<section id="HEA978495FA2A4986B9A0E09488C713FC"><enum>102.</enum><header>Classified Schedule of Authorizations</header> 
<subsection id="HB75F25D8411842E9806EC7DEEB59E9C1"><enum>(a)</enum><header>Specifications of Amounts and Personnel Ceilings</header><text>The amounts authorized to be appropriated under section 101, and the authorized personnel ceilings as of September 30, 2007, for the conduct of the intelligence and intelligence-related activities of the elements listed in such section, are those specified in the classified Schedule of Authorizations prepared to accompany the conference report on the bill H.R. 5020 of the One Hundred Ninth Congress.</text></subsection> 
<subsection id="H78F7685C43B64723A528C78860155E1C"><enum>(b)</enum><header>Availability of Classified Schedule of Authorizations</header><text>The Schedule of Authorizations shall be made available to the Committees on Appropriations of the Senate and House of Representatives and to the President. The President shall provide for suitable distribution of the Schedule, or of appropriate portions of the Schedule, within the executive branch.</text></subsection></section> 
<section id="H2F9D5421FCB9434E9EC500668735FC00"><enum>103.</enum><header>Personnel ceiling adjustments</header> 
<subsection id="HE0A63EAC27DD4F7284DAD823DD909030"><enum>(a)</enum><header>Authority for Adjustments</header><text display-inline="yes-display-inline">With the approval of the Director of the Office of Management and Budget, the Director of National Intelligence may authorize employment of civilian personnel in excess of the number authorized for fiscal year 2007 under section 102 when the Director of National Intelligence determines that such action is necessary to the performance of important intelligence functions, except that the number of personnel employed in excess of the number authorized under such section may not, for any element of the intelligence community, exceed 2 percent of the number of civilian personnel authorized under such section for such element.</text></subsection> 
<subsection id="HFBFC77DEF8304C1800123730CD2252D6"><enum>(b)</enum><header>Notice to Intelligence Committees</header><text>The Director of National Intelligence shall promptly notify the Select Committee on Intelligence of the Senate and the Permanent Select Committee on Intelligence of the House of Representatives whenever the Director exercises the authority granted by this section.</text></subsection></section> 
<section id="HEC45C8968FC344799B42B6846C0039AB"><enum>104.</enum><header>Intelligence Community Management Account</header> 
<subsection id="H280DBBC530284BAABC86C42E692107E5"><enum>(a)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2007 the sum of $990,000,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2008.</text></subsection> 
<subsection id="H6033FBDBE96E497193A5CC723B48932"><enum>(b)</enum><header>Authorized Personnel Levels</header><text>The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized 1,539 full-time personnel as of September 30, 2007. Personnel serving in such elements may be permanent employees of the Intelligence Community Management Account or personnel detailed from other elements of the United States Government.</text></subsection> 
<subsection id="HEC1290C54B9341ECA2DC7FCE08DCE53D"><enum>(c)</enum><header>Classified Authorizations</header> 
<paragraph id="H439874CBF9C546C58C50668F70445436"><enum>(1)</enum><header>Authorization of appropriations</header><text>In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are also authorized to be appropriated for the Intelligence Community Management Account for fiscal year 2007 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 102(a). Such additional amounts for research and development shall remain available until September 30, 2007.</text></paragraph> 
<paragraph id="HDFFB5E56E35C4808BEBB1200D3C3C5C0"><enum>(2)</enum><header>Authorization of personnel</header><text>In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2007, there are also authorized such additional personnel for such elements as of that date as are specified in the classified Schedule of Authorizations.</text></paragraph></subsection> 
<subsection id="H6DD146D139CE485AAA3E814416511D97"><enum>(d)</enum><header>Reimbursement</header><text>Except as provided in section 113 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/404h">50 U.S.C. 404h</external-xref>), during fiscal year 2007 any officer or employee of the United States or a member of the Armed Forces who is detailed to the staff of the Intelligence Community Management Account from another element of the United States Government shall be detailed on a reimbursable basis, except that any such officer, employee, or member may be detailed on a nonreimbursable basis for a period of less than one year as the Director of National Intelligence considers necessary.</text></subsection></section> 
