<paragraph id="HA837CA56A3A24F78A85948E6056684B3"><enum>(1)</enum><header>Conference</header><text>The term <term>Conference</term> means the Conference of the Parties established by paragraph 1 of Article 19 of the POPs Convention.</text></paragraph> 
<paragraph id="HCE71011F92F84540B69C5092995FA357"><enum>(2)</enum><header>Conference listing decision</header><text>The term <term>Conference listing decision</term> means a decision by the Conference to approve an amendment to list a chemical substance or mixture in Annex A or B to the POPs Convention.</text></paragraph> 
<paragraph id="HB684E3EC041D4495A3D8001EBA1F3796"><enum>(3)</enum><header>Designated national authority</header><text>The term <term>designated national authority</term> means the 1 or more authorities that a government has designated in a notification to the Secretariat of the PIC Convention in accordance with Article 4 of the PIC Convention.</text></paragraph> 
<paragraph id="H8BFBD81463F549C3BF53E9401465ECA5"><enum>(4)</enum><header>Executive Body</header><text>The term <term>Executive Body</term> means the Executive Body established by Article 10 of the LRTAP Convention.</text></paragraph> 
<paragraph id="H29785C0795AE498200763E36507253DB" display-inline="no-display-inline"><enum>(5)</enum><header>Executive body decision 1998/2</header><text display-inline="yes-display-inline">The term <quote>Executive Body Decision 1998/2</quote> means the decision of the Executive Body titled <quote>Executive Body Decision 1998/2 on Information to Be Submitted and the Procedure for Adding Substances to Annexes I, II, or III to the Protocol on Persistent Organic Pollutants</quote> including any amendments thereto, as provided in Article 14 of the LRTAP POPs Protocol.</text></paragraph> 
<paragraph id="HED678491249949789E3BCB6EB302533D"><enum>(6)</enum><header>HCH</header><text>The term <term>HCH</term> means hexachlorocyclohexane, including lindane.</text></paragraph> 
<paragraph id="H4BE197156E434190AC7C69D68E55E1D"><enum>(7)</enum><header>LRTAP Convention</header><text>The term <term>LRTAP Convention</term> means the Convention on Long-Range Transboundary Air Pollution, done at Geneva on November 13, 1979 (TIAS 10541).</text></paragraph>

<paragraph id="H416B31EACE434614B90006F9B076B21C"><enum>(10)</enum><header>LRTAP POPs Protocol</header><text>The term <term>LRTAP POPs Protocol</term> means the Protocol on Persistent Organic Pollutants to the LRTAP Convention, done at Aarhus on June 24, 1998, and any subsequent amendment to which the United States consents to be bound.</text></paragraph> 
<paragraph id="HAAECF4C910D6422A92DD5A77E1063EF"><enum>(11)</enum><header>PCB</header><text>The term <term>PCB</term> means a polychlorinated biphenyl.</text></paragraph> 
<paragraph id="HA7E908D4119F4C7982AF7503D00D61D"><enum>(12)</enum><header>PIC Convention</header><text display-inline="yes-display-inline">The term <term>PIC Convention</term> means the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, done at Rotterdam on September 10, 1998, and any subsequent amendment to which the United States consents to be bound .</text></paragraph>

<subparagraph id="H14C91BB4379C497AB17584FCCF50CED7"><enum>(B)</enum><text>chlordane;</text></subparagraph> 
<subparagraph id="H80488A235DC84B20A2266B9E93595CD1"><enum>(C)</enum><text>dichlorodiphenyltrichloroethane (DDT);</text></subparagraph> 
<subparagraph id="H05C0EA5F002446C3ADD48CF36B2491C"><enum>(D)</enum><text>dieldrin;</text></subparagraph> 
<subparagraph id="H80896808BC8A40CF83B0602CB0838767"><enum>(E)</enum><text>endrin;</text></subparagraph>

<subparagraph id="HF8C5EB0F9CBA4AA7BAD33535C8A6A0CA"><enum>(K)</enum><text>any other chemical substance or mixture that is listed in Annex A or B to the POPs Convention.</text></subparagraph></paragraph> 
<paragraph id="H3AE63CD2CF944DBB9FB4F5D293A2595E"><enum>(14)</enum><header>POPs Convention</header><text display-inline="yes-display-inline">The term <term>POPs Convention</term> means the Stockholm Convention on Persistent Organic Pollutants, done at Stockholm on May 22, 2001, and any subsequent amendment to which the United States consents to be bound.</text></paragraph> 
<paragraph id="H0CEBE9EFDA604ADABFEA5FCB400015D8"><enum>(15)</enum><header>POPs Review Committee</header><text>The term <term>POPs Review Committee</term> means the Persistent Organic Pollutants Review Committee established under paragraph 6 of Article 19 of the POPs Convention.</text></paragraph></section> 
<section id="HC01328F6E3084EBAB67CE45BAE1F52B7"><enum>502.</enum><header>Implementation of POPs Convention and LRTAP POPs Protocol</header> 
<subsection id="HDC9D0210DEB147FA9E00726FFD00EE92"><enum>(a)</enum><header>Prohibition on specified POPs Chemical substances and mixtures and LRTAP POPs Chemical substances and mixtures</header><text>Subject to subsections (c), (d), and (i) and the relevant provisions of the POPs Convention and the LRTAP POPs Protocol, notwithstanding any other provision of law, a person shall not manufacture, process, distribute in commerce for export, use, or dispose of any of the following:</text> 
<paragraph id="HC154BFE0EB0D4BE9A870F537693F3E05"><enum>(1)</enum><text>A POPs chemical substance or mixture specified in any of subparagraphs (A) through (H) and (J) of section 501(13).</text></paragraph> 
<paragraph id="H9E967F0F2E5E4C709C56307BE7F87DC"><enum>(2)</enum><text>A LRTAP POPs chemical substance or mixture specified in any of subparagraphs (A) through (K) and (M) of section 501(8).</text></paragraph></subsection> 
<subsection id="H3655F4EE238541C8B04865AF16CE1121"><enum>(b)</enum><header>Prohibition on other POPs Chemical substances and mixtures and LRTAP POPs Chemical substances and mixtures</header><text>Subject to subsections (c), (d), and (i), notwithstanding any other provision of law, a person shall not manufacture, process, distribute in commerce for export, use, or dispose of a POPs chemical substance or mixture described in section 501(13)(K), or a LRTAP POPs chemical substance or mixture described in 501(8)(N), in a manner that is inconsistent with regulations promulgated under subsection (h).</text></subsection> 
<subsection id="H311236FAD6AD48008E9258044F81F320"><enum>(c)</enum><header>Exemptions under POPs Convention</header> 
<paragraph id="H7FECBDEF0D4B4774AE7560DB8493D71B"><enum>(1)</enum><header>In general</header><text>The prohibitions specified in subsection (b) shall not apply to any manufacture, processing, distribution in commerce for export, use, or disposal of a POPs chemical substance or mixture that the Administrator (in consultation with the Secretary of State) determines, through final regulations promulgated under subsection (h)—</text> 
<subparagraph id="H84CA4F6A1BFE423293F75EB4F745D6A1"><enum>(A)</enum><text>is consistent with—</text> 
<clause id="H16F4DDA674DB4AE3AFCDC3DF1FED58AE"><enum>(i)</enum><text>a production or use specific exemption applicable to the United States under Annex A or B to the POPs Convention; or</text></clause> 
<clause id="H8ECD068483824CC0854375CE96D51EA9"><enum>(ii)</enum><text>an acceptable purpose applicable to the United States under Annex B to the POPs Convention; and</text></clause></subparagraph> 
<subparagraph id="H9D03984AD2D94B9097DC005E14BE3E09"><enum>(B)</enum><text>would, as a result, not prevent the United States from complying with the obligations of the United States under the POPs Convention.</text></subparagraph></paragraph> 
<paragraph id="HC68AFC3ACF9A4953B71EF19BB31615CB"><enum>(2)</enum><header>Unintentional trace contaminants</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any quantity of a POPs chemical substance or mixture that occurs as an unintentional trace contaminant in a product or article.</text></paragraph> 
<paragraph id="H61069EFE204E4DD48DA3F1375DA510F6"><enum>(3)</enum><header>Research</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any quantity of a POPs chemical substance or mixture that is used for laboratory scale research or as a reference standard.</text></paragraph> 
<paragraph id="H66DE295A50F54D969BB5BC7DDABBAF9B"><enum>(4)</enum><header>Constituent of Article in use before prohibition applied</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any quantity of a POPs chemical substance or mixture that occurs as a constituent of an article, if—</text> 
<subparagraph id="H9DF3A1736EEC4122B484412FD04DDA24"><enum>(A)</enum><text>the article is manufactured or in use on or before the date of entry into force of the obligation applicable to the POPs chemical substance or mixture; and</text></subparagraph> 
<subparagraph id="H4CF0F14F9E9E4C7784DC9B32ECEEA58"><enum>(B)</enum><text>the United States has met any applicable requirement of the POPs Convention to notify the Secretariat of the POPs Convention concerning the article.</text></subparagraph></paragraph> 
<paragraph id="HAA81F7068F924AC5B600956B28BF76A7"><enum>(5)</enum><header>Closed-system site-limited intermediate</header> 
<subparagraph id="H64564879FF9E4858A7FA6F27C307355C"><enum>(A)</enum><header>Exemption</header> 
<clause id="H5756FF124D6D4ABBA8E571C600648EAC"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), to the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any quantity of a POPs chemical substance or mixture that is—</text> 
<subclause id="H6B6C7B17092545D9999490A4471D86C6"><enum>(I)</enum><text>manufactured and used as a closed-system site-limited intermediate; and</text></subclause> 
<subclause id="HB6CFE04F93A64020956F04CB1001C055"><enum>(II)</enum><text>chemically transformed in the manufacture of other chemicals that do not exhibit the characteristics of persistent organic pollutants (taking into consideration the criteria in paragraph 1 of Annex D of the POPs Convention).</text></subclause></clause> 
<clause id="H7D8115E039604649B472485819C6A999"><enum>(ii)</enum><header>Conditions</header><text>Clause (i) applies if, before the commencement of the manufacture or use of the POPs chemical substance or mixture, and before the commencement of each 10-year period thereafter—</text> 
<subclause id="HBEF44F617DB344A1B29100057691A503"><enum>(I)</enum><text>any person that desires to invoke the exemption provides to the Administrator information concerning—</text> 
<item id="H26E2776CF07448E285B13C07397980D6"><enum>(aa)</enum><text>the annual total quantity of the POPs chemical substance or mixture anticipated to be manufactured or used or a reasonable estimate of the quantity; and</text></item> 
<item id="HC5667CC0EC0844FB9B7DE310BCF35C00"><enum>(bb)</enum><text>the nature of the closed system site-limited process, including the quantity of any nontransformed and unintentional trace contamination by the POPs chemical substance or mixture that remains in the final product; and</text></item></subclause> 
<subclause id="HA9EE28AC03FC410FB0E2C0A41EEC21A1"><enum>(II)</enum><text>notwithstanding any other provision of law, the Administrator—</text> 
