<section id="H9E847A49A8B44DC59DD59B6116C7DF8" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ryan White CARE Act Amendments of 2006</short-title></quote>.</text></section> 
<section id="HD3CB3D01FBF64920A56E437D6F589D94"><enum>2.</enum><header>Reauthorization of appropriations</header><text display-inline="no-display-inline">Title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-11">42 U.S.C. 300ff–11 et seq.</external-xref>) is amended—</text> 
<paragraph id="H116FAE0011524B14AAB3C7051404D622"><enum>(1)</enum><text>in section 2677—</text> 
<subparagraph id="H1F543972A93F4BB992F3E0BAFB8F41C1"><enum>(A)</enum><text>in subsection (a), by striking <quote>2001 through 2005</quote> and inserting <quote>2006 through 2010</quote>; and</text></subparagraph>

<section id="H4B5065BE58FB480D8456EC3563F2C6E"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2676 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-76">42 U.S.C. 300ff–76</external-xref>) is amended—</text> 
<paragraph id="H0ED0C1D9EC24440F878BB404EAAF22BB"><enum>(1)</enum><text>by redesignating paragraphs (11) and (12), as paragraphs (12) and (15), respectively;</text></paragraph> 
<paragraph id="H0B31C7AA15864635A153492CF4929CE"><enum>(2)</enum><text>by inserting after paragraph (10) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H74D15E7DD286401B91F5BFFE286BA4A2" style="OLC"> 
<paragraph id="H5FE4640640E34B04B59850BA5F54414"><enum>(11)</enum><header>Partner notification</header><text>The term <term>partner notification</term> means the process by which—</text> 
<subparagraph id="H9FB75798BCF04205A9DF0760BEDF9354"><enum>(A)</enum><text>an HIV-positive individual provides the names of such individual's sex and needle-sharing partners to health care providers or other health workers, who then confidentially notify the partners directly of the partners' exposure to HIV; and</text></subparagraph> 
<subparagraph id="H7AAA3D6960FE4D6DBB61DA0985FBCD5C"><enum>(B)</enum><text>current and past partners of an HIV-positive individual (index person) are confidentially notified of the partners' exposure to HIV, counseled about the partners' exposure, and offered services, including testing, referrals for treatment, and notification of the partners' sex and needle-sharing partners.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF748B6264DCA44489D4B2E7790069E40"><enum>(3)</enum><text>by inserting after paragraph (12) (as redesignated by paragraph (1)) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H9C484C9BC7EE4748AAA2FAED39ECA855" style="OLC"> 
<paragraph id="HDFB5529FC67B4D6DAC1B14EB40CDC3BE"><enum>(13)</enum><header>Primary medical care</header><text>The term <quote>primary medical care</quote> means medical care that consists of medication, prescription drugs, diagnostic tests, visits with physicians and medically credentialed health care providers, treatment for oral health, treatment for psychiatric conditions, and treatment for other health care conditions directly related to HIV/AIDS infection, as well as the cost of health insurance premiums, co-payments, and deductibles. Such term does not include case management for non-medical services or short-term transitional housing.</text></paragraph> 
<paragraph id="HB5289E577F844171AB9DA3B656005974"><enum>(14)</enum><header>Routine testing</header><text>The term <quote>routine testing</quote> means HIV testing—</text> 
