<legis-type>A BILL</legis-type> 
<official-title>To prohibit the entry of ocean shipping containers into the United States unless such containers have been scanned and sealed before loading on the vessel for shipment to the United States, either directly or via a foreign port.</official-title>

<section id="H1782D0A3AE7D458DB033D83F8C6B6154" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sail Only if Scanned Act of 2006</short-title></quote>.</text></section> 
<section id="H21758A07881E413BB33300270215C41E"><enum>2.</enum><header>Requirements relating to entry of ocean shipping containers into the United States</header> 
<subsection id="HE3165BF06A2F46AC883242E3B01EACD9"><enum>(a)</enum><header>Requirements</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/70116">Section 70116</external-xref> of title 46, United States Code, is amended by adding at the end the following new subsection: </text>

<subsection id="HC944BD2D2AB5490FA2B001A2E8C36C06"><enum>(c)</enum><header>Requirements relating to entry of ocean shipping containers</header> 
<paragraph id="HDD5CF027235C42B9B3DEC4063BCDF35E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An ocean shipping container may enter the United States, either directly or via a foreign port, only if—</text> 
<subparagraph id="HC85CC08631D4494A898EDE1300F103EB"><enum>(A)</enum><text display-inline="yes-display-inline">the container is scanned with equipment that meets the standards established pursuant to paragraph (2)(A) and a copy of the scan is provided to the Secretary, and</text></subparagraph> 
<subparagraph id="H0F924C8DA33D44B7BC36CFB1FE5E4A5"><enum>(B)</enum><text>the container is secured with a seal that meets the standards established pursuant to paragraph (2)(B),</text></subparagraph><continuation-text continuation-text-level="paragraph">before the container is loaded on the vessel for shipment to the United States.</continuation-text></paragraph> 
<paragraph id="HA89A20EAF1234DA3B2BD7BA400F3F900"><enum>(2)</enum><header>Standards for scanning equipment and seals</header> 
<subparagraph id="H869091F4A36942A687175EFD514BFC47"><enum>(A)</enum><header>Scanning equipment</header><text display-inline="yes-display-inline">The Secretary shall establish standards for scanning equipment required to be used under paragraph (1)(A) to ensure that such equipment uses the best-available technology, including technology to scan a container for radiation and density and, if appropriate, for atomic elements.</text></subparagraph> 
<subparagraph id="HA1682378C3B44048BFE33E9E77D1B9F"><enum>(B)</enum><header>Seals</header><text display-inline="yes-display-inline">The Secretary shall establish standards for seals required to be used under paragraph (1)(B) to ensure that such seals use the best-available technology, including technology to—</text> 
<clause id="H84C55CC2391747D3B031994CD193C037"><enum>(i)</enum><text display-inline="yes-display-inline">detect any breach into a container;</text></clause> 
<clause id="H19CAD32B9F9848BE84A913B21378ADA2"><enum>(ii)</enum><text>identify the time and place of such breach;</text></clause> 
<clause id="HC90D3331BBB84EBA9FD00D4A7643B5D"><enum>(iii)</enum><text>notify the Secretary of such breach before the container enters the Exclusive Economic Zone of the United States; and</text></clause> 
<clause id="H2A74BD4ABF124EEBAF2DFC756881997E"><enum>(iv)</enum><text>track the time and location of the container during transit to the United States, including by truck, rail, or vessel.</text></clause></subparagraph> 
<subparagraph id="HAC8F03273EA14F3100C7A3FCC105A500"><enum>(C)</enum><header>Review and revision</header><text display-inline="yes-display-inline">The Secretary shall review and, if necessary, revise the standards established pursuant to subparagraphs (A) and (B) not less than once every two years.</text></subparagraph> 
<subparagraph id="HCF9ABD60A5BB47D08723D3A82F4DDFDB"><enum>(D)</enum><header>Definition</header><text>In subparagraph (B), the term <quote>Exclusive Economic Zone of the United States</quote> has the meaning given the term <quote>Exclusive Economic Zone</quote> in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(10a)</external-xref> of this title.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCE30E3F51C6645038FAB2514E16E9305" commented="no"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out <external-xref legal-doc="usc" parsable-cite="usc/46/70116">section 70116(c)</external-xref> of title 46, United States Code, as added by subsection (a) of this section, such sums as may be necessary for fiscal year 2007 and each subsequent fiscal year. </text></subsection> 
<subsection id="H430D09005E0644CA9003E600034D0752"><enum>(c)</enum><header>Regulations; effective date</header> 
<paragraph id="HD0B4959F04A642168500B1B0F7F199F8"><enum>(1)</enum><header>Regulations</header> 
<subparagraph id="H706A406333E34CA98B35A0BDF82DC9C1"><enum>(A)</enum><header>Interim final rule</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall issue an interim final rule as a temporary regulation to implement <external-xref legal-doc="usc" parsable-cite="usc/46/70116">section 70116(c)</external-xref> of title 46, United States Code, as added by subsection (a) of this section, not later than 90 days after the date of the enactment of this section, without regard to the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="H229D343627474E8A8CF67FE0A7194E75"><enum>(B)</enum><header>Final rule</header><text display-inline="yes-display-inline">The Secretary shall issue a final rule as a permanent regulation to implement <external-xref legal-doc="usc" parsable-cite="usc/46/70116">section 70116(c)</external-xref> of title 46, United States Code, as added by subsection (a) of this section, not later than one year after the date of the enactment of this section, in accordance with the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code. The final rule issued pursuant to that rulemaking may supersede the interim final rule issued pursuant to subparagraph (A). </text> </subparagraph></paragraph> 
<paragraph id="H273FBC452AC64B30947F55907723D711"><enum>(2)</enum><header>Effective date</header><text>The requirements of <external-xref legal-doc="usc" parsable-cite="usc/46/70116">section 70116(c)</external-xref> of title 46, United States Code, as added by subsection (a) of this section, apply with respect to any ocean shipping container entering the United States, either directly or via a foreign port, beginning one year after the date of the enactment of this Act.</text></paragraph></subsection></section>
