<section section-type="section-one" id="H0B02BF9156AF47A8A2AC6000A3E952C3" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chemical Facility Anti-Terrorism Act of 2006</short-title></quote>.</text></section> 
<section id="HF2B63410C4684FD1B577F4002F2CF3D6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H06CBAD3553BD4DC98DB11C5206F6B3BE"><enum>(1)</enum><header>Chemical source</header><text>The term <term>chemical source</term> means a facility designated as a chemical source by the Secretary under section 3.</text></paragraph> 
<paragraph id="HAA07B22E916C450CA4E0E6FDBF1B2E3E"><enum>(2)</enum><header>Critical infrastructure</header><text>The term <term>critical infrastructure</term> has the meaning given the term in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text></paragraph> 
<paragraph id="HB36F7D18D7374D63009842413F8B868E"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Homeland Security.</text></paragraph> 
<paragraph id="H51AC4D0EA33145DFB1E247B79828512B"><enum>(4)</enum><header>Environment</header><text>The term <term>environment</term> has the meaning given the term in section 101 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph> 
<paragraph id="HF507F6E2A3864109AD00A7463900A054"><enum>(5)</enum><header>Higher risk tier</header><text>The term <term>higher risk tier</term> means a tier designated by the Secretary as a higher risk tier under section 3(e)(3).</text></paragraph> 
<paragraph id="H12B8831C7B7F4B84871D304993008881"><enum>(6)</enum><header>MTSA-regulated facilities</header><text>The term <term>MTSA-regulated facility</term> means a facility subject to the security requirements under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/701">chapter 701</external-xref> of title 46, United States Code (commonly known as the <quote>Maritime Transportation Security Act</quote>).</text></paragraph> 
<paragraph id="HC89C31F1DEFB4C34AEE265DA78CBCEF3"><enum>(7)</enum><header>Owner or operator</header><text>The term <term>owner or operator</term> means any person who owns, leases, operates, controls, or supervises a chemical source.</text></paragraph> 
<paragraph id="H0817451F34D0409E807B1EEB5BCA01B"><enum>(8)</enum><header>Release</header><text>The term <term>release</term> has the meaning given the term in section 101 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph> 
<paragraph id="H2AA06381EDCA4C4F9E42A19F6C15AFB1"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> 
<paragraph id="HF850AE8E4EDF462FB0421966E664B821"><enum>(10)</enum><header>Security measure</header> 
<subparagraph id="H3A50D506ECB04F02AF6E83D9A0B60389"><enum>(A)</enum><header>In general</header><text>The term <term>security measure</term> means an action to ensure or enhance the security of a chemical source against a terrorist incident.</text></subparagraph> 
<subparagraph id="HE854352C014F4080A971769757B4CBEA"><enum>(B)</enum><header>Inclusions</header><text>The term <term>security measure</term>, with respect to a chemical source, includes measures such as—</text> 
<clause id="H82FF57ADAB434427BFD53347693E1244"><enum>(i)</enum><text>employee training and background and identification authentication checks;</text></clause> 
<clause id="HA6D79EFAC99C4220993D4F6B73D2BE1D"><enum>(ii)</enum><text>the limitation and prevention of access to controls of the chemical source;</text></clause> 
<clause id="H6E8A2C0040AD43FF839FDFA92039BD2F"><enum>(iii)</enum><text>the protection of the perimeter of the chemical source;</text></clause> 
<clause id="H5B02051546EE4903949000C336262025"><enum>(iv)</enum><text>the installation and operation of intrusion detection sensors;</text></clause> 
<clause id="H3D886D5DDC3C4EA2AE001900B77ADF3"><enum>(v)</enum><text>the implementation of measures to increase computer or computer network security;</text></clause> 
<clause id="HEC1D74E2FF5049A5A131BA5F11460000"><enum>(vi)</enum><text>the implementation of other security-related measures to ensure or enhance the security of a chemical source from a terrorist incident; </text></clause> 
<clause id="HA5CFB70845194D6C905E1834D3831352"><enum>(vii)</enum><text>the implementation of measures and controls to prevent, protect against, or reduce the consequences of a terrorist incident, including—</text> 
<subclause id="HB2510F27EE41447EB0E1899E13E2D713"><enum>(I)</enum><text>contingency and evacuation plans;</text></subclause> 
<subclause id="HEC13058DE6E54D99B454AD9B5556D3C8"><enum>(II)</enum><text>early warning systems; and</text></subclause> 
<subclause id="HF2CB4B301BDB46078F5586FCE501F047"><enum>(III)</enum><text>the relocation, hardening of the storage or containment, modification, processing, substitution, or reduction of substances of concern; and</text></subclause></clause> 
<clause id="HB028F72A8F9440D6A53E006EB1007187"><enum>(viii)</enum><text>the conduct of any similar security-related activity, as determined by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="H66184C10D5684F4D9806B63FB79ED341"><enum>(11)</enum><header>Substance of concern</header><text>The term <term>substance of concern</term> means—</text> 
<subparagraph id="H414EBC782C7547A98634FE4400FBB5C"><enum>(A)</enum><text>a chemical substance present at a chemical source in quantities equal to or exceeding the threshold quantities for the chemical substance, as defined in or established under paragraphs (3) and (5) of section 112(r) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)</external-xref>);</text></subparagraph> 
<subparagraph id="HF28CD9683AC84F50ADE8FDC387430033"><enum>(B)</enum><text>ammonium nitrate, in a quantity to be determined by the Secretary by regulation; and</text></subparagraph> 
<subparagraph id="HB36C1EF70E5E46889FA4E05293765014"><enum>(C)</enum><text>any other chemical substance designated as a substance of concern by the Secretary under section 3(i) in quantities equal to or exceeding the threshold quantities established under section 3(i), based on the potential extent of death, injury, or serious adverse effects to human health and safety or the environment or the potential impact on national or economic security or critical infrastructure caused by a terrorist incident involving the chemical substance.</text></subparagraph></paragraph> 
<paragraph id="HB6F172BFD71841779E0158B54D7664C4"><enum>(12)</enum><header>Terrorism</header><text>The term <term>terrorism</term> has the meaning given the term in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text></paragraph> 
<paragraph id="H28C54B5772F4453A81DFA66D6EA97800"><enum>(13)</enum><header>Terrorist incident</header><text>The term <term>terrorist incident</term> means—</text> 
<subparagraph id="H6B5A5E358BB14D23B0FE9420A568C7D2"><enum>(A)</enum><text>a terrorist attack against a chemical source;</text></subparagraph> 
<subparagraph id="H3DDA78373C474CABBC3620C3F12D166E"><enum>(B)</enum><text>a release from a chemical source into the environment of a substance of concern that is caused by an act of terrorism; and</text></subparagraph> 
<subparagraph id="HAC3DEF3C10FB4D3FA9198768739DAB32"><enum>(C)</enum><text>the theft of a substance of concern by a person for off-site release in furtherance of an act of terrorism.</text></subparagraph></paragraph></section> 
<section id="H754F4124D5734EBF86A8B8D5D9B11DF"><enum>3.</enum><header>Designation and tiering of chemical sources</header> 
<subsection id="H9C00C15D0CCB417185169B6FE51D4D52"><enum>(a)</enum><header>Designation</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall—</text> 
<paragraph id="H836674DD55FE4A42A65FEF3D963152FD"><enum>(1)</enum><text>promulgate regulations establishing criteria for designating chemical sources by using the risk factors described in subsection (b) and by evaluating the types of facilities described in subsection (c) that shall be considered in designating chemical sources; and</text></paragraph> 
<paragraph id="H93ED0930EF8E46289F226EA3EB4FF3E0"><enum>(2)</enum><text>designate chemical sources in existence as of that date.</text></paragraph></subsection> 
<subsection id="HFF76A6B201344CB9A49BC09D337937B6"><enum>(b)</enum><header>Risk factors to be considered</header><text>In establishing criteria under subsection (a)(1) for designating chemical sources, the Secretary shall consider—</text> 
<paragraph id="H5DBE2D87CB3F40A4B8B0C2761D68F646"><enum>(1)</enum><text>the perceived threat to a facility, including a consideration of adversary capabilities and intent, preparedness, target attractiveness, and deterrence capabilities;</text></paragraph> 
<paragraph id="H954DB76FD43A4BADAF8330AC6E3B08B7"><enum>(2)</enum><text>the potential extent and likelihood of death, injury, or serious adverse effects to human health and safety or to the environment caused by a terrorist incident at a facility;</text></paragraph> 
<paragraph id="H0F3995E66C794E8196D02DA416F1AFE6"><enum>(3)</enum><text>the threats to or potential impact on national security or critical infrastructure caused by a terrorist incident at a facility;</text></paragraph> 
<paragraph id="H05BF9958BFB740320073FD003E0090CB"><enum>(4)</enum><text>the potential threats or harm to the economy that would result from a terrorist incident at a facility, including whether a facility is the sole supplier, or the producer of a high percentage, of a product that is critical to the economy, the chemical industry, or national security;</text></paragraph> 
<paragraph id="H06BC55B53EA14123932C66F72FA81FDB"><enum>(5)</enum><text>the proximity of a facility to population centers;</text></paragraph> 
<paragraph id="H1CE87219B6964C8EAC8DB4DAB1D1C703"><enum>(6)</enum><text>the nature and quantity of substances of concern at a facility; and</text></paragraph> 
<paragraph id="HC2E2E7BCDB8246E5ACD034044910EB19"><enum>(7)</enum><text>such other security-related factors as the Secretary determines to be appropriate and necessary to protect the public health and safety, critical infrastructure, and national and economic security.</text></paragraph></subsection> 
<subsection id="H071D064A165540249997575887D4D278"><enum>(c)</enum><header>Criteria for facilities</header><text>In establishing criteria under subsection (a)(1) for designating chemical sources, the Secretary shall—</text> 
<paragraph id="H2CEFBB69C14842B8AC91D499BB516182"><enum>(1)</enum><text>consider any facility that is a stationary source (as defined in section 112(r)(2) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(2)</external-xref>) for which the owner or operator is required to complete a risk management plan in accordance with section 112(r)(7)(B)(ii) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(7)(B)(ii)</external-xref>);</text></paragraph> 
<paragraph id="H9264859FD6F04296B554A2D6B445CDBB"><enum>(2)</enum><text>consider any other facility that produces, uses, or stores a substance of concern; and</text></paragraph> 
<paragraph id="HE39C74EBD23A415C8CED7401BAEF0947"><enum>(3)</enum><text>determine whether any additional facility (including, as of the date of the determination, any facility that is operational and any facility that will become operational in the future) shall be designated chemical sources under this Act.</text></paragraph></subsection> 
<subsection id="H404C2EAE2EE049580063FE58C15D15F4"><enum>(d)</enum><header>Exclusions</header><text>In designating facilities as chemical sources, the Secretary shall not include any facility owned or operated by the Department of Defense or the Department of Energy.</text></subsection> 
<subsection id="HBB618074FA2542788925FB85EEDCD00"><enum>(e)</enum><header>Tiered security system</header> 
<paragraph id="HA65D2DF0FD98473690CC199C87B007E4"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall promulgate rules establishing a risk-based tier system of chemical sources that—</text> 
<subparagraph id="H5A667EFFC8384C7683C1E89D81C3FC92"><enum>(A)</enum><text>shall be based on the criteria established by the Secretary under subsection (a)(1);</text></subparagraph> 
<subparagraph id="HF630EDFAF98F49309606208323FD305F"><enum>(B)</enum><text>consists of several tiers of chemical sources;</text></subparagraph> 
<subparagraph id="HAE4E672D704E4935914F21D3443F0024"><enum>(C)</enum><text>to the maximum extent practicable, enables a chemical source to develop appropriate site-specific measures to meet the security performance standards established under subsection (f) for the tier applicable to the chemical source; and</text></subparagraph> 