<item id="HC8F6A4DCF2674BCCBAD6A59F21C5E9E6"><enum>(aa)</enum><text>determines, in consultation with the Secretary of State, that the information provided under subclause (I) is complete and sufficient; and</text></item> 
<item id="H964BF28C15ED4C8BA95935B307EC41CA"><enum>(bb)</enum><text>transmits the information to the Secretariat of the POPs Convention.</text></item></subclause></clause></subparagraph> 
<subparagraph id="H91EF90864B204E9CBB6FAB8148AF1524"><enum>(B)</enum><header>Termination of exemption</header><text>If, at the termination of any 10-year exemption period under subparagraph (A), a particular closed-system site-limited intermediate exemption is no longer authorized for the United States under the POPs Convention, it shall be unlawful for any person to continue to manufacture or use any such POPs chemical substance or mixture as a closed-system site-limited intermediate.</text></subparagraph></paragraph> 
<paragraph id="HF861583AA13740ED00E1ABAA9FA1592B"><enum>(6)</enum><header>Distribution in commerce for export if production or use specific exemption or acceptable purpose is in effect</header> 
<subparagraph id="H4EC6CAB9D45E425489E100315098FD78"><enum>(A)</enum><header>In general</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any distribution in commerce for export of any POPs chemical substance or mixture for which a production or use specific exemption under Annex A to the POPs Convention applicable to the United States is in effect, or for which a production or use specific exemption or acceptable purpose under Annex B to the POPs Convention applicable to the United States is in effect, unless the POPs chemical substance or mixture does not comply with an export condition described in—</text> 
<clause id="H8C5B2024F2E24545BE68DC786B9438CC"><enum>(i)</enum><text>subparagraph (B), as determined by the Administrator in consultation with the heads of other interested Federal agencies; or</text></clause> 
<clause id="HA930B0B934024302BE511DC17C45E136"><enum>(ii)</enum><text>subparagraph (C) or (D), as determined by the Administrator in consultation with the heads of other interested Federal agencies, the Secretary of State, and the United States Trade Representative.</text></clause></subparagraph> 
<subparagraph id="H25532FADBFDE449685A1DB6FC5B33F85"><enum>(B)</enum><header>Export for environmentally sound disposal</header><text>An export condition referred to in subparagraph (A) is that the POPs chemical substance or mixture is exported for the purpose of environmentally sound disposal in accordance with paragraph 1(d) of Article 6 of the POPs Convention.</text></subparagraph> 
<subparagraph id="HAE693CBAB54142B0B07D2449860050A1"><enum>(C)</enum><header>Export to party with permission to use</header><text>An export condition referred to in subparagraph (A) is that the POPs chemical substance or mixture is exported to a party to the POPs Convention that is permitted to use the POPs chemical substance or mixture under Annex A or B to the POPs Convention.</text></subparagraph> 
<subparagraph id="HCB2CE0972BFD4210A182EE93FA63900"><enum>(D)</enum><header>Export to nonparty that has provided nonparty certification</header> 
<clause id="H691F70BD47D54D8A90F57CA6D2CD4391"><enum>(i)</enum><header>In general</header><text>An export condition referred to in subparagraph (A) is that the POPs chemical substance or mixture is exported to an importing foreign state that—</text> 
<subclause id="HD4B5C6A1F3E6425680E8F199F07109CF"><enum>(I)</enum><text>is not a party to the POPs Convention with respect to the POPs chemical substance or mixture; and</text></subclause> 
<subclause id="HBE34046FA0B04368B97C812C6B95D776"><enum>(II)</enum><text>has provided an annual certification to the Administrator.</text></subclause></clause> 
<clause id="H93845215F75947DFA3068793004C599C"><enum>(ii)</enum><header>Commitments by importing nonparty</header><text>Consistent with the POPs Convention, an annual nonparty certification under clause (i) shall specify the intended use of the POPs chemical substance or mixture and state that, with respect to the POPs chemical substance or mixture, the importing nonparty is committed to—</text> 
<subclause id="H13110BC735924858BB74E1DB76B07828"><enum>(I)</enum><text>protecting human health and the environment by taking necessary measures to minimize or prevent releases;</text></subclause> 
<subclause id="HC4C11692C434430800BF7F057E01EFF6"><enum>(II)</enum><text>complying with paragraph 1(d) of Article 6 of the POPs Convention; and</text></subclause> 
<subclause id="H3FEF78F0A69E4B64B679E6AA3FEE14BB"><enum>(III)</enum><text>complying, to the extent appropriate, with paragraph 2 of Part II of Annex B to the POPs Convention.</text></subclause></clause> 
<clause id="H17CA6700B1974668BACDAA128368C600"><enum>(iii)</enum><header>Supporting documentation</header><text>Each nonparty certification shall include any appropriate supporting documentation, such as legislation, regulatory instruments, and administrative or policy guidelines.</text></clause> 
<clause id="H084AE89BDEE44DA3A8E4131B6BFD7529"><enum>(iv)</enum><header>Submission to secretariat of POPs Convention</header><text>Not later than 60 days after the date of receipt of a complete nonparty certification, the Administrator shall submit a copy of the nonparty certification to the Secretariat of the POPs Convention.</text></clause></subparagraph></paragraph> 
<paragraph id="HB9DA34BEFA924AA8B9E1BCEB7507526C"><enum>(7)</enum><header>Export for environmentally sound disposal if no production or use specific exemption in effect</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any distribution in commerce for export for the purpose of environmentally sound disposal, in accordance with paragraph 1(d) of Article 6 of the POPs Convention, of a POPs chemical substance or mixture listed in Annex A to the POPs Convention for which no production or use specific exemption is in effect for any party to the POPs Convention.</text></paragraph> 
<paragraph id="HC8F91BD4AA724215AF97A82C917E3EE5"><enum>(8)</enum><header>Imports for specified purposes</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to a POPs chemical substance or mixture that is imported for the purpose of environmentally sound disposal in accordance with paragraph 1(d) of Article 6 of the POPs Convention.</text></paragraph> 
<paragraph id="HF03E5663D8C94E3F8DEE45FD7F5062B"><enum>(9)</enum><header>Waste</header><text>To the extent consistent with the POPs Convention, the prohibitions specified in subsections (a) and (b) shall not apply to any quantity of a POPs chemical substance or mixture, including any article that consists of, contains, or is contaminated with a POPs chemical substance or mixture, that has become waste and that is managed in a manner consistent with Article 6 of the POPs Convention.</text></paragraph> 
<paragraph id="H394F0FA5F199482890CFF65B1A84157"><enum>(10)</enum><header>No effect on other prohibitions</header><text>Nothing in this subsection authorizes any manufacture, processing, distribution in commerce for export, use, or disposal of a POPs chemical substance or mixture that is prohibited under any other provision of law.</text></paragraph></subsection> 
<subsection id="HC8CE96D900864E1280C209E8C2C7D12F"><enum>(d)</enum><header>Exemptions under LRTAP POPs Protocol</header> 
<paragraph id="H7A5ED9609E9D4AAAB6F53D5507CF3856"><enum>(1)</enum><header>In general</header><text>To the extent consistent with the LRTAP POPs Protocol, the prohibitions on manufacture, processing, distribution in commerce for export, or use specified in subsections (a) and (b) shall not apply to—</text> 
<subparagraph id="HED58928B14A940DD00CB7E8700BEA2C2"><enum>(A)</enum><text>any manufacture, processing, distribution in commerce for export, or use of a LRTAP POPs chemical substance or mixture that the Administrator determines (in consultation with the Secretary of State), through final regulations promulgated in accordance with subsection (h)—</text> 
<clause id="HC3114E1F1C704E78B4B799CFD605B66"><enum>(i)</enum><text>is consistent with an allowed restricted use or condition applicable to the United States under Annex I or II to the LRTAP POPs Protocol; and</text></clause> 
<clause id="H4254DCD123B34743B4AFF473C0F73E52"><enum>(ii)</enum><text>would, as a result, not prevent the United States from complying with the obligations of the United States under the LRTAP POPs Protocol;</text></clause></subparagraph> 
<subparagraph id="HC41D971B6E9B49C58461F3E52B3527EA"><enum>(B)</enum><text>any quantity of a LRTAP POPs chemical substance or mixture that is used for laboratory scale research or as a reference standard;</text></subparagraph> 
<subparagraph id="H459BCA37E10F4C338D5F321952B53196"><enum>(C)</enum><text>any quantity of a LRTAP POPs chemical substance or mixture that occurs as a contaminant in a product;</text></subparagraph> 
<subparagraph id="H47282045D3D64E4CBA6DEA69811273F3"><enum>(D)</enum><text>any quantity of a LRTAP POPs chemical substance or mixture that is in an article manufactured or in use on or before—</text> 
<clause id="H099121EDA5C3452A9B005D99B44D0084"><enum>(i)</enum><text>the implementation date of any applicable obligation of the LRTAP POPs Protocol; or</text></clause> 
<clause id="H58262102422446D0B2A75EA0E177D32B"><enum>(ii)</enum><text>in the case of any LRTAP POPs chemical substance or mixture added to any applicable Annex after the implementation date of the applicable obligation of the LRTAP POPs Protocol, the implementation date in the amendment to the LRTAP POPs Protocol that makes the addition;</text></clause></subparagraph> 
<subparagraph id="H21423EAAFF68452395B0D20640987FEE"><enum>(E)</enum><text>any quantity of a LRTAP POPs chemical substance or mixture that occurs as a site-limited chemical intermediate in the manufacture of 1 or more different substances and that is subsequently chemically transformed;</text></subparagraph> 
<subparagraph id="HCB41F842797749D4B1189CBEC4188242"><enum>(F)</enum><text>the production or use of any quantity of HCH that complies with the restrictions and conditions specified for HCH in Annex II to the LRTAP POPs Protocol;</text></subparagraph> 
<subparagraph id="H15C508EC71514207BAF4484BA20007B0"><enum>(G)</enum><text>any quantity of a LRTAP POPs chemical substance or mixture that has become waste and that is disposed of in an environmentally sound manner in accordance with paragraph 1(b) of Article 3 of the LRTAP POPs Protocol;</text></subparagraph> 
<subparagraph id="HEDC74329F00D4CBC89721EEEA448CDA"><enum>(H)</enum><text>any distribution in commerce for export of a LRTAP POPs chemical substance or mixture if the distribution in commerce for export is conducted in an environmentally sound manner; or</text></subparagraph> 
<subparagraph id="HF8CD35602F174D6BA58B486D6773E551"><enum>(I)</enum><text>any import of a LRTAP POPs chemical substance or mixture if the import is conducted in an environmentally sound manner.</text></subparagraph></paragraph> 
