<official-title>To provide for Medicare reimbursement for health care services provided to Medicare-eligible veterans in facilities of the Department of Veterans Affairs.</official-title>

<section id="HDE7537EBBAF24B6EB9922E82F7D0512C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Medicare Assistance Act of 2006</short-title></quote>.</text></section> 
<section id="H0C03CF5E43C745A1890013648CC9C234"><enum>2.</enum><header>Establishment of medicare subvention for veterans</header><text display-inline="no-display-inline">Section 1862 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H2670188F84BE4BC998572FFFD7ED61D"><enum>(n)</enum><header>Medicare subvention for veterans</header> 
<paragraph id="HE25EAEC75B0A4958B9F68E89343C92"><enum>(1)</enum><header>Establishment of procedure for reimbursement</header> 
<subparagraph id="H0E3692577C6F4DEF923DFCCE250124BB"><enum>(A)</enum><header>In general</header><text>The administering Secretaries shall establish a procedure under which the Secretary shall reimburse the Secretary of Veterans Affairs, from the trust funds, for medicare health care services furnished to medicare-eligible veterans.</text></subparagraph> 
<subparagraph id="HE2947DFE23BA46E29F5D92F1727EA792"><enum>(B)</enum><header>Requirements</header><text>Under the procedure established under subparagraph (A)—</text> 
<clause id="HA167862E389949EB897098F34EF0E0BF"><enum>(i)</enum><text>the administering Secretaries shall certify that any Department of Veterans Affairs medical facility that furnishes medicare health care services for which the Secretary of Veterans Affairs is reimbursed under this subsection has sufficient—</text> 
<subclause id="H7DCC71A0F26E4EF3A3065474CBF5BB29"><enum>(I)</enum><text>resources and expertise to provide the health care benefits required to be provided to individuals entitled to benefits under part A or enrolled under part B; and</text></subclause> 
<subclause id="H9C0EE0A922484CC7B8F66F5B56D42FDA"><enum>(II)</enum><text>information and billing systems in place to ensure accurate and timely submission of claims for health care benefits to the Secretary; </text></subclause></clause> 
<clause id="HB139F82CEF074B04A4F9BE018FD0FBAD"><enum>(ii)</enum><text>the Secretary shall have access to all data of the Department of Veterans Affairs that the Secretary determines is necessary to verify accuracy in billing and claims information; and</text></clause> 
<clause id="H144CDC009FCB49919B1DB32BF7356BEB"><enum>(iii)</enum><text>the Secretary shall waive requirements for conditions of participation otherwise applicable to a provider of services or a supplier under this title in the case of a Department of Veterans Affairs medical facility consistent with paragraph (3).</text></clause></subparagraph> 
<subparagraph id="HA59BF1D0B1DE402BA288D5B836C55B6D"><enum>(C)</enum><header>Restriction on new or expanded facilities</header><text display-inline="yes-display-inline">No new Veterans Affairs medical facilities may be built or expanded with funds received under this subsection. </text></subparagraph></paragraph> 
<paragraph id="H16F3B368E9F142FCB4D7F53364293FF7"><enum>(2)</enum><header>Cost-sharing</header><text>The amount of reimbursement to the Secretary of Veterans Affairs for medicare health care services shall be reduced by amounts attributable to applicable deductible, coinsurance, and cost-sharing requirements under this title.</text></paragraph> 
<paragraph id="H9F261F6A34D24ED1AF2558C913D07E4B"><enum>(3)</enum><header>Medicare requirements</header> 
<subparagraph id="H9997DB6C91854F45002EAF5C9D98CD4C"><enum>(A)</enum><header>Waiver</header><text>The Secretary shall waive any requirements referred to in paragraph (1)(B)(iii) (relating to requirements for conditions of participation) in the case of a Department of Veterans Affairs medical facility, or approve equivalent or alternative ways of meeting such a requirement, but only if such waiver or approval—</text> 
<clause id="H637EC5FB083B47BC0024A742F63BF479"><enum>(i)</enum><text>reflects the unique status of the Department of Veterans Affairs as an agency of the Federal Government; and</text></clause> 
<clause id="H71E0A2544CB24181B1C6D3C204F9E6F2"><enum>(ii)</enum><text>is necessary to provide (or to improve the efficiency of providing) for reimbursement for medicare health care services under this subsection.</text></clause></subparagraph> 
