<enum>I</enum><header>TYLERSVILLE FISH HATCHERY CONVEYANCE</header> <section id="H39AA91B790B54152917758B74B605DD" section-type="sec."><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Tylersville Fish Hatchery Conveyance Act</quote>.</text></section> <section id="HD97C99AA77E34F509B1300229C2BAA76"><enum>102.</enum><header>Conveyance of tylersville national fish hatchery to the state of pennsylvania</header> <subsection id="H69DC94F5F40B4C1E8F0706900600AF9B"><enum>(a)</enum><header>Conveyance requirement</header><text>Within 180 days after the date of the enactment of this Act, the Secretary of the Interior shall convey to the State of Pennsylvania without reimbursement all right, title, and interest of the United States in and to the property described in subsection (b) for use by the Pennsylvania Fish and Boat Commission as part of the State of Pennsylvania fish culture program.</text></subsection> <subsection id="HC9C847F5733144B09186643489101018"><enum>(b)</enum><header>Property described</header><text>The property referred to in subsection (a) consists of—</text> <paragraph id="HE28B6181EDD64CED90DF31EE7D571E81"><enum>(1)</enum><text>the Tylersville division of the Lamar National Fish Hatchery and Fish Technology Center comprised of approximately 40 acres leased to the State of Pennsylvania Fish and Boat Commission, located on 43 Hatchery Lane in Loganton, Pennsylvania, as described in the 1984 Cooperative Agreement between the United States Fish and Wildlife Service and the State of Pennsylvania;</text></paragraph> <paragraph id="H097F17C535144823B5237F0729E6C3BE"><enum>(2)</enum><text>all improvements and related personal property under the control of the Secretary that is located on that property, including buildings, structures, equipment, and all easements and leases relating to that property; and</text></paragraph> <paragraph id="H36F568BF54314DC4B464BE381BA22C3C"><enum>(3)</enum><text>all water rights relating to that property.</text></paragraph></subsection> <subsection id="H10959238EA3B44A1A73556C8B3F69B1"><enum>(c)</enum><header>Reversionary interest</header><text>If any of the property conveyed to the State of Pennsylvania under this section is used for any purpose other than the use authorized under subsection (a), all right, title, and interest in and to all property conveyed under this section shall revert to the United States. The State of Pennsylvania shall ensure that all property reverting to the United States under this subsection is in substantially the same or better condition as at the time of transfer to the State.</text></subsection></section>

This paragraph shall not be considered to authorize delay of the schedule previously established by the United States Fish and Wildlife Service for the submission, judging, and awarding of grants.</text></paragraph></subsection> <subsection id="H3CCC92DA3A6140C09C8F2FBD84E6CF33"><enum>(g)</enum><header>Report</header><text>Section 8 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6107">16 U.S.C. 6107</external-xref>) is amended by striking <quote>October 1, 2002,</quote> and inserting <quote>2 years after the date of the enactment of the Neotropical Migratory Bird Conservation Improvement Act of 2006</quote>.</text></subsection> <subsection id="HC773EDFB03A943E2B3593450C38BAF5E"><enum>(h)</enum><header>Neotropical migratory bird conservation fund</header> <paragraph id="H35D3EE2599F4412E8ECCEC1C9F081714"><enum>(1)</enum><header>In general</header><text>Section 9 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6108">16 U.S.C. 6108</external-xref>) is amended by striking so much as precedes subsection (c) and inserting the following:</text> <quoted-block id="HBA6F95E41A574020889E9D3738E4CEC0" style="OLC"> <section id="H32A35E2F57F44BB8007C0617721245A8"><enum>9.</enum><header>Neotropical migratory bird conservation fund</header> <subsection id="H43F8E7B2ED134F30B57F70A3E056AD00"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a separate account, which shall be known as the <quote>Neotropical Migratory Bird Conservation Fund</quote>. The Fund shall consist of amounts deposited into the Fund by the Secretary of the Treasury under subsection (b).