<official-title>To amend the Intelligence Reform and Terrorism Prevention Act of 2004 with respect to the Privacy and Civil Liberties Oversight Board, and for other purposes.</official-title> 
</form>

<section id="HFA233863AB5C42EC9DF65F2F31023D27" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>9/11 Commission Civil Liberties Board Act</short-title></quote>.</text></section> 
<section id="H25C6F1A79F3449C7BBE3101DAE6028B2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HA49FD2B131204B7FB23100727199BDA9"><enum>(1)</enum><text display-inline="yes-display-inline">On July 22, 2004 the National Commission on Terrorist Attacks Upon the United States (also known as the 9/11 Commission) issued a report that included 41 specific recommendations to help prevent future terrorist attacks, including details of a global strategy and government reorganization necessary to implement that strategy.</text></paragraph> 
<paragraph id="H5386E8C346DD43FC88A5B590377154D0"><enum>(2)</enum><text>One of the recommendations focused on the protections of civil liberties. Specifically the following recommendation was made: <quote>At this time of increased and consolidated government authority, there should be a board within the executive branch to oversee adherence to the guidelines we recommend and the commitment the government makes to defend our civil liberties.</quote>. </text></paragraph> 
<paragraph id="H32AB4F81DF56456F8F751802A488E0AC"><enum>(3)</enum><text>The report also states that <quote>the choice between security and liberty is a false choice, as nothing is more likely to endanger America’s liberties than the success of a terrorist attack at home. Our History has shown that the insecurity threatens liberty at home. Yet if our liberties are curtailed, we lose the values that we are struggling to defend.</quote>. </text></paragraph> 
<paragraph id="HD8F64FFD2D7B4FA0B0F664F2B38EFB4"><enum>(4)</enum><text>On December 17, 2004, <external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>, the National Intelligence Reform Act, was signed into law. This law created a civil liberties board that does not have the authority necessary to protect civil liberties.</text></paragraph> 
<paragraph id="H126111857BB841A29CD0DAF472A74962"><enum>(5)</enum><text display-inline="yes-display-inline">The establishment and adequate funding of a Privacy and Civil Liberties Oversight Board was a crucial recommendation made by the 9/11 Commission.</text></paragraph> 
<paragraph id="H8F119B0B51FF4101BDEC2FC685370902"><enum>(6)</enum><text display-inline="yes-display-inline">In its Final Report on 9/11 Commission Recommendations, the Commission noted <quote>very little urgency</quote> and <quote>insufficient</quote> funding as it relates to the establishment of the Privacy and Civil Liberties Oversight Board. </text></paragraph> 
<paragraph id="H9C14125921124DF0A7FF0557D6E7073"><enum>(7)</enum><text display-inline="yes-display-inline">While the President’s budget submission for fiscal year 2006 included $750,000 for the Privacy and Civil Liberties Oversight Board, the President’s budget submission for fiscal year 2007 does not contain a funding line for the Board. </text></paragraph></section> 
<section id="HAC358181D2AD48A883E2C947FBD74C0"><enum>3.</enum><header>Making the Privacy and Civil Liberties Oversight Board independent</header><text display-inline="no-display-inline">Section 1061(b) of the Intelligence Reform and Terrorism Prevention Act of 2004 is amended by striking <quote>within the Executive Office of the President</quote> and inserting <quote>as an independent agency within the Executive branch</quote>.</text></section> 
<section id="H5E3BDD42AF054DF882FB4F42E4F85B88"><enum>4.</enum><header>Requiring all members of the Privacy and Civil Liberties Oversight Board be confirmed by the Senate</header><text display-inline="no-display-inline">Subsection (e) of section 1061 of the Intelligence Reform and Terrorism Prevention Act of 2004 is amended to read as follows:</text> 
<quoted-block style="OLC" id="HEF5A51608A1D4AF6BF87E49FEEBC1C47" display-inline="no-display-inline"> 
<subsection id="HD2A8DF9651BA4DCE99CA8432ADBF2958"><enum>(e)</enum><header>Membership</header> 
<paragraph id="H85658D7C5FAC4965B2EC5F00F0A3E6AD"><enum>(1)</enum><header>Members</header><text>The Board shall be composed of a full-time chairman and 4 additional members, who shall be appointed by the President, by and with the advice and consent of the Senate.</text></paragraph> 