<subparagraph id="H58E1FC0B231640E498BC0019AB416CCE"><enum>(A)</enum><text>that is administered automatically to those accessing health care services for any reason; and</text></subparagraph> 
<subparagraph id="H37C053BE4CBB4BDA95CA667BF6F9DADF"><enum>(B)</enum><text>in which—</text> 
<clause id="H3F7BC97B0DC041E48FE11C5B45E2E02"><enum>(i)</enum><text>pre-test counseling is not required but the subject is notified that the subject will receive an HIV test and the subject may opt out of such testing; and</text></clause> 
<clause id="H5C9EC435175243F4ACF52557365B424C"><enum>(ii)</enum><text>for those individuals with a positive test result, post-test counseling, including referrals to care, is provided and confidentiality is protected.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H2487B8484C354415B017327F94812D8C"><enum>4.</enum><header>Funding for primary medical care</header> 
<subsection id="H899A25C9E4A84C73B1D25759D1285E2E"><enum>(a)</enum><header>Part a</header><text>Section 2604 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-14">42 U.S.C. 300ff–14</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H79ACD375A4714A3A9570E859C529CFFD" style="OLC"> 
<subsection id="H08E80390AA644B4B9389B256C1EFE540"><enum>(h)</enum><header>Required funding for primary medical care</header><text>Notwithstanding any other provision of law, a grantee under this part shall expend not less than 75 percent of the funds received under the grant on primary medical care.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H38DC2F2F38E44C9CAB439CC6D42FFE5D"><enum>(b)</enum><header>Part b</header><text>Section 2612 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-22">42 U.S.C. 300ff–22</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H47F0AC797BE944FFA56943FAC8B21100"><enum>(e)</enum><header>Required funding for primary medical care</header><text>Notwithstanding any other provision of law, a grantee under this part shall expend not less than 75 percent of the funds received under the grant on primary medical care.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC5713CCB88294B7D87E9AB952C4C00B9"><enum>(c)</enum><header>Part c</header><text>Subpart II of part C of title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-61">42 U.S.C. 300ff–61 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H3D67D58C91804E4B88E7FB302DC83DE3"><enum>2668.</enum><header>Required funding for primary medical care</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a grantee under this part shall expend not less than 75 percent of the funds received under the grant on primary medical care. Grant funds expended for the services described in subparagraphs (B) through (E) of section 2651(b)(2) shall count as expenditures on primary medical care.</text></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection> 
<subsection id="HDE4150F002514304AFA5F1B36C8BE08D"><enum>(d)</enum><header>Grants for coordinated services and access to research for women, infants, children, and youth</header><text>Section 2671 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-71">42 U.S.C. 300ff–71</external-xref>) is amended—</text> 
<paragraph id="HD84A9DABB36C4A8F9B691E66DD87F3C5"><enum>(1)</enum><text>by redesignating subsection (k) as subsection (l); and</text></paragraph> 
<paragraph id="H47D400C694A740E182B4F3D20CC1C52"><enum>(2)</enum><text>by inserting after subsection (j) the following:</text>

