the short length of a voyage, the operator of a vessel is unable to discharge ballast water in accordance with the requirements of paragraph (3)(A)(ii) without substantial business hardship, as determined under regulations prescribed by the Secretary, the operator may request a waiver from the Secretary to discharge ballast water in accordance with paragraph (7). A request for a waiver under this subparagraph shall be submitted to the Secretary at such time and in such form and manner as the Secretary may require.</text></subparagraph> 
<subparagraph id="HCEEEF0F73263433883C561B900E3CA00"><enum>(B)</enum><header>Substantial business hardship</header><text>For purposes of subparagraph (A), the factors taken into account in determining substantial business hardship shall include whether—</text> 
<clause id="H94033768574D4444BCDCECEBB6003822"><enum>(i)</enum><text>compliance with the requirements of paragraph (3)(A)(ii) would require a sufficiently great change in routing or scheduling of service as to compromise the economic or commercial viability of the trade or business in which the vessel is operated; or</text></clause> 
<clause id="H74569871D8054D11B5A95C649B4B18D3"><enum>(ii)</enum><text>it is reasonable to expect that the trade or business or service provided will be continued only if a waiver is granted under subparagraph (A).</text></clause></subparagraph> 
<subparagraph id="HBDA82D467C024C0D9F33289EE2DD24C"><enum>(C)</enum><header>Aquatic invasive species plan</header><text display-inline="yes-display-inline">If the Secretary grants a waiver under this paragraph for a vessel, then the aquatic invasive species plan as required for the vessel under subsection (c) shall be revised to include operations to minimize the risk of introduction of aquatic invasive species.</text></subparagraph></paragraph> 
<paragraph id="H4589609B10B04EE6B9720070BE237C45"><enum>(6)</enum><header>Designation of alternative areas</header> 
<subparagraph id="HE57892E053114307B21643D95F3268D7"><enum>(A)</enum><header>Review of potential alternative areas</header><text>Within 1 year after the date of the enactment of this paragraph, the Secretary, in consultation with the Under Secretary, the Task Force, the Administrator, and a representative of any State that may be affected by discharge of ballast water in an area, shall finish a review to assist in the designation of alternative areas that would not be affected by the discharge of ballast water.</text></subparagraph> 
<subparagraph id="H2A8C68DBF1554AD3BF47C85CC45060C2"><enum>(B)</enum><header>Regulations</header><text display-inline="yes-display-inline">After completion of the review in accordance with subparagraph (A), the Secretary may issue regulations designating alternative areas where the discharge of ballast water would not affect the surrounding aquatic ecosystem.</text> </subparagraph> 
<subparagraph id="H89F10D12D76D405AA049F7DE794B34C2"><enum>(C)</enum><header>Review and revision</header><text>The Secretary shall review and revise the designation of alternative areas under this paragraph as necessary. </text></subparagraph> 
<subparagraph id="H332480B4BC6C44A895B564BF62EF9B15"><enum>(D)</enum><header>Special review and revision</header><text>Not later than 90 days after the date on which the Task Force makes a request to the Secretary for a special review and revision of the areas designated as alternative areas for ballast water discharge, the Secretary, in consultation with the Under Secretary, the Task Force, the Administrator, and a representative of any State that may be affected by the discharge of ballast water in such an area, shall conduct a review to revise the designations if necessary.</text></subparagraph></paragraph> 
<paragraph id="H4189990B8ECE4ABC915F64294FB4C39B"><enum>(7)</enum><header>Permissible discharge</header> 
<subparagraph id="HCBEBCEAD09934B4DB59F03A0A9AD1EC9"><enum>(A)</enum><header>In general</header><text>The discharge of ballast water shall be considered to be carried out in accordance with this paragraph if it is—</text> 
<clause id="HC526CB56503F47A094C063FBB47691C6"><enum>(i)</enum><text>in an alternative area designated for that purpose under paragraph (6) by the Secretary; or</text></clause> 
<clause id="H4199079C071D4C8FAC00C6512F6389DA"><enum>(ii)</enum><text>into a reception facility described in subsection (g)(2).</text></clause></subparagraph> 
<subparagraph id="H75D8A732894542EABB8C869F61B72881"><enum>(B)</enum><header>Limitation on volume</header><text>The volume of any ballast water discharged under the provisions of this paragraph may not exceed the volume necessary to ensure the safe operation of the vessel.</text></subparagraph></paragraph> 
<paragraph id="H410476CF586C454ABD1204F6F9CC0029"><enum>(8)</enum><header>Partial compliance</header> 
<subparagraph id="HDA331FA1572C4BFAB0FA399C4970ECBF"><enum>(A)</enum><header>In general</header><text>The operator of a vessel that is unable to comply fully with the requirements of paragraphs (1) and (3)—</text> 
<clause id="HB35AA4D8CBB64A04AE83E6EDC11297B2"><enum>(i)</enum><text>shall nonetheless conduct ballast water exchange to the maximum extent feasible in compliance with those paragraphs;</text></clause> 
<clause id="H965D2DF0256447839075BE09A9DAB8D2"><enum>(ii)</enum><text>may conduct a partial ballast water exchange under this paragraph only to the extent that the ballast water in an individual ballast tank can be completely exchanged in accordance with paragraph (1);</text></clause> 
<clause id="H1D736E33567847E98FD1C820AB6E4875"><enum>(iii)</enum><text>shall notify the Secretary as soon as practicable thereafter, but no later than 24 hours after making the determination to conduct ballast water exchange under this paragraph; and</text></clause> 
<clause id="H82B32AE096074CE2B8A5641DDE6832D"><enum>(iv)</enum><text>shall ensure that the determination, the reasons for the determination, and the notice are recorded in the vessel’s ballast water record book.</text></clause></subparagraph> 
<subparagraph id="HD5DA795B2A834A5BA45EEF81A8E0D7D0"><enum>(B)</enum><header>Review of circumstances</header><text>If the master of a vessel conducts a ballast water discharge under this paragraph, the Secretary shall review the circumstances to determine whether the vessel was unable to comply fully with the requirements of paragraphs (1) and (3). The review under this subparagraph shall be in addition to any other enforcement authority of the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HA248005504424AEC9BCA8FEE08BA8D29"><enum>(9)</enum><header>Special requirements for NOBOBs</header> 
<subparagraph id="HE8656EEF1DE740C6873D62838F479168"><enum>(A)</enum><header>Saltwater flushing requirement</header><text>Beginning 180 days after the date of the enactment of this paragraph, any vessel operating en route to the United States from outside the exclusive economic zone of the United States that is unable to conduct ballast water exchange as otherwise required under this subsection, other than as provided in paragraph (4) and paragraph (5), shall conduct saltwater flushing of its empty ballast tanks in an area located at least 200 nautical miles from any point on land in the United States before entering any port in the United States.</text> </subparagraph> 
<subparagraph id="H6B0F7AEB79DB41D4B8AF8B0499620194"><enum>(B)</enum><header>Saltwater flushing defined</header><text>For the purposes of this paragraph, the term ‘saltwater flushing’ means a process that includes—</text> 
<clause id="HEBC6A560A42647D9A67CC3C45F8341F8"><enum>(i)</enum><text>the addition to each empty ballast tank of as much ocean water that is safe for the vessel and crew;</text></clause> 
<clause id="H231A17CF79374E549C3C8B751415117E"><enum>(ii)</enum><text>the mixing of the flush water with residual water and sediment through the motion of the vessel; and</text></clause> 
<clause id="H38210154C8374C6FB95F634D356B506E"><enum>(iii)</enum><text>the discharge of the mixed water,</text> </clause><continuation-text continuation-text-level="subparagraph">in areas greater than 200 nautical miles from the nearest point of land in the United States such that the resultant residual water remaining in the tank has a salinity greater than 30 parts per thousand.</continuation-text></subparagraph></paragraph> 
<paragraph id="HB71F04580661480C9559CEC86C1539FB"><enum>(10)</enum><header>Designation of enclosed aquatic ecosystems</header> 
<subparagraph id="H23AA2115055748889C5EBE13C883128E"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with the Under Secretary, the Administrator, the Task Force, and representatives from affected States designated by the Task Force, shall designate, in addition to the Great Lakes, enclosed aquatic ecosystems in which the potential for movement of organisms by natural and anthropogenic means is not significantly altered by the movement of vessels, including ballast water discharge, to which this section apply. </text></subparagraph> 
<subparagraph id="H32D262FE9DD14EDB9C9EF6973675A0EB"><enum>(B)</enum><header>Designation of represented States</header><text>The Task Force shall designate the States that may appoint representatives to assist in designating enclosed aquatic ecosystems under subparagraph (A) and the number of representatives that may be appointed for each State. The governor of each designated State shall appoint the representatives for that State.</text></subparagraph></paragraph> 
<paragraph id="H73CFBF47C9814AFDA93CE8CA9B9F009C"><enum>(11)</enum><header>Vessels operating on the Great Lakes</header><text display-inline="yes-display-inline">No vessel shall be operated in the Great Lakes if the master of the vessel has not certified to the Secretary or the Secretary's designee by not later than the departure of that vessel from the first lock in the St. Lawrence Seaway that the vessel has complied with the requirements under this title, including the regulations issued under this title.</text></paragraph> 
<paragraph id="HB3E429377CC942418584003255377B51"><enum>(12)</enum><header>Certain geographically limited routes</header><text display-inline="yes-display-inline">Notwithstanding paragraph (3)(B) of this subsection, the operator of a vessel is not required to comply with the requirements of paragraph (1) if—</text> 
<subparagraph id="HD0F59305FF704F2EA2AABBBF9FF1D97D"><enum>(A)</enum><text>the vessel operates exclusively—</text> 
<clause id="HB6E394B3AC774D39BA0273C001C82DA9"><enum>(i)</enum><text>within Lake Superior, Lake Michigan, Lake Huron, and Lake Erie and the connecting channels;</text></clause> 
<clause id="HE89BD69382D241529CACF2850040CCAD"><enum>(ii)</enum><text>between or among the main group of the Hawaiian Islands; or</text></clause> 
<clause id="H88FE77E6B8C94AA0817D46A928067126"><enum>(iii)</enum><text display-inline="yes-display-inline">within any enclosed aquatic ecosystem designated under paragraph (10); and</text></clause></subparagraph> 
<subparagraph id="H348146676A264D16ACBF711B2FC0A9F5"><enum>(B)</enum><text display-inline="yes-display-inline">the vessel carries only ballast water and sediment from the area identified under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H84C75BAA5D7246B20064B4B415A7771E"><enum>(13)</enum><header>Marine sanctuaries and other prohibited areas</header><text>A vessel may not conduct ballast water exchange or discharge unexchanged ballast water under this subsection within a marine sanctuary designated under title III of the National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431 et seq.</external-xref>) or in any other waters designated by the Secretary after consultation with the Under Secretary and the Administrator.</text></paragraph> 
<paragraph id="H603A98435D264CDC8653C3DB4F901753"><enum>(14)</enum><header>Study and requirement of alternatives for the Great Lakes</header> 
<subparagraph id="H1BA9B4F0CE264D19AC2052E69098CF42"><enum>(A)</enum><header>Study</header><text>Not later than January 1, 2011, the Secretary, in consultation with the Administer and the Under Secretary, shall conduct a study to evaluate alternatives to on-board treatment, including but not limited to cargo transfer and shore-based treatment, for vessels entering the Great Lakes from beyond the exclusive economic zone. </text></subparagraph> 
<subparagraph id="H407C2C70E56149829B8EC77955083531"><enum>(B)</enum><header>Regulations</header><text>The Secretary may promulgate regulations based on the results of the study to require alternatives that would assist in preventing the introduction of aquatic invasive species from vessels.</text></subparagraph></paragraph> 
<paragraph id="HBDDA34C27FB241D99D40AA9EB7193DC2"><enum>(15)</enum><header>Public notice of actions</header> 
<subparagraph id="HC997B0C9AB304DFD9300394C42001CBA"><enum>(A)</enum><header>Notice requirement</header><text>The Secretary shall provide public notice of each of the following:</text> 
<clause id="HE4DF3697297946C0A6F57000C0D25F4B"><enum>(i)</enum><text>Exemptions applied under paragraph (4), including the nature and circumstances surrounding the application of the exemption. </text></clause> 
<clause id="H7DF30B98751240C797942FAB2D14A0A"><enum>(ii)</enum><text>Waivers granted under paragraph (5), including the nature and circumstances surrounding the waiver. </text></clause> 
<clause id="H1F3EF285498E4F2F9DCEDE00A8AAB7C1"><enum>(iii)</enum><text>Instances of partial compliance under paragraph (8), including the nature and circumstances surrounding the instance of partial compliance. </text></clause> 
<clause id="H3983EED3AB914E939D3E49203CDF9D00"><enum>(iv)</enum><text>Determinations made by the Secretary after reviews conducted pursuant to paragraphs (4) and (8). </text></clause></subparagraph> 
<subparagraph id="H36C2730CF83D4DA09815AC64271631D"><enum>(B)</enum><header>Manner of notice</header><text>The Secretary shall publish notice under this paragraph—</text> 
<clause id="HE0480119AEBF4812BD3C559B86CB4650"><enum>(i)</enum><text>in the Federal Register and on relevant web sites maintained by the Secretary;</text></clause> 
<clause id="H44AE1DB2C1C44EE39FC856ED8113F3AB"><enum>(ii)</enum><text>once every 2 weeks; and </text></clause> 
<clause id="HF21A655BE4CD4367BA5191192DF7DCE"><enum>(iii)</enum><text>with respect to all of the matters referred to in subparagraph (A) for the 2-week period preceding publication of the notice.</text></clause></subparagraph> 
<subparagraph id="H2047D3A169034C31A316C23941874738"><enum>(C)</enum><header>Database of notices</header><text>The Secretary shall make all notices published under subparagraph (B)(i) available, at all times, to the public on relevant World Wide Web sites maintained by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HCF633DFCA2684D32B85E68A7F560275E"><enum>(16)</enum><header>Regulations deadline</header><text>The Secretary shall issue a final rule for regulations required by this subsection within 1 year after the date of enactment of the Prevention of Aquatic Invasive Species Act of 2006.</text></paragraph></subsection> 
<subsection id="H2CEC12840B2D4F75B94ECB05B7273D35"><enum>(g)</enum><header>Ballast water treatment requirements</header> 
<paragraph id="H477222136B2849C1A583E971EB1CFB7B"><enum>(1)</enum><header>Performance standards</header><text>A vessel to which this section applies shall conduct ballast water treatment in accordance with the requirements of this subsection before discharging ballast water so that the ballast water discharged will contain—</text> 