</text></subsection> <subsection id="HB31C94AE18BF4D3E00BD00F08CC1E15B"><enum>(b)</enum><header>Deposits into the fund</header><text>The Secretary of the Treasury shall deposit into the Fund—</text> <paragraph id="H8B28AB8FDE754C6BBAB0411704B3908D"><enum>(1)</enum><text>all amounts received by the Secretary in the form of donations under subsection (d); and</text></paragraph> <paragraph id="H063E156684204DFE9F34A354E0CFD593"><enum>(2)</enum><text>other amounts appropriated to the Fund.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H271CDC9E653D4B7CBD426636481B5BBF"><enum>(2)</enum><header>Administrative expenses</header><text>Section 9(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6108">16 U.S.C. 6108(c)(2)</external-xref>) is amended by striking <quote>$80,000</quote> and inserting <quote>$100,000</quote>.</text></paragraph> <paragraph id="H2F03252F17FE4AC587D4B412FD319B"><enum>(3)</enum><header>Conforming amendments</header><text>Such Act is amended further as follows:</text> <subparagraph id="H9AC9611B85CA4D3AA693B9D344F6F5D0"><enum>(A)</enum><text>In section 4 (<external-xref legal-doc="usc" parsable-cite="usc/16/6103">16 U.S.C. 6103</external-xref>), by striking paragraph (1) and inserting the following:</text> <quoted-block id="H073CFBDEDAE64B9395A2189B5DFCF16B" style="OLC"> <paragraph id="H2B6DA9457E694C8881CF01D0B153BE71"><enum>(1)</enum><header>Fund</header><text>The term <quote>Fund</quote> means the Neotropical Migratory Bird Conservation Fund established by section 9(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H7EADFB3131154AD3B9CADC532546DFD8"><enum>(B)</enum><text>In section 9(d) (<external-xref legal-doc="usc" parsable-cite="usc/16/6108">16 U.S.C. 6108(d)</external-xref>), by striking <quote>Account</quote> and inserting <quote>Fund</quote>.</text></subparagraph></paragraph> <paragraph id="H3C76E2B3B39747E49FF2722FB506B618"><enum>(4)</enum><header>Transfer</header><text>The Secretary of the Treasury may transfer to the Neotropical Migratory Bird Conservation Fund amounts that were in the Neotropical Migratory Bird Conservation Account immediately before the enactment of this Act.</text></paragraph></subsection> <subsection id="H12A5FB836FAE44129CB9234E23D458AF"><enum>(i)</enum><header>Authorization of appropriations</header><text>Section 10 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6109">16 U.S.C. 6109</external-xref>) is amended to read as follows:</text> <paragraph id="H986AD3CE99DA40CA92F35F02E5D735D7"><enum>(1) </enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In General</header-in-text>.—</quote> before the first sentence;</text></paragraph> <paragraph id="HB2CC5C8792A14AEA8C88864140454674"><enum>(2)</enum><text>by striking <quote>$5,000,000 for each of fiscal years 2001 through 2005</quote> and inserting <quote>for each of fiscal years 2006 through 2010 the amount specified for that fiscal year in subsection (b)</quote>; and</text></paragraph> <paragraph id="H6D7F6594EE1A4416B6CCAF1DF18515AA"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H5F02A90D8920425EA590362507F51FDE" style="OLC"> <subsection id="HEEFAAFDB5D3D422687F88CDD797FE600"><enum>(b)</enum><header>Authorized amount</header><text>The amount referred to in subsection (a) is—</text> <paragraph id="H7D1F660E82B84F13BE326361AD3B1602"><enum>(1)</enum><text>$5,000,000 for each of fiscal years 2006 and 2007;</text></paragraph> <paragraph id="H37B018211E8C4C378954A0674709EDCB"><enum>(2)</enum><text>$5,500,000 for fiscal year 2008;</text></paragraph> <paragraph id="H524A69D4AAF94BDC979691792EE7FAAA"><enum>(3)</enum><text>$6,000,000 for fiscal year 2009; and</text></paragraph> <paragraph id="H6F2835C052D340F99FB785E45C91D100"><enum>(4)</enum><text>$6,500,000 for fiscal year 2010.</text></paragraph></subsection> <subsection id="H86A2824CB52645AE9C8228B8E3439FAC"><enum>(c)</enum><header>Availability</header><text>Amounts appropriated under this section may remain available until expended.