<section id="H8FEF816F135C40B896CD0206D7E2D9AC"><enum>5.</enum><header>Supplemental treatment drug grants safety net</header> 
<subsection id="H97081AAC8C01401A94197B88DBC43CAF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2618(a)(2)(I)(ii) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-28">42 U.S.C. 300ff–28(a)(2)(I)(ii)</external-xref>) is amended by striking subclauses (V) and (VI) and inserting the following:</text>

<subclause id="H7719744099F14E45A3C825111DE414BD"><enum>(V)</enum><header>Funding</header> 
<item id="H0BE6B79EB99E4DAEBF4891D15431A5B8"><enum>(aa)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this clause for a fiscal year an amount that is not more than 8 percent of the amount appropriated to carry out section 2616 for such fiscal year.</text></item> 
<item id="H750BFA2B037E4F869F2FBBEB28D106B"><enum>(bb)</enum><header>Transfer of funds when appropriations are insufficient</header> 
<subitem id="HF25A7FF2CB204C89BDFCE1204C15C38"><enum>(AA)</enum><header>In general</header><text>For any fiscal year for which the amount appropriated to carry out this clause and the amount redistributed to carry out this clause pursuant to section 2679 total less than 5 percent of the amount appropriated to carry out section 2616 for such fiscal year, the Secretary shall transfer from funds appropriated to carry out this part (except this section) and parts A, C, D, E, and F, for the fiscal year and in accordance with subitem (BB), such amounts as are necessary to make the lesser of $35,000,000 or 5 percent of the amount appropriated to carry out section 2616 for such fiscal year, available to carry out this clause for such fiscal year.</text></subitem> 
<subitem id="HBF5013397CC043DDBE00D0BCF9F48E50"><enum>(BB)</enum><header>Formula for the transfer of funds</header><text>In carrying out subitem (AA) for a fiscal year, the Secretary shall transfer from each part under this title an amount, from the amount of funds appropriated for such part for the fiscal year, that bears the same relation to the total amount required to be transferred under subitem (AA) for the fiscal year, as the amount of funds appropriated to carry out such part for the fiscal year bears to the total amount of funds appropriated to carry out this title for such fiscal year.</text></subitem> 
<subitem id="H4CBBFAEFD2044FFCB12E5FB463150733"><enum>(CC)</enum><header>Additional amounts from HRSA</header><text>In addition to transferring funds under subitem (AA), the Secretary may transfer, for any fiscal year for which the amount appropriated to carry out this clause is less than $35,000,000, not more than $5,000,000 from administrative funds of the Health Resources and Services Administration of the Department of Health and Human Services to carry out this clause.</text></subitem></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE5CE9CE2B4CD46FA8FC893F3199D21D5"><enum>(b)</enum><header>Return of unobligated funds</header> 
<paragraph id="HE099E649035349789FE9126C4DE65E2C"><enum>(1)</enum><header>In general</header><text>Part D of title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-71">42 U.S.C. 300ff–71 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H314AA55642064F3BB27E2D51FE4C1EDA" style="OLC"> 
<section id="H8BACB93E968B4D01984688286C6B9F75"><enum>2679.</enum><header>Unobligated funds used for supplemental treatment drug grants</header><text display-inline="no-display-inline">Notwithstanding any other provision of this title, any funds received under this title during a fiscal year that remain unobligated at the end of the second fiscal year succeeding the fiscal year during which the funds were received shall be returned to the Administrator of the Health Resources and Services Administration who shall redistribute such funds to carry out section 2618(a)(2)(C)(ii).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H271ABED5E6384E19BD6800449790156F"><enum>(2)</enum><header>Conforming amendments</header><text>Section 2618 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-28">42 U.S.C. 300ff–28</external-xref>) is amended—</text> 
<subparagraph id="HF08170AA3F054B2A8B00622F4243805D"><enum>(A)</enum><text>in subsection (a)(2)(I)(ii)(I) by striking <quote>subclause (V)</quote> and inserting <quote>subclause (V) and section 2679</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF629FCB1F2EE46068FD9C02667023F35"><enum>(B)</enum><text>by striking subsection (d).</text></subparagraph></paragraph></subsection></section>

<subsection id="H4D883421356E45C989BFBFB7FAB80000"><enum>(a)</enum><header>Distribution of funds</header><text>Section 2618(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-28">42 U.S.C. 300ff–28(a)</external-xref>) is amended—</text> 
<paragraph id="HD19C5E4E94F644FA90E051C667ABFB49"><enum>(1)</enum><text>in paragraph (1)(A)—</text> 
<subparagraph id="H761895C785CE4D3200FECCB0A93DDB85"><enum>(A)</enum><text>in clause (i)—</text>