<subparagraph id="HB214C77EDA1A49CA8CC356FD84EB3DFF"><enum>(B)</enum><header>Waiver of prohibition on payments to Federal providers of services</header><text>The prohibition of payments to Federal providers of services under sections 1814(c) and 1835(d), and paragraphs (2) and (3) of subsection (a), shall not apply.</text></subparagraph></paragraph> 
<paragraph id="H2932B8C1789B4457A32CE79B5681A6CA"><enum>(4)</enum><header>Verification of eligibility</header> 
<subparagraph id="HFE685BE6FF9F40369F5660AEC85D5D4F"><enum>(A)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall establish procedures for determining whether an individual is a medicare-eligible veteran.</text></subparagraph> 
<subparagraph id="H325F955037B94F488130C3E5668EF4DD"><enum>(B)</enum><header>Restriction</header><text>No reimbursement shall be made under this subsection for any medicare health care service provided to an individual unless the individual has been determined to be a medicare-eligible veteran pursuant to the procedures established under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H817701BCCBBD4C85836FBB9E0048EAD6"><enum>(5)</enum><header>Data requirements</header><text>Reimbursements for medicare health care services furnished to medicare-eligible veterans may not be made until such time as the administering Secretaries certify to Congress that the—</text> 
<subparagraph id="HD5CC7FCDD78A43CFB02F956CB69508F3"><enum>(A)</enum><text>cost accounting and related transaction systems of the Veterans Health Administration provide cost information and encounter data regarding health care delivered at each Department of Veterans Affairs medical facility on an inpatient and outpatient basis; and</text></subparagraph> 
<subparagraph id="H9C267929107C40209DEE859952B24569"><enum>(B)</enum><text>cost information and encounter data provided by such systems is accurate, reliable, and consistent across all facilities.</text></subparagraph></paragraph> 
<paragraph id="H27F243AE8C1C46709BC7B4176755D1DD"><enum>(6)</enum><header>Payments based on regular medicare payment rates</header> 
<subparagraph id="H94838B1CB2DA4FB7871D00513772A832"><enum>(A)</enum><header>Amount</header><text>Subject to the succeeding provisions of this paragraph, the Secretary shall reimburse the Secretary of Veterans Affairs for health care benefits provided to medicare-eligible veterans at a rate equal to 100 percent of the amounts that otherwise would be payable under this title on a noncapitated basis for such service if the Department of Veterans Affairs medical facility were a provider of services, were participating in the medicare program, and imposed charges for such service.</text></subparagraph> 
<subparagraph id="H728618FFAEE345989F3EA372CD5015B2"><enum>(B)</enum><header>Exclusion of certain amounts</header><text>In computing the amount of payment under subparagraph (A), the following amounts shall be excluded:</text> 
<clause id="HE6B1FA426CE0400F94414DBAEF944E09"><enum>(i)</enum><header>Disproportionate share hospital adjustment</header><text>Any amount attributable to an adjustment under section 1886(d)(5)(F).</text></clause> 
<clause id="HA6CB2A8AA5CC4FD1A9BD8CA00BD2457"><enum>(ii)</enum><header>Direct graduate medical education payments</header><text>Any amount attributable to a payment under section 1886(h).</text></clause> 
<clause id="HB7E50E5AA30D4042A23311DBC50097C6"><enum>(iii)</enum><header>Indirect medical education adjustment</header><text>Any amount attributable to the adjustment under section 1886(d)(5)(B).</text></clause> 
<clause id="H548A339CC8D840E2AED00E79E3091E"><enum>(iv)</enum><header>Percentage of capital payments</header><text>67 percent of any amounts attributable to payments for capital-related costs under medicare payment policies under section 1886(g).</text></clause></subparagraph> 
<subparagraph id="H4681C045533144B8BE6955DB83DB7F5C"><enum>(C)</enum><header>Periodic payments from medicare trust funds</header><text>Payments under this paragraph shall be made—</text> 
<clause id="H8F59D7526887471890DFC31DCF7D537E"><enum>(i)</enum><text>on a periodic basis consistent with the periodicity of payments under this title; and</text></clause> 
<clause id="H2F0E05A6011641C9AA721CB87BB65B20"><enum>(ii)</enum><text>in appropriate part, as determined by the Secretary, from the trust funds.</text></clause></subparagraph></paragraph> 
