<official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/27">chapter 27</external-xref> of title 18, United States Code, to prohibit the unauthorized construction, financing, or reckless permitting (on one’s land) the construction or use of a tunnel or subterranean passageway between the United States and another country.</official-title>

<section id="H512840031D1C4C95A4F1528E1E00A64" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Tunnel Prevention Act of 2006</short-title></quote>.</text></section> 
<section id="H4DA7D3D236384D518315794E04D39701" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Construction of border tunnel or passage</header> 
<subsection id="H66F9FC4C0265446DBDAFDBBB67003BEF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/27">Chapter 27</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H33623A9BA59D4D2F9C2744FC8EA700E9" style="USC"> 
<section id="HCD125A496EF041008C03F0240083DB63"><enum>554.</enum><header>Border tunnels and passages</header> 
<subsection id="HAEC3D38EC99B43B6A4C31871A255D88E"><enum>(a)</enum><text>Any person who knowingly constructs or finances the construction of a tunnel or subterranean passage that crosses the international border between the United States and another country, other than a lawfully authorized tunnel or passage known to the Secretary of Homeland Security and subject to inspection by the Bureau of Immigration and Customs Enforcement, shall be imprisoned for not more than 20 years.</text></subsection> 
<subsection id="HB955FD3C04514A45B422BBC320C77820"><enum>(b)</enum><text display-inline="yes-display-inline">Any person who recklessly permits the construction or use of a tunnel or passage described in subsection (a) on land that the person owns or controls shall be imprisoned for not more than 10 years.</text></subsection> 
<subsection id="HFEDA60C385D940DBBD88B26428EF5241"><enum>(c)</enum><text>Any person who uses a tunnel or passage described in subsection (a) to unlawfully smuggle an alien, goods (in violation of section 545), controlled substances, weapons of mass destruction (including biological weapons), or a member of a terrorist organization (as defined in section 212(a)(3)(B)(vi) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(vi)</external-xref>)) shall be subject to twice the penalty that would have otherwise been imposed had the unlawful activity not made use of such a tunnel or passage.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H951CFC9F0212408487AF1800A100C29C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/27">chapter 27</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="H2A5DFA35F38F475A006FDD5D8179AC00"><enum>(c)</enum><header>Criminal forfeiture</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/982">Section 982(a)(6)</external-xref> of title 18, United States Code, is amended by inserting <quote>554,</quote> before <quote>1425,</quote>.</text></subsection></section> 
<section id="H1905EAC377A64339A254F2F8617E58C1"><enum>3.</enum><header>Directive to the United States Sentencing Commission</header> 
<subsection id="H77673F7674604A728D1FDB8F53294F09"><enum>(a)</enum><header>In general</header><text>Pursuant to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994</external-xref> of title 28, United States Code, and in accordance with this section, the United States Sentencing Commission shall promulgate or amend sentencing guidelines to provide for increased penalties for persons convicted of offenses described in <external-xref legal-doc="usc" parsable-cite="usc/18/554">section 554</external-xref> of title 18, United States Code, as added by section 1.</text></subsection> 
<subsection id="HEBE890C13E7F4A5C8BCAC66C077200DA"><enum>(b)</enum><header>Requirements</header><text>In carrying out this section, the United States Sentencing Commission shall—</text> 
<paragraph id="H996F0D4B2E1443E3B49B9FE3F7238204"><enum>(1)</enum><text>ensure that the sentencing guidelines, policy statements, and official commentary reflect the serious nature of the offenses described in <external-xref legal-doc="usc" parsable-cite="usc/18/554">section 554</external-xref> of title 18, United States Code, and the need for aggressive and appropriate law enforcement action to prevent such offenses;</text></paragraph> 
<paragraph id="HB7B6E048476F4985B03FC9547B709172"><enum>(2)</enum><text>provide adequate base offense levels for offenses under such section;</text></paragraph> 
<paragraph id="HFBC8C90B61E14969AE248834DDC1D32"><enum>(3)</enum><text>account for any aggravating or mitigating circumstances that might justify exceptions, including—</text> 
<subparagraph id="H9E98E352047446528D1E3D8FB00944D"><enum>(A)</enum><text>the use of a tunnel or passage described in subsection (a) of such section to facilitate other felonies; and</text></subparagraph> 
<subparagraph id="H7F31FA64DB324EE1BA18C0C36F643959"><enum>(B)</enum><text>the circumstances for which the sentencing guidelines currently provide applicable sentencing enhancements;</text></subparagraph></paragraph> 
<paragraph id="H6B1D37F5039440DAAECD127396E9CD5"><enum>(4)</enum><text>ensure reasonable consistency with other relevant directives, other sentencing guidelines, and statutes;</text></paragraph> 
<paragraph id="HA878810C38874CC2AE25264429D3B32D"><enum>(5)</enum><text>make any necessary and conforming changes to the sentencing guidelines and policy statements; and</text></paragraph> 
<paragraph id="HC9E54D604502499390005E63C53BA6B3"><enum>(6)</enum><text>ensure that the sentencing guidelines adequately meet the purposes of sentencing set forth in <external-xref legal-doc="usc" parsable-cite="usc/18/3553">section 3553(a)(2)</external-xref> of title 18, United States Code.</text></paragraph></subsection></section>