<subparagraph id="HE7CC65C675F74088A6BB0E7F13900C5"><enum>(A)</enum><text>less than 1 living organism per 10 cubic meters that is 50 or more micrometers in minimum dimension;</text></subparagraph> 
<subparagraph id="H869763AA8F7A4515A87E9EC0FD47B776"><enum>(B)</enum><text>less than 1 living organism per 10 milliliters that is less than 50 micrometers in minimum dimension and more than 10 micrometers in minimum dimension;</text></subparagraph> 
<subparagraph id="H9EBBFD93B8F742E69C40982E4D33879B"><enum>(C)</enum><text>concentrations of indicator microbes that are less than—</text> 
<clause id="H667057BBA315405C9DDE0112DD581717"><enum>(i)</enum><text>1 colony-forming unit of toxicogenic Vibrio cholera (serotypes O1 and O139) per 100 milliliters, or less than 1 colony-forming unit of that microbe per gram of wet weight of zoological samples;</text></clause> 
<clause id="H4C76839623884975ABBD08DE3FED18A4"><enum>(ii)</enum><text>126 colony-forming units of escherichia coli per 100 milliliters; and</text></clause> 
<clause id="HB1A171F7C5114B07927FA35B3E189759"><enum>(iii)</enum><text>33 colony-forming units of intestinal enterococci per 100 milliliters; and</text></clause></subparagraph> 
<subparagraph id="HF5C8CE63BB0C4DFDA850987851670082"><enum>(D)</enum><text>concentrations of such additional indicator microbes as may be specified in regulations promulgated by the Secretary, after consultation with the Administrator, that are less than the amount specified in those regulations.</text></subparagraph></paragraph> 
<paragraph id="H4289EF0137B64D3C94903B97319119A8"><enum>(2)</enum><header>Reception facility exception</header> 
<subparagraph id="HCC8F9C9E335F44EA83E2A2006998E73"><enum>(A)</enum><header>In general</header><text>Paragraph (1) does not apply to a vessel that discharges ballast water into—</text> 
<clause id="H5C480ACB4A4E47B1ADA2DB9F383D854C"><enum>(i)</enum><text display-inline="yes-display-inline">a land-based facility for the reception of ballast water that meets standards prescribed by the Administrator; or</text></clause> 
<clause id="H2CF4844F19784C85AB86ED15D8612936"><enum>(ii)</enum><text display-inline="yes-display-inline">a water-based facility for the reception of ballast water that meets standards prescribed by the Secretary.</text></clause> </subparagraph> 
<subparagraph id="H270D27A8ACE648D08018B794D6AF587E"><enum>(B)</enum><header>Promulgation of standards</header><text display-inline="yes-display-inline">Within 1 year after the date of enactment of the paragraph—</text> 
<clause id="HFF4CD351A2FC44D4B79739AC71773D17"><enum>(i)</enum><text>the Administrator shall promulgate standards for—</text> 
<subclause id="H55F360DB1393404A91BE1BB773D17F6C"><enum>(I)</enum><text>the reception of ballast water in land-based facilities; and</text></subclause> 
<subclause id="H36A701144DC3465D00E6151FFC1A23B"><enum>(II)</enum><text>the disposal or treatment of ballast water discharged into a land-based or water-based reception facility in a way that does not impair or damage the environment, human health, property, or resources; and</text></subclause></clause> 
<clause id="H008E57D65CCF4CE39EE46FF8E9091F27"><enum>(ii)</enum><text>the Secretary shall promulgate standards for the reception of ballast water in water-based facilities.</text> </clause> </subparagraph></paragraph> 
<paragraph id="H745076E3BC4A46CE89211E6FE641B6DB"><enum>(3)</enum><header>Implementation schedule</header><text>Paragraph (1) applies to vessels in accordance with the following schedule:</text> 
<subparagraph id="HB2D520462C7E4274A244DDAFE0C23773"><enum>(A)</enum><header>First phase</header><text>Beginning January 1, 2009, for vessels constructed on or after that date with a ballast water capacity of less than 5,000 cubic meters.</text></subparagraph> 
<subparagraph id="HA7937ED73E514630999882DAC298E7B8"><enum>(B)</enum><header>Second phase</header><text>Beginning January 1, 2012, for vessels constructed on or after that date with a ballast water capacity of 5,000 cubic meters or more.</text></subparagraph> 
<subparagraph id="HE5D343F4217D4A9D8262E100E92B8E57"><enum>(C)</enum><header>Third phase</header><text>Beginning January 1, 2014, for vessels constructed before January 1, 2009, with a ballast water capacity of 1,500 cubic meters or more but not more than 5,000 cubic meters.</text></subparagraph> 
<subparagraph id="HD34A97C517E04884A32931EB2CE2582B"><enum>(D)</enum><header>Fourth phase</header><text>Beginning January 1, 2016, for vessels constructed—</text> 
<clause id="H2A0B590E044C4B46A98445D0EBD97E81"><enum>(i)</enum><text>before January 1, 2009, with a ballast water capacity of less than 1,500 cubic meters or 5,000 cubic meters or more; or</text></clause> 
<clause id="HAA2FC37087CE450284763D71FC2805D4"><enum>(ii)</enum><text>on or after January 1, 2009, and before January 1, 2012, with a ballast water capacity of 5,000 cubic meters or more.</text></clause></subparagraph></paragraph> 
<paragraph id="HF75EFE1A170B499194A2494F2BFCE1BF"><enum>(4)</enum><header>Treatment system approval required</header><text>The operator of a vessel may not use a ballast water treatment system to comply with the requirements of this subsection unless the system is approved by the Secretary under paragraph (8) or (10).</text></paragraph> 
<paragraph id="HF268566DA0CD4A480009625163DCC295"><enum>(5)</enum><header>Feasibility review</header> 
<subparagraph id="HA8C3AF7D30EF40518208FA200C89D4F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not less than 2 years before the date on which paragraph (1) applies to vessels under each subparagraph of paragraph (3), or as that date may be extended under this paragraph, the Secretary, in consultation with the Administrator, the Under Secretary, and the Task Force, shall complete a review to determine whether appropriate technologies are available to achieve the standards set forth in paragraph (1) for the vessels to which they apply under the schedule set forth in paragraph (3). In reviewing the technologies the Secretary shall consider—</text> 
<clause id="H67BAA449F0684500A17C5D36A3F40023"><enum>(i)</enum><text>the effectiveness of a technology in achieving the standards;</text></clause> 
<clause id="H834F593BAEFA45C3AE4B532F5048AB63"><enum>(ii)</enum><text>feasibility in terms of compatibility with vessel design and operations;</text></clause> 
<clause id="H1527F25B13D64E978F362929F9563141"><enum>(iii)</enum><text>safety considerations;</text></clause> 
<clause id="HE462BB4A6872403692BBA2FB92D21161"><enum>(iv)</enum><text>whether a technology is determined to have an adverse impact on the environment under the criteria issued under paragraph (11); and</text></clause> 
<clause id="H98F8C05136914B189E46C04722D1A169"><enum>(v)</enum><text>cost effectiveness.</text></clause></subparagraph> 
<subparagraph id="H3BD13E6BADEF43BAB5662E652449003C"><enum>(B)</enum><header>Delay in scheduled application</header><text display-inline="yes-display-inline">If the Secretary determines, on the basis of the review conducted under subparagraph (A), that compliance with the standards set forth in paragraph (1) in accordance with the schedule set forth in any subparagraph of paragraph (3) is not feasible for any class of vessels, the Secretary, in consultation with the Administrator, the Under Secretary, and the Task Force, shall—</text> 
<clause id="H7735092C68DC42B5BB37B014982C5780"><enum>(i)</enum><text>extend the date on which that subparagraph first applies to vessels for a period of not more than 24 months; and</text></clause> 
<clause id="H9A0DFBB6FF1348A595D1AF609EEAC5BC"><enum>(ii)</enum><text>recommend action to ensure that compliance with the extended date schedule for that subparagraph is achieved.</text></clause></subparagraph> 
<subparagraph id="H75E62C7CEC1C4B46B4A011E3C78600FA"><enum>(C)</enum><header>Higher standards; earlier implementation</header> 
<clause id="H80E9DF9098B1403FA9DE00B02CA26DA"><enum>(i)</enum><header>Standards</header><text display-inline="yes-display-inline">If the Secretary determines that ballast water treatment technology exists that exceeds the performance standards required under this subsection, the Secretary, in consultation with the Administrator, the Under Secretary, and the Task Force, shall, for any class of vessels, revise the performance standards to incorporate the higher performance standards.</text></clause> 
<clause id="H1229CDE47D4B40349B2F7D77848BA2DC"><enum>(ii)</enum><header>Implementation</header><text display-inline="yes-display-inline">If the Secretary determines that technology that achieves the applicable performance standards required under this subsection can be implemented earlier than required by this subsection, the Secretary, in consultation with the Administrator, the Under Secretary, and the Task Force, shall, for any class of vessels, accelerate the implementation schedule under paragraph (3). If the Secretary accelerates the implementation schedule pursuant to this clause, the Secretary shall provide notice at least 24 months before such accelerated implementation goes into effect.</text></clause> 
<clause id="HCAACA225912F4DDB8BF4873F25040074"><enum>(iii)</enum><header>Determinations not mutually exclusive</header><text>The Secretary shall take action under both clause (i) and clause (ii) if the Secretary makes determinations under both clauses.</text></clause></subparagraph> 
<subparagraph id="H826059B688BE496EBF1537AFD9B983C"><enum>(D)</enum><header>Interim standards</header><text display-inline="yes-display-inline">If the Secretary determines that appropriate technologies are not available to meet the standards set forth in paragraph (1), then the International Maritime Organization standard for treatment in the Ballast Water Management Convention shall apply instead of the standards set forth in paragraph (1), in accordance with the implementation schedule established under paragraph (3), until the standards set forth in paragraph (1) take effect pursuant to subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H9B89469069A04A37A4064F57A899B67D"><enum>(6)</enum><header>Review of ballast water treatment standards</header><text display-inline="yes-display-inline">At the end of the 3-year period beginning on the date of the enactment of this paragraph and every 3 years thereafter, the Secretary, in consultation with the Administrator and based on recommendations by the Task Force and information collected and analyzed under this title, and in accordance with criteria developed by the Task Force under paragraph (15), shall—</text> 
<subparagraph id="H3243D36D0C6243A69D41446D7E2398B7"><enum>(A)</enum><text>assess the compliance by vessels with regulations promulgated under this section;</text></subparagraph> 
<subparagraph id="HD93F1F6F9B324511B20262F55DB016AA"><enum>(B)</enum><text>assess the effectiveness of regulations promulgated under this section in reducing the introduction and spread of aquatic invasive species by vessels;</text></subparagraph> 
<subparagraph id="H3A6674079B414108874B6787A643A1C1"><enum>(C)</enum><text>assess the approval process under paragraph (8); and</text></subparagraph> 
<subparagraph id="H569411A112E54E82982F653060015293"><enum>(D)</enum><text>as necessary, revise regulations promulgated under this section and promulgate new regulations.</text></subparagraph></paragraph> 
<paragraph id="H25C370D5DFE24582BEAF619B18D3DA44"><enum>(7)</enum><header>Special review and revision</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Task Force makes a request to the Secretary for a special review and revision of the regulations promulgated under this section, the Secretary, in consultation with the Administrator, shall conduct a special review in accordance with paragraph (6), including the revision of regulations or the promulgation of new regulations as necessary.</text></paragraph> 
<paragraph id="H55B9173BA9E44AE497E5459ACE0B358"><enum>(8)</enum><header>Approval of ballast water treatment systems</header> 
<subparagraph id="HBB9A434BD0B64191A9B66DED16A800E2"><enum>(A)</enum><header>Regulations</header><text>The Secretary, in consultation with the Administrator, the Under Secretary, and the Task Force and by not later than 1 year after the date of the enactment of this paragraph, shall issue regulations establishing an approval process for ballast water treatment systems. The regulations shall include standards for the certification of treatment or practices and an ongoing enforcement of the use of treatments and practices. </text></subparagraph> 
<subparagraph id="H2955E34982E3477A96EBE8F9938405B"><enum>(B)</enum><header>Qualified type-approval process</header><text>The approval of ballast water treatment systems shall be based on a qualified type-approval process that is capable of estimating the extent to which treated ballast water discharge is to comply with the standards of paragraph (1). </text></subparagraph> 
<subparagraph id="HCC39343EACD846CFAA1DC1168E4FF6CA"><enum>(C)</enum><header>Consideration of restrictions</header><text>The approval of ballast water treatment systems shall take into account restrictions relating to—</text> 
<clause id="HB9029B7E48C343BBB3E3143302E50067"><enum>(i)</enum><text>biological, chemical, or physical conditions of water taken into ballast tanks; and </text></clause> 
<clause id="H94AC1CCE2E1340858B3CBDAE194B2DF7"><enum>(ii)</enum><text>conditions encountered during a ship’s voyage. </text></clause></subparagraph> 
<subparagraph id="H0B9EA797A83A47E78CDDD0E810FD78B8"><enum>(D)</enum><header>Environmental soundness and safety</header><text>The approval process for ballast water treatment systems shall be capable of determining the extent to which a ballast water treatment method is—</text> 
<clause id="H7597B76D461448AD9C9222B3F27DD1C"><enum>(i)</enum><text>environmentally sound based on criteria promulgated by the Administrator pursuant to paragraph (11); and </text></clause> 
<clause id="H44EF24C0783A4E4E96C33D1E1C083079"><enum>(ii)</enum><text>safe for vessel and crew. </text></clause></subparagraph> 
<subparagraph id="HB089029858C6433D9266CE8FFC2DC66"><enum>(E)</enum><header>Estimation of useful life</header><text>The approval process for ballast water treatment systems may be used to estimate the useful life of the ballast water treatment system, as determined on the basis of voyage patterns and normal use conditions.</text></subparagraph> 
<subparagraph id="H6D0BB644CCD540B5837CA3872293007C"><enum>(F)</enum><header>Ship-boarding testing</header><text>The approval process of ballast water treatment systems shall include a ship-boarding testing component, and may include a shore-based testing component. </text></subparagraph> 
<subparagraph id="H0E8D3EDC20854B95B94E2F8898B33400"><enum>(G)</enum><header>Monitoring</header><text>The approval process for ballast water treatment systems shall provide for appropriate monitoring. </text></subparagraph> 
<subparagraph id="H35398C4D803F492F84CA9EFB81581358"><enum>(H)</enum><header>Application form and information</header><text>The Secretary shall approve an application for certification of ballast water treatment system only if the application is in such form and contains such information as the Secretary requires.</text></subparagraph></paragraph> 
<paragraph id="H30BA87F5C36C48AC8B3F8CBF87CDA51C"><enum>(9)</enum><header>Monitoring and effectiveness; revocation of certification</header><text display-inline="yes-display-inline">Based on the results of appropriate monitoring of ballast water treatment systems, the Secretary shall revoke the certification of a ballast water treatment system if it is found that ballast water treated with the system does not meet the standards of paragraph (1) or paragraph (11).</text></paragraph> 
