<legis-type>A BILL</legis-type> 
<official-title>To establish a student loan forgiveness program for members of the Sudanese Diaspora to enable them to return to southern Sudan and contribute to the reconstruction effort of southern Sudan.</official-title>

<section id="H4320AACCE1234A7FBA2B9DEB91D168E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sudanese Diaspora Loan Forgiveness Act</short-title></quote>.</text> </section> 
<section id="H8F71FB0214B3435B9EF94B2C15FBDEB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H8E6887D079654DD28E2B0965B65F6F33"><enum>(1)</enum><text>The 21-year civil war between the North and the South in Sudan caused many Sudanese people to flee their homeland and seek refuge in other countries, including the United States.</text></paragraph> 
<paragraph id="H70529BC3FFC94E418E849EAC03FF9C5"><enum>(2)</enum><text>The United States has assisted many Sudanese citizens fleeing the violence in their homeland, including the Lost Boys in 2001, a group of approximately 3,800 children that were separated from their parents during the civil war and who fled on foot to Ethiopia, walking more than 1,000 kilometers on the four-month journey, and who then fled again to Kenya to avoid forcible repatriation to Sudan.</text></paragraph> 
<paragraph id="HCB0988CE89C04A0786D98F7528FB4E7E"><enum>(3)</enum><text>Approximately 5,640 Sudanese citizens have been granted refugee status in the United States in Fiscal Years 2003 and 2004 alone.</text></paragraph> 
<paragraph id="HBAC56FF438D4405F89B400051F6915B6"><enum>(4)</enum><text>The National Congress Party Government and the Sudanese People’s Liberation Movement (SPLM) signed the Comprehensive Peace Agreement in Nairobi, Kenya, on January 9, 2005, formally ending the conflict between the North and the South and creating a new Government of Sudan that consists of a coalition of opposition groups and the former regime.</text></paragraph> 
<paragraph id="H83C9E2FB19244B088894DAA305447B9"><enum>(5)</enum><text>With the signing of the Comprehensive Peace Agreement in Nairobi, Kenya, on January 9, 2005, the Government of Southern Sudan’s plans for reconstruction in Southern Sudan are moving forward.</text></paragraph> 
<paragraph id="HD649747730044AA50000AF048884B0C4"><enum>(6)</enum><text>Sudanese refugees in the United States have acquired a reputation for being an extremely resilient group, and a number of them have, after adjusting to a new life in the United States, chosen to pursue a higher education, and now have professional skills to contribute to the rebuilding of their homeland.</text></paragraph></section> 
<section id="H3D2071CCDF0142B2AEB48561021D7059"><enum>3.</enum><header>Establishment of program</header> 
<subsection id="HC19F54CC3D254B2800E2486F659C173D"><enum>(a)</enum><header>Stafford loans</header><text>Part B of title IV of the Higher Education Act of 1965 is amended by inserting after section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) the following new section:</text>

<section id="HA2199BDF7FE84EFFBA456774EA4DA5D4"><enum>428L.</enum><header>Loan forgiveness for members of the sudanese diaspora</header> 
<subsection id="HA3A4AC232CA54A5E8265449925CEBF67"><enum>(a)</enum><header>Statement of purpose</header><text>It is the purpose of this section to encourage members of the Sudanese Diaspora in the United States to return to Southern Sudan for purposes of contributing to the reconstruction efforts there.</text></subsection> 
<subsection id="H7B3859DDCDD24227B9D0F963B3A32807"><enum>(b)</enum><header>Program authorized</header><text>From the amount appropriated under subsection (f) for any fiscal year, the Secretary of Education shall, in accordance with subsection (c) and in consultation with the Secretary of State, carry out a program, through the holder of the loan, of assuming the obligation to repay a qualified loan amount for a loan made under section 428 or 428H for any borrower who—</text> 
