		<official-title display="yes">To amend the Help America Vote Act of 2002
		  to require each individual who desires to vote in an election for Federal
		  office to provide the appropriate election official with a government-issued
		  photo identification, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H78F6496C9F934335929E3741BD43F4F7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Election Integrity Act of
			 2006</short-title></quote> .</text>
		</section><section id="H76D44E613A8341498421E007C494CD7"><enum>2.</enum><header>Requiring Voters
			 to Provide Photo Identification</header>
			<subsection display-inline="no-display-inline" id="HEBA4A21A6D3842100047690133F6C387"><enum>(a)</enum><header>Requirement to
			 Provide Photo Identification as Condition of Receiving
			 Ballot</header><text>Section 303(b) of the Help America Vote Act of 2002
			 (42 U.S.C.
			 15483(b)) is amended—</text>
				<paragraph id="H1C7BEA4AE50C49D8A62E574012890098"><enum>(1)</enum><text>in the heading, by
			 striking <quote><header-in-text level="subsection">for Voters Who Register by
			 Mail</header-in-text></quote> and inserting <quote><header-in-text level="subsection">for Providing Photo Identification</header-in-text></quote>;
			 and</text>
				</paragraph><paragraph id="H7B24CD87B29F4DE0B17C62BBFD94B483"><enum>(2)</enum><text>by striking
			 paragraphs (1) through (3) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1B7DF86083DA40D4B5DAD249EBE5108F" style="OLC">
						<paragraph id="H126317184D9A447C9FB58E6264633B00"><enum>(1)</enum><header>Individuals
				voting in person</header>
							<subparagraph id="H8F0277F4233749209FBEAD167CC99676"><enum>(A)</enum><header>Requirement to
				provide identification</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law
				and except as provided in subparagraph (B), the appropriate State or local
				election official may not provide a ballot for an election for Federal office
				to an individual who desires to vote in person unless the individual presents
				to the official—</text>
								<clause id="H46E411D16C61499900921491BF91FE70"><enum>(i)</enum><text>a
				government-issued, current, and valid photo identification; or</text>
								</clause><clause id="H7783EF21DF7F436F9382BAA9D7EEB9AA"><enum>(ii)</enum><text>in the case of
				the regularly scheduled general election for Federal office held in November
				2010 and each subsequent election for Federal office, a government-issued,
				current, and valid photo identification for which the individual was required
				to provide proof of United States citizenship as a condition for the issuance
				of the identification.</text>
								</clause></subparagraph><subparagraph id="HC83AB521D73F4759B2D36056E7DE581"><enum>(B)</enum><header>Availability of
				provisional ballot</header><text>If an individual does not present the
				identification required under subparagraph (A), the individual shall be
				permitted to cast a provisional ballot with respect to the election under
				section 302(a), except that the appropriate State or local election official
				may not make a determination under section 302(a)(4) that the individual is
				eligible under State law to vote in the election unless the individual presents
				the identification required under subparagraph (A) to the official not later
				than 48 hours after casting the provisional ballot.</text>
							</subparagraph></paragraph><paragraph id="H0A72685FFB5E490EA6D75E052CF70F5"><enum>(2)</enum><header>Individuals
				voting other than in person</header>
							<subparagraph id="HAB8E9124A37C4D15B669C500C5F47D21"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law and except as
				provided in subparagraph (B), the appropriate State or local election official
				may not accept any ballot for an election for Federal office provided by an
				individual who votes other than in person unless the individual submits with
				the ballot—</text>
								<clause id="H5BFAE6CA0BB2416CA4FB515C7821CF30"><enum>(i)</enum><text>a
				copy of a government-issued, current, and valid photo identification; or</text>
								</clause><clause id="HA0ACDF16E2CB4E9CA55C8EAA178949E"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of the regularly scheduled
				general election for Federal office held in November 2010 and each subsequent
				election for Federal office, a copy of a government-issued, current, and valid
				photo identification for which the individual was required to provide proof of
				United States citizenship as a condition for the issuance of the
				identification.</text>
								</clause></subparagraph><subparagraph id="HA5CA43B9250449AEB7EBB600A72DBF50"><enum>(B)</enum><header>Exception for
				overseas military voters</header><text>Subparagraph (A) does not apply with
				respect to a ballot provided by an absent uniformed services voter who, by
				reason of active duty or service, is absent from the United States on the date
				of the election involved. In this subparagraph, the term <quote>absent
				uniformed services voter</quote> has the meaning given such term in section
				107(1) of the Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C.