<paragraph id="HA969E3A14FDF4FEF94E86FE8E0E1F57C"><enum>(10)</enum><header>Approval of experimental ballast water treatment technologies</header> 
<subparagraph id="HF34F32862E5F4E0CA766DE2D6E6BB2E"><enum>(A)</enum><header>In general</header><text>If a vessel participates in a program approved by the Secretary to test and evaluate promising ballast water treatment technologies that are likely to result in treatment technologies achieving a standard that is the same as or more stringent than the standard that applies under paragraph (1) before the first date on which paragraph (1) applies to that vessel, the Secretary shall certify a vessel to allow the use of that technology and such vessel shall be deemed to be in compliance with the requirements of paragraph (1) during the period of certification. </text></subparagraph> 
<subparagraph id="H001723B4A80B434A83213520E752A273"><enum>(B)</enum><header>Guidelines by Secretary</header><text>The Secretary, in consultation with the Administrator, the Under Secretary, and the Task Force, within 1 year after the date of the enactment of this paragraph shall issue guidelines for the approval of experimental ballast water treatment technologies that are likely to meet the standards of paragraph (1). </text></subparagraph> 
<subparagraph id="HCA48E9FC50204120A82B65812848A955"><enum>(C)</enum><header>Guidelines by Administrator</header><text>The Administrator, in consultation with the Secretary, the Under Secretary, and the Task Force, within 1 year after the date of the enactment of this paragraph shall issue guidelines for the approval of ballast water treatment technologies under this paragraph pursuant to the environmental soundness criteria under paragraph (11). </text></subparagraph> 
<subparagraph id="H42EE066C473C48F5B4DED80A9B05CE5"><enum>(D)</enum><header>Criteria by Administrator</header><text>The Administrator shall include in criteria promulgated under paragraph (11) specific criteria to grant environmental soundness exceptions such that, in an emergency situation, to achieve reductions in significant and acute risk of transfers of invasive species by vessels, the Secretary and the Administrator may jointly determine to make an exception to criteria of paragraph (11). To be eligible for an exception, approval for an experimental technology under this paragraph shall be subject to all other provisions of this paragraph.</text></subparagraph> 
<subparagraph id="H99F2A0B390E744818B51FA59C9646F21"><enum>(E)</enum><header>Certification by Administrator</header><text>Not later than 90 days after receiving an application, the Administrator shall review the application for compliance with environmental soundness criteria under paragraph (11) and certify the ballast water treatment system covered by the application as meeting environmental requirements if it indeed meets those criteria. The Administrator’s determination should be based on independent and peer-reviewed information. </text></subparagraph> 
<subparagraph id="HA520CB56E82C4B679561006124BF2632"><enum>(F)</enum><header>Approval or disapproval by Secretary</header><text>Not later than 180 days after receiving an application, the Secretary shall—</text> 
<clause id="H397222BA624B4D81A6D5F1C0A57DC4D0"><enum>(i)</enum><text>determine if the ballast water treatment system covered by the application meets the requirements of this subsection;</text></clause> 
<clause id="HA7AC33BABBE142F2A3B88600E8C2971"><enum>(ii)</enum><text>approve or disapprove the application; and </text></clause> 
<clause id="H86C7CE74F69E46D2992EE0F19DB3B147"><enum>(iii)</enum><text>provide the applicant written notice of the approval or disapproval. </text></clause></subparagraph> 
<subparagraph id="HD037DF2988F845889D50E65B42E7BA7"><enum>(G)</enum><header>Appeal process</header><text>As part of the guidelines issued under this paragraph, the Secretary shall establish a process for applicants receiving a notice of disapproval to appeal the Secretary’s decision. </text></subparagraph> 
<subparagraph id="H35C22D14EF894F008CDB055C5802367"><enum>(H)</enum><header>Certification by Administrator required</header><text>The Secretary shall approve and certify a ballast water treatment system only if the Administrator certifies the system as meeting the criteria of paragraph (11).</text></subparagraph> 
<subparagraph id="H3D3F1A44C43243AFB9A9B889A001BEC9"><enum>(I)</enum><header>Conditions of use of approved systems</header><text>As determined by the Secretary in consultation with the Administrator and the Under Secretary, approved ballast water treatment systems shall be used only for voyage patterns, durations, or any other characteristic that may affect the effectiveness or environmental soundness of the ballast water treatment system covered by the application. </text></subparagraph> 
<subparagraph id="H446093B648DF4C3C8B9E92A14F00ABCF"><enum>(J)</enum><header>Determination of vessels to use approved system</header><text>Approved ballast water treatment systems may be applicable to a specific vessel or group of vessels as determined by the Secretary. </text></subparagraph> 
<subparagraph id="HC264525960BE493CB9CD22ABE09174FD"><enum>(K)</enum><header>Variety and type of participating vessels</header><text>The Secretary shall seek to ensure that a wide variety of vessel types and voyages are included in the program, but may not grant a delay under this paragraph to more than 5 percent of the vessels to which this subsection applies.</text></subparagraph> 
<subparagraph id="H685BE05FD8724C218600515698006479"><enum>(L)</enum><header>Exemptions</header><text display-inline="yes-display-inline">A vessel operating en route to the United States from outside the exclusive economic zone of the United States that declares to have no ballast on board or is claimed to be carrying only umpumpable quantities of ballast are exempt from the requirements of subparagraph (K).</text></subparagraph> 
<subparagraph id="HF370BA6F94EB476D98D322CF5E407D34"><enum>(M)</enum><header>Term of certification</header><text>The certification of an approved ballast water treatment system shall be valid only for the lesser of the following: </text> 
<clause id="HE8087917E3D543E8BC991082B5930000"><enum>(i)</enum><text>The expected life of the ballast water treatment system. </text></clause> 
<clause id="H61CA2E20453049869926E4ABFF900190"><enum>(ii)</enum><text>10 years. </text></clause> 
<clause id="HB03B2DA0B7D74166B3AD5C74EBFA578"><enum>(iii)</enum><text>Until such time as the Secretary or Administrator (as appropriate) determines that, based on available information, the ballast water treatment system fails to meet the requirements of this subsection. </text></clause></subparagraph> 
<subparagraph id="H1E66C00D3F324C6000458461BE4BC69B"><enum>(N)</enum><header>Termination of certification</header><text>The Secretary may terminate the certification of a vessel under this subsection if participation of the vessel in the program is terminated without the consent of the Secretary. </text></subparagraph> 
<subparagraph id="H1E5A0859A6BC4A648B797F867C9398AE"><enum>(O)</enum><header>Sampling and reporting information</header><text>Upon receiving approval for a treatment under this paragraph, the owner or operator of a vessel shall collect and report such information requested by the Secretary regarding the operational and biological effectiveness of the treatment through sampling of the intake and discharge ballast. </text></subparagraph> 
<subparagraph id="HD3338BFFB9514A7088DA5C737FCDC81E"><enum>(P)</enum><header>Annual evaluation; revocation of certification</header><text>The Secretary, in consultation with the Administrator and the Under Secretary, shall establish an annual evaluation process to determine if approved experimental technology is effective or causing harm to the environment. If the technology is not effective or causes harm to the environment, then the Secretary shall revoke the certification.</text></subparagraph> 
<subparagraph id="H9479C708523B4062A8ACF378FF2E0006"><enum>(Q)</enum><header>Fees</header><text>The Secretary, with concurrence of the Administrator, may establish fees for processing the application.</text></subparagraph></paragraph> 
<paragraph id="HC6B320A3E9C24588A24F7EEC02BF2000"><enum>(11)</enum><header>Environmental soundness criteria for ballast water treatment systems</header> 
<subparagraph id="HE998CBA8C0A44493942E00B4FB006E7E"><enum>(A)</enum><header>In general</header><text>The Administrator shall include in criteria promulgated under section 1202(k)(1) specific criteria—</text> 
<clause id="H7D47DBD56CC747088CE7D1016D17FEA"><enum>(i)</enum><text>to ensure environmental soundness of ballast water treatment systems; and</text></clause> 
<clause id="H7E52FE16A13B4B1393417D7657ABD0BA"><enum>(ii)</enum><text>to grant environmental soundness exceptions under subparagraph (B).</text></clause></subparagraph> 
<subparagraph id="HC336B701B20C4AB200B78DEF5E2BF651"><enum>(B)</enum><header>Exceptions</header><text>In reviewing applications under paragraph (10) in an emergency situation to achieve reductions in significant and acute risk of transfers of invasive species by vessels, the Secretary and the Administrator may jointly determine to make an exception to criteria described in subparagraph (A)(i).</text> </subparagraph></paragraph> 
<paragraph id="HEC6334500D574DFC8F757D3C2F4E44BF"><enum>(12)</enum><header>Incentives for use of ballast water treatment systems</header><text display-inline="yes-display-inline">The Secretary, the Secretary of Transportation, and the Administrator shall assist owners or operators of vessels that seek to obtain experimental approval for installation of ballast water treatment systems, including through providing guidance on—</text> 
<subparagraph id="H52AD1C6E10E74BEDB8D8193E5E0788AB"><enum>(A)</enum><text>a sampling protocol and test program for cost effective treatment evaluation;</text></subparagraph> 
<subparagraph id="H2FE0F0DD063F433F90D37984F23BED06"><enum>(B)</enum><text>sources of sampling equipment and field biological expertise; and </text></subparagraph> 
<subparagraph id="H3E6E0BA8743D4FE8AB3BEC092C408D40"><enum>(C)</enum><text>examples of shipboard evaluation studies.</text></subparagraph></paragraph> 
<paragraph id="H9AFC0BFD6C754E018C1E83E2E2EEA90"><enum>(13)</enum><header>Selection of technologies and practices</header><text display-inline="yes-display-inline">In selecting technologies and practices for shipboard demonstration under section 1104(b), the Secretary of the Interior and the Secretary of Commerce shall give priority consideration to technologies and practices that have received or are in the process of receiving certification under paragraph (10).</text></paragraph> 
<paragraph id="HABDF86FDDF534DE2B2A3DD77F3D97C8E"><enum>(14)</enum><header>Annual summaries on performance of ballast water treatment technologies</header> 
<subparagraph id="H088D0EDA8144472EBFF2C9BB3D882EB6"><enum>(A)</enum><header>Annual summaries</header><text>The Secretary shall annually summarize, and make available to interested persons, all available information on the performance of technologies proposed for ballast water treatment to facilitate the application process for experimental approval for ballast water treatment. </text></subparagraph> 
<subparagraph id="HD146BEC080254CC28058172D73F92365"><enum>(B)</enum><header>Publication of other information</header><text>The Administrator, in consultation with the Invasive Species Council, shall publish not later than 1 year after the date of the enactment of this paragraph and update annually—</text> 
<clause id="HE54A72943B2F4FF4B097E68CE3973B1F"><enum>(i)</enum><text>a list of environmentally sound treatment methods that meet the requirements of this section;</text></clause> 
<clause id="H7C6DB12354984D1683189CC42FAA7032"><enum>(ii)</enum><text>accompanying research that supports the environmental soundness of each approved treatment method; and </text></clause> 
<clause id="H1522FCB583794CA989DBF6FFFF2FADF9"><enum>(iii)</enum><text>explicit guidelines under which each treatment method can be used in an environmentally sound manner. </text></clause></subparagraph> 
<subparagraph id="H0F9F964466F8475CA6A988A1E03B4722"><enum>(C)</enum><header>Reports</header><text>The Invasive Species Council and the Task Force shall include the published information in the reports submitted under section 1201(f)(2)(B).</text></subparagraph></paragraph> 
<paragraph id="H464462AB4F8944F7969000FD59F4722C"><enum>(15)</enum><header>Criteria for adequacy and effectiveness</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph and every 3 years thereafter, the Task Force shall submit to the Secretary criteria for determining the adequacy and effectiveness of all regulations promulgated under this section.</text> </paragraph> 
<paragraph id="H7B19B3B97FA54CD3830074730046E500" commented="no"><enum>(16)</enum><header>High-risk vessels</header> 
<subparagraph id="HD4F13D0F51C24C528BC607FC0002D1BF" commented="no"><enum>(A)</enum><header>Vessel list</header><text>Within 1 year after the date of enactment of the Prevention of Aquatic Invasive Species Act of 2006, the Secretary shall initiate a list, in consultation with States, of vessels that, due to factors such as the origin of their voyages, the frequency of their voyages, the volume of ballast water they carry, the biological makeup of the ballast water, and the fact that they frequently discharge unexchanged or improperly exchanged ballast water pursuant to an exception under subsection (f), pose a relatively high risk of introducing aquatic invasive species into the waters of those States.</text></subparagraph> 
<subparagraph id="H087C5BCA82244C1395DA553938FBAD81" commented="no"><enum>(B)</enum><header>Incentive programs</header><text>The Secretary shall—</text> 
<clause id="HFC4464A264E549C2991FA9BCC183B1C1" commented="no"><enum>(i)</enum><text>give priority to vessels on the list for participation in pilot programs described in paragraph (10); and</text></clause> 
<clause id="HB2F9AF631E284F188BB7E800B7D1CA42" commented="no"><enum>(ii)</enum><text>encourage Federal and State technology development programs or other incentives (whether positive or negative) to give priority to such vessels in order to encourage the adoption of ballast water treatment technology by those vessels consistent with the requirements of this section on an expedited basis.</text></clause></subparagraph></paragraph> 
<paragraph id="H2B618226CE704B328702E2CF5715F1BE"><enum>(17)</enum><header>Qualified exemptions</header> 
<subparagraph id="H45747DAC736E42DEAACB7300E294CB00"><enum>(A)</enum><header>In general</header><text>A vessel operating entirely on the Great Lakes or in enclosed aquatic ecosystems designated under subsection (f)(10) shall be granted an exemption from the requirements of this subsection if the vessel meets requirements prescribed by the Secretary. </text></subparagraph> 
<subparagraph id="H72F608979A3A4AF79E65DE8030A800FC"><enum>(B)</enum><header>Guidelines establishing process</header><text>The Secretary, in consultation with the Administrator and the Task Force, shall issue guidelines establishing a process for certifying vessels as exempt under this paragraph. The guidelines shall ensure that ships receiving an exemption carry only ballast water and sediment from the enclosed aquatic ecosystem in which the vessel operates. </text></subparagraph> 