<paragraph id="HD4D3BE192FCC4889B2305C0625201B9B"><enum>(2)</enum><header>Qualifications</header><text>Members of the Board shall be selected solely on the basis of their professional qualifications, achievements, public stature, expertise in civil liberties and privacy, and relevant experience, and without regard to political affiliation, but in no event shall more than 3 members of the Board be members of the same political party. The President shall, before appointing an individual who is not a member of the same political party as the President consult with the leadership of that party, if any, in the Senate and House of Representatives.</text></paragraph> 
<paragraph id="HC6FA888326D5499199D3D900BDA6B28C"><enum>(3)</enum><header>Incompatible office</header><text>An individual appointed to the Board may not, while serving on the Board, be an elected official, officer, or employee of the Federal Government, other than in the capacity as a member of the Board.</text></paragraph> 
<paragraph id="H7F4737533CFD48328CD2822C7B346C3E"><enum>(4)</enum><header>Term</header><text>Each member of the Board shall serve a term of six years, except that—</text> 
<subparagraph id="HEB5CE2931437430095DDF14FB07FD"><enum>(A)</enum><text>a member appointed to a term of office after the commencement of such term may serve under such appointment only for the remainder of such term;</text></subparagraph> 
<subparagraph id="H71D4D167FE1B4EDBBC322C771E46423C"><enum>(B)</enum><text>upon the expiration of the term of office of a member, the member shall continue to serve until the member's successor has been appointed and qualified, except that no member may serve under this subparagraph—</text> 
<clause id="HB7CD9C50820645EC83A72CB7B0243C2C"><enum>(i)</enum><text>for more than 60 days when Congress is in session unless a nomination to fill the vacancy shall have been submitted to the Senate; or</text></clause> 
<clause id="HB764ED4564534D6C8CD0DEA1F37C32C"><enum>(ii)</enum><text>after the adjournment sine die of the session of the Senate in which such nomination is submitted; and</text></clause></subparagraph> 
<subparagraph id="H879D3D2D60DB4731BA2D736CF16841D5"><enum>(C)</enum><text>the members initially appointed under this subsection shall serve terms of two, three, four, five, and six years, respectively, from the effective date of this Act, with the term of each such member to be designated by the President.</text></subparagraph></paragraph> 
<paragraph id="H25122775A98741D2A4119DCDAFBB0816"><enum>(5)</enum><header>Quorum and meetings</header><text>The Board shall meet upon the call of the chairman or a majority of its members. Three members of the Board shall constitute a quorum.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HAAB872F0635D439092691751ACF7A91B"><enum>5.</enum><header>Subpoena power for the Privacy and Civil Liberties Oversight Board</header><text display-inline="no-display-inline">Section 1061(d) of the Intelligence Reform and Terrorism Prevention Act of 2004 is amended—</text> 
<paragraph id="HFC5AEC90DE724F89971D886300BE8280"><enum>(1)</enum><text>so that subparagraph (D) of paragraph (1) reads as follows:</text> 
<quoted-block style="OLC" id="HFAB8959ADF6E40958E4DF028627B9B89" display-inline="no-display-inline"> 
<subparagraph id="HB3C025C5402644C784456510EEEC56B1"><enum>(D)</enum><text display-inline="yes-display-inline">require, by subpoena issued at the direction of a majority of the members of the Board, persons (other than departments, agencies, and elements of the executive branch) to produce any relevant information, documents, reports, answers, records, accounts, papers, and other documentary or testimonial evidence.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HEA96A08FD4EF4100BA546BB578F8A6B9"><enum>(2)</enum><text>so that paragraph (2) reads as follows:</text> 
<quoted-block style="OLC" id="H744BD65B7B9C44F4B6C16D03EBE80032" display-inline="no-display-inline"> 
<paragraph id="HE8D8D72BC9234884B645ABDB64A2BD7"><enum>(2)</enum><header>Enforcement of subpoena</header><text display-inline="yes-display-inline">In the case of contumacy or failure to obey a subpoena issued under paragraph (1)(D), the United States district court for the judicial district in which the subpoenaed person resides, is served, or may be found may issue an order requiring such person to produce the evidence required by such subpoena.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HDD94422671204124BDE8FC4C8FE1D500"><enum>6.</enum><header>Reporting requirements</header> 
<subsection id="H3D5D6BE9C5BD42DEB9C24C4BF1CA817"><enum>(a)</enum><header>Duties of Board</header><text display-inline="yes-display-inline">Paragraph (4) of section 1061(c) of the Intelligence Reform and Terrorism Prevention Act of 2004 is amended to read as follows:</text>