<subparagraph id="H7F1121960FC94D23ADE38747F1D1CE7"><enum>(D)</enum><text>provides guidance to the owner or operator of a chemical source regarding the steps that would enable the chemical source to move to a lower risk tier, if the owner or operator seeks to move to a lower risk tier.</text></subparagraph></paragraph> 
<paragraph id="HC66D12F85DA04477B7C0703D6C36EDE2"><enum>(2)</enum><header>Determination of tier</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall determine the tier applicable to each chemical source designated under subsection (a)(2).</text></paragraph> 
<paragraph id="HCCA96117A17943C1AF46514E6EE5C397"><enum>(3)</enum><header>Higher risk tiers</header><text>The Secretary shall designate 1 or more tiers established under paragraph (1) as higher risk tiers.</text></paragraph></subsection> 
<subsection id="HE0EA91C0EBED481988C6CDF58214FAD0"><enum>(f)</enum><header>Security performance standards</header> 
<paragraph id="H33EA4E618636406AA9F7EFE85C703B"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish security performance standards appropriate to the risk-based tiers established under subsection (e).</text></paragraph> 
<paragraph id="HB4E9257B33FD451094AA83AEC0AF145F"><enum>(2)</enum><header>Contents</header><text>The security performance standards established under paragraph (1) shall—</text> 
<subparagraph id="HCB93FBC6C2EA4994B6F36B7893923847"><enum>(A)</enum><text>set increasingly strict security requirements as the level of risk for the tier increases;</text></subparagraph> 
<subparagraph id="HDF2A06D700E84B019D0811B001EEBD5"><enum>(B)</enum><text>enable a chemical source to select security measures that, in combination, satisfy the security performance standards established by the Secretary; and</text></subparagraph> 
<subparagraph id="H6D5542CA03094D7EA3FB476597177945"><enum>(C)</enum><text>be based on the criteria in section 4(a)(2).</text></subparagraph></paragraph> 
<paragraph id="H9FDF967DB9594F9784A6D200E11AB25"><enum>(3)</enum><header>Guidance</header> 
<subparagraph id="HFE5BAA785EB048F600C1C4C5B97451E"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide guidance to a chemical source regarding the types of security measures that, if applied, could satisfy the security performance standards.</text></subparagraph> 
<subparagraph id="H0CB9DB6308344AA8822E706D91689B1B"><enum>(B)</enum><header>Alternate measures</header><text>The owner or operator of a chemical source shall have flexibility to employ different security measures than those contained in the guidance described in subparagraph (A) if such measures satisfy the security performance standards established for the tier applicable to the chemical source.</text></subparagraph></paragraph></subsection> 
<subsection id="H46DA7562872D44A08538B7C663B5842"><enum>(g)</enum><header>Notice to facilities</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall notify facilities that may be designated as chemical sources regarding the review of facilities and designation of chemical sources to be conducted under this Act, including the timeline for such review and designation.</text></subsection> 
<subsection id="HC957B34A29C7442B965E4E44811BC13D"><enum>(h)</enum><header>Subsequent determinations</header> 
<paragraph id="HFCD95A830DC541C4AB56F86B66CF80B8"><enum>(1)</enum><header>Periodic review of determinations</header><text>Not later than 3 years after the designation of chemical sources under subsection (a)(2), and every 3 years thereafter, the Secretary shall, after considering the criteria established under subsection (a)(1) and the exclusions under subsection (d), determine whether to designate any additional facility as a chemical source or remove the designation of any particular facility as a chemical source.</text></paragraph> 
<paragraph id="HEA6FC053E41945A2B22D06E9CD476ED"><enum>(2)</enum><header>Other review</header><text>In addition to the periodic review required under paragraph (1), the Secretary may, after considering the criteria established under subsection (a)(1) and the exclusions under subsection (d), designate a facility as chemical source or remove the designation of any facility as a chemical source.</text></paragraph> 
<paragraph id="H5F1350BE705342DB98630009003E0057"><enum>(3)</enum><header>Duty to report</header> 
<subparagraph id="HD91D469EEA604647900006AF7DA816B4"><enum>(A)</enum><header>Facilities becoming operational</header> 
<clause id="H580D6EACBF7242AF8868BA58C324AE00"><enum>(i)</enum><header>In general</header><text>Each facility described in clause (ii) shall file a petition with the Secretary for a determination on whether that facility should be designated as a chemical source not later than 180 days after the later of—</text> 
<subclause id="H6831C90890814CFDB7EEBE8384EB8898"><enum>(I)</enum><text>the date of the promulgation of final rules under subsection (a)(1); or</text></subclause> 
<subclause id="HE25FC696ECBF45EF964F6D73DC00C6FB"><enum>(II)</enum><text>the date that facility becomes operational.</text></subclause></clause> 
<clause id="H164A97DF94394F5C82819CA4012C002B"><enum>(ii)</enum><header>Facilities covered</header><text>A facility described in this clause is a facility—</text> 
<subclause id="HE45DCAE1A4E34A5590C90362DF1407F5"><enum>(I)</enum><text>that becomes operational on or after the date of the designation of chemical sources under subsection (a)(2); and</text></subclause> 
<subclause id="H4F95CAFDB2D04F4BA314C7CD52B9957E"><enum>(II)</enum><text>at which a threshold quantity of a substance of concern is present.</text></subclause></clause></subparagraph> 
<subparagraph id="H2D2F95F32523440D90881484B8460551"><enum>(B)</enum><header>Existing facilities</header> 
<clause id="H7D96CD0EDCAE4315B433FB3082F59554"><enum>(i)</enum><header>In general</header><text>Each facility described in clause (ii) shall submit a petition to the Secretary for a determination on whether that facility should be designated as a chemical source not later than 180 days after the later of—</text> 
<subclause id="HE3231EA9CD804FC2B6281DA7B7E71EF8"><enum>(I)</enum><text>the date of the promulgation of final regulations under subsection (a)(1); or</text></subclause> 
<subclause id="HC41B8A9FE04A4B57A64F645C00A1BEE6"><enum>(II)</enum><text>the date on which the threshold quantity of a substance of concern is first present at that facility.</text></subclause></clause> 
<clause id="HDF0ED7FCC38C4D8DA50091837BC15737"><enum>(ii)</enum><header>Facilities covered</header><text>A facility described in this clause is a facility—</text> 
<subclause id="HAF72B0E4949A43798B406FCD8053EFBB"><enum>(I)</enum><text>for which the owner or operator is not required to complete a risk management plan under section 112(r)(7)(B)(ii) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(7)(B)(ii)</external-xref>);</text></subclause> 
<subclause id="H1BB0291EB5D048BBB0FD9F9E94645039"><enum>(II)</enum><text>that is operational before the date of the promulgation of the final rules establishing criteria for designating chemical sources under subsection (a)(1); and</text></subclause> 
<subclause id="HEDCB8C50DBEB468CB1687DE980E6B95E"><enum>(III)</enum><text>at which a threshold quantity of a substance of concern is present.</text></subclause></clause></subparagraph> 
<subparagraph indent="subparagraph" id="HBAA2045E14B94A15BC27046E62F82F26"><enum>(C)</enum><header>Consultation</header><text>The Secretary, in consultation with the Administrator of the Environmental Protection Agency, shall establish a mechanism for the Secretary to receive notice in a timely fashion of a facility required by the Administrator to complete a risk management plan in accordance with section 112(r)(7)(B)(ii) of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(7)(B)(ii)</external-xref>).</text></subparagraph> 
<subparagraph id="H4742EAD03CAB4747A162AAF7287BA05"><enum>(D)</enum><header>Regulations</header><text>The Secretary may promulgate regulations to carry out this paragraph.</text> 
<clause indent="subsection" id="HEEDCF91378944092B4AC0502D48147E3"><enum>(i)</enum><header>Designation, exemption, and adjustment of threshold quantities of substances of concern</header></clause></subparagraph></paragraph> 
<paragraph id="H8CCF35105BB34B5C9734A376C5C700E6"><enum>(1)</enum><header>In general</header><text>The Secretary may, by regulation—</text> 
<subparagraph id="H8FCCEB02551743CC846EB1F2C65E510"><enum>(A)</enum><text>designate a chemical substance, in a particular threshold quantity, as a substance of concern under this Act;</text></subparagraph> 
<subparagraph id="H4C65E142E4FE45CE83F43EBF7B71AFA2"><enum>(B)</enum><text>exempt a chemical substance from designation as a substance of concern under this Act; and</text></subparagraph> 
<subparagraph id="HAE26C85A565D4041BA0054B0333C4E05"><enum>(C)</enum><text>establish or revise the threshold quantity for a chemical substance to be designated a substance of concern.</text></subparagraph></paragraph> 
<paragraph id="H360FE47D06084E11B6CBF2C7FF1D36CE"><enum>(2)</enum><header>Considerations</header><text>In designating or exempting a chemical substance or establishing or revising the threshold quantity of a chemical substance under paragraph (1), the Secretary shall consider the potential extent of death, injury, or serious adverse effects to human health and safety or the environment and the potential impact on national security, the economy, or critical infrastructure that would result from a terrorist incident involving the chemical substance.</text></paragraph> 
<paragraph id="HA208492626B14A1385AD5C911CF3E161"><enum>(3)</enum><header>Regulations</header><text>The Secretary may make a designation, exemption, or revision under paragraph (1) in the regulations promulgated under subsection (a)(1).</text></paragraph></subsection></section> 
<section id="H9ECC0AE0484C43149082377C2C225CC7"><enum>4.</enum><header>Vulnerability assessments, site security plans, and emergency response plans</header> 
<subsection id="HB05192A45CFA4DE60050DAC4A0BA9862"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="H6383F7DF2156424BA7E8ECAFA870A2DB"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall promulgate regulations that require the owner or operator of each chemical source—</text> 
<subparagraph id="H6159F8F5159045C89151F05DF4C949E"><enum>(A)</enum><text>to conduct a vulnerability assessment, evaluating the vulnerability of the chemical source to a terrorist incident;</text></subparagraph> 
<subparagraph id="H0AF36F81DBE94895B6527311B04D943D"><enum>(B)</enum><text>to prepare and implement a site security plan that addresses the risks identified in the vulnerability assessment; and</text></subparagraph> 
<subparagraph id="H2EA3162D455642839D007B8DE5002197"><enum>(C)</enum><text>to prepare and implement an emergency response plan or prepare and implement an addendum to an existing emergency response plan to include response planning for a terrorist incident.</text></subparagraph></paragraph> 
<paragraph id="HE856B7378FB449E2A88E52E517ABCFC"><enum>(2)</enum><header>Regulatory criteria</header><text>The regulations promulgated under paragraph (1)—</text> 
<subparagraph id="H7F5784DC36C44CFDB7FA20D288BE7F18"><enum>(A)</enum><text>shall be risk-based, performance based, and flexible; and</text></subparagraph> 
<subparagraph id="H946D855CD4F64ED082A98BCCA2EF73C3"><enum>(B)</enum><text>shall include consideration of—</text> 
<clause id="HC4CF4628B804439381A9040053A3282"><enum>(i)</enum><text>the criteria established by the Secretary under section 3(a)(1);</text></clause> 
<clause id="HCD244DB3027449E999AF16F2D263BABF"><enum>(ii)</enum><text>cost and technical feasibility; and</text></clause> 
<clause id="HC5475E2D60F745CE852BAFADE9D28349"><enum>(iii)</enum><text>scale of operations.</text></clause></subparagraph></paragraph> 
<paragraph id="H85DC4B65AB3642AB991222D2E458DB88"><enum>(3)</enum><header>Co-located chemical sources</header><text>The regulations promulgated under paragraph (1) shall permit the development and implementation of coordinated vulnerability assessments, site security plans, and emergency response plans in any case in which more than 1 chemical source is operating at a single location or at contiguous locations, including cases in which a chemical source is under the control of more than 1 owner or operator.</text></paragraph> 
<paragraph id="HF9826F224CB449A08E91FA9113EB5664"><enum>(4)</enum><header>Sharing of threat information</header><text>To the maximum extent practicable under applicable authority and in the interests of national security, the Secretary shall provide State and local government officials and an owner or operator of a chemical source with threat information that is relevant to the chemical source in particular or to the chemical sector in general.</text></paragraph> 
