<official-title>To authorize the Federal Emergency Management Agency to provide relief to the victims of Hurricane Katrina and Hurricane Rita by placing manufactured homes in flood plains, and for other purposes.</official-title>

<section id="H7242ACE300B04D729C4382A5A0A7F9D7" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hope Housing Act of 2006</short-title></quote>.</text></section> 
<section id="H0F005CBE4E5343B8911897BB919DF252"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text> 
<paragraph id="HA2A75543308B43C5A0057E3248FE9249"><enum>(1)</enum><text>the term <term>authorized placement</term> means placing a covered manufactured home as authorized by subparagraph (A), (B), or (C) of section 3(a)(1);</text></paragraph> 
<paragraph id="H2D7C8F73155D468FAEC3296B31B6A6B5"><enum>(2)</enum><text>the term <term>base flood</term> means the flood which has a 1 percent chance of being equaled or exceeded in any given year;</text></paragraph> 
<paragraph id="H52F9FF89C77947D480EB2760B6103365"><enum>(3)</enum><text>the term <term>costal high hazard area</term> means an area subject to high velocity waters, including hurricane wave wash or a tsunami;</text></paragraph> 
<paragraph id="H380D33FA17B649E1AF00D6FD88CD484B"><enum>(4)</enum><text>the term <term>covered civil action</term> means a civil action against the Federal Government for damages related to the flooding of a covered manufactured home that is the subject of an authorized placement;</text></paragraph> 
<paragraph id="HB56CA25F622B4B208C5CB3FBCEAB5B9F"><enum>(5)</enum><text>the term <term>covered manufactured home</term> means a manufactured home purchased by the Federal Emergency Management Agency during the period beginning on August 1, 2005, and ending on the date of enactment of this Act;</text></paragraph> 
<paragraph id="H11AF1FA719AA42A192B8007D2F56F5D5"><enum>(6)</enum><text>the term <term>Director</term> means the Director of the Federal Emergency Management Agency;</text></paragraph> 
<paragraph id="HC3EC518CD00448CC9FF43F12932BBE79"><enum>(7)</enum><text>the term <term>flood</term> means a general and temporary condition of partial or complete inundation of normally dry land areas from—</text> 
<subparagraph id="H7ED2414A0F724BD09EA6517C965D016C"><enum>(A)</enum><text>the overflow of inland or tidal waters; or</text></subparagraph> 
<subparagraph id="H5640BCDDC1FB4D8D93B7E184342C2C96"><enum>(B)</enum><text>the unusual and rapid accumulation or runoff of surface waters from any source;</text></subparagraph></paragraph> 
<paragraph id="H8198206BD0C74C7D0091111D0074ACD3"><enum>(8)</enum><text>the term <term>flood plain</term> means an area which has a .2 percent chance of being flooded in any given year;</text></paragraph> 
<paragraph id="HE4B9702B6B884C35A9009C64FEC59381"><enum>(9)</enum><text>the term <term>floodway</term> means that portion of the flood plain which—</text> 
<subparagraph id="H674221429F6242A78B3E2F99FA58DB9"><enum>(A)</enum><text>provides for the discharge of the base flood so the cumulative increase in water surface elevation is no more than 12 inches; and</text></subparagraph> 
<subparagraph id="H2508BD7DCA7A4C07A1EF70F18F41CE13"><enum>(B)</enum><text>is effective in carrying flow, within which this carrying capacity shall be preserved and where the flood hazard is generally highest; and</text></subparagraph></paragraph> 
<paragraph id="HC4D09B8F20614059961C00D2FBF7DDB"><enum>(10)</enum><text>the term <term>manufactured home</term> has the same meaning as in section 603 of the National Manufactured Housing Construction and Safety Standards Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5402">42 U.S.C. 5402</external-xref>).</text></paragraph></section> 
<section id="H2B5E417A05CE469DBC053EEBE3CAEF"><enum>3.</enum><header>Emergency housing for victims</header> 
<subsection id="HEC7F1F2CA4244489866B00DE64503494"><enum>(a)</enum><header>Use of Manufactured homes</header> 
<paragraph id="HB2F7A28568C94A939EEF819059858499"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, including <external-xref legal-doc="regulation" parsable-cite="cfr/44/9.13">section 9.13</external-xref> of title 44, Code of Federal Regulations (or any corresponding similar regulation or ruling), the Director may place a covered manufactured home—</text> 
<subparagraph id="HC371ED1488604BD583AB75BA5FBA3CD2"><enum>(A)</enum><text>in a floodway or costal high hazard area;</text></subparagraph> 
<subparagraph id="H67E60297917E4BAE9E00288700CE30FC"><enum>(B)</enum><text>in a flood plain, without elevating such home up to the base flood level; or</text></subparagraph> 
<subparagraph id="H9331871A69794189B8EDA55E4084C178"><enum>(C)</enum><text>in a flood plain, without complying with—</text> 
<clause id="H928DD5EABEB0485CA55C2EB17CB38EC3"><enum>(i)</enum><text>the decision-making process required under <external-xref legal-doc="regulation" parsable-cite="cfr/44/9.6">section 9.6</external-xref> of title 44, Code of Federal Regulations (or any corresponding similar regulation or ruling); and</text></clause> 
<clause id="H3C0F8C67A8034042B5047EECF8C03A4"><enum>(ii)</enum><text>the mitigation requirements under <external-xref legal-doc="regulation" parsable-cite="cfr/44/9.11">section 9.11</external-xref> of title 44, Code of Federal Regulations (or any corresponding similar regulation or ruling).</text></clause></subparagraph></paragraph> 
<paragraph id="H5BEB6E8195F04612A192199FAE89DDA"><enum>(2)</enum><header>Types of use</header><text>Any authorized placement shall be used to house an individual displaced by Hurricane Katrina of 2005 or Hurricane Rita of 2005.</text></paragraph> 
<paragraph id="H1A471C502B3E42B2993DE7599DCEEBCF"><enum>(3)</enum><header>Promotional materials</header><text>The Director shall make appropriate changes to any promotional materials to reflect, and otherwise publicize, the authorization in this subsection.</text></paragraph> 
<paragraph id="H10999F8FD9894079AFBA38BB97EEF648"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to prohibit any other lawful use of a covered manufactured home.</text></paragraph></subsection> 
<subsection id="H70015C9CF088441F998300FCE4B1BDBD"><enum>(b)</enum><header>Liability</header> 
<paragraph id="H4750819C1F3F47F4B2590628AFC7F67"><enum>(1)</enum><header>In general</header><text>If the Director makes an authorized placement, a covered civil action relating to the covered manufactured home involved in such authorized placement may not be brought in any Federal or State court.</text></paragraph> 
<paragraph id="HB09D632F334749A1BB3600F6ABCD21A6"><enum>(2)</enum><header>Notice</header><text>The Director shall provide any person to whom the Director provides a covered manufactured home as part of an authorized placement with written notice of—</text> 
<subparagraph id="H0F581D9010054C0CB6E13D2B4CFBCC7"><enum>(A)</enum><text>the potential risks associated with such placement; and</text></subparagraph> 
<subparagraph id="H5EEF292C6DDB451990AE8CE165FE70EF"><enum>(B)</enum><text>the limitations on liability under paragraph (1).</text></subparagraph></paragraph></subsection></section>
