<official-title>To further the purposes of the Sand Creek Massacre National Historic Site Establishment Act of 2000.</official-title>

<section id="HEF54F8BBF57D462688B189C8B46831D7" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sand Creek Massacre National Historic Site Trust Act of 2005</short-title></quote>.</text></section> 
<section id="H14F8613DCCCC466F9DAA30A79431C9D6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H6107C4440BFF47F093DFF408EED18E91"><enum>(1)</enum><header>Facility</header><text>The term <term>facility</term> means any structure, utility, road, or sign constructed on the trust property on or after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H90399F0FAB9E4335963EE9F28E58EBCB"><enum>(2)</enum><header>Improvement</header><text>The term <term>improvement</term> means—</text> 
<subparagraph id="H2AB9DA6300A9476BA787FD59FE312600"><enum>(A)</enum><text>a 1,625 square foot 1-story ranch house, built in 1952, located in the SW quarter of sec. 30, T. 17 S., R. 45 W., sixth principal meridian;</text></subparagraph> 
<subparagraph id="HF837538FF07B4AAAB2FC13C37D271065"><enum>(B)</enum><text>a 3,600 square foot metal-constructed shop building, built in 1975, located in the SW quarter of sec. 30, T. 17 S., R. 45 W., sixth principal meridian;</text></subparagraph> 
<subparagraph id="H6DF5D7C5A6EC4A3AA7ABFC6D04A0A088"><enum>(C)</enum><text>a livestock corral and shelter; and</text></subparagraph> 
<subparagraph id="HBD710B37D31F472AA2A9D7343FBB1075"><enum>(D)</enum><text>a water system and wastewater system with all associated utility connections.</text></subparagraph></paragraph> 
<paragraph id="HF2D6E0F70D6F4D059919BD87682908F6"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HA0BA4B921C94466200088BD2C709EB00"><enum>(4)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Cheyenne and Arapaho Tribes of Oklahoma, a federally recognized Indian tribe.</text></paragraph> 
<paragraph id="H4D06E79064754A2AA655565E209802CE"><enum>(5)</enum><header>Trust property</header><text>The term <term>trust property</term> means the real property, including rights to all minerals, and excluding the improvements, formerly known as the <quote>Dawson Ranch</quote>, consisting of approximately 1,465 total acres presently under the jurisdiction of the Tribe, situated within Kiowa County, Colorado, and more particularly described as follows:</text> 
<subparagraph id="H87EF4F6E66D944F399CA3CF1E64ECB07"><enum>(A)</enum><text>The portion of sec. 24, T. 17 S., R. 46 W., sixth principal meridian, that is the Eastern half of the NW quarter, the SW quarter of the NE quarter, the NW quarter of the SE quarter, sixth principal meridian.</text></subparagraph> 
<subparagraph id="HFD7644CC74244DCEBBEEC3327293CB6D"><enum>(B)</enum><text>All of sec. 25, T. 17 S., R. 46 W., sixth principal meridian.</text></subparagraph> 
<subparagraph id="HFA905866ABE7435F9CCE1962F4E31C27"><enum>(C)</enum><text>All of sec. 30, T. 17 S., R. 45 W., sixth principal meridian.</text></subparagraph></paragraph></section> 
<section id="H42F9E57A7CD949B38118BA5EA4A400B5"><enum>3.</enum><header>Conveyance of land to be held in trust for the cheyenne and arapaho tribes of oklahoma</header> 
<subsection id="H62AEBCF6D0B64886881FDA000000557C"><enum>(a)</enum><header>Land Held in Trust for the Cheyenne and Arapaho Tribes of Oklahoma</header><text>On conveyance of title to the trust property by the Tribe to the United States, without any further action by the Secretary, the trust property shall be held in trust for the benefit of the Tribe.</text></subsection> 
<subsection id="H53C10522804C4EE5913FAE5CCED7FDBF"><enum>(b)</enum><header>Trust</header><text>All right, title, and interest of the United States in and to the trust property, except any facilities constructed under section 4(b), are declared to be held by the United States in trust for the Tribe.</text></subsection></section> 
<section id="HD059FB4DB5AD4832810538E7F3FD316"><enum>4.</enum><header>Improvements and facilities</header> 
<subsection id="H7D194667EC2741FCB797002793834DCC"><enum>(a)</enum><header>Improvements</header><text>The Secretary may acquire by donation the improvements in fee.</text></subsection> 
<subsection id="HA5F418BBA34B4D60AAB02F84EC48E1A0"><enum>(b)</enum><header>Facilities</header> 