<paragraph id="H3910ACCB96244732AD00B228DBC90C"><enum>(2)</enum><header>Exemptions by Administrator</header><text>The Administrator, in consultation with the Secretary of State, may grant an exemption from the prohibitions applicable to LRTAP POPs chemical substances or mixtures specified in subsection (a) or (b) that the Administrator determines are consistent with the exemptions authorized under paragraph 2 of Article 4 of the LRTAP POPs Protocol.</text></paragraph> 
<paragraph id="H959B8901E3674EFC80DFC594E51750DA"><enum>(3)</enum><header>Exemptions by petition</header> 
<subparagraph id="H60031323CF2E46069CF518F6F71ED405"><enum>(A)</enum><header>Petitions</header><text>A person may petition the Administrator for an exemption from a prohibition applicable to LRTAP POPs chemical substances or mixtures specified in subsection (a) or (b) that is consistent with the exemptions authorized under paragraph 2 of Article 4 of the LRTAP POPs Protocol.</text></subparagraph> 
<subparagraph id="H9118CABE0AB64BB5BA27D61CE04E9B14"><enum>(B)</enum><header>Required elements of petitions</header><text>Any petition under subparagraph (A) shall, at a minimum, contain—</text> 
<clause id="HE41BCB2D82FD4267ABC02F42D378B5B7"><enum>(i)</enum><text>information relating to each finding, if any, that the Administrator is required to make under the LRTAP POPs Protocol before granting the exemption; and</text></clause> 
<clause id="HE0F394C953C442F480CD69EA1001CCBF"><enum>(ii)</enum><text>any additional information, if any, that the Administrator is required to provide to the Secretariat of the LRTAP POPs Protocol concerning a granted exemption.</text></clause></subparagraph> 
<subparagraph id="H38C72CB26ACB4CBD8441E0489FB4466"><enum>(C)</enum><header>Grant or denial of petition</header><text>The Administrator, in consultation with the Secretary of State, shall—</text> 
<clause id="HFE1999EA594D4CD89E1EA2771D3820AB"><enum>(i)</enum><text>if the petition is authorized for the United States under, and is otherwise consistent with, the LRTAP POPs Protocol, grant the petition with such conditions or limitations as are necessary to meet any requirement of the LRTAP POPs Protocol or any other provision of law; or</text></clause> 
<clause id="HA74C7F89C47445C2A9853BCA3B0F104"><enum>(ii)</enum><text>deny the petition.</text></clause></subparagraph></paragraph> 
<paragraph id="H61B70C59E7EE431F8D44006EB8BF0056"><enum>(4)</enum><header>Provision of information to secretariat</header><text>Notwithstanding any other provision of law, if the Administrator grants an exemption under this subsection, the Administrator, not later than 90 days after the date on which the exemption is granted, shall provide the Secretariat of the LRTAP POPs Protocol with the information specified in paragraph 3 of Article 4 of the LRTAP POPs Protocol.</text></paragraph> 
<paragraph id="HE64D58624172424FB59FD2D77FC5C3CF"><enum>(5)</enum><header>Disallowance of exemption by LRTAP POPs Protocol</header> 
<subparagraph id="HA83925C26EDB444781F591E7B92CE11C"><enum>(A)</enum><header>In general</header><text>If, after an exemption has been granted under this subsection, the exemption is no longer authorized by the United States under the LRTAP POPs Protocol, it shall be unlawful for any person to manufacture, process, distribute in commerce for export, or use a LRTAP POPs chemical substance or mixture in the manner authorized by the exemption.</text></subparagraph> 
<subparagraph id="H561FEF7E91084EE2996E65D45D58C7CE"><enum>(B)</enum><header>Publication of notice in Federal Register</header><text>The Administrator shall publish in the Federal Register a notice announcing the disallowance of any exemption under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H685609A9BC6644FC929300A04941CC7B"><enum>(6)</enum><header>No effect on other prohibitions</header><text>Nothing in this subsection authorizes any manufacture, processing, distribution in commerce for export, use, or disposal of a LRTAP POPs chemical substance or mixture that is prohibited under any other provision of law.</text></paragraph></subsection> 
<subsection id="H456F7D7651784C208FA57E3C89B71793"><enum>(e)</enum><header>Notice after decision that screening criteria are met under POPs Convention or after risk profile submitted under LRTAP POPs Protocol</header> 
<paragraph id="HC2185D4588C94AD992AA00A4009773A4"><enum>(1)</enum><header>Applicability</header><text>This subsection applies if—</text> 
<subparagraph id="H9DE19C40F9DF429D94D7C591B4A0A12D"><enum>(A)</enum><text>the POPs Review Committee or Conference decides—</text> 
<clause id="H95AA017D920B4651A9A3C1AB2C0891EB"><enum>(i)</enum><text>under paragraph 4(a) of Article 8 of the POPs Convention, that a proposal for listing a chemical substance or mixture in Annex A, B, or C to the POPs Convention fulfills the screening criteria specified in Annex D to the POPs Convention; or</text></clause> 
<clause id="HBA5D8372B66A4EE19C9DDB001FD1F8A5"><enum>(ii)</enum><text>under paragraph 5 of Article 8 of the POPs Convention, that such a proposal shall proceed; or</text></clause></subparagraph> 
<subparagraph id="H226B4629FA704430A100C8D85348E62E"><enum>(B)</enum><text>if a party to the LRTAP POPs Protocol submits to the Executive Body a risk profile in support of a proposal to list a chemical substance or mixture in Annex I, II, or III to the LRTAP POPs Protocol.</text></subparagraph></paragraph> 
<paragraph id="H1F95EC0FFF114CB48588C3A89890C903"><enum>(2)</enum><header>Requirement</header><text>Not later than 45 days after the date of the POPs Review Committee or Conference decision on a proposal or the submission of a risk profile in support of a proposal under the LRTAP POPs Protocol described in subparagraph (A) or (B) of paragraph (1), respectively, the Administrator shall—</text> 
<subparagraph id="HA183CBF595F342149B7EFA7012A526D2"><enum>(A)</enum><text>publish in the Federal Register a notice of the proposal; and</text></subparagraph> 
<subparagraph id="HBFF3FCAA2D214F319BB04231B849CFB"><enum>(B)</enum><text>provide opportunity for comment on the proposal.</text></subparagraph></paragraph> 
<paragraph id="H561829C0612641859375B7FFAE1DE27E"><enum>(3)</enum><header>Required elements of notice</header><text>A notice under paragraph (2) shall—</text> 
<subparagraph id="HC36A6E7C565F4794B4B18FFEE51490C6"><enum>(A)</enum><text>identify the chemical substance or mixture that is the subject of the proposal;</text></subparagraph> 
<subparagraph id="H19DA97792F764DD798B7EB669CE4FDFE"><enum>(B)</enum><text>include a summary of the process under the POPs Convention or the LRTAP POPs Protocol for submission of a proposal and listing of a chemical substance or mixture that is the subject of a proposal (including criteria applied in that process);</text></subparagraph> 
<subparagraph id="H9145546468254C3391891E8C1CA1D48C"><enum>(C)</enum><text>include a summary of the POPs Review Committee or Conference decision and the basis for the decision;</text></subparagraph> 
<subparagraph id="H2350973E414442BF9F4790EAA053F628"><enum>(D)</enum><text>request information relevant to and comment on—</text> 
<clause id="HA3370C4E093A490B82B37FA7B891FEF"><enum>(i)</enum><text>in the case of a chemical substance or mixture proposed for listing in an Annex to the POPs Convention, the information requirements and screening criteria elements covered under Annex D to the POPs Convention; and</text></clause> 
<clause id="H8FF06C6E416148D1B38838D29397FC26"><enum>(ii)</enum><text>in the case of a chemical substance or mixture proposed for listing in an Annex to the LRTAP POPs Protocol, the information referenced in paragraph 6(a) of Article 14 of the LRTAP POPs Protocol;</text></clause></subparagraph> 
<subparagraph id="HD7B7015E720A497EAFD5D67546DDCE4F"><enum>(E)</enum><text>request the information required under paragraph (4);</text></subparagraph> 
<subparagraph id="H9275A77507924D1F8127CB600BB0070"><enum>(F)</enum><text>include any other information that the Administrator considers to be relevant to the proposal; and</text></subparagraph> 
<subparagraph id="H30ADD6E7DF4F4FA38640A448269F5CF8"><enum>(G)</enum><text>request information and comment on—</text> 
<clause id="H2C0DD5D0B9D745D0A89DFB33761C62D4"><enum>(i)</enum><text>information relevant to the risk profile of the POPs Review Committee covered under Annex E to the POPs Convention; and</text></clause> 
<clause id="H18BF987289D64682A57EA50933EB6528"><enum>(ii)</enum><text>information relevant to any technical review conducted under paragraph 2 of Executive Body decision 1998/2.</text></clause></subparagraph></paragraph> 
<paragraph id="H9A281A71F96F462CBBC66995754F4091"><enum>(4)</enum><header>Provision of information</header> 
<subparagraph id="HC810AB4557A24589BDB8AA4DC52599C3"><enum>(A)</enum><header>Provision of information under POPs Convention</header><text>Not later than 60 days after the date of publication of the notice under paragraph (2) regarding a proposal to list a chemical substance or mixture on an Annex of the POPs Convention, any person that manufactures, processes, distributes in commerce for export, or disposes of a chemical substance or mixture that is the subject of the notice shall provide (and any other interested person may provide) to the Administrator information (to the extent the information is known or readily obtainable to the person) on—</text> 
<clause id="HF9EE0AD75BFD404FA1D2EE001961FB00"><enum>(i)</enum><text>the annual quantity of the chemical substance or mixture that the person manufactures and the locations of the manufacture;</text></clause> 
<clause id="H48C36A30F9BB4F72A57564933866C8D7"><enum>(ii)</enum><text>the uses of the chemical substance or mixture;</text></clause> 
<clause id="H5D83BAC8BBA244CEA55BFDAC6D5D015"><enum>(iii)</enum><text>the approximate annual quantity of the chemical substance or mixture that the person releases into the environment; and</text></clause> 
<clause id="H7B9DC76C6A3040ECA1F17D345DAAF4CF"><enum>(iv)</enum><text>other information or monitoring data relating to the chemical substance or mixture that is consistent with the information specified in paragraph 1 of Annex D, and subsections (b) through (e) of Annex E, to the POPs Convention.</text></clause></subparagraph> 
<subparagraph id="H76C4975B079649C4A48FEC9B14B19BAA"><enum>(B)</enum><header>Provision of information under LRTAP POPs Protocol</header><text>Not later than 60 days after the date of publication of the notice under paragraph (2) regarding a proposal to list a chemical substance or mixture on an Annex of the LRTAP POPs Protocol, any person that manufactures, processes, distributes in commerce for export, or disposes of a chemical substance or mixture that is the subject of the notice shall provide (and any other interested person may provide) to the Administrator information (to the extent the information is known or readily obtainable to the person) on—</text> 
