<section section-type="section-one" id="H28C7A6172E5346FE803ECA4544D7AD4E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Death Penalty Abolition Act</short-title></quote>.</text></section> 
<section id="HBE8CF341BD8C45B29868DCBD002E19DA"><enum>2.</enum><header>Repeal of Federal laws providing for the death penalty</header> 
<subsection id="H6A5A96DF11A9474699446177DD6E82D6"><enum>(a)</enum><header>Homicide-related offenses</header> 
<paragraph id="H50B6EA8BA99F4714A3578CDC94D71E85"><enum>(1)</enum><header>Murder related to the smuggling of aliens</header><text>Section 274(a)(1)(B)(iv) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)(1)(B)(iv)</external-xref>) is amended by striking <quote>punished by death or</quote>.</text></paragraph> 
<paragraph id="H8EBDB6EC817046449E94EBB6AC001ECC"><enum>(2)</enum><header>Destruction of aircraft, motor vehicles, or related facilities resulting in death</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/34">Section 34</external-xref> of title 18, United States Code, is amended by striking <quote>to the death penalty or</quote>.</text></paragraph> 
<paragraph id="HF07D8D0993204E25A7B3DADB00E47E48"><enum>(3)</enum><header>Murder committed during a drug-related drive-by shooting</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/36">Section 36(b)(2)(A)</external-xref> of title 18, United States Code, is amended by striking <quote>death or</quote>.</text></paragraph> 
<paragraph id="H1706C19133D44CF3843358E0E07DEBD7"><enum>(4)</enum><header>Murder committed at an airport serving international civil aviation</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/37">Section 37(a)</external-xref> of title 18, United States Code, is amended, in the matter following paragraph (2), by striking <quote>punished by death or</quote>.</text></paragraph> 
<paragraph id="HEBB0961B10E042E4AC461559B75B3E52"><enum>(5)</enum><header>Civil rights offenses resulting in death</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/13">Chapter 13</external-xref> of title 18, United States Code, is amended—</text>

<paragraph id="HF8C2AB47598F47F296C0A6460614D7B"><enum>(6)</enum><header>Murder of a member of congress, an important executive official, or a supreme court justice</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/351">Section 351</external-xref> of title 18, United States Code, is amended—</text>

<paragraph id="H8C0010B164F846C4892447CF155EBE23"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of chapters for part II of title 18, United States Code, is amended by striking the item relating to chapter 228.</text></paragraph></subsection></section> 
<section id="H20A2E4642B8A41F0858CC15696223BDF"><enum>3.</enum><header>Prohibition on imposition of death sentence</header> 
<subsection id="H347B8E4FECAA414996E82FA5B93C5767"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, no person may be sentenced to death or put to death on or after the date of enactment of this Act for any violation of Federal law.</text></subsection> 
<subsection id="H3837202B2DC747AB88001DBB44B9F8BE"><enum>(b)</enum><header>Persons sentenced before date of enactment</header><text>Notwithstanding any other provision of law, any person sentenced to death before the date of enactment of this Act for any violation of Federal law shall serve a sentence of life imprisonment without the possibility of parole.</text></subsection></section>
