<official-title>To increase the amounts payable under the Department of Defense death gratuity program and the Servicemembers’ Group Life Insurance program.</official-title>

<section id="HE4D2503B77AB49AC843064C22200C6B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Honoring Fallen Heroes Act of 2005</short-title></quote>.</text></section> 
<section id="H284B9E9560754E8AB3FCD9B3BD435AD"><enum>2.</enum><header>Increase in death gratuity payable with respect to members of the Armed Forces</header> 
<subsection id="H7E798B1955374D4396BFD19F6887AF37"><enum>(a)</enum><header>Amount of death gratuity</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1478">Section 1478(a)</external-xref> of title 10, United States Code, is amended by striking <quote>$12,000</quote> and inserting <quote>$100,000</quote>.</text></subsection> 
<subsection id="HFECF290311F34EDAB4864F1BA614FDF3"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply with respect to deaths occurring on or after October 1, 2000.</text></subsection> </section> 
<section id="H4291A06E6A17411A9252FE5323E000C0"><enum>3.</enum><header>Increase in coverage under Servicemembers’ Group Life Insurance program</header> 
<subsection id="H92553D9E1C8E41389FF57727C505C9D"><enum>(a)</enum><header>Insurance coverage</header><text>Paragraph (3)(A)(i) of <external-xref legal-doc="usc" parsable-cite="usc/38/1967">section 1967(a)</external-xref> of title 38, United States Code, is amended by striking <quote>$250,000</quote> and inserting <quote>$400,000</quote>.</text> </subsection> 
<subsection id="H792C47CB29154251ACEE0922A12DC900"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1967(d) of such title is amended by striking <quote>of $250,000</quote> and inserting <quote>provided for a member under subparagraph (A)(i) of subsection (a)(3)</quote>.</text></subsection> 
<subsection id="HB9C511099DF44693874800F8B8063BBB"><enum>(c)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the first day of the first month that begins more than 120 days after the date of the enactment of this Act.</text> </subsection> 
<subsection id="H94923338ECC24420930081F715975C48"><enum>(d)</enum><header>Retroactive applicability of increase in maximum SGLI benefit for members dying in performance of duty on or after October 1, 2000</header><text display-inline="yes-display-inline">Notwithstanding subsection (c), the amendment made by subsection (a) to <external-xref legal-doc="usc" parsable-cite="usc/38/1967">section 1967(a)(3)(A)(i)</external-xref> of title 38, United States Code, shall take effect as of October 1, 2000, with respect to any member of the uniformed services who died in the performance of duty (as determined by the Secretary concerned) during the period beginning on October 1, 2000, and ending at the date specified in subsection (c) and who on the date of death was insured under the Servicemembers’ Group Life Insurance program under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/19">chapter 19</external-xref> of title 38, United States Code, for the maximum coverage available under that program on that date. </text></subsection> 
<subsection id="H025B868C45E644A29EFEBE0044CED708"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HF845C2D43C5241A58244BFA5DB371886"><enum>(1)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="HE26994A27BDA4DB4BA5EA7AE48403769"><enum>(2)</enum><header>Uniformed services</header><text>The term <term>uniformed services</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/38/1965">section 1965(6)</external-xref> of title 38, United States Code.</text></paragraph></subsection></section>
