<legis-type>A BILL</legis-type> 
<official-title>To prohibit the Department of Homeland Security from procuring certain items directly related to the national security unless the items are grown, reprocessed, reused, or produced in the United States.</official-title>

<legis-body id="HF61128298EEE45868333FE7EAD5150" style="OLC"> 
<section id="HCF9168F69C9847DE91E429F464875FE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Berry Amendment Extension Act</short-title></quote>.</text></section> 
<section section-type="subsequent-section" id="H9FAF1F2F495E459BB7F6D2BC08B74573" display-inline="no-display-inline"><enum>2.</enum><header>Buy-American requirement imposed on Department of Homeland Security; exceptions</header> 
<subsection id="H7DCACA57D4024558AD761BCDB3A2B700"><enum>(a)</enum><header>Requirement</header><text>Except as provided in subsections (c) through (e), funds appropriated or otherwise available to the Department of Homeland Security may not be used for the procurement of an item described in subsection (b) if the item is not grown, reprocessed, reused, or produced in the United States.</text></subsection> 
<subsection id="H2B375015E4044AAEA29EE83B9042B320"><enum>(b)</enum><header>Covered items</header><text>An item referred to in subsection (a) is any of the following, if the item is directly related to the national security interests of the United States:</text> 
<paragraph id="H2321526E4D46429FA8C5EB15BD408B2D"><enum>(1)</enum><text>An article or item of—</text> 
<subparagraph id="H572FF5B487CE41D790BF594B5FB92F5F"><enum>(A)</enum><text>clothing and the materials and components thereof, other than sensors, electronics, or other items added to, and not normally associated with, clothing (and the materials and components thereof);</text></subparagraph> 
<subparagraph id="H407F0227ED1F41F5AE4B47CC98F42D72"><enum>(B)</enum><text>tents, tarpaulins, or covers;</text></subparagraph> 
<subparagraph id="H668BC0D3364F460C969F7F6BEC4F86CF"><enum>(C)</enum><text>cotton and other natural fiber products, woven silk or woven silk blends, spun silk yarn for cartridge cloth, synthetic fabric or coated synthetic fabric (including all textile fibers and yarns that are for use in such fabrics), canvas products, or wool (whether in the form of fiber or yarn or contained in fabrics, materials, or manufactured articles); or</text></subparagraph> 
<subparagraph id="H7976F60192C44D40836B1FD73F36B337"><enum>(D)</enum><text>any item of individual equipment manufactured from or containing such fibers, yarns, fabrics, or materials.</text></subparagraph></paragraph> 
<paragraph id="H4DE6AEFC31F34D3FBBD9F7CF154607C5"><enum>(2)</enum><text>Specialty metals, including stainless steel flatware.</text></paragraph> 
<paragraph id="H5AEFDDBF0BA14A9DBDE65150003868D6"><enum>(3)</enum><text>Hand or measuring tools.</text></paragraph></subsection> 
<subsection id="H87958FBBAC4F431597CF43901FF2D7F6"><enum>(c)</enum><header>Availability exception</header><text>Subsection (a) does not apply to the extent that the Secretary of Homeland Security determines that satisfactory quality and sufficient quantity of any such article or item described in subsection (b)(1) or specialty metals (including stainless steel flatware) grown, reprocessed, reused, or produced in the United States cannot be procured as and when needed at United States market prices.</text></subsection> 
<subsection id="H438545AFAC054157988D74B0934CE808"><enum>(d)</enum><header>Exception for certain procurements outside the United States</header><text>Subsection (a) does not apply to the following:</text> 
<paragraph id="H1F252D9497F843D2AB5CD2D641AD6450"><enum>(1)</enum><text>Procurements by vessels in foreign waters.</text></paragraph> 
<paragraph id="H5D23E347BB9541848D766F6DD418059E"><enum>(2)</enum><text>Emergency procurements or procurements of perishable foods by an establishment located outside the United States for the personnel attached to such establishment.</text></paragraph></subsection> 
<subsection id="HEE94B46F2ECD42CAAB29DB95C42953F"><enum>(e)</enum><header>Exception for small purchases</header><text>Subsection (a) does not apply to purchases for amounts not greater than the simplified acquisition threshold referred to in <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(g)</external-xref> of title 10, United States Code.</text></subsection> 
<subsection id="H621D271292754C19870260C9DD67C024"><enum>(f)</enum><header>Applicability to contracts and subcontracts for procurement of commercial items</header><text>This section is applicable to contracts and subcontracts for the procurement of commercial items notwithstanding section 34 of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/430">41 U.S.C. 430</external-xref>).</text></subsection> 
<subsection id="HD6118A3F67874695843480C8D4F4C206"><enum>(g)</enum><header>Geographic coverage</header><text>In this section, the term <term>United States</term> includes the possessions of the United States.</text></subsection> 
<subsection id="H8D12D61CA7554F1085FB0491F18C5569"><enum>(h)</enum><header>Notification required within 7 days after contract award if certain exceptions applied</header><text>In the case of any contract for the procurement of an item described in subsection (b)(1), if the Secretary of Homeland Security applies an exception set forth in subsection (c) with respect to that contract, the Secretary shall, not later than 7 days after the award of the contract, post a notification that the exception has been applied on the Internet site maintained by the General Services Administration known as FedBizOps.gov (or any successor site).</text></subsection> 
<subsection id="H1F9FEA0BB64240BA84323BEE64FF6165"><enum>(i)</enum><header>Training During Fiscal Year 2006</header> 
<paragraph id="HDC7350E1A9D746ADA8F2636007F9F4BE"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall ensure that each member of the acquisition workforce in the Department of Homeland Security who participates personally and substantially in the acquisition of textiles on a regular basis receives training during fiscal year 2006 on the requirements of this section and the regulations implementing this section.</text></paragraph> 
<paragraph id="HF92E349F5DFF480C97DC991E2D94E07C"><enum>(2)</enum><header>Inclusion of information in new training programs</header><text>The Secretary shall ensure that any training program for the acquisition workforce developed or implemented after the date of the enactment of this Act includes comprehensive information on the requirements described in paragraph (1).</text></paragraph></subsection> 
<subsection id="HF3DFBC2F522845539742146CFAE6B68F" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header>Consistency with international agreements</header> 
<paragraph id="HC316A5A68ACE486AA21700864F455734"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No provision of this Act shall apply to the extent the Secretary of Homeland Security, in consultation with the United States Trade Representative, determines that it is in inconsistent with United States obligations under an international agreement.</text></paragraph> 
<paragraph id="H0C42F364F0AC4452A9FE92E81455B371" display-inline="no-display-inline"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall submit a report each year to Congress containing, with respect to the year covered by the report—</text> 
<subparagraph id="H3843D043920B470E958F501060C1C438"><enum>(A)</enum><text>a list of each provision of this Act that did not apply during that year pursuant to a determination by the Secretary under paragraph (1); and</text></subparagraph> 
<subparagraph id="H9DC08EC2AC3343C9B36CE36FB29ECB9"><enum>(B)</enum><text>a list of each contract awarded by the Department of Homeland Security during that year without regard to a provision in this Act because that provision was made inapplicable pursuant to such a determination. </text></subparagraph></paragraph> </subsection> 
<subsection id="H37BDE56E01194CFCA7E2B779BCDE7230"><enum>(k)</enum><header>Effective date</header><text>This section applies with respect to contracts entered into by the Department of Homeland Security after the date of the enactment of this Act.</text></subsection></section>