<subparagraph id="H9C57B40695D0452A843DFE8737387485"><enum>(C)</enum><header>Limitation on exemptions</header><text>The Secretary shall not issue an exemption under this paragraph if the exemption would increase the risk of the invasion and spread of aquatic invasive species relative to a situation where an applicable vessel complies with the requirements of this subsection. </text></subparagraph> 
<subparagraph id="H07CF7AFB12BE4D65AB8DD2D3FF2CAC72"><enum>(D)</enum><header>Review of exemptions</header> 
<clause id="H1E95ED7F0201437CA2A9D8B0E20839BD"><enum>(i)</enum><header>Required review</header><text>The Secretary shall review any exemption granted under this paragraph at least as often as every 2 years, and shall approve or revoke the exemption based on the review and the requirements of this paragraph.</text></clause> 
<clause id="H77CD4AB71D2E4DB7A6D959535BF93569"><enum>(ii)</enum><header>Discretionary review</header><text>The Secretary may review an exemption at any time. </text></clause> 
<clause id="H62F15408743041F580B0D16EA188D2B5"><enum>(iii)</enum><header>Review upon request</header><text>The Administrator or the Task Force may request a review of an exemption at any time. Upon receipt of such a request, the Secretary shall complete a review within 14 days.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HC4E33EB48B0645E0B903F128324CFEA1"><enum>(h)</enum><header>Warnings concerning ballast water uptake</header> 
<paragraph id="H118F5A3E71634E7C8CF4D003B13E008F"><enum>(1)</enum><header>In general</header><text>The Secretary shall notify vessel owners and operators of any area in waters subject to the jurisdiction of the United States in which vessels should not uptake ballast water due to known conditions.</text></paragraph> 
<paragraph id="H64905A5488ED4E8886CD04423A995E4"><enum>(2)</enum><header>Contents</header><text>The notice shall include—</text> 
<subparagraph id="HD606BFA28F534EB8AD2008CEF21CA8DB"><enum>(A)</enum><text>the coordinates of the area; and</text></subparagraph> 
<subparagraph id="H4DB96C2435FA49DCA1317F2252300011"><enum>(B)</enum><text>if possible, the location of alternative areas for the uptake of ballast water.</text></subparagraph></paragraph></subsection> 
<subsection id="HE566D81167754D1FA9561C29B8FD2C5D"><enum>(i)</enum><header>Sediment management</header> 
<paragraph id="H02FCB6E3322040F4BD180005AD566041"><enum>(1)</enum><header>In general</header><text>The operator of a vessel to which this section applies may not remove or dispose of sediment from spaces designed to carry ballast water except—</text> 
<subparagraph id="H50239F95FBDC4134A200B97E6CF4C88F"><enum>(A)</enum><text>in accordance with this subsection and the aquatic invasive species plan required under subsection (c); and</text></subparagraph> 
<subparagraph id="H3D4BFDA9B3574C8FA68BB8C13B88BC32"><enum>(B)</enum><text>more than 200 nautical miles from the nearest point of land in the United States or into a reception facility that meets the requirements of paragraph (3).</text></subparagraph></paragraph> 
<paragraph id="H2D41897287BE40FA9F149279C1BF8D9D"><enum>(2)</enum><header>Design requirements</header> 
<subparagraph id="HDCABF42B37AB4158B6CC483D54AA133E"><enum>(A)</enum><header>New vessels</header><text>After December 31, 2008, it shall be unlawful to construct a vessel in the United States to which this section applies unless that vessel is designed and constructed, in accordance with regulations prescribed under subparagraph (C), in a manner that—</text> 
<clause id="HEC46FF81C15B457580BA6B1D544C25B4"><enum>(i)</enum><text>minimizes the uptake and entrapment of sediment;</text></clause> 
<clause id="HC15C50EEC6684661B446B61130721CF"><enum>(ii)</enum><text>facilitates removal of sediment; and</text></clause> 
<clause id="H8607DB4A24CB47EB9600FA1B665BA2EC"><enum>(iii)</enum><text>provides for safe access for sediment removal and sampling.</text></clause></subparagraph> 
<subparagraph id="HF53E01E63DD94074B4C116565EEFA6D"><enum>(B)</enum><header>Existing vessels</header><text>Every vessel to which this section applies that was constructed before January 1, 2009, shall be modified before January 1, 2009, to the extent practicable, to achieve the objectives described in clauses (i), (ii), and (iii) of subparagraph (A).</text></subparagraph> 
<subparagraph id="H0BDC3DFB6AB941F9BD726E4554D35DA7"><enum>(C)</enum><header>Regulations</header><text>The Secretary shall promulgate regulations establishing design and construction standards to achieve the objectives of subparagraph (A) and providing guidance for modifications and practices under subparagraph (B). The Secretary shall incorporate the standards and guidance in the regulations governing the aquatic invasive species plan.</text></subparagraph></paragraph> 
<paragraph id="HD49804C6EE7B4EF0AEFC8E422E02DB33"><enum>(3)</enum><header>Sediment reception facilities</header> 
<subparagraph id="H32963CB719CC4D70A720E25779661B48"><enum>(A)</enum><header>Standards</header><text>The Administrator shall promulgate regulations governing facilities for the reception of vessel sediment from spaces designed to carry ballast water that provide for the disposal of such sediment in a way that does not impair or damage the environment, human health, or property or resources of the disposal area. The Administrator may not prescribe standards under this subparagraph that are less stringent than any otherwise applicable Federal, State, or local law requirements.</text></subparagraph> 
<subparagraph id="H9668730D876545FF8195E46F6E077E2E"><enum>(B)</enum><header>Designation</header><text>The Administrator shall designate facilities for the reception of vessel sediment that meet the requirements of the regulations promulgated under subparagraph (A) at ports and terminals where ballast tanks are cleaned or repaired.</text> </subparagraph></paragraph> </subsection> 
<subsection id="HE57FEEA1EE1943E09B4B2391235D3F47" indent="subsection"><enum>(j)</enum><header>Examinations and certifications</header> 
<paragraph id="H005A53D99FBC40C2B344E966A0AB52D8"><enum>(1)</enum><header>Initial examination</header> 
<subparagraph id="H03228CC7FF734C6684B98DDBB3DA430"><enum>(A)</enum><header>In general</header><text>The Secretary shall examine vessels to which this section applies to determine whether—</text> 
<clause id="H48A94A3265054109AE2B7E3953A8D00"><enum>(i)</enum><text>there is an aquatic invasive species plan for the vessel that meets the requirements of this section; and</text></clause> 
<clause id="H92D5BAA1F71142DB911BA75D2CBF93ED"><enum>(ii)</enum><text>the equipment used for ballast water and sediment management in accordance with the requirements of this section and the regulations promulgated hereunder is installed and functioning properly.</text></clause></subparagraph> 
<subparagraph id="HA73857BF79F443A888E581D5693399C1"><enum>(B)</enum><header>New vessels</header><text>For vessels constructed on or after January 1, 2009, the Secretary shall conduct the examination required by subparagraph (A) before the vessel is placed in service.</text></subparagraph> 
<subparagraph id="HC1DAC8171AEC4242A7DD585881118FD2"><enum>(C)</enum><header>Existing vessels</header><text>For vessels constructed before January 1, 2009, the Secretary shall—</text> 
<clause id="H4459621CA7C246399E1ECFA63F56F150"><enum>(i)</enum><text>conduct the examination required by subparagraph (A) before the date on which subsection (g)(1) applies to the vessel according to the schedule in subsection (g)(3); and</text></clause> 
<clause id="H56E4F09F9DB5434EA8FA808658BF9BF8"><enum>(ii)</enum><text>inspect the vessel’s ballast water record book required by subsection (d).</text></clause></subparagraph> 
<subparagraph id="H9DEA09BE5AF54643A3BF7311939F27DD"><enum>(D)</enum><header>Foreign vessels</header><text>In the case of a foreign vessel (as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(12)</external-xref> of title 46, United States Code), the Secretary shall perform the examination required by this paragraph the first time the vessel enters a United States port.</text></subparagraph></paragraph> 
<paragraph id="HCACF1B9E605C4053B5781BA449BDB072"><enum>(2)</enum><header>Subsequent examinations</header><text>The Secretary shall examine vessels no less frequently than once each year to ensure vessel compliance with the requirements of this section.</text></paragraph> 
<paragraph id="H2C601A949FB0411CAE139B17C2DD83F"><enum>(3)</enum><header>Inspection authority</header><text>The Secretary may carry out such inspections of any vessel to which this section applies at any time, including the taking of ballast water samples, to ensure the vessel’s compliance with this Act.</text></paragraph> 
<paragraph id="H5C386C0C47EC43BA9D24F0AFDB380387"><enum>(4)</enum><header>Required certificate</header><text>If, on the basis of an initial examination under paragraph (1) the Secretary finds that a vessel complies with the requirements of this section and the regulations promulgated hereunder, the Secretary shall issue a certificate under this paragraph as evidence of such compliance. The certificate shall be valid for a period of not more than 5 years, as specified by the Secretary. The certificate or a true copy shall be maintained on board the vessel.</text></paragraph> 
<paragraph id="H38B07B31E4914334B375115EB6D02D02"><enum>(5)</enum><header>Notification of violations</header><text>If the Secretary finds, on the basis of an examination under paragraph (1) or paragraph (2), sampling under paragraph (3), or any other information, that a vessel is being operated in violation of the requirements of this section and the regulations promulgated hereunder, the Secretary shall—</text> 
<subparagraph id="H7D8ED7EB17364B82809E756807134999"><enum>(A)</enum><text>notify—</text> 
<clause id="HA0DFA5EAC0C7403E881336D003AEC7B5"><enum>(i)</enum><text>the master of the vessel; and</text></clause> 
<clause id="H3A8A131B5A1348B687F9CA5303008352"><enum>(ii)</enum><text>the captain of the port at the vessel’s next port of call; and</text></clause></subparagraph> 
<subparagraph id="H8CF474E3DC1243DD8F9F5F36799BB97F"><enum>(B)</enum><text>take such other action as may be appropriate.</text></subparagraph></paragraph> 
<paragraph id="H1DB53AA5BF0C425CAC12DAB1DBB62D9D"><enum>(6)</enum><header>Compliance monitoring</header><text>The Secretary shall by regulation establish sampling procedures to monitor compliance with the requirements of this section.</text></paragraph> 
<paragraph id="H4D617A8538D74109A336D2E7F9231166"><enum>(7)</enum><header>Education and technical assistance programs</header><text>The Secretary may carry out education and technical assistance programs and other measures to promote compliance with the requirements issued under this section.</text></paragraph></subsection> 
<subsection id="H52A60B3A534D449BAFDEFF7B486BBE79"><enum>(k)</enum><header>Detention of vessels</header> 
<paragraph id="HD3E18AFE500B4FFC99741282F689697F"><enum>(1)</enum><header>In general</header><text>The Secretary, by notice to the owner, charterer, managing operator, agent, master, or other individual in charge of a vessel, may detain that vessel if the Secretary has reasonable cause to believe that—</text> 
<subparagraph id="H9D60B29B5DB848F4A22D03001C64BE54"><enum>(A)</enum><text>the vessel is a vessel to which this section applies; and</text></subparagraph> 
<subparagraph id="HBF1757055E2745069BC80319F001F63E"><enum>(B)</enum><text>the vessel does not comply with the requirements of this section or of the regulations issued hereunder or is being operated in violation of such requirements.</text></subparagraph></paragraph> 
<paragraph id="H79EE6BD1E2EA44FDA0A1036D5EBBE65F"><enum>(2)</enum><header>Clearance</header> 
<subparagraph id="HB562096B1A024255BEFEC576CC339457"><enum>(A)</enum><header>In general</header><text>A vessel detained under paragraph (1) may obtain clearance under section 4197 of the Revised Statutes (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/91">46 U.S.C. App. 91</external-xref>) only if the violation for which it was detained has been corrected.</text></subparagraph> 
<subparagraph id="H49C29F38DC924DBCB366ED58623F6881"><enum>(B)</enum><header>Withdrawal</header><text>If the Secretary finds that a vessel detained under paragraph (1) has received a clearance under section 4197 of the Revised Statutes (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/91">46 U.S.C. App. 91</external-xref>) before it was detained under paragraph (1), the Secretary shall withdraw, withhold, or revoke the clearance.</text></subparagraph></paragraph></subsection> 
<subsection id="H777D31AD26744DFBB8CD36293E0034FA"><enum>(l)</enum><header>Sanctions</header> 
<paragraph id="HF6862FF46DEA4373BBB3561D0025306E"><enum>(1)</enum><header>Civil penalties</header><text>Any person who violates a regulation promulgated under this section shall be liable for a civil penalty in an amount not to exceed $50,000. Each day of a continuing violation constitutes a separate violation. A vessel operated in violation of the regulations is liable in rem for any civil penalty assessed under this subsection for that violation.</text></paragraph> 
<paragraph id="HAB0E094679774F21865FEFFA6510058"><enum>(2)</enum><header>Criminal penalties</header><text>Any person who knowingly violates the regulations promulgated under this section is guilty of a class C felony.</text></paragraph> 
<paragraph id="H303172E360B94FB7A85CF75200BDAA6"><enum>(3)</enum><header>Revocation of clearance</header><text>Except as provided in subsection (k)(2), upon request of the Secretary, the Secretary of the Treasury shall withhold or revoke the clearance of a vessel required by section 4197 of the Revised Statutes (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/91">46 U.S.C. App. 91</external-xref>), if the owner or operator of that vessel is in violation of the regulations issued under this section.</text></paragraph> 
<paragraph id="H7C901811B0BE484D87006088CBC632A4"><enum>(4)</enum><header>Exception to sanctions</header><text>This subsection does not apply to a failure to exchange ballast water if—</text> 
<subparagraph id="H3D56B4E50B4F410DB6C181D100124C92"><enum>(A) </enum><text display-inline="yes-display-inline">the master of a vessel discharges ballast water in accordance with subsection (f)(4); and</text> </subparagraph> 
<subparagraph id="HD4AD342373DF40D0BEFC00AAB7DB06C"><enum>(B)</enum><text>the Secretary determines that the requirements of subsection (f)(4) are met.</text> </subparagraph> </paragraph></subsection> 
<subsection id="H92039DA02FB445D393BA8D5FB7586D1D"><enum>(m)</enum><header>Enforcement</header> 
<paragraph id="H02AFD3ED7754418088E6CE21EDB8C7D"><enum>(1)</enum><header>Administrative actions</header><text>If the Secretary finds, after notice and an opportunity for a hearing, that a person has violated any provision of this section or any regulation promulgated hereunder, the Secretary may assess a civil penalty for that violation.</text></paragraph> 
<paragraph id="H62820BA0930E45A10004F5C8A2814F2C"><enum>(2)</enum><header>Civil actions</header><text>At the request of the Secretary, the Attorney General may bring a civil action in an appropriate district court of the United States to enforce this section, or any regulation promulgated hereunder. Any court before which such an action is brought may award appropriate relief, including temporary or permanent injunctions and civil penalties.</text></paragraph></subsection> 