<paragraph id="H94AC979B6DFB4C7DBDFEE2661F2D5008"><enum>(1)</enum><text display-inline="yes-display-inline">as of the date of the enactment of this section, is a Sudanese citizen who—</text> 
<subparagraph id="H2C1855DCE0AC41E2A9B09C5E9D0000F2"><enum>(A)</enum><text>has been granted refugee or asylum status in the United States;</text></subparagraph> 
<subparagraph id="H78F7450525E041E4B3347D0097A59BFC"><enum>(B)</enum><text>has been granted lawful permanent resident status in the United States; or</text></subparagraph> 
<subparagraph id="H33BCCC2F4FC64EAC9EF6CAD764B1F2A2"><enum>(C)</enum><text>is a naturalized United States citizen;</text></subparagraph></paragraph> 
<paragraph id="H08D49E8922A647308685ADEA06846C19"><enum>(2)</enum><text display-inline="yes-display-inline">commits to returning to Southern Sudan for a period of five or more years for purposes of contributing professional skills to repairing the damage to the infrastructure of Southern Sudan caused by the Sudanese civil war, as approved by the Secretary for purposes of this section; and</text></paragraph> 
<paragraph id="H5686EB989BEC43BABEE98E53E885B6FA"><enum>(3)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></paragraph></subsection> 
<subsection id="H0AD4320DFC874A0992A60742670058D6"><enum>(c)</enum><header>Qualified loans amount</header> 
<paragraph id="H69F3F22E28FC4EC58D89B8882B7B9739"><enum>(1)</enum><header>In general</header><text>Of the aggregate of the loan obligation on a loan made under section 428 or 428H that is outstanding to an individual who meets the requirements of subsection (b), the Secretary may, from funds appropriated under subsection (f), repay not more than—</text> 
<subparagraph id="HA9B4C5AB6ABC43FE885E9CC1C5A0AB25"><enum>(A)</enum><text>$3,000 after the first calendar year of service described in subsection (b)(2);</text></subparagraph> 
<subparagraph id="HD69D93B17479468AB77FE7F698C3B02"><enum>(B)</enum><text>$4,000 after the second such year of service;</text></subparagraph> 
<subparagraph id="HD983BBF1DA6C424AAEE4006030E8B238"><enum>(C)</enum><text>$5,000 after the third such year of service;</text></subparagraph> 
<subparagraph id="HD431DBD3D0CE45B6A3ECD66800F76ED3"><enum>(D)</enum><text>$6,000 after the fourth such year of service; and</text></subparagraph> 
<subparagraph id="H058D9B39055543B894E6EB8E2028318F"><enum>(E)</enum><text>$7,000 after the fifth such year of service.</text></subparagraph></paragraph> 
<paragraph id="H64B48DDC4FB9417E80C5BBA0C474A589"><enum>(2)</enum><header>Award basis</header><text>The Secretary shall make payments under this subsection on a first-come first-served basis, subject to the availability of appropriations.</text></paragraph></subsection> 
<subsection id="HD33082C4FEBD48F3A97FB6F37A72ED3"><enum>(d)</enum><header>Additional provisions</header> 
<paragraph id="H75ED76C9881D47E19CCCC624C3FD20E9"><enum>(1)</enum><header>Treatment of consolidation loans</header><text>A loan amount for a loan made under section 428C may be a qualified loan amount for the purposes of this subsection only to the extent that such loan amount was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a loan made under section 428 or 428H for a borrower who meets the requirements of subsection (b), as determined in accordance with regulations prescribed by the Secretary.</text></paragraph> 
<paragraph id="HBF23B7C9BB6B4A5BB1C7DECED8053CB"><enum>(2)</enum><header>Double benefits prohibited</header><text>No borrower may receive a reduction of loan obligations under both this section and section 460A.</text></paragraph></subsection> 
<subsection id="HC4384122C579407DBA357BEA619EF640"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with the Secretary of State, issue such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="H387A98CBE25A47269E7EA20961C8E5D1"><enum>(f)</enum><header>Construction</header><text>Nothing in this section shall be construed to authorize any refunding of any repayment of a loan.</text></subsection> 