<paragraph id="HF710CDFE41004ED6B3218EF3D9BD5600"><enum>(4)</enum><header>Reports</header> 
<subparagraph id="H3013A4D24FAD465DAAF552D3FC099F09"><enum>(A)</enum><header>Receipt, review, and submission</header> 
<clause id="HF7E776ACC3E64249AD0060F729573408"><enum>(i)</enum><header>In general</header><text>The Board shall—</text> 
<subclause id="HF6F172B931604F51AC71E5013216157D"><enum>(I)</enum><text>receive and review reports from privacy officers and civil liberties officers described in section 212; and</text></subclause> 
<subclause id="HAE3650B21A05402C9211E3DCBAE03645"><enum>(II)</enum><text>periodically submit, not less than semiannually, reports to the appropriate committees of Congress, including the Committees on the Judiciary of the Senate and the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Government Reform of the House of Representatives, the Select Committee on Intelligence of the Senate, and the Permanent Select Committee on Intelligence of the House of Representatives, and to the President.</text></subclause><continuation-text continuation-text-level="clause">Such reports shall be in unclassified form to the greatest extent possible, with a classified annex where necessary.</continuation-text></clause> 
<clause id="H3545178C65364BEA9F40A59E308524D8"><enum>(ii)</enum><header>Contents</header><text>Not less than 2 reports the Board submits each year under clause (i)(II) shall include—</text> 
<subclause id="H0D091D688CCF4394AEE716B6CF305973"><enum>(I)</enum><text>a description of the major activities of the Board during the preceding period;</text></subclause> 
<subclause id="HBCFABAD3CF744BB2BEDFC584EC9BBA47"><enum>(II)</enum><text>information on the findings, conclusions, and recommendations of the Board resulting from its advice and oversight functions under subsection (c);</text></subclause> 
<subclause id="H81B091891C8C49B591C2854008CCAB0"><enum>(III)</enum><text>the minority views on any findings, conclusions, and recommendations of the Board resulting from its advice and oversight functions under subsection (c); and</text></subclause> 
<subclause id="H042D856F88254909B2F08DCF362EED26"><enum>(IV)</enum><text>each proposal reviewed by the Board under subsection (c)(1) that the Board advised against implementing, but that notwithstanding such advice, was implemented.</text></subclause></clause></subparagraph> 
<subparagraph id="HAE333D93A885430A88FC90AD75F3D36B"><enum>(B)</enum><header>Informing the public</header><text>The Board shall—</text> 
<clause id="HD892FE44BBAB40E3B87C16F5B6FE0059"><enum>(i)</enum><text>make its reports, including its reports to Congress, available to the public to the greatest extent that is consistent with the protection of classified information and applicable law; and</text></clause> 
<clause id="HD446005BC6FE42A6AB9F2805AC111FFB"><enum>(ii)</enum><text>hold public hearings and otherwise inform the public of its activities, as appropriate and in a manner consistent with the protection of classified information and applicable law.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4560B99106654E8B949EFD65C913B833"><enum>(b)</enum><header>Privacy and civil liberties officers</header><text display-inline="yes-display-inline">Section 1062 of the Intelligence Reform and Terrorism Prevention Act of 2004 is amended to read as follows:</text> 
<quoted-block style="OLC" id="HDB53A8B5FCA9460ABCDFA68498FC92A9" display-inline="no-display-inline"> 
<section id="HC5EA5307814A4A23B3ECFE40617912F0"><enum>1062.</enum><header>Privacy and civil liberties officers</header> 
<subsection id="H0B53A2008FF04F9800BA2F1B7047525F"><enum>(a)</enum><header>Designation and functions</header><text display-inline="yes-display-inline">The Attorney General, the Secretary of Defense, the Secretary of State, the Secretary of the Treasury, the Secretary of Health and Human Services, the Secretary of Homeland Security, the National Intelligence Director, the Director of the Central Intelligence Agency, any other entity within the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a</external-xref>)), and the head of any other department, agency, or element of the executive branch designated by the Privacy and Civil Liberties Oversight Board to be appropriate for coverage under this section shall designate not less than 1 senior officer to—</text> 
<paragraph id="H1952E435442C40E78BF1A5D307B8A539"><enum>(1)</enum><text>assist the head of such department, agency, or element and other officials of such department, agency, or element in appropriately considering privacy and civil liberties concerns when such officials are proposing, developing, or implementing laws, regulations, policies, procedures, or guidelines related to efforts to protect the Nation against terrorism;</text></paragraph> 