<clause id="H4AAECB959579434794D0D3AD5D3AD1"><enum>(i)</enum><header>In general</header><text>The amount referred to in paragraph (1)(A)(ii) for a State and paragraph (1)(B) for a territory of the United States shall be determined—</text> 
<subclause id="HCF1E5DE500484725B4FCAB9CF6FB46A1"><enum>(I)</enum><text>for fiscal year 2007, according to the formula under this paragraph as in effect on the day before the date of enactment of the Ryan White CARE Act Amendments of 2006; and</text></subclause> 
<subclause id="HDE4C161BCEA246CBB300654D539B29F9"><enum>(II)</enum><text>for fiscal year 2008 and each succeeding fiscal year, according to the formula described in clause (ii).</text></subclause></clause> 
<clause id="H539AFBB4294C47ACB40479715C3B38BF"><enum>(ii)</enum><header>Amount based on cases not counted under part A</header><text>A State or territory of the United States shall receive an amount under this part for a fiscal year that bears the same relation to the amount appropriated under section 2677(b) for grants under this part for the fiscal year as the number of cases determined under clause (iii) for the State or territory for such fiscal year bears to the total number of cases determined under clause (iii) for all States and territories for such fiscal year.</text></clause> 
<clause id="H5D9162E5916D4A0FB7F8FB8E1803A355"><enum>(iii)</enum><header>Number of cases</header> 
<subclause id="H63AEB27A3A4D4B83BDF95BC75D8CF6B3"><enum>(I)</enum><header>Reporting system in effect prior to October 2000</header><text>In the case of a State or territory that has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention prior to October 1, 2000, the number of cases under this clause for such State or territory for a fiscal year shall be equal to the total number of reported cases of HIV disease (reported to and confirmed as accurate by the Director of the Centers for Disease Control and Prevention) living in the State or territory during such year, minus the number of reported cases of HIV disease (reported to and confirmed as accurate by the Director of the Centers for Disease Control and Prevention) living in such State or territory that are within an eligible area (as determined under part A).</text></subclause> 
<subclause id="H4BA16ACA15F74C7C8657E09982FE0018"><enum>(II)</enum><header>Reporting system in effect prior to October 2006 but after October 2000</header><text>In the case of a State or territory that has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention prior to October 1, 2006, but on or after October 1, 2000, the number of cases under this clause for such State or territory for a fiscal year shall be equal to the total number of cases of HIV disease (estimated by the Director of the Centers for Disease Control and Prevention) living in the State or territory during such year, minus the number of cases of HIV disease (estimated by the Director of the Centers for Disease Control and Prevention) living in such State or territory that are within an eligible area (as determined under part A).</text></subclause> 
<subclause id="HEB36AD68440E4C91A1F44F819D11F166"><enum>(III)</enum><header>Reporting system not in effect by October 2006</header><text>In the case of a State or territory that has not enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention prior to October 1, 2006, the number of cases under this clause for such State or territory for a fiscal year shall be equal to—</text> 
<item id="HC27C9A7E0D614290B670AABF89374873"><enum>(aa)</enum><text>until such time as such State or territory has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention, the total number of reported cases of acquired immune deficiency syndrome (reported to and confirmed as accurate by the Director of the Centers for Disease Control and Prevention) living in the State or territory during such year, minus the number of reported cases of acquired immune deficiency syndrome (reported to and confirmed as accurate by the Director of the Centers for Disease Control and Prevention) living in such State or territory that are within an eligible area (as determined under part A); and</text></item>

<paragraph id="HE7F782AAE16446F5967BB004EADD169"><enum>(2)</enum><header>Metropolitan areas to remain eligible areas until 2 consecutive years of not qualifying as an eligible area</header><text>Notwithstanding any other provision of this section except as provided in paragraph (1), a metropolitan area shall be deemed an eligible area under this section until such time as such metropolitan area does not meet the qualifications of an eligible area as described in this section for 2 consecutive years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" id="HB12AD8CB78954A919D66D4BE5D5C6BFA"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on October 1, 2007.</text></paragraph></subsection> 
<subsection id="H5CA94BC028E743A0BD775F22EA33C5EC"><enum>(b)</enum><header>Type and distribution of grants</header><text>Section 2603(a)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-13">42 U.S.C. 300ff–13(a)</external-xref>) is amended—</text>

<clause id="H57953008081B48DE8F4900E122CE8BF"><enum>(ii)</enum><text>for fiscal year 2008, in the case of an eligible area in a protection period for such fiscal year, the Secretary shall increase the amount of the grant made pursuant to paragraph (2) for the area to ensure that the grant is not less than 25 percent of the amount of the grant made for the eligible area pursuant to such paragraph for the base year for the protection period; and</text></clause> 
<clause id="H63C2E1DC975F4B37AE46C47D289BB51D"><enum>(iii)</enum><text>for fiscal year 2009 and each succeeding fiscal year, in the case of an eligible area in a protection period for such fiscal year, the Secretary shall not increase the amount of the grant pursuant to this paragraph.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H16D33C4B54D3405BBF488E5BA9914F00"><enum>8.</enum><header>Prohibition on funding for entities that prohibit or impose barriers on partner notification</header><text display-inline="no-display-inline">Part D of title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-71">42 U.S.C. 300ff–71 et seq.</external-xref>), as amended by section 5, is further amended by adding at the end the following:</text>