<clause id="H353A81D595C043A3A9CEEA24A1AAB92B"><enum>(i)</enum><text>the potential for long-range transboundary atmospheric transport of the chemical substance or mixture;</text></clause> 
<clause id="HDFF4AA039A28460489A0716787AE33F8"><enum>(ii)</enum><text>the toxicity of the chemical substance or mixture;</text></clause> 
<clause id="HAA5005BCF5AC4F23B597555D066BF0B8"><enum>(iii)</enum><text>the persistence of the chemical substance or mixture, including biotic degradation processes and rates and degradation products;</text></clause> 
<clause id="HCA385A024A81463EB96CD7D3C2FF2FB"><enum>(iv)</enum><text>the bioaccumulation of the chemical substance or mixture, including bioavailability;</text></clause> 
<clause id="H6F505DDF92174733B19B002862D4F55"><enum>(v)</enum><text>the annual quantity of the chemical substance or mixture that the person manufactures and the locations of the manufacture;</text></clause> 
<clause id="H5BA1CE46AB284826969DDAC909B4FA8D"><enum>(vi)</enum><text>the uses of the chemical substance or mixture;</text></clause> 
<clause id="HDAA4C380396246A4BDC1000068C5A38B"><enum>(vii)</enum><text>the approximate annual quantity of the chemical substance or mixture that the person releases into the environment;</text></clause> 
<clause id="HE2C0388C01DE4C8CA7555F2212AB0053"><enum>(viii)</enum><text>environmental monitoring data relating to the chemical substance or mixture (in areas distant from sources);</text></clause> 
<clause id="HD5DE28427112494C9DE1020764DE9C58"><enum>(ix)</enum> 
<subclause display-inline="yes-display-inline" id="H49F68B35BB8D441DBAE588FC82DF3C60"><enum>(I)</enum><text>information on alternatives to the uses of the chemical substance or mixture and the efficacy of each alternative; and</text></subclause> 
<subclause indent="up1" id="HA2A1F522D5DB4609AD30F25200213CE2"><enum>(II)</enum><text>information on any known adverse environmental or human health effects associated with each alternative;</text></subclause></clause> 
<clause id="H8C605E5A8A2E425A8B8DD1F843993F1"><enum>(x)</enum><text>information on—</text> 
<subclause id="H136C24F5736544C5B31CEF12E98F4727"><enum>(I)</enum><text>process changes, control technologies, operating practices, and other pollution prevention techniques that can be used to reduce the emissions of the chemical substance or mixture; and</text></subclause> 
<subclause id="H29F95BDCAEB44411A57EC4E7C368F5B1"><enum>(II)</enum><text>the applicability and effectiveness of each technique described in subclause (I); and</text></subclause></clause> 
<clause id="H8D858E98174541269D339F63E1B26848"><enum>(xi)</enum><text>information on the nonmonetary costs and benefits and the quantifiable costs and benefits associated with the use of each alternative described in clause (ix) or technique described in clause (x)(I).</text></clause></subparagraph> 
<subparagraph id="H7F774A7219674393AA34D03ECA5CE43"><enum>(C)</enum><header>Updating of information</header> 
<clause id="H4F961F33E40E448686435EE9A1005D25"><enum>(i)</enum><header>Voluntary updates</header><text>Any person that submits information under subparagraph (A) or (B) may voluntarily update the information at any time.</text></clause> 
<clause id="H4908A8FF28F44EDCB7CBF5419B2D0620"><enum>(ii)</enum><header>Required updates</header><text>If the Administrator determines, in consultation with the Secretary of State, that an update of information submitted under subparagraph (A) or (B) is necessary, the Administrator may, through a notice published in the Federal Register, require 1 or more persons that are required to submit the information to update the information.</text></clause> 
<clause id="HC6087D7795BC4CD586D6ABB390F87141"><enum>(iii)</enum><header>New information</header><text>The Administrator may require, by general order published in the Federal Register or otherwise, any person that (after the date under subparagraphs (A) and (B) by which persons are required to submit information) commences manufacturing, processing, distributing in commerce for export, or disposing of a chemical substance or mixture subject to the requirements in subparagraph (A) or (B), to submit the information required to be submitted under subparagraph (A) or (B).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H7EDAEAAA243A44108B15D11CA89654E4"><enum>(f)</enum><header>Notice after decision that global action warranted under POPs Convention or that further consideration of Chemical substance or mixture warranted under LRTAP POPs Protocol</header> 
<paragraph id="HDA57B4AC840B461492317774122D178C"><enum>(1)</enum><header>Applicability</header><text>This subsection applies if—</text> 
<subparagraph id="H5DB4952CC5834549A5DD0081A615EBB1"><enum>(A)</enum><text>the POPs Review Committee decides, under paragraph 7(a) of Article 8 of the POPs Convention, that global action is warranted with respect to the chemical substance or mixture that is the subject of the proposal, or the Conference decides, under paragraph 8 of that Article, that the proposal shall proceed; or</text></subparagraph> 
<subparagraph id="H454D2354D4F1439F81004DBC58C4B94"><enum>(B)</enum><text>the Executive Body determines pursuant to paragraph 2 of Executive Body Decision 1998/2 that further consideration of the chemical substance or mixture is warranted, and therefore requires 1 or more technical reviews of the proposal.</text></subparagraph></paragraph> 
<paragraph id="HCFA5882EB1814ABCB3C747DE87BA86EB"><enum>(2)</enum><header>Notice</header><text>Not later than 45 days after the date on which a decision or determination is made under paragraph (1), the Administrator shall—</text> 
<subparagraph id="H90770FC8A3204D5F9E72C0B9BE87A11F"><enum>(A)</enum><text>publish in the Federal Register a notice of the decision or determination; and</text></subparagraph> 
<subparagraph id="H01665CAAA7334A849BEA662929DC5DE3"><enum>(B)</enum><text>provide opportunity for comment on the decision or determination.</text></subparagraph></paragraph> 
<paragraph id="H66B7A23BE138454FA680530047FA72A5"><enum>(3)</enum><header>Required elements of notice</header><text>A notice under paragraph (1) shall—</text> 
<subparagraph id="H7B538AF165624311A5B6A238471EBFC4"><enum>(A)</enum><text>identify the chemical substance or mixture that is the subject of the proposal;</text></subparagraph> 
<subparagraph id="HAD6B79C85E534FA3AD6B14AFD45BD587"><enum>(B)</enum><text>include a summary of—</text> 
<clause id="HC0339348450D45B08F32C29807C3765D"><enum>(i)</enum><text>the POPs Review Committee or Conference decision and the basis for the decision; or</text></clause> 
<clause id="HC2F39922F413417300AD73129EAB45EF"><enum>(ii)</enum><text>the Executive Body determination and basis for the determination;</text></clause></subparagraph> 
<subparagraph id="H6BD6DAFE5A43406B9DBA665538F180C"><enum>(C)</enum><text>request information and comment on—</text> 
<clause id="HD35AC8B691814A2D9B43E24D47EFA8D"><enum>(i)</enum><text>in the case of a chemical substance or mixture proposed for addition to an Annex of the POPs Convention—</text> 
<subclause id="H95F3F4F9374D483D86701C6C61D3EEFA"><enum>(I)</enum><text>information on socioeconomic considerations covered under Annex F to the POPs Convention; and</text></subclause> 
<subclause id="H2995858A3AA04880A40009DDA419A44E"><enum>(II)</enum><text>information on socioeconomic considerations covered under Annex F to the POPs Convention applicable to the range of possible prohibitions described in subparagraph (E), including the impact of the chemical substance or mixture on minority and low-income populations; and</text></subclause></clause> 
<clause id="H5CADFC3A64F3463EA8D67C4988526E62"><enum>(ii)</enum><text>in the case of a chemical substance or mixture proposed for listing on an Annex to the LRTAP POPs Protocol, information on—</text> 
<subclause id="H7C4DDC96F20D41E3A1C1E8184EBBD07"><enum>(I)</enum><text>any additional measures not described in the notice published under subparagraph (E) that may exist to reduce the risks of adverse effects on human health or the environment that result from the long-range transboundary atmospheric transport of the chemical substance or mixture; and</text></subclause> 
<subclause id="HE37E552FD0CE47AEB3F2155521653D2C"><enum>(II)</enum><text>the feasibility of any of the additional measures or the measures outlined in the notice published pursuant to subparagraph (E);</text></subclause></clause></subparagraph> 
<subparagraph id="HF2F8A712B7794928A7907667E9E66BF4"><enum>(D)</enum><text>request information on any current or anticipated production or use of the chemical substance or mixture that is the subject of the proposal for which the United States may wish to—</text> 
<clause id="HAF531E7C4839426EB326478637889B00"><enum>(i)</enum><text>seek an exemption or acceptable purpose under the POPs Convention; or</text></clause> 
<clause id="H4EDB6BF9E4064FDA8B203304162CFF8E"><enum>(ii)</enum><text>allow a restricted use or condition under the LRTAP POPs Protocol;</text></clause></subparagraph> 
<subparagraph id="H6ED510C51FA343BD980121197C2791B4"><enum>(E)</enum><text>describe a broad range of possible prohibitions or restrictions that the United States could impose on the manufacture, processing, distribution in commerce for export, use, or disposal of the chemical substance or mixture to address any risks that the chemical substance or mixture may pose; and</text></subparagraph> 
<subparagraph id="HD9A750A7AEF64003BA84B4C63197D429"><enum>(F)</enum><text>specify what changes, if any, to the regulatory requirements and risk management measures applicable to the chemical substance or mixture in the United States have been made since the date of publication of the notice under subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H4289109EFF04438DBB986DBE347093D5" display-inline="no-display-inline"><enum>(4)</enum><header>Provision of information</header><text>Not later than 60 days after the date of publication of the notice under paragraph (2), any person that manufactures, processes, distributes in commerce for export, or disposes of a chemical substance or mixture that is the subject of the notice shall provide (and any other interested party may provide) to the Administrator—</text> 
<subparagraph id="H2B0C82436C304EEAAFF24EE4379E47F0"><enum>(A)</enum><text>consistent with the information needs described in Annex F to the POPs Convention, any information that the person believes is relevant to—</text> 
<clause id="HFA7F8FC5A1A541FF90F676211D7407BB"><enum>(i)</enum><text>a risk management evaluation carried out under paragraph 7 of Article 8 of the POPs Convention; or</text></clause> 
<clause id="H2F60D84FE67F41AD9272FFADD3003461"><enum>(ii)</enum><text>a decision by the Conference under paragraph 9 of Article 8 of the POPs Convention;</text></clause></subparagraph> 
<subparagraph id="HD7236BF1A31747AF9950E3BA52C7FCF0"><enum>(B)</enum><text>consistent with the information needs for the technical review described in paragraph 2 of Executive Body Decision 1998/2, any information the person believes is relevant to the technical review or to an Executive Body decision made under paragraph 3 of Article 14 of the LRTAP POPs Protocol; and</text></subparagraph> 
