		<section changed="added" display-inline="no-display-inline" id="H4C8816CCF2D24408BED86D2355024067" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>FHA
			 Manufactured Housing Loan Modernization Act of 2006</quote>.</text>
		</section><section changed="added" id="H32DAA8464BA84E2497910000CEE1797" reported-display-style="italic"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection changed="added" id="H25A572A618274B2F9FBD99FEDFD3BDC2" reported-display-style="italic"><enum>(a)</enum><header>Findings</header><text>The
			 Congress finds that—</text>
				<paragraph id="HB43CB503C40C47B3A9233FF947265157"><enum>(1)</enum><text>manufactured housing
			 plays a vital role in providing housing for low- and moderate-income families
			 in the United States;</text>
				</paragraph><paragraph id="H79223BBE427144FB00CACAE7994CEF94"><enum>(2)</enum><text>the FHA title I insurance
			 program for manufactured home loans traditionally has been a major provider of
			 mortgage insurance for home-only transactions;</text>
				</paragraph><paragraph id="H0BA0F045B3DB49A9828B5BA22C0C3F6"><enum>(3)</enum><text>the manufactured housing
			 market is in the midst of a prolonged downturn which has resulted in a severe
			 contraction of traditional sources of private lending for manufactured home
			 purchases;</text>
				</paragraph><paragraph id="H20C2FA9BBD8C43D8A51DEE47AA007D50"><enum>(4)</enum><text>during past downturns the
			 FHA title I insurance program for manufactured homes has filled the lending
			 void by providing stability until the private markets could recover;</text>
				</paragraph><paragraph id="H88E0C71C4E644A89A511906500C0D229"><enum>(5)</enum><text>in 1992, during the
			 manufactured housing industry’s last major recession, over 30,000 manufactured
			 home loans were insured under title I;</text>
				</paragraph><paragraph id="H063FB81026044C84B388FEABC4A9C01D"><enum>(6)</enum><text>in 2004, fewer than 2,000
			 manufactured housing loans were insured under title I;</text>
				</paragraph><paragraph id="H8C8AFA8EA5564046005B3C37D6100E2"><enum>(7)</enum><text>the loan limits for title
			 I manufactured housing loans have not been adjusted for inflation since 1992;
			 and</text>
				</paragraph><paragraph id="H6C240E64E5174EA5A6B7D9656F09FD3C"><enum>(8)</enum><text>these problems with the
			 title I program have resulted in an atrophied market for manufactured housing
			 loans, leaving American families who have the most difficulty achieving
			 homeownership without adequate financing options for home-only manufactured
			 home purchases.</text>
				</paragraph></subsection><subsection changed="added" id="H45390AD103FC44E3816E86CF9F9F49CC" reported-display-style="italic"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="HD4E1BBC34F264E2E957FD0E305AB3900"><enum>(1)</enum><text>to provide adequate
			 funding for FHA-insured manufactured housing loans for low- and moderate-income
			 homebuyers during all economic cycles in the manufactured housing
			 industry;</text>
				</paragraph><paragraph id="H36CAE70BD6114EB5BBA9B645C79B4838"><enum>(2)</enum><text>to modernize the FHA
			 title I insurance program for manufactured housing loans to enhance
			 participation by Ginnie Mae and the private lending markets; and</text>
				</paragraph><paragraph id="HCB6064BF13E64C890082FD124F0568F4"><enum>(3)</enum><text>to adjust the low loan
			 limits for title I manufactured home loan insurance to reflect the increase in
			 costs since such limits were last increased in 1992 and to index the limits to
			 inflation.</text>
				</paragraph></subsection></section><section changed="added" id="H1F8DDF53331C40FABD4314D9BE1CE645" reported-display-style="italic"><enum>3.</enum><header>Exception to limitation
			 on financial institution portfolio</header><text display-inline="no-display-inline">The second sentence of section 2(a) of the
			 National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(a)</external-xref>) is amended—</text>
			<paragraph id="HAA381581DD5C476BB8B459220016684F"><enum>(1)</enum><text>by striking <quote>In no
			 case</quote> and inserting <quote>Other than in connection with a manufactured
			 home or a lot on which to place such a home (or both), in no case</quote>;
			 and</text>
			</paragraph><paragraph id="HBE3DEC43A90D49D5ACEDEAC54883474F"><enum>(2)</enum><text>by striking <quote>:
			 <italic>Provided</italic>, That with</quote> and inserting <quote>.