</text></subsection> <subsection id="HF56B63A90BED40998C01FBA04C29E3DB"><enum>(d)</enum><header>Allocation</header><text>Of amounts appropriated under this section for each fiscal year, not less than 75 percent shall be expended for projects carried out outside the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <enum>IV</enum><header>ED FOUNTAIN PARK EXPANSION ACT</header> <section id="H725116E853284FACBBD9F4C1DA10BE33"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Ed Fountain Park Expansion Act</quote>.</text></section> <section id="H08704D02B6C0425A9BD32D38CDD627AD"><enum>402.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H5DE45EDE96C14E0AAB84DE676026DA13"><enum>(1)</enum><header>Administrative site</header><text>The term <quote>administrative site</quote> means the parcel of real property identified as <quote>Lands to be Conveyed to the City of Las Vegas; approximately, 7.89 acres</quote> on the map entitled <quote>Ed Fountain Park Expansion</quote> and dated November 1, 2005.</text></paragraph> <paragraph id="H453BF3CDF1FB43378CADFEFA6521C361"><enum>(2)</enum><header>City</header><text>The term <quote>City</quote> means the city of Las Vegas, Nevada.</text></paragraph> <paragraph id="H82F52D06C81C4F72AEF08CA77C4C17D5"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></section> <section id="HD2E9DF1EB2D644C392BED5017F10C31"><enum>403.</enum><header>Conveyance of United States fish and wildlife service administrative site, las vegas, nevada</header> <subsection id="H59CB651D76674493B7D9E469406D3E2C"><enum>(a)</enum><header>In general</header><text>The Secretary shall convey to the City, without consideration, all right, title, and interest of the United States in and to the administrative site for use by the City—</text> <paragraph id="HDB49F1E43E7042C28040449F657BC5AF"><enum>(1)</enum><text>as a park; or</text></paragraph> <paragraph id="H516E49FE34614E56AE2F6FF086FC9102"><enum>(2)</enum><text>for any other recreation or nonprofit-related purpose.</text></paragraph></subsection> <subsection id="H5E1FA0492757464292FE6E253D867961"><enum>(b)</enum><header>Administrative expenses</header><text>As a condition of the conveyance under subsection (a), the Secretary shall require that the City pay the administrative costs of the conveyance, including survey costs and any other costs associated with the conveyance.</text></subsection> <subsection id="HBCFB821315FB45EFAEE1004CC399C2CC"><enum>(c)</enum><header>Reversionary interest</header> <paragraph id="H3934104E76344F7A98C87793DE000235"><enum>(1)</enum><header>In general</header><text>If the Secretary determines that the City is not using the administrative site for a purpose described in paragraph (1) or (2) of subsection (a), all right, title, and interest of the City in and to the administrative site (including any improvements to the administrative site) shall revert, at the option of the Secretary, to the United States.</text></paragraph> <paragraph id="H77912EAD213E420395C47105C4BFF3C"><enum>(2)</enum><header>Hearing</header><text>Any determination of the Secretary with respect to a reversion under paragraph (1) shall be made—</text> <subparagraph id="H3AC83601BAD94B2398E48D41C3A906C6"><enum>(A)</enum><text>on the record; and</text></subparagraph> <subparagraph id="H9BEDF534604C429FA000496E80B7A3A6"><enum>(B)</enum><text>after an opportunity for a hearing.</text></subparagraph></paragraph></subsection></section> <enum>V</enum><header>CAHABA RIVER NATIONAL WILDLIFE REFUGE EXPANSION</header> <section id="HD08BE593564A4025BD9EED5540601936"><enum>501.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Cahaba River National Wildlife Refuge Expansion Act</quote>.</text></section> <section id="H90CBA9799E7A4E61BA2DF4E82DB403A9"><enum>502.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H95DF94CB31B44C518B1BB8006EEA0802"><enum>(1)</enum><header>Refuge</header><text>The term <quote>Refuge</quote> means the Cahaba River National Wildlife Refuge and the lands and waters in such refuge in Bibb County, Alabama, as established by the Cahaba River National Wildlife Refuge Establishment Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/331">Public Law 106–331</external-xref>).