		<official-title>To facilitate remediation of perchlorate contamination in

		  water sources in the State of California, and for other

		  purposes.</official-title>

		<section display-inline="no-display-inline" id="H12A65FDA880D4E49BAA8DA1B186DD0B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>California Perchlorate Contamination

			 Remediation Act</short-title></quote>.</text>

		</section><section id="H83662B3E0068444782F2C0C871E533E2"><enum>2.</enum><header>Purposes</header>

			<subsection id="HD2B85215F0F2421EBBBF6F56CCC63FA0"><enum></enum><text>The purposes of

			 this Act are—</text>

				<paragraph id="HEA7A20EC175C443E9FC463F3C4F17804"><enum>(1)</enum><text>to provide grants

			 for remediation of perchlorate contamination of water sources and supplies

			 (including wellheads) in the State;</text>

				</paragraph><paragraph id="H85E2538D2A1145FE81E1E7BE0461731B"><enum>(2)</enum><text>to provide grants

			 for research and development of perchlorate remediation technologies;

			 and</text>

				</paragraph><paragraph commented="no" id="H07AE677E989B48D994BEEB2780B441E2"><enum>(3)</enum><text>to express the

			 sense of Congress that the Administrator should establish a national drinking

			 water standard for perchlorate.</text>

				</paragraph></subsection></section><section id="HB438833B0BB44CF794BBC5FD43FB172B"><enum>3.</enum><header>Definitions</header>

			<subsection id="HCE6CD221022C4AFC8F849094C6E25BA1"><enum></enum><text>In this

			 Act:</text>

				<paragraph id="H8CA8979207A04AC9B84F5B5B83E59E8B"><enum>(1)</enum><header>Administrator</header><text>The

			 term <term>Administrator</term> means the Administrator of the Environmental

			 Protection Agency.</text>

				</paragraph><paragraph id="H6BBDF35380F54F6EBA1F93D4381496A5"><enum>(2)</enum><header>California water

			 authority</header><text>The term <term>California water authority</term> means

			 a public water district, public water utility, public water planning agency,

			 municipality, or Indian tribe that is—</text>

					<subparagraph id="H0B8168D8803B4DD68F7FF001B14895D"><enum>(A)</enum><text>located in a region

			 identified under section 4(b)(3)(B); and</text>

					</subparagraph><subparagraph id="HD0EDEA0E2D7443F7A5E719E7641FE9F8"><enum>(B)</enum><text>in operation as of

			 the date of enactment of this Act.</text>

					</subparagraph></paragraph><paragraph id="H229C8AA2D6704647B75FB9AE309CAD8"><enum>(3)</enum><header>Fund</header><text>The

			 term <term>Fund</term> means the California Perchlorate Cleanup Fund

			 established by section 4(a)(1).</text>

				</paragraph><paragraph id="H0C13BE30BFDD4C9B88EA0400A76337BF"><enum>(4)</enum><header>State</header><text>The

			 term <term>State</term> means the State of California.</text>

				</paragraph></subsection></section><section id="H09233FB6508C4570A7A808911FED7DB3"><enum>4.</enum><header>California

			 perchlorate remediation grants</header>

			<subsection id="H52BB96339BB248F8ACDB4B48F4D3E713"><enum>(a)</enum><header>Perchlorate

			 cleanup fund</header>

				<paragraph id="HE23257CF6FA1476BBFB3385115474FB1"><enum>(1)</enum><header>Establishment</header><text>There

			 is established in the Treasury of the United States a fund, to be known as the

			 <quote>California Perchlorate Cleanup Fund</quote>, consisting of—</text>

					<subparagraph id="HB9D1726557924D28B78BA621B5ABE755"><enum>(A)</enum><text>any amount

			 appropriated to the Fund under section 7; and</text>

					</subparagraph><subparagraph id="H2EEE244AA42E4043B6B2E26100EA2782"><enum>(B)</enum><text>any interest

			 earned on investment of amounts in the Fund under paragraph (3).</text>

					</subparagraph></paragraph><paragraph id="H894229D1BF9D47CC8EBC00BD9023DBB3"><enum>(2)</enum><header>Expenditures

			 from Fund</header>

					<subparagraph id="HF9FA9CCCE2604B64896856B842892564"><enum>(A)</enum><header>In

			 general</header><text>Subject to subparagraph (B), on receipt of a request by

			 the Administrator, the Secretary of the Treasury shall transfer to the

			 Administrator such amounts as the Administrator determines to be necessary to

			 provide grants under subsections (b) and (c).</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2CE1FDD63B03440BA9F1CF30006EE6E"><enum>(B)</enum><header>Administrative

			 expenses</header><text>An amount not to exceed 0.4 percent of the amounts in

			 the Fund may be used to pay the administrative expenses necessary to carry out

			 this subsection.</text>

					</subparagraph></paragraph><paragraph id="HFC3566EA751144E3A8A75F6CD573CF73"><enum>(3)</enum><header>Investment of

			 amounts</header>

					<subparagraph id="H5722219BD0B547D5ACBB62D43CAB35F2"><enum>(A)</enum><header>In

			 general</header><text>The Secretary of the Treasury shall invest such portion

			 of the Fund as is not, in the judgment of the Secretary of the Treasury,

			 required to meet current withdrawals.</text>

					</subparagraph><subparagraph id="H3DAB82AA4E2B43BEA43DB2C8AF9415B1"><enum>(B)</enum><header>Interest-bearing