				1973ff—6(1)), other than an individual described in section 107(1)(C) of such
				Act.</text>
							</subparagraph></paragraph><paragraph id="HBD87459FD72F4F10851C3ED4CF54FBE9"><enum>(3)</enum><header>Specific
				requirements for identifications</header><text display-inline="yes-display-inline">For purposes of paragraphs (1) and
				(2)—</text>
							<subparagraph id="HAC2F2D939509468D9FF47CD52267A1C9"><enum>(A)</enum><text>an identification
				is <quote>government-issued</quote> if it is issued by the Federal Government
				or by the government of a State; and</text>
							</subparagraph><subparagraph id="H104F24E22B124A60B98354A640CB5951"><enum>(B)</enum><text>an identification
				is one for which an individual was required to provide proof of United States
				citizenship as a condition for issuance if the identification displays an
				official marking or other indication that the individual is a United States
				citizen.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H1F33ED62A6AB4FB88DC1668936BEE26D"><enum>(b)</enum><header>Conforming
			 Amendments</header><text>Section 303 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483</external-xref>)
			 is amended—</text>
				<paragraph id="HE61F945C4A9E407891981DA89400B097"><enum>(1)</enum><text>in the heading, by
			 striking <quote><header-in-text level="section">for voters who register by
			 mail</header-in-text></quote> and inserting <quote><header-in-text level="section">for Providing Photo Identification</header-in-text></quote>;
			 and</text>
				</paragraph><paragraph id="H6E28DA5341644F698854F170B63F75C"><enum>(2)</enum><text>in
			 subsection (c), by striking <quote>subsections (a)(5)(A)(i)(II) and
			 (b)(3)(B)(i)(II)</quote> and inserting <quote>subsection
			 (a)(5)(A)(i)(II)</quote>.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H098A8158C080485BB05CD9BBC7A476B"><enum>(c)</enum><header>Clerical
			 Amendment</header><text>The table of contents of such Act is amended by
			 amending the item relating to section 303 to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HBB7E5AC1CEE743659D46D62BDA7CA3CA" style="OLC">
					<toc regeneration="no-regeneration">
						<toc-entry level="section">Sec. 303. Computerized statewide voter
				registration list requirements and requirements for providing photo
				identification.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H92C0D4D53A364F64BF129539DBD57434"><enum>(d)</enum><header>Effective
			 Date</header>
				<paragraph id="H702D1B710AAE460B00A83D305067ADF"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">This section and the
			 amendments made by this section shall apply with respect to the regularly
			 scheduled general election for Federal office held in November 2008 and each
			 subsequent election for Federal office.</text>
				</paragraph><paragraph id="H47E2159F258D4C4BB863CD3EFB0017F"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 303(d)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(d)(2)</external-xref>) is amended
			 to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HAA0C97A136F4433CA627165DB1A98789" style="OLC">
						<paragraph id="H5BB0A6232F434A1089FCD5C6FE715F74"><enum>(2)</enum><header>Requirement to
				provide photo identification</header><text display-inline="yes-display-inline">Paragraphs (1) and (2) of subsection (b)
				shall apply with respect to the regularly scheduled general election for
				Federal office held in November 2008 and each subsequent election for Federal
				office.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="HC95EBC72B5854F608C072CA12E9C863F"><enum>3.</enum><header>Making Photo
			 Identifications Available</header>
			<subsection id="H1750920D4067437EB7535D3F1829DD04"><enum>(a)</enum><header>Requiring States
			 to make identification available</header><text>Section 303(b) of the Help
			 America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)</external-xref>), as amended by
			 section 2(a)(2), is amended—</text>
				<paragraph id="HB5DD17E168064C20A91D8E69EAE6ED97"><enum>(1)</enum><text>by redesignating
			 paragraphs (4) and (5) as paragraphs (5) and (6); and</text>
				</paragraph><paragraph id="H3F4420D82C7B402EBE7BA52F92E6DBBC"><enum>(2)</enum><text>by inserting after
			 paragraph (3) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H60C3233FF5A542EDB693AF3E55CAF239" style="OLC">
						<paragraph id="H55EE2C24D28B41C8A2BBC2AECC500053"><enum>(4)</enum><header>Making photo