</text></paragraph> <paragraph id="H525F88CDB292453D80755E17AB5C88A8"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section> <section id="HABF0AAA44C314AE988D4C695AE574607"><enum>503.</enum><header>Expansion of boundaries</header> <subsection id="H68DDC30CB8114E7AA6E6BAD76D8266B2"><enum>(a)</enum><header>Expansion</header><text>The boundaries of the Refuge are expanded to include land and water in Bibb County, Alabama, depicted as <quote>Proposed National Wildlife Refuge Expansion Boundary</quote> on the map entitled <quote>Cahaba River NWR Expansion</quote> and dated March 14, 2006.</text></subsection> <subsection id="HB3021646A48E400C9E9EE4A4C15F956"><enum>(b)</enum><header>Availability of map</header><text>The Secretary shall make the map referred to in subsection (a) available for inspection in appropriate offices of the United States Fish and Wildlife Service.</text></subsection></section> <section id="H9B7C307107EA4E149BC96C28CF9B6666"><enum>504.</enum><header>Acquisition of land and water in expanded boundaries</header> <subsection id="HFE92F17C8B09428788B8895F00D363FF"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the Secretary may acquire by donation, purchase with donated or appropriated funds, or exchange the land and water, and interests in land and water (including conservation easements), within the boundaries of the Refuge as expanded by this title.</text></subsection> <subsection id="H68B6CE636D6C49BEBB3F029102AA7204"><enum>(b)</enum><header>Manner of acquisition</header><text>All acquisitions of land or waters under this section shall be made in a voluntary manner and shall not be the result of forced takings.</text></subsection> <subsection id="H54F5ED28DA7A40558CEBEC888F141521"><enum>(c)</enum><header>Inclusion in refuge; administration</header><text>Any land, water, or interest acquired by the Secretary under this section—</text> <paragraph id="HEA760427F92E40838FCEF285BCF2054F"><enum>(1)</enum><text>shall be part of the Refuge; and</text></paragraph> <paragraph id="H253AC9C26A2B43CF808C57EE34CDEE41"><enum>(2)</enum><text>shall be administered by the Secretary in accordance with—</text> <subparagraph id="H75E773197B5649FF824E972B4C947900"><enum>(A)</enum><text>the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>);</text></subparagraph> <subparagraph id="H19838710D2E84E88812747A41BE48D34"><enum>(B)</enum><text>the Cahaba River National Wildlife Refuge Establishment Act; and</text></subparagraph> <subparagraph id="HB33848423EA949CFA2781DCFED7FE6CE"><enum>(C)</enum><text>this Act.</text></subparagraph></paragraph></subsection></section> <enum>VI</enum><header>CHERRY VALLEY NATIONAL WILDLIFE REFUGE</header> <section id="H363E29B3EBC94794B6A27F7F007F07E5"><enum>601.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Cherry Valley National Wildlife Refuge Study Act</quote>.</text></section> <section id="HD946B71156D842919DA70085C5CDE26"><enum>602.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> <paragraph id="H3A63E9C4176F4A35B694A2D95B2DF15"><enum>(1)</enum><text>The scenic Cherry Valley area of Northeastern Pennsylvania is blessed with more than 80 special-concern animal and plant species and natural habitats.</text></paragraph> <paragraph id="H09C54FD5F8254427A099C76E27822B57"><enum>(2)</enum><text>In a preliminary assessment of Cherry Valley, United States Fish and Wildlife Service biologists ranked Cherry Valley very high as a potential national wildlife refuge.</text></paragraph> <paragraph id="H963D761E02E54FE4B942626E281441EE"><enum>(3)</enum><text>Six species that are listed as endangered species or threatened species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) have been documented within or near Cherry Valley: The bog turtle (possibly the most significant population of the listed subspecies), the dwarf wedge mussel, the northeastern bulrush, the small whorled pogonia, the bald eagle, and the Indiana bat (a historic resident, with efforts under way to re-establish favorable conditions).