<subparagraph id="H283DB695013D490491B21DAFF428848"><enum>(C)</enum><text>information on any article in use that consists of, contains, or is contaminated with the chemical substance or mixture.</text></subparagraph></paragraph></subsection> 
<subsection id="H3942EFC25B4E4638ACC479EA2621CDF5"><enum>(g)</enum><header>Notice after recommendation that Conference consider listing or after completion of technical review</header> 
<paragraph id="HB0B019E08C614705AF9CDB3000AF5EFB"><enum>(1)</enum><header>Applicability</header><text>This subsection applies—</text> 
<subparagraph id="HB85103E6D53B418C9B14753409EF1600"><enum>(A)</enum><text>if the POPs Review Committee recommends, under paragraph 9 of Article 8 of the POPs Convention, that the Conference consider making a Conference listing decision with respect to the chemical substance or mixture in accordance with the proposal; or</text></subparagraph> 
<subparagraph id="H4BC77A1413F841CCB44C3B08D9283F2E"><enum>(B)</enum><text>after completion of a technical review of a proposal to list a chemical substance or mixture on an Annex of the LRTAP POPs Protocol.</text></subparagraph></paragraph> 
<paragraph id="HB69BC2B7D68F4F6BBA005B9DF1FA3766"><enum>(2)</enum><header>Notice</header><text>Not later than 45 days after the date on which a recommendation under paragraph (1) is made or a technical review described in paragraph (1) is completed, the Administrator shall—</text> 
<subparagraph id="HDBA9FF70AD2F404BBA17461D17FD53E8"><enum>(A)</enum><text>publish in the Federal Register a notice of the recommendation or completion of the technical review; and</text></subparagraph> 
<subparagraph id="HB5B97FEFAABB4F01A37D5D04813E3C08"><enum>(B)</enum><text>provide opportunity for comment on the recommendation or the technical review.</text></subparagraph></paragraph> 
<paragraph id="HA7B79BD9DE57401800FEA9B3E1F0896"><enum>(3)</enum><header>Required elements</header><text>A notice under paragraph (2) shall—</text> 
<subparagraph id="H9E1AA73726A748E896C9EE68142CF3"><enum>(A)</enum><text>include a summary of the POPs Review Committee recommendation and the basis for the recommendation or a summary of the technical review; and</text></subparagraph> 
<subparagraph id="H8461186B98764577BA230515126DDEE9"><enum>(B)</enum><text>summarize any control measures for the chemical substance or mixture that are identified by the POPs Review Committee or in the technical review.</text></subparagraph></paragraph></subsection> 
<subsection id="HDAFD132011CC442395E4831867CD7EC1" display-inline="no-display-inline"><enum>(h)</enum><header>Chemical substance or mixture subsequently listed under POPs Convention or LRTAP POPs Protocol</header> 
<paragraph id="H89E34B7D00FC4B1F969FE14767171C73"><enum>(1)</enum><header>Regulations</header><text>If the Conference decides to list a chemical substance or mixture in Annex A or B to the POPs Convention, or if the parties to the LRTAP POPs Protocol decide to list a chemical substance or mixture in Annex I or II to the LRTAP POPs Protocol, the Administrator shall—</text> 
<subparagraph id="HAF9A1188A0724DF2A6666B926805554C"><enum>(A)</enum><text display-inline="yes-display-inline">not more than 1 year after the date of such decision, publish in the Federal Register—</text> 
<clause id="HA1CA85648EC745FD9F843C6BC0903578"><enum>(i)</enum><text display-inline="yes-display-inline">a proposed rule, to prohibit or restrict the domestic manufacture, processing, distribution in commerce for export, use, or disposal of the additional chemical substance or mixture, that protects against significant adverse human health and environmental effects from such domestic manufacture, processing, distribution in commerce for export, use, or disposal associated with the chemical substance or mixture (including, as the Administrator considers appropriate, effects from long-range environmental transport), which at a minimum implements the control measures specified for the chemical substance or mixture in Annex A and B of the POPs Convention and Annex I and II to the LRTAP POPs Protocol;</text></clause> 
<clause id="H0924E76C153242B0B181A71CE5425E89"><enum>(ii)</enum><text display-inline="yes-display-inline">a statement that—</text> 
<subclause id="HC316DE8F53A24C81A1853F4800AF2900"><enum>(I)</enum><text display-inline="yes-display-inline">a proposed rule has been issued under other Federal law to prohibit or restrict the domestic manufacture, processing, distribution in commerce for export, use, or disposal of the additional chemical substance or mixture, which at a minimum implements the control measures specified for the chemical substance or mixture in Annex A and B of the POPs Convention and Annex I and II to the LRTAP POPs Protocol; and</text></subclause> 
<subclause id="H9061946D90BD4752BB00657CC90278AB"><enum>(II)</enum><text display-inline="yes-display-inline">a final rule pursuant to that proposed rule will be issued not more than 2 years after the date of the publication of the proposed rule;</text></subclause></clause> 
<clause id="HC9EFFB42001F49E78F6E3C3487FC5CC5"><enum>(iii)</enum><text display-inline="yes-display-inline">a statement that additional regulation is not necessary because the additional chemical substance or mixture is already regulated in the United States in a manner that at a minimum implements the control measures specified for the chemical substance or mixture in Annex A and B of the POPs Convention and Annex I and II to the LRTAP POPs Protocol; or</text></clause> 
<clause id="HFD824F96820343748DCD25E601DAAE6D"><enum>(iv)</enum><text display-inline="yes-display-inline">a proposed decision not to prohibit or restrict the domestic manufacture, processing, distribution in commerce for export, use, or disposal of the additional chemical substance or mixture because the chemical substance or mixture is not likely to lead to significant adverse human health or environmental effects from such domestic manufacture, processing, distribution in commerce for export, use, or disposal (including, as the Administrator considers appropriate, effects from long-range environmental transport); and</text></clause></subparagraph> 
<subparagraph id="HD3327AF0819D4CDD8BA6BFA8B08FDC6B"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 2 years after the date of a proposed rule or decision under subparagraph (A), publish in the Federal Register—</text> 
<clause id="H2D59C05EFFAE45489D77EA17003E534C"><enum>(i)</enum><text display-inline="yes-display-inline"> a final rule, to prohibit or restrict the domestic manufacture, processing, distribution in commerce for export, use, or disposal of the additional chemical substance or mixture, that protects against significant adverse human health and environmental effects from such domestic manufacture, processing, distribution in commerce for export, use, or disposal associated with the chemical substance or mixture (including, as the Administrator considers appropriate, effects from long-range environmental transport), which at a minimum implements the control measures specified for the chemical substance or mixture in Annex A and B of the POPs Convention and Annex I and II to the LRTAP POPs Protocol;</text></clause> 
<clause id="HA87567CB0AFF434DB0DC12C380E3CA9D"><enum>(ii)</enum><text display-inline="yes-display-inline">a final rule, issued under other Federal law, to prohibit or restrict the domestic manufacture, processing, distribution in commerce for export, use, or disposal of the additional chemical substance or mixture, which at a minimum implements the control measures specified for the chemical substance or mixture in Annex A and B of the POPs Convention and Annex I and II to the LRTAP POPs Protocol; or</text></clause> 
<clause id="HC9E21352CF024F9C9600BE56396F6F8D"><enum>(iii)</enum><text display-inline="yes-display-inline">a final decision not to prohibit or restrict the domestic manufacture, processing, distribution in commerce for export, use, or disposal of the additional chemical substance or mixture because the chemical substance or mixture is not likely to lead to significant adverse human health or environmental effects from such domestic manufacture, processing, distribution in commerce for export, use, or disposal (including, as the Administrator considers appropriate, effects from long-range environmental transport).</text></clause><continuation-text continuation-text-level="paragraph">A decision made under subparagraph (B)(ii) shall not prohibit the Administrator from issuing at a later date a final rule described in subparagraph (B)(i) with respect to the chemical substance or mixture. A final rule described in subparagraph (B)(i) or (ii) shall not take effect unless the United States has consented to be bound by the listing of the chemical substance or mixture with respect to which the final rule applies.</continuation-text></subparagraph></paragraph> 
<paragraph id="HA4368B3054444DFE9EAF5C794C0F303" display-inline="no-display-inline"><enum>(2)</enum><header>Judicial review</header> 
<subparagraph id="HBDA1329F48A9439BAAECCB503ADEA4B"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date of publication of a final rule or decision under paragraph (1)(B), any person may file a petition for judicial review of the rule or decision with—</text> 
<clause id="H0C5B839FF64F4820B22163CEB54FE11C"><enum>(i)</enum><text>the United States Court of Appeals for the District of Columbia; or</text></clause> 
<clause id="H8C57FCB4D1BC44EA93DEC4DF6197A568"><enum>(ii)</enum><text>the United States court of appeals for the circuit in which the person resides or maintains a principal place of business.</text></clause></subparagraph> 
<subparagraph id="H26F6B38E07F6465D931932655CB28C75"><enum>(B)</enum><header>Jurisdiction</header><text>The United States courts of appeals shall have exclusive jurisdiction of any action to obtain judicial review (other than in an enforcement proceeding) of a rule or decision under this subsection if any United States district court would have had jurisdiction of the action but for this paragraph.</text></subparagraph> 
<subparagraph id="H2C1ADF40A85847EF9B00AD760069EF04"><enum>(C)</enum><header>Copies</header><text>The clerk of the court with which a petition is filed under this paragraph shall submit to the Administrator and the Attorney General copies of the petition.</text></subparagraph> 
<subparagraph id="HC61ED3078D0345499CE0D2B6454C746D"><enum>(D)</enum><header>Rulemaking proceedings</header><text>With respect to an action to obtain judicial review under this paragraph, <external-xref legal-doc="usc" parsable-cite="usc/28/2112">section 2112</external-xref> of title 28, United States Code, shall apply to—</text> 
<clause id="HB6CB8CA1F4BE4CA3BBE108E5F91E55ED"><enum>(i)</enum><text>the filing of the record of proceedings for a rulemaking on which the Administrator based the regulation; and</text></clause> 
