<official-title>To amend <external-xref legal-doc="usc" parsable-cite="usc/5/8339">section 8339(p)</external-xref> of title 5, United States Code, to clarify the method for computing certain annuities under the Civil Service Retirement System which are based on part-time service, and for other purposes.</official-title>

<section section-type="section-one" id="H009B5DBD228B490BB49BB2799290C96C" display-inline="no-display-inline"><enum>1.</enum><header>Computation of certain annuities based on part-time service</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/8339">Section 8339(p)</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<paragraph indent="up1" id="H64149B2A14964CA5A54B205C2E6BA8E5"><enum>(3)</enum><text>In the administration of paragraph (1)—</text> 
<subparagraph id="H60698AF55A35497F84CAF72C77F23BE"><enum>(A)</enum><text>subparagraph (A) of such paragraph shall apply with respect to pay for service performed before, on, or after April 7, 1986; and</text></subparagraph> 
<subparagraph id="H0FEA325242C342C3BF7324AC90059F1B"><enum>(B)</enum><text>subparagraph (B) of such paragraph—</text> 
<clause id="H9294E997240D4075A0CCC6D601AB2700"><enum>(i)</enum><text>shall apply with respect to that portion of any annuity which is attributable to service performed on or after April 7, 1986; and</text></clause> 
<clause id="H28FBDB264181479A00B93C8E1E79C64"><enum>(ii)</enum><text>shall not apply with respect to that portion of any annuity which is attributable to service performed before April 7, 1986.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H19C4FF525F08469AB08744DE3E4C3EF8"><enum>2.</enum><header>Applicability</header> 
<subsection id="HDE9585C5E199483CBDC6733BF9C9E76C"><enum>(a)</enum><header>In general</header><text>The amendment made by this Act shall be effective with respect to any annuity entitlement to which is based on a separation from service occurring on or after the date of enactment of this Act.</text></subsection> 
<subsection id="H619DE1FD46C4450DA962AD9998581330"><enum>(b)</enum><header>Recomputation of certain annuities</header> 
<paragraph id="H2D8FDA6996914693864CE3703B5B65AE"><enum>(1)</enum><header>In general</header><text>In the case of any individual who—</text> 
<subparagraph id="H38AA3668AC264717B4001655CDB030FC"><enum>(A)</enum><text>before April 7, 1986, performed any service creditable under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code, and</text></subparagraph> 
<subparagraph id="H3EC37AFA3CF544D19034A2F253D5E9DB"><enum>(B)</enum><text>was separated from the service on or after April 7, 1986, and before the date of enactment of this Act,</text></subparagraph><continuation-text continuation-text-level="paragraph">any annuity under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code (or under chapter 84 of such title 5, to the extent of any portion of such annuity which is computed under subchapter III of such chapter 83) based on the service of such individual shall be recomputed to take into account the amendment made by this Act, if application therefor is made within 18 months after the date of enactment of this Act.</continuation-text></paragraph> 
<paragraph id="H30AA8BF5AD224EE4822C5D5586AD5578"><enum>(2)</enum><header>Amounts to which applicable</header><text>Any change in an annuity resulting from a recomputation under paragraph (1) shall be effective with respect to amounts accruing for months beginning after the date on which application for such recomputation is made.</text></paragraph></subsection> 
<subsection id="H80497F6ACCED427F96521F74ACDA9D96"><enum>(c)</enum><header>Notice requirement</header> 
<paragraph id="HF49AC88FC51647C4AA04C41E4EEA47AF"><enum>(1)</enum><header>In general</header><text>The Office of Personnel Management shall take such action as may be necessary and appropriate to inform individuals entitled to have any annuity recomputed under subsection (b) of their entitlement to such recomputation.</text></paragraph> 
<paragraph id="HD67E020BB8C4421687C8005905A2FDB"><enum>(2)</enum><header>Assistance</header><text>The Office shall, on request, assist any individual referred to in paragraph (1) in obtaining from any department, agency, or other instrumentality of the United States such information in the possession of such instrumentality as may be necessary—</text> 
<subparagraph id="HE1DF9A56DB2E43CA90136BDC00BEA3EE"><enum>(A)</enum><text>to verify the entitlement of such individual to have an annuity recomputed under subsection (b); or</text></subparagraph> 
<subparagraph id="HF9F00645A3994B5DB77D1F82BFCA6CB9"><enum>(B)</enum><text>to carry out any such recomputation.</text></subparagraph></paragraph> 
<paragraph id="H78AF949A94604AA09F2B84DD45C2EDE1"><enum>(3)</enum><header>Information</header><text>Any department, agency, or other instrumentality of the United States which possesses any information with respect to part-time service performed by an individual shall, at the request of the Office, furnish such information to the Office.</text></paragraph></subsection></section>