<paragraph id="HC33152B8559B481AB2A4CAE31074BA3"><enum>(5)</enum><header>Contents of vulnerability assessment</header><text>A vulnerability assessment shall—</text> 
<subparagraph id="H1045C163B4D848929CAFF6486BD731C2"><enum>(A)</enum><text>be based on a rigorous methodology developed or endorsed by the Secretary;</text></subparagraph> 
<subparagraph id="HE29CDACC322E4AA39FB505E0B95F7797"><enum>(B)</enum><text>incorporate any threat information provided under paragraph (4);</text></subparagraph> 
<subparagraph id="H97F4B8FE97B34584AFBEA9CDDA2B35E2"><enum>(C)</enum><text>address the appropriate security performance standards established by Secretary under section 3(f); and</text></subparagraph> 
<subparagraph id="H13AA17ED59A84DC99BA2C05780F7BAF"><enum>(D)</enum><text>include an analysis of—</text> 
<clause id="H9FC5D0B32FA5481784533D1BF899897D"><enum>(i)</enum><text>physical security;</text></clause> 
<clause id="H275E35B0A9EB4EFDABBF1E2C007530DB"><enum>(ii)</enum><text>communication systems;</text></clause> 
<clause id="HD5DB8DA8237944F9A500A636BD00CD95"><enum>(iii)</enum><text>electronic, computer, or other automated systems which are utilized by the chemical source;</text></clause> 
<clause id="HCB6B9D4AF28B40C38F3BD9FDE6C32900"><enum>(iv)</enum><text>the sufficiency of security measures relative to the threats and consequences of a terrorist incident, including vulnerabilities at the chemical source arising from the nature and quantities of substances of concern and the use, storage, or handling of substances of concern; and</text></clause> 
<clause id="H8FD491D42F80408F9DB01A4F42F3CB"><enum>(v)</enum><text>other areas, as determined by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="H58F2294596F349D500336C44DA169129"><enum>(6)</enum><header>Contents of site security plan</header><text>A site security plan shall—</text> 
<subparagraph id="H7E7E36B6AF5C47C900E6F795839AA87"><enum>(A)</enum><text>indicate the tier applicable to the chemical source, as determined by the Secretary under section 3(e)(2);</text></subparagraph> 
<subparagraph id="HBDD9D356F472402BAA07DDF0D9F409E9"><enum>(B)</enum><text>address the risks identified in the vulnerability assessment;</text></subparagraph> 
<subparagraph id="H33F7494E12504A98A2F635BB398424E9"><enum>(C)</enum><text>address the appropriate security performance standards established by Secretary under section 3(f);</text></subparagraph> 
<subparagraph id="HAEADF9FE76134FFB8CC603CD1858D9F2"><enum>(D)</enum><text>include security measures appropriate to the tier level of the chemical source that address the risks identified in the vulnerability assessment and are sufficient to deter, to the maximum extent practicable, a terrorist incident or a substantial threat of such an incident;</text></subparagraph> 
<subparagraph id="H8820D7633DE44089B8C6DB9B21EF40E9"><enum>(E)</enum><text>include security measures to mitigate the consequences of a terrorist incident;</text></subparagraph> 
<subparagraph id="HEB22E423237B4C66B111D85348B600E2"><enum>(F)</enum><text>describe, at a minimum, particular plans, processes, or procedures that could be used by or at the chemical source in the event of a terrorist incident;</text></subparagraph> 
<subparagraph id="H512E082968F940719CD43CB4492233DD"><enum>(G)</enum><text>identify the roles and responsibilities of employees at the chemical source;</text></subparagraph> 
<subparagraph id="H169350C08498440493C76840DFE50022"><enum>(H)</enum><text>identify steps taken by the chemical source to coordinate security measures and plans for response to a terrorist incident with Federal, State, and local government officials, including law enforcement and first responders and specify the security officer who will be the point of contact for the National Incident Management System and Federal, State, and local law enforcement and first responders; and</text></subparagraph> 
<subparagraph id="H4573FB8CA9B54E65B47311F7FA3FCAE4"><enum>(I)</enum><text>describe the training, drills (including periodic unannounced drills), exercises, and security actions of persons at the chemical source, to be carried out under the plan to deter, to the maximum extent practicable, a terrorist incident or a substantial threat of such an incident.</text></subparagraph></paragraph> 
<paragraph id="HAC3EAD2FD9F14875802F589351934300"><enum>(7)</enum><header>Contents of emergency response plan</header> 
<subparagraph id="HEBFEF9E01DCB48468B10C69EFBCF058"><enum>(A)</enum><header>In general</header><text>An emergency response plan shall—</text> 
<clause id="H1CE80AC442A64E7689EE5531AD539C6E"><enum>(i)</enum><text>specifically address the consequences of a terrorist incident identified in the vulnerability assessment prepared under paragraph (4);</text></clause> 
<clause id="H3EEE1B6BBEC245698940D1F5CD676EE"><enum>(ii)</enum><text>be consistent with the site security plan prepared under paragraph (6); and</text></clause> 
<clause id="H940ECF6931B44CBEB5FB8F838AFAFB4"><enum>(iii)</enum><text>identify the roles and responsibilities of employees at the chemical source.</text></clause></subparagraph> 
<subparagraph id="H0EFC55B1BB094890B915456BA83E8226"><enum>(B)</enum><header>Relationship to the National Contingency Plan</header> 
<clause id="HEB54735C8C804795B5F0F2DAC1B416A6"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), an emergency response plan shall be a Federally approved or certified emergency response plan in effect on the date of enactment of this Act that is—</text> 
<subclause id="H9CFB053B2AF74AFB85DE6CEDF0EF32D1"><enum>(I)</enum><text>consistent with guidance provided by the National Response Team established under the National Contingency Plan created under section 105 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605</external-xref>); and</text></subclause> 
<subclause id="H896D7E615829466498DC008672973B07"><enum>(II)</enum><text>modified to satisfy the requirements of subparagraph (A).</text></subclause></clause> 
<clause id="H34E51ABAE429481598F3B9227EAD1F65"><enum>(ii)</enum><header>No existing plan</header><text>The owner or operator of a chemical source that does not have a Federally approved or certified emergency response plan in effect on the date of enactment of this Act shall follow the guidance provided by the National Response Team established under the National Contingency Plan created under section 105 of the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605</external-xref>) in developing an emergency response plan to meet the specific considerations of that chemical source.</text></clause></subparagraph> 
<subparagraph id="HFE817E452F314DA7A08B6547E79DA930"><enum>(C)</enum><header>Protection of security information</header><text>If, in order meet the requirements of this paragraph, the owner or operator of a chemical source is required to include in an emergency response plan information, the release of which would be detrimental to the security of the source, that information shall be separated in a security addendum to the emergency response plan.</text></subparagraph></paragraph> 
<paragraph id="H09D06A47917B43809CD8EC9E99FE8134"><enum>(8)</enum><header>Guidance to chemical sources</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall publish guidance to assist owners and operators of chemical sources in complying with this Act, including advice on aspects of compliance with this Act that may be unique to small business concerns.</text></paragraph></subsection> 
<subsection id="H0DA95CF6BB5F4992BA6B53E6EF4BDCA1"><enum>(b)</enum><header>Certification and submission</header> 
<paragraph id="HF2C8BA7FE4DD48B79875457CE0EED5B2"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of the promulgation of regulations under subsection (a)(1), each owner or operator of a chemical source shall certify in writing to the Secretary that the owner or operator has completed a vulnerability assessment and has developed and implemented, or is implementing, a site security plan and an emergency response plan in accordance with this Act.</text></paragraph> 
<paragraph id="H16C80A716A164566AAF06128BA73B93B"><enum>(2)</enum><header>Submission</header><text>Not later than 6 months after the date of the promulgation of regulations under subsection (a)(1), an owner or operator of a chemical source shall submit to the Secretary copies of the vulnerability assessment, site security plan, and emergency response plan of the chemical source for review.</text></paragraph> 
<paragraph id="HFC1AED9FAEFC45E484AB64C007BD3BA3"><enum>(3)</enum><header>Failure to comply</header><text>If an owner or operator of a chemical source fails to certify or submit a vulnerability assessment, site security plan, or emergency response plan in accordance with paragraph (2), the Secretary may issue an order requiring the certification and submission of a vulnerability assessment, site security plan, or emergency response plan in accordance with this section.</text></paragraph></subsection> 
<subsection id="H2395650C78EE422E82BA91AF19B398B3"><enum>(c)</enum><header>Review by the Secretary</header> 
<paragraph id="HB83BF0333AB6428999B016DFC9576B37"><enum>(1)</enum><header>In general</header><text>The Secretary shall review the vulnerability assessment, site security plan, and emergency response plan submitted by the owner or operator of a chemical source under subsection (b)(2) to determine whether the assessment and plans and the implementation of such plans comply with this section.</text></paragraph> 
<paragraph id="H6E9B0DD808EF42009D008CBEE2682E4E"><enum>(2)</enum><header>Disapproval</header><text>The Secretary shall disapprove a vulnerability assessment, site security plan, or emergency response plan submitted under subsection (b)(2) if the Secretary determines that the vulnerability assessment, site security plan, emergency response plan, or the implementation of such plans does not comply with this section.</text></paragraph> 
<paragraph id="H229D00F158A54C508BA72339EEDE1DDB"><enum>(3)</enum><header>Compliance</header> 
<subparagraph id="H02C828C6A6E44D31AFEE4700D22056DA"><enum>(A)</enum><header>In general</header><text>If the Secretary disapproves a vulnerability assessment, site security plan, or emergency response plan of a chemical source under paragraph (2), the Secretary—</text> 
<clause id="H87476F487AF24551922FB1D33F00B58D"><enum>(i)</enum><text>shall provide the owner or operator of the chemical source a written notification of the determination that includes a clear explanation of deficiencies in the vulnerability assessment, site security plan, emergency response plan, or implementation of the site security plan;</text></clause> 
<clause id="H3A18B9DAD5904240908961FBC1B9FDA9"><enum>(ii)</enum><text>shall consult with the owner or operator of the chemical source to identify appropriate steps to achieve compliance;</text></clause> 
<clause id="H42029D384D8C45A989C41D065CBCAE7F"><enum>(iii)</enum><text>if, following consultation under clause (ii), the owner or operator of the chemical source does not achieve compliance by such date as the Secretary determines to be appropriate under the circumstances, shall issue an order requiring the owner or operator to correct specified deficiencies; and</text></clause> 
<clause id="H5B7F56B9747A41E2817935DC01005E35"><enum>(iv)</enum><text>if the owner or operator continues to be in noncompliance, may issue an order for the chemical source to cease operation.</text></clause></subparagraph> 
<subparagraph id="HEF82B15BA1CA41D6A895CC3744A4753E"><enum>(B)</enum><header>Compliance for higher risk tiers</header> 
<clause id="H15425B58D5A24B5E845100A4923358EC"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the later of the date of the promulgation of regulations under subsection (a)(1) and the date of the promulgation of regulations under section 3(e), the Secretary shall—</text> 
<subclause id="H41CCC6E523C046C200757C5CB55BD4B"><enum>(I)</enum><text>determine whether to approve, disapprove, or modify the vulnerability assessment, site security plan, and emergency response plan submitted under subsection (b)(2) by a chemical source in a higher risk tier; and</text></subclause> 
<subclause id="H2A0EECD725584CA59D82AA01D0F276E0"><enum>(II)</enum><text>determine whether a chemical source in a higher risk tier is operating in compliance with the site security plan and emergency response plan submitted by the chemical source under subsection (b)(2).</text></subclause></clause> 