<paragraph id="H9C5FBE4D956242A0AD73F5880C1C7A9"><enum>(1)</enum><header>In general</header><text>The Secretary may construct a facility on the trust property only after consulting with, soliciting advice from, and obtaining the agreement of, the Tribe, the Northern Cheyenne Tribe, and the Northern Arapaho Tribe.</text></paragraph> 
<paragraph id="H77569AEA92E84BD5A6DC2BA97FDDB343"><enum>(2)</enum><header>Ownership</header><text>Facilities constructed with Federal funds or funds donated to the United States shall be owned in fee by the United States.</text></paragraph></subsection> 
<subsection id="HCAB26E7BD6514BF6A541DF3B0067C73"><enum>(c)</enum><header>Federal Funds</header><text>For the purposes of the construction, maintenance, or demolition of improvements or facilities, Federal funds shall be expended only on improvements or facilities that are owned in fee by the United States.</text></subsection></section> 
<section id="HDCFA4A20F29846C892B8306759F9A9E7"><enum>5.</enum><header>Survey of boundary line; publication of description</header> 
<subsection id="H29C9B12EAA734577822494FD7B0043FB"><enum>(a)</enum><header>Survey of Boundary Line</header><text>To accurately establish the boundary of the trust property, not later than 180 days after the date of enactment of this Act, the Secretary shall cause a survey to be conducted by the Office of Cadastral Survey of the Bureau of Land Management of the boundary lines described in section 2(5).</text></subsection> 
<subsection id="HC46C79C4771F44F2B6D4DD74B1D208EB"><enum>(b)</enum><header>Publication of Land Description</header> 
<paragraph id="H4E5EDDC6590F479CBE0043A585002C24"><enum>(1)</enum><header>In general</header><text>On completion of the survey under subsection (a), and acceptance of the survey by the representatives of the Tribe, the Secretary shall cause the full metes and bounds description of the lines, with a full and accurate description of the trust property, to be published in the Federal Register.</text></paragraph> 
<paragraph id="H5410902FE226472489F5BBC86931DB1F"><enum>(2)</enum><header>Effect</header><text>The description shall, on publication, constitute the official description of the trust property.</text></paragraph></subsection></section> 
<section id="H73E67C5B82F34DDC9500351425861C83"><enum>6.</enum><header>Administration of trust property</header> 
<subsection id="H9B54CA8AC11B4F168F953276912B6D77"><enum>(a)</enum><header>In General</header><text>The trust property shall be administered in perpetuity by the Secretary as part of the Sand Creek Massacre National Historic Site, only for historical, traditional, cultural, and other uses in accordance with the Sand Creek Massacre National Historic Site Establishment Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/465">Public Law 106–465</external-xref>).</text></subsection> 
<subsection id="HF2B0CD0379734BCA8BE1002D904B54F5"><enum>(b)</enum><header>Access for Administration</header><text>For purposes of administration, the Secretary shall have access to the trust property, improvements, and facilities as necessary for management of the Sand Creek Massacre National Historic Site in accordance with the Sand Creek Massacre National Historic Site Establishment Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/465">Public Law 106–465</external-xref>).</text></subsection> 
<subsection id="HB540DB24E5034FC0A42C67E5C7F3C9F1"><enum>(c)</enum><header>Duty of the Secretary</header><text>The Secretary shall take such action as is necessary to ensure that the trust property is used only in accordance with this section.</text></subsection> 
<subsection id="HCE89C13205CF4904B3F7177B4DA842D"><enum>(d)</enum><header>Savings Provision</header><text>Nothing in this Act supersedes the laws and policies governing units of the National Park System.</text></subsection></section> 
<section id="H23C7E64C41CA47C0878976C71451D1DA"><enum>7.</enum><header>Acquisition of property</header><text display-inline="no-display-inline">Section 6(a)(2) of the Sand Creek Massacre National Historic Site Establishment Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/465">Public Law 106–465</external-xref>) is amended by inserting <quote>or exchange</quote> after <quote>only by donation</quote>.</text></section>