<clause id="H9A72F2A145E9427D92A27B68438D7FE3"><enum>(ii)</enum><text>any transfer of proceedings between United States courts of appeals.</text></clause></subparagraph> 
<subparagraph id="H85198C0963934F13B28BE584980633B1" display-inline="no-display-inline"><enum>(E)</enum><header>Standard of review</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/706">Section 706</external-xref> of title 5, United States Code, shall apply to the review of a rule or decision under this paragraph.</text></subparagraph> 
<subparagraph id="HF621FB5C65A0467A98B2E0A597C3FAD"><enum>(F)</enum><header>Fees and costs</header><text>The decision of the court in an action commenced under this paragraph, or of the Supreme Court of the United States on review of such a decision, may include an award of costs relating to the action (including reasonable fees for attorneys and expert witnesses) if the court determines that such an award is appropriate.</text></subparagraph> 
<subparagraph id="H2A26CB0F84D24AD298007DB5B7C2B76"><enum>(G)</enum><header>Other remedies</header><text>The remedies provided under this paragraph shall be in addition to and not in lieu of remedies provided under any other provision of law.</text></subparagraph></paragraph> 
<paragraph id="H8A3C962D5FBA477D85B89BB829890168"><enum>(3)</enum><header>Sole procedure</header> 
<subparagraph id="H19D246C9E9B14464B857B44CB96079DC"><enum>(A)</enum><header>In general</header><text>No other rulemaking procedure under this Act shall apply to rules promulgated under this section.</text></subparagraph> 
<subparagraph id="H9085207E23BF4184B2C3E1C072194FB5"><enum>(B)</enum><header>Rulemaking</header><text>Regulations promulgated by the Administrator under this section shall comply with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code (without regard to any reference in that section to sections 556 and 557 of that title).</text></subparagraph></paragraph></subsection> 
<subsection id="HE42B2E9F556845EAAB55AA32B14104A0"><enum>(i)</enum><header>Harmonization of POPs Convention and LRTAP POPs Protocol</header> 
<paragraph id="HB7D6D11F166B40F592CC023157C4487"><enum>(1)</enum><header>In general</header><text>If a chemical substance or mixture is both a POPs chemical substance or mixture and a LRTAP POPs chemical substance or mixture, in the case of a conflict between a provision of this section applicable to a POPs chemical substance or mixture and a provision of this section applicable to a LRTAP POPs chemical substance or mixture, the more stringent provision shall apply, as determined by the Administrator in consultation with the Secretary of State.</text></paragraph> 
<paragraph id="HC2A3442A927E4728A3DC20D2E11239D6"><enum>(2)</enum><header>Application</header><text>In the case of chemical substance or mixture described in paragraph (1), this section shall be applied in such a manner as to ensure that the United States is in compliance with the POPs Convention and the LRTAP POPs Protocol with respect to the chemical substance or mixture.</text></paragraph></subsection> 
<subsection id="HBA7EF07D807D49D08EC403E02F72D029"><enum>(j)</enum><header>Authority to issue regulations</header><text>The Administrator may issue regulations as necessary to implement this section.</text></subsection></section> 
<section id="H8ECA9E9AA136436080FF81D259BE5130"><enum>503.</enum><header>Notice and record of prohibitions, exemptions, disallowances, and other information</header> 
<subsection id="H074DB4F63EE94346A19550374BC53912"><enum>(a)</enum><header>In general</header><text>The Administrator—</text> 
<paragraph id="H5B9971BD91CE4DACBD700723E583D912"><enum>(1)</enum><text>shall publish in the Federal Register timely notice concerning—</text> 
<subparagraph id="HEDE1B85AA8A047E1A670E4D5F152EB4E"><enum>(A)</enum><text>the POPs chemical substances and mixtures, or the LRTAP POPs chemical substances and mixtures, subject to the prohibitions specified in section 502;</text></subparagraph> 
<subparagraph id="H97D20B240222424A91C63801F1E307B0"><enum>(B)</enum><text>any exemptions from the prohibitions authorized under section 502, including the date on which the exemptions are no longer authorized;</text></subparagraph> 
<subparagraph id="H28D30DD6BE5C4DD281C21518E1189200"><enum>(C)</enum><text>in the case of a LRTAP POPs chemical substance or mixture, any disallowances of exemptions under section 502(d)(5); and</text></subparagraph> 
<subparagraph id="H24535633AFDE40E680A87E3F683155F"><enum>(D)</enum><text>in the case of a POPs chemical substance or mixture, a list of any importing foreign states from which the Administrator has received a nonparty certification under section 502(c)(6)(D); and</text></subparagraph></paragraph> 
<paragraph id="H32882D9E23214DA48546F5C138E3347C"><enum>(2)</enum><text>may include in the notice any other information that the Administrator determines to be necessary to ensure adequate notice of the requirements of—</text> 
<subparagraph id="H02354C97BEBD448A80C74E23A8F9CDA"><enum>(A)</enum><text>this title;</text></subparagraph> 
<subparagraph id="H26B51BA75F214285922526146F665610"><enum>(B)</enum><text>the POPs Convention; or</text></subparagraph> 
<subparagraph id="H2BA3922C70DF44549C4C1899E13F5134"><enum>(C)</enum><text>the LRTAP POPs Protocol.</text></subparagraph></paragraph></subsection> 
<subsection id="HF63EBA7F92EF4AF9B969FE5D53975B39"><enum>(b)</enum><header>Updating and availability of record</header><text>The Administrator shall—</text> 
<paragraph id="HD42ACE6EEA6E4D1881BC4F130344C6D8"><enum>(1)</enum><text>update the record as necessary; and</text></paragraph> 
<paragraph id="H45C678B02FCD4586B334E822963BAA08"><enum>(2)</enum><text>make the record publicly available.</text></paragraph></subsection> 
<subsection id="H87E2FC5458AC4361AAAE4611D4950849"><enum>(c)</enum><header>Disclosure of data</header><text>Any information provided to or otherwise obtained by the Administrator (or any representative of the Administrator) under this title shall be subject to section 14 of this Act.</text></subsection></section> 
<section id="H7948A39F8D0E495E8074EAB91FF3E9AC"><enum>504.</enum><header>International conventions and cooperation in international efforts</header><text display-inline="no-display-inline">In cooperation with the Secretary of State and the head of any other appropriate Federal agency, the Administrator shall—</text> 
<paragraph id="HC77402C7150D4535BC4FAA8E89413DF2"><enum>(1)</enum><text>participate and cooperate in any international efforts to develop improved research and regulations on chemical substances and mixtures; and</text></paragraph> 
<paragraph id="H2F81D276DC0048D48B3D9E0495C7AD9E"><enum>(2)</enum><text>participate in technical cooperation and capacity building activities designed to support implementation of—</text> 
<subparagraph id="H5A34C0211A334089BBC00A1A911A6B8"><enum>(A)</enum><text>the LRTAP POPs Protocol;</text></subparagraph> 
<subparagraph id="HB428E92646024D0AB27FE38C6512F4E"><enum>(B)</enum><text>the PIC Convention; and</text></subparagraph> 
<subparagraph id="H73CEA38B7C0D48B79178804457D10099"><enum>(C)</enum><text>the POPs Convention.</text></subparagraph></paragraph></section> 
<section id="HE348AAA4CDD64E81834CA4DDF8C43065"><enum>505.</enum><header>Exports</header> 
<subsection id="H1272FB4D7F6948FFA32EC165A9C8692"><enum>(a)</enum><header>Requirements for exports</header><text>In the case of a chemical substance or mixture identified by the Administrator as listed on Annex III of the PIC Convention in a notice issued under subsection (d)(3), any person that distributes in commerce the chemical substance or mixture for export shall comply with any export conditions or restrictions identified by the Administrator in the notice.</text></subsection> 
<subsection id="H051F48ED6A3E46BFB55D941EFE71C3A8"><enum>(b)</enum><header>Pre-export notices</header> 
<paragraph id="H355EA40E80EC41378D81A9690048B2FB"><enum>(1)</enum><header>In general</header> 
<subparagraph id="HF591E462627448D48DB1F4FBCFF5E606"><enum>(A)</enum><header>Requirement</header><text>In the case of—</text> 
<clause id="H003A96BCA03E4B64BE8D973F9010A04"><enum>(i)</enum><text>a chemical substance or mixture that the Administrator determines under subsection (d)(1) to be banned or severely restricted;</text></clause> 
<clause id="HB62439DA3D144F32B38F024E4D774EF6"><enum>(ii)</enum><text>a chemical substance or mixture identified by the Administrator in a notice issued under subsection (d)(3); or</text></clause> 
<clause id="H4186329D07184347A9466C1690FC716D"><enum>(iii)</enum><text>a POPs chemical substance or mixture allowed to be exported under paragraph (6) or (7) of section 502(c);</text></clause><continuation-text continuation-text-level="subparagraph">the exporter of the chemical substance or mixture shall provide to the Administrator notice of the intent of the exporter to export the chemical substance or mixture.</continuation-text></subparagraph> 
<subparagraph id="H504DC1F90B9948A2AE3D306807F2074F"><enum>(B)</enum><header>Timing of notice for banned or severely restricted Chemical substances or mixtures</header> 
<clause id="H1182EA9A0B8B4B5A92117B3DE3AB5349"><enum>(i)</enum><header>First export</header><text>In the case of a first export that an exporter makes from the territory of the United States to each importing foreign state after the Administrator issues a notice under subsection (d)(1), the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of export.</text></clause> 
<clause id="HED4A37867A4844DF92DD639DF9FE48D2"><enum>(ii)</enum><header>Subsequent exports</header><text>In the case of subsequent exports to the importing foreign state in the calendar year subsequent to the notification provided under clause (i), the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of the first export in each calendar year.</text></clause></subparagraph> 
<subparagraph id="H305FC9B4F60B40F68C68598300A94BC"><enum>(C)</enum><header>Timing of pre-export notice for Chemical substances or mixtures listed on Annex III of the PIC Convention</header> 
<clause id="H25EF1E19D43549F39BD09FA3E06DAB1B"><enum>(i)</enum><header>First export</header><text>In the case of a first export that an exporter makes from the territory of the United States to each importing foreign state after the Administrator notifies the public under subsection (d)(3), the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of export.</text></clause> 
<clause id="H02BFEF30569D416692E9D51D9FCC21FF"><enum>(ii)</enum><header>Subsequent exports</header><text>In the case of subsequent exports by the exporter to the importing foreign state in a calendar year subsequent to the notification provided under clause (i), the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of the first such subsequent export in each calendar year.</text></clause> 