<subsection id="HCAF48AE200C543189ED5A6374086D069"><enum>(g)</enum><header>Authorization of Appropriations</header><text>For fiscal year 2006 and for each of the 5 succeeding fiscal years, there are authorized to be appropriated such sums as may be necessary to repay loans in the amounts specified in subsection (c)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEBA3B2BA41EB49C1A0C16D48A0D6D01E"><enum>(b)</enum><header>Direct loans</header><text>Part D of title IV is amended by inserting after section 460 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j</external-xref>) the following new section:</text>

<section id="H0C76ED73E84A461C983FDB1805072831"><enum>460A.</enum><header>Loan forgiveness for members of the sudanese diaspora</header> 
<subsection id="H5AD4183AB00F44D99B1CAE51EC00D509"><enum>(a)</enum><header>Statement of purpose</header><text>It is the purpose of this section to encourage members of the Sudanese Diaspora in the United States to return to Southern Sudan for purposes of contributing to the reconstruction efforts there.</text></subsection> 
<subsection id="H0619F4A45CBF4B15A2C58CBF15FB20F8"><enum>(b)</enum><header>Program authorized</header><text display-inline="yes-display-inline">From the amount appropriated under subsection (f) for any fiscal year, the Secretary of Education shall, in accordance with subsection (c) and in consultation with the Secretary of State, carry out a program of canceling the obligation to repay a qualified loan amount in accordance with subsection (c) for Federal Direct Stafford Loans and Federal Direct Unsubsidized Stafford Loans made under this part for any borrower who—</text> 
<paragraph id="HE81983803B1E4979B532C0C3D4FC287F"><enum>(1)</enum><text display-inline="yes-display-inline">as of the date of the enactment of this section, is a Sudanese citizen who—</text> 
<subparagraph id="HB0213884C71040AA9B9626F11FD616D2"><enum>(A)</enum><text>has been granted refugee or asylum status in the United States;</text></subparagraph> 
<subparagraph id="H6351F6BE5ACF48028C687DE68E91EBE"><enum>(B)</enum><text>has been granted lawful permanent resident status in the United States; or</text></subparagraph> 
<subparagraph id="H37EE0A97420E460FAACCF70001407C03"><enum>(C)</enum><text>is a naturalized United States citizen;</text></subparagraph></paragraph> 
<paragraph id="HF76429B18C1E4FC6AFCC90008F82BDE9"><enum>(2)</enum><text display-inline="yes-display-inline">commits to returning to Southern Sudan for a period of five or more years for purposes of contributing professional skills to repairing the damage to the infrastructure of Southern Sudan caused by the Sudanese civil war, as approved by the Secretary for purposes of this section; and</text></paragraph> 
<paragraph id="H8CE7AC1A298044CE9E465D0690522119"><enum>(3)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></paragraph></subsection> 
<subsection id="HDB797C8942D44CF5BF0915739638C227"><enum>(c)</enum><header>Qualified loans amount</header> 
<paragraph id="H50ECC44AC9354E5EA8690085E138AEF6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Of the aggregate of the loan obligation on a Federal Direct Stafford Loans and Federal Direct Unsubsidized Stafford Loan that is outstanding to an individual who meets the requirements of subsection (b), the Secretary may, from funds appropriated under subsection (f), repay not more than—</text>

<subparagraph id="H86627EF4322A4486B5E9551252009E00"><enum>(D)</enum><text>$6,000 after the fourth such year of service; and</text></subparagraph> 
<subparagraph id="H4321BF173A104A74848752B436DD91F1"><enum>(E)</enum><text>$7,000 after the fifth such year of service.</text></subparagraph></paragraph> 
<paragraph id="H89E9B83C0C5E4E4FBD5D30441E603C99"><enum>(2)</enum><header>Award basis</header><text>The Secretary shall make payments under this subsection on a first-come first-served basis, subject to the availability of appropriations.</text></paragraph></subsection> 
<subsection id="HF0BB7F99D0D84A1ABCBD36FCD4E0463"><enum>(d)</enum><header>Additional provisions</header>
