<legis-type>A BILL</legis-type> 
<official-title>To amend the Family and Medical Leave Act of 1993 to allow employees to take, as additional leave, parental involvement leave to participate in or attend their children’s and grandchildren’s educational and extracurricular activities and to clarify that leave may be taken for routine family medical needs and to assist elderly relatives, and for other purposes.</official-title>

<section section-type="section-one" id="H33DB7F0D910D4DF48FF9DC78F4C9B456" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family and Medical Leave Enhancement Act of 2005</short-title></quote>.</text></section> 
<section id="HE629B255E7B841AAAC3C5921E28392B"><enum>2.</enum><header>Eligible employee</header><text display-inline="no-display-inline">Section 101(2)(B)(ii) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611(2)(B)(ii)</external-xref>) is amended by striking <quote>less than 50</quote> each place it appears and inserting <quote>fewer than 25</quote>.</text></section> 
<section id="HE196A13F43A745269F00A53DADA6AF44"><enum>3.</enum><header>Additional entitlement to leave for parental involvement</header> 
<subsection id="H18534CFC74844AEBB359B700CC395E75"><enum>(a)</enum><header>Leave requirement</header><text>Section 102(a) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H27AD90893AC3469689A43EE7859512FE"><enum>(3)</enum><header>Entitlement to additional leave for parental involvement</header> 
<subparagraph id="HEC8B10D88ADD42F3A26CB700E8252437"><enum>(A)</enum><header>In general</header><text>Subject to section 103(f), in addition to leave available under paragraph (1), an eligible employee shall be entitled to a total of four hours of leave during any 30-day period, and a total of 24 hours of leave during any 12-month period to participate in or attend an activity that—</text> 
<clause id="HEB9CD46FFC7347AFB6D783D7A219058E"><enum>(i)</enum><text>is sponsored by a school or community organization; and</text></clause> 
<clause id="H630F4D996C0E4D98AE01293E94506B88"><enum>(ii)</enum><text>relates to a program of the school or organization that is attended by a son or daughter or a grandchild of the employee.</text></clause></subparagraph> 
<subparagraph id="H7F16229AA9B14F77851F6472A5D3E580"><enum>(B)</enum><header>Definitions</header><text>As used in this paragraph:</text> 
<clause id="HCB912C86B73648B5A4C200F8BBB2378F"><enum>(i)</enum><header>School</header><text>The term <term>school</term> means an elementary school or secondary school (as such terms are defined in the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>)), a Head Start program assisted under the <act-name parsable-cite="HSA">Head Start Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), and a child care facility licensed under State law.</text></clause> 
<clause id="HF12A04CD30C1440DB9DC77DF5D6684B"><enum>(ii)</enum><header>Community organization</header><text>The term <term>community organization</term> means a private nonprofit organization that is representative of a community or a significant segment of a community and provides activities for individuals described in subparagraph (A) or (B) of section 101(12), such as a scouting or sports organization.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9300623E6B97402C94F963C33B005D02"><enum>(b)</enum><header>Schedule</header><text>Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the second sentence the following new sentence: <quote>Leave under subsection (a)(3)(A) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection> 
<subsection id="HC95F98FF22FB4F289B5C6B7CE43CA661"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 102(d)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(A)</external-xref>) is amended by inserting after <quote>subsection (a)(1)</quote> the following: <quote>or under subsection (a)(3)(A)</quote>.</text> </subsection> 
<subsection id="HA944177CDF1C40078B910200354C78E0"><enum>(d)</enum><header>Notice</header><text>Section 102(e)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)(1)</external-xref>) is amended by adding at the end the following new sentence: <quote>In any case in which an employee requests leave under subsection (a)(3)(A), the employee shall provide the employer with not less than seven days’ notice, before the date the leave is to begin, of the employee’s intention to take leave under such subsection.</quote>.</text></subsection> 
<subsection id="H5837759DC6174B94A6A663CDA7923B4F"><enum>(e)</enum><header>Certification</header><text>Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H0639190E44484AE7BFB41CD6FC354053"><enum>(f)</enum><header>Certification for parental involvement leave</header><text>An employer may require that a request for leave under section 102(a)(3)(A) be supported by a certification issued at such time and in such manner as the Secretary may by regulation prescribe.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HC47CB5E419DE494B9F6F23B5D0637518"><enum>4.</enum><header>Entitlement to leave for civil servants for parental involvement</header> 
<subsection id="H084DCDDDE8434194BFB64F00E92BFB97"><enum>(a)</enum><header>Leave requirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382(a)</external-xref> of title 5, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph indent="up1" id="H36E79569D6684515878DB477545D7720"><enum>(3)</enum> 
<subparagraph display-inline="yes-display-inline" id="HA9636C6730434162B2C0AEC28E4C9987"><enum>(A)</enum><text>Subject to section 6383(f), in addition to leave available under paragraph (1), an employee shall be entitled to a total of four hours of leave during any 30-day period, and a total of 24 hours of leave during any 12-month period to participate in or attend an activity that—</text> 
<clause indent="up1" id="H71698E6B34E64A509B621BEC8CB07F67"><enum>(i)</enum><text>is sponsored by a school or community organization; and</text></clause> 
<clause indent="up1" id="HDB4CD15472F24313B5B3FDDEF4876E01"><enum>(ii)</enum><text>relates to a program of the school or organization that is attended by a son or daughter or a grandchild of the employee.</text></clause></subparagraph> 
<subparagraph indent="up1" id="HEAC9166465324A32B0D047865E840024"><enum>(B)</enum><text>For the purpose of this paragraph:</text>