<paragraph id="H2486F08642E2437F83BC47A5FFB100A3"><enum>(2)</enum><text>periodically investigate and review department, agency, or element actions, policies, procedures, guidelines, and related laws and their implementation to ensure that such department, agency, or element is adequately considering privacy and civil liberties in its actions;</text></paragraph> 
<paragraph id="HCB4ED10FD48F4B66898D06A3805BB710"><enum>(3)</enum><text>ensure that such department, agency, or element has adequate procedures to receive, investigate, respond to, and redress complaints from individuals who allege such department, agency, or element has violated their privacy or civil liberties; and</text></paragraph> 
<paragraph id="H1427A9CF30084DCBA84119BE9E4BAF46"><enum>(4)</enum><text>in providing advice on proposals to retain or enhance a particular governmental power the officer shall consider whether such department, agency, or element has established—</text> 
<subparagraph id="HE1843F39360D4EB9918186FDFDC9A155"><enum>(A)</enum><text>that the power actually enhances security and the need for the power is balanced with the need to protect privacy and civil liberties;</text></subparagraph> 
<subparagraph id="H4B7EC94E844B4706B522FFC5DCEDBC24"><enum>(B)</enum><text>that there is adequate supervision of the use by such department, agency, or element of the power to ensure protection of privacy and civil liberties; and</text></subparagraph> 
<subparagraph id="HD6EF3E6BF1A14F6192BFDCB737D094C"><enum>(C)</enum><text>that there are adequate guidelines and oversight to properly confine its use.</text></subparagraph></paragraph></subsection> 
<subsection id="H5FD999EE29A246429B573000C8CAE777"><enum>(b)</enum><header>Exception to designation authority</header> 
<paragraph id="H384730F9AD9F468394822F6412E7C056"><enum>(1)</enum><header>Privacy officers</header><text>In any department, agency, or element referred to in subsection (a) or designated by the Board, which has a statutorily created privacy officer, such officer shall perform the functions specified in subsection (a) with respect to privacy.</text></paragraph> 
<paragraph id="HF036B21624384ED4B38FFFF9C5D91FC6"><enum>(2)</enum><header>Civil liberties officers</header><text>In any department, agency, or element referred to in subsection (a) or designated by the Board, which has a statutorily created civil liberties officer, such officer shall perform the functions specified in subsection (a) with respect to civil liberties.</text></paragraph></subsection> 
<subsection id="H3CF136EC22934F82BFA39440F4953198"><enum>(c)</enum><header>Supervision and coordination</header><text>Each privacy officer or civil liberties officer described in subsection (a) or (b) shall—</text> 
<paragraph id="H59201BB10E984841B5DC3129F1FEF91D"><enum>(1)</enum><text>report directly to the head of the department, agency, or element concerned; and</text></paragraph> 
<paragraph id="H916E1D84307D45888966F26CE9CB001B"><enum>(2)</enum><text>coordinate their activities with the Inspector General of such department, agency, or element to avoid duplication of effort.</text></paragraph></subsection> 
<subsection id="H59205CB53DBD4B018596058596F303CF"><enum>(d)</enum><header>Agency cooperation</header><text>The head of each department, agency, or element shall ensure that each privacy officer and civil liberties officer—</text> 
<paragraph id="H7746242DC6744BEF9194501477AA2D29"><enum>(1)</enum><text>has the information, material, and resources necessary to fulfill the functions of such officer;</text></paragraph> 
<paragraph id="H170F07ED00B2488FB4124B2BFC29BD25"><enum>(2)</enum><text>is advised of proposed policy changes;</text></paragraph> 
<paragraph id="H8425E6BDBBDB4FF8007973A9A3A6CFA9"><enum>(3)</enum><text>is consulted by decisionmakers; and</text></paragraph> 
<paragraph id="H08A4DE5E42DF4F21BA58C789155997E"><enum>(4)</enum><text>is given access to material and personnel the officer determines to be necessary to carry out the functions of such officer.</text></paragraph></subsection> 
<subsection id="H28A87DE2B85C4516AC36CA9BB1D45582"><enum>(e)</enum><header>Reprisal for making complaint</header><text>No action constituting a reprisal, or threat of reprisal, for making a complaint or for disclosing information to a privacy officer or civil liberties officer described in subsection (a) or (b), or to the Privacy and Civil Liberties Oversight Board, that indicates a possible violation of privacy protections or civil liberties in the administration of the programs and operations of the Federal Government relating to efforts to protect the Nation from terrorism shall be taken by any Federal employee in a position to take such action, unless the complaint was made or the information was disclosed with the knowledge that it was false or with willful disregard for its truth or falsity.</text></subsection> 