			 With</quote>.</text>
			</paragraph></section><section changed="added" id="H3CF0C25DC3184133BF3C7437374BB6BA" reported-display-style="italic"><enum>4.</enum><header>Insurance
			 benefits</header>
			<subsection id="H32CB0649325E4B45B054AE41B2840028"><enum>(a)</enum><header>In
			 general</header><text>Subsection (b) of section 2 of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)</external-xref>), is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block id="H94204F6BF97C4BABAFBAE0B309461E8E" style="OLC">
					<paragraph id="H27764115B3C74AE90099C51F7F0912F7"><enum>(8)</enum><header>Insurance
				benefits for manufactured housing loans</header><text>Any contract of insurance
				with respect to loans, advances of credit, or purchases in connection with a
				manufactured home or a lot on which to place a manufactured home (or both) for
				a financial institution that is executed under this title after the date of the
				enactment of the <short-title>FHA Manufactured Housing
				Loan Modernization Act of 2006</short-title> by the Secretary shall be
				conclusive evidence of the eligibility of such financial institution for
				insurance, and the validity of any contract of insurance so executed shall be
				incontestable in the hands of the bearer from the date of the execution of such
				contract, except for fraud or misrepresentation on the part of such
				institution.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="HDA0FE0CE7B9E481485A3E0AAC57227F5" reported-display-style="italic"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall only apply to loans that are registered
			 or endorsed for insurance after the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" id="HCCAC56B622284307B38BA7DA98FC1B07" reported-display-style="italic"><enum>5.</enum><header>Maximum loan
			 limits</header>
			<subsection changed="added" id="H554D65BD667747B5A796F54C4FAC7EDE" reported-display-style="italic"><enum>(a)</enum><header>Dollar
			 Amounts</header><text>Paragraph (1) of section 2(b) of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)(1)</external-xref>) is amended—</text>
				<paragraph id="H45445CC74F174E44A76525287C854FC4"><enum>(1)</enum><text>in clause (ii) of
			 subparagraph (A), by striking <quote>$17,500</quote> and inserting
			 <quote>$24,500</quote>;</text>
				</paragraph><paragraph id="H060ABAD0D1F14809A6C3FA2568D06FC"><enum>(2)</enum><text>in subparagraph (C) by
			 striking <quote>$48,600</quote> and inserting <quote>$68,040</quote>;</text>
				</paragraph><paragraph id="HA25D5DA9231D444DA042E55347F04087"><enum>(3)</enum><text>in subparagraph (D) by
			 striking <quote>$64,800</quote> and inserting <quote>$90,720</quote>;</text>
				</paragraph><paragraph id="H0AD830FA1F45494F8B234F7BCC3DABF7"><enum>(4)</enum><text>in subparagraph (E) by
			 striking <quote>$16,200</quote> and inserting <quote>$22,680</quote>;
			 and</text>
				</paragraph><paragraph id="HA8B51357D0A94ADBA3E909351F007FA4"><enum>(5)</enum><text>by realigning
			 subparagraphs (C), (D), and (E) 2 ems to the left so that the left margins of
			 such subparagraphs are aligned with the margins of subparagraphs (A) and
			 (B).</text>
				</paragraph></subsection><subsection changed="added" id="HF8A71AF6897641BD876E1440DF325800" reported-display-style="italic"><enum>(b)</enum><header>Annual
			 Indexing</header><text>Subsection (b) of section 2 of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)</external-xref>), as amended by the preceding provisions of this Act, is
			 further amended by adding at the end the following new paragraph:</text>
				<quoted-block id="H09377787287C442D851BC75E2D287332" style="OLC">
					<paragraph id="HF75F94A6BAED4EDABE395F8972A95B26"><enum>(9)</enum><header>Annual indexing
				of manufactured housing loans</header><text>The Secretary shall develop a
				method of indexing in order to annually adjust the loan limits established in
				subparagraphs (A)(ii), (C), (D), and (E) of this subsection. Such index shall
				be based on the manufactured housing price data collected by the United States
				Census Bureau. The Secretary shall establish such index no later than one year
				after the date of the enactment of the <short-title>FHA
				Manufactured Housing Loan Modernization Act of
				2006</short-title>.</text>
					</paragraph><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="H2D6A8BABA2C64BAEB2B1008943A8F9D2" reported-display-style="italic"><enum>(c)</enum><header>Technical and
			 conforming changes</header><text>Paragraph (1) of section 2(b) of the National
			 Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)(1)</external-xref>) is amended—</text>
				<paragraph id="H7E273E543469434C9FB1C4546350B1F6"><enum>(1)</enum><text>by striking
			 <quote>No</quote> and inserting <quote>Except as provided in the last sentence