<subsection id="H7394C47FBC6A4663B97DAD1D443F66CE"><enum>(b)</enum><header>Pregnant women and newborns</header><text>The Secretary shall require—</text> 
<paragraph id="HAB3B66B243E2453800147F8CC45382C6"><enum>(1)</enum><text>a health facility receiving Federal funds or a Federal health program (including a program supported under this title) that is treating a pregnant woman to offer to such woman routine testing; and</text></paragraph> 
<paragraph id="HE2B61426F7BE492AABAABDCC8B6FB76F"><enum>(2)</enum><text>a health facility receiving Federal funds or a Federal health program (including a program supported under this title) that is treating a newborn to offer to the parents of such newborn rapid routine testing of such newborn if such newborn's mother's HIV status is unknown.</text></paragraph></subsection> 
<subsection id="HBA9968C3F0854D31BC972D899198556F"><enum>(c)</enum><header>Counseling and treatment</header><text>An entity or program that conducts routine testing pursuant to this section shall provide to each individual tested pursuant to this section who tests positive for HIV antibodies, appropriate counseling and referral into treatment in a timely manner.</text></subsection> 
<subsection id="HF030122BE3654E5A9C91F1259600D433"><enum>(d)</enum><header>Testing</header><text>The Director of the Centers for Disease Control and Prevention shall annually purchase and distribute not less than 1,500,000 rapid HIV tests, including tests that are oral based.</text></subsection> 
<subsection id="H0F0D1E259EEA4A1EBD59221CECBA00B5"><enum>(e)</enum><header>State or local prohibitions</header><text>Beginning 25 months after the date of enactment of this section, a State or locality that prohibits or imposes significant administrative, statutory, regulatory, or practical barriers to routine testing as described in this section shall not be eligible to receive funds under this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6F9A2C46B64040028DF9AA487230928C"><enum>(b)</enum><header>CDC guidelines for pregnant women</header><text>Section 2625 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-33">42 U.S.C. 300ff–33</external-xref>) is amended—</text> 
<paragraph id="H1499233F293840B9BB551D65A1A0E25D"><enum>(1)</enum><text>in subsection (a), by striking <quote>voluntary</quote> and inserting <quote>routine</quote>; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB7051E30276A498EB643DCA31FC7FE55"><enum>(2)</enum><text>in subsection (c)(1)(C), by striking <quote>voluntary HIV testing for such disease</quote> and inserting <quote>routine testing</quote>.</text></paragraph></subsection></section> 
<section id="H0A94825B4A7248BBA53F341268C8E082"><enum>13.</enum><header>ADAP recommended formulary and report card</header><text display-inline="no-display-inline">Section 2616 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-26">42 U.S.C. 300ff–26</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H66BA43E07C92418E93E8E796C68DEF5C" style="OLC"> 
<subsection id="H82628232109C4386B49B05E89381AEA1"><enum>(f)</enum><header>Recommendations for minimum standard formulary and annual report</header> 
<paragraph id="H507C0FB671224188A8C04825B5E17DF0"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary shall issue guidelines that provide recommendations for therapeutics described in subsection (a) that shall, at a minimum, be included in the formularies that are maintained by the States for purposes of this section.</text></paragraph> 
<paragraph id="HC6B4C59BD9AC47479900A9BF8548FE3"><enum>(2)</enum><header>Annual reports</header><text>Not later than May 31 of each year, the Secretary shall submit to Congress a report that, with respect to the program under this section, specifies the following:</text> 
<subparagraph id="H746F5C5822204041A51EF8196C5B08B"><enum>(A)</enum><text>For each State:</text> 
<clause id="H5460640DB0AC4564A405DCDF417841C2"><enum>(i)</enum><text>The number of patients who have requested therapeutics described in subsection (a) from the program as carried out in the State, but are on a waiting list because such program does not have the capacity to serve the patients.</text></clause> 
<clause id="H73687BE78730418598A09800FF1D59C1"><enum>(ii)</enum><text>If patients on the waiting list are receiving such therapeutics, the sources from which the patients are obtaining the therapeutics.</text></clause> 
<clause id="H2679CC9E39AC4EBC8E5B9C7F00E06C39"><enum>(iii)</enum><text>The estimated cost to provide the amount of therapeutics that would be necessary to serve all patients on the waiting list and thereby eliminate the wait in the State.</text></clause> 
<clause id="H18C4285BB5D3462783B5E7E995E3AAF0"><enum>(iv)</enum><text>Each source of funds that, in addition to funds appropriated to carry out this part, is used by the State to provide therapeutics under the program.</text></clause></subparagraph> 
<subparagraph id="HB12F159BC73C4F65A7CAAF8D5B288F38"><enum>(B)</enum><text>Each State whose formulary maintained for purposes of the program does not meet the recommendations of the Secretary under paragraph (1).</text></subparagraph> 
<subparagraph id="HFA49F479C58A47DFA3C29F6D75BD1FAE"><enum>(C)</enum><text>The actions being taken by States with such waiting lists to reduce the number of patients on the lists, including any restrictions imposed by the States on the number or quantity of therapeutics made available under the program.</text></subparagraph> 
<subparagraph id="H0CA15E8F496742FFA0BCB9270068C385"><enum>(D)</enum><text>The amount of funds each State receives under this title and how such funds have been allocated among each of the following categories:</text> 
<clause id="HC8D4910CF6FD40C0B44E4CB1BE7100E0"><enum>(i)</enum><text>Therapeutics.</text></clause> 
<clause id="HE75CF7A2DE4F41D3ADE3B860E568B881"><enum>(ii)</enum><text>Primary medical care, including medical evaluations and physician services.</text></clause> 
<clause id="H16E0D29E76E84E42B3398E158633A617"><enum>(iii)</enum><text>Support services, administrative costs, and other expenses not included in clause (i) or (ii).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H26451AC861414F5DB687E993FE78BC74"><enum>14.</enum><header>State flexibility in providing HIV/AIDS care</header> 
<subsection id="H60A8E89A14AC4CA3936F266036F15C1B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2612 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-22">42 U.S.C. 300ff–22</external-xref>), as amended by section 4, is further amended by adding at the end the following:</text>