<section id="HF0A05BA4CDA94C6981D61006343D6723" display-inline="no-display-inline" section-type="subsequent-section"><enum>105.</enum><header>Incorporation of reporting requirements</header> 
<subsection id="H47ED2CA68E544E4BA023EDB5B777DCCC"><enum>(a)</enum><header>In General</header><text>Each requirement to submit a report to the congressional intelligence committees that is included in the joint explanatory statement to accompany the conference report on the bill H.R. 5020 of the One Hundred Ninth Congress, or in the classified annex to this Act, is hereby incorporated into this Act, and is hereby made a requirement in law.</text></subsection> 
<subsection id="H7A8B8B7279C24699BBBDF2DF39BCC303"><enum>(b)</enum><header>Congressional Intelligence Committees Defined</header><text>In this section, the term <term>congressional intelligence committees</term> means—</text> 
<paragraph id="H5D620512F9654224993B4692424CC653"><enum>(1)</enum><text>the Select Committee on Intelligence of the Senate; and</text></paragraph> 
<paragraph id="H3E0D89A5293043D3A48D531E92CDABC"><enum>(2)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection></section></title> 
<title id="HFC1EA7216B8E418ABA5F5D0968FBE112"><enum>II</enum><header>CENTRAL INTELLIGENCE AGENCY RETIREMENT AND DISABILITY SYSTEM</header> 
<section id="HCA3689536850432DA22496BBCB4F53F7"><enum>201.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2007 the sum of $256,400,000.</text></section></title> 
<title id="HE7AFC136AF5E40DEBDB8EAFF3CEA089"><enum>III</enum><header>INTELLIGENCE AND GENERAL INTELLIGENCE COMMUNITY MATTERS</header> 
<section id="H0CA1EC96F1204E5BB05660E2C78FB3D"><enum>301.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text></section> 
<section id="H999DEDDBF49C42258408C56BA562AC"><enum>302.</enum><header>Restriction on conduct of intelligence Activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States.</text></section> 
<section id="H9C62095C735A4C20A6B2B7817BC83670"><enum>303.</enum><header>Clarification of definition of Intelligence Community under the National Security Act of 1947</header><text display-inline="no-display-inline">Subparagraph (L) of section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>) is amended by striking <quote>other</quote> the second place it appears.</text></section> 
<section id="H7A0D9EC44AA74D7B91BA82546F6F4D7"><enum>304.</enum><header>Delegation of authority for travel on common carriers for intelligence collection personnel</header> 
<subsection id="H1963781BD0F94303B4A0F041469B6900"><enum>(a)</enum><header>Delegation of Authority</header><text>Section 116(b) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/404k">50 U.S.C. 404k(b)</external-xref>) is amended—</text> 
<paragraph id="HA34B7D1856B84E1D8F49C95B7B47EAEE"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>The Director</quote>;</text></paragraph>

<paragraph id="H2D483DDE34A646C9BCF4A8E53EE1769"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph indent="up1" id="H56119E8275384DD3004C6051B3311E1F"><enum>(2)</enum><text>The head of an element of the intelligence community to whom the authority in subsection (a) is delegated pursuant to paragraph (1) may further delegate such authority to such senior officials of such element as are specified in guidelines prescribed by the Director of National Intelligence for purposes of this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBD2FAD92CE804BB0AFF71B15E95642C6"><enum>(b)</enum><header>Submittal of Guidelines to Congress</header><text>Not later than six months after the date of the enactment of this Act, the Director of National Intelligence shall prescribe and submit to the congressional intelligence committees the guidelines referred to in paragraph (2) of section 116(b) of the National Security Act of 1947, as added by subsection (a).</text></subsection> 
<subsection id="H644C8129EB0E4818B5BF3778B8EBA4BC"><enum>(c)</enum><header>Congressional Intelligence Committees Defined</header><text>In this section, the term <term>congressional intelligence committees</term> means—</text> 
<paragraph id="HA2A2F8A6478644E893B93EB4300EBF9"><enum>(1)</enum><text>the Select Committee on Intelligence of the Senate; and</text></paragraph> 
<paragraph id="H6A37EED399EC4467A900E0285826D6BC"><enum>(2)</enum><text>the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection></section> 
<section id="H1F5179919D5543D680DFBB8389F80008"><enum>305.</enum><header>Retention and use of amounts paid as debts to Elements of the Intelligence Community</header> 
<subsection id="H1C5123F5FED44FA18E66E9B4B8C2B9A3"><enum>(a)</enum><header>In General</header><text>Title XI of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/442">50 U.S.C. 442 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H7FEADE5739FB4AB9B9472E0013A9F83B"><enum>1103.</enum><header>Retention and use of amounts paid as debts to Elements of the Intelligence Community</header> 