<subsection id="H5FFD292BC1384B318CC7CCBCB0A87D12"><enum>(b)</enum><header>Schedule</header><text>Section 6382(b)(1) of such title is amended by inserting after the second sentence the following new sentence: <quote>Leave under subsection (a)(3)(A) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection> 
<subsection id="HD3C420755BCB4EB1ABCD504279B215D"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 6382(d) of such title is amended by inserting before <quote>, except</quote> the following: <quote>, or for leave provided under subsection (a)(3)(A) any of the employee’s accrued or accumulated annual leave under subchapter I for any part of the 24-hour period of such leave under such subsection</quote>.</text></subsection> 
<subsection id="H57EC11121F2640728B66764D30E1BCA3"><enum>(d)</enum><header>Notice</header><text>Section 6382(e)(1) of such title is amended by adding at the end the following new sentence: <quote>In any case in which an employee requests leave under subsection (a)(3)(A), the employee shall provide the employing agency with not less than seven days’ notice, before the date the leave is to begin, of the employee’s intention to take leave under such subsection.</quote>.</text></subsection>

<subsection id="HBD249C3BB7D8494CAAFB215DF36388C6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) and <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382(a)(1)</external-xref> of title 5, United States Code, are each amended by adding at the end the following new subparagraphs:</text>

<subparagraph id="H0285E76BE8264F45AB9E4820CE4090CC"><enum>(E)</enum><text>In order to meet routine family medical care needs, including transportation of a son or daughter or a grandchild for medical and dental appointments for annual checkups and vaccinations.</text></subparagraph> 
<subparagraph id="HD202E699A2674048BA2C8CD14882DA27"><enum>(F)</enum><text>In order to meet the routine family medical care needs of elderly individuals who are related to the eligible employee, including visits to nursing homes and group homes.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<subsection id="H4C357D15B4A747EBB426292978053CB6"><enum>(a)</enum><header>Non-civil-service employees</header><text>Section 101 of the Family and Medical Leave Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is amended by adding at the end the following new paragraph:</text>

<subsection id="H517BF6AEF3774C2394B875AA0628BD08"><enum>(b)</enum><header>Civil service employees</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6381">Section 6381</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="HFC948A49E12D49969E56D4AA7F1CCC61"><enum>(1)</enum><text>in paragraph (5)(B), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H6AAB587E0B634768AC6FA2647BF231BC"><enum>(2)</enum><text>in paragraph (6)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HDE012CA6936F4340A8C48D61D5E9906"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