<clause id="HD579C68FB086450F83149904D5419C00"><enum>(iii)</enum><header>Changed circumstances meriting new notice</header><text>If conditions or restrictions imposed by the importing foreign state change and the Administrator notifies the public of the change under subsection (d)(3), or if an earlier pre-export notice no longer applies, the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of export.</text></clause></subparagraph> 
<subparagraph id="HDF4ABEB9A48E4911B276CF08D7A5F2E1"><enum>(D)</enum><header>Timing of pre-export notice for Chemical substances or mixtures allowed to be exported under paragraph (6) or (7) of Section <enum-in-header>502(c)</enum-in-header></header> 
<clause id="H981488FD595148FA9B606C90D3453570"><enum>(i)</enum><header>First export of the calendar year</header><text>In the case of the first export that an exporter makes from the territory of the United States to each importing foreign state of a chemical substance or mixture exported under paragraph (6) or (7) of section 502(c), the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of the first export.</text></clause> 
<clause id="H188DDC650CF7466DB3C6AC25C883B508"><enum>(ii)</enum><header>Subsequent exports</header><text>In the case of subsequent exports by the exporter to the importing foreign state in a calendar year subsequent to the notification provided under clause (i) to the importing foreign state, the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of the first such subsequent export in each calendar year.</text></clause> 
<clause id="H7ACE95150A2B4F1591E0120741EAE228"><enum>(iii)</enum><header>Changed circumstances meriting new notice</header><text>If the information provided in an earlier pre-export notice is no longer accurate, the exporter shall provide the notice so that the Administrator receives the notice not earlier than 30 nor later than 15 calendar days before the date of export.</text></clause></subparagraph></paragraph> 
<paragraph id="H5E95B875EF4D434D86864F3EFFEE594"><enum>(2)</enum><header>Alternate timeframe for notices</header><text>Notwithstanding subparagraphs (B), (C), and (D) of paragraph (1), the Administrator may set an alternate timeframe for providing notices under paragraph (1) if the Administrator determines that such alternate timeframe is appropriate and the Administrator is able, within such alternate timeframe, to administer notice activities in accordance with the PIC Convention and comply with the POPs Convention.</text></paragraph> 
<paragraph id="HB3DB4F97A79C47BCAB0738B6CFDED2DB"><enum>(3)</enum><header>Content of pre-export notices</header> 
<subparagraph id="HD9ABDE16DD784BB9B77E63B300C694A7"><enum>(A)</enum><header>Notices under paragraph <enum-in-header>(1)(B)</enum-in-header></header><text>A notice under paragraph (1)(B) shall include—</text> 
<clause id="H221CA99A3ED84955ABE1FA9816A471DE"><enum>(i)</enum><text>the name and address of the exporter;</text></clause> 
<clause id="H12EFB96B2AE24BDA83B773CDEA36CFBC"><enum>(ii)</enum><text>the name and address of the appropriate designated national authority of the United States;</text></clause> 
<clause id="HD25894F44A7F4651BD81F54385A64E18"><enum>(iii)</enum><text>the name and address of the appropriate designated national authority of the importing foreign state, if available;</text></clause> 
<clause id="HDC9767CC1F404284A50044B43E004F9D"><enum>(iv)</enum><text>the name and address of the importer;</text></clause> 
<clause id="H24577DFD9E0B48B6B38182FBE13771F3"><enum>(v)</enum><text>the name of the chemical substance or mixture for which the notice is required;</text></clause> 
<clause id="H304928CF3B9A46C282274F2980BE8320"><enum>(vi)</enum><text>the expected date of export;</text></clause> 
<clause id="H5BEB6D8A6C3B49EE825492672FA23522"><enum>(vii)</enum><text>any information relating to the foreseen uses of the chemical substance or mixture, if known, in the importing foreign state;</text></clause> 
<clause id="HD9087EE2DD6844419C123B9791A7188D"><enum>(viii)</enum><text>any information on precautionary measures to reduce exposure to, and emission of, the chemical substance or mixture;</text></clause> 
<clause id="H0EDB284EA9CB49BF8F4E708959D204C4"><enum>(ix)</enum><text>any information relating to the concentration of the chemical substance or mixture; and</text></clause> 
<clause id="H4D25B2686BFB41B8ADFA9B4BC3B85992"><enum>(x)</enum><text>any other information specified in Annex V to the PIC Convention.</text></clause></subparagraph> 
<subparagraph id="H9766D74070294C6897F3ACCBDCD66092"><enum>(B)</enum><header>Notices under paragraph <enum-in-header>(1)(C)</enum-in-header></header><text>A notice under paragraph (1)(C) shall include—</text> 
<clause id="HF7BDA3655600417FB47266BDBC7EAC6E"><enum>(i)</enum><text>all of the information required to be included under subparagraph (A);</text></clause> 
<clause id="HD1C3C4198B014357A597D7E7D1059CD1"><enum>(ii)</enum><text>any information relating to export conditions or restrictions identified by the Administrator in the notice issued under subsection (d)(3) with respect to the chemical substance or mixture;</text></clause> 
<clause id="HEF252772E9354D690089C0EF00CB78"><enum>(iii)</enum><text>a general description of the manner in which the export complies with those conditions; and</text></clause> 
<clause id="H9D4E8C700EA741979CB0503B25C5C7D9"><enum>(iv)</enum><text>any other information that the Administrator determines to be necessary for effective enforcement of the export conditions or restrictions applicable to the chemical substance or mixture.</text></clause></subparagraph> 
<subparagraph id="HFC4A25A7E649420486E1B08D5CC5759E"><enum>(C)</enum><header>Notices under paragraph <enum-in-header>(1)(D)</enum-in-header></header><text>A notice submitted to the Administrator under paragraph (1)(D) shall include—</text> 
<clause id="H69A61CA6B8344161B8788D36ACB4F700"><enum>(i)</enum><text>the name and address of the exporter;</text></clause> 
<clause id="H5C42DE8304E34202AFB8EDE3DA630093"><enum>(ii)</enum><text>the name and address of the importer;</text></clause> 
<clause id="H60794602897E43A882C180C699E33246"><enum>(iii)</enum><text>a specification of the identity of the POPs chemical substance or mixture;</text></clause> 
<clause id="HB6F67AC031734FA1BD608C166B1E3126"><enum>(iv)</enum><text>a general description of how the export complies with the conditions under paragraph (6) or (7) of section 502(c); and</text></clause> 
<clause id="H59781718612D40E9B81333388B9F4542"><enum>(v)</enum><text>such other information as the Administrator determines to be necessary for enforcement of the export-related obligations of the POPs Convention applicable to the chemical substance or mixture.</text></clause></subparagraph></paragraph> 
<paragraph id="H6556BE0538A04A42BFCF2903FA7D39D0"><enum>(4)</enum><header>Pre-export notices accompanying each export</header><text>An exporter shall ensure that a copy of the most recent applicable pre-export notice accompanies each shipment for export and is available for inspection upon export from the United States of—</text> 
<subparagraph id="H1E3A4125BFDB475AA16F4115816D2E65"><enum>(A)</enum><text>any chemical substance or mixture that the Administrator has identified under subsection (d)(3) as being listed on Annex III of the PIC Convention; or</text></subparagraph> 
<subparagraph id="H65C87F98AE0747B6AADBEB62C19044C4"><enum>(B)</enum><text>any POPs chemical substance or mixture that is exported under paragraph (6) or (7) of section 502(c).</text></subparagraph></paragraph> 
<paragraph id="H8F67106B5AD14DA28C7422950333D3FB"><enum>(5)</enum><header>Retention of pre-export notices</header><text>An exporter required to provide a notice under subparagraph (C) or (D) of paragraph (1) shall maintain a copy of the notice and other documents used to generate the notice and have it readily available for a period of not less than 3 years beginning on the date on which the notice is provided.</text></paragraph></subsection> 
<subsection id="H42C1B01674A348169CC36BAADFEE6E1E"><enum>(c)</enum><header>Labeling requirements</header> 
<paragraph id="HB1D105DB0DD24C41A6B9383B53713DA3"><enum>(1)</enum><header>In general</header><text>In the case of any chemical substance or mixture that is the subject of a notice issued under paragraph (1) or (3) of subsection (d) and that is manufactured, processed, or distributed in commerce for export, the chemical substance or mixture shall, in accordance with the PIC Convention—</text> 
<subparagraph id="H98CA9AD9FFD2414A90108D411FCFEDE7"><enum>(A)</enum><text>bear labeling information relating to risks or hazards to human health or the environment; and</text></subparagraph> 
<subparagraph id="HCCB1897527BE4E5090D536D57839E7C"><enum>(B)</enum><text>be accompanied by shipping documents that include any relevant safety data sheets on the chemical substance or mixture.</text></subparagraph></paragraph> 
<paragraph id="H7E51DE589A244F2CBDD0214879AC6B37"><enum>(2)</enum><header>Custom codes</header><text>A chemical substance or mixture that is the subject of a notice issued under subsection (d)(3) and that is distributed or sold for export shall be accompanied by shipping documents that bear, at a minimum, any appropriate harmonized system customs codes assigned by the World Customs Organization.</text></paragraph></subsection> 
<subsection id="H6BC8DE138667400CBF20E7AA27068600"><enum>(d)</enum><header>Notice requirements and exemption</header> 
<paragraph id="H644E4B85A970479B9F1E07EB68BD02BC"><enum>(1)</enum><header>Determination whether Chemical substance or mixture is banned or severely restricted</header> 
<subparagraph id="H8085D555C40B41D0B384EE7E9375CF6B"><enum>(A)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary of State, shall determine whether a chemical substance or mixture is banned or severely restricted within the United States (as those terms are defined by the PIC Convention).</text></subparagraph> 
<subparagraph id="H01754D163AC946E5891084270462CBE6"><enum>(B)</enum><header>Notice of determinations</header><text>Notwithstanding any other provision of law, the Administrator shall issue to the Secretariat of the PIC Convention and the public a notice of each determination under subparagraph (A) that includes—</text> 
<clause id="HCF788D6C2CED47D4AB9D43385BF5F55B"><enum>(i)</enum><text>in the case of a notice to the Secretariat of the PIC Convention, the information specified in Annex I to the PIC Convention; and</text></clause> 
<clause id="HEFD0ACAA6F6B4FEBB8D5A89D90791C85"><enum>(ii)</enum><text>in the case of a notice to the public, at a minimum, a summary of that information.</text></clause></subparagraph></paragraph> 
<paragraph id="HCDE1E064F7AD4B168BF7C69EFF1A139"><enum>(2)</enum><header>Notice to foreign countries</header> 
<subparagraph id="HAB746CEF755948E500BF5081A0B118ED"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, on receipt of a notice of intent to export under subsection (b)(1)(B), the Administrator shall provide a copy of the notice to the designated national authority of the importing foreign state.</text></subparagraph> 