<subsection id="HC6E1E313B01A49AF008CC36244CD7B00"><enum>(n)</enum><header>Coordination with other agencies</header><text display-inline="yes-display-inline">The Secretary is encouraged to use, with consent of the head of the Federal or State agency concerned, the expertise, facilities, and personnel of appropriate Federal and State agencies and organizations that have routine contact with vessels, as determined by the Secretary.</text></subsection> 
<subsection id="H10A6A33E33434C53ABC477E3779B468"><enum>(o)</enum><header>Consultation with canada, mexico, and other foreign governments</header><text>In developing the guidelines issued and regulations promulgated under this section, the Secretary is encouraged to consult with the Government of Canada, the Government of Mexico, and any other government of a foreign country that the Secretary, after consultation with the Task Force, determines to be necessary to develop and implement an effective international program for preventing the unintentional introduction and spread of aquatic invasive species.</text></subsection> 
<subsection id="HC9933EF850214F049DD49708A6E6CD3F"><enum>(p)</enum><header>International cooperation</header><text>The Secretary, in cooperation with the Under Secretary, the Secretary of State, the Administrator, the heads of other relevant Federal agencies, the International Maritime Organization of the United Nations, and the Commission on Environmental Cooperation established pursuant to the North American Free Trade Agreement, is encouraged to enter into negotiations with the governments of foreign countries to develop and implement an effective international program for preventing the unintentional introduction and spread of aquatic invasive species, particularly by seeking bilateral and multilateral agreements with Canada (through the International Joint Commission), Mexico, and other nations in the Wider Caribbean (as defined in the Convention for the Protection and Development of the Marine Environment of the Wider Caribbean, Cartagena Convention).</text> </subsection> 
<subsection id="H61F07872E0AC42E7B0AA1B85A112E267"><enum>(q)</enum><header>Non-discrimination</header><text>The Secretary shall ensure that vessels registered outside of the United States do not receive more favorable treatment than vessels registered in the United States when the Secretary performs studies, reviews compliance, determines effectiveness, establishes requirements, or performs any other responsibilities under this Act.</text></subsection> 
<subsection id="H6E3075A3E2474B8BB5CC5E1FCB74E53E"><enum>(r)</enum><header>Support for Federal Ballast Water Demonstration Project</header><text>In addition to amounts otherwise available to the Maritime Administration, the National Oceanographic and Atmospheric Administration, and the United States Fish and Wildlife Service for the Federal Ballast Water Demonstration Project, the Secretary shall provide support for the conduct and expansion of the project, including grants for research and development of innovative technologies for the management, treatment, and disposal of ballast water and sediment, for ballast water exchange, and for other vessel vectors of aquatic invasive species such as hull-fouling. There are authorized to be appropriated to the Secretary such sums as may be necessary for each of fiscal years 2007 through 2011 to carry out this subsection.</text></subsection> 
<subsection id="H8887A47DEAC74621BAF1301958086CC8"><enum>(s)</enum><header>Consultation with Task Force</header><text>The Secretary shall consult with the Task Force in carrying out this section.</text></subsection> 
<subsection id="HAFD7331C834B47EB9F028D70E59238C"><enum>(t)</enum><header>Preemption</header> 
<paragraph id="H184912D96D174CA5AB876DD461C7EFE0"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) but notwithstanding any other provision of law, the provisions of subsections (f) and (g) supersede any provision of State or local law that is inconsistent with the requirements of those subsections or that conflicts with the requirements of those subsections. The imposition, by State or local law, of greater penalties or fees for acts or omissions that are violations of such law and also violations of this Act shall not be considered to be inconsistent with, or to conflict with, the requirements of those subsections. Nothing in the preceding sentence limits the scope of State or local law provisions that are not to be considered to be inconsistent with, or to conflict with, the requirements of those subsections</text></paragraph> 
<paragraph id="HE136010B447F43BE94E5DCDA306FB0F1"><enum>(2)</enum><header>Reception facilities</header><text>The standards prescribed by the Administrator or the Secretary under subsection (g)(2) do not supersede any more stringent standard under any otherwise applicable Federal, State, or local law.</text></paragraph> 
<paragraph id="H110D1EF025D149BBA7C7B222DE1CA0C6"><enum>(3)</enum><header>Application with other statutes</header><text>This section provides the Federal authority for addressing aquatic invasive species in ballast water or sediment. If there is a conflict between any otherwise applicable provision of Federal law and the requirements of this section, the provisions of this section shall control to the extent that such requirements relate to vessels with respect to aquatic invasive species in ballast water or sediment.</text></paragraph></subsection> 
<subsection id="H8D060C41112749B8B9922600A9F246B5"><enum>(u)</enum><header>Regulations</header> 
<paragraph id="H4528175C79E14E8EAC6D38A460266D7C"><enum>(1)</enum><header>In general</header><text>The Secretary, after consultation with the Administrator, shall issue such regulations as may be necessary initially to carry out this section within 1 year after the date of enactment of the Prevention of Aquatic Invasive Species Act of 2006.</text></paragraph> 
<paragraph id="H3DA98035EB1148C0AFD7D9D7AA82A285"><enum>(2)</enum><header>Judicial review</header> 
<subparagraph id="H34CBFF68FC3B425EAE7194EA95CFAF54"><enum>(A)</enum><header>120-day rule</header><text>An interested person may bring an action for review of a final regulation promulgated under this section by the Secretary of the department in which the Coast Guard is operating, or by the Administrator, in the United States Circuit Court of Appeals for the Federal judicial district in which that person resides or transacts business which is directly affected by that regulation only if that action is filed within—</text> 
<clause id="HCF94485859E84F8FAA77422D969D4DDD"><enum>(i)</enum><text>120 days after the date on which the regulation is promulgated; or</text></clause> 
<clause id="H0DD6E1362C0F4A17B2A3111FEFE30300"><enum>(ii)</enum><text>more than 120 days after that date if the action is based on grounds that arose after that 120-day period.</text></clause></subparagraph> 
<subparagraph id="H775DFAF086F04C0BBEFED6AEBBB05123"><enum>(B)</enum><header>Review in enforcement proceedings</header><text>A regulation for which review could have been obtained under subparagraph (A) of this paragraph is not subject to judicial review in any civil or criminal proceeding for enforcement.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<clause id="H7824B6E29356488CB34C00AE351BB72D"><enum>(i)</enum><text>water taken on board a vessel to control trim, list, draught, stability, or stresses of the vessel, including matter suspended in such water; and </text></clause> 
<clause id="H2DD8E7AE3820447999B5471760E6B854"><enum>(ii)</enum><text>any water placed into a ballast tank during cleaning, maintenance, or other operations; and</text></clause></subparagraph> 
<subparagraph id="HA0EFD6255CCA492B95DDAACC19EA545D"><enum>(B)</enum><text>does not include water that—</text> 
<clause id="H8C02B3BA0E5F479CB662307267D2E1DF"><enum>(i)</enum><text>at the time of discharge, does not contain aquatic invasive species; and </text></clause> 
<clause id="H43A693871836486BA96FF24C8D4127"><enum>(ii)</enum><text>was taken on board a vessel and used for a purpose described in subparagraph (A);</text></clause></subparagraph></paragraph> 
<paragraph id="H7F3CA80AEB0347BB946C19FB3330A501"><enum>(6)</enum><text display-inline="yes-display-inline"><quote>ballast water capacity</quote> means the total volumetric capacity of all ballast tanks on a vessel;</text></paragraph> 
<paragraph id="H9A5FEB3E1F4A49F5B3B67CB3FCD04C06"><enum>(7)</enum><text><quote>ballast water management</quote> means mechanical, physical, chemical, and biological processes used, either singularly or in combination, to remove, render harmless, or avoid the uptake or discharge of harmful aquatic organisms and pathogens within ballast water and sediment;</text></paragraph> 
<paragraph id="HE96BF017DFD5422BB02E64000345E980"><enum>(8)</enum><text display-inline="yes-display-inline"><quote>constructed</quote> means a state of construction of a vessel at which—</text> 
<subparagraph id="HA3E69C7169F24FCF977C6E9807FC1599"><enum>(A)</enum><text>the keel is laid;</text></subparagraph> 
<subparagraph id="H568E9751E2BD49B5ABA6EA7402AE23E2"><enum>(B)</enum><text>construction identifiable with the specific vessel begins;</text></subparagraph> 
<subparagraph id="H496FB94B412D415C9C5295654D184075"><enum>(C)</enum><text>assembly of the vessel has begun comprising at least 50 tons or 1 percent of the estimated mass of all structural material of the vessel, whichever is less; or</text></subparagraph> 
<subparagraph id="H6C117B4050E84521AC5532D8F2AA0188"><enum>(D)</enum><text>the vessel undergoes a major conversion;</text> </subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA80C46B1F34B4D330029922F497BB800"><enum>(5)</enum><text>by inserting after paragraph (15), as redesignated, the following:</text>

<subparagraph id="H8762C6F8B43541A9AAD6E1F630516FF"><enum>(B)</enum><text>changes the vessel class;</text></subparagraph> 
<subparagraph id="HCBA563A33C0445BEA5013E8C9945E910"><enum>(C)</enum><text>is projected to prolong the vessel’s life by at least 10 years (as determined by the Secretary); or</text></subparagraph> 
<subparagraph id="H7526333447434DCBB134013436A2E2D2"><enum>(D)</enum><text>results in modifications to the vessel’s ballast water system, except—</text> 
<clause id="H2778D82CF4FA4085A9C650AD73F75B41"><enum>(i)</enum><text>component replacement-in-kind; or</text></clause> 
<clause id="HB62C19ADBA5E426D973842F466F1C018"><enum>(ii)</enum><text>conversion of a vessel to meet the requirements of section 1101(f);</text></clause></subparagraph></paragraph> <after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF5093BD48B9549DFB9ACD4104C68EBE1"><enum>(6)</enum><text>by inserting after paragraph (19), as redesignated, the following:</text>

<subparagraph id="H1E193E396F6F46248DA9FF4D04C55356"><enum>(B)</enum><text>any vessel owned or operated by the Department of Homeland Security that is designated by the Secretary of the department in which the Coast Guard is operating as a vessel equivalent to a vessel described in subparagraph (A);</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<title id="H39CB6477F3604274B1C1CB5F9E9B6366"><enum>II</enum><header>Prevention of the introduction of aquatic Invasive Species by other pathways</header> 
<section id="H9A43BDA068A64822921180640662843E" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>201.</enum><header>Coast Guard reports and standards on other sources of vessel-borne invasive species</header> 
<subsection id="HB0B384EB399B4BBEB966F553FFFB70D8" commented="no"><enum>(a)</enum><header>Report on hull-fouling and other vessel sources</header><text>Within 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall transmit a report to the Congress on vessel-related vectors of harmful aquatic organisms and pathogens other than ballast water and sediment, including vessel hulls and equipment, and from vessels equipped with ballast tanks that carry no ballast water on board.</text></subsection> 
<subsection id="H0D3356EA4D39473E8869A865F700E7E7" commented="no"><enum>(b)</enum><header>Best practices</header><text></text> 
<paragraph id="HEF966579AC104DE895326B71A58DE282"><enum>(1)</enum><header>Standards and procedures</header><text>As soon as practicable, the Coast Guard shall develop and implement best practices standards and procedures designed to reduce the introduction of invasive species into and within the United States from vessels and establish a timeframe for implementation of those standards and procedures by vessels, in addition to the mandatory requirements set forth in section 1101 for ballast water.</text></paragraph> 
<paragraph id="H4464232FBA3D4E60B62563348466AF35"><enum>(2)</enum><header>Included standards</header><text>Standards and procedures implemented under paragraph (1) should include designation of geographical locations for uptake and discharge of untreated ballast water, as well as standards and procedures for other vessel vectors of aquatic invasive species.</text></paragraph> 
<paragraph id="H3FA1D151EF5640E69152B3B0AF947CD1"><enum>(3)</enum><header>Report on standards and procedures</header><text>The Commandant of the Coast Guard shall transmit a report to the Congress describing the standards and procedures developed and the implementation timeframe, together with any recommendations, including legislative recommendations if appropriate, the Commandant deems appropriate.</text></paragraph> 
<paragraph id="H6F4F2F9BD0DD41CEA54EB5FBF181B5FD"><enum>(4)</enum><header>Regulations</header><text>The Secretary may promulgate regulations to incorporate and enforce standards and procedures developed under this subsection.</text></paragraph></subsection> 
<subsection id="H05B2CFBFBABB435800EBB52206FB51EE" commented="no"><enum>(c)</enum><header>Transiting vessels</header><text>Within 180 days after the date of enactment of this Act, the Commandant of the Coast Guard shall transmit a report to the Congress containing—</text> 
<paragraph id="HB1961776C3464CDEB200D17EA5C926CF" commented="no"><enum>(1)</enum><text>an assessment of the magnitude and potential adverse impacts of ballast water operations from foreign vessels designed, adapted, or constructed to carry ballast water that are transiting waters subject to the jurisdiction of the United States; and</text></paragraph> 
<paragraph id="HA37447D9C1EC4C949FC50568FEB27043" commented="no"><enum>(2)</enum><text>recommendations, including legislative recommendations if appropriate, of options for addressing ballast water operations of those vessels.</text></paragraph></subsection></section> 
<section id="H8193F31AEB0345D2B2D513D35FC085BA"><enum>202.</enum><header>Priority pathway management program</header><text display-inline="no-display-inline">Subtitle C of title I of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H3B6B9D30890F422500678517474F663C"> 
<section id="H1CD53F698E8643F981CB60449E57C49E"><enum>1210.</enum><header>Priority pathway management program</header> 
<subsection id="H38CB1EE972AC40979BD4FCCDD8FFCC9D"><enum>(a)</enum><header>Identification of high priority pathways</header><text>Not later than 2 years after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, and every 3 years thereafter, the Task Force, in coordination with the Invasive Species Council and in consultation with representatives of States, industry, and other interested parties, shall, based on pathway surveys and other available research relating to the rates of introductions in waters of the United States—</text> 
