<official-title>To promote the national defense by establishing requirements for the ownership, management, and operation of critical infrastructure in the United States, and for other purposes.</official-title>

<section id="H587F8A8213014AACB870F4218F346B44" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Defense Critical Infrastructure Protection Act of 2006</short-title></quote>.</text></section> 
<section id="H99CAAFE28F23471B83ED83CCFFBF271"><enum>2.</enum><header>Citizenship and other requirements for ownership, management, and operation of United States critical infrastructure</header> 
<subsection id="HD7E6CA5D7537424AB0E35D19BD448ED"><enum>(a)</enum><header>Limitation on corporate ownership and management and operation</header><text display-inline="yes-display-inline">A corporation may not own, or be authorized (by contract or otherwise) to manage or operate, any system or asset that is included on the national defense critical infrastructure list unless the corporation meets the critical infrastructure national security management requirements.</text></subsection> 
<subsection id="HAFF0CEC012C645FFA6B81B604FFBF81F"><enum>(b)</enum><header>Critical infrastructure national security management requirements</header><text display-inline="yes-display-inline">A corporation meets the critical infrastructure national security management requirements for purposes of subsection (a) only if each of the following applies to the corporation:</text> 
<paragraph id="HC3589BE63F264A1ABE64CAB766E1DFE0" display-inline="no-display-inline"><enum>(1)</enum><text>The corporation is organized under the laws of the United States. </text></paragraph> 
<paragraph id="H732F18993FB74DC195B0D23687551C72"><enum>(2)</enum><text>The corporation has a board of directors the majority of whom are citizens of the United States. </text></paragraph> 
<paragraph id="HDFE0490374B0438A8F1F4BD8342510AB"><enum>(3)</enum><text>The corporation has a chief executive officer and chairman of the board of directors who are citizens of the United States.</text></paragraph> 
<paragraph id="HB138EF4958E34206905EAB7900B0FF74"><enum>(4)</enum><text display-inline="yes-display-inline">A majority of the voting shares of the corporation, and a majority of nonvoting shares of the corporation, are owned by citizens of the United States.</text></paragraph> 
<paragraph id="H1223A3594BED408AB83EC0C7D32FCA2F"><enum>(5)</enum><text display-inline="yes-display-inline">More than 50 percent of the members of the board of directors of the corporation have been approved by the Secretary of Defense, in consultation with the Secretary of Homeland Security, for membership on the board.</text></paragraph> 
<paragraph id="HB42C87EC44954C508DF2CA95ED3491FD"><enum>(6)</enum><text>Not less than 20 percent of the members of the board of directors are independent directors.</text></paragraph> 
<paragraph id="HF0293F91FD404F16AFBFB8A5FC16A156"><enum>(7)</enum><text display-inline="yes-display-inline">All of the independent directors have been approved by the Secretary of Defense, in consultation with the Secretary of Homeland Security, for membership on the board.</text></paragraph> 
<paragraph id="HEDF76CCBF6C94337A1B6D716DB5390D7"><enum>(8)</enum><text display-inline="yes-display-inline">The board of directors has a government security committee, all of whose members are approved by the Secretary of Defense, in consultation with the Secretary of Homeland Security, for membership on the committee.</text> </paragraph> 
<paragraph id="H04EBC45469074136BB19253894995588"><enum>(9)</enum><text>The board of directors has a compensation committee that—</text> 
<subparagraph id="H51CFFAB16AE04EBA8BA0CD00B32BE0F3"><enum>(A)</enum><text>is comprised of citizens of the United States; and </text></subparagraph> 
<subparagraph id="HCCB7E47FAA3641D8AAD396ECEE33009B"><enum>(B)</enum><text>includes the independent directors approved under paragraph (7).</text></subparagraph></paragraph> 