				identifications available</header>
							<subparagraph id="HF40E3748D8F744D2A800D704A3A309A7"><enum>(A)</enum><header>In
				general</header><text>During fiscal year 2008 and each succeeding fiscal year,
				each State shall establish a program to provide photo identifications which may
				be used to meet the requirements of paragraphs (1) and (2) by individuals who
				desire to vote in elections held in the State but who do not otherwise possess
				a government-issued photo identification.</text>
							</subparagraph><subparagraph id="HD2F755116AA842A8004200FF5B83108C"><enum>(B)</enum><header>Identifications
				provided at no cost to indigent individuals</header><text display-inline="yes-display-inline">If a State charges an individual a fee for
				providing a photo identification under the program established under
				subparagraph (A)—</text>
								<clause id="H1BD4FB0406744564AE7496C7A63EA7CF"><enum>(i)</enum><text>the fee charged
				may not exceed the reasonable cost to the State of providing the identification
				to the individual; and</text>
								</clause><clause id="HF74876F2CFED480D87A99BF6F0D3EFC9"><enum>(ii)</enum><text>the State may not
				charge a fee to any individual who provides an attestation that the individual
				is unable to afford the fee.</text>
								</clause></subparagraph><subparagraph id="H149103BF4DB24C6BA0DD8008B7DD73C1"><enum>(C)</enum><header>Identifications
				not to be used for other purposes</header><text>Any photo identification
				provided under the program established under subparagraph (A) may not serve as
				a government-issued photo identification for purposes of any program or
				function of a State or local government other than the administration of
				elections.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H46EEF14A24584001BD99D5DE9B59C89B"><enum>(b)</enum><header>Payments to
			 States to cover costs</header><text>Subtitle D of title II of such Act
			 (42 U.S.C. 15321 et
			 seq.) is amended by adding at the end the following new
			 part:</text>
				<quoted-block display-inline="no-display-inline" id="H67AF3FAB46434E918C8E0088C8F000F1" style="OLC">
					<part id="H95E46EBEBBE145ADB1704578B37703E1"><enum>7</enum><header>Payments to Cover
				Costs of Providing Photo Identifications to Indigent Individuals</header>
						<section id="HF934DCF0751E4C52ACD0D3B12E66B260"><enum>297.</enum><header>Payments to
				Cover Costs to States of Providing Photo Identifications For Voting to Indigent
				Individuals</header>
							<subsection id="HAD4552959A3746E0AA25A4AB90A8DFE8"><enum>(a)</enum><header>Payments to
				States</header><text>The Commission shall make payments to States to cover the
				costs incurred in providing photo identifications under the program established
				under section 303(b)(4) to individuals who are unable to afford the fee that
				would otherwise be charged under the program.</text>
							</subsection><subsection id="H12F9970DD4D945A0ABA2DC759B9C42A1"><enum>(b)</enum><header>Amount of
				Payment</header><text>The amount of the payment made to a State under this part
				for any year shall be equal to the amount of fees which would have been
				collected by the State during the year under the program established under
				section 303(b)(4) but for the application of section 303(b)(4)(B)(ii), as
				determined on the basis of information furnished to the Commission by the State
				at such time and in such form as the Commission may require.</text>
							</subsection></section><section id="H23D0574E6C82404AA6A806BFCE5500BE"><enum>297A.</enum><header>Authorization
				of Appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated for payments under this part such sums as may be
				necessary for fiscal year 2008 and each succeeding fiscal
				year.</text>
						</section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H56BCA6007A094F1BA000E46ECDB35EC3"><enum>(c)</enum><header>Clerical
			 amendment</header><text>The table of contents of such Act is amended by adding
			 at the end of the item relating to subtitle D of title II the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF83E9F7AC0A74F5BBEC0012C59F897" style="OLC">

						<toc-entry level="part">Part 7—Payments to Cover Costs of Providing

				individuals.</toc-entry>
						<toc-entry level="section">Sec. 297A. Authorization of
				appropriations.</toc-entry>
