<official-title>To amend title II of the Social Security Act to provide that a duty of the Board of Trustees of the Social Security Trust funds is to hold them in trust for the beneficiaries and to ensure that the assets of such trust funds are not diverted, and to authorize investment of such trust funds in securities that are not limited to obligations of the United States or obligations guaranteed as to principal and interest by the United States.</official-title>

<section id="H09EA11D04B6D47879C3F40676BAB98DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security Trust Funds Investment Act of 2006</short-title></quote>.</text></section> 
<section id="H0004C9F126824951A05016B9E346A010"><enum>2.</enum><header>Managment and investment of social security trust funds</header> 
<subsection id="H7EBBC594C90D45B485B7888660EE7E56"><enum>(a)</enum><header>Duty of the Board of Trustees</header><text>Section 201(c)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401(c)(1)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="traditional" id="HBABAC51932E44A4B95C10846F95710F" display-inline="no-display-inline"> 
<paragraph id="H12108DE8656A4B869C499F42304F292D"><enum>(1)</enum><text>Hold the Trust Funds in trust for the benefit of beneficiaries under this title and ensure that the assets of the Trust Funds are not diverted;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H13F0AA1F8252403E8DEB9EC468409241"><enum>(b)</enum><header>Authority to invest assets of the Trust Funds</header><text display-inline="yes-display-inline">Section 201(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401(d)</external-xref>) is amended—</text> 
<paragraph id="HDBDAA8A5A143425BB0D8CC48163F4F41"><enum>(1)</enum><text>by striking the second sentence and inserting the following: <quote>Such investments may be made in interest-bearing obligations of the United States, in obligations guaranteed as to both principal and interest by the United States, or in such other securities as the Board of Trustees may consider prudent investments.</quote>;</text></paragraph> 
<paragraph id="H8AAE71EA3C72432BA539CF29BD23C4F"><enum>(2)</enum><text>in the third sentence, by inserting <quote>or other securities</quote> after <quote>obligations</quote>; and</text></paragraph> 
<paragraph id="H0A1387767C1D4804B0108D6E645F3DAA"><enum>(3)</enum><text>by striking the last sentence and adding the following new sentence: <quote>In making investments under this subsection, the Board of Trustees shall exercise the judgment and care under the circumstances then prevailing that persons of ordinary prudence, discretion, and intelligence exercise in the management of their own affairs, not in regard to speculation, but in regard to the permanent disposition of their funds, considering the probable income therefrom as well as the probable safety of their capital.</quote>.</text></paragraph></subsection></section>