<subsection display-inline="yes-display-inline" id="H05D1D20458414E3F9834E207F484B1D4"><enum>(a)</enum><header>Authority To Retain Amounts Paid</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, United States Code, or any other provision of law, the head of an element of the intelligence community may retain amounts paid or reimbursed to the United States, including amounts paid by an employee of the Federal Government from personal funds, for repayment of a debt owed to the element of the intelligence community.</text></subsection> 
<subsection id="HECDE375CA9F04F21A3E48BC989254000"><enum>(b)</enum><header>Crediting of Amounts Retained</header> 
<paragraph display-inline="yes-display-inline" id="HCC092120DD254D6F823200CD278E1C4E"><enum>(1)</enum><text>Amounts retained under subsection (a) shall be credited to the current appropriation or account from which such funds were derived or whose expenditure formed the basis for the underlying activity from which the debt concerned arose.</text></paragraph> 
<paragraph indent="up1" id="HFFED15BB49FB455CBD90D6AFFCB77988"><enum>(2)</enum><text>Amounts credited to an appropriation or account under paragraph (1) shall be merged with amounts in such appropriation or account, and shall be available in accordance with subsection (c).</text></paragraph></subsection> 
<subsection id="H75658638BF1E4485B8AE10D0964752BD"><enum>(c)</enum><header>Availability of Amounts</header><text>Amounts credited to an appropriation or account under subsection (b) with respect to a debt owed to an element of the intelligence community shall be available to the head of such element, for such time as is applicable to amounts in such appropriation or account, or such longer time as may be provided by law, for purposes as follows:</text> 
<paragraph id="H07769EE4AC64431081CC5BFFD465049B"><enum>(1)</enum><text>In the case of a debt arising from lost or damaged property of such element, the repair of such property or the replacement of such property with alternative property that will perform the same or similar functions as such property.</text></paragraph> 
<paragraph id="H839EFF8526E149988411C1B0A4DE0912"><enum>(2)</enum><text>The funding of any other activities authorized to be funded by such appropriation or account.</text></paragraph></subsection> 
<subsection id="HADC501336C314D9DB6070579072C4808"><enum>(d)</enum><header>Debt Owed to an Element of the Intelligence Community Defined</header><text>In this section, the term <term>debt owed to an element of the intelligence community</term> means any of the following:</text> 
<paragraph id="HB50DA0C33B654EE9A71D10E2B4001123"><enum>(1)</enum><text>A debt owed to an element of the intelligence community by an employee or former employee of such element for the negligent or willful loss of or damage to property of such element that was procured by such element using appropriated funds.</text></paragraph> 
<paragraph id="H2814ADB85E3B48AB951881C9CB17BB2"><enum>(2)</enum><text>A debt owed to an element of the intelligence community by an employee or former employee of such element as repayment for default on the terms and conditions associated with a scholarship, fellowship, or other educational assistance provided to such individual by such element, whether in exchange for future services or otherwise, using appropriated funds.</text></paragraph> 
<paragraph id="HF5C3672A7BEE47B29DAFD8A030E724BF"><enum>(3)</enum><text>Any other debt or repayment owed to an element of the intelligence community by a private person or entity by reason of the negligent or willful action of such person or entity, as determined by a court of competent jurisdiction or in a lawful administrative proceeding.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBFB92B359EA14ADCA67BA1386CA9F2F"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of contents in the first section of that Act is amended by adding at the end the following new item:</text>

<subsection id="H25E183BA50D647738D1123343E7EE4E"><enum>(a)</enum><header>Funds of Office of Director of National Intelligence</header><text>Funds appropriated to the Office of the Director of National Intelligence and available for travel and transportation expenses shall be available for such expenses when any part of the travel or transportation concerned begins in a fiscal year pursuant to travel orders issued in such fiscal year, notwithstanding that such travel or transportation is or may not be completed during such fiscal year.</text></subsection> 
<subsection id="H750CF373CA944AC0BAD0F5695983EF2D"><enum>(b)</enum><header>Funds of Central Intelligence Agency</header><text>Funds appropriated to the Central Intelligence Agency and available for travel and transportation expenses shall be available for such expenses when any part of the travel or transportation concerned begins in a fiscal year pursuant to travel orders issued in such fiscal year, notwithstanding that such travel or transportation is or may not be completed during such fiscal year.</text></subsection> 