<clause id="H5F7371D78EB54F4B9CE0AFCD86DFB7B8"><enum>(ii)</enum><header>Enforcement</header><text>The Secretary may issue an order to a chemical source in a higher risk tier to cease operation if the Secretary—</text> 
<subclause id="H874A8E2706FE431EB3C5EB779348DEFB"><enum>(I)</enum><text>disapproves the vulnerability assessment, site security plan, or emergency response plan submitted under subsection (b)(2) by a chemical source in a higher risk tier; or</text></subclause> 
<subclause id="H1C3ED4017CDF45E9BEA422C3BF6C15B8"><enum>(II)</enum><text>determines that a chemical source in a higher risk tier is not operating in compliance with the site security plan or emergency response plan submitted by the chemical source under subsection (b)(2).</text></subclause></clause></subparagraph> 
<subparagraph indent="subparagraph" id="H0F3D0E6670D2495DABFA660091D897CA"><enum>(C)</enum><header>Compliance for other tiers</header><text>Not later than 5 years after the date of the submission of the vulnerability assessment, site security plan, and emergency response plan by a chemical source that is not in a higher risk tier under subsection (b)(2), the Secretary shall complete the review of the assessment and plans and make a determination regarding compliance with this section.</text></subparagraph> 
<subparagraph id="H6BB815B6CF03484099E7DF7FB09FD81B"><enum>(D)</enum><header>Subsequent review</header><text>The Secretary may conduct subsequent reviews and determinations of compliance under this Act for a chemical source on a schedule as determined to be appropriate by the Secretary, with priority given to chemical sources in a higher risk tier.</text></subparagraph></paragraph></subsection> 
<subsection id="HBA0454A55166446200C2413C1DD1DC03"><enum>(d)</enum><header>Submission and certification of changes</header> 
<paragraph id="HD7EDE544C7684108B9735BF5489400AA"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date on which a change is made to a chemical source that affects the security of the chemical source, the owner or operator of the chemical source shall—</text> 
<subparagraph id="H91757CE8023048058122597651C974D7"><enum>(A)</enum><text>notify the Secretary in writing;</text></subparagraph> 
<subparagraph id="HCC2952F1BE1F4F9F9DE423F8E66E61DF"><enum>(B)</enum><text>provide a description of the change at the chemical source; and</text></subparagraph> 
<subparagraph id="HFFF425814ABB4F5CA31221CA9F901166"><enum>(C)</enum><text>either—</text> 
<clause id="HB38CD8E911434DF6A86D6D48129662FF"><enum>(i)</enum><text>request a waiver from resubmitting the vulnerability assessment, security plan, and emergency response plan; or</text></clause> 
<clause id="H852B35BF805F4153BEAA375359BC59B6"><enum>(ii)</enum><text>review and resubmit the vulnerability assessment, site security plan, and emergency response plan, with the appropriate modifications.</text></clause></subparagraph></paragraph> 
<paragraph id="H7CAE8C6B30594730ABE5DA5919E49533"><enum>(2)</enum><header>Notice and request</header><text>If the Secretary determines that additional modification of a vulnerability assessment, site security plan, or emergency response plan is required, the Secretary shall—</text> 
<subparagraph id="H6F760739B9654555A2679B4666DAE1F8"><enum>(A)</enum><text>provide a written notice to the chemical source owner or operator, requiring modifications addressing any matters specified in the notice; and</text></subparagraph> 
<subparagraph id="H71AD13D1554543BBA204978ED5D1F224"><enum>(B)</enum><text>provide the owner or operator of the chemical source not less than 60 days after the date of the notice under subparagraph (A) to submit proposed modifications.</text></subparagraph></paragraph> 
<paragraph id="H82D069E4F105484D9E8CAB328824A1C3"><enum>(3)</enum><header>Temporary security measures</header><text>During the period before the Secretary approves a modified vulnerability assessment, site security plan, or emergency response plan or issues a waiver, an owner or operator of a chemical source shall ensure temporary security measures are implemented.</text></paragraph></subsection> 
<subsection id="H306182ED41F14430BA4072E1C646F544"><enum>(e)</enum><header>MTSA-regulated facilities</header> 
<paragraph id="H336290D23BD54EEE952E5D7EAADC8885"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (4), a chemical source that is also a MTSA-regulated facility shall comply with this Act.</text></paragraph> 
<paragraph id="H5552AA36D00A473E89972FD518B83D69"><enum>(2)</enum><header>Compliance</header> 
<subparagraph id="H63B5E3D6101340B8BC06279BD22BB49E"><enum>(A)</enum><header>In general</header><text>A chemical source that is also a MTSA-regulated facility shall review its facility security assessment, facility security plan, and emergency response plan and make any modifications necessary to comply with the security performance standards established for the tier applicable to the chemical source under section 3(f) and the requirements of subsection (a)(1).</text></subparagraph> 
<subparagraph id="HD035F5E74C234ABA8490B7B345E64BA8"><enum>(B)</enum><header>Submission</header><text>Not later than 180 days after the date on which the Secretary promulgates regulations under subsection (a)(1), the owner or operator of a chemical source that is also a MTSA-regulated facility shall—</text> 
<clause id="H4FDFF1DCFE3A462DAAF39470872315B"><enum>(i)</enum><text>submit the facility security assessment, facility security plan, and emergency response plan, with any appropriate modifications under subparagraph (A), for the chemical source to the Federal Maritime Security Coordinator for the area in which the chemical source is located and the Secretary for approval; and</text></clause> 
<clause id="H65BB53C0C8E5492FBFCB6EF00AEE8E"><enum>(ii)</enum><text>certify in writing to the Federal Maritime Security Coordinator for the area in which the facility is located and the Secretary that—</text> 
<subclause id="H04F13DBDD6444DAD8E822CA02BA100F2"><enum>(I)</enum><text>the facility security assessment and facility security plan for the facility are in compliance with the security performance standards for the tier applicable to the chemical source under section 3(f) and the requirements under subsection (a)(1); and</text></subclause> 
<subclause id="H03B130B8146D4E3E8E091DD7F91E30FF"><enum>(II)</enum><text>the owner or operator has submitted an approved or certified emergency response plan required under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/701">chapter 701</external-xref> of title 46, United States Code, to the Federal Maritime Security Coordinator for the area in which the facility is located.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H346A83424BE24D19A44D6FE0AFAF88F2"><enum>(3)</enum><header>Review by the Secretary</header><text>In accordance with the procedures under subsection (c), the Secretary, in consultation with the Federal Maritime Security Coordinator for the area in which a chemical source that is also a MTSA-regulated facility is located, shall determine whether a facility security assessment and facility security plan submitted under paragraph (2)(B) meets the security performance standards established by the Secretary under section 3(f) and the requirements under subsection (a)(1).</text></paragraph> 
<paragraph id="HBFCC9DB0225F43F0B32245D828006B90"><enum>(4)</enum><header>Exemption</header><text>A chemical source that is a MTSA-regulated facility is exempt from section 6(d) of this Act.</text></paragraph> 
<paragraph id="HDE86394231E343EFADBF2E00F2EA4DE6"><enum>(5)</enum><header>Integration and coordination</header> 
<subparagraph id="H6E2944C3E040408DBA9DDCCD1EB61E2"><enum>(A)</enum><header>In general</header><text>The Secretary shall implement this Act and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/701">chapter 701</external-xref> of title 46, United States Code, in as consistent and integrated manner as possible.</text></subparagraph> 
<subparagraph id="HA17C36462D424DFBB08493874EE46840"><enum>(B)</enum><header>Coast guard</header><text>The Secretary shall ensure coordination between the Under Secretary for Preparedness and the Coast Guard Commandant in carrying out this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H1DF86AD7C7614003AD51B5BDF200F578"><enum>(f)</enum><header>Alternative security programs</header> 
<paragraph id="HDA525C62271045BEA38D949D38ABE887"><enum>(1)</enum><header>In general</header><text>The Secretary may consider a petition submitted by any person that describes—</text> 
<subparagraph id="H0E081347F0AE4EECA03E96B7FD197ED2"><enum>(A)</enum><text>alternate procedures, protocols, and standards established by an industry entity, Federal, State, or local government authorities, or other applicable laws; and</text></subparagraph> 
<subparagraph id="H4A980D35D1F7492A85B5E58DFB2D412B"><enum>(B)</enum><text>the scope of chemical sources to which such program would apply.</text></subparagraph></paragraph> 
<paragraph id="H61B84CBB6829432F923B357CF7AC3378"><enum>(2)</enum><header>Review</header><text>The Secretary may review the requirements of any alternative security program submitted under paragraph (1) to determine whether a vulnerability assessment, security plan, or emergency response plan prepared under that program meets each required element under subsection (a)(1) for a vulnerability assessment, security plan, and emergency response plan submitted under subsection (b)(2).</text></paragraph> 
<paragraph id="H34B3E9C84C264E4A9E682BB1AAB129FF"><enum>(3)</enum><header>Determination</header> 
<subparagraph id="HCBE065E3A43B4713A3B945D62BF5B5C"><enum>(A)</enum><header>In general</header><text>If the Secretary determines that a vulnerability assessment, security plan, or emergency response plan prepared under that alternative security program meets each required element under subsection (a)(1) for a vulnerability assessment, security plan, and emergency response plan submitted under subsection (b)(2), the Secretary shall notify the petitioner that any chemical source covered by that program may submit an assessment or plan prepared under that program without further revision.</text></subparagraph> 
<subparagraph id="HD870FA8077B74756B781F73E170009BF"><enum>(B)</enum><header>Other determinations</header><text>If the Secretary determines that a vulnerability assessment, security plan, or emergency response plan prepared under that alternative security program does not meet each required element under subsection (a)(1) for a vulnerability assessment, security plan, and emergency response plan submitted under subsection (b)(2)—</text> 
<clause id="H86AC9EDF7E1F42BB8CECEBB6A4F8F857"><enum>(i)</enum><text>the Secretary may specify what modifications would be necessary to meet the required elements for a vulnerability assessment, security plan, or emergency response plan submitted under subsection (b)(2); and</text></clause> 
<clause id="H96B3C13EF66946C094D61107F63D00E1"><enum>(ii)</enum><text>a chemical source covered by that program may submit the assessment or plans with the specified modifications.</text></clause></subparagraph> 
<subparagraph id="H364A651BA1E74E5CBF8400B32DB0B404"><enum>(C)</enum><header>Form</header><text>Any action taken by the Secretary under this paragraph shall be made by rule, regulation, or order.</text></subparagraph></paragraph> 
<paragraph id="H8FE5051433B74717A7C74BD042A17400"><enum>(4)</enum><header>Review</header><text>Nothing in this subsection shall relieve the Secretary of the obligation—</text> 
<subparagraph id="H4EE40D0076EA45BF8B676E8BE6EC871"><enum>(A)</enum><text>to review the vulnerability assessment, security plan, and emergency response plan submitted by each chemical source under this section according to the performance standards established by section 3(f) and the requirements under subsection (a)(1); or</text></subparagraph> 
<subparagraph id="HE7F61BC402E64DE1AB7E482193FACE2B"><enum>(B)</enum><text>to approve or disapprove each submission on an individual basis.</text></subparagraph></paragraph></subsection> 
<subsection id="HC45B9B95675841D6B2B08DFBE3C4D5F1"><enum>(g)</enum><header>Periodic review</header> 
<paragraph id="H7CC45AE132F647EC8EF0E8717700BDA2"><enum>(1)</enum><header>In general</header><text>On the timeline established by the Secretary under paragraph (2), the owner or operator of a chemical source shall—</text> 
<subparagraph id="H93462FA272844E44BAFEC0CD00139B1"><enum>(A)</enum><text>review the adequacy of the vulnerability assessment, site security plan, and emergency response plan for the chemical source;</text></subparagraph> 