			 of this paragraph, no</quote>; and</text>
				</paragraph><paragraph id="HE2A860F49DE0461189D8159DEAD3CB55"><enum>(2)</enum><text>by adding after and below
			 subparagraph (G) the following:</text>
					<quoted-block id="HCFF4AD2787BA46888D7EF2CCA5B1CC8" style="OLC">
						<text display-inline="no-display-inline">The Secretary shall, by regulation, annually
				increase the dollar amount limitations in subparagraphs (A)(ii), (C), (D), and
				(E) (as such limiations may have been previously adjusted under this sentence)
				in accordance with the index established pursuant to paragraph
				(9).</text>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="added" id="HFB2803A74B894452A3E2DACFE5254F87" reported-display-style="italic"><enum>6.</enum><header>Insurance
			 premiums</header><text display-inline="no-display-inline">Subsection (f) of
			 section 2 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(f)</external-xref>) is amended—</text>
			<paragraph id="HE213A651F5DD44FC9470460110B790C8"><enum>(1)</enum><text>by inserting
			 <quote>(1)<header-in-text level="subsection" style="OLC"> Premium
			 charges.—</header-in-text></quote> after <quote>(f)</quote>; and</text>
			</paragraph><paragraph id="H2F95FCD7175F462193AA0000FC3EB5DD"><enum>(2)</enum><text>by adding at the end the
			 following new paragraph:</text>
				<quoted-block id="HAF24073D0BC046AC8643F493D1008997" style="OLC">
					<paragraph id="HC70322AD6EB441EAA0CF6383A953F877" indent="up1"><enum>(2)</enum><header>Manufactured home
				loans</header><text display-inline="yes-display-inline">Notwithstanding
				paragraph (1), in the case of a loan, advance of credit, or purchase in
				connection with a manufactured home or a lot on which to place such a home (or
				both), the premium charge for the insurance granted under this section shall be
				paid by the borrower under the loan or advance of credit, as follows:</text>
						<subparagraph id="H587E5A01781E4AD8B44BB7F0437BDD49"><enum>(A)</enum><text>At the time of the making of the loan,
				advance of credit, or purchase, a single premium payment in an amount not to
				exceed 2.25 percent of the amount of the original insured principal
				obligation.</text>
						</subparagraph><subparagraph id="H5CFB1844B3E9492E9D2F75893D37EE1B"><enum>(B)</enum><text>In addition to the premium under
				subparagraph (A), annual premium payments during the term of the loan, advance,
				or obligation purchased in an amount not exceeding 1.0 percent of the remaining
				insured principal balance (excluding the portion of the remaining balance
				attributable to the premium collected under subparagraph (A) and without taking
				into account delinquent payments or prepayments).</text>
						</subparagraph><subparagraph id="HFCA7B29D76454EBA93D4FFC0025A224"><enum>(C)</enum><text>Premium charges under this paragraph
				shall be established in amounts that are sufficient, but do not exceed the
				minimum amounts necessary, to maintain a negative credit subsidy for the
				program under this section for insurance of loans, advances of credit, or
				purchases in connection with a manufactured home or a lot on which to place
				such a home (or both), as determined based upon risk to the Federal Government
				under existing underwriting requirements.</text>
						</subparagraph><subparagraph id="HC272941B4A9143B5BB9304A8B8373F96"><enum>(D)</enum><text>The Secretary may increase the
				limitations on premium payments to percentages above those set forth in
				subparagraphs (A) and (B), but only if necessary, and not in excess of the
				minimum increase necessary, to maintain a negative credit subsidy as described
				in subparagraph
				(C).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" id="H74A873B3D9A945AFA429F6D7B9071F14" reported-display-style="italic"><enum>7.</enum><header>Technical
			 corrections</header>
			<subsection changed="added" id="H483F5E1BE2C04F30B30057225CF11100" reported-display-style="italic"><enum>(a)</enum><header>Dates</header><text>Subsection
			 (a) of section 2 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(a)</external-xref>) is
			 amended—</text>
				<paragraph id="HDF05E749A18746C4B2A062004BA50714"><enum>(1)</enum><text>by striking <quote>on and
			 after July 1, 1939,</quote> each place such term appears; and</text>
				</paragraph><paragraph id="HDEEB5BC821F74CBDA65DA95F85A0A1B1"><enum>(2)</enum><text>by striking <quote>made
			 after the effective date of the Housing Act of 1954</quote>.</text>
				</paragraph></subsection><subsection changed="added" id="HD0AAD675F9BB4C4FA778A8E62C2CA41" reported-display-style="italic"><enum>(b)</enum><header>Authority of
			 Secretary</header><text>Subsection (c) of section 2 of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(c)</external-xref>) is amended to read as follows:</text>
