<section id="HE8A383BF075B48B3AFD9DF2F83B2B615" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Port Security Act of 2006</short-title></quote>.</text></section> 
<section id="H57CDAAAC168E4291003FCAFE4EE35B06" section-type="subsequent-section"><enum>2.</enum><header>Prohibition on leases of real property and facilities at United States ports by foreign government-owned entities</header> 
<subsection id="H186F1004F6F049D48F60FF072DB03B3F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 271(d) of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(d)</external-xref>) is amended—</text> 
<paragraph id="HE57A11FEE3CA4007A472DC7BEBAC1E00"><enum>(1)</enum><text>by striking <quote>Subject to subsection (d)</quote> and inserting the following:</text>

<paragraph id="HBCC23876068043CCB66CC85E8407C5E5"><enum>(1)</enum><header>In general</header><text>Subject to subsection (e)</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H57CE39783ABE40B1B1D58BF0F717D5B5"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block act-name="" display-inline="no-display-inline" id="H63C4AD47F75348BBAC664960786D3307" style="OLC"> 
<paragraph id="HF640F344ACC84C81802E5B71EB105DAA"><enum>(2)</enum><header>Prohibition on leases of real property and facilities at United States ports by foreign government-owned entities</header><text>The President shall prohibit any merger, acquisition, or takeover described in subsection (a)(1) that will result in any entity that is owned or controlled by a foreign government leasing, operating, managing, or owning real property or facilities at a United States port.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB41999A538FE4F4DBF20A93DB9913272"><enum>(b)</enum><header>Report required</header> 
<paragraph id="H2C71DE5CBA1849CD8B986B5488E3ECE5"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the President shall submit to Congress a report on the leasing, operating, managing, or owning real property or facilities at United States ports by entities that are owned or controlled by foreign governments.</text></paragraph> 
<paragraph id="H5FD6ADA9ED3E464989014509FA920893"><enum>(2)</enum><header>Content</header><text>The report required under paragraph (1) shall include—</text> 
<subparagraph id="H65558B391F5D42DDBB2900CF48191559"><enum>(A)</enum><text>a list of all entities that are owned or controlled by foreign governments that are leasing, operating, managing, or owning real property or facilities at United States ports;</text></subparagraph> 
<subparagraph id="H68E8EF764F944B2FAD53C9B70080B630"><enum>(B)</enum><text>an assessment of the national security threat posed by such activities; and</text></subparagraph> 
<subparagraph id="H4B9A8B70996B40B3A171771C002E0016"><enum>(C)</enum><text>recommendations for any legislation in response to such threat.</text></subparagraph></paragraph></subsection></section> 
<section id="HE74F1A25AEFF40A38C245D889B009408"><enum>3.</enum><header>Increased transparency of mandatory investigations</header><text display-inline="no-display-inline">Section 271(b) of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(b)</external-xref>) is amended—</text> 
<paragraph id="H7A5FE55CCCD8485982D6E5EB90F8173B"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></paragraph> 
<paragraph id="H8B6D2C05CB9F4523B790D405F8363BA3"><enum>(2)</enum><text>by striking <quote>The President</quote> and inserting the following:</text>

<paragraph id="H80CF4C11825E47DB00DF89365FFBBE5E"><enum>(1)</enum><header>In general</header><text>The President</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H566011A29D7B4616AE9820D573542364"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="H4F1147F6BCF245FCBED5E871648C9D40"><enum>(2)</enum><header>Notification to Congress</header><text>Not later than one day after commencing an investigation under paragraph (1), the President shall provide notice of the investigation and relevant information regarding the proposed merger, acquisition, or takeover, including relevant ownership records to—</text> 
<subparagraph id="HB96AF071AC6849F69427A2741A21779"><enum>(A)</enum><text>the Majority Leader and Minority Leader of the Senate;</text></subparagraph> 
<subparagraph id="H139FD0F60A234322A51FE974C7776ECB"><enum>(B)</enum><text>the Speaker and Minority Leader of the House of Representatives;</text></subparagraph> 
<subparagraph id="H8556B11890B94128878653EAD410C8F9"><enum>(C)</enum><text>the Chairmen and Ranking Members of the Committee on Finance, the Committee on Homeland Security and Government Affairs, the Committee on Banking, Housing, and Urban Affairs, the Committee on Armed Services, and the Select Committee on Intelligence of the Senate;</text></subparagraph> 
<subparagraph id="H956C815531284E4E8D943B34A213FDE5"><enum>(D)</enum><text>the Chairmen and Ranking Members of the Committee on Ways and Means, the Committee on Homeland Security, the Committee on Financial Services, the Committee on Armed Services, and the Permanent Select Committee on Intelligence of the House of Representatives; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H24EF1B213E8443668800ADBFC0DE1FDF"><enum>(E)</enum><text>the Members of Congress representing the States and districts affected by the proposed transaction.</text></subparagraph></paragraph> 
<paragraph id="H14DC263687984B61955118F26E98FA9"><enum>(3)</enum><header>Notification to public officials of investigations of proposed transactions affecting United States ports</header><text>In the case of an investigation under paragraph (1) of a proposed merger, acquisition, or takeover that will result in any entity that is owned or controlled by a foreign government leasing, operating, managing, or owning real property or facilities at a United States port, the President shall, not later than one day after commencing an investigation under paragraph (1), notify the Governors and heads of relevant government agencies of the States in which such ports are located and provide to such Governors and relevant agency heads information regarding the proposed merger, acquisition, or takeover, including relevant ownership records.</text></paragraph> 
<paragraph id="H390EE7E42E5E46B78EC5F931A3278900"><enum>(4)</enum><header>Public Comments</header> 
<subparagraph id="H830A60762CB34385BA71864986B4738D"><enum>(A)</enum><header>Solicitation of public comments</header><text>Not later than 7 days after commencing an investigation under paragraph (1), the President shall publish in the Federal Register a description of the proposed merger, acquisition, or takeover, including a solicitation for public comments on such proposed merger, acquisition, or takeover.</text></subparagraph> 
<subparagraph id="H043EB4286720436DB4A30788BE99B977"><enum>(B)</enum><header>Summary of public comments</header><text>Not later than 10 days prior to the completion of an investigation under paragraph (1), the President shall publish in the Federal Register a summary of the public comments received pursuant to subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HFB5FEBDE70534010B2AD9CE9A4F95029"><enum>4.</enum><header>Technical correction</header><text display-inline="no-display-inline">Section 271(e) of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170(e)</external-xref>) is amended by striking <quote>subsection (c)</quote> and inserting <quote>subsection (d)</quote>.</text></section> 
<section id="HC74925C8200740FB910090E29B2F399F"><enum>5.</enum><header>Effective Date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to any merger, acquisition, or takeover considered on or after October 1, 2005 under section 271 of the Defense Production Act of 1950 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/2170">50 U.S.C. App. 2170</external-xref>).</text></section>