<subparagraph id="HBB3108D3C5BD4839BCD1BDC3AA8CCB82"><enum>(B)</enum><text>certify to the Secretary that the chemical source has completed the review and implemented any necessary modifications to the vulnerability assessment, site security plan, or emergency response plan; and</text></subparagraph> 
<subparagraph id="H009B927D004742D6BD91771D10C10204"><enum>(C)</enum><text>provide to the Secretary a description of any changes to the vulnerability assessment, site security plan, or emergency response plan.</text></subparagraph></paragraph> 
<paragraph id="H0998B873694B42019E7ED6A99EE587FE"><enum>(2)</enum><header>Timing</header><text>The Secretary shall establish a timeline for review appropriate to the tier level of the chemical source that requires a review—</text> 
<subparagraph id="HC1A4FBD80D244657A1F6001E1801BB6D"><enum>(A)</enum><text>for a higher risk tier, not later than 1 year after the date of approval of a vulnerability assessment, site security plan, and emergency response plan under subsection (b)(1) and not less often than every 3 years thereafter; and</text></subparagraph> 
<subparagraph id="HD82A458C68A34930B30000C1A1D56F1E"><enum>(B)</enum><text>for all other tiers, not later than 5 years after the date of approval of a vulnerability assessment, site security plan, and emergency response plan under subsection (b)(1) and not less often than every 5 years thereafter.</text></subparagraph></paragraph></subsection></section> 
<section id="H8DC0652D1FD24E6E93B866464774AC23"><enum>5.</enum><header>Recordkeeping; site inspections; production of information</header> 
<subsection id="H4BD83A3D12894CBF8031172876E95BE5"><enum>(a)</enum><header>Recordkeeping</header><text>The owner or operator of a chemical source shall retain a copy of the vulnerability assessment, site security plan, and emergency response plan for the chemical source for not less than 5 years after the date on which such assessment or plan was approved by the Secretary under section 4(c).</text></subsection> 
<subsection id="H62EC978C0AEE4BDE87E00037D4A57DA0"><enum>(b)</enum><header>Right of entry</header> 
<paragraph id="H71E48D8196804FE8979687124EB9F9C4"><enum>(1)</enum><header>In general</header><text>In carrying out this Act, the Secretary or the designee of the Secretary, on presentation of credentials, shall have a right of entry to, on, or through—</text> 
<subparagraph id="H934D7E4B16784B59B9B90004788C8805"><enum>(A)</enum><text>the premises of a chemical source; and</text></subparagraph> 
<subparagraph id="HA1442E72EB924DDB966F7DDF90D15208"><enum>(B)</enum><text>any premises on which any record required to be maintained under subsection (a) is located.</text></subparagraph></paragraph> 
<paragraph id="H89B99F496BCE487686B0FEECC1076DCD"><enum>(2)</enum><header>Audits and inspections</header> 
<subparagraph id="H7EA9B86788B34E0387A441E0EDDC60B"><enum>(A)</enum><header>In general</header><text>The Secretary shall, at such times and places as the Secretary determines to be appropriate, conduct, or require the conduct of, facility security audits and inspections, the requirements of which may be established by rule, regulation, or order.</text></subparagraph> 
<subparagraph id="H5AA0768DF5AE4B1AB91269D2FE62CC79"><enum>(B)</enum><header>Scope</header><text>Audits and inspections under subparagraph (A) shall ensure and evaluate compliance with this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H19186F4B7BE14A5CA26B98C83893A2F2"><enum>(c)</enum><header>Requests for records</header><text>In carrying out this Act, the Secretary may require the submission of, or, on presentation of credentials, may at reasonable times seek access to and copy—</text> 
<paragraph id="H0B6225658AA342C0BA84C7EB24CDC926"><enum>(1)</enum><text>any records, reports, or other information described in subsection (a); and</text></paragraph> 
<paragraph id="H3946C011667D45B9AFBBB310DA879F9F"><enum>(2)</enum><text>any other documentation necessary for the—</text> 
<subparagraph id="H7FD1AD7BADFD4CEF9B5D4021222CF8B7"><enum>(A)</enum><text>review or analysis of a vulnerability assessment or security plan; or</text></subparagraph> 
<subparagraph id="H2704BDD4B22A46BF879172E1FB24F48C"><enum>(B)</enum><text>implementation of a security plan.</text></subparagraph></paragraph></subsection> 
<subsection id="H2EE3B522E97E4614B75E9EDD7FBBF748"><enum>(d)</enum><header>Compliance</header><text>If the Secretary determines that an owner or operator of a chemical source is not maintaining, producing, or permitting access to records or to the premises of the chemical source as required by this section, the Secretary may issue an order requiring compliance with the relevant provisions of this section.</text></subsection></section> 
<section id="HA6676F489A7D4F5D8313B238AD1692DB"><enum>6.</enum><header>Infrastructure Protection and implementation</header> 
<subsection id="H24A10E39716A43EE8DF2738B57BB937F"><enum>(a)</enum><header>Coordination</header> 
<paragraph id="H3B3E3BD5D5EC4FCDB7AC002FF57F3C43"><enum>(1)</enum><header>In general</header><text>The Secretary shall ensure effective chemical security planning and response by providing the necessary infrastructure, leadership, technical assistance, guidance, and accountability for security planning and response in areas surrounding chemical sources.</text></paragraph> 
<paragraph id="HB6E80C50A2874D4D9F2E354F7C2B00A5"><enum>(2)</enum><header>With other law</header><text>The Secretary shall model the regulations promulgated, organizations established, and actions taken under this section on the requirements of sections 70102, 70103, 70104, and 70112 of title 46, United States Code.</text></paragraph> 
<paragraph id="H4336B3AE121E44CEA171A43300E9023C"><enum>(3)</enum><header>With committees</header><text>The Secretary, and those in positions assigned under this section, shall coordinate with other Federal area security and response committees in order to provide a unified and effective Federal effort for security and response organizational infrastructure for the Nation. Nothing in this section shall supersede any other Federal area security or response committee and the entities established under this section shall be organized to complement such other committees.</text></paragraph></subsection> 
<subsection id="H987DEEF9FD764E29A7E31658A0CDCB00"><enum>(b)</enum><header>Compliance office</header> 
<paragraph id="H70B10F7235D14E61B0795629713FB38B"><enum>(1)</enum><header>Establishment</header><text>Not later than 3 months after the date of enactment of this Act, the Secretary shall establish an office under the Assistant Secretary for Infrastructure Protection that shall be responsible for implementing and enforcing this Act.</text></paragraph> 
<paragraph id="H64EE88B96DDD4FCDB8C714DBBE0026FE"><enum>(2)</enum><header>Activities</header><text>The Secretary, acting through the Assistant Secretary for Infrastructure Protection, shall—</text> 
<subparagraph id="H3DCBA7E1E11242F7ACF0FFBFD545D126"><enum>(A)</enum><text>provide leadership, guidance, planning, technical assistance, resources, and conduct oversight activities to establish an effective chemical security planning and response infrastructure for the Nation;</text></subparagraph> 
<subparagraph id="H7F16BE1B7E5F40040003BBAAFC145ED"><enum>(B)</enum><text>provide leadership, personnel, training, equipment, other resources as necessary, and technical assistance to—</text> 
<clause id="H1217D9B8B48747D790E2D513006194E9"><enum>(i)</enum><text>Federal, State and local government agencies;</text></clause> 
<clause id="H7DF337B1257745DBAEEA090000DD888D"><enum>(ii)</enum><text>Infrastructure Protection Regional Security Offices; and</text></clause> 
<clause id="H7CB0F630A86B41C5BA4DC39F3780E83C"><enum>(iii)</enum><text>Area Security Committees, as requested by the Federal Area Security Coordinator;</text></clause></subparagraph> 
<subparagraph id="H7F9485E66B8E4CAEAEA29B13FF8E500"><enum>(C)</enum><text>coordinate with law enforcement agencies, first responders, and chemical sources regarding the response to a potential or actual terrorist incident at a chemical source;</text></subparagraph> 
<subparagraph id="HE9D23EC1F3E84FF4B1DA1E7349F01FA"><enum>(D)</enum><text>review and approve each Area Security Plan submitted under subsection (d); and</text></subparagraph> 
<subparagraph id="HA799D293BC1342EEA00376436F2C31B3"><enum>(E)</enum><text>coordinate with the Office of State and Local Government Coordination and Preparedness of the Department, to ensure some homeland security grants administered by the Department support the plans required under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H75CC004D2FBE4B2BA5C511298CE728C1"><enum>(c)</enum><header>Infrastructure Protection Regional Security Offices</header> 
<paragraph id="H5A4DEB15AB364255BAE2C9B3A8FAFF20"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall establish in each Federal Emergency Management Agency Region an Infrastructure Protection Regional Security Office, for purposes of carrying out this Act and coordinating regional security, as described in this section.</text></paragraph> 
<paragraph id="HAB04FF61F2F440B99182717D7FFA42C3"><enum>(2)</enum><header>Membership and duties</header><text>Each Infrastructure Protection Regional Security Office shall—</text> 
<subparagraph id="H1E00583C8A8C46D68C41C8540055F827"><enum>(A)</enum><text>consist of—</text> 
<clause id="H8F0DEED19972480CAE9EBABD9C3C85A3"><enum>(i)</enum><text>the personnel of the Infrastructure Protection Office of the Department within the region; and</text></clause> 
<clause id="HB1F6FC082C934583BE3B048B94FC01A4"><enum>(ii)</enum><text>a regional security advisory staff, to be appointed by the Secretary;</text></clause></subparagraph> 
<subparagraph id="HE1F00F1DD10845839E4442C477BCB904"><enum>(B)</enum><text>review and approve each Area Security Plan for the region to ensure coordination between regions and States;</text></subparagraph> 
<subparagraph id="H9968F0609ECF458AB8E400941DEEA945"><enum>(C)</enum><text>oversee implementation of this Act to ensure consistent implementation within the region, in conjunction with the strategic mission and policies of, and guidance from, the Department; and</text></subparagraph> 
<subparagraph id="HA97E47E23928409DA4E8894E4DDF1743"><enum>(D)</enum><text>perform other functions as assigned by the Secretary necessary to implement the requirements of this Act or help protect other critical infrastructure.</text></subparagraph></paragraph></subsection> 
<subsection id="HCD98BF4CC0BA4947B2BB1F5FCA2A21F"><enum>(d)</enum><header>Area Security Committees and plans</header> 
<paragraph id="H0353FD2DD74D4C17A928FB4B80BF296F"><enum>(1)</enum><header>Designation of areas and Federal Area Security Coordinators</header> 
<subparagraph id="H8D6906237F9346449B85EB9CF884FE1F"><enum>(A)</enum><header>Deadline</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall designate geographic areas for the Area Committees established under paragraph (2).</text></subparagraph> 
<subparagraph id="H9B4334F0AAC444EF9E5B3918F8B98FBC"><enum>(B)</enum><header>Requirements</header><text>In designating areas under subparagraph (A), the Secretary shall ensure that—</text> 
<clause id="H3F50A0B8D5EF4FD9B3EC6F26AD36F5E"><enum>(i)</enum><text>except as provided in subparagraph (C), all parts of the United States are included in an area; and</text></clause> 
<clause id="H679F9B6EC96946F282CF012D60EE7BC"><enum>(ii)</enum><text>no area is larger than a single State, although an area may incorporate portions of more than 1 State, based on the organization and number of chemical sources in a geographic area.</text></clause></subparagraph> 
<subparagraph id="HCDE5C9B3E75747BBBA772FB23CBF59F4"><enum>(C)</enum><header>Exclusion</header><text>Any area designated under <external-xref legal-doc="usc" parsable-cite="usc/46/70103">section 70103(a)(2)(G)</external-xref> of title 46, United States Code, shall not be included in any area designated under this Act.</text></subparagraph></paragraph> 
<paragraph id="HCC7637F5A03B4DF1A57657E293002500"><enum>(2)</enum><header>Establishment and designation</header> 
<subparagraph id="HBF1A2032998C44B6A1B255970325E6B4"><enum>(A)</enum><header>Committees</header><text>There is established for each area designated by the Secretary under paragraph (1) an Area Security Committee, comprised of members appointed by the Secretary, in consultation with State and local government officials, from qualified and effected security and response personnel of Federal, State, and local government agencies, chemical sources, local emergency planning and response entities, other critical infrastructure sectors, and other appropriate organizations.</text></subparagraph> 