<subsection id="H73D93AB48B3D4C689600EE2B5F8C06AD"><enum>(c)</enum><header>Travel and Transportation Expenses Defined</header><text>In this section, the term <term>travel and transportation expenses</term> means the following:</text>

<subsection id="H30EA816BE46048899BE42FBEBF65549F"><enum>(c)</enum><header>Report</header> 
<paragraph display-inline="yes-display-inline" id="H173EBD3884404CCC809BF1C0C3FCC81D"><enum>(1)</enum><text>Not later than June 30, 2007, the Director of National Intelligence shall submit to Congress a report containing a strategy for the development and use of technology in the intelligence community through 2021.</text></paragraph> 
<paragraph indent="up1" id="H355A2E2905494F879EE7E70892DDDEB3"><enum>(2)</enum><text>The report shall include—</text> 
<subparagraph id="HB9B0B330DB604D91BFECA27E3178EBA6"><enum>(A)</enum><text>an assessment of the highest priority intelligence gaps across the intelligence community that may be resolved by the use of technology;</text></subparagraph> 
<subparagraph id="HDD80CF0B0C4C4A0B9B606F80B46B8651"><enum>(B)</enum><text>goals for advanced research and development and a strategy to achieve such goals;</text></subparagraph> 
<subparagraph id="H0242A6C372284D3DAF252BD100634002"><enum>(C)</enum><text>an explanation of how each advanced research and development project funded under the National Intelligence Program addresses an identified intelligence gap;</text></subparagraph> 
<subparagraph id="HDC6723CF262543A7B65600171D446875"><enum>(D)</enum><text>a list of all current and projected research and development projects by research type (basic, advanced, or applied) with estimated funding levels, estimated initiation dates, and estimated completion dates; and</text></subparagraph> 
<subparagraph id="H7BA46A4590084156B6DA1653EECBDD13"><enum>(E)</enum><text>a plan to incorporate technology from research and development projects into National Intelligence Program acquisition programs.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H893D7DDAFA4E4230A213AFD55FC975E1"><enum>(3)</enum><text>The report may be submitted in classified form.</text></paragraph></subsection></section>

<section id="H9E21A90B53A04C0AB86E9EB5583938D0"><enum>410.</enum><header>Comprehensive inventory of special access programs</header><text display-inline="no-display-inline">Not later than January 15, 2007, the Director of National Intelligence shall submit to the congressional intelligence committees (as defined in section 3(7) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(7)</external-xref>)) a classified report providing a comprehensive inventory of all special access programs under the National Intelligence Program (as defined in section 3(6) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(6)</external-xref>)).</text></section> 
<section id="H4D97515E38744AF3822900DC8B7C76EA"><enum>411.</enum><header>Sense of Congress on multi-level security clearances</header><text display-inline="no-display-inline">It is the sense of Congress that the Director of National Intelligence should promptly establish and oversee the implementation of a multi-level security clearance system across the intelligence community to leverage the cultural and linguistic skills of subject matter experts and individuals proficient in foreign languages critical to national security.</text></section> 
<section id="HD2657F6A4B35497584E703EAB0CD5256"><enum>412.</enum><header>Access to information by staff and members of the congressional intelligence committees</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall provide to the members and staff of the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate accounts for and access to the Intelink System (or any successor system) through the Joint Worldwide Intelligence Communications System (or any successor system). Such access shall include access up to and including the level of sensitive compartmented information and shall be provided in the sensitive compartmented information facilities of each Committee.</text></section> 
<section id="HE8A13BC692D84CA5855244F9A161A242" section-type="subsequent-section"><enum>413.</enum><header>Study on revoking pensions of persons who commit unauthorized disclosures of classified information</header> 
<subsection id="HDC392709251A4BC59929D28491597197"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Director of National Intelligence shall conduct a study on the feasibility of revoking the pensions of personnel in the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>)) who commit unauthorized disclosures of classified information, including whether revoking such pensions is feasible under existing law or under the administrative authority of the Director of National Intelligence or any other head of an element of the intelligence community.</text></subsection> 