<paragraph id="HC46B4B62C77542DEBD37D100A45C5BF1"><enum>(1)</enum><text>identify those pathways, other than ballast water and sediment, that pose the highest risk for introductions of invasive species, both nationally and on a region-by-region basis unless further managed;</text></paragraph> 
<paragraph id="H31DF9131666447029DFE44B8CC8EB15"><enum>(2)</enum><text>develop recommendations for management strategies for those high-risk pathways;</text></paragraph> 
<paragraph id="H6B1903C9EFCF479A9F816CD7A24538C7"><enum>(3)</enum><text>include in the report to the Congress required under section 1201(f)(2)(B) a description of the identifications, strategies, and recommendations; and</text></paragraph> 
<paragraph id="H0CFA7F324E2D40CA90D0F46BB6B30064"><enum>(4)</enum><text>identify aquatic invasive species not yet introduced into waters of the United States that are likely to be introduced into waters of the United States unless preventative measures are taken.</text></paragraph></subsection> 
<subsection id="HE5F444ECA5A145DB83272C81FDD9C3D9"><enum>(b)</enum><header>Management of high priority pathways</header><text>Not later than 3 years after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Task Force or agencies of jurisdiction shall, to the maximum extent practicable, implement the strategies described in subsection (a)(2).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H6C1B8DCAF20F45AE00A56F82EC579195"><enum>203.</enum><header>Importation of live aquatic organisms</header><text display-inline="no-display-inline">Subtitle B of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711 et seq.</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H0210004DBF42404FBDD0C4B535A29C61"><enum>(a)</enum><header>Review of imported aquatic organisms</header><text>Not later than 2 years after date of the enactment of the Prevention of Aquatic Invasive Species Act of 2006, the Invasive Species Council, in consultation with the Task Force and the regional panels convened under section 1203, States, relevant Federal agencies, and affected industries, shall complete a review of the importation of live aquatic species into the United States.</text></subsection> 
<subsection id="H5DAB055E252B47A49BD11100D8196195"><enum>(b)</enum><header>Purpose of review</header><text>The review under subsection (a) shall—</text> 
<paragraph id="HCEA2B9DF336944CC8558D444320031E4"><enum>(1)</enum><text>identify live aquatic species imported into the United States that pose a risk to waters of the United States;</text></paragraph> 
<paragraph id="H1EF77ED4D8AC4C27BB1107D78090D1FD"><enum>(2)</enum><text>consider the likelihood of the spread of live aquatic species imported into the United States by human or natural means, both nationally and on a region-by-region basis;</text></paragraph> 
<paragraph id="H269D33DBE31843D281B194A1570C302"><enum>(3)</enum><text>consider species, including pathogens, parasites, and free-living organisms, that may be transported in association with live aquatic organisms imported into the United States;</text></paragraph> 
<paragraph id="H13F8F49355B7439295A65878AA40A005"><enum>(4)</enum><text>designate species imported into the United States with high or moderate probability of spreading if introduced into the waters of the United States;</text></paragraph> 
<paragraph id="H14975BA44D434CEDB64D6FC14633DBF"><enum>(5)</enum><text>designate species with respect to which there is insufficient information to determine the level probability of spreading if introduced into the waters of the United States; and</text></paragraph> 
<paragraph id="H0A3C4CD41F6546199FD94E5483EFCB72"><enum>(6)</enum><text>include recommendations to prevent the spread of live aquatic organisms imported into the United States throughout the waters of the United States.</text></paragraph></subsection> 
<subsection id="H23EF0881259942D0B6015253ED4FEA3F"><enum>(c)</enum><header>Guidelines</header><text>Not later than 42 months after the date of the enactment of the Prevention of Aquatic Invasive Species Act of 2006, the Invasive Species Council shall issue guidelines for Federal agencies and States responsible for screening live aquatic organisms imported into the United States to prevent the introduction and spread of species identified in the review under subsection (a).</text> </subsection> 
<subsection id="H15CABBB42D7F4E73B085B59E65DB3492"><enum>(d)</enum><header>Implementation of guidelines</header><text>Not later than 4 years after the date of the enactment of the Prevention of Aquatic Invasive Species Act of 2006, the head of each Federal agency identified in the guidelines issued under subsection (c) shall implement the guidelines to the maximum extent possible.</text></subsection> 
<subsection id="H7CFFB4DC5B83427AA20972DD25A7ECB7"><enum>(e)</enum><header>Coordination with states</header><text>The Invasive Species Council and the heads of Federal agencies identified in the guidelines issued under with subsection (c) shall work cooperatively with States to prevent the introduction into waters of the United States of live aquatic organisms imported into the United States.</text></subsection></section> <after-quoted-block>.</after-quoted-block></quoted-block></section> </title> 
<title id="H40494CBBDA3A4E5C938DAAB15F333C69"><enum>III</enum><header>Early detection; rapid response; control and outreach</header> 
<section id="H0652D9EC1F7B40B582041E3744D082CC"><enum>301.</enum><header>Early detection</header><text display-inline="no-display-inline">Subtitle B of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HB491D03E1E1347DF85E93672493396C1"><enum>1106.</enum><header>Early detection and monitoring</header> 
<subsection id="HBDE7FAFBC2DB45B7B0D25D2D96F776A7"><enum>(a)</enum><header>Early detection</header> 
<paragraph id="HCFF49BDB70B845C5927837AE168FF955"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the Prevention of Aquatic Invasive Species Act of 2006, the Task Force, in consultation with the Invasive Species Council, shall develop and promulgate a set of sampling protocols, a geographic plan, and budget to support a national system of ecological surveys to rapidly detect recently established aquatic invasive species in waters of the United States.</text> </paragraph> 
<paragraph id="H556CE5E986E6437CBF63CE989621FEB6"><enum>(2)</enum><header>Contents</header><text>The protocols, plan, and budget shall, at a minimum—</text> 
<subparagraph id="HC3693A1919C1425C846E68C31475995B"><enum>(A)</enum><text>address a diversity of aquatic ecosystems of the United States (including inland and coastal waters);</text></subparagraph> 
<subparagraph id="H5F915BEC355F40A3836E7108D13EB994"><enum>(B)</enum><text>encourage State, local, port, and tribal participation in monitoring;</text></subparagraph> 
<subparagraph id="HE176771914DC452EABEE9B55B1440640"><enum>(C)</enum><text>balance scientific rigor with practicability, timeliness, and breadth of sampling activity;</text></subparagraph> 
<subparagraph id="H297212BA0753438FBC8307450034FBDE"><enum>(D)</enum><text>consider the pathways and/or organisms identified under section 1210;</text></subparagraph> 
<subparagraph id="H2E4372FFB47548C3A263EDC52B6B17E"><enum>(E)</enum><text>include a capacity to evaluate the impacts of the importation of live aquatic organisms into the United States; and</text></subparagraph> 
<subparagraph id="H85F66CFBB8864092A7A150D97BA8F23B"><enum>(F)</enum><text>include clear lines of communication with appropriate Federal, State, and regional rapid response authorities.</text></subparagraph></paragraph> 
<paragraph id="HA69BB1D42A5F408093BFA41D95AE00A3"><enum>(3)</enum><header>Implementation</header><text>Not later than 3 years after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Director, the Under Secretary, and the Administrator (in consultation with the Invasive Species Council and in coordination with other agencies) shall implement a national system of ecological surveys that is—</text> 
<subparagraph id="H5A02C00D634F4BACAC7CB2FB54C20904"><enum>(A)</enum><text>carried out in cooperation with State, local, port, tribal authorities, and other non-Federal entities (such as colleges and universities); and</text></subparagraph> 
<subparagraph id="H5B8DBC20CEE24B7EBFF911C956B2DB30"><enum>(B)</enum><text>based on the protocols, plan, and budget published under subsection (a)(1) and any public comment.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H932E83C468984F1C8DDFFA9772B87457"><enum>302.</enum><header>Rapid response</header><text display-inline="no-display-inline">Subtitle C of title I of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721 et seq.</external-xref>) is further amended by adding at the end the following:</text>

<section id="HB64A2685335442E3AB68BCCC6D3768C"><enum>1211.</enum><header>Rapid response</header> 
<subsection id="H6E10AE3E54BE446B00E6B5A474B0000"><enum>(a)</enum><header>State Rapid Response Contingency Strategies</header> 
<paragraph id="H4F17284F7F8B47B48D12828642A7B637"><enum>(1)</enum><header>Emergency funds for rapid response</header><text>A State that has in effect a rapid response contingency strategy for invasive species in the State, including rapid assessment capabilities, that is approved under paragraph (2) shall be eligible to receive emergency funding to remain available until expended to implement rapid response measures for aquatic invasive species under the strategy, subject to renewal, as determined by the Secretary of the Interior and the Secretary in accordance with paragraph (2).</text></paragraph> 
<paragraph id="H0E2AADF063CF4C4590BF41A3B53B514F"><enum>(2)</enum><header>Approval of Rapid Response Contingency Strategies</header><text>The Task Force, in consultation with the Invasive Species Council, shall approve a State rapid response contingency strategy described in paragraph (1) if the strategy—</text> 
<subparagraph id="H9A1D8DF73E3D42D9AEBB479D796BF847"><enum>(A)</enum><text>identifies all key governmental and nongovernmental partners to be involved in carrying out the strategy;</text></subparagraph> 
<subparagraph id="H4F2CED454F6F40C39E78B054B32801E3"><enum>(B)</enum><text>clearly designates the authorities and responsibilities of each partner, including the authority of any State or government of an Indian tribe to distribute emergency funds;</text></subparagraph> 
<subparagraph id="HFD5D566DDCEC4E6CA2818250D72BA7E0"><enum>(C)</enum><text>specifies criteria for rapid response measures, including a diagnostic system that—</text> 
<clause id="HF7BAB1C93009454FA1DF5BB1B41D8030"><enum>(i)</enum><text>distinguishes cases in which rapid response has a likelihood of success and cases in which rapid response has no likelihood of success;</text></clause> 
<clause id="HFA9F36CA601F4DC0B7E00377B44BA00"><enum>(ii)</enum><text>distinguishes rapid response measures from ongoing management and control of established populations of aquatic invasive species; and</text></clause> 
<clause id="H84029EEBBAF6429A91AA5B6EEFA14EB"><enum>(iii)</enum><text>distinguishes instances in which the rate and probability of organism dispersal is significantly altered by vessel movements;</text></clause></subparagraph> 
<subparagraph id="H41A3065AB5434DA59F12C6995CACF758"><enum>(D)</enum><text>includes an early detection strategy that supports or complements the early detection and monitoring system developed under section 1106;</text></subparagraph> 
<subparagraph id="H45EBA5834BA44F778F87C08F9D533BF"><enum>(E)</enum><text>provides for a monitoring capability to assess—</text> 
<clause id="HCF37DD9B41AC4F50A885B1C08342963"><enum>(i)</enum><text>the extent of infestations; and</text></clause> 
<clause id="HDE5AD76E8DDD481881ADF5004CBA811C"><enum>(ii)</enum><text>the effectiveness of rapid response efforts;</text></clause></subparagraph> 
<subparagraph id="HAD4F581EC1D646BBAB0305ED1CB3854D"><enum>(F)</enum><text>to the maximum extent practicable, is integrated into the State aquatic invasive species management plan approved under section 1204;</text></subparagraph> 
<subparagraph id="H520ECADF84394B40AC206301BA1BD047"><enum>(G)</enum><text>to the maximum extent possible, does not use rapid response tools that do not meet environmental criteria developed under subsection (e)(4);</text></subparagraph> 
<subparagraph id="HE45C0412049840968711E259AF67CD00"><enum>(H)</enum><text>includes a public education and outreach component directed at—</text> 
<clause id="HA0139198A06F498CB5C200C911B2CC8B"><enum>(i)</enum><text>potential pathways for spread of aquatic invasive species; and</text></clause> 
<clause id="HF2034D92E2C645A1807370473C34F1BE"><enum>(ii)</enum><text>persons involved in industries and recreational activities associated with those pathways; and</text> 
<subclause indent="up2" id="H33803C056E894624B93DB7CDD9604696"><enum>(I)</enum><text>to the extent that the strategy involves vessels, conforms with guidelines issued by the Secretary under subsection (c)(2).</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H629C87F3FE504CD98016FE29135C5C13"><enum>(b)</enum><header>Regional Rapid Response Contingency Strategies</header><text>The Task Force, with the concurrence of the Invasive Species Council and in consultation with the regional panels of the Task Force established under section 1203, shall encourage the development of regional rapid response contingency strategies that—</text> 
<paragraph id="H4FD9FD4AF17249CE00B4A7CB00533684"><enum>(1)</enum><text>provide a consistent and coordinated approach to rapid response; and</text></paragraph> 
<paragraph id="H1E9CD62155F844C3A593CF6C29A5CC9B"><enum>(2)</enum><text>are approved by—</text> 
<subparagraph id="H0FCE1310FC034B7FB57E29606D47B19E"><enum>(A)</enum><text>the Secretary; and</text></subparagraph> 
<subparagraph id="H1302E55C7DD24BC4AF1881F5B9674E3C"><enum>(B)</enum><text>the Governors and Indian tribes having jurisdiction over areas within a region.</text></subparagraph></paragraph></subsection> 
<subsection id="H6D43D79FAFB24BC0B7B35022EA6035F5"><enum>(c)</enum><header>Model Rapid Response Contingency Strategies</header><text>Not later than 18 months after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>—</text> 
<paragraph id="H146722C205494595AC44F173F69DAB8"><enum>(1)</enum><text>the Task Force, with the concurrence of the Invasive Species Council and the regional panels of the Task Force established under section 1203, shall develop—</text> 
<subparagraph id="H9D65EDED09FD463EA55CB7DAA3207B09"><enum>(A)</enum><text>a model State rapid response contingency strategy for aquatic invasive species, including rapid assessment capability, that includes, to the maximum extent practicable, the components listed under subparagraphs (A) through (H) of subsection (a)(2); and</text></subparagraph> 
<subparagraph id="HB7F016C28B0F4FB400129FAA8CD686CC"><enum>(B)</enum><text>a model regional rapid response contingency strategy for aquatic invasive species; and</text></subparagraph></paragraph> 
<paragraph id="H7D5234ECAB2743BAABD73B39F3F3CC6D"><enum>(2)</enum><text>the Secretary, in concurrence with the Task Force and the regional panels, shall issue guidelines that describe vessel-related requirements that may be used in a rapid response contingency strategy, including specific requirements for strategy approved under this section.</text></paragraph></subsection> 
<subsection id="H99A8BC5D345F479A8519DD55181F858F"><enum>(d)</enum><header>Cost sharing</header> 