<subsection id="H5224C952114F4BC7A6B042948837B38"><enum>(f)</enum><header>Periodic reports</header> 
<paragraph id="HB4EA8234E8094AD184B3301D43B9F21F"><enum>(1)</enum><header>In general</header><text>The privacy officers and civil liberties officers of each department, agency, or element referred to or described in subsection (a) or (b) shall periodically, but not less than quarterly, submit a report on the activities of such officers—</text> 
<subparagraph id="H9F9038EEA6E24E649C8EBB8C588CC4B"><enum>(A)</enum> 
<clause id="HBDDBE26DE4CD4F99B62B06CB03DB95A5" display-inline="yes-display-inline"><enum>(i)</enum><text>to the appropriate committees of Congress, including the Committees on the Judiciary of the Senate and the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Government Reform of the House of Representatives, the Select Committee on Intelligence of the Senate, and the Permanent Select Committee on Intelligence of the House of Representatives;</text></clause> 
<clause id="H73EFFF7DCFF14989AEBC326735AA94FC" indent="up1"><enum>(ii)</enum><text>to the head of such department, agency, or element; and</text></clause> 
<clause id="H74859EA658C54E93AD80745E10B09D34" indent="up1"><enum>(iii)</enum><text>to the Privacy and Civil Liberties Oversight Board; and</text></clause></subparagraph> 
<subparagraph id="HEF0449BDE0EE461BA76CF4793C28EBD9"><enum>(B)</enum><text>which shall be in unclassified form to the greatest extent possible, with a classified annex where necessary.</text></subparagraph></paragraph> 
<paragraph id="H4D25EB48E9A8478AB1EABB7974C08246"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include information on the discharge of each of the functions of the officer concerned, including—</text> 
<subparagraph id="HBD8B82C131F342E5B45F7382C5CD81F"><enum>(A)</enum><text>information on the number and types of reviews undertaken;</text></subparagraph> 
<subparagraph id="H82101F5BF9D745C99069C91F8B2246F9"><enum>(B)</enum><text>the type of advice provided and the response given to such advice;</text></subparagraph> 
<subparagraph id="HBF2FF123059D4F1BB6ED81213FE4D7C1"><enum>(C)</enum><text>the number and nature of the complaints received by the department, agency, or element concerned for alleged violations; and</text></subparagraph> 
<subparagraph id="HBCD8E2ECDA414F12A0BED731F4ED945"><enum>(D)</enum><text>a summary of the disposition of such complaints, the reviews and inquiries conducted, and the impact of the activities of such officer.</text></subparagraph></paragraph></subsection> 
<subsection id="H23ED1E09149747E2912D442D005973B6"><enum>(g)</enum><header>Informing the public</header><text>Each privacy officer and civil liberties officer shall—</text> 
<paragraph id="H01031801F171428CB7F8A067A0D03FF8"><enum>(1)</enum><text>make the reports of such officer, including reports to Congress, available to the public to the greatest extent that is consistent with the protection of classified information and applicable law; and</text></paragraph> 
<paragraph id="H348AC183EFAA4F7E99B3AE1974708B00"><enum>(2)</enum><text>otherwise inform the public of the activities of such officer, as appropriate and in a manner consistent with the protection of classified information and applicable law.</text></paragraph></subsection> 
<subsection id="H957BF11F4C674A719CC192841E1DF598"><enum>(h)</enum><header>Savings clause</header><text>Nothing in this section shall be construed to limit or otherwise supplant any other authorities or responsibilities provided by law to privacy officers or civil liberties officers.</text></subsection> 
<subsection id="HBBE2EEE42BA84237A760D91F265EF946"><enum>(i)</enum><header>Protections for human research subjects</header><text>The Secretary of Homeland Security shall ensure that the Department of Homeland Security complies with the protections for human research subjects, as described in part 46 of title 45, Code of Federal Regulations, or in equivalent regulations as promulgated by such Secretary, with respect to research that is conducted or supported by such Department.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HBC30C28DEC6B4AA28E1698A4F19184EB"><enum>7.</enum><header>Inclusion in President’s budget submission to Congress</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/1105">Section 1105(a)</external-xref> of title 31, United States Code, is amended by adding at the end the following new paragraph: </text>
