<official-title>To extend the deadlines for distributing certain funds secured by the Michigan Indian Land Claims Settlement Act and for other purposes.</official-title>

<section id="H080EF5E2C399472EB5935C341818B0BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Michigan Indian Land Claims Settlement Act Amendments</short-title></quote>.</text></section> 
<section id="HDE5622AC5CDD4E92830163B22F56AC00"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="HD4742F324E274561A6D457B3FFBFB00"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="H2B6E0E7749784A68BDBDB8B7D047C983"><enum>(1)</enum><text>The Michigan Indian Land Claims Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/105/143">Public Law 105–143</external-xref>) (hereafter <quote>the Act</quote>) provides for the distribution of certain judgment funds awarded by the Indian Claims Commission to certain Ottawa and Chippewa of Michigan in dockets numbered 18-E, 58, 18-R, and 364.</text></paragraph> 
<paragraph id="H78645D9FFA4E4D618B95DEFF25FCF8F2"><enum>(2)</enum><text>Under the terms and conditions of the Act, a sizable percentage of those funds have already been distributed to the Grand Traverse Band of Ottawa and Chippewa Indian, the Bay Mills Indian Community, the Little River Band of Ottawa Indians, the Little Traverse Bay Bands of Odawa, and the Sault Ste. Marie Tribe of Chippewa. The remaining funds are currently being held in trust pending distribution to certain individual descendants of treaty signers, and to certain unrecognized Michigan Ottawa and Chippewa Tribes that obtain Federal acknowledgment or a Federal reaffirmation of the government-to-government relationship with the United States prior to the distribution period established in the Act. That distribution period is no earlier than December 15, 2005, and no later than December 15, 2006.</text></paragraph> 
<paragraph id="H7170FCA116364075A8BA23745CD0556D"><enum>(3)</enum><text>To qualify for these funds, an unrecognized Michigan Ottawa or Chippewa Tribe must—</text> 
<subparagraph id="H89388AA09D88446EB04E44EAB538C8A0"><enum>(A)</enum><text>be a signatory to either the 1836 treaty (7 Stat. 391) or the 1855 treaty (11 Stat. 621);</text></subparagraph> 
<subparagraph id="H55F26E05E5214111A7615DAF9004E7D8"><enum>(B)</enum><text>have a membership which is predominantly Chippewa and Ottawa;</text></subparagraph> 
<subparagraph id="H40D0E7D5AB384FCCA39CB49F7DEA2C00"><enum>(C)</enum><text>have submitted to the Bureau of Indian Affairs a letter of intent to seek Federal acknowledgment not later than July 15, 1998;</text></subparagraph> 
<subparagraph id="H7A1E6BD5D2E14D60A01F9C1E058FED7B"><enum>(D)</enum><text>have submitted to the Bureau of Indian Affairs a documented petition for Federal acknowledgment not later than December 15, 2000; and</text></subparagraph> 
<subparagraph id="H91F1CAFB99544B058CFD548805FB0385"><enum>(E)</enum><text>have obtained Federal acknowledgment or reaffirmation by Congress or the Bureau of Indian Affairs prior to the distribution period established in the Act.</text></subparagraph></paragraph> 
<paragraph id="H9FC6B47283264DCB82804909B06CB41B"><enum>(4)</enum><text>Two Michigan based unrecognized Ottawa and Chippewa Tribes, the Burt Lake Band of Ottawa and Chippewa Indians and the Grand River Band of Ottawa and Chippewa Indians, have met the first 5 requirements, but the Bureau of Indian Affairs has not completed its review of the tribes’ documented petitions.</text></paragraph> 
<paragraph id="HC91B6FDE04C24B9C94089C39B205AD00"><enum>(5)</enum><text>Because neither of those tribes has caused this delay, it would be unfair and unjust to deny either tribe its tribal shares of the funds merely because the Bureau of Indian Affairs has been unable to complete work on the petitions.</text></paragraph> </subsection> 
<subsection id="HC876918F10E24C7D008F651F21D76381"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to extend the distribution dates established in <external-xref legal-doc="public-law" parsable-cite="pl/105/143">Public Law 105–143</external-xref> to protect the legal rights of those 2 tribes.</text></subsection></section> 
<section id="H2AA6A17EC8B1445A9CFC7658576DC007"><enum>3.</enum><header>Technical amendment</header><text display-inline="no-display-inline">Section 106(a)(2) of the Michigan Indian Land Claims Settlement Act is amended to read as follows:</text>

<paragraph id="H9D64339256FC42A9BEE1A96CFFE396F1" display-inline="no-display-inline"><enum>(1)</enum><header>Time limitations</header><text>The judgment distribution roll of descendants prepared pursuant to paragraph (1)(A) shall be approved not later than December 15, 2007.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