<paragraph id="H012180D087744CD681E0EDE093BC373F"><enum>(1)</enum><header>State Rapid Response Contingency Strategies</header><text>The Federal share of the cost of activities carried out under a State rapid response contingency strategy approved under subsection (a) shall be not less than 50 percent.</text></paragraph> 
<paragraph id="H6536087F079F451987816BA41366DDA5"><enum>(2)</enum><header>Regional Rapid Response Contingency Strategies</header><text>The Federal share of the cost of activities carried out under a regional rapid response contingency strategy approved under subsection (b) shall be not less than 75 percent.</text></paragraph> 
<paragraph id="H4A405F21426C4E008601881F8492CBA7"><enum>(3)</enum><header>In-kind contributions</header><text>States or regions that receive Federal funds for rapid response activities may provide matching funds in the form of in-kind contributions.</text></paragraph></subsection> 
<subsection id="H60E3C6D658CF4FFE84F4A2E8A120A900"><enum>(e)</enum><header>Federal rapid response teams</header> 
<paragraph id="HE0C35837DA7A4E089782FEEEA8B47728"><enum>(1)</enum><header>Establishment of teams</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Invasive Species Council, in coordination with the Task Force and the heads of appropriate Federal agencies, shall establish a Federal rapid response team for each of the 10 Federal regions that comprise the Standard Federal Regional Boundary System.</text></paragraph> 
<paragraph id="H2AA177F41CFC4CBD87DC82598BA7E1A9"><enum>(2)</enum><header>Duties of teams</header><text>Each Federal rapid response team shall, at a minimum—</text> 
<subparagraph id="HC58C0A760EB347A8B2B1E3B1990037C"><enum>(A)</enum><text>implement rapid eradication or control responses for newly detected aquatic invasive species on Federal and tribal land;</text></subparagraph> 
<subparagraph id="HBC5E3EE47C6C4AA800A67DDE009C39AF"><enum>(B)</enum><text>carry out, or assist in carrying out, rapid responses for newly detected aquatic invasive species on non-Federal land at the request of a State, Indian tribe, or group of States or Indian tribes;</text></subparagraph> 
<subparagraph id="HB91B92319189444AA135F65E33F5C76C"><enum>(C)</enum><text>provide training and expertise for State, tribal, or regional rapid responders;</text></subparagraph> 
<subparagraph id="HDF207825834B439AA0CEC8427FFE43E9"><enum>(D)</enum><text>provide central sources of information for rapid responders;</text></subparagraph> 
<subparagraph id="H32EC48F5EFAC4A90A5A1AC0580E6FFAA"><enum>(E)</enum><text>maintain a list of researchers and rapid response volunteers; and</text></subparagraph> 
<subparagraph id="H2B398107F16645D7AED0D5422FA5A522"><enum>(F)</enum><text>in carrying out any rapid response activity with respect to an aquatic noxious weed listed under section 412(f) of the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7712">7 U.S.C. 7712(f)</external-xref>), include representatives of the Animal and Plant Health Inspection Service.</text></subparagraph></paragraph> 
<paragraph id="HC17562CE399D4375AC01D085F916B770"><enum>(3)</enum><header>Criteria for identifying cases of rapid response warranting Federal assistance</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Task Force, with the concurrence of the Invasive Species Council, shall develop criteria to identify cases of rapid response warranting Federal assistance under this subsection, including criteria relating to, at a minimum—</text> 
<subparagraph id="HBFAA64C48746499CA39EF5079213E759"><enum>(A)</enum><text>the extent to which infestations of aquatic invasive species may be managed successfully by rapid response;</text></subparagraph> 
<subparagraph id="HCA6458EA0EF04EB5BA803094D656F0FC"><enum>(B)</enum><text>the extent to which rapid response efforts may differ from ongoing management and control; and</text></subparagraph> 
<subparagraph id="H1289782A39284A58A3A06200ED554511"><enum>(C)</enum><text>the extent to which infestations of nonindigenous aquatic invasive species are considered to be an acute or chronic threat to—</text> 
<clause id="H0520AC4D238341DC957D901196A91B15"><enum>(i)</enum><text>biodiversity of native fish and wildlife;</text></clause> 
<clause id="H101FE05E32174D4D8E13224955F9F35"><enum>(ii)</enum><text>habitats of native fish and wildlife; or</text></clause> 
<clause id="H30A55C8AE7A14DCE888B677000924205"><enum>(iii)</enum><text>human health.</text></clause></subparagraph></paragraph> 
<paragraph id="H180C731FF9214E0483C7FFB9FE47F79"><enum>(4)</enum><header>Environmental criteria</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Administrator, in consultation with the Invasive Species Council, the Secretary of Transportation, the Task Force (including regional panels of the Task Force established under section 1203), the Director, and the Director of the National Marine Fisheries Service, shall develop environmental criteria to minimize nontarget environmental impacts of rapid responses carried out pursuant to this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H858A5EBA6D9A44E39573CBBA97546CF2"><enum>303.</enum><header>Dispersal barriers</header> <text display-inline="no-display-inline">Section 1202 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>) is amended—</text> 
<paragraph id="HE40373EF0DBD4C92B98356822C1E151D"><enum>(1)</enum><text>by redesignating subsections (j) and (k) as subsections (l) and (m), respectively; and</text></paragraph> 
<paragraph id="HEE30EF3536374EE19FA7CFA79000052"><enum>(2)</enum><text>by inserting after subsection (i) the following:</text>

<subsection id="H37CD3EED06274BAE9900DCF1CC6C6446"><enum>(j)</enum><header>National dispersal barrier program</header> 
<paragraph id="HDAE0C0FE46504783A4B2DA8C81D59D96"><enum>(1)</enum><header>Chicago River Ship and Sanitary Canal dispersal barrier project</header> 
<subparagraph id="H50BA9FEE1F034C79A9988614FB00AF03"><enum>(A)</enum><header>In general</header><text>The Assistant Secretary, with the concurrence of the Administrator, shall complete construction of, operate, and maintain, the Chicago River Ship and Sanitary Canal dispersal barrier project.</text></subparagraph> 
<subparagraph id="HD4826854B77D41329C31A7DAF0FDCEA2"><enum>(B)</enum><header>Consultation</header><text>Subparagraph (A) shall be carried out in consultation with the appropriate Federal, State, local, and other nongovernmental entities.</text></subparagraph> 
<subparagraph id="H91B971AFE5274969BC81768DD0BEB800"><enum>(C)</enum><header>Construction</header><text>The completed barrier project shall include additions to the dispersal barrier in existence on the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, including—</text> 
<clause id="H3BFA60670E444898A32DE6C0D14BEE37"><enum>(i)</enum><text>backup power;</text></clause> 
<clause id="H195E4B8CC515400BAEC4D52F90A6F49C"><enum>(ii)</enum><text>a research vessel launching crane;</text></clause> 
<clause id="H5F66C8FC461E41188BE0E6945677278E"><enum>(iii)</enum><text>replacement electrodes;</text></clause> 
<clause id="HA580170DAA84452393EB319CEF3FC24E"><enum>(iv)</enum><text>other barrier elements, as available and appropriate;</text></clause> 
<clause id="H5DFE75BA1FB64C86904F7C1650D6DFC2"><enum>(v)</enum><text>an acoustic monitoring system;</text></clause> 
<clause id="H44637CF9617C4B4B93CA1F13934DB1A8"><enum>(vi)</enum><text>an emergency egress system; and</text></clause> 
<clause id="H214F92BE651B4411B60027927B2BCC84"><enum>(vii)</enum><text>a second long-service life dispersal barrier.</text></clause></subparagraph> 
<subparagraph id="HB99938AE4DEB462389BFE100008673F8"><enum>(D)</enum><header>Feasibility study of Chicago River Ship and Sanitary Canal</header> 
<clause id="HB60FF016D26A4A58BDB34325D9920363"><enum>(i)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Assistant Secretary, in consultation with appropriate Federal, State, local, and nongovernmental entities, shall conduct a feasibility study of the full range of options available to prevent the spread of aquatic species through the Chicago River Ship and Sanitary dispersal barrier.</text></clause> 
<clause id="HD8506E64015C46558E816E33AD658400"><enum>(ii)</enum><header>Matters to be studied</header><text>The study shall—</text> 
<subclause id="HF4FA48C5DF3B4036A029A4DBC8F94646"><enum>(I)</enum><text>provide recommendations concerning additional and long-term measures necessary to improve the performance of the Chicago River Ship and Sanitary Canal dispersal barrier; and</text></subclause> 
<subclause id="H93F3E2F2116B4FE900C0632EA36D962"><enum>(II)</enum><text>examine methods and measures necessary to achieve, to the maximum extent practicable, 100-percent efficacy of the barrier with respect to aquatic invasive species of fish and maximum efficacy of the barrier with respect to other taxa of aquatic invasive species.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H12B39D0285D04C919D69AFAF1054715C"><enum>(2)</enum><header>Monitoring program</header> 
<subparagraph id="HBE8F8F7209F54660AF068E0300FFD3B3"><enum>(A)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Secretary of the Interior shall establish an interbasin and intrabasin monitoring program.</text></subparagraph> 
<subparagraph id="H7618BA7CF6014EBA8D1149719CD91392"><enum>(B)</enum><header>Required elements</header><text>The monitoring program shall—</text> 
<clause id="H713F6E7440544B09BEFFADD58DB16308"><enum>(i)</enum><text>track aquatic invasive species moving through the Chicago River Ship and Sanitary Canal, the Lake Champlain Canal, other interbasin waterways, and major river systems as recommended by regional panels convened under section 1203;</text></clause> 
<clause id="H40D3D07EC9FA42D787FA4D1281FE682F"><enum>(ii)</enum><text>assess the efficacy of dispersal barriers and other measures in preventing the spread of aquatic invasive species through the waterways; and</text></clause> 
<clause id="HD41D889B983448689F35F1E6E4A85CFC"><enum>(iii)</enum><text>identify waterways suitable for dispersal barrier demonstration projects, in addition to the waterways at which dispersal barrier demonstration projects were carried out before the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>.</text></clause></subparagraph> 
<subparagraph id="H5917D7A8687B46208F98031F0059C0DA"><enum>(C)</enum><header>Reports</header><text>The Secretary of the Interior shall issue biennial reports on the findings of the monitoring program.</text></subparagraph></paragraph> 
<paragraph id="HE04B20AED47842B1B0421B4499BEA98F"><enum>(3)</enum><header>Prevention and mitigation plans for army corps of engineers projects</header><text>In developing projects involving interbasin waterways or other hydrologic alternations that could create pathways for aquatic invasive species, the Assistant Secretary shall develop adequate prevention and mitigation plans for controlling the dispersal of aquatic invasive species.</text></paragraph> 
<paragraph id="HA52CB0B624AA4494B6066999850098F3"><enum>(4)</enum><header>Technical assistance</header><text>The Great Lakes Environmental Research Laboratory of the National Oceanic and Atmospheric Administration shall provide technical assistance to appropriate entities to assist in the research conducted under this subsection.</text></paragraph> 
<paragraph id="H637B6890ABAD4F0BB38BA1D5B168B22"><enum>(5)</enum><header>Reports</header><text>Not later than 3 years after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Assistant Secretary and the Director shall jointly submit to the Congress a report that describes—</text> 
<subparagraph id="HB89B9869C2C84071826E016C362289CA"><enum>(A)</enum><text>the efficacy of the Chicago River Ship and Sanitary Canal dispersal barrier project; and</text></subparagraph> 
<subparagraph id="H0AA34DDA568A471BB07764D3B68C1DE"><enum>(B)</enum><text>a plan to provide for additional dispersal barrier demonstration projects and further research needs.</text></subparagraph></paragraph> 
<paragraph id="H21651304D90142718763977396E36827"><enum>(6)</enum><header>Additional waterways</header><text>The Assistant Secretary, with the concurrence of the Administrator, and other relevant Federal agencies, shall—</text> 
<subparagraph id="HE0AA911F0F544760984C8619BEDAFAEC"><enum>(A)</enum><text>identify additional waterways suitable for the construction of new dispersal barriers (based on the monitoring program established under paragraph (2)); and</text></subparagraph> 
<subparagraph id="H76D8AF7BEA6142049BB35C60537EC85"><enum>(B)</enum><text>construct, maintain, and operate such dispersal barriers as necessary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H336256FEEB91467288843172B2D04B98"><enum>304.</enum><header>Environmental soundness</header><text display-inline="no-display-inline">Section 1202 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>) is further amended by inserting after subsection (j) the following:</text>

<subsection id="HB54D04E03CEE4DEC956F0014997912F0"><enum>(k)</enum><header>Improvement of treatment methods for aquatic Invasive Species</header> 
<paragraph id="H7589B36712AB4ECBB431991C4D4186E3"><enum>(1)</enum><header>Criteria to evaluate environmental soundness of treatment methods</header> 
<subparagraph id="H62AE02A51AF94204ABE9D5DBD6B6DC06"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Administrator, in consultation and cooperation with the Secretary, the Invasive Species Council, and the Task Force (including any regional panels of the Task Force) shall promulgate criteria to evaluate the treatment methods described in subparagraph (B) for the purpose of ensuring that the treatment methods pose no significant threat of adverse effect on human health, public safety, or the environment (including air quality and the aquatic environment) that is acute, chronic, cumulative, or collective.</text></subparagraph> 
<subparagraph id="H9CA4A4903C2A47F6825E948BE049168D"><enum>(B)</enum><header>Treatment methods</header><text>The treatment methods referred to in subparagraph (A) are all mechanical, physical, chemical, biological, and other treatment methods used in bodies of water of the United States (regardless of whether the bodies of water are navigable and regardless of the origin of the waters), to prevent, treat, or respond to the introduction of aquatic invasive species.</text></subparagraph> 
<subparagraph id="H78ACD19007FC4C0FAD57864ED8D12B87"><enum>(C)</enum><header>Consultation</header><text>In carrying out subparagraph (A), the Administrator shall consult with—</text> 
<clause id="H46FC2A83B6C44DCEAB421072B3C2BDC2"><enum>(i)</enum><text>the Secretary of Transportation;</text></clause> 
<clause id="H9D326C4AA8B841C0BA3E36F7E77DC79"><enum>(ii)</enum><text>the Task Force (including the regional panels of the Task Force established under section 1203);</text></clause> 
<clause id="HF6F0571B7256473DAFA6B79427B3DF45"><enum>(iii)</enum><text>the Director;</text></clause> 
<clause id="HB1C9B5371F9041289C002EAED800B95D"><enum>(iv)</enum><text>the Assistant Secretary;</text></clause> 
<clause id="H04D6DD99EEBA4D5EA8387C4FD899D7C7"><enum>(v)</enum><text>the Under Secretary;</text></clause> 
<clause id="HC3D813D86B9B4340913541C5740644E5"><enum>(vi)</enum><text>the Director of the National Marine Fisheries Service; and</text></clause>

<paragraph id="HD01A3960C3AD4A9D9BDF8E5DD84FC3BA"><enum>(2)</enum><header>Publication of information on environmentally sound treatment methods</header><text>Not later than 1 year after the date of enactment of the Prevention of Aquatic Invasive Species Act of 2006, the Administrator, in consultation with the Invasive Species Council, shall publish and update annually—</text> 
