<official-title>To prohibit entities owned or controlled by foreign governments from conducting certain operations at seaports in the United States, and from entering into agreements to conduct such operations.</official-title>

<section id="H79916DAB926B4EF39966C4FB50FA3E97" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Operation of U.S. seaports</header> 
<subsection id="H33D1471753C2423B833515DC5F386D8F"><enum>(a)</enum><header>Requirement</header><text>No entity that is owned or controlled by a foreign government, or any agency or instrumentality thereof, may—</text> 
<paragraph id="H5B023D11D1B5499BA3E34828A8E2DDFE"><enum>(1)</enum><text> conduct operations at any seaport in the United States relating to—</text> 
<subparagraph id="HC3FFB552E1344B20A451767577AAA790"><enum>(A)</enum><text>the import or export of cargo by vessel, or the movement of cargo in connection with such import or export; or</text></subparagraph> 
<subparagraph id="HA9DC36B5CDA140E9AAF8050000D5B182"><enum>(B)</enum><text>the arrival or departure of the crew and passengers on a cargo vessel; or</text></subparagraph></paragraph> 
<paragraph id="HF65C8642F4A34051908C98F5E3868722"><enum>(2)</enum><text display-inline="yes-display-inline">enter into any contract or other agreement to conduct operations described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H2C601AE9F8A341D9B2C070C5B2707C49"><enum>(b)</enum><header>Regulations</header><text>The President shall promulgate such regulations as may be necessary to enforce the requirements of subsection (a), including requiring any person to furnish, in the form of reports or otherwise, such information as is necessary to enforce such requirements.</text></subsection> 
<subsection id="H521F601FEF234721B0FFFA00AFD6F9B1"><enum>(c)</enum><header>Employees</header><text>The prohibition in subsection (a) does not apply to any individual performing operations described in that subsection in the course of employment by another person.</text></subsection> 
<subsection id="H3FC00D0EABC54EB100327000855D0500"><enum>(d)</enum><header>Penalties</header><text>Any person who violates any requirement of subsection (a) or any regulation promulgated under subsection (b) shall be subject to the penalties under section 206 of the International Emergency Economic Powers Act (50 U.S. 1705) to the same extent as such penalties apply to violations under that Act.</text></subsection> 
<subsection id="H064F3E44F8954F68B914484C76912E54"><enum>(e)</enum><header>Definition</header><text>In this section:</text> 
<paragraph id="HBE9152846D214F5EA93963FC9C7C600"><enum>(1)</enum><header>State</header><text>The term <quote>State</quote> means any of the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph> 
<paragraph id="H11B4E8963D534F2FBDBBCE07B36F74AF"><enum>(2)</enum><header>United States</header><text display-inline="yes-display-inline">The term <quote>United States</quote> means the several States, the District of Columbia, and any commonwealth, territory, or possession of the United States.</text></paragraph></subsection></section> 
<section id="H06FC76BBA0764E22ACFB0002E39141EE"><enum>2.</enum><header>Effective date</header> 
<subsection id="H07556EE988BE42C78728CE684E36CB00"><enum>(a)</enum><header>In general</header><text>This Act shall take effect 90 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="HB471D307DEC84171BE6497DD4D85C2F3"><enum>(b)</enum><header>Applicability</header><text>This Act shall not apply with respect to any contract or other agreement to conduct operations described in subsection (a) that is entered into before the effective date of this Act.</text></subsection></section>