<subsection id="HA72BB7267BC2474680DAA5F46C437E"><enum>(f)</enum><header>State flexibility in providing HIV/AIDS care</header><text>Upon approval by the Secretary, a State may use amounts provided under a grant made under this part for providing medical assistance to individuals who are eligible for assistance under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) and are HIV-positive.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA8BAB62A5C34439BA28C3E2200DB643B"><enum>(b)</enum><header>Supplement, not supplant</header><text>Part D of title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-71">42 U.S.C. 300ff–71 et seq.</external-xref>), as amended by sections 5, 8, and 12, is further amended by adding at the end the following:</text>

<section id="H0D11666BC60947E9A1A753DB3C00B184"><enum>2679C.</enum><header>Supplement, not supplant State medicaid funding</header><text display-inline="no-display-inline">Funds received by a State under this title shall be used to supplement, and not supplant, State funds that would otherwise be used for the State share of expenditures under a State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) for providing medical assistance to individuals who are eligible for such assistance and are HIV-positive.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HFADA1CEF999348D1B4EE87B2810A428"><enum>15.</enum><header>Prices paid for therapeutics for ADAP</header> 
<subsection id="H77F92015D68D4DDE9BC1AE83AEBE96A8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2616 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-26">42 U.S.C. 300ff–26</external-xref>), as amended by section 13, is further amended by adding at the end the following:</text>

<subsection id="H0ECC9305B21147AA840368012E8C48E4"><enum>(b)</enum><header>Coordination of all therapeutic purchases through ADAP</header><text>Part D of title XXVI of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-71">42 U.S.C. 300ff–71 et seq.</external-xref>), as amended by sections 5, 8, 12, and 14, is further amended by adding at the end the following:</text>

<section commented="no" id="H937829F851CF42A787944923A7A179E"><enum>2679D.</enum><header>Coordination of all therapeutic purchases through ADAP</header><text display-inline="no-display-inline">In any purchases of therapeutics to treat HIV disease pursuant to a program that receives Federal assistance under this title, an entity shall coordinate such purchases through the program described in section 2616 in order to ensure that the recipients of the therapeutics are receiving the best possible price for the therapeutics.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H91F1763C1FB44007B3EDF913668552C7"><enum>16.</enum><header>Authorization of appropriations for ADAP</header><text display-inline="no-display-inline">Section 2616 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-26">42 U.S.C. 300ff–26</external-xref>), as amended by sections 13 and 15, is further amended by adding at the end the following:</text>