<paragraph id="HE10AA4A411474804AE34FA9FB2FC2D02"><enum>(7)</enum><header>Crediting of payments</header><text display-inline="yes-display-inline">Any payment shall be deposited in the Department of Veterans Affairs Medical Care Collections Fund established under <external-xref legal-doc="usc" parsable-cite="usc/38/1729A">section 1729A</external-xref> of title 38, United States Code.</text></paragraph> 
<paragraph id="HFAA1565A15894C108D96264D8CC059D7"><enum>(8)</enum><header>Rules of construction</header><text>Nothing in this subsection shall be construed—</text> 
<subparagraph id="HC6397190D29540B885005224136C4FA2"><enum>(A)</enum><text>as prohibiting the Inspector General of the Department of Health and Human Services from investigating any matters regarding the expenditure of funds under this subsection, including compliance with the provisions of this title and all other relevant laws; or</text></subparagraph> 
<subparagraph id="H890D0C869825460C009292D2247E146E"><enum>(B)</enum><text>as adding or requiring additional criteria for eligibility for health care benefits furnished to veterans by the Secretary of Veterans Affairs, as established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code.</text></subparagraph></paragraph> 
<paragraph id="HD85C071CE9AF4100A62CBABA71031C73"><enum>(9)</enum><header>Evaluation and reports</header><text>The administering Secretaries shall conduct ongoing evaluations of the procedure established under this subsection, and shall submit periodic reports to Congress on—</text> 
<subparagraph id="H4B0DB11FEA6345FE9E7DE1A2F8B51F66"><enum>(A)</enum><text>any savings or costs to the medicare program by reason of this subsection; and</text></subparagraph> 
<subparagraph id="H35EBB9E6256A4A5591EACB168006C24"><enum>(B)</enum><text>effects of this subsection on access to care by medicare-eligible veterans.</text></subparagraph></paragraph> 
<paragraph id="H996BA668889546E98900BCCB82A4A16E"><enum>(10)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:—</text> 
<subparagraph id="H6D977188C9E74FE400C39BA4289CDDF7"><enum>(A)</enum><header>Administering secretaries</header><text>The term <quote>administering Secretaries</quote> means the Secretary and the Secretary of Veterans Affairs acting jointly.</text></subparagraph> 
<subparagraph id="HD8E7AB8A4575424C8F9F347795AC9215"><enum>(B)</enum><header>Medicare health care services</header><text>The term <quote>medicare health care services</quote> means items or services covered under part A or B of this title.</text></subparagraph> 
<subparagraph id="H42D739ED7D0A4A8EA780CDA51846B419"><enum>(C)</enum><header>Medicare-eligible veteran</header><text>The term <quote>medicare-eligible veteran</quote> means an individual who—</text> 
<clause id="H4CB15BC7C93348E590589F73FB89A7E3"><enum>(i)</enum><text>is a veteran (as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/101">section 101(2)</external-xref> of title 38, United States Code) who is eligible for care and services under <external-xref legal-doc="usc" parsable-cite="usc/38/1705">section 1705(a)</external-xref> of title 38, United States Code;</text></clause> 
<clause id="H33CC8D55210948A7BCEBD74600B67F66"><enum>(ii)</enum><text>has attained age 65;</text></clause> 
<clause id="H919A074A5F464CFDB3DBA809388BD1ED"><enum>(iii)</enum><text>is entitled to, or enrolled for, benefits under part A of this title; and</text></clause> 
<clause id="H99C1B37B20D34A6EBE67BE1BD2EDF758"><enum>(iv)</enum><text>is enrolled for benefits under part B of this title.</text></clause></subparagraph> 
<subparagraph id="H4A19BF435BFF41A2B305FE5C98D66155"><enum>(D)</enum><header>Trust funds</header><text>The term <quote>trust funds</quote> means the Federal Hospital Insurance Trust Fund established in section 1817 and the Federal Supplementary Medical Insurance Trust Fund established in section 1841.</text></subparagraph> 
<subparagraph id="H27CE17BFBF54433FADB5F400C9AC9801"><enum>(E)</enum><header>Department of veterans affairs medical facility</header><text>The term <quote>Department of Veterans Affairs medical facility</quote> means a medical facility as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/8101">section 8101(3)</external-xref> of title 38, United States Code alone or in conjunction with other facilities under the jurisdiction of the Secretary of Veterans Affairs.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