</text></paragraph> <paragraph id="HBF47EEA3F4B24901AB635B3220DFF1A2"><enum>(4)</enum><text>Cherry Valley provides habitat for at least 79 species of national or regional concern, which either nest in Cherry Valley or migrate through the area during critical times in their life cycle, including—</text> <subparagraph id="HF5A98B6249574E879D15A211A8005D90"><enum>(A)</enum><text>neo-tropical migratory birds such as the Cerulean Warbler, the Worm-eating Warbler, and the Wood Thrush, all of which nest in Cherry Valley;</text></subparagraph> <subparagraph id="H7225E3868E2A4A31B932D500C5E2AAEC"><enum>(B)</enum><text>waterfowl such as the American Black Duck;</text></subparagraph> <subparagraph id="H6EFAF58DEA3D4D3C8F96D006ED37B559"><enum>(C)</enum><text>several globally rare plants, such as the spreading globeflower; and</text></subparagraph> <subparagraph id="H835FABA8449D477591534B2FD8744B98"><enum>(D)</enum><text>anadromous fish species.</text></subparagraph></paragraph> <paragraph id="H18B942DFC56442AEBC49FFE41A190DF"><enum>(5)</enum><text>The Cherry Valley watershed encompasses a large segment of the Kittatinny Ridge, an important migration route for birds of prey throughout the Northeastern United States. Every migratory raptor species in the Northeast is regularly observed along the Kittatinny Ridge during the autumnal migration, including the bald eagle, the golden eagle, and the broad-winged hawk.</text></paragraph> <paragraph id="H1A253755F54E4A5BA7380031071BB4E5"><enum>(6)</enum><text>The Kittatinny Ridge also includes a long segment of the Appalachian Trail, a nationally significant natural-cultural-recreational feature.</text></paragraph> <paragraph id="HBDEB96FA829A49278EB6AA036BB66776"><enum>(7)</enum><text>Many of the significant wildlife habitats found in the Cherry Valley, especially the rare calcareous wetlands, have disappeared from other localities in their range.</text></paragraph> <paragraph id="H185D570C7D85465AA2F0308ED5C5D6F5"><enum>(8)</enum><text>Ongoing studies have documented the high water quality of Cherry Creek.</text></paragraph> <paragraph id="H083111A84AD1418EA964C918C3D298F"><enum>(9)</enum><text>Public meetings over several years have demonstrated strong, deep, and growing local support for a Cherry Valley National Wildlife Refuge, as demonstrated by the following:</text> <subparagraph id="HB43322A131044CCEB24356ABB6ED730"><enum>(A)</enum><text>Area landowners, business and community leaders, media, and elected officials have consistently voiced their enthusiasm for a Cherry Valley National Wildlife Refuge.</text></subparagraph> <subparagraph id="HC83BD5E595FD41E086E34B41ACF5D699"><enum>(B)</enum><text>Numerous local communities and public and private conservation entities share complementary goals for protecting Cherry Valley and are energetically conserving wildlife habitat and farmland. Along with State land-management agencies and the National Park Service, these local entities represent potential strong partners for the United States Fish and Wildlife Service, and view a Cherry Valley National Wildlife Refuge as a complement to existing private, county, municipal, and State efforts.</text></subparagraph> <subparagraph id="HCF7EAA6933FE4CC2BE43002C6F00B967"><enum>(C)</enum><text>A number of local landowners have already put their land into conservation easements or other conservation arrangements.</text></subparagraph> <subparagraph id="HDE2708723D4D4F3DBCFD5915C23C2B46"><enum>(D)</enum><text>A voter-approved Monroe County Open Space Fund and a voter-approved Stroud Township municipal land conservation fund have contributed to many of these projects.</text></subparagraph></paragraph> <paragraph id="H95153E7F6E174657AB2900E6F94B56FA"><enum>(10)</enum><text>Two federally owned parcels of land are contiguous to the area to be studied under this title as for acquisition and inclusion in a future Cherry Valley National Wildlife Refuge: The Delaware Water Gap National Recreation Area and a 700-acre segment of the Appalachian Trail owned by the National Park Service.</text></paragraph></section> <section id="H3CD77892B3364374B53F3845ECC3DCCF"><enum>603.