<section id="H98930201AA7A42B68DCD8953EFA503F"><enum>17.</enum><header>Special projects of national significance</header><text display-inline="no-display-inline">Section 2691 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-101">42 U.S.C. 300ff–101</external-xref>) is amended—</text> 
<paragraph id="HC3778162446B47E791F2FE3BC9341FE2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>the greater of $20,000,000 or 3 percent of such amount appropriated under each such part, but not to exceed $25,000,000,</quote> and inserting <quote>not more than $15,000,000</quote>; and</text></paragraph> 
<paragraph id="HBB684F8F0B954AE9B900975FF486ADD3"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

<subsection id="H702B1FE13D2949FDA578DBD2BA8CEDDF"><enum>(h)</enum><header>Pilot programs</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall use funds available under this section to conduct not less than 5 pilot programs to evaluate various forms of partner notification programs, including attitudes of source patients and those being notified towards such services and the cost effectiveness of such programs.</text></subsection> 
<subsection id="H1B2CD3E0E46C4254A619CC29215E4FF0"><enum>(i)</enum><header>Standard electronic client information data system</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall use funds available under this section to develop a standard electronic client information data system to improve coordination of coverage provided to patients under programs supported under this title, as well as programs under the medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) and the medicaid program under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>).</text></subsection> 
<subsection id="H4AF7AB28EFA34FDE9E712952FF90B01B"><enum>(j)</enum><header>Study</header><text>The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall use funds available under this section to conduct a study to develop recommendations for best primary medical care practices for disease management for those living with HIV disease or AIDS.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H14799F8DA3B14A89B8FA2749B5EDF3A5"><enum>18.</enum><header>Housing opportunities for persons with HIV/AIDS</header> 
<subsection id="H34108975943F4A48BA81C14D24209200"><enum>(a)</enum><header>HOPWA formula amendments</header><text display-inline="yes-display-inline">Section 854(c) of the AIDS Housing Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12903">42 U.S.C. 12903(c)</external-xref>) is amended—</text> 
<paragraph id="HF730CBE3E8CD4937A1C5A5BB7C6B3F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>