<paragraph id="HCC3513A8F64D4EC38C23C84D99AFEF19"><enum>(10)</enum><text display-inline="yes-display-inline">The corporation has agreed to allow, and has instituted procedures to authorize, the Secretary of Defense, in consultation with the Secretary of Homeland Security, to annually inspect the procedures of the corporation for handling classified information and, based on such an annual inspection, the procedures of the corporation for handling classified information have been approved by the Secretary of Defense.</text> </paragraph><continuation-text continuation-text-level="subsection">In the case of a corporation that as of the effective date of subsection (a) owns, or is authorized by contract (or otherwise) to manage or operate, a system or asset that is included on the national defense critical infrastructure list, the provisions of paragraph (4) of this subsection take effect with respect to that corporation as of the date that is five years after the date of the enactment of this Act.</continuation-text></subsection> 
<subsection id="H2CA0C976D68E45EA956B00351DAE19C9" display-inline="no-display-inline"><enum>(c)</enum><header>Notification requirements</header><text display-inline="yes-display-inline">Any corporation that has met the requirements of subsection (b) and that owns, or manages or operates, a system or asset on the national defense critical infrastructure list shall promptly submit notice to the Secretary in the event any of the following occurs:</text> 
<paragraph id="HEACC7C4ABBF4496783897ECFECAE9E44"><enum>(1)</enum><text>Acquisition of ownership or beneficial ownership, direct or indirect, of five percent or more of the corporation’s voting securities by a foreign person.</text></paragraph> 
<paragraph id="H56F55111CA39446BA3FA09D9F9AA71C8"><enum>(2)</enum><text display-inline="yes-display-inline">Acquisition of ownership or beneficial ownership, direct or indirect, of 25 percent or more of any class of the corporation’s nonvoting securities by a foreign person.</text></paragraph> 
<paragraph id="HFE2321C1E8BE479785ECDAB93DAAD7AC"><enum>(3)</enum><text display-inline="yes-display-inline">Authority or ability of a foreign person to have power, direct or indirect, to control the election, appointment, or tenure of directors, officers, or executive personnel of the corporation and the power to control other decisions or activities of the corporation.</text></paragraph> 
<paragraph id="H6E322C6468944B6A91D6A0C6B31F8126"><enum>(4)</enum><text>Total revenues or net income in excess of five percent from a single foreign person or in excess of 30 percent from foreign persons in the aggregate in any fiscal year of the corporation.</text></paragraph> 
<paragraph id="H8DF41BEC2A3C429D96B76657E4DE93DD"><enum>(5)</enum><text>Ten percent or more of any class of the corporation’s voting securities held in <quote>nominee shares</quote>, <quote>street names</quote>, or in some other method that does not disclose the beneficial owner of equitable title.</text></paragraph> 
<paragraph id="HB91C79BE1A954B989B973D048561E421"><enum>(6)</enum><text>Interlocking directors with foreign persons and any officer or management official of the applicant company who is also employed by a foreign person.</text></paragraph> 
<paragraph id="H17AD73E9E6D8405B8B6F02A0BE69A89"><enum>(7)</enum><text>Any other factor that indicates or demonstrates a capability on the part of foreign persons to control or influence the operations or management of the corporation.</text></paragraph> 
<paragraph id="H2A36F1D526EA4B7C0021F3494E90EF8B"><enum>(8)</enum><text display-inline="yes-display-inline">Acquisition by the corporation of ownership of 10 percent or more of any foreign interest.</text> </paragraph></subsection> 
<subsection id="H052E55D2030643FEAB11F84B001E41B" display-inline="no-display-inline"><enum>(d)</enum><header>National defense critical infrastructure list</header> 