<subparagraph id="HE8CB54EC10454859BDDCE71165FBDF5F"><enum>(B)</enum><header>Nonidentified designated national authority</header><text>In a case in which a designated national authority has not been identified, the Administrator shall provide the notice of intent to export to any other appropriate official of the importing foreign state, as identified by the Administrator.</text></subparagraph></paragraph> 
<paragraph id="H04E7D7099704487394BCD7B97FC87624"><enum>(3)</enum><header>Notice to public</header> 
<subparagraph id="H57BD9A5E52784F3684E192311CC7066D"><enum>(A)</enum><header>In general</header><text>The Administrator, in consultation with the Secretary of State, shall issue a notice to inform the public of—</text> 
<clause id="HF1A945603562481CB7F8C900BEFED90"><enum>(i)</enum><text>any chemical substance or mixture that is listed on Annex III to the PIC Convention; and</text></clause> 
<clause id="H12B9C1A3BB6D46CFA1B7F646417DA687"><enum>(ii)</enum><text>any condition or restriction of an importing foreign state that is applicable to the import, in accordance with the PIC Convention, of the chemical substance or mixture.</text></clause></subparagraph> 
<subparagraph id="HA968617179234855B371E4B3B21EB080"><enum>(B)</enum><header>Timing</header><text>A notice required under subparagraph (A) shall be issued not later than 90 days after, and any conditions or restrictions described in subparagraph (A)(ii) shall take effect not later than 180 days after, the date of receipt of a notice from the Secretariat of the PIC Convention who—</text> 
<clause id="HA137BAEEBCE7411096B86EEA00BB4FD8"><enum>(i)</enum><text>transmits import decisions of the parties to the PIC Convention; or</text></clause> 
<clause id="H48A92099C2284EDD8F90556FF991812C"><enum>(ii)</enum><text>provides notice of the failure of the parties to provide import decisions.</text></clause></subparagraph> 
<subparagraph id="H34810182569A48139FA0C72DC59D0945"><enum>(C)</enum><header>Treatment of conditions and restrictions</header><text>A condition or restriction identified by a notice required under subparagraph (A) shall be considered to be an export condition or restriction for the purpose of subsection (a).</text></subparagraph></paragraph> 
<paragraph id="HD8171912AA8E4248AC6249A858E11835"><enum>(4)</enum><header>Notice of exemption</header><text>The Administrator may issue a notice exempting any chemical substance or mixture from the requirements of subsections (a) through (c) and this subsection if the Administrator determines, in consultation with the Secretary of State, that the exemption would be consistent with the PIC Convention.</text></paragraph> 
<paragraph id="HB83659F8B0F34528A47360A31A912B9"><enum>(5)</enum><header>Integration with other notices</header><text>To the maximum extent practicable, the Administrator shall integrate the information contained in any notice issued under this subsection into any notice published under—</text> 
<subparagraph id="H0E656E5BAB9349638D1790FA447CD506"><enum>(A)</enum><text>section 12(b); or</text></subparagraph> 
<subparagraph id="H5881436DDC2C4844A200D1CECB9CAB90"><enum>(B)</enum><text>section 502.</text></subparagraph></paragraph></subsection> 
<subsection id="H2577134BBFC843589F92567E1D05F3F9"><enum>(e)</enum><header>Regulations</header><text>The Administrator may promulgate such regulations as the Administrator determines to be necessary—</text> 
<paragraph id="HAE43F06809A74089BE9B69D314805E99"><enum>(1)</enum><text>to facilitate implementation of this section;</text></paragraph> 
<paragraph id="HB76F3D2C860B4B17BFA94900CFB2569B"><enum>(2)</enum><text>to ensure compliance with the PIC Convention; and</text></paragraph> 
<paragraph id="H9ACB3DFCA66B45178D7BB1A23DDC9109"><enum>(3)</enum><text>to allow the pre-export notice requirement under this section and any pre-export notice requirement in other provisions of this Act or in any other Federal law to be satisfied by a single notice.</text></paragraph></subsection> 
<subsection id="H5B54BB253604443895F0665FE32E1DDB"><enum>(f)</enum><header>Harmonization of POPs Convention and PIC Convention</header> 
<paragraph id="H8CF65C83CA36464C9C07AD3441D6A7C2"><enum>(1)</enum><header>In general</header><text>If the export of a chemical substance or mixture is addressed or restricted under both section 502 and this section, that section and this section shall apply to the chemical substance or mixture.</text></paragraph> 
<paragraph id="H0ED9FF2EDA8C44A98D5CF4D6C98CCB9D"><enum>(2)</enum><header>Conflict</header><text>In the case of a conflict between section 502 and this section with respect to a chemical substance or mixture, the more stringent provision shall govern.</text></paragraph> 
<paragraph id="H5C4D93805D2B4605B8E53D254948A000"><enum>(3)</enum><header>Application</header><text>With respect to a chemical substance or mixture, section 502 and this section shall be applied in such a manner as to ensure that the United States is in compliance with the POPs Convention and the PIC Convention with respect to the chemical substance or mixture.</text></paragraph></subsection></section> 
<section id="H53D6A3D3382749649CB797AE2CB8964C"><enum>506.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Nothing in this title—</text> 
<paragraph id="H7F610A05758B414C879BAAB693BC25ED"><enum>(1)</enum><text>shall be construed to require the United States to register for any specific exemption available to the United States under Annex A or B to the POPs Convention or any acceptable purpose available to the United States under Annex B to the POPs Convention; or</text></paragraph> 
<paragraph id="H415480F98D0A450D80D42C2C7001B92"><enum>(2)</enum><text>affects the authority of the Administrator to regulate a chemical substance or mixture under any other law or any other provision of this Act.</text></paragraph></section> 
<section id="H86303C0597794FCD9C5E7DF419D51D7"><enum>507.</enum><header>Applicability</header><text display-inline="no-display-inline">A requirement of this title that relates to the LRTAP POPs Protocol, the POPs Convention, or the PIC Convention shall be effective only if the United States is a party to such Protocol or Convention.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H5AECCF9D4C30446B82BDCF46886006B6" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Polychlorinated biphenyls (PCBs)</header><text display-inline="no-display-inline">Section 6(e) of the Toxic Substance Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(e)</external-xref>) is amended—</text> 
<paragraph id="H64659BECB8F9465F945DA8ABD5428FA9"><enum>(1)</enum><text>by adding at the end of paragraph (3) the following new subparagraph:</text> 
<quoted-block style="OLC" id="H146AAAA6FDB34B9DA99CC200E74610DA" display-inline="no-display-inline"> 
<subparagraph id="H99F6E3618E8843F68DED25C18600E3B9" indent="up2"><enum>(D)</enum><text>The Administrator may not, after the date of enactment of this subparagraph, grant an exemption under subparagraph (B) unless the manufacturing, processing, or distribution in commerce with respect to which such exemption applies is authorized under section 503(f) or (g), subject to section 503(h).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF9AD096D4BAD44A9AD67EA95004B494B"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="H6D2B00E3337F44DBAFE9843D304785A3" display-inline="no-display-inline"> 
<paragraph id="H9F48C83F2CEF46428659D603FF1A12" indent="up1"><enum>(6)</enum><text>Notwithstanding any other provision of this subsection, no person may distribute in commerce for export equipment (including transformers, capacitors, and other receptacles) containing greater than 0.05 liters of liquid stock that contains greater than 0.005 percent polychlorinated biphenyls, except for the purpose of environmentally sound waste management to the extent that such distribution in commerce for export is authorized by Federal law.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HC5402793120946239DE388B0065B609"><enum>4.</enum><header>Exports</header><text display-inline="no-display-inline">Section 12(a)(1) of the <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/2611">15 U.S.C. 2611(a)(1)</external-xref>) is amended by striking <quote>(other than section 8)</quote> and inserting <quote>(other than section 8 or title V)</quote>.</text></section> 
<section id="HBBCA1BC775EB44659432DD803B671B"><enum>5.</enum><header>Prohibited acts</header><text display-inline="no-display-inline">Section 15 of the <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/2614">15 U.S.C. 2614</external-xref>) is amended to read as follows:</text>

<subparagraph id="H5DCFFA4F7C134AA1A2FF49E21F17F8B2"><enum>(C)</enum><text>any rule promulgated or order issued under section 5 or 6;</text></subparagraph> 
<subparagraph id="H2083420F0E6D4C0C0065BB0029219EA5"><enum>(D)</enum><text>any requirement of title II;</text></subparagraph> 
<subparagraph id="H4139EF72CB9E4E768E4B00A08E5CEC29"><enum>(E)</enum><text>any rule promulgated or order issued under title II;</text></subparagraph> 
<subparagraph id="H2521F55422D3431DBAA367B3A86EDB3D"><enum>(F)</enum><text>any requirement of title V; or</text></subparagraph> 
<subparagraph id="HB7655523024B43E386B2B8FE85563256"><enum>(G)</enum><text>any rule promulgated under title V;</text></subparagraph></paragraph> 
<paragraph id="H075688285B924F949E89597DE6F7539D"><enum>(2)</enum><text>use for commercial purposes a chemical substance or mixture that the person knew or had reason to know was manufactured, processed, or distributed in commerce in violation of—</text> 
<subparagraph id="HBDBA0424B10742D5871328F999BF15A2"><enum>(A)</enum><text>section 5 or 6;</text></subparagraph> 
<subparagraph id="H2368D4E8A60943A68D69285FD6D89CCE"><enum>(B)</enum><text>a rule promulgated or order issued under section 5 or 6; or</text></subparagraph> 
<subparagraph id="H0B3D78076AA841F480F5A7E723EFFB0"><enum>(C)</enum><text>an order issued in a civil action brought under section 5 or 7;</text></subparagraph></paragraph> 
<paragraph id="H716E22C8BB254E1C00A8337ED1ED6E4" display-inline="no-display-inline"><enum>(3)</enum><text>use for commercial purposes a chemical substance or mixture that the person knew or had reason to know was manufactured, processed, distributed in commerce for export, used, or disposed of in violation of—</text>

<subsection id="HB8CC00E1765A4E7B8E848B13BA82D9D0"><enum>(a)</enum><text>Section 11 of the <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/2610">15 U.S.C. 2610</external-xref>) is amended in subsections (a) and (b) by striking <quote>title IV</quote> each place it appears and inserting <quote>title IV or V</quote>.</text></subsection> 
<subsection id="HF9EC669344064D5AAE30C200EC816700"><enum>(b)</enum><text>Section 13(a)(1) of the <act-name parsable-cite="TSCA">Toxic Substances Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/2612">15 U.S.C. 2612(a)(1)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text>