<subparagraph id="H64CDF8A4FF4F4BFF8200B31387F81CF0"><enum>(B)</enum><header>Coordinator</header><text>For each area designated by the Secretary under paragraph (1), the Secretary shall designate a Federal Area Security Coordinator with knowledge of and experience in the activities required under this subsection.</text></subparagraph></paragraph> 
<paragraph id="H2338A6D3B91340E7A66B868F92E927A2"><enum>(3)</enum><header>Duties</header> 
<subparagraph id="HC9A4DED8A6D945428119B474FC17BAE"><enum>(A)</enum><header>Committees</header><text>Each Area Security Committee, under the direction of the Federal Area Security Coordinator for the area assigned to such Area Security Committee, shall—</text> 
<clause id="HD8743212905343998C8362F9A537FD59"><enum>(i)</enum><text>meet not less frequently than twice per year;</text></clause> 
<clause id="H25C47D6F44A8458B8FD61777A6947DD9"><enum>(ii)</enum><text>prepare the Area Security Plan described in paragraph (4) for that area and submit the Area Security Plan to the Secretary for approval; and</text></clause> 
<clause id="H2015AF07744749F686AE9867CEB72FF1"><enum>(iii)</enum><text>coordinate with Federal, State, and local government officials and chemical sources to enhance the security and response planning of those officials and to assure effective preplanning of joint security and response efforts, including exercises, drills, evacuations, sheltering, and rescue.</text></clause></subparagraph> 
<subparagraph id="HC7014337FFDD47CEA52C5D4D37F31D2B"><enum>(B)</enum><header>Coordinator</header><text>Each Federal Area Security Coordinator shall, for the area assigned to such official—</text> 
<clause id="HAE226489CE494FE1A1083CE9D364D38B"><enum>(i)</enum><text>conduct audits and inspections of chemical sources under this Act;</text></clause> 
<clause id="H3B549E167A48484B8E489E374E2BDB95"><enum>(ii)</enum><text>provide appropriate guidance and support to chemical sources; and</text></clause> 
<clause id="HE1CDAFFC70B6439288501C82EFD92160"><enum>(iii)</enum><text>perform such other duties as are required by the Area Security Committee or the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="H42F3CB98B97B4DF5A1A2D6F423DE9B6"><enum>(4)</enum><header>Area Security Plans</header> 
<subparagraph id="HDD22F4DE3A8D4F1FB1972200FB14073F"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, each Area Security Committee shall prepare and submit to the Secretary for approval an Area Security Plan for the area assigned to such Area Security Committee.</text></subparagraph> 
<subparagraph id="H23D55EFCBF1344FCB0E512F8DF59E14"><enum>(B)</enum><header>Plan requirements</header><text>The Area Security Plan shall—</text> 
<clause id="HA27506C3C2C040D0AE4542D200BC8041"><enum>(i)</enum><text>coordinate the resources of the area assigned to the Area Security Committee to deter a potential or actual terrorist incident at a chemical source in that area, or to respond to a terrorist incident at a chemical source in that area;</text></clause> 
<clause id="H41E59F1E7BDC42BD9D2B912146962EF1"><enum>(ii)</enum><text>coordinate with the National Infrastructure Protection Plan, the National Response Plan, the site security plan of any chemical source located in the area assigned to the Area Security Committee, other appropriate national security and response plans, and the Area Security Plans for contiguous areas;</text></clause> 
<clause id="H36CA3A2FE80B4C3E87E2BFF7007EC02F"><enum>(iii)</enum><text>reflect security and response post-incident investigative reports, as determined by the Secretary;</text></clause> 
<clause id="H3A1F65A56D3E4940853E153E8F4F78B1"><enum>(iv)</enum><text>describe in detail the responsibilities of an owner or operator of a chemical source (based upon the approved site security plan for the chemical source) and of Federal, State, and local government agencies in responding to potential or actual terrorist incident at a chemical source operating in the area assigned to the Area Security Committee;</text></clause> 
<clause id="H116274DEAFF1446B88F4BBAC9DCD5DE"><enum>(v)</enum><text>describe the area covered by the plan, list the assets and resources available to respond to a terrorist incident, and include any other information the Secretary requires;</text></clause> 
<clause id="H9E231348D3084E67987BD1E9C65A64F"><enum>(vi)</enum><text>be updated periodically by the Area Security Committee; and</text></clause> 
<clause id="HF0389CBDA0D64C67A76387A15191F351"><enum>(vii)</enum><text>provide for coordination with the appropriate Federal, State and local government agencies or members of local entities that plan for emergency releases from chemical sources regarding how local populations that may be affected by a release are provided with information, including evacuation planning, sheltering in place, and areas of refuge.</text></clause></subparagraph></paragraph> 
<paragraph id="H755A1D5A74A74C7EB0B4BF56F4A9C13D"><enum>(5)</enum><header>Review</header><text>Not later than 24 months after the date of enactment of this Act, the Secretary shall—</text> 
<subparagraph id="H116447A414F24CFC984600E827FC50F0"><enum>(A)</enum><text>review each Area Security Plan developed under paragraph (4);</text></subparagraph> 
<subparagraph id="H650EDF43270D4EA79C1E1DBB8543BE00"><enum>(B)</enum><text>require amendments to any plan that does not meet the requirements of this section; and</text></subparagraph> 
<subparagraph id="HA5411BC687754376A640AF2D8539E0B3"><enum>(C)</enum><text>approve each plan that meets the requirements of this section.</text></subparagraph></paragraph></subsection> 
<subsection id="HE8D36E4DB6CC43AB9B68EC5978DE49E7"><enum>(e)</enum><header>Area exercises and drills</header> 
<paragraph id="HA271E42901874E4FBC700441D0182799"><enum>(1)</enum><header>In general</header><text>The Secretary shall periodically conduct drills and exercises, some without prior notice, including full functional and communications exercises of security and response capability in each area for which an Area Security Plan is required under this section and under the site security plan and emergency response plans of relevant chemical sources.</text></paragraph> 
<paragraph id="H6B0099DC65394B98AD57B0B3D9DF495F"><enum>(2)</enum><header>Scope of participation</header><text>The drills and exercises conducted under paragraph (1) may include participation by—</text> 
<subparagraph id="HC19B50370B1241F2A004200500C58E98"><enum>(A)</enum><text>Federal, State, and local government agencies, including law enforcement and first responders;</text></subparagraph> 
<subparagraph id="HDFDA5CC4A20D43C0893D6C1DF566CD6F"><enum>(B)</enum><text>the owner and operator of any chemical source in the area;</text></subparagraph> 
<subparagraph id="H107490747D1D43768C89D27BD90018F0"><enum>(C)</enum><text>members of local entities that plan for emergency releases;</text></subparagraph> 
<subparagraph id="H192140BA54C74FA78FA94800D95BB718"><enum>(D)</enum><text>representatives of other critical infrastructure; and</text></subparagraph> 
<subparagraph id="HC3D27ED3D8194D78A15107A0028A400"><enum>(E)</enum><text>other participants as determined appropriate by the Secretary or the designee of the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H7F9C5F986BDF46C0A2CCC919C5556FD6"><enum>(3)</enum><header>Reports</header><text>The Secretary shall publish annual reports on drills under this subsection, including assessments of the effectiveness of the plans described in paragraph (1), lessons learned, and a list of any amendments made to improve any plan described in paragraph (1). The annual reports shall not include protected information.</text></paragraph></subsection></section> 
<section id="H46C10253867640F18F4B554341E2ACDE"><enum>7.</enum><header>Heightened security measures</header> 
<subsection id="HCF5F1430E1D74B9F8DFB58AFEBF7C3E"><enum>(a)</enum><header>In general</header><text>If the Secretary determines that additional security measures are necessary to respond to a threat assessment or to a specific threat against the chemical sector, the Secretary may issue an order to the owner or operator of a chemical source setting forth mandatory security measures. Only the Secretary or the designee of the Secretary may issue an order under this section.</text></subsection> 
<subsection id="H226B2EF42A99465A98C7A1B21743F873"><enum>(b)</enum><header>Period of order</header> 
<paragraph id="HFCEB859B701D482AB68B6CEE1B79716D"><enum>(1)</enum><header>In general</header><text>Any order issued by the Secretary under subsection (a) shall be effective upon issuance and shall remain in effect for a period of not more than 90 days, unless the Secretary files an action in an appropriate United States district court before the expiration of that 90-day period.</text></paragraph> 
<paragraph id="H718A78252C464400B94CBD5063A465A6"><enum>(2)</enum><header>Effect of filing</header><text>If the Secretary files an action described in paragraph (1), an order issued by the Secretary under subsection (a) shall remain in effect for 14 days in addition to the 90-day period under paragraph (1), or for such shorter or longer period as may be authorized by the court in which such action is filed.</text></paragraph></subsection></section> 
<section id="H28124F6052BC4542BD4B91001D35E1ED"><enum>8.</enum><header>Penalties</header> 
<subsection id="HAC722EA23BC3462E9E70F6B0F767E8A7"><enum>(a)</enum><header>Administrative penalties</header> 
<paragraph id="H2C6AA3F90EDB4297A5AB8BD8E4784B8"><enum>(1)</enum><header>Penalties</header><text>The Secretary may impose an administrative penalty of not more than $25,000 per day, and not more than a maximum of $1,000,000 per year, for failure to comply with an order or directive issued by the Secretary under this Act.</text></paragraph> 
<paragraph id="HA3B897789C034E89A623AA9B8716324E"><enum>(2)</enum><header>Notice and hearing</header><text>Before imposing a penalty under paragraph (1), the Secretary shall provide to the person against which the penalty is to be assessed—</text> 
<subparagraph id="HD9586B3CA4314F22970382A6D16920F9"><enum>(A)</enum><text>a written notice of the proposed penalty; and</text></subparagraph> 
<subparagraph id="H6396A179683D4AD3829C405797205618"><enum>(B)</enum><text>not later than 30 days after the date on which the person receives the notice, the opportunity to request a hearing on the proposed penalty.</text></subparagraph></paragraph> 
<paragraph id="HC5062D0B7FF746B6A911DC87D19197AB"><enum>(3)</enum><header>Procedures</header><text>The Secretary shall promulgate regulations establishing procedures for administrative hearings and appropriate review, including necessary deadlines.</text></paragraph></subsection> 
<subsection id="HF42F09AD239B4A2B83ADC8CC2C376121"><enum>(b)</enum><header>Civil penalties</header> 
<paragraph id="H680EF72D220248579200EA4475E5F87"><enum>(1)</enum><header>In general</header><text>The Secretary may bring an action in a United States district court against any owner or operator of a chemical source that violates or fails to comply with any order or directive issued by the Secretary under this Act or a site security plan approved by the Secretary under this Act.</text></paragraph> 
<paragraph id="H4DE72F1E031D4E7190D33E4EA25339DE"><enum>(2)</enum><header>Relief</header><text>In any action under paragraph (1), a court may issue an order for injunctive relief and may award a civil penalty of not more than $50,000 for each day on which a violation occurs or a failure to comply continues.</text></paragraph></subsection> 
<subsection id="H3A660B2F4DCE4920951C054B26DB18E9"><enum>(c)</enum><header>Criminal penalties</header><text>An owner or operator of a chemical source who knowingly violates any order issued by the Secretary under this Act or knowingly fails to comply with a site security plan approved by the Secretary under this Act shall be fined not more than $50,000 for each day of such violation, imprisoned not more than 2 years, or both.</text></subsection></section> 
<section id="H7651CBEE2A41438F899E59E841007886"><enum>9.</enum><header>Protection of information</header> 
<subsection id="H2BF13ED5C58646E9A01D5EA548749143"><enum>(a)</enum><header>Disclosure exemptions</header> 
<paragraph id="H4FA0F35A79364603BEA580F5095179B3"><enum>(1)</enum><header>Records of the Department</header> 