<paragraph id="H50844AC9F55B4454BB1CAB247061E27F"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the Secretary of Defense, in consultation with the Secretary of Homeland Security, shall prepare and maintain a list, to be known as the <quote>national defense critical infrastructure list</quote>, of critical infrastructure in the United States. The list shall include both military installations and non-military installations.</text></paragraph> 
<paragraph id="HAA70F9052E134D06A762DEEB88035B7F"><enum>(2)</enum><header>Submission to congressional committees</header><text display-inline="yes-display-inline">Whenever the national defense critical infrastructure list is revised, the Secretary of Defense shall, not later than 15 days after the date of the revision, submit notice of the revision in writing to the following:</text> 
<subparagraph id="HCD33DC83F9CD4E3AA6462586E9DA49C4"><enum>(A)</enum><text>The Committee on Armed Services of the Senate.</text></subparagraph> 
<subparagraph id="H403571B52C744BF9BF772645859230B5"><enum>(B)</enum><text display-inline="yes-display-inline">The Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph> 
<paragraph id="H36E30C8529CB410DBCB168B176DD2E30" display-inline="no-display-inline"><enum>(3)</enum><header>Critical infrastructure defined</header><text>In this section, the term <quote>critical infrastructure</quote> means any system or asset, whether physical or virtual, that is so vital to the United States that the incapacity or destruction of such system or asset would have a debilitating effect on national security, on national economic security, on national public health or safety, or on any combination of those matters. </text> </paragraph></subsection> 
<subsection id="H9499FF44A33745EBB26F48E550609EE"><enum>(e)</enum><header>Citizen of the United States defined</header> <text>In this section: </text> 
<paragraph id="HC42EB9644C3D4A9CBBB115BC137E2EA"><enum>(1)</enum><header>Citizen of the united states</header><text>The term <quote>citizen of the United States</quote> includes— </text> 
<subparagraph id="H8F59F02035BB420187CAC74799FE3B68"><enum>(A)</enum><text>a person that is a citizen of the United States under section 2 of the Shipping Act, 1916 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/802">46 U.S.C. App. 802</external-xref>); and </text></subparagraph> 
<subparagraph id="H5E652A90ADFE44E09097CCAF49FAE1CD"><enum>(B)</enum><text>a United States citizen trust. </text></subparagraph></paragraph> 
<paragraph id="HFD8E76C1FBB5402C8EB5E8D807D9C249"><enum>(2)</enum><header>United States citizen trust</header><text></text> 
<subparagraph id="H9F5658BD6F324B4D8F742C00B686034F"><enum>(A)</enum><text>Subject to subparagraph (C), the term <quote>United States citizen trust</quote> means a trust that is qualified under this paragraph. </text></subparagraph> 
<subparagraph id="H824C9D0E841C4294AC6586FFE0C31C99"><enum>(B)</enum><text>A trust is qualified under this paragraph with respect to critical infrastructure only if— </text> 
<clause id="HD066CE8DEE494AE3B0D95126B9FF087"><enum>(i)</enum><text>each of the trustees is a citizen of the United States; and </text></clause> 
<clause id="H6A4E745437B14AD1A47CB6209962C182"><enum>(ii)</enum><text>the trust submits to the Secretary of Defense an affidavit of each trustee stating that the trustee is not aware of any reason involving a beneficiary of the trust that is not a citizen of the United States, or involving any other person that is not a citizen of the United States, as a result of which the beneficiary or other person would hold more than 25 percent of the aggregate power to influence or limit the exercise of the authority of the trustee with respect to matters involving any ownership or operation of the critical infrastructure that may adversely affect the interests of the United States. </text></clause></subparagraph> 