				<quoted-block id="H18C3ADFA28E74FE98C363874D116C0FC" style="OLC">
					<subsection id="H6FD97C6B7C8B4D7E9408BC7091B1E06C"><enum>(c)</enum><header>Handling and
				disposal of property</header>
						<paragraph id="H7DE62E8DF6F94B0897354B474674A401"><enum>(1)</enum><header>Authority of
				Secretary</header><text>Notwithstanding any other provision of law, the
				Secretary may—</text>
							<subparagraph id="H897D532B724D4959948D6FC0B3AE831B"><enum>(A)</enum><text>deal with,
				complete, rent, renovate, modernize, insure, or assign or sell at public or
				private sale, or otherwise dispose of, for cash or credit in the Secretary’s
				discretion, and upon such terms and conditions and for such consideration as
				the Secretary shall determine to be reasonable, any real or personal property
				conveyed to or otherwise acquired by the Secretary, in connection with the
				payment of insurance heretofore or hereafter granted under this title,
				including any evidence of debt, contract, claim, personal property, or security
				assigned to or held by him in connection with the payment of insurance
				heretofore or hereafter granted under this section; and</text>
							</subparagraph><subparagraph id="HE23327B76A17424F814CB4F4F6FC4C54"><enum>(B)</enum><text>pursue to final
				collection, by way of compromise or otherwise, all claims assigned to or held
				by the Secretary and all legal or equitable rights accruing to the Secretary in
				connection with the payment of such insurance, including unpaid insurance
				premiums owed in connection with insurance made available by this title.</text>
							</subparagraph></paragraph><paragraph id="H2B0596C3D44246DE943412D6A705A165"><enum>(2)</enum><header>Advertisements
				for proposals</header><text>Section 3709 of the Revised Statutes shall not be
				construed to apply to any contract of hazard insurance or to any purchase or
				contract for services or supplies on account of such property if the amount
				thereof does not exceed $25,000.</text>
						</paragraph><paragraph id="HFB9A86B1DFEC40B2A6CB4B715DFB7E1"><enum>(3)</enum><header>Delegation of
				authority</header><text>The power to convey and to execute in the name of the
				Secretary, deeds of conveyance, deeds of release, assignments and satisfactions
				of mortgages, and any other written instrument relating to real or personal
				property or any interest therein heretofore or hereafter acquired by the
				Secretary pursuant to the provisions of this title may be exercised by an
				officer appointed by the Secretary without the execution of any express
				delegation of power or power of attorney. Nothing in this subsection shall be
				construed to prevent the Secretary from delegating such power by order or by
				power of attorney, in the Secretary’s discretion, to any officer or agent the
				Secretary may
				appoint.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section changed="added" id="HEABD01BEA6604C3B87CA7C67EFF74F2" reported-display-style="italic"><enum>8.</enum><header>Revision of underwriting
			 criteria</header>
			<subsection id="H5AC7FAF5728943A38F6CD4D148C8EA40"><enum>(a)</enum><header>In
			 General</header><text>Subsection (b) of section 2 of the National Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1703">12 U.S.C. 1703(b)</external-xref>), as amended by the preceding provisions of this Act, is
			 further amended by adding at the end the following new paragraph:</text>
				<quoted-block id="HBBCCFF51A08A4C8FBB902840B3C68893" style="OLC">
					<paragraph id="HAB1B0385E1034DC481A7364B7BA3A7CD"><enum>(10)</enum><header>Financial
				Soundness of Manufactured Housing Program</header><text>The Secretary shall
				establish such underwriting criteria for loans and advances of credit in
				connection with a manufactured home or a lot on which to place a manufactured
				home (or both), including such loans and advances represented by obligations
				purchased by financial institutions, as may be necessary to ensure that the
				program under this title for insurance for financial institutions against
				losses from such loans, advances of credit, and purchases is financially
				sound.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection changed="added" id="HEB80C095BCE24F88A5EF58B81C889D7F" reported-display-style="italic"><enum>(b)</enum><header>Timing</header><text>Not
			 later than the expiration of the 6-month period beginning on the date of the
			 enactment of this Act, the Secretary of Housing and Urban Development shall
			 revise the existing underwriting criteria for the program referred to in
			 paragraph (10) of section 2(b) of the National Housing Act (as added by
			 subsection (a) of this section) in accordance with the requirements of such
			 paragraph.</text>
