<official-title>To amend the Internal Revenue Code of 1986 to exclude from gross income interest received on loans secured by agricultural real estate and rural housing.</official-title>

<section id="HC00373AD2A324FDABDB91402F6BED5BC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Communities Investment Act of 2006</short-title></quote>.</text></section> 
<section id="H8237CFA86DD64B1F99154D0089AB9CDF"><enum>2.</enum><header>Exclusion for interest on loans secured by agricultural real estate and rural housing </header> 
<subsection id="H73C73741B32D49B49BB6DD72B74D12D6"><enum>(a)</enum><header>In General</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to items specifically excluded from gross income) is amended by inserting after section 139A the following new section:</text> 
<quoted-block style="OLC" id="HA2D812D2BFBA46EFB1D658807531E18B" display-inline="no-display-inline"> 
<section id="H8AD92DEB11D7409688FC2653B269D68F"><enum>139B.</enum><header>Interest on loans secured by agricultural real estate and rural housing</header> 
<subsection id="H2D00AF78D1ED4790AD724066268B2F09"><enum>(a)</enum><header>Exclusion</header><text>Gross income shall not include interest received by a qualified lender on any qualified real estate loan.</text></subsection> 
<subsection id="H03BF8C6CF3924B0FA9E8D05D9C0D6AD"><enum>(b)</enum><header>Definitions and special rules</header><text>For purposes of this section—</text> 
<paragraph id="H1225D05790E7429AB254CD74004C2F00"><enum>(1)</enum><header>Qualified lender</header><text>The term <quote>qualified lender</quote> means any bank or savings association the deposits of which are insured under the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1811">12 U.S.C. 1811 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H64490A74103846989875BA1D4C84FCA5"><enum>(2)</enum><header>Qualified real estate loan</header><text>The term <quote>qualified real estate loan</quote> means—</text> 
<subparagraph id="H579678CB157D4417843FDAC894AFF392"><enum>(A)</enum><text display-inline="yes-display-inline">any indebtedness (including the refinancing of indebtedness) secured by agricultural real estate or by a leasehold mortgage (with a status as a lien) on agricultural real estate, or </text></subparagraph> 
<subparagraph id="HF879F63179FD4C4282A9EADE8B973B34"><enum>(B)</enum><text>any indebtedness—</text> 
<clause id="HC823BF02FC1045F49300119D25A298D8"><enum>(i)</enum><text>acquired for the purpose of purchasing or improving rural housing, and</text></clause> 
<clause id="H13569595678445D6990657A6EBFA23C"><enum>(ii)</enum><text display-inline="yes-display-inline">secured by such rural housing or by a leasehold mortgage (with a status as a lien) on such rural housing.</text></clause></subparagraph></paragraph> 
<paragraph id="H92CAEFB08ECA4901812EF68DAF31342D"><enum>(3)</enum><header>Agricultural real estate</header> 
<subparagraph id="H25BA32F52E2642C3BD1D45E40037A42F"><enum>(A)</enum><header>In general</header><text>The term <quote>agricultural real estate</quote> means real property used or available for the production of 1 or more agricultural products.</text> </subparagraph> 
<subparagraph id="H4141F008804C49BCA3E86BC8ECE045DF"><enum>(B)</enum><header>When determination made</header><text>For purposes of subparagraph (A), the determination of whether property securing any indebtedness is agricultural real estate shall be made as of the time the interest income on such indebtedness accrues.</text></subparagraph> </paragraph> 
<paragraph id="H98D568661DA44203B968F4998E587CDD"><enum>(4)</enum><header>Rural housing</header> 
<subparagraph id="HE7438AA465764829B60018F872BEBB1E"><enum>(A)</enum><header>In general</header><text>The term <quote>rural housing</quote> means any single family residence which is located in a rural area and which is the principal residence (within the meaning of section 121) of the borrower.</text> </subparagraph> 
<subparagraph id="H0B316096B1D24235AD66D6809606B43D"><enum>(B)</enum><header>When determination made</header><text>The determination of whether property qualifies as rural housing with respect to any indebtedness shall be made as of the date such indebtedness originates.</text></subparagraph></paragraph> 
<paragraph id="H9D753878F6FE4E97B42B2453E5A96D4B"><enum>(5)</enum><header>Rural area</header><text display-inline="yes-display-inline">The term <quote>rural area</quote> means an area (as determined by the Secretary of Agriculture) which is not within a metropolitan statistical area (as defined by the Office of Management and Budget) and which has a population (determined on the basis of the most recent decennial census for which date are available) of 2,500 or less.</text></paragraph></subsection> 
<subsection id="HE28DF7A8438A4C7FB634DD4943F9A2F0"><enum>(c)</enum><header>Coordination with section <enum-in-header>265</enum-in-header></header><text>For purposes of this section, the rules of section 265 shall apply, as follows:</text> 
<paragraph id="H36C27AFD1EEF4CE183C8101B320089B8"><enum>(1)</enum><header>In general</header><text>Qualified real estate loans shall be treated as an obligation described in section 265(a)(2).</text></paragraph> 
<paragraph id="H872B1A651C014B02A6005CDB9C61A162"><enum>(2)</enum><header>Pro rata allocation of interest expense of financial institutions to tax-exempt interest</header><text>In applying section 265(b)—</text> 
<subparagraph id="HFE913F127BEB4E829B546CE5B0F8EE04"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>tax-exempt obligation</quote>, as defined in paragraph (4)(B) thereof, shall include a qualified real estate loan,</text></subparagraph> 
<subparagraph id="HEDEA9CA37BEA4F45AE4019698C943531"><enum>(B)</enum><text>the term <quote>financial institution</quote>, as defined in paragraph (5) thereof, shall include a qualified lender, and</text></subparagraph> 
<subparagraph id="H6DC41C83D8F8495F89A0E0EA334E213"><enum>(C)</enum><text display-inline="yes-display-inline">the term <quote>qualified tax-exempt obligation</quote>, as defined in paragraph (3)(B) thereof, shall include a qualified real estate loan made after December 31, 2005, to a qualified small borrower.</text> </subparagraph><continuation-text continuation-text-level="paragraph">For purposes of subparagraph (C), the term <quote>qualified small borrower</quote> means, with respect to qualified real estate loans received during any calendar year, any borrower if the reasonably anticipated amount of qualified real estate loans which will be received by such borrower during such calendar year does not exceed $10,000,000.</continuation-text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFDF79348390F476C0045A299EE56A93F"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such part III is amended by inserting after the item relating to section 139A the following new item:</text>

<toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="HA2D812D2BFBA46EFB1D658807531E18B" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> 
<toc-entry idref="H8AD92DEB11D7409688FC2653B269D68F" level="section">Sec. 139B. Interest on loans secured by agricultural real estate and rural housing.</toc-entry> </toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFB63D0B7C1E44A44957C83A7DEC0F469"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act. </text></subsection></section>