<subparagraph id="H4437AC1387A7443D88A15F3F44B7F700"><enum>(A)</enum><header>In general</header><text>Except as provided in subsection (b), the Department shall not be required under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, to make available to the public a record described in subparagraph (B).</text></subparagraph> 
<subparagraph id="H57C71B81923F4C0EBE481FC8D779CAC0"><enum>(B)</enum><header>Records not disclosed</header><text>A record described in this subparagraph is—</text> 
<clause id="H9A93E9ACDA5C4022948E6BE4E8F2C5DB"><enum>(i)</enum><text>a vulnerability assessment, site security plan, or a security addendum to an emergency response plan obtained by the Department under section 4;</text></clause> 
<clause id="HD16C53CEAAB44A5691AD9F8BA9C0AEF4"><enum>(ii)</enum><text>an area security plan required under section 6(d)(4);</text></clause> 
<clause id="H897704BD8D86471D85ED8376F8A10538"><enum>(iii)</enum><text>materials developed or produced by a chemical source exclusively in preparation of documents referred to in clause (i) and obtained by the Department under section 4; or</text></clause> 
<clause id="HAD5D7F2616DE4F289B78239256FD38DD"><enum>(iv)</enum><text>any record developed exclusively for the purposes of this Act by the Department, or produced exclusively for the purposes of this Act by a chemical source and obtained by the Department under section 4, to the extent that the record contains information that—</text> 
<subclause id="HD4ADA3B4644C4952BD03817623A283B"><enum>(I)</enum><text>describes a specific chemical source or the specific vulnerabilities of a chemical source;</text></subclause> 
<subclause id="H877533B0ED6B43FB9C67D8F3EE351E99"><enum>(II)</enum><text>was taken from a record described in clause (i) or (ii) or from a copy of such record in possession of the chemical source; and</text></subclause> 
<subclause id="H90BD7229BFD64718AB80AC4159302D98"><enum>(III)</enum><text>would, if disclosed, be detrimental to the security of a chemical source.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H6AEBC5958B7F4ABCAAD5533FE15C544E"><enum>(2)</enum><header>Records of other agencies</header> 
<subparagraph id="H24D6A2DB005F427B8897F15E30F1D152"><enum>(A)</enum><header>In general</header><text>A Federal agency other than the Department shall not be required under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, to make available to the public a record described in subparagraph (C).</text></subparagraph> 
<subparagraph id="H2CE9857F5AFE4985932007C562016131"><enum>(B)</enum><header>Referral of requests</header><text>If a Federal agency other than the Department receives a request under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, for a record described in clause (i) or clause (ii)(I) of subparagraph (C), the agency, without consideration by the agency of whether subparagraph (C)(ii)(II) is satisfied—</text> 
<clause id="H653D7A4CF01447758323B5CC3C80028"><enum>(i)</enum><text>shall not disclose the record; and</text></clause> 
<clause id="HC1471526F6FD4DF69F11F32C9B25F95"><enum>(ii)</enum><text>shall refer the request to the Department for processing and response.</text></clause></subparagraph> 
<subparagraph id="H3B4AFB2B23E843868282CC41117E4F"><enum>(C)</enum><header>Records not disclosed</header><text>A record described in this subparagraph is any record—</text> 
<clause id="HC2BD329089B54C7093F59E0086BAA219"><enum>(i)</enum><text>described in paragraph (1)(B) that was shared by the Department with the agency under this section; and</text></clause> 
<clause id="H2E863186AAC54C909BB3EEAB62F9977C"><enum>(ii)</enum><text>produced exclusively for the purposes of this Act by the agency, to the extent that the record contains information that—</text> 
<subclause id="H5648F70D6CD6416AB56FBE8DBFD5F5B8"><enum>(I)</enum><text>describes a specific chemical source or the specific vulnerabilities of a chemical source;</text></subclause> 
<subclause id="HF3BCEEDC21804D9497B9EF7B43648660"><enum>(II)</enum><text>was taken from a record described in clause (i); and</text></subclause> 
<subclause id="H638D2927DB3F40518C62EBBD0032F1BF"><enum>(III)</enum><text>would, if disclosed, be detrimental to the security of a chemical source.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HA17561503E384F1AA8E6033551B0847B"><enum>(3)</enum><header>Records of State or local Government agencies</header> 
<subparagraph id="H61858049684A4BFAAC0210FF64F5237E"><enum>(A)</enum><header>In general</header><text>A State or local government agency shall not be required under any State or local law providing for public access to information to make available to the public a record described in subparagraph (B).</text></subparagraph> 
<subparagraph id="H301BB2FD198E4150864E004977CFDEF5"><enum>(B)</enum><header>Records not disclosed</header><text>A record described in this subparagraph is any record—</text> 
<clause id="HD0F4ADAE47DB44D9B7F3DD6518993EDE"><enum>(i)</enum><text>described in paragraph (1)(B) that was shared by the Department with the State or local government agency under section 6; and</text></clause> 
<clause id="HA514562640F64FAC9435A8D8F21F37A7"><enum>(ii)</enum><text>produced exclusively for the purposes of this Act by the State or local government agency, to the extent that the record contains information that—</text> 
<subclause id="H8CEE35D0BD034A31B87FB80089F9D79E"><enum>(I)</enum><text>describes a specific chemical source or the specific vulnerabilities of a chemical source; and</text></subclause> 
<subclause id="HA655F57D6FBA4F7F896CF2FBB39E01F2"><enum>(II)</enum><text>was taken from a record described in clause (i) or (ii) or from a copy of such document in possession of the chemical source.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H91F8F7A5B0514855AF9F2F2D7B614367"><enum>(b)</enum><header>Public information</header> 
<paragraph id="HBA6D61706CB64023B0CF51C22E208DA1"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HC10129BB872D454CA7740102D59362F2"><enum>(A)</enum><header>Information disclosed</header><text>Except as provided in subparagraph (B), the following records shall be made available to the public under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code:</text> 
<clause id="HEDAE845699784820A640C22C278770C6"><enum>(i)</enum><header>Certifications</header><text>A certification under section 4(b)(1).</text></clause> 
<clause id="H7FD536E5FB124DBCAB09772215DEF291"><enum>(ii)</enum><header>Order for failure to comply</header><text>An order under section 4(b)(3).</text></clause> 
<clause id="HE0180A5DDA48450091B43C35315E5BA4"><enum>(iii)</enum><header>Compliance certificates</header><text>A certificate of compliance under paragraph (2).</text></clause> 
<clause id="H7C49128F274943BEBB03D209A3B40040"><enum>(iv)</enum><header>Other orders</header><text>The identity of any chemical source and the owner or operator of the chemical source for which any other order or any approval or disapproval is issued under this Act, together with information identifying the applicable order, approval, or disapproval.</text></clause></subparagraph> 
<subparagraph id="HC32BF7518CA043469BFB81EE22CF03B8"><enum>(B)</enum><header>Exception</header> 
<clause id="HCE9A69967E664AD2005BC8E33BFBDB7"><enum>(i)</enum><header>In general</header><text>If the Secretary makes a specific finding and determination with respect to a particular chemical source that releasing any record described in subparagraph (A) regarding that chemical source would increase the risk to the security of any chemical source, the Secretary may establish a period, not to exceed 6 months, during which the record shall not be made available to the public under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code.</text></clause> 
<clause id="H3EB03B06001746229EB1B4B116BCF827"><enum>(ii)</enum><header>Extension</header><text>Not more than 60 days before to the expiration of a period established under clause (i) (or an extension of such period under this clause), the Secretary may extend the period for an additional period not to exceed 6 months if the Secretary makes a specific finding and determination with respect to a particular chemical source that releasing any record described in subparagraph (A) regarding that chemical source would increase the risk to the security of any chemical source.</text></clause> 
<clause id="H85C36384CC7C497780110382B2DE236D"><enum>(iii)</enum><header>Notice to GAO</header><text>If the Secretary determines not to allow a record to be made available to the public under clause (i) or extends the period of nondisclosure under clause (ii), the Secretary shall submit to the Comptroller General of the United States, for inclusion and evaluation in the reports under section 12, a detailed statement—</text> 
<subclause id="HDC89A955B76448F3AEC6056B2F6FE6DD"><enum>(I)</enum><text>identifying the chemical source;</text></subclause> 
<subclause id="H7C9B3E0387C149719500634BC49B586E"><enum>(II)</enum><text>describing the record;</text></subclause> 
<subclause id="HD71B4FAE76344E1DA5452950092E7EA0"><enum>(III)</enum><text>explaining the basis for the Secretary’s determination; and</text></subclause> 
<subclause id="H90E93715C88E43D1B3B1074B88BAC9B3"><enum>(IV)</enum><text>describing any security measures being implemented by the chemical source.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HFDC49201204442A2A789397E96A56536"><enum>(2)</enum><header>Certification of compliance</header><text>When the Secretary determines that a chemical source is in compliance with the requirements of this Act, the Secretary shall issue and make available for public inspection a certificate of approval that contains the following statement: <quote>____ (chemical source name) ____ is in compliance with the Chemical Facility Anti-Terrorism Act of 2006.</quote>.</text></paragraph> 
<paragraph id="HEFBD0688ED2245CA9E222145D0BD849E"><enum>(3)</enum><header>Report to Congress</header><text>Not less frequently than once each year, the Secretary shall submit to Congress a public report on the performance of chemical sources under the Act, in the aggregate, including a description of common problems, solutions, and industry best practices.</text></paragraph></subsection> 
<subsection id="H551B3C963A9F47F68F00F9942823167C"><enum>(c)</enum><header>Development of protocols</header> 
<paragraph id="HFA09048984F24669B5328396AF32E8D5"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Director of the Office of Management and Budget and appropriate Federal law enforcement and intelligence officials and in a manner consistent with existing protections for sensitive or classified information, shall, by regulation, establish confidentiality protocols for maintenance and use of records described in paragraphs (1)(B), (2)(C), and (3)(B) of subsection (a).</text></paragraph> 
<paragraph id="HAE6876BCB90F4D9BA7208F144DFFA72"><enum>(2)</enum><header>Requirements for protocols</header><text>The protocols established under paragraph (1) shall ensure, to the maximum extent practicable, that—</text> 
<subparagraph id="H87B7C8F455BE44AD0067B5DB73B6DEF"><enum>(A)</enum><text>the records shall be maintained in a secure location; and</text></subparagraph> 
<subparagraph id="HF961D5197A43450F971C8DA84B293709"><enum>(B)</enum><text>access to records shall be limited—</text> 
<clause id="H4BA2DE12A0714D9B0085F161FC016C4"><enum>(i)</enum><text>as may be necessary to—</text> 
<subclause id="HDC66C405085141BDA6DD673CE22F844C"><enum>(I)</enum><text>enable enforcement of this Act; or</text></subclause> 
<subclause id="HA62C893F277A4FAAB3A994FBCAA0C093"><enum>(II)</enum><text>address an imminent and substantial threat to security, health, safety, or the environment;</text></subclause></clause> 
<clause id="H228CB6603074498D828D00EBF48B97E2"><enum>(ii)</enum><text>to State or local law enforcement officials, first responders, or other State or local government officials granted access to records for the purpose of carrying out this Act; and</text></clause> 
<clause id="H8A61C1486D2743ED92F0BC67031ECE89"><enum>(iii)</enum><text>to other persons granted access for the purpose of carrying out this Act.</text></clause></subparagraph></paragraph> 
<paragraph id="H73016519DF494BF780A400E5465ED962"><enum>(3)</enum><header>Other procedures in protocols</header><text>The protocols established under paragraph (1) shall also—</text> 
<subparagraph id="HDA2F40EE56264C4BA56F940026DCF000"><enum>(A)</enum><text>provide for the labeling of any record described in paragraph (1)(B), (2)(C), or (3)(B) of subsection (a), to enable the sensitive information in such record to be traced back to the specific document from which the information was derived;</text></subparagraph> 