<subsection id="HE5E8249C0CE945E2BB879F78D9097ED2"><enum>(b)</enum><header>Transition formula and exception to the use of reported HIV data</header><text>Section 854 of the AIDS Housing Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12903">42 U.S.C. 12903</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H3052A7214A174876A423BAA8695136AB"><enum>(g)</enum><header>Transition formula</header><text>In applying the formula allocation under subsection (c)(1), the Secretary shall—</text> 
<paragraph id="H54448AC5F2A645C8B578D1A817164618"><enum>(1)</enum><text>for fiscal year 2007, allocate—</text> 
<subparagraph id="HFFD7C76E28A84DC88BE832AE17B7E93F"><enum>(A)</enum><text>75 percent of any amounts made available for allocation, using the formula allocation described in subsection (c), as in effect on the day before the date of enactment of the Ryan White CARE Act Amendments of 2006; and</text></subparagraph> 
<subparagraph id="H9DD7FFB199EC407CA27F84FA046CA581"><enum>(B)</enum><text>25 percent of such amounts made available for allocation, using the formula allocation described in subsection (c), as amended by the Ryan White CARE Act Amendments of 2006;</text></subparagraph></paragraph> 
<paragraph id="HFE1C37128B7743D700B8B981D08300A1"><enum>(2)</enum><text>for fiscal year 2008, allocate—</text> 
<subparagraph id="H11EC93AD5EC94C9E9589933E63208D4E"><enum>(A)</enum><text>25 percent of any amounts made available for allocation, using the formula allocation described in subsection (c), as in effect on the day before the date of enactment of the Ryan White CARE Act Amendments of 2006; and</text></subparagraph> 
<subparagraph id="H3F889382342F42578C627D8C180028C2"><enum>(B)</enum><text>75 percent of such amounts made available for allocation, using the formula allocation described in subsection (c), as amended by the Ryan White CARE Act Amendments of 2006; and</text></subparagraph></paragraph> 
<paragraph id="H4055C43CA81B40298748FCC18200F03"><enum>(3)</enum><text>for fiscal year 2009, and each fiscal year thereafter, allocate any amounts made available for allocation using the formula allocation described in subsection (c), as amended by the Ryan White CARE Act Amendments of 2006.</text></paragraph></subsection> 
<subsection id="HFF7072064EF24E4E8B46C8924CA74085"><enum>(h)</enum><header>Exception to the use of reported HIV data</header><text>Any State or city—</text> 
<paragraph id="H1D6E95EA2F3347FDA5E979F420C73812"><enum>(1)</enum><text>that has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention prior to October 1, 2000, shall for purposes of allocating any amounts under subsection (c) to that State or city, have such allocation determined by using the formula allocation described in such subsection, as amended by the Ryan White CARE Act Amendments of 2006;</text></paragraph> 
<paragraph id="H273116F13EBD46D6A3D1F0A32C03552B"><enum>(2)</enum><text>that has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention prior to October 1, 2006, but on or after October 1, 2000, shall for purposes of allocating any amounts under subsection (c) to that State or city, have such allocation determined by using the formula allocation based on the number of cases of HIV disease (estimated by the Director of the Centers for Disease Control and Prevention) instead of reported living cases of HIV disease (as reported to, and confirmed as accurate, by the Director of the Centers for Disease Control and Prevention); and</text></paragraph> 
<paragraph commented="no" id="H7C2DA9F3984A4E48A68EA43F22F566D9"><enum>(3)</enum><text>that does not have an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention prior to October 1, 2006, shall for purposes of allocating any amounts under subsection (c) to that State or city—</text> 
<subparagraph commented="no" id="HDA7399BB8AF74078A810BF4EE2FCFA82"><enum>(A)</enum><text>until such time as such State or city has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention, have such allocation determined by using the formula allocation described in such subsection as in effect on the day before the date of enactment of the Ryan White CARE Act Amendments of 2006; and</text></subparagraph> 
<subparagraph commented="no" id="H1EC4D1F6383F437BA7EE343DF1BFEF45"><enum>(B)</enum><text>once such State or city has enacted an HIV reporting system that has been confirmed as accurate and reliable by the Director of the Centers for Disease Control and Prevention, have such allocation determined by using the formula allocation based on the number of cases of HIV disease (estimated by the Director of the Centers for Disease Control and Prevention) instead of reported living cases of HIV disease (as reported to, and confirmed as accurate, by the Director of the Centers for Disease Control and Prevention).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H51898A0EACD74BE584709C9D9CCD2C21"><enum>(c)</enum><header>Allocation requirement</header><text>Section 854 of the AIDS Housing Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12903">42 U.S.C. 12903</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H29C848D5B2224398A0A9EA00AB1E5B5C" style="OLC"> 
<subsection id="HCC10519473864CA2BE41F540EAEBB54"><enum>(h)</enum><header>Allocation requirement</header><text>The Secretary shall ensure that not less than 75 percent of all amounts allocated under this section are used for the provision, construction, maintenance, or development of housing assistance.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H238151BE3BB049DB81EF07BD2540C357"><enum>19.</enum><header>Ensuring stability in infrastructure</header><text display-inline="no-display-inline">Section 2618(a)(2)(B)(i) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300ff-28">42 U.S.C. 300ff–28(a)(2)(B)(i)</external-xref>), as redesignated by section 6, is amended—</text> 
<paragraph id="HE670206C0C354199BF5D10C8E24B467B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>2000</quote> each place the term appears and inserting <quote>2005</quote>;</text></paragraph> 
<paragraph id="HC9B298F9221548F386B8D591E20F29F"><enum>(2)</enum><text>in subclause (I), by striking <quote>2001, 99 percent</quote> and inserting <quote>2006, 95 percent</quote>;</text></paragraph>
