<official-title>To amend the Atomic Energy Act of 1954 to require a licensee to notify the State, county, and public in which a facility is located whenever there is an unplanned release of fission products in excess of allowable limits.</official-title>

<section id="HA432C9AC905E463281D6DA27DE80AD98" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Release Notice Act of 2006</short-title></quote>.</text></section> 
<section id="HC1B4F444CC694D0AB56290C1A6008358"><enum>2.</enum><header>Nuclear release notice requirement</header><text display-inline="no-display-inline">Section 103 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>) is amended—</text> 
<paragraph id="H6458A03AABA54AD6998B5D005F00D424"><enum>(1)</enum><text>by redesignating subsection f. as subsection e.; and</text></paragraph> 
<paragraph id="H8A4BB2CE83CF4E9CBEFE47C72255EAE9"><enum>(2)</enum><text>in subsection e. (as so redesignated)—</text> 
<subparagraph id="H2A7A7B923B494E1898F08DDDBDBB8"><enum>(A)</enum><text>by designating the first, second, and third sentences as paragraphs (1), (2), and (3), respectively;</text></subparagraph> 
<subparagraph id="HF206989BAF954C7B9EDE4295B9F9AEC5"><enum>(B)</enum><text>by striking the subsection designation and paragraph (1) (as so designated) and inserting the following:</text>

<subsection id="H8B4DCCDAD6324A3900D200AC7E8DB85D"><enum>f.</enum><header>Notice of unplanned release of radioactive substances</header> 
<paragraph id="H078D8ECD8A6445B5B06652C29B3E4E20"><enum>(1)</enum><header>Notice required</header> 
<subparagraph id="HB6552977F6EF4AD984DA82AEAC499614"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each license issued for a utilization facility under this section or section 104 b. shall require as a condition of the license that in case of an unplanned release described in subparagraph (B), the licensee shall immediately notify the Commission, and the State and county in which the facility is located, of the release.</text> </subparagraph> 
<subparagraph id="H1DFDD85067814521BD6F8E06AB497B90"><enum>(B)</enum><header>Unplanned releases</header><text>Subparagraph (A) applies to any unplanned release of quantities of fission products or other radioactive substances—</text> 
<clause id="HD72F8FBE5E9D4E0FB0F5CDFC2D000011"><enum>(i)</enum><text>in excess of allowable limits for normal operation established by the Commission or other applicable Federal laws or standards; and</text></clause> 
<clause id="H73B9E5CBDF6445439B00ABC8798059E1"><enum>(ii)</enum><text>within allowable limits for normal operation established by the Commission or other applicable Federal laws or standards but that occurs more than twice within a 2-year period originating from the same source, process, or equipment at a facility.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HD5A6E0FBEC32480B8B94E3A76C6492C9"><enum>(C)</enum><text>in paragraph (3) (as so designated), by striking <quote>date of enactment of this subsection</quote> and inserting <quote>date of enactment of the <short-title>Nuclear Release Notice Act of 2006</short-title></quote>.</text></subparagraph></paragraph></section>