<subparagraph id="H18B3D5E7197E4421AD6678DEF3275CA5"><enum>(C)</enum><text>If any person that is not a citizen of the United States has authority to direct or participate in directing a trustee for a trust in matters involving any ownership or operation of the critical infrastructure that may adversely affect the interests of the United States or in removing a trustee for a trust without cause, either directly or indirectly through the control of another person, the trust is not qualified under this paragraph unless the trust instrument provides that persons who are not citizens of the United States may not hold more than 25 percent of the aggregate authority to so direct or remove a trustee. </text></subparagraph> 
<subparagraph id="HD3B30FCBB0514C1B9987524113A6537D"><enum>(D)</enum><text>This paragraph shall not be considered to prohibit a person who is not a citizen of the United States from holding more than 25 percent of the beneficial interest in a trust. </text></subparagraph></paragraph></subsection> 
<subsection id="HC7E36CA75C8A43B7B7677D2BEFF8FF0"><enum>(f)</enum><header>Effective dates</header> 
<paragraph id="H2778D970268C47F2B26CA643B82B31DB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) shall take effect on the date on which the national defense critical infrastructure list is submitted to Congress pursuant to paragraph (2) and shall apply to any corporation covered by that subsection as of that date or thereafter.</text></paragraph> 
<paragraph id="H1794688B85B949758FE5D8DAE7CCECA2"><enum>(2)</enum><header>National defense critical infrastructure list</header><text display-inline="yes-display-inline">The national defense critical infrastructure list required by subsection (c) shall be established, and the initial list under that subsection shall be submitted in writing to the Congress, not later than three months after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HC85B4C6DB8EE43439639744500166DEA"><enum>(g)</enum><header>Special rule for certain port terminals</header> 
<paragraph id="H19308D1049A749F58061FB2E61465403"><enum>(1)</enum><header>Special rule</header><text display-inline="yes-display-inline">The port terminals specified in paragraph (2) are deemed to be on the national defense critical infrastructure list, and the provisions of subsection (a) apply with respect to those terminals effective as of February 28, 2006.</text></paragraph> 
<paragraph id="H65D59D1DDAEB409480EC1BE0ECB9D973"><enum>(2)</enum><header>Specified port terminals</header><text display-inline="yes-display-inline">The port terminals specified in this paragraph are the following:</text> 
<subparagraph id="H1A18876CFC3145B99B80FCE748D11D23"><enum>(A)</enum><text>The terminals that as of February 28, 2006, were operated by the United Kingdom company, Peninsular and Oriental Steam Navigation Company (P &amp; O), at the following United States ports: </text> 
<clause id="H67062D4912B54655BE9C812B00A359FA"><enum>(i)</enum><text>Baltimore, Maryland.</text></clause> 
<clause id="HA3B67D75B4A74BF9A8DDCE8289D8EAEF"><enum>(ii)</enum><text display-inline="yes-display-inline">Philadelphia, Pennsylvania.</text></clause> 
<clause id="HAA331BEBDD2B40F7A0D8DC98FDF64170"><enum>(iii)</enum><text>Miami, Florida.</text></clause> 
<clause id="H56D5C92A623F4776A1E35E8DA34BE716"><enum>(iv)</enum><text>New Orleans, Louisiana.</text></clause> 
<clause id="H453568B12EA345F3AD115DB326AD917B"><enum>(v)</enum><text>Houston, Texas.</text></clause> 
<clause id="H9D6E920B7371481EA566801F784660F0"><enum>(vi)</enum><text>Newark and Elizabeth, New Jersey.</text></clause></subparagraph> 
<subparagraph id="H3854B6608B2042218862847CD3E2F8E1"><enum>(B)</enum><text display-inline="yes-display-inline">Any terminal at a port in the United States other than a port listed in subparagraph (A) that as of February 28, 2006, was operated in part, or with the contribution of, the company named in subparagraph (A).</text> </subparagraph></paragraph></subsection> </section> 
<section id="H6AFB66613886461E8C70F78880E904B4" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Enhanced authority to review certain foreign mergers, acquisitions, and takeovers</header> 
<subsection id="H0A83FC314E57437DB23D8D3D7D6220D7"><enum>(a)</enum><header>Confidentiality of information</header><text>Subsection (c) of section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(c)</external-xref>) is amended—</text> 
<paragraph id="HF7C3C5F694234330B399D26CEA2D94E5"><enum>(1)</enum><text>by inserting <quote>during the process of investigation</quote> after <quote>prevent disclosure</quote>; and</text></paragraph> 
<paragraph id="HD25B67D659EA461082251973AABDA92F"><enum>(2)</enum><text>by inserting <quote>of any information considered during the process of investigation</quote> before the period at the end.</text></paragraph></subsection> 
<subsection id="H77AC62393EE048F68EB3EA8D0637009D"><enum>(b)</enum><header>Findings of the President</header><text>Subsection (e) of such section (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(e)</external-xref>) is amended—</text> 
<paragraph id="HE6DF6FFA565F42E689B1A45FA2A1762"><enum>(1)</enum><text>in the matter preceding paragraph (1)—</text> 
<subparagraph id="H9755C32C6B5D4CE6B9C242DAD2B38DF3"><enum>(A)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>;</text></subparagraph> 
<subparagraph id="H205B349082BE454FB2FC834D6D4172AF"><enum>(B)</enum><text>by striking <quote>subsection (c)</quote> and inserting <quote>subsection (d)</quote>; and</text></subparagraph> 
<subparagraph id="H93C4D90C514C4AEF9D353DFDCB8B4CB"><enum>(C)</enum><text>by striking <quote>only</quote>; and </text></subparagraph></paragraph> 
<paragraph id="H2C710653DA6842E5B4F8990057E4BD21"><enum>(2)</enum><text>by striking paragraph (1) and inserting the following:</text>

<paragraph id="H67A8E90272D0451DAA122EB25556F8B7"><enum>(1)</enum><text display-inline="yes-display-inline">there is either—</text> 
<subparagraph id="H74B59908DAE04D788B04AB32C6D61611"><enum>(A)</enum><text>credible evidence that leads the President to believe that the foreign interest exercising control might take action that threatens to impair the national security; or</text></subparagraph> 
<subparagraph id="H3BB863467D5D4C5B9581CD789553D386"><enum>(B)</enum><text>a reasonable expectation that the foreign interest exercising control would use such control—</text> 
<clause id="H6B86FF18FD6145CEA348C576DE826D42"><enum>(i)</enum><text>to adversely affect the ability of domestic industries to meet existing production requirements for defense or homeland security;</text></clause> 
<clause id="H241ADF2B28D44E958828FEDCC285862B"><enum>(ii)</enum><text>to acquire advanced technology illicitly; or</text></clause> 
<clause id="H6D3F4F9373784366A029C29D58E3BA68"><enum>(iii)</enum><text>to increase its ability to affect United States critical infrastructure; and</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8057D33B36F546AF802C761E73225644"><enum>(c)</enum><header>Factors to be considered</header><text>Subsection (f) of such section (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(f)</external-xref>) is amended—</text> 
<paragraph id="H1698759DE29D40659BC2C6F031D76EE6"><enum>(1)</enum><text>in the matter preceding paragraph (1)—</text> 
<subparagraph id="H50CA47E02DB84DDEB8CBC87946B7C096"><enum>(A)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text></subparagraph> 
<subparagraph id="H0D5A71214D49418E82C66E678E3060B1"><enum>(B)</enum><text>by striking <quote>factors—</quote> and inserting <quote>factors the following:</quote>; </text></subparagraph></paragraph> 
<paragraph id="HD37B1B700EAB4D63A78DEAC045A74EAB"><enum>(2)</enum><text>by capitalizing the first letter of the first word of paragraphs (1), (2), (3), (4), and (5);</text></paragraph> 
<paragraph id="HC92AEEE7B1E84D2AB38F00E330058C00" commented="no"><enum>(3)</enum><text>at the end of paragraphs (1), (2), and (3), by striking the comma and inserting a period; </text></paragraph> 
<paragraph id="HBE52A04B91994DC19E32B4E8A645A5D3"><enum>(4)</enum><text display-inline="yes-display-inline">at the end of paragraph (4), by striking <quote>; and</quote> and inserting a period; </text></paragraph> 
<paragraph id="H8849E0AAF61948E69CC08398AD434149" commented="no"><enum>(5)</enum><text>by redesignating paragraph (5) as paragraph (8); and</text></paragraph> 
<paragraph id="H9F2B45559F4045ADB81EE3F57543EAB"><enum>(6)</enum><text>by inserting after paragraph (4) the following new paragraphs:</text> 
<quoted-block style="OLC" id="HBE7845084CA349AC91003F201EB7D566" display-inline="no-display-inline"> 
<paragraph id="H8782EF66AB6C4E4C85749664E01000BA"><enum>(5)</enum><text>Domestic production needed to meet the needs of homeland security.</text></paragraph> 
<paragraph id="HAA821B927DC84B70906CF26B00975B11"><enum>(6)</enum><text>The potential effects of the proposed or pending transaction on control of critical infrastructure, such as energy, telecommunications, transportation, or information.</text></paragraph> 
<paragraph id="H3F687F3BF2C64D66A7A73D7FFA30A9C5"><enum>(7)</enum><text display-inline="yes-display-inline">The potential effects of the proposed or pending transaction on secure United States access to strategic natural resources, including energy supplies and critical minerals.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2ED67EB0AA2B48EDB0129E8D7305B5FB"><enum>(d)</enum><header>Notification to government</header> 
<paragraph id="H25271B420DE64B18ABBEC812C62C3348"><enum>(1)</enum><header>Required notice of proposed or pending transactions</header><text>Such section is further amended—</text> 
<subparagraph id="H6F2005917AD148C8BEC8DF63CF6EFE38"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subsections (g), (h), (i), (j), and (k) as subsections (h), (i), (j), (k), and (l), respectively; and</text></subparagraph> 
<subparagraph id="H44CDD56AC1F44E8D9DC2A1C351FD5655"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subsection (f) the following new subsection:</text>

<subsection id="H6102322EF04244A48174F302F2057040"><enum>(g)</enum><header>Notification to government</header> 
<paragraph id="HA2B345A212CB428EAFE483E542785FE9"><enum>(1)</enum><header>Required notice</header><text>The President shall provide for the regulations issued pursuant to this section to require that, in any case in which there is a proposed or pending merger, acquisition, or takeover that is or may be subject to an investigation under subsection (a), the President or the President’s designee shall be provided written notification of the proposed or pending merger, acquisition, or takeover, as referred to in the second sentence of subsection (a), and that such written notification shall be provided in sufficient time for the review process under this section to be completed before the proposed or pending merger, acquisition, or takeover is finalized.</text></paragraph> 
<paragraph id="HF9863E996A2D474ABB753D669D4FA0C1"><enum>(2) </enum><header>Publication in Federal Register</header><text>Any notification pursuant to paragraph (1) shall be published in the Federal Register within five days of such notification.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H36BDC1801F204E7591E5273C25B2548D"><enum>(2)</enum><header>Interim rules</header><text display-inline="yes-display-inline">The President or the President’s designee may prescribe interim rules necessary to carry out the responsibilities under subsection (g) of section 721 of the Defense Production Act of 1950 as added by paragraph (1)(B). Any otherwise applicable notice-and-comment requirement of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code, shall not apply to such interim rules. Interim rules prescribed under the authority of this subsection that are not earlier superceded by final rules shall expire as specified in such interim rules, but not later than the end of the one-year period beginning on the the date of the enactment of this Act.</text></paragraph> </subsection> 
<subsection id="HDE5A493F9A2E4F928798545E0082626C"><enum>(e)</enum><header>Annual report</header><text display-inline="yes-display-inline">Subsection (l) of such section, as redesignated by subsection (d)(1), is amended—</text> 