<subsection id="H7C03F9CD152F464EA34BC2C100D4600"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the Permanent Select Committee on Intelligence of the House of Representatives and the Select Committee on Intelligence of the Senate a report containing the results of the study conducted under subsection (a).</text></subsection></section></subtitle>

<subsection id="HDCA254A2887445FC80AF3774911188E"><enum>(b)</enum><text display-inline="yes-display-inline"> The powers granted under subsection (a) may be exercised only in accordance with guidelines approved by the Attorney General.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>

<subsection id="HF295F5B6D97C46618011F1A2C970396D" display-inline="yes-display-inline"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the head of an element of the intelligence community may not provide personnel for the protection of a former official of an element of the intelligence community unless—</text> 
<paragraph id="HA751C8F9EA634E5398508F80CE4C724B" indent="up1"><enum>(1)</enum><text>there is a specific and credible threat to such former official arising from the service of such former official to the United States; and</text></paragraph> 
<paragraph id="H5AE65497580047CCBBE26EC054BE942F" indent="up1"><enum>(2)</enum><text>such head of an element of the intelligence community submits to the Director of National Intelligence notice of the intention to provide such personnel and an assessment of—</text> 
<subparagraph id="H56554DADAEE848DDA8C1A64EABFB54E9"><enum>(A)</enum><text>the threat to such former official; and</text></subparagraph> 
<subparagraph id="HE6777F77AA114E77A393F88961BB5177"><enum>(B)</enum><text>the level of protective services necessary to protect such former official based on such threat.</text></subparagraph></paragraph></subsection> 
<subsection id="H3323FA5F12B1433898B19C9B7DAF887E"><enum>(b)</enum><header>Exception for recent termination of employment</header><text display-inline="yes-display-inline">The head of an element of the intelligence community may provide personnel for the protection of a former official of an element of the intelligence community without a specific and credible threat to such former official for not more than one year after the termination of the employment of such former official if such former official requests such protection.</text></subsection> 
<subsection id="HBA13702B2119430792B7CDD066EE7108"><enum>(c)</enum><header>Threat assessment updates</header><text>Not later than 180 days after the date on which the head of an element of the intelligence community begins providing personnel for the protection of a former official of an element of the intelligence community, and at least every 180 days thereafter until such head of an element of the intelligence community determines that there is no longer a threat to such former official, such head of an element of the intelligence community shall submit to the Director of National Intelligence an updated assessment of the threat to such former official and the level of protective services necessary to protect such former official based on such threat.</text></subsection> 
<subsection id="HAD0F4685C2974E1DAD7C9479A704081"><enum>(d)</enum><header>Termination of protective services</header><text>If the head of an element of the intelligence community that is providing personnel for the protection of a former official of an element of the intelligence community pursuant to subsection (a) determines that there is no longer a threat to such former official, such head of an element of the intelligence community shall cease providing personnel for the protection of such former official not later than 30 days after determining such threat no longer exists.</text></subsection> 
<subsection id="HD75A2D74CAE84F2AA3952CF92F9B221C"><enum>(e)</enum><header>Report</header><text>Not later than 7 days after the date on which the head of an element of the intelligence community begins providing personnel for the protection of a former official of an element of the intelligence community, the Director of National Intelligence shall submit to the congressional intelligence committees notice of the provision of personnel for the protection of such former official.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H7D48194508914D5E9E8193FACC4C53C"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Defense shall conduct a study of aerial reconnaissance platforms to determine whether the Global Hawk RQ–4 unmanned aerial vehicle has reached mission capability and has attained collection capabilities on a par with the collection capabilities of the U-2 Block 20 aircraft program as of April 1, 2006.</text></paragraph>