<subparagraph id="H6B7CCF9B6104478990F8AEBD60219F5B"><enum>(B)</enum><text>accommodate the making of disclosures under sections <external-xref legal-doc="usc" parsable-cite="usc/5/2302">2302(b)(8)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/7211">7211</external-xref> of title 5, United States Code, and provide guidance to employees as to how to make such disclosures without compromising security;</text></subparagraph> 
<subparagraph id="H94A66D49A3044F7894E062502F94B389"><enum>(C)</enum><text>include procedures applicable to a request under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, requiring that any portion of a record that reasonably may be separated shall be provided to a person requesting the record after redaction of any portion that is exempt from disclosure;</text></subparagraph> 
<subparagraph id="HB4AAE382AC1B470885D256C439008DED"><enum>(D)</enum><text>establish procedures by which a record described in paragraph (1)(B), (2)(C), or (3)(B) of subsection (a) may become subject to the requirements regarding public disclosure under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, when, because of changed circumstances or the passage of time, disclosure of the record would not be detrimental to the security of a chemical source.</text></subparagraph></paragraph></subsection> 
<subsection id="HDA66F055C44D49238560117B9151BFCB"><enum>(d)</enum><header>Process for reporting problems</header> 
<paragraph id="H3C4B927E7D034877A465E3A29C327BEA"><enum>(1)</enum><header>Establishment of a reporting process</header><text>The Secretary shall establish, and provide information to the public regarding, a process by which any person may submit a report to the Secretary regarding problems, deficiencies, or vulnerabilities at a chemical source.</text></paragraph> 
<paragraph id="H7E52F651835747FC84A7FBFA26C68CA"><enum>(2)</enum><header>Confidentiality</header><text>The Secretary shall keep confidential the identity of a person who submits a report under paragraph (1) and any such report shall be treated as a record described in subsection (a)(1)(B), to the extent that it does not consist of publicly available information.</text></paragraph> 
<paragraph id="HDD193ECE450E454FAF20C80D934DC4D"><enum>(3)</enum><header>Acknowledgment of receipt</header><text>If a report submitted under paragraph (1) identifies the person making the report, the Secretary shall respond promptly to such person and acknowledge receipt of the report.</text></paragraph> 
<paragraph id="HF340F73B812A4104A52E1FD7CE2887A1"><enum>(4)</enum><header>Steps to address problems</header><text>The Secretary shall review and consider the information provided in any report submitted under paragraph (1) and shall take whatever steps the Secretary determines appropriate to address any problems, deficiencies, or vulnerabilities identified.</text></paragraph> 
<paragraph id="H89B06F03DF1C4633B7CFE634911D60FC"><enum>(5)</enum><header>Retaliation prohibited</header><text>No employer may discharge any employee or otherwise discriminate against any employee with respect to the compensation to, or terms, conditions, or privileges of the employment of, such employee because the employee (or a person acting pursuant to a request of the employee) made a report under paragraph (1).</text></paragraph> 
<paragraph id="HECEA7A217405448BB5057166885D6830"><enum>(6)</enum><header>GAO reporting</header><text>The Comptroller General of the United States shall, in the reports under section 12—</text> 
<subparagraph id="H516594E7E64F4D9AA35B719275851EFF"><enum>(A)</enum><text>describe the number and type of problems, deficiencies, and vulnerabilities reported on under this subsection; and</text></subparagraph> 
<subparagraph id="HF5E71EA17324442A966654279F7298AF"><enum>(B)</enum><text>evaluate the Secretary’s efforts in addressing such problems, deficiencies, and vulnerabilities.</text></subparagraph></paragraph></subsection> 
<subsection id="H690D7DD328244E8FB8003E19CF49C18"><enum>(e)</enum><header>Protected disclosures</header><text>Nothing in this Act shall be construed to limit—</text> 
<paragraph id="H83047632AD7C46A8BCD1357837F3FD2B"><enum>(1)</enum><text>the right of an individual to make any disclosure—</text> 
<subparagraph id="H7D264093DB704A90AE4CD5522D78833D"><enum>(A)</enum><text>protected or authorized under section <external-xref legal-doc="usc" parsable-cite="usc/5/2302">2302(b)(8)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/7211">7211</external-xref> of title 5, United States Code; or</text></subparagraph> 
<subparagraph id="H40B5D7402EB04B41A2C866E5DAFF3D5"><enum>(B)</enum><text>to the Special Counsel, the inspector general of an agency, or any other employee designated by the head of an agency to receive similar disclosures; or</text></subparagraph></paragraph> 
<paragraph id="HE4A36736C79340AD8379282024596C7C"><enum>(2)</enum><text>the applicability or enforcement of sections 818 and 820 of the Transportation, Treasury, Housing and Urban Development, the Judiciary, and Independent Agencies Appropriations Act, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/115">Public Law 109–115</external-xref>).</text></paragraph></subsection> 
<subsection id="HA07448992D344E0A898EA72B710395D"><enum>(f)</enum><header>Materials not held by agencies</header><text>Nothing in this Act shall be construed to limit the rights or obligations of any chemical source, any entity that is not a Federal, State, or local government agency in possession of a record described in paragraphs (1)(B), (2)(C), and (3)(B) of subsection (a), or any individual, with respect to the withholding or disclosure of any information or record held by the chemical source, entity, or individual, regardless of whether or not the Department has received or possesses similar or identical information or a similar or identical record.</text></subsection> 
<subsection id="H6BF30F92A28741C9A412082CB717AA92"><enum>(g)</enum><header>Disclosure of independently furnished information</header> 
<paragraph id="H97456C83334C49AB97F9654FF2E12417"><enum>(1)</enum><header>In general</header><text>Nothing in this Act shall be construed to affect the handling, treatment, or disclosure of a record or information obtained from a chemical source under any other law.</text></paragraph> 
<paragraph id="HD8F1212671484CEB001103739CC410D3"><enum>(2)</enum><header>Other authority</header><text>Nothing in this Act shall be construed to affect any authority or obligation of an agency to disclose any record that the agency receives independently of a record that is exempt under this section from the public disclosure requirements under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, regardless of whether or not the Department has an identical or similar record that is so exempt.</text></paragraph></subsection> 
<subsection id="HBC395F563ABC49F68B717DD142F2EB5B"><enum>(h)</enum><header>Other obligations unaffected</header> 
<paragraph id="H0ADA18225D6E4452B608E453FF18D905"><enum>(1)</enum><header>In general</header><text>Nothing in this section affects any obligation of the owner or operator of a chemical source to submit or make available information to a Federal, State, or local government agency under, or otherwise to comply with, any other law.</text></paragraph> 
<paragraph id="H0F9F4DC6D82E4C1B8CC3EAC03716554F"><enum>(2)</enum><header>No use of information to gain governmental benefit</header><text>The owner or operator of a chemical source may not use any record described in paragraph (1)(B), (2)(C), or (3)(B) of subsection (a) to satisfy any legal requirement or obligation other than a requirement under this Act or to obtain any grant, permit, contract, benefit (including agency forbearance, loans, or deduction or modifications of agency penalties or rulings) or other governmental approval.</text></paragraph></subsection> 
<subsection id="H1E91CA567C474EA3AF8246DB4D0969A3"><enum>(i)</enum><header>Availability of information to Congress</header><text>Nothing in this Act shall be construed to authorize information to be withheld from Congress.</text></subsection> 
<subsection id="H4DCCAFBAD6DF46B582784BF573B13D23"><enum>(j)</enum><header>Penalties for unauthorized disclosure</header><text>Any officer or employee of a Federal, State, or local government agency who, in a manner or to an extent not authorized by law, knowingly discloses any record described in paragraph (1)(B), (2)(C), or (3)(B) of subsection (a) shall—</text> 
<paragraph id="H8F8CBECF780A4AAC9186FE4BC0A60021"><enum>(1)</enum><text>be imprisoned not more than 1 year, fined under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States Code, or both; and</text></paragraph> 
<paragraph id="H229A4FBAFECE455081587C693F01385E"><enum>(2)</enum><text>if an officer or employee of the Government, be removed from Federal office or employment.</text></paragraph></subsection></section> 
<section id="H11F066F743FB479DB393757C8046478F"><enum>10.</enum><header>State and other laws</header> 
<subsection id="H1A32CE2033BF463080EB324ECB94CCE"><enum>(a)</enum><header>In general</header><text>Nothing in this Act shall preclude or deny any right of any State or political subdivision thereof to adopt or enforce any regulation, requirement, or standard of performance respecting chemical facility security that is more stringent than a regulation, requirement, or standard of performance in effect under this Act, or shall otherwise impair any right or jurisdiction of the States with respect to chemical facilities within such States unless there is an actual conflict between a provision of this Act and the law of the State.</text></subsection>
<subsection id="HF7A4F9126FF34C66B714C92B801D7608"><enum>(b)</enum><header>Other requirements</header><text>Nothing in this Act shall preclude or deny the right of any State or political subdivision thereof to adopt or enforce any regulation, requirement, or standard of performance, including air or water pollution requirements, that are directed at problems other than reducing damage from terrorist attacks.</text></subsection></section> 
<section id="HB54FD6D69AC24A8EB647DE8B594D7D9C"><enum>11.</enum><header>Chemical security reporting</header><text display-inline="no-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Energy and Commerce of the House of Representatives an update of the national strategy for the chemical sector required to be submitted by the Secretary to the Committee on Appropriations of the Senate and the Committee on Appropriations of the House of Representatives by February 10, 2006.</text></section> 
<section id="H76C800315C3147E6B125817973BD069F"><enum>12.</enum><header>Review by the Government Accountability Office</header> 
<subsection id="H3F1145ADA460412299D3833C00001F5F"><enum>(a)</enum><header>Accessibility</header><text>The Secretary shall provide access to the Government Accountability Office of any document or information required to be submitted to, generated by, or otherwise in the possession of the Department under this Act.</text></subsection> 
<subsection id="H7E0FCACB87D84F77BB00888300EFB78D"><enum>(b)</enum><header>Review and reports</header> 
<paragraph id="HD8700106045E4946945E96B9F97A6E9"><enum>(1)</enum><header>In general</header><text>Not later than January 1 of the first year following the calendar year in which the regulations are promulgated under section 4(a)(1), and on January 1 of each year thereafter, the Government Accountability Office shall submit a report described under paragraph (2) to—</text> 
<subparagraph id="H78D76E5E5F2349F2AAC693BB4CE5DC39"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph> 
<subparagraph id="H18DDC2EE9BE84D4DBA13E0ECADBADDDE"><enum>(B)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="HDCF0B5ADD0984FCB8F57EE03619BDDD2"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include—</text> 
<subparagraph id="H56F5E4A7CCB64DFCB8F6263B06C3614C"><enum>(A)</enum><text>a review of site security plans, vulnerability assessments, and emergency response plans under this Act; and</text></subparagraph> 
<subparagraph id="HF63F7FEDD7514806B4E74DFAEAEC3925"><enum>(B)</enum><text>a determination of whether such plans and assessments are in compliance with this Act.</text></subparagraph></paragraph></subsection></section> 
<section id="H5041FEB2BADF46FB97E840ED252A2A"><enum>13.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></section>