<subparagraph id="HDC3AFE6CA6A64F44AD23DA194EBC3F74"><enum>(A)</enum><text>a list of environmentally sound treatment methods that may apply to a potential aquatic invasive species response effort;</text></subparagraph> 
<subparagraph id="H90CC50C6792F41C5A5193BF3B92FDEBE"><enum>(B)</enum><text>accompanying research that supports the environmental soundness of each approved treatment method; and</text></subparagraph> 
<subparagraph id="H70899BAA20D14141A8FFB8E005BDDC3"><enum>(C)</enum><text>explicit guidelines under which each treatment method can be used in an environmentally sound manner.</text></subparagraph></paragraph> 
<paragraph id="H1DDC789F89B048B5BCC8700B28FDD00"><enum>(3)</enum><header>Reports</header><text>The Invasive Species Council and Task Force shall include the information described in paragraph (2) in the reports submitted under section 1201(f)(2)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subparagraph id="H184683EDC9D04E71BF5490B2F0005F44"><enum>(B)</enum><header>Public warnings</header><text>Not later than 180 days after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, each Federal officer of an agency that provides Federal funds to States for building or maintaining public access points to waters of the United States shall amend the guidelines of the agency, in consultation with relevant State agencies, to encourage the posting of regionally specific public warnings or other suitable informational and educational materials at the access points regarding—</text> 
<clause id="H6BCE288ECB7B46E5A0F62498271D3E6D"><enum>(i)</enum><text>the danger of spread of aquatic invasive species through the transport of recreational watercraft; and</text></clause> 
<clause id="HEFBC49513C2E4BEBA4B14CF0AE8BF089"><enum>(ii)</enum><text>methods for removing organisms prior to transporting a watercraft.</text></clause> </subparagraph> 
<subparagraph id="H9D1A395F29054A4F008C90E78FAC2192"><enum>(C)</enum><header>Cleaning of watercraft at marinas</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Under Secretary and the Director (in cooperation with the Task Force and in consultation with the States, relevant industry groups, and Indian tribes) shall develop an education, outreach, and training program directed toward marinas and marina operators regarding—</text> 
<clause id="H714B2E43A69B4B7DA4C0DA7BC36A0C0"><enum>(i)</enum><text>checking watercraft for live organisms;</text></clause> 
<clause id="HF22D118FC55F451A804E00EEF300A4E1"><enum>(ii)</enum><text>removing live organisms from the watercraft before the watercraft are commercially or recreationally trailered;</text></clause> 
<clause id="H49F5EB97C8884BB2A822CAEC2000F547"><enum>(iii)</enum><text>encouraging regular hull cleaning and maintenance, avoiding in-water hull cleaning; and</text></clause> 
<clause id="HF8BE1D612F024D0DB5BAC8FB85AAC5FB"><enum>(iv)</enum><text>other activities, as identified by the Secretary.</text></clause></subparagraph> 
<subparagraph id="HBD0278825EA646B9B9B081F7B6E91EDC"><enum>(D)</enum><header>Proper disposal of nonindigenous live aquatic organisms in trade</header><text>The Task Force shall—</text> 
<clause id="HED40E3CF5D6D4FFCB7E0AA88D21CD44D"><enum>(i)</enum><text>not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, develop (in consultation with industry and other affected parties) issue guidelines for proper disposal of live nonindigenous aquatic organisms in trade; and</text></clause> 
<clause id="H71DA035CA57946DCA4EE8D95370025CC"><enum>(ii)</enum><text>use the guidelines in appropriate public information and outreach efforts.</text></clause></subparagraph> 
<subparagraph id="H0A543A6F6BBA4DD59E49756BB663DC23"><enum>(E)</enum><header>Expansion of program</header> 
<clause id="H1B71F206CCD74056911300BBA8CC068"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Task Force shall expand the information and education program directed at recreational boaters in States from which watercraft are transported westward across the 100th meridian.</text></clause> 
<clause id="H05C9B88F6BD14E90915F7B715C2883CA"><enum>(ii)</enum><header>Activities</header><text>In carrying out the program, the Task Force shall—</text> 
<subclause id="H3D356425610E460C8CB308C5FD00004D"><enum>(I)</enum><text>survey owners of watercraft transported westward across the 100th meridian to determine the States of origin of most such owners;</text></subclause> 
<subclause id="HFCD5CF591AF14AF38431D31D7DCD8CED"><enum>(II)</enum><text>provide information directly to watercraft owners concerning the importance of cleaning watercraft carrying live organisms before transporting the watercraft; and</text></subclause> 
<subclause id="H35B4C70BA6A748E6A607547054F6FE38"><enum>(III)</enum><text>support education and information programs of the States of origin to ensure that the State programs address westward spread.</text></subclause></clause></subparagraph> 
<subparagraph id="HDE6B27CCDF6B4D5EA6587892998FB897"><enum>(F)</enum><header>Information and education program by National Park Service</header><text>The Secretary of the Interior, acting through the Director of the National Park Service, shall develop a program to provide public outreach and other educational activities to prevent the spread of aquatic invasive species by recreational watercraft in units of the National Park System or through events sponsored by the National Park Service.</text></subparagraph></paragraph> 
<paragraph id="HCA4F8490D6AF4FF482AD5DE86EBF4FBD"><enum>(3)</enum><header>Outreach to industry</header><text>The Task Force, in conjunction with the Invasive Species Council, shall carry out activities to inform and promote voluntary cooperation and regulatory compliance by members of the national and international maritime, horticultural, aquarium, aquaculture, and pet trade industries with screening, monitoring, and control of the transportation of aquatic invasive species.</text></paragraph> 
<paragraph id="HC0B8FCE0BD404FD29F078B79FCACFB15"><enum>(4)</enum><header>Public access to monitoring information</header><text>The Task Force, the Invasive Species Council, and other relevant agencies, shall maintain information on the Internet regarding—</text> 
<subparagraph id="HD5C930B9FF114461871704E0FB765E82"><enum>(A)</enum><text>the best approaches for the public and private interests to use in assisting with national early detection and monitoring of aquatic invasive species in waters of the United States;</text></subparagraph> 
<subparagraph id="HA63622AEAA9144EE8CEC1C5B95DCFF"><enum>(B)</enum><text>contact locations for joining a national network of monitoring stations;</text></subparagraph> 
<subparagraph id="H734ABA7E9D8C41D08C6D3DDAA3E4602F"><enum>(C)</enum><text>approved State Management Plans under section 1204(a) and Rapid Response Contingency Strategies under sections 1211(a)(2) and 1211(c); and</text></subparagraph> 
<subparagraph id="H9F49034BFB164CC9BE00B4C6F54A7A2"><enum>(D)</enum><text>the list of potential invaders under section 1210(a)(4).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title>

<subparagraph id="H86BDE86E1E1A432B9007317CFB161CA8"><enum>(B)</enum><text>any list of noxious weeds under the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>) (including regulations promulgated under that Act contained in part 360 of title 7, Code of Federal Regulations (or any successor regulations)).</text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0DE40116A463499CA5265BBABDED5B79"><enum>(d)</enum><header>Regional coordination</header><text>Section 1203 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4723">16 U.S.C. 4723</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H1C76F07CC80741FF917D65E88D19CAC5"><enum>(e)</enum><header>Organizations</header><text>An interstate organization that has a Federal charter authorized by law, interstate agreement, or Executive Order for purposes of fisheries or natural resource management may receive funds under this Act to implement activities authorized under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF1EB2A770F5D42DE886361A3B56BC8C"><enum>(e)</enum><header>State aquatic Invasive Species management plans</header><text>Section 1204(a) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4724">16 U.S.C. 4724(a)</external-xref>) is amended—</text> 
<paragraph id="H1C6B16FAAC624C6D9DD7284B00079661"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (2)(A) and inserting the following:</text>

<clause id="H7B458A186E534CE3940099F0DB4FC698"><enum>(iv)</enum><text>screening of imported live aquatic species in accordance with guidelines issued under section 1105;</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="HCE1F32D51F194BFE879EEA0600CE4118"><enum>(2)</enum><text>in paragraph (2)(D) by inserting <quote>include</quote> after <quote>(D)</quote>; and</text></paragraph> 
<paragraph id="H5C3B46B77F114AF4A5E69F7E2500DB4F"><enum>(3)</enum><text>by adding at the end the following:</text>

<subparagraph id="H5776EE5EB3354218BEC60054F91EC0FB"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Task Force shall publish in the Federal Register guidelines for the development of plans under this subsection, including guidelines for reporting progress in implementing the plans, to encourage consistency in implementation of and reporting under those plans.</text></subparagraph> 
<subparagraph id="H2BA9ACF86CBF494DABEACE86D48E9D75"><enum>(B)</enum><header>Guidelines</header><text>The guidelines published under subparagraph (A) shall include, for the purpose of paragraph (2)(A), guidelines concerning—</text> 
<clause id="HDAB58FCE060B4C92BF2CEEA875C3DDE2"><enum>(i)</enum><text>rapid response contingency strategies under section 1211;</text></clause> 
<clause id="H5E4921E40D7645E69FE8318D672298B2"><enum>(ii)</enum><text>early detection and monitoring strategies under section 1211(a)(2)(D);</text></clause> 
<clause id="HAADFD35834944CB09886F9BDADAA9C66"><enum>(iii)</enum><text>aquatic plant control programs; and</text></clause> 
<clause id="H8F70AB1FA8DA470BB7FAFD58FFB9D00"><enum>(iv)</enum><text>the review and revision of requirements of this subsection and the reapproval process under this subsection.</text></clause></subparagraph></paragraph> 
<paragraph id="H9D59047E197F4D019E8601F1ACCAB5D8"><enum>(6)</enum><header>Relationship to other plans</header> 
<subparagraph id="H08619B24F6FA4DDE8780DFEC9DCBBCDC"><enum>(A)</enum><header>In general</header><text>A plan approved under paragraph (4) shall be deemed to meet any State planning requirement of the program established under section 104 of the River and Harbor Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/33/610">33 U.S.C. 610</external-xref>) for a plan to control noxious aquatic plant growths.</text></subparagraph> 
<subparagraph id="HDEF60D22AC6C46A093B3F700D8A9E8AC"><enum>(B)</enum><header>Enforcement</header><text>Funds provided to States for implementation of plans pursuant to section 1204 may be used by States to enforce requirements relating to aquatic invasive species under the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>) (including regulations promulgated under that Act contained in part 360 of title 7, Code of Federal Regulations (or any successor regulations)).</text></subparagraph></paragraph> 
<paragraph id="H235F50A568FE4A6BA2F4C75D00342B5E"><enum>(7)</enum><header>Review and revision</header> 
<subparagraph id="H9B39E80EDA1C41AFB264C0112B8154B3"><enum>(A)</enum><header>In general</header><text>Each State shall periodically review and, as necessary and subject to subparagraph (B), revise the management plan of the State in accordance with guidelines of the Task Force under paragraph (5).</text></subparagraph> 
<subparagraph id="H8A1506D695F34B149876CA2DF29B68F5"><enum>(B)</enum><header>Update of existing plans</header><text>A State plan approved under the section before the date of the enactment of the Prevention of Aquatic Invasive Species Act of 2006 shall be revised by the State under guidelines issued by the Director to conform to the guidelines published under paragraph (5), but shall be treated as a plan approved under this subsection for purposes of grants under this section.</text></subparagraph></paragraph> 
<paragraph id="H983F513E3E604AF99E4474218EDB6145"><enum>(8)</enum><header>Other State Management Plans</header><text>In addition to the management plans required under this subsection, the Director shall encourage each State to develop and implement new, and expand existing, State management plans to improve State actions to prevent and control aquatic invasive species.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDC86A7F85E264E1DA4081796DEC2C714" display-inline="no-display-inline"><enum>(f)</enum><header>Grant program</header><text>Section 1204(b)(1) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4724">16 U.S.C. 4724(b)(1)</external-xref>) is amended by striking <quote>subsection (a) for the implementation of those plans.</quote> and inserting the following: <quote>subsection (a) to develop and implement those plans.</quote>.</text> </subsection></section>

<subsection id="H78143912586344A400D5B3CCA1B697"><enum>(a)</enum><header>In general</header><text>The Task Force, in consultation with the Secretary of State, shall include in the report required by section 1202(m) a description of the means by which international agreements and regulations with countries that share a border with the United States will be implemented and enforced by Federal agencies (including a clarification of the roles and responsibilities of those agencies).</text></subsection> 
<subsection id="H788F0196F4024178844F5EC905EDA460"><enum>(b)</enum><header>Negotiations</header><text>As soon as practicable after the date of enactment of the <short-title>Prevention of Aquatic Invasive Species Act of 2006</short-title>, the Secretary of State may enter into negotiations with—</text> 
<paragraph id="H19746FF7ED0F43FCA5357657529BAA9E"><enum>(1)</enum><text>Canada to issue a request that the International Joint Commission, by not later than 18 months after the date of enactment of that Act, review, research, conduct hearings on, and submit to the parties represented on the International Joint Commission a report that describes the success of current policies of governments in the United States and Canada having jurisdiction over the Great Lakes in anticipating and preventing biological invasions of the aquatic ecosystem in the Great Lakes, including—</text> 
<subparagraph id="HAFCB3C03DE224731AD7366027533FE73"><enum>(A)</enum><text>an analysis of current Federal, State or Provincial, local, and international laws, enforcement practices, and agreements;</text></subparagraph> 
<subparagraph id="H6776298698364ABEA2AA7CC110083BC"><enum>(B)</enum><text>an analysis of prevention efforts related to all likely pathways for biological invasions of the aquatic ecosystem in the Great Lakes; and</text></subparagraph> 
<subparagraph id="HF9C2849C34E74D9295853C68094F57A"><enum>(C)</enum><text>recommendations of the International Joint Commission for means by which to improve and harmonize the policies and enforcement practices referred to in clause (i); and</text></subparagraph></paragraph> 
<paragraph id="H93C1F24DC2934331B276CAB7CC003461"><enum>(2)</enum><text>Mexico, to ensure coordination of efforts of the United States with efforts of Mexico to manage invasive species established in the United States-Mexico border region.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title>
