<section id="H4EA8EFA6514A43E6A04514468F6328ED" section-type="section-one"><enum>1.</enum><header>Priority in awarding maritime transportation security grants</header><text display-inline="no-display-inline">Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/46/70107">section 70107</external-xref> of title 46, United States Code, is amended to read as follows:</text>

<subsection id="H835AEBFB929F4D41BEC143722E65CD2C"><enum>(a)</enum><header>In general</header> 
<paragraph id="H94000218CF724E3486D750EDDB60836C"><enum>(1)</enum><header>Establishment of grant program</header><text display-inline="yes-display-inline">The Secretary shall establish a grant program for making a fair and equitable allocation of funds to implement Area Maritime Transportation Security Plans and facility security plans among port authorities, facility operators, and State and local government agencies required to provide port security services. Before awarding a grant under the program, the Secretary shall provide for review and comment by the appropriate Federal Maritime Security Coordinators and the Maritime Administrator. In administering the grant program, the Secretary shall take into account national economic and strategic defense concerns.</text></paragraph> 
<paragraph id="H22499661B21549CDBF2E00EC2310F672"><enum>(2)</enum><header>Priority in awarding grants</header><text>In awarding a grant under the grant program established under subsection (a), the Secretary shall prioritize port authorities, facility operators, and State or local government agencies that provide port security based on—</text> 
<subparagraph id="HE937FCF03BA94147B7C1C839749CA01D"><enum>(A)</enum><text>the risks and vulnerabilities of the port for which the port authority, facility operator, or State or local government agency provides security; and</text></subparagraph> 
<subparagraph id="H832FC6624D1645FCBB79FE7D37953855"><enum>(B)</enum><text>the proximity of such port to critical infrastructure or to an urban or sensitive area.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