			 obligations</header><text>Investments may be made only in interest-bearing

			 obligations of the United States.</text>

					</subparagraph><subparagraph id="H0AA871F550D248B8A8A02D0085086825"><enum>(C)</enum><header>Acquisition of

			 obligations</header><text>For the purpose of investments under subparagraph

			 (A), obligations may be acquired—</text>

						<clause id="HA88CBCAFC8CA40878529C1EBD9EE5C2"><enum>(i)</enum><text>on

			 original issue at the issue price; or</text>

						</clause><clause id="HDCC350EF4DFA4F27827ED47E6FAE363B"><enum>(ii)</enum><text>by

			 purchase of outstanding obligations at the market price.</text>

						</clause></subparagraph><subparagraph id="H47F7D0C2C3F34AF4B67CAB24696C00C1"><enum>(D)</enum><header>Sale of

			 obligations</header><text>Any obligation acquired by the Fund may be sold by

			 the Secretary of the Treasury at the market price.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3CDF0898D7424173A3D82BD47004BC6"><enum>(E)</enum><header>Credits to

			 Fund</header><text>The interest on, and the proceeds from the sale or

			 redemption of, any obligations held in the Fund shall be credited to and form a

			 part of the Fund.</text>

					</subparagraph></paragraph></subsection><subsection id="HB6B3478D9C124474A393F52F87DE92B"><enum>(b)</enum><header>Cleanup

			 grants</header>

				<paragraph id="H2A4044103C9547B59BF9572B08FD77A9"><enum>(1)</enum><header>In

			 general</header><text>Subject to paragraph (3), the Administrator shall provide

			 grants to California water authorities, the total amount of which shall not

			 exceed $50,000,000, to pay the Federal share of the cost of activities relating

			 to cleanup of water sources and supplies (including wellheads) in the State

			 that are contaminated by perchlorate.</text>

				</paragraph><paragraph id="H734C693372D54BF18E3E43103E9DF3E6"><enum>(2)</enum><header>Federal

			 share</header><text>The Federal share of the cost of an activity described in

			 paragraph (1) shall not exceed 50 percent.</text>

				</paragraph><paragraph id="H1598691664E5490382F98168E6E50564"><enum>(3)</enum><header>Eligibility;

			 priority</header>

					<subparagraph id="HE1A173BD861D40DF00947418335BA661"><enum>(A)</enum><header>Eligibility</header><text>A

			 California water authority that the Administrator determines to be responsible

			 for perchlorate contamination shall not be eligible to receive a grant under

			 this subsection.</text>

					</subparagraph><subparagraph id="HD7AC8B65A6C9473B81A20038CC3FD711"><enum>(B)</enum><header>Priority</header><text>In

			 providing grants under this subsection, the Administrator shall give priority

			 to an activity described in paragraph (1) that is carried out in 1 or more of

			 the following regions in the State:</text>

						<clause id="H2A81A8C00C394105831CE2F915C19DA9"><enum>(i)</enum><text>The

			 Santa Clara Valley.</text>

						</clause><clause id="H5713B6D1B9D6458188615932AC79A38E"><enum>(ii)</enum><text>A

			 region within the natural watershed of the Santa Ana River.</text>

						</clause><clause id="H0232BDE36756469DBBEB7713DFDE4FE1"><enum>(iii)</enum><text>The San Gabriel

			 Valley.</text>

						</clause><clause id="HCA67E6A2FF10412A00015F7136513B00"><enum>(iv)</enum><text>Sacramento

			 County.</text>

						</clause><clause id="H79F561E5477446FCBE1FC2D5BC000726"><enum>(v)</enum><text>Any

			 other region that has a damaged water source as a result of perchlorate

			 contamination, as determined by the Administrator.</text>

						</clause></subparagraph></paragraph></subsection><subsection id="H791BCA034B0347E4B23158AF001224CE"><enum>(c)</enum><header>Research and

			 development grants</header>

				<paragraph id="HA8C6890886F54BDAA7AB71798B7914EB"><enum>(1)</enum><header>In

			 general</header><text>The Administrator shall provide grants, the total amount

			 of which shall not exceed $8,000,000, to qualified non-Federal entities (as

			 determined by the Administrator) for use in carrying out research and

			 development of perchlorate remediation technologies.</text>

				</paragraph><paragraph id="H0B5D53C203AF4EA486FA00547F3CD0FF"><enum>(2)</enum><header>Maximum amount

			 of grant</header><text>The amount of a grant provided under paragraph (1) shall

			 not exceed $1,000,000.</text>

				</paragraph></subsection></section><section id="HEB3AB05EA3D04F94B9D0B180627C3762"><enum>5.</enum><header>Effect of

			 Act</header>

			<subsection id="H9CD5434ADB6545CD929542DCD4955903"><enum></enum><text>Nothing in this

			 Act affects any authority or program of a Federal or State agency in existence

			 on the date of enactment of this Act.</text>

			</subsection></section><section commented="no" id="H5DCF64E18C3D45DE8001DB5204A7F8F"><enum>6.</enum><header>Sense of

			 Congress</header><text display-inline="no-display-inline">It is the sense of

			 Congress that the Administrator should establish a national drinking water

			 standard for perchlorate as soon as practicable after the date of enactment of

			 this Act.</text>

		</section><section id="HBDDAC11EA69B4EB1B76C3F23CE7652A6"><enum>7.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There is

			 authorized to be appropriated to carry out this Act $58,000,000, to remain

			 available until expended.</text>