</enum><header>Study of refuge potential and future refuge land acquisition</header> <subsection id="H15CC214EC3FB4FF7B9C7C4200BAACD"><enum>(a)</enum><header>Study</header><text>The Secretary shall initiate within 30 days after the date of the enactment of this Act a study to evaluate the fish and wildlife habitat and aquatic and terrestrial communities located in Northeastern Pennsylvania and identified on the map entitled, <quote>Proposed Cherry Valley National Wildlife Refuge—Authorization Boundary</quote>, dated February 24, 2005, for their potential acquisition by the United States Fish and Wildlife Service through donation, exchange, or willing seller purchase and subsequent inclusion in a future Cherry Valley National Wildlife Refuge.</text></subsection> <subsection id="HFA988CDAE2EF49E78B8CDE7965EB50A0"><enum>(b)</enum><header>Consultation</header><text>The Secretary, while conducting the study required under this section, shall consult appropriate State and local officials, private conservation organizations, major landowners and other interested persons, regarding the identification of eligible lands, waters, and interests therein that are appropriate for acquisition for a national wildlife refuge and the determination of boundaries within which such acquisitions should be made.</text></subsection> <subsection id="H0B5998D8448B4728A1F669393DC79D28"><enum>(c)</enum><header>Components of study</header><text>As part of the study under this section the Secretary shall do the following:</text> <paragraph id="H8BA59CD97A2C4D4289BA1BC51B1156B"><enum>(1)</enum><text>Determine if the fish and wildlife habitat and aquatic and terrestrial communities to be evaluated are suitable for inclusion in the National Wildlife Refuge System and management under the policies of the National Wildlife Refuge System Administration Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/16/668dd">16 U.S.C. 668dd et seq.</external-xref>).</text></paragraph> <paragraph id="H09825B45D7B34BD1AB434FB0525638F2"><enum>(2)</enum><text>Assess the conservation benefits to be gained from the establishment of a Cherry Valley National Wildlife Refuge including—</text> <subparagraph id="H3D2777E674E8483B958801D9D1DADEC4"><enum>(A)</enum><text>preservation and maintenance of diverse populations of fish, wildlife, and plants, including species listed as threatened species or endangered species;</text></subparagraph> <subparagraph id="HA2E881356998483C9DF8B037BA8262F2"><enum>(B)</enum><text>protection and enhancement of aquatic and wetland habitats;</text></subparagraph> <subparagraph id="H741918CDEC694EE4B1DFA996F675BCDA"><enum>(C)</enum><text>opportunities for compatible wildlife-dependent recreation, scientific research, and environmental education and interpretation; and</text></subparagraph> <subparagraph id="HDD708D9416A645A18200BEF9E4536700"><enum>(D)</enum><text>fulfillment of international obligations of the United States with respect to fish, wildlife, and their habitats.</text></subparagraph></paragraph> <paragraph id="H51373CE4EAC9487D96AD46C240D75B3B"><enum>(3)</enum><text>Provide an opportunity for public participation and give special consideration to views expressed by local public and private entities regarding lands, waters, and interests therein for potential future acquisition for refuge purposes.</text></paragraph> <paragraph id="H40EF7F941805408DB65E4956873200DD"><enum>(4)</enum><text>The total area of lands, water, and interests therein that may be acquired shall not in the aggregate exceed 30,000 acres.</text></paragraph></subsection> <subsection id="H7143E893564C46A08E34E3404D7B7FCD"><enum>(d)</enum><header>Report</header><text>The Secretary shall, within 12 months after date of the enactment of this Act, complete the study required by this section and submit a report containing the results thereof to the Committee on Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate. The report shall include—</text> <paragraph id="HCA6296D144894D53AEEEAC9158CF937"><enum>(1)</enum><text>a map that identifies and prioritizes specific lands, waters, and interests therein for future acquisition, and that delineates an acquisition boundary, for a potential Cherry Valley National Wildlife Refuge;</text></paragraph> <paragraph id="H322322C1B6214134A531AB76C1E14814"><enum>(2)</enum><text>a cost estimate for the acquisition of all lands, waters, and interests therein that are appropriate for refuge status; and</text></paragraph> <paragraph id="H4A4DC442154343EC8E19602E89A7AE74"><enum>(3)</enum><text>an estimate of potentially available acquisition and management funds from non-Federal sources.