<subsection id="H33332C9107674342924326EB9F54F8B"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Rocky Mountain Forest Insects Response Enhancement and Support Act</short-title></quote> or the <quote>Rocky Mountain FIRES Act</quote>.</text></subsection>

<section id="HF5DB089522CB4BE0A37339C0153D700"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="HC292675EC01F431CB9C743D48FD1746"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="H4597A0A99EA44CD9A300164BFCA9D8C"><enum>(1)</enum><text>Fire, bark beetles, and other insects that feed on trees are natural parts of the Rocky Mountain forest ecology that have some beneficial effects and help shape the forests by thinning dense tree stands and promoting cyclical re-growth.</text></paragraph> 
<paragraph id="H7432CE8062924788AB7D059C84F6B850"><enum>(2)</enum><text display-inline="yes-display-inline">However, in various parts of the Rocky Mountain region, large-scale infestations of bark beetles and other insects, in combination with other factors, have increased the likelihood of unusually severe wildfires that pose a threat to lives and property in nearby communities.</text></paragraph> 
<paragraph id="HFE8D4E64015143FB94F300439056008C"><enum>(3)</enum><text>This increased wildfire danger is the result of the following factors:</text> 
<subparagraph id="HDF368BF56FE44718A72567D8CBB85F23"><enum>(A)</enum><text display-inline="yes-display-inline">A century-long policy of suppressing even small fires on Federal lands, which combined with a more recent reduction in the quantity of timber harvesting on Federal lands, has resulted in unusually dense vegetation that can provide fuel for unusually severe wildfires.</text></subparagraph> 
<subparagraph id="H220B45CEE3D2498B89A45979AADD7FF1"><enum>(B)</enum><text>A pronounced and prolonged drought that has weakened trees and made them more susceptible to both wildfire and insects.</text></subparagraph> 
<subparagraph id="H512719923026409295C4455975D16E8E"><enum>(C)</enum><text>Population growth in mountain communities adjacent to Federal lands and the development of ski areas and other recreational facilities on and in the vicinity of Federal lands, with a resulting increase in the number of people, homes, and businesses at risk;</text></subparagraph></paragraph> 
<paragraph id="H648EB69F11DB46E3B2F5F3D2B83D3E4"><enum>(4)</enum><text display-inline="yes-display-inline">The Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/148">Public Law 108–148</external-xref>; 16 U.S.C. 6501 et seq) addressed the need to reduce the volume of fuel that can feed the most severe fires that threaten communities.</text></paragraph> 
<paragraph id="HBA74E6809F234209BCDFC61E2C482429"><enum>(5)</enum><text display-inline="yes-display-inline">However, provisions of the Healthy Forests Restoration Act of 2003 and other laws need to be modified to help further reduce the risks to communities in the Rocky Mountain region associated with current insect infestations.</text></paragraph></subsection> 
<subsection id="H25C8CD7EF7D14E298D831450568455E5"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to facilitate a swifter response by the Secretary of Agriculture and the Secretary of the Interior to reduce the increased risk of severe wildfires to communities in the Rocky Mountain region resulting from the effects of widespread infestations of bark beetles and other insects.</text></subsection></section> 
<section id="HAC5A8BB2383544D18345C917EE85199"><enum>3.</enum><header>Response to widespread infestations of bark beetles and other insects on Federal land in Rocky Mountain region</header> 
<subsection id="H697EE2ACAA9D4FE3B492AAE0D658D2AC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>) is amended— </text> 
<paragraph id="H2F1E07126316403CA7CAB252795B745F"><enum>(1)</enum><text>by redesignating paragraphs (12) through (16) as paragraphs (13), (14), (16), (17), and (18), respectively;</text></paragraph> 
<paragraph id="HC8070EF74F7C4366867549925E02457C"><enum>(2)</enum><text>by inserting after paragraph (11) the following new paragraph:</text> 
<quoted-block style="OLC" id="H7BC4852779CE47750063A10D1DA089" display-inline="no-display-inline"> 
<paragraph id="H152205729C394980BCFF4F6890FB1B1F"><enum>(12)</enum><header>Insect-emergency area</header><text display-inline="yes-display-inline">The term <quote>insect-emergency area</quote> means Federal land in the Rocky Mountain region that—</text> 
<subparagraph id="H8ED11552D0C44010877B00FDC74579A3"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary determines is subject to a widespread infestation of bark beetles or other insects; </text></subparagraph> 
<subparagraph id="H569C2159044B4882852EBA1657477904"><enum>(B)</enum><text display-inline="yes-display-inline">is identified for hazardous fuel reduction treatment in a community wildfire protection plan; and</text></subparagraph> 
<subparagraph id="H118AA0F6620344879E140019EED8F838"><enum>(C)</enum><text display-inline="yes-display-inline">is characterized by insect-induced tree mortality that the Secretary determines has, or within one year will have, produced a condition such that an immediate reduction in hazardous fuels is required in order to reduce the risks to human life and property or to a municipal water supply from a severe wildfire.</text></subparagraph></paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H295F4AC93EC349FD99CF00EA11B900CF"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (14), as redesignated by paragraph (2), the following new paragraph:</text> 
<quoted-block style="OLC" id="H0834C53EC0FB4519A4A7C8247508DA7" display-inline="no-display-inline"> 
<paragraph id="HC109621B3F424D93AA49D63D90DC64D5"><enum>(16)</enum><header>Rocky mountain region</header><text>The term <quote>Rocky Mountain region</quote> means the States of Arizona, Colorado, Idaho, Montana, New Mexico, North Dakota, South Dakota, Utah, and Wyoming.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="H50ACD6BAAD084DEB81CDD1B0BEF9B47C"><enum>(b)</enum><header>Funding allocation prioritization for federal lands in rocky mountain region</header><text display-inline="yes-display-inline">Section 103(d)(1) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6513">16 U.S.C. 6513(d)(1)(B)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HCACEC21CE4044E7FA409187F96421348" display-inline="no-display-inline"> 
<subparagraph id="HE062BD4642C640E8AC098C7C8C5FE7B6"><enum>(D)</enum><header>Special rule for rocky mountain region</header><text display-inline="yes-display-inline">The Secretary shall allocate not less than 70 percent of the funds allocated for authorized hazardous fuel reduction projects in the Rocky Mountain region for—</text> 
<clause id="H7F076282D8834B7C969C2C09D92FADAC"><enum>(i)</enum><text>projects in the wildland-urban interface; and</text></clause> 
<clause id="H7A0961634FB1405CBB001D7B06D68458"><enum>(ii)</enum><text display-inline="yes-display-inline">lands that are in proximity to a municipal water supply system or a stream feeding such a system within a municipal watershed and that have been identified for such projects in community wildfire protection plans.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3D97F16B32624181BB6087073271D571"><enum>(c)</enum><header>Alternative analysis process</header><text display-inline="yes-display-inline">Section 104(d)(2) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6514">16 U.S.C. 6514(d)(2)</external-xref>) is amended by inserting after <quote>at-risk community</quote> the following: <quote>or on any other lands identified for such a project in a community wildfire protection plan for an at-risk community in or adjacent to an insect-emergency area</quote>.</text></subsection> 
<subsection id="H03868688E38B4D119EA08DCD6DCB56DE"><enum>(d)</enum><header>Insect emergencies</header><text display-inline="yes-display-inline">Title I of the Healthy Forests Restoration Act of 2003 is amended—</text> 
<paragraph id="H6A4626E6A5C2440B9D2E55936B335794"><enum>(1)</enum><text>by redesignating sections 107 and 108 as sections 109 and 110, respectively; and</text></paragraph> 
<paragraph id="H5A806129FE3845A6917DB318F576A0CD"><enum>(2)</enum><text>by inserting after section 106 the following new section:</text> 
<quoted-block style="OLC" id="H287F4755EE0746A4B0E5309184A1104D" display-inline="no-display-inline"> 
<section id="H92B25E25BA2E480897568E8B37E2E703"><enum>107.</enum><header>Actions related to insect-emergency areas</header> 
<subsection id="H6520219212B14EE800B131C3E28BA72" display-inline="no-display-inline"><enum>(a)</enum><header>Designation</header> 
<paragraph id="HC7297E8B5DDD422FAA00ED45B9100024"><enum>(1)</enum><header>Designation authority</header><text>The Secretary may designate insect-emergency areas. The designation shall be made on the basis of the best information available, including observation of relevant insect infestations.</text></paragraph> 
<paragraph id="H8E8C8263F4A44C1A96696DC12D749F2C"><enum>(2)</enum><header>Initiation</header><text display-inline="yes-display-inline">The designation of an insect-emergency area may be made on the initiative of the Secretary or in response to a request by any State agency or any political subdivision of a State.</text></paragraph> 
<paragraph id="H5596545D25934FD7869DB64765B822A4"><enum>(3)</enum><header>Deadline</header><text display-inline="yes-display-inline">If a State agency or a political subdivision of a State requests an area to be designated as an insect-emergency area pursuant to paragraph (2), the decision regarding such request shall be made no later than 90 days after receipt of the request.</text></paragraph> 
<paragraph id="H74F9D57F46AF48DC85AFEB7CF1F58E76"><enum>(4)</enum><header>Limitation on delegation</header><text display-inline="yes-display-inline">In the case of National Forest System lands, the authority to make a designation under this subsection may be delegated only to a Regional Forester.</text></paragraph></subsection> 
<subsection id="HC20E1579409047B78B65CEDF26136588"><enum>(b)</enum><header>Consultation and public comment</header><text display-inline="yes-display-inline">Before making a determination to designate an insect-emergency area, the Secretary shall—</text> 
<paragraph id="H9E40CFB2D5EF4C74ACE22C679B5ED4B9"><enum>(1)</enum><text>consult with any Federal agency responsible for management of lands within a relevant community wildfire protection plan and appropriate State and local officials; and</text></paragraph> 
<paragraph id="HCF4C8F691F7D4C90919BE52BEF6D0070"><enum>(2)</enum><text>provide public notice and seek public comments.</text></paragraph></subsection> 
<subsection id="HD8D6A26627474339AD3194D6AE7993"><enum>(c)</enum><header>Review of designation</header><text display-inline="yes-display-inline">Any administrative or judicial review of a designation made pursuant to subsection (a) shall be subject to regulations issued pursuant to section 105 and to the provisions of section 106. </text></subsection> 
<subsection id="H9BD4E70D550A4D4EBF541029933731EB"><enum>(d)</enum><header>Effect of determination</header> 
<paragraph id="H6498295EE9E940D7BDE91FC0C8A323A"><enum>(1)</enum><header>Authorized hazardous fuel reduction projects</header><text display-inline="yes-display-inline">An authorized hazardous fuel reduction project involving lands within an area designated as an insect-emergency area may be categorically excluded from documentation in an environmental impact statement and environmental assessment under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) if—</text> 
<subparagraph id="H366CF1C82C1240F28B7963AB3100FB8"><enum>(A)</enum><text>the project involves only lands that are identified for hazardous-fuel reduction treatment in a community wildfire protection plan; and</text></subparagraph> 
<subparagraph id="HE9B0EED8E5CC4D8581AEFB3EE5B73FDA"><enum>(B)</enum><text>the decision to categorically exclude the project is made in accordance with applicable extraordinary circumstances procedures established pursuant to <external-xref legal-doc="regulation" parsable-cite="cfr/40/1508.4">section 1508.4</external-xref> of title 40, Code of Federal Regulations.</text> </subparagraph></paragraph> 
<paragraph id="HCDFEC6545F9645E2B5379B1C133C2788"><enum>(2)</enum><header>Stewardship projects</header><text display-inline="yes-display-inline">A stewardship contracting project under section 347 of the Department of the Interior and Related Agencies Appropriations Act, 1999 (as contained in section 101(e) of <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/2104">16 U.S.C. 2104</external-xref> note) to implement a hazardous fuel reduction project in an insect-emergency area may exceed 10 years, but may not exceed 15 years.</text></paragraph></subsection> 
<subsection id="H9A0F756E21AE4AC9A5ECFA7400BEB41F"><enum>(e)</enum><header>Personnel authority</header><text display-inline="yes-display-inline">The Secretary of Agriculture may relocate or reassign personnel of the Forest Service in order to provide additional personnel to prepare and carry out applied silvicultural assessments under section 404 in response to an insect emergency or to prepare and implement other appropriate actions involving Federal lands subject to an insect emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H874DAD601864464E9F4DE65CB4737762"><enum>(e)</enum><header>Relation to appeals reform act</header><text display-inline="yes-display-inline">Section 105 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6515">16 U.S.C. 6515</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H548903B30C164318004E904BFA3685B3" display-inline="no-display-inline"> 
<subsection id="H3E27D683D5F4406F923E617500777106"><enum>(d)</enum><header>Relation to appeals reform act</header><text display-inline="yes-display-inline">Nothing in section 322 of the Department of the Interior and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="public-law" parsable-cite="pl/102/381">Public Law 102–381</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/1612">16 U.S.C. 1612</external-xref> note) shall be construed to require administrative review procedures different from, or in addition to, the procedures established by regulations issued pursuant to this section for administrative review of an authorized hazardous fuel reduction project conducted pursuant to section 102 or the designation of an insect-emergency area pursuant to section 107.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section> 
<section id="H94939364884C44FF808CE85F979E0723"><enum>4.</enum><header>Community wildfire protection plan development assistance for at-risk communities in the Rocky Mountain region</header> 
<subsection id="H06C6F7FEF98143FBB87445C4207FB489"><enum>(a)</enum><header>Availability of assistance</header><text>Section 103 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6513">16 U.S.C. 6513</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H424C962D488D40B5B7C9B5044353F6E" display-inline="no-display-inline"> 
<subsection id="HA9045D9865E8469292BAC43100B4F067"><enum>(e)</enum><header>Planning assistance for at-risk communities</header><text display-inline="yes-display-inline">Using amounts made available to the Secretary of Agriculture under section 35(c) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191(c)</external-xref>), the Secretary of Agriculture shall make grants to at-risk communities in the Rocky Mountain region to assist the at-risk communities to prepare or revise a community wildfire protection plan. The Secretary of Agriculture shall make such grants in consultation with appropriate State agencies.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H09C1E85F8EEC4662A4D457509DB81E00"><enum>(b)</enum><header>Funding source</header><text display-inline="yes-display-inline">Section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H96713F94E771421A90864100BDCA6F06" display-inline="no-display-inline"> 
<subsection id="H40131C54832C45B4A8C3C71D57BA5C18"><enum>(c)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), $5,000,000 of the monies paid into the Treasury under such subsection for each of the fiscal years 2006 through 2010 shall be made available to the Secretary of Agriculture, without further appropriation and until expended, for obligation and expenditure pursuant to section 103(e) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6513">16 U.S.C. 6513</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H1BA4FB6652234518A17674B0AAE6FD6C"><enum>5.</enum><header>Additional assistance for preparation of community wildfire protection plans</header><text display-inline="no-display-inline">Subparagraph (L) of section 33(b)(3) of the Federal Fire Prevention and Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/15/2229">15 U.S.C. 2229(b)(3)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H61FB67C38F8B45CB86284E874239F1AF" display-inline="no-display-inline"> 
<subparagraph id="H061909DAFBDF42BDBEBEC75E5DF00080"><enum>(L)</enum><text display-inline="yes-display-inline">To fund fire prevention programs, including the development of community wildfire protection plans (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HA17C5A5FAFE440ACA3AEC882A04DCA89"><enum>6.</enum><header>Biomass commercial utilization grant program and biomass collection</header> 
<subsection id="H29E8B5EED15F4AAF8B755F81A01D7D26"><enum>(a)</enum><header>Grant program</header><text display-inline="yes-display-inline">Section 203 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6531">16 U.S.C. 6531</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HF8359984201D47C6A5DAE5982129A2D0" display-inline="no-display-inline"> 
<section id="H27CEF03620214A9EBA6157F4591B735"><enum>203.</enum><header>Biomass commercial utilization grant program</header> 
<subsection id="HE87A4FF03B22484E83563BF10036A825"><enum>(a)</enum><header>Program authorized</header><text display-inline="yes-display-inline">The Secretary of Agriculture may make grants to the owners or operators of facilities that use biomass—</text> 
<paragraph id="H3D40F5D9E25247B30028D932EFED4FF8"><enum>(1)</enum><text>as a raw material to produce electricity, sensible heat, transportation fuel, or substitutes for petroleum-based products; </text></paragraph> 
<paragraph id="HE292235882C54FCEBD004F0083F434D8"><enum>(2)</enum><text>for wood-based products; or </text></paragraph> 
<paragraph id="H722C6455D0564C4CA4A307DE15F67504"><enum>(3)</enum><text>for other commercial purposes. </text></paragraph></subsection> 
<subsection id="H9F4D594232D342C2BBE330FCD5133867"><enum>(b)</enum><header>Priority</header><text>In making grants under this section, the Secretary shall give priority to applications submitted by persons who purchase biomass removed from lands in insect-emergency areas through an authorized hazardous fuel reduction project carried out pursuant to section 102.</text></subsection> 
<subsection id="H627115153EE6459A8E558582C807438C"><enum>(c)</enum><header>Use of grant funds</header><text>Grants made pursuant to this section may be used to offset the costs of purchasing biomass.</text></subsection> 
<subsection id="H6D9C11FACD1C4C2782C6194069E36785"><enum>(d)</enum><header>Relation to other authorities</header><text>The authority provided by this section is in addition to any other authority of the Secretary to make grants related to biomass.</text></subsection> 
<subsection id="H6A287F28C21449C1B5003100A0AB51FE"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary $10,000,000 for each of fiscal years 2007 through 2010 to make grants under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H025AFA1CF4FD441CA195EA1B40352C70"><enum>(b)</enum><header>Central collection points</header><text>Title II of the Healthy Forests Restoration Act of 2003 is amended by adding at the end the following new section:</text>

<section id="HCF888F50D2954B9888DC3E22EF3DA44E"><enum>204.</enum><header>Establishment of central collection points</header> 
<subsection id="H071551BCE5254C2A0099A563375C707F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">To the maximum extent practicable and consistent with relevant land management plans, the Secretary shall establish one or more collection point for the placement of vegetative material removed from Federal or other lands as part of hazardous fuel reduction projects under title I. No collection point shall be established on any lands not owned by the United States without the consent of the owner of such lands.</text></subsection> 
<subsection id="HDC872555326941E3B9E8C8F76B99CEE2"><enum>(b)</enum><header>Use</header><text>Vegetative material placed at a collection point established under this section may be sold, donated, or otherwise made available to any party who will remove the material from the collection point.</text></subsection> 
<subsection id="HEF1EF4658E514F8C8985F108BA4268D"><enum>(c)</enum><header>Definition</header><text>In this section, the term “Secretary” means—</text> 
<paragraph id="H3D92CFAB18C04764B423EF36EAC3E2F"><enum>(1)</enum><text>the Secretary of Agriculture with respect to lands managed by the Forest Service; and</text></paragraph> 
<paragraph id="HB88A3D157B1049DABC152C8D61C85D75"><enum>(2)</enum><text>the Secretary of the Interior with respect to lands managed by any agency of the Department of the Interior.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H9559EE9447E34A7B937EE798EE3DB127"><enum>7.</enum><header>Cooperation with certain private landowners</header><text display-inline="no-display-inline">Title I of the Healthy Forests Restoration Act of 2003 is amended by inserting after section 107, as added by section 3(d), the following new section:</text>

<section id="H8782530E107740C8A53BA7310018A568"><enum>108.</enum><header>Cooperation with certain private landowners</header> 
<subsection id="H2EAF434193E244C19C123531CFACC54F"><enum>(a)</enum><header>Use of private landowners</header><text display-inline="yes-display-inline">The Secretary may award stewardship contracts to or enter into agreements with owners of lands contiguous to Federal lands managed by the Secretary under which the landowners may carry out a fuel-reduction project or other activities on the contiguous Federal lands in order to reduce the extent to which the Federal lands or other lands could be affected by wildfires. The agreement shall include such terms and conditions as the Secretary considers appropriate with regard to activities to be performed on the Federal lands.</text></subsection> 
<subsection id="H5A0C3B5DB4DF477DA9166617B5602C41"><enum>(b)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">A stewardship contract or other agreement under this section may provide for reimbursement by the Secretary for costs incurred by the landowner related to the fuel-reduction project or other activities on the Federal lands. If reimbursement is not provided, the cost incurred by the landowner shall be treated as a donation to the United States for purposes of the Internal Revenue Code of 1986.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H862112104FA3425C891ED8527F8BFC5D" commented="no"><enum>8.</enum><header>Partial exclusion from gross income of payments received as compensation for silvicultural activities in response to insect-infestation emergencies</header> 
<subsection id="H0BFE9615B79E4A1AAAEC4F39B500718C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to items specifically excluded from gross income) is amended by inserting after section 139A the following new section:</text>

<section id="H13F683FB865F494C97318EDC3F1D702C" commented="no"><enum>139B.</enum><header>Compensation for silvicultural activities in response to insect-infestation emergencies</header> 
<subsection id="H7AA3D9C8CDB04C858C66936D5E983ED1" commented="no"><enum>(a)</enum><header>General rule</header><text display-inline="yes-display-inline">Gross income shall not include any qualified silvicultural payments.</text></subsection> 
<subsection id="H2B44320A5B134A2D8B263B6E290072E5" display-inline="no-display-inline"><enum>(b)</enum><header>Dollar limitation</header><text display-inline="yes-display-inline">The aggregate of the payments which may be taken into account under subsection (a) with respect to a taxpayer for a taxable year shall not exceed $10,000 ($20,000 in the case of a joint return).</text> </subsection> 
<subsection id="H9173FBABB8E24AFF922002893200A131"><enum>(c)</enum><header>Qualified silvicultural payments</header><text>For purposes of this section—</text> 
<paragraph id="H781538644D01433D9338D5A4FE3124EA"><enum>(1)</enum><header>In general</header><text>The term <quote>qualified silvicultural payment</quote> means any amount received by the taxpayer during the taxable year as compensation for work performed in the Rocky Mountain region as part of—</text> 
<subparagraph id="H931EBF3C135344EEB095CC287C58A630" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an authorized hazardous fuels reduction project conducted pursuant to section 102 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6512">16 U.S.C. 6512</external-xref>) in an insect-emergency area, or</text></subparagraph> 
<subparagraph id="H99FE44F41DE14128A1298E86837647FC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a silvicultural assessment or other treatment conducted under section 404 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6554">16 U.S.C. 6554</external-xref>) in an insect-emergency area.</text></subparagraph></paragraph> 
<paragraph id="HFCC681215E4E46A4A46C8D00E426D70" commented="no"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">The terms <quote>authorized hazardous fuels reduction project</quote>, <quote>insect-emergency area</quote>, and <quote>Rocky Mountain region</quote> have the meanings given those terms in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