<paragraph id="H1CDDE5F783A04B8DA296C84BB6F728E0"><enum>(1)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Quadrennial report.—</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Annual report.—</header-in-text></quote>; and</text></paragraph> 
<paragraph id="HFFA3700B67254ADDA6CAEDFC939700B"><enum>(2)</enum><text>in paragraph (1), by striking <quote>not later than 1 year</quote> and all that follows through <quote>every 4 years thereafter</quote> and inserting <quote>not later than November 1 each year</quote>. </text></paragraph></subsection> 
<subsection id="HB86DA637DFC34CA100DDA816C7900083"><enum>(f)</enum><header>Technical Amendments</header><text>Such section is further amended—</text> 
<paragraph id="H4F6D5E31613E44C180BD4E00BECF5378"><enum>(1)</enum><text>in subsections (a) and (d), by striking <quote>the date of enactment of this section</quote> and inserting <quote>August 23, 1988</quote>;</text></paragraph> 
<paragraph id="H698728F9AD9F4B5AA897E12CD8C4E322"><enum>(2)</enum><text>in subsection (d), by striking <quote>subsection (d)</quote> and inserting <quote>subsection (e)</quote>; and</text></paragraph> 
<paragraph id="H61B9860D8BFD4DD1825027CC9D2B8CF"><enum>(3)</enum><text>in the last sentence of subsection (h), as redesignated by subsection (d)(1), by striking <quote>of this Act</quote>.</text></paragraph> </subsection> 
<subsection id="H28B6A0BCCCC543E98D8351C5701340AE"><enum>(g)</enum><header>Effective dates</header> 
<paragraph id="HC6FF1D73BDDD48BE831180122305D8A7"><enum>(1)</enum><header>Applicability to new investigations</header><text>The amendments made by this section shall apply with respect to any investigation under section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170</external-xref>) that is commenced after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HC2EA1F9B4C6C4B3889A3198F725D14CF"><enum>(2)</enum><header>Time limit for required new regulations</header><text>Regulations required by subsection (g) of such section, as added by the amendment made by subsection (d)(1)(B), shall be prescribed not later than the end of the one-year period beginning on the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="HA7A9F076E78A4E518FCB4B321DA96024" section-type="subsequent-section" display-inline="no-display-inline"><enum>4.</enum><header>Mandatory inspection of cargo</header> 
<subsection id="H3A40E91BB5D34A9983DDC67C63F0C430"><enum>(a)</enum><header>Mandatory inspections</header><text>No cargo transported by a commercial motor vehicle may enter the United States from Canada or Mexico, and no cargo transported by vessel may be unloaded in the United States, unless an appropriate officer or employee of the Directorate of Border and Transportation Security or other appropriate officer or employee of the United States has inspected the cargo to ensure that it complies with the laws of the United States.</text></subsection> 
<subsection id="HD9F9073AB3984307BC20851CF488BC5"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H6700505E8BEB4FFC9B61CF5FA2CCC2B" display-inline="no-display-inline"><enum>(1)</enum><header>Cargo</header><text>The term <quote>cargo</quote> means property, or mail, or both.</text></paragraph> 
<paragraph id="H9EC0230DC5444ED8B355EF0058672CE"><enum>(2)</enum><header>Commercial motor vehicle</header><text>The term <quote>commercial motor vehicle</quote> means a commercial motor vehicle as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/31101">section 31101(1)</external-xref> of title 49, United States Code, that is used principally to transport cargo.</text></paragraph> 
<paragraph id="H9409FF69F6B946D6AC3B71815B7DCF04"><enum>(3)</enum><header>United States; vessel</header><text>The terms <quote>United States</quote> and <quote>vessel</quote> have the meanings given those terms in section 401 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1401">19 U.S.C. 1401</external-xref>).</text></paragraph></subsection> 
<subsection id="H4F2CB5B4A0934A67AD5FB7DD69BCECE1"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect 6 months after the date of the enactment of this Act.</text></subsection></section>