</text></paragraph></subsection> <subsection id="H1CFE879ED1AB432FB4E2EA2600BC8E7F"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $200,000 to carry out the study.</text></subsection></section> <section id="HF35FD5151E6F423FA3184200F985372B"><enum>604.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title the term <quote>Secretary</quote> means the Secretary of the Interior acting through the Director of the United States Fish and Wildlife Service.</text></section> <enum>VII</enum><header>GREAT APE CONSERVATION</header> <section id="HBF4E053C0B8342CABE7921015301A187"><enum>701.</enum><header>Great ape conservation assistance</header><text display-inline="no-display-inline">Section 4 of the Great Ape Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6303">16 U.S.C. 6303</external-xref>) is amended—</text> <paragraph id="H23BB20DE9E3243BE990855751C81004D"><enum>(1)</enum><text>in subsection (d)—</text> <subparagraph id="HAF869997897244A6B7403CECA639962C"><enum>(A)</enum><text>in paragraph (4)(C), by striking <quote>or</quote> after the semicolon at the end;</text></subparagraph> <subparagraph id="H04B88E3ABC4F41B99E90FC42358F3032"><enum>(B)</enum><text>in paragraph (5), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph> <subparagraph id="H4FBE54E3FCBF4C6492126C09DA80FFA2"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H4D54B7EB8E504EF688702C8800AF313E" style="OLC"> <paragraph id="H93FA18C1C76A4A65B57FA7E23566E502"><enum>(6)</enum><text>address root causes of threats to great apes in range states, including illegal bushmeat trade, diseases, lack of regional or local capacity for conservation, and habitat loss due to natural disasters.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H0CC5335EF41040FFB700BC8393A300CF"><enum>(2)</enum><text>in subsection (i)—</text> <subparagraph id="H83AC79B07C63474F96CF03448776B6C"><enum>(A)</enum><text>by striking <quote>Every</quote> and inserting the following:</text> <quoted-block id="HDDBBDFD743024F20A08BC51187566602" style="OLC"> <paragraph id="H6AAA7C5D819A49E6BD29F28E0018C114"><enum>(1)</enum><header>In general</header><text>Every</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H3F485E97F27246E89E89DE3B056CE12D"><enum>(B)</enum><text>in paragraph (1) (as designated by subparagraph (A)), by striking <quote>shall</quote> and inserting <quote>may</quote>; and</text></subparagraph> <subparagraph id="HF1117CA2D7A84C6096E27E02444F9F9C"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H7525105ED90F4ADF947725CAA800FB5F" style="OLC"> <paragraph id="H9AE49AA7D81E46599BFEC74330BAEEE"><enum>(2)</enum><header>Applicability of faca</header><text>The Federal Advisory Committee Act (5 App. U.S.C.) shall not apply to a panel convened under paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="H55609559EB9442B28DFDF5658EAB436B"><enum>702.</enum><header>Great ape conservation fund</header><text display-inline="no-display-inline">Section 5(b)(2) of the Great Ape Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6304">16 U.S.C. 6304(b)(2)</external-xref>) is amended—</text> <paragraph id="HE5425BE464B84188B25B77B83471223D"><enum>(1)</enum><text>by striking <quote>expand</quote> and inserting <quote>expend</quote>; and</text></paragraph> <paragraph id="H69E624B695734D5EA7C7D273FD6DFE5E"><enum>(2)</enum><text>by striking <quote>$80,000</quote> and inserting <quote>$100,000</quote>.</text></paragraph></section> <section id="H8E059FC43663420F91DBA18D30264B25"><enum>703.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 6 of the Great Ape Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6305">16 U.S.C. 6305</external-xref>) is amended by striking <quote>fiscal years 2001 through 2005</quote> and inserting <quote>fiscal years 2006 through 2010</quote>.</text></section>
