<official-title>To amend the Defense Production Act of 1950 to prohibit acquisitions, mergers, or takeovers of persons engaged in interstate commerce in the United States by entities controlled by or acting on behalf of foreign governments that do not recognize countries that are member states of the United Nations, participate in boycotts against countries that are friendly to the United States, or provide support for international terrorism.</official-title>

<section id="H6DD6ECB118F547C8A15D9000BE48D2CD" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Prohibition on acquisitions, mergers, or takeovers by entities controlled by or acting on behalf of certain foreign governments</header> 
<subsection id="HE899EDBED872499B8700005C59A05500"><enum>(a)</enum><header>In general</header><text>Section 271(d) of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(d)</external-xref>) is amended—</text> 
<paragraph id="HCC407EDF88E74D8CAA2B3B40CACBA54B"><enum>(1)</enum><text>by striking <quote>Subject to subsection (d)</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="HFD7E36D2F5994E33B4AD3F7781AEF78D" display-inline="no-display-inline"> 
<paragraph id="HD19AD2DF62D94BB0844FFA0087D54111"><enum>(1)</enum><header>In general</header><text>Subject to subsection (e)</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H274BB90C98ED49E7AA28DB2366134B33"><enum>(2)</enum><text>by inserting after the first sentence the following new paragraph:</text> 
<quoted-block style="OLC" id="H282113C4F18D4E8EAF9D00611C44FADC" display-inline="no-display-inline"> 
<paragraph id="HE60B942418F14D06BE3CC4FD20002835"><enum>(2)</enum><header>Prohibition on acquisitions, mergers, or takeovers by entities controlled by or acting on behalf of certain foreign governments</header> 
<subparagraph id="H601CF392CDD5441B85DD5F5C27A2D009"><enum>(A)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The President shall prohibit any acquisition, merger, or takeover described in subsection (b) that will result in control of a person engaged in interstate commerce in the United States by an entity controlled by or acting on behalf of a foreign government described in subparagraph (B). </text></subparagraph> 
<subparagraph id="HA3E2A195A74F4853ADF34EF7BDD6E5DA"><enum>(B)</enum><header>Foreign government described</header><text>A foreign government referred to in subparagraph (A) is a foreign government that—</text> 
<clause id="H1A06B79E074D4C778928FB487000F45C"><enum>(i)</enum><text display-inline="yes-display-inline">does not recognize any country that is a member state of the United Nations;</text></clause> 
<clause id="H7E9E50211490404AADD5BA76E527447F"><enum>(ii)</enum><text display-inline="yes-display-inline">takes or knowingly agrees to take any action to support any boycott against a country that is friendly to the United States and that is not itself the object of any form of boycott pursuant to United States law or regulation; or</text></clause> 
<clause id="H84267F6419BE4E9A9155DE9D87CE400"><enum>(iii)</enum><text>the Secretary of State has determined, for purposes of section 6(j) of the Export Administration Act of 1979, section 620A of the Foreign Assistance Act of 1961, section 40 of the Arms Export Control Act, or any other provision of law, is a government that has repeatedly provided support for acts of international terrorism.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6F54799B31234FC285F9B42200099E00"><enum>(3)</enum><text>by striking <quote>The President shall announce</quote> and inserting the following new paragraph: </text> 
<quoted-block style="OLC" id="HCEB6630037724BA388353CCE00D252DE" display-inline="no-display-inline"> 
<paragraph id="H2CC09E8634904D169D8B79C488CBB430"><enum>(3)</enum><header>Announcement of decision; other appropriate relief</header><text>The President shall announce</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H04D633A497A74EB496F6D500688560A2"><enum>(4)</enum><text>in paragraph (3) (as so added)—</text> 
<subparagraph id="HBB424C8B345C4109AD2255E34BF0FB46"><enum>(A)</enum><text>by striking <quote>pursuant to this subsection</quote> and inserting <quote>pursuant to paragraph (1) or (2) of this subsection</quote>; and</text></subparagraph> 
<subparagraph id="H97C2448C018B4B1B9E11AC4D78501D19"><enum>(B)</enum><text>by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a) or (b), as the case may be,</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HB1550FBB395546228274E6824004D4B"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) apply with respect to any written notification of a proposed or pending acquisition, merger, or takeover received pursuant to section 721(b) of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(b)</external-xref>) on or after the date of the enactment of this Act. </text></subsection></